Hank Williams Junior’s Free Speech Violated? Give me a Break… it was Business doing what is best for Business

Back when I was in college I did something incredibly stupid simply because I thought that I was being funny. I had a part time job as a Peer Counselor with the Educational Opportunity Program. The program was to help kids from poor families with not so great educations get a chance at college. Some kids did well and others didn’t. My wife Judy was a student in the University’s program for Deaf and Hard of Hearing Students. The office that ran the deaf program was called Support Services for Deaf Students or simply SSDS.

Judy had a roommate named Kendra and the three of us came up with some pretty sick jokes. In fact I learned sign language more to tell jokes with Kendra more than any other reason. Since Judy was “just hard of hearing” I used some sign with her but mostly to help her understand in difficult situations as for the most part she functioned as a hearing person despite having a 77% hearing loss. Judy is also an artist and a cartoonist. One day we came up with a fake flyer for a parody of SSDS. We called it Support Services to Dead Students. Judy did the drawing and all would have been well had I not gotten the less than brilliant idea to “spam” the flyer out. Now this was way before e-mail and Facebook or any other social media. So I went to a copy store and made about 50 copies and took them to work. I put them in messenger envelopes and sent them to most school departments through the internal school mail system. I thought that it was hysterical and I must have let slip to someone that I had pulled this off this prank. Anyway a couple of days later I was called into my boss’s office and was told by him that he knew that I did it. He felt that it was deeply offensive and that I could resign or be fired. I ended up resigning and my boss was grateful. To be truthful it had nothing to do with the EOP students we were poking fun at the deaf students. Yes it was still crass and insensitive but I didn’t think that I would lose my job over it. I thought that it was a funny parody. My employer didn’t.

I learned a hard lesson. No matter how funny I thought that my parody was that it didn’t mean that my employer had to keep me on. What I did embarrassed my department and paid the price for it. Was anyone harmed? No. Was it malicious? No. Could it be interpreted in ways that I didn’t intend it to be? Yes. Did it reflect on my lack of judgment? Yes. Did my boss have a right to terminate me? Yes. Did I learn? Most of the time.

Now of course Hank Williams Jr. made a complete ass of himself on Fox and Friends Monday morning. Not only did he compare President Obama with Hitler but he went into a rant that just made him look like an angry idiot. He called Obama “the enemy” and in making the Hitler comparison really made light of the Holocaust. There is little that any American politician on the right or the left can do to be compared with Hitler. Even his Fox friends who are not known for their love of Obama looked really uncomfortable as Hank ranted on.

Now to get things right I will defend people’s free speech rights and I don’t have to agree with them. If one decides to compare any American President with Adolf Hitler Joe Stalin, Pol Pot or the Ayatollah Khomeini he or she can say it without fear of being prosecuted by the State for doing so and if he is I will defend his right to that speech, even if I think it is hateful. It may be hateful and ignorant to do what Hank did but there is no law against it and if he was prosecuted for it by the government I would defend his Free Speech rights.

That being said if one is the face of Monday Night Football as Hank was ESPN then there are risks to acting like an idiot. The producer of that show and the NFL had a right to end his relationship with the show. It is about business, other companies with that advertise on Monday Night Football don’t want to be linked to the “H” word. If they had not ended the relationship it would have been bad for business.

Let’s face it using the Hitler analogy tends to get people fired and it is not about free speech it is about business. There are probably hundreds if not thousands of “conservative” commentators, bloggers and journalists who have made the Hitler analogy frequently on the internet and in print. It is protected Free Speech. In fact when George W. Bush was President left wing bloggers and columnists frequently played the Hitler card against him. . However none of them were the face of Monday Night Football and generally they work for employers that make money by criticizing Obama and the Democrats or Bush and the Republicans so they keep their jobs. Remember each business determines what is good for their business. Monday Night Football decided that Hank was now bad for business.

Hank is now saying that he decided to leave Monday Night Football “with his rowdy friends.” He said that what happened to him was a violation of his free speech rights. Now it seems like most people with the exception of Hank and Sean Hannity think that ESPN was within its rights to end their relationship with Hank. If I recall one of the key conservative tenants is that employers are the ones that set the conditions for employing people. The right to hire and fire at will is something that conservatives and Libertarians love. Firing and shunning celebrities for doing stupid, ignorant or hateful things or even for benign associations is a sport in this country if a business deems the celebrity’s actions bad for business.

Let’s just go back 50-60 years, the McCarthy hearings and the Hollywood “blacklist” which tarred and feathered many actors, directors and others involved in the film industry being associated with the Communists or other unpopular causes at some point in their life, even if they had renounced that association. Those people were not allowed to work, many for years simply because their loyalty to the country which had nothing to do with their acting abilities was questioned and producers fearing audience backlash simply blacklisted them. Some of the many people blacklisted included Orson Welles, Burgess Meredith, Eddie Arnold and Edward G. Robinson.

Then there was an actress named Hanoi Jane Fonda, daughter of Hollywood icon Henry Fonda who had the dumb ass idea to go to North Vietnam, make anti-American and anti-war statements and be photographed on an anti-aircraft gun within a mile or so of the Hanoi Hilton POW camp. She couldn’t get work for several years and when she did start working again, many people, me included boycotted her films and I still won’t watch them. She was able to say what she wanted but she suffered the consequences and is still one of the most hated Hollywood celebrities in conservative circles.

There are so many other examples where celebrities have been fired or shunned because of their actions. Here are a few:

Gilbert Gottfried: Tsunami jokes got him fired as the voice of the Aflack Duck.

Megan Fox: Canned from Transformers due to Hitler remarks.

Madonna: Fired from her Pepsi sponsorship when the American Family Association boycotted Pepsi after Madonna released her controversial “Like a Prayer” music video.

Michael Phelps: After getting caught smoking dope was dropped by Kellogg’s Corn Flakes and Frosted Flakes.

Mel Gibson: He was shunned after making anti-Semitic comments during a DUI arrest. His career has not been the same since.

Whoopi Goldberg: The Sister Act star got canned from her Slim Fast spokesperson job when she made double entendres about President George Bush at a John Kerry fund raiser. She was also shunned by Kerry after it.

Sharon Stone: Dropped by Christian Dior inChina for suggesting that Chinese earthquakes were caused byChina’s treatment of Tibet.

The Smothers Brothers: Their hit comedy was cancelled by CBS for their controversial statements about racism,Vietnam and politics.

The Dixie Chicks: While touring “Old Europe” the country singers lashed out at President Bush and the Iraq War. They were not fired but lost a huge number of fans in the process. The fans shunned them. They lost money and have not regained their former popularity.

The list can go on but I think I make my point. If people want to claim that business are free to do as they please and hire and fire people for whatever reason they deem fit on one hand, then they shouldn’t that their Free Speech rights are being violated. It is a two way street. Think about it. If you are a business owner or in management and one of your employees does something that you think reflects badly on your business and may hurt your business would you fire them? You bet your ass you would and it doesn’t matter for what reason politics, religion or even your sense of humor.

What old Hank did was so stupid it defies imagination but he could say it. Fox didn’t cut away as he shot off his mouth, he wasn’t censored. While his words and tenor were unbelievably stupid they were not illegal. However I don’t blame ESPN for firing his sorry ass. Hank is no victim of political correctness he shot his own balls off and I don’t care if he works ever again or he overcomes this and his career recovers. However, he can say what he wants and believe what he wants and if he was prosecuted by the government for voicing those beliefs I would defend his Free Speech rights. But that is not the case here.

Now I do have a lot of strong feelings about the often capricious ways that businesses use their liberty to mistreat or silence workers for speaking their political and religious beliefs in the workplace. However if one wants to say that businesses should be free to do what they want to increase profits and market share without government interference then one has to expect that businesses will do best for business. Profit and not Free Speech is their number one concern. Many celebrities and ordinary citizens have found this out before Hank; he can just join the club. Heck, I’m no celebrity but it happened to me too… boo hoo Hank. Boo hoo. I’ll cry in my beer with you. Wow that rhymed.

Return to the Great Montana Dude Ranch Sleepover: Padre Steve’s Cure to Politics as Usual

I wrote this about a year ago and after the fiasco that we have endured during this long and all too painful year think that it is time to revisit the topic. Since I have been rather morose of late I figure that this should break things up a bit.

I don’t know about you but as a passionate moderate I am fed up with the nasty politics as usual that is killing our country. Our political ruling class appears to be hell bent on destroying the country all to satisfy their respective need for power and to satisfy the basest wants of their most strident supporters. The corruption and malevolence of the career politicians on both sides of the aisle have bankrupted the country, cost American lives in war, cost American jobs, destroyed our manufacturing base, placed the interests of financial traders who produce nothing except promote the evil practice of usury because it makes them money which they in turn contribute copious amounts of said money to their political patrons. Then to top it all off they pass laws that make no sense and that you have to have an army of lawyers to understand. They are out of touch with the everyday concerns of real Americans and have done their best to destroy the fabric of our society in their quest for power and they are many times an unseemly lot who do things that regular people could never get away with. The number of ethics violations, criminal charges and convictions and resignations due to shady financial dealings, backroom deals, sexual scandals and sometimes rather nasty criminal cases are too numerous to catalogue unless you are Matt Drudge. I won’t list them here but they include notable Democrats as well as Republicans, nor will I go into all the idiotic things that our government, both Democrat and Republican controlled administrations or congresses have done as the task would be ginormous. Since we all get spun up about different issues usually in tune with our own political or social viewpoints I leave it to you my readers to fill in the blanks and comment on what you think they are screwing up.

Part of the problem is that our political ruling class, the Federal Government particular is completely out of touch because they live in the netherworld ofWashingtonD.C. This city has become the symbol of all that ails the country and since our political class only leaves it to raise money for their next campaigns they have no earthly clue of what the rest of us are experiencing. Thus they can coddle up to their big financial supporters and most demented party extremists and unseemly lobbyists representing some of the vilest elements of our society. As a result for at least the past 10 years and I am sure a lot more they have for the most part forgotten the people that they are supposed to represent. The political class doesn’t live in our world, thus they do everything that they can not to look at what is best for the country but rather what is best for them, for their party, their supporters and their agendas. If you ask me its all out of whack and they really all should be whacked.

Since they all spend far too much time inWashingtonor raising money to stay there it is high time that they get out of Dodge so to speak. This is my idea of how we fix this situation. My suggestion is definitely not politics as usual. Instead it is based on relationships built from shared suffering and since we are suffering why shouldn’t they suffer too? So here’s my idea. First we shut down the government for a month. Now before you think that you won’t get what the government owes you I don’t mean the people that actually do the work. What I mean is both houses of Congress, the White House and the Supreme Court. We shut them down. Let the clerks of the court do their thing, let the White House staff do its job and congressional aides deal with constituents. Give the Russians and Chinese, the Iranians, Al Qaida, the European Union and everyone else a message that we’re busy the next month so don’t bother us. We’ll tell them that if they mind their own business that our stand ins with itchy fingers won’t nuke them. where is Al Haig when you need him the most? Hey MAD (mutual assured destruction) worked during the Cold War, after all nothing like an ICBM loaded with multiple nuclear warheads to keep people in line and not do anything really stupid.

So do you hear me Mahmoud and Osama? Do you hear me? All that would come between you and nuclear annihilation are a few disgruntled civil servants with road rage that just got to work after being stuck in Beltway traffic for 3 hours. Go ahead make our day.

Once we shut the place down we put all of these guys and gals on Greyhound buses packed to the gills. Each bus would have a mix of members of each party really making sure those that hate each other most sit next to each other. Secret Service and FBI agents on the buses would have the option to Taser anyone that tries to switch seats. Then we drive them all to some big assed dude ranch inMontana, outfit them in silly looking cowboy clothes with boots that are a bit too tight and leave them there in the charge of a bunch of cowboys at least two of which have had a recent “BrokebackMountain” experience.

They would have no cell phones, computers or communications with the outside world or even their minions back in D.C., nope, just them and Mother Nature sharing the experience of high plains living. In fact to liven the place up we need to bring a few folks back into the mix, some former Presidents and Speakers of the House would do fine. Also the addition of the most strident Cable TV and radio talking heads and commentators would be good too, but I digress, too many extras might spoil the moment. Maybe we should have a separate sleepover of Rush Limbaugh and Maureen Dowd or Sean Hannity and Keith Olberman later? No, we’ll throw them into this one to make it more fun.

This dude ranch living would be a bit Spartan. Since most of these folks a Spartan way is driving in a luxury car or SUV, having to fly First Class, staying in a luxury suite or eating at a 4 star restaurant they might have a hard time with what I propose but that would just be tough. They made this mess and by God we’re going to get them back in touch with the real world and in the process get them to build real relationships with each other instead of the artificial life that they have led inside the beltway for years.

Once we get them to the big assed Dude Ranch we pair them up the best we can with a liberal and a conservative in each cabin. We would try to keep the cabins of the same gender not to cause too much scandal but would make a few exceptions to that rule. Now by cabins I don’t mean those really nice cabins that people take real vacations at, no I mean really rustic, Spartan tiny cabins with no amenities and only one bed, a full sized bed that our new roommates would need to share. The cabins would have no couches, easy chairs or love seats, no sleeping bags not even a bearskin rug, nope nothing else but the bed. They would have a rather rustic communal outhouse to share with everyone else over a deep pit latrine and share their meals in a rather dilapidated chow hall eating off of tin plates and drinking from tin cups. There would be a camp saloon but it would be like those of the old west, nothing but rotgut whisky, no mixed drinks, no foo-foo appetizers, no micro-brew beer. They would sleep together, eat together and have to participate in trail rides, fly fishing, Grizzly Bear hunting, rodeo events such as bull riding and calf roping as couples, odd couples, but couples nonetheless. This togetherness would be enforced. Those Secret Service and FBI agents with their tasers… they’ll be out there too. Anyway when our leaders go on the overnight trail rides the fun really starts. After they eat their beans from tin plates, sing really bad western songs and take a swig or two or more of rotgut whiskey and then relieve themselves in the manner that the cowboys did in the old West they would get to curl up together in their own two person pup tent, a really small one and spoon. This would help break down the walls that separate them and force them to get to know each other, some possibly in the Biblical sense of the word, but in the spirit of Don’t Ask Don’t Tell I won’t go there.

There is something about shared suffering to bring people together and make them realize that there is more to life than their own narcissistic agendas and power trips. No this wouldn’t be prison for them as much as a lot of Americans think that prison would be fitting for them; prison is far too easy for our political class. Instead this would build character, character that if once they had they lost over their years inside the Beltway.

Of course they would not get to pick their room-mates so here are some of my suggestions:

President Obama and Rush Limbaugh: I know I said that the media should have their own version of this but since Limbaugh is the leader of the conservative movement he has to come and buck with his pal Barry.

Harry Reid and Orrin Hatch: They’re both Mormons so they can at least pray together.

Chief Justice John Roberts and Rachel Maddow: I don’t know it just sounds right.

Nancy Pelosi and Antonin Scalia: Sure it’s an opposite sex pairing but they are both Italians they should have fun.

Tom Tancredo and Janet Napolitano: Let’s make a run for the border and mend some fences together

Russ Feingold and Ron Paul: Government control and Libertarianism two great tastes that go great together

John Ensign and Barbara Boxer: He can’t seem to hold it in and she looks like that she could use some loving

Al Franken and Clarence Thomas: A comedian and a straight man…what a combination

John Kerry and John McCain: Both Vietnam Veterans, they understand the value of camaraderie

Mitch McConnell and Chuck Schumer: The just look like they need to be together

Diane Feinstein and Michael Savage: ASan Francisco treat

Barbara Milkulski and Kay Bailey-Hutchinson: Why not?

Joe Lieberman and Tim Pawlwnty: Not opposites but they seem to go together

Unfortunately some of our more interesting members of our political class have passed on I would have loved to throw Teddy Kennedy, Robert Byrd, Jesse Helms, Ronald Reagan and any number of others into the mix, but what can I say?

So after 30 days our political elites would board their buses and go back to their home districts or home towns. Then they would have some real town meetings as couples, holding hands, looking dreamily into each other’s eyes and bringing peace to the political landscape. With those pesky Secret Service and FBI agents and their tasers at the ready our leaders would have to listen to their constituents and not the lobbyists. Speaking of lobbyists they all get sent toNew Guinea. As for the Congressmen and Senators they and their new found friends would have to spend 8 months a year living in their home state or district. The would give up their palatial estates in favor of homes that are in the median real estate price for their area. They would send their kids to public schools, go to PTA meetings, coach little league or soccer, deal with local government officials as the rest of us are forced to do. They would have to do their own grocery shopping, fight lines at Wal-Mart, take out their own garbage and spend time sitting in traffic behind the wheel of their average car or SUV. They would fly coach or business class and go through the TSA checkpoints like the rest of us, maybe even getting the full body scan once in a while. They would sit in the drive through line at Wendy’s, make a run for the border, Taco Bell that is and shop for the lowest priced gasoline. The four months that they spend inWashingtonDCwill be devoted to actually fixing things that they have fouled up over the years. They would have to pass non-pork laden budgets passed, reduce the deficit and do everything that they can to bring industry back into this country, rebuild the manufacturing base, protecting the environment as they rebuildour nation’s infrastructure and eliminate the barriers that keep small businesses and entrepreneurs from developing solutions to the challenges that face the country. Likewise they would need to repeal all of the draconian laws that intrude on the everyday life of ordinary Americans. I want the Federal government out of our churches, out of our local public schools, out of our bedrooms and out of everything that they don’t belong in. Freedom baby, I love it.

Finally just to make sure that our now properly schooled public servants don’t forget the lessons of the Great Montana Dude Ranch Sleepover they would for two weeks each year have to do this again. Maybe it could be a trail ride inTexasandOklahoma, a swamp safari inLouisianacomplete with no mosquito repellent. Perhaps a winter camp out at the Donner Pass, a gang- reenactment camp in East L.A. or an Appalachian family get together, still building and moonshine making contest in some holler in West Virginia or Eastern Kentucky. The possibilities in our great country are endless after all learning should be a lifetime event.

Of course my pairings of political bedfellows may not work for you, maybe you have better ones. If so feel free to add them as a comment and on this one no pairing will be denied because it’s all about togetherness. Because as I see it everything comes down to relationships and if we can just get these folks out of Washington to share some hardship, to eat together, ride together and even spoon together after all who can’t say that they don’t feel closer to someone after spooning together?

Now before you think that I am advocating that they all have higgily-piggily sex together I am not. However if it does happen and they get right with each other and start to work together for us what can be wrong with it? Half have probably had nasty sex with people that aren’t their spouses anyway so what difference does it make? It would be a sacrifice that they make for us, their fellow Americans. I know that I don’t want to sleep with any of them and figure that you don’t either and I really don’t want to know what happens when they spoon. Don’t ask don’t tell baby, don’t ask don’t tell. Besides would you want to know what happens when Sean Hannity and Barney Frank spoon? I don’t. I’ll say it again, don’t ask, don’t tell that’s my rule for life.

If this works maybe just maybe that they will finally start looking to the issues that Americans care about. Maybe they will finally understand the desire that we all have to see our children grow up to have the opportunity to outdo us, that our children might have a better future and that the country that we live in would come together like we did in the Second World War to overcome all the obstacles that stand between us and a better future. Call me a genius or call me crazy, chalk it up to Mad Cow, after all I can’t give blood because I lived inEuropeand ate too much beef. But remember “Padre Steve” is a “Uniter” not a divider, a decider not a ditherer and a real American for real Americans.

Another Sign of the Apocalypse: No Number One Seeds Left in the NCAA Tournament

Signs of the Apocalypse?

Well my friends there are wars, rumors of wars, natural and unnatural disasters Iranian Ayatollahs proclaiming that the Mahdi is coming so Iran can beat the snot out of all the infidels and all the number one seeds eliminated before the Final Four. What a deal, the only things lacking for the great apocalyptic battle are the Cubs winning the World Series and a conspiracy theory website that purports that President Obama is actually a Vulcan with clipped ears, thus no birth certificate. Wow, I had just typed that when an advertisement for a nutty televangelist and his ditzy wife was aired while I was watching House hinting that Obama might be a Moslem, so be sure to watch them on Sunday.

Yes my friends it looks like the Four Horsemen, Dick Cheney, Nancy Pelosi, Oprah and Gilbert Gottfried, are mounting their steeds and preparing Trigger, Champion, Secretariat and Mr. Ed for the last rodeo. Things are getting serious all over the place. When showed Padre Steve that this was the case was not the wars or the natural disasters. No friends it was VCU killing off Kansas to ensure that no number one seeded team got in the Final Four this year. Of course Butler had killed off Pitt, Kentucky had killed off Ohio State and Arizona had killed off Duke. Since my bracket had gone to hell by the round of 32 and my last finalist North Carolina went Tango Uniform in the Elite 8 I couldn’t care less who actually won I just wanted no number ones in the Final Four, no number twos if possible and chaos to reign.

I got my wish when VCU took down Kansas yesterday and even though I had put North Carolina through to the Final Four I wanted Kentucky to win simply because they were a lower seed than the Tar Heels. When you come to think about the fact that no number one or two seeded teams are in the Final Four really is amazing. In fact it is the first time ever that no number one or number two seeds have made the Final Four. In 2006 and 1980 no number one teams made it but this is the first time ever that this has happened and this year the aggregate seeding of the Final Four Teams is lower than any Final Four ever. Three number three seeds have won the National Championship Florida (2006), Indiana (1981), Michigan (1989) and Syracuse (2003). Only one number four seed has won the National Title Arizona in 1997. Villanova is the only number eight seed to take the National Championship and that was in 1985. No number eleven seeds have ever reached the title game although George Mason (2006) and LSU (1986) did reach the Final Four.

Now just because this is the lowest seeding of Final Four teams does not mean that these are bad teams. Let’s face it UCONN is a major player as is Kentucky and Butler is no stranger to the Sweet 16 and Final Four getting into the title game last year. VCU is the real surprise because they were the last team chosen and had to win an extra game to get in the 64 team field.

This is also no real changing of the guard in College Basketball. With the exception of Richmond and VCU the teams in the Elite Eight were all big programs or in the case of Butler a team that was in the Final Four last year and is a quality program. While more VCUs and Butler’s may go deep in the tournament expect that the big programs will still be in the Final Four more often than not. I may want the little guys to be there all the time but that probably won’t happen but that doesn’t mean that I can’t cheer them on every year, heck I picked ODU to be in the Final Four but Butler took them out in the first round.

So the Four Horsemen have lined up, the world is all goofy but at least this Final Four field is no threat to the end of the world as we know it. So my picks for the National Championship, VCU against Kentucky and God only knows who wins that. As my Iraqi friends say, Inshallah.

My God What Happened? I’ve become a Civil Rights Advocate and I know Why

I don’t know what it is, maybe the Mad Cow or something but somehow and I don’t know how I have become a raging civil libertarian championing or supporting all sorts of causes that as a law and order conservative that I would never espoused. I have been so riled up lately about what is going on with the Transportation Security Agency because I have been accosted by them and practically strip searched while traveling in my Navy uniform on valid travel orders with proper military identification while foreigners wearing clothes that could hide a truck bomb passed through the checkpoint. That was back in 2003 before the current Grope on Site order was in place. This happened again in 2008 when coming home from Iraq. I think that it was those two instances that were the watershed for me.

When I was forced to remove my ribbons, rank, belt buckle and made to unzip back in 2003, or remove boots and belt buckle and uniform shirt less than an hour after returning from Iraq I knew that if the TSA was out of control, and that my dear readers was back in the days of the Bush administration. When I realized that the TSA was subjecting military personnel in uniform with proper ID and on orders to such ludicrous and humiliating searches that the police state was already here even if most people didn’t see the danger.

Evidently I am still in a minority as according to a CNN/Gallup poll 80% of Americans supported the TSA so long as “it made them safe.” Of course probably 60% of the poll respondents have not had the pleasure of being assaulted by the TSA since they don’t fly. It’s easy to support such practices if they don’t affect you.

I guess it is the repugnant Gestapo, STASI or KGB like invasive search methods that are nothing less than physical and sexual assault and battery that have turned me into a civil libertarian. It is the indictment of innocent citizens that only desire to travel by air and are forced to prove that they are not terrorists that bothers me. To see people with medical conditions and even children humiliated and even strip searched is abhorrent. It is even more so because despite the billions of dollars allotted to the TSA not a single terrorist has been apprehended by them and the new tactics are already being rendered obsolete by the terrorists that attacked us on 9-11-2001. With each year the TSA’s methods have grown more invasive and humiliating to average citizens whose only crime is travelling without any corresponding increase in air safety and security.

Unfortunately the tactics of the TSA will not change because no politician wants to get blamed if something does go wrong and we will find that our liberties will be stripped away one by one under the benevolent and watchful eye of government bureaucrats and officials empowered by ill conceived laws; laws that the vast majority of the legislators that voted for them never even read.

George Washington said it so eloquently “Government is not reason; it is not eloquence. It is force. And force, like fire, is a dangerous servant and a fearful master.” James Monroe was even more prophetic when he addressed the Virginia Ratifying Convention in 1788: “How prone all human institutions have been to decay; how subject the best-formed and most wisely organized governments have been to lose their check and totally dissolve; how difficult it has been for mankind, in all ages and countries, to preserve their dearest rights and best privileges, impelled as it were by an irresistible fate of despotism.”

Now I see that many people are okay with this and that I expect because I believe that the vast majority of people will always opt for security over freedom if pushed hard enough. However, when I see people that raised no alarm when the Patriot Act and other security legislation was passed by a Republican Congress and signed into law by President Bush now castigate President Obama for not going against the will of 80% of the population who think this is perfectly fine. After all what politician goes against the will of voters when they are in great political difficulty?

When people like Rush Limbaugh state on the air “Mr. President don’t touch my teabags” when the fly on private jets I want to scream. The differences now are that the TSA has bought technology that was not available in 2001 to do the job that Bush’s second director of Homeland Security Director Michael Chertoff advocated buying. Chertoff has been retained by the manufacturers of the devices and their lobbyists. Of course the company Rapiscan Systems also has Linda Daschle a former FAA official and wife of former Democrat Speaker of the House Tom Daschle on their payroll. I love bi-partisanship don’t you?

The second reason is all politics. There is a Democrat in the White House. A Democrat that Limbaugh and others will shred if he appears soft on terrorism and if terrorists somehow succeed in conducting an attack. Obama is damned if he does and damned if he doesn’t, just as Bush was after 9-11 when people were in a panic and every politician, pundit and media personality was demanding action.

Sometimes I think in our current drift toward a police state civil libertarians are not appreciated because they raise issues that make people uncomfortable. You see for many if not most people it is better to trade safety and security for liberty when politicians, pundits and the media tell us that it is necessary and that they have our best interests at heart. It is just as Daniel Webster said: “Good intentions will always be pleaded for every assumption of authority. It is hardly too strong to say that the Constitution was made to guard the people against the dangers of good intentions. There are men in all ages who mean to govern well, but they mean to govern. They promise to be good masters, but they mean to be masters.”

You see what is happening with the TSA is the tip of the iceberg. Once we get hit again no politician of any party with the possible exception of Ron Paul will willingly divest him themselves of the powers granted under emergency provision which are deemed “necessary” in a crisis and most people will support them. Unfortunately it is hard for me to see how the provisions of the Patriot Act and the actions of the TSA in their current methods of passenger screening do not violate the 4^th Amendment which states: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Unfortunately such actions even with the approval of the citizenry trample the Constitution. It is the Constitution that is the best guarantee for us remaining a free society. The Constitution as Justice David Davis wrote “is a law for rulers and people, equally in war and in peace, and covers with the shield of its protection all classes of men, at all times, and under all circumstances. No doctrine, involving more pernicious consequences, was ever invented by the wit of man than that any of its provisions can be suspended during any of the great exigencies of government. Such a doctrine leads directly to anarchy or despotism, but the theory of necessity on which it is based is false; for the government, within the Constitution, has all the powers granted to it, which are necessary to preserve its existence; as has been happily proved by the result of the great effort to throw off its just authority.”

We need to learn as a nation and people before it is too late the dangerous course that we have embarked upon. Other great nations have surrendered liberties in times of crisis and because it was necessary. How many have recovered them without being totally destroyed and having to be rebuilt?

Al Qaeda and its allies have done what no previous enemy has ever succeeded in doing. More than the human and material costs of 9-11-2001 and other terrorist acts Osama Bin Laden and his allies have succeeded in giving up essential liberties in the name of security. James Madison was correct when he wrote: The means of defense against foreign danger historically have become the instruments of tyranny at home. I pray that we will come to our collective senses before we lose everything. When Patrick Henry said “Give me liberty or give me death” he understood that liberty and its defense were more important than life itself. If we continue down this path we will lose even more liberty and it will be all be for our good and perfectly legal. Bin Laden and his evil consorts must be laughing as we walk down this path and are certainly going to keep making threats and attacks to cause us to curtail our freedom even more than we have. As Bin Laden said: “And he moved the tyranny and suppression of freedom to his own country, and they called it the Patriot Act under the disguise of fighting terrorism.”

Freedom willingly Surrendered is Seldom Regained

William Pitt once said: “Necessity is the plea for every infringement of human freedom. It is argument of tyrants. It is the creed of slaves.” Unfortunately necessity seems to have trumped freedom in the United States.

I have no fear of Al Qaeda or any other terrorist regardless of their malevolent intents, perverse ideology, and lethalness of their weapons or commitment to their cause. I don’t fear these malignant vermin because in our history we have faced down far greater threats to our country, our freedom and way of life. Unfortunately after the attacks of September 11^th 2001 something changed in our country. For the first time an enemy had executed a successful attack on the continental United States killing nearly 3000 Americans and throwing the country into a state of shock and dare I say panic and generated such fear and anxiety that people willingly allowed their legislature to pass several acts to safeguard the country. These acts were of grand scale and affected almost every aspect of life in the country from driver’s licenses to airport security as well as government surveillance of e-mail and about every other form of communication outside of cans and string. Under previous courts parts or all of some of these acts would have been declared unconstitutional because previous courts recognized the inherent dangers of such types of legislation.

However fear has a strange affect on people especially a people who have become conditioned to desiring security and material comfort over freedom which entails risk. Despite warnings of civil libertarians on both the political left and right the Patriot Act of 2001 and the Intelligence Reform and Terrorism Protection Act of 2004 were passed by large majorities in the then Republican dominated Congress and signed into law by President Bush. They were passed in the shadow of the single most devastating attack on the country in what were considered emergency conditions. They were passed because we were told and many of us earnestly believed that they were necessary for the protection of the American “homeland.” People willingly submitted to ever increasing security measures especially those in airports and few seem to know or even care that almost every type of telephonic, wireless or electronic means of communication to include e-mail and chat is monitored by Carnivore a massive surveillance system operated by the National Security Agency. The rational for accepting them is that they were needed to keep us safe form the terrorists. However, as Justice Charles Evans wrote: “Emergency does not create power. Emergency does not increase granted power or remove or diminish the restrictions imposed upon power granted or reserved. The Constitution was adopted in a period of grave emergency. Its grants of power to the federal government and its limitations of the power of the States were determined in the light of emergency, and they are not altered by emergency.”

As I said in my previous post The Road to Totalitarianism is paved with Good Intentions https://padresteve.wordpress.com/2010/11/20/the-road-to-totalitarianism-is-paved-with-good-intentions/ that those that hastily enacted the legislation did so with good intentions, intentions to govern, but as Daniel Webster said: “Good intentions will always be pleaded for every assumption of authority. They promise to be good masters, but they mean to be masters.”

In reaction to further threats and methods of attack by Al Qaeda and its allies the Department of Homeland Security (DHS) and its Transportation Security Agency (TSA) have put into use more stringent and intrusive methods at their airport passenger and crew screening stations. These include full body scanners that reveal a person’s naked body and if they do not desire that the can submit to a “pat down search” which can also be done to people chosen at random. The methods employed would be illegal if a teacher did them to a student and would get almost anyone else charged with sexual assault. They are draconian and have been applied to the most vulnerable citizens, children strip searched http://www.youtube.com/watch?v=XSQTz1bccL4 , cancer survivors having their prosthetics removed and examined and one man having his urostomy bag broken leaving him soaked in urine. http://www.msnbc.msn.com/id/40291856/ns/travel-news There have been hundreds of complaints by other citizens who have felt that they have been assaulted in the process of being screened. To add insult to injury the TSA has announced that people who enter a security line and then decided that they do not want to be searched and want to leave the airport can be detained, interrogated and possibly charged with a felony, imprisoned and fined up to $11,000. They don’t even have to have anything on them; they can be law abiding citizens that simply decide at the moment that air travel is just not worth the humiliation.

The sad thing is that 80% in a CNN Poll said that they were okay with this but in reality these measures are already obsolete because Al Qaeda can change its tactics in an instant. The TSA has dug in and is refusing to modify the searches despite pressure from their superiors at the DHS and some in Congress. The have been supported by the President but what really can he do. If he forces a change and something happens then he gets blamed by his political opponents who already have it out for him. Likewise he isn’t doing something that President Bush and John Ashcroft would not have done earlier had the technology been available in 2001. Add to the fact that 80% of the people say they are okay with these measures as long as they are safe means that he has to back the TSA. If he doesn’t he alienates even more of the people. He’s damned if he does and damned if he doesn’t.

In surrendering our liberty and all that we hold dear for an illusion of security we have in effect granted victory to Al Qaeda and its allies. Our Marines, Soldiers, Sailors and Airmen fight and die every day while their countrymen surrender the freedom that they honestly believe that they are fighting for. The freedoms and liberties that we give up will only grow in number and intensity. It will not end well.

9-11-2001: A Date that Will Live in Infamy 9 Years Later

On September 11^th 2001 I was the Chaplain for Headquarters Battalion 2^nd Marine Division, Camp LeJeune North Carolina. I first learned of the attacks as I was logging off of my computer to go to PT after a couple of counseling cases in the early morning. The headline I saw on Yahoo’s home page was “Airplane crashes into World Trade Center.” I simply figured from that that a private pilot had flown a small aircraft into on e of the buildings. I got to my car and when I turned on the engine a talk radio host was screaming “Another airline has crashed into the second tower.” I don’t even remember what talk show host that it was. My mind immediately went to terrorism as the cause thinking about the bombing of the USS Cole. I drove to the French Creek gym to see if there was anything on the televisions. When I arrived I saw the trade centers burning and Marines and Sailors crowded around in stunned silence or whispering to each other in muted tones. I returned to my office, showered, got my uniform on and drove to our Battalion Headquarters where Colonel Richard Lake was gathering the staff. Within hours the base was locked down with combat ready Marines patrolling possible danger areas and with hasty roadblocks and checkpoints established around the base. We were locked down for almost four days as things began to settle out. By December I was the Chaplain for the USS Hue City and deployed in February 2002 to support Operation Enduring Freedom and Operation Southern Watch. In 2007 and 2008 I was deployed to Iraq serving with the Iraq Assistance Group and Marine, Army and other advisors serving with the Iraqi 1^st and 7^th Divisions and other security forces fighting insurgents in Al Anbar Province. I have many friends that have deployed numerous times between the 9-11 attacks and today, some have been wounded and others killed. Many suffer the psychological and spiritual trauma of PTSD and Traumatic Brain injury. Even if we were to be able to end these wars today we would be dealing with the ravages of this long war. I still serve working among many continue to deploy and return as well as treat those traumatized by war. I will return to Camp LeJeune next month as the Command Chaplain of the Naval Hospital which takes care of the Marines and Sailors of the II Marine Expeditionary Force, much of which is deployed to Afghanistan. I cannot forget 9-11. These are my thoughts.

I remember exactly where I was on that terrible day known simply now as 9-11. The events of that day and in the following changed our lives and our country possibly forever. The images of that day are seared into our individual and collective consciousness as Americans and usually conjure up deep emotions of anger, sadness, grief and pain. The sheer magnitude of attacks, especially those on the World Trade Center towers covered on live television shocked and stunned the nation as the nation saw us transition from peace to war before its eyes.

The attack on the Pentagon was also dramatic but because it was a military target the psychological impact on most Americans was less than the attack on the Trade Center towers.

The images are still disconcerting and when watched show the genius of Bin Laden as he struck at great symbols of American power. Bin Laden did what no enemy had done previously striking so hard at such symbolic targets; he destroyed our sense of safety. Of course that sense of safety was an illusion all along as with the advent of ICBMs and long range bombers we have been within reach of our enemies. Likewise we had seen terrorists attack us before including a 1993 attack on the WTC designed to bring the building down. But this was different than all those that came before, for the first time Americans no longer felt safe behind the “moats” of the oceans that surround the country. For the first time since the War of 1812 a foreign enemy had struck at the heart of America on the Continental United States itself and unlike then the nation saw the attack unfold in real time together. Only the attack on the Pacific Fleet at Pearl Harbor by the Japanese Navy on December 7^th 1941 has had such an impact on us. We watched as near 3000 Americans and others died in the towers, at the Pentagon and aboard Flight 93. Some would say that we need to “get over” 9-11, but those that say such things do not understand the magnitude of the affect of the attacks on the soul of this nation.

The emotions generated by these attacks even 9 years later in are almost visceral because they are symptomatic of the deep and yet unhealed wounds suffered on that day. The attacks on the World Trade Center, the Pentagon and United Flight 93 perpetrated in the caves of Afghanistan by Osama Bin Laden and Al Qaeda and executed by 19 terrorists who hijacked the four aircraft involved did more than destroy or damage landmarks and kill innocent people; they wounded our nation both psychologically and spiritually.

That day also created an immense desire to see the perpetrators brought to justice and set us on a course for war a war that has no end in sight even 9 years after the 9-11 attacks. To put this in perspective from Pearl Harbor to VJ Day was just under 3 years and 9 months and even Vietnam from the Gulf of Tonkin incident to the cease fire was only 8 years 4 months. The young men and women now enlisting as 18 year olds in our armed forces were 9 years old when the attacks occurred, kids that were in 3^rd or 4^th grade playing little league baseball, soccer, pee-wee football and playing with their X-Box, PS-2 or Game Cubes. Now these children serve in harm’s way with many dying as the average age of our casualties is about 20 years old.

After the attack Americans banded together as Americans for the first time that I can remember. There were remembrances, prayer vigils and rallies to show our unity to the world. Congress even banded together in a rare display of unity spontaneously breaking into “God Bless America”

Within a month President Bush launched our military into an attack on Al Qaeda bases and those of their Taliban allies in Afghanistan. With the help of different Afghan Mujahidin groups US Special Forces, Marines and Paratroops had driven the Taliban out of power and were searching for Bin Laden. Although American forces came close at the battle of Tora Bora to catching Bin Laden he escaped along with the leader of the Taliban Mullah Omar. Eventually the effort in Afghanistan became secondary as the United States focused its attention on Iraq and became involved in a bloody insurgency against Al Qaeda allies as well as Iraqi militants of various types. Mistakes were made by the administration in disbanding the Iraqi Army, police and Civil Service following our 2003 invasion. On the ground some American soldiers at Abu Ghraib videotaped acts of torture on prisoners and detainees which found their way into the world wide press creating a firestorm reaction which made the war that much more difficult as it made those on the fence more likely to at least give the insurgents aid and support. That changed in 2007 the “Surge” of extra combat troops to implement a true counter-insurgency strategy aided by Iraq security forces and the Anbar Awakening where the Sunnis turned against Al Qaeda. Iraq still has major issues but in the long run will likely do well as the Iraqis take control of the country. I know that there are many people including some experts who doubt this but knowing a number of Iraqi senior officers of both Sunni and Shi’a Moslem factions and the history of modern Iraq which is one of secularism, I believe that Iraq will do fine.

The strategic problem with Iraq was that it diverted attention from Afghanistan where we had an early chance to drive out and keep out both Al Qaeda and the Taliban. The loss of emphasis in Afghanistan allowed the Taliban to regroup and reestablish their control throughout much of the country. The other thing was that it created a situation that cost the US Military a large number of casualties and made it difficult to fulfill other commitments and contingencies.

Nine years later we are still at war, American Soldiers ream in Iraq helping the Iraqis manage their own security and American troops lead NATO and Afghan forces in a bloody war against the resurgent Taliban which has claimed as of today 1257 Americans on top of the 4404 lost in Iraq. http://projects.washingtonpost.com/fallen/

The war in Afghanistan has blown up over the past two years as the Taliban often aided by elements of Pakistani intelligence services take advantage of the corrupt and unpopular Afghan government. The Afghan government led by President Karzai who at best can be described as an unreliable ally in the war against the Taliban is barely able to influence events in the capitol Kubul, but less in outlying areas where the Taliban has established a formidable shadow government.

At home the United States seems to be at war with itself, no longer united but bitterly divided even as American military personnel lay down their lives overseas. A controversy rages about an Islamic Cultural Center and Mosque to be built not far from Ground Zero while Fundamentalist Christian pastors threat to burn copies of the Koran inciting more rage against Americans deployed in harm’s way. The President is increasingly unpopular and the Congress even less so. Sentiment is building for wholesale change with some even talking of revolution or secession. It doesn’t seem that either the builders of the so called “Ground Zero Mosque,” its opponents and the hate filled pastors have any clue about the propaganda victories that they hand our enemies on a daily basis. In a world-wide insurgency, which this has become propaganda is often more important than military power.

It seems that Osama Bin Laden is succeeding in his goals. In 2004 Bin Laden said on a video “All we have to do is send two mujaheddin . . . to raise a small piece of cloth on which is written ‘al-Qaeda’ in order to make the generals race there, to cause America to suffer human, economic and political losses.” Bin Laden and his allies have seen us abandon some of deepest principles of freedom of speech, movement and association as the government tries to ensure that no more attacks take place. However as any student of terrorism knows there is no way to stop every terrorist attack. Eventually another will succeed and when it does we will see freedom curtailed even more. If the attack is large enough the real possibility exists of Martial Law.

As this transpires American Military personnel of every race, color, creed and political persuasion do battle with the enemy. At home other military units train and prepare for battle. Police, security and intelligence officers from a myriad of Federal and state agencies conduct the painstaking work of trying to figure out where the next attack is coming from and try to stop it. Since 9-11 they have been successful but the law of averages says that eventually another attack will succeed because Al Qaeda and other Islamic terrorists while small are always seeking ways to further terrorize Americans and other westerners.

All I can imagine now is that our current state of division will last until we are shocked out of it by something worse than 9-11. I hope and pray that cooler heads will prevail and somehow we will recover our sense of who we are as Americans that sense of “e pluribus Unum” “Out of many, One” will take the place of hyphenated America and Red States versus Blue States. Bin Laden would like for nothing more for us to continue to be at war with ourselves.

Today we mark 9-11 and I hope and pray that the lessons of 9-11 will not be forgotten and that both the losses of that day and sacrifices since will not be in vain. As for me and the rest of us in uniform we will continue to serve to preserve and defend this country and our most cherished ideals. May God have mercy on us all.

The Great Montana Dude Ranch Sleepover: Padre Steve’s Solution to Politics as Usual

Sleepover on a Dude Ranch anyone?

Part of the problem is that our political ruling class, the Federal Government particular is completely out of touch because they live in the netherworld of Washington D.C. This city has become the symbol of all that ails the country and since our political class only leaves it to raise money for their next campaigns they have no earthly clue of what the rest of us are experiencing. Thus they can coddle up to their big financial supporters and most demented party extremists and unseemly lobbyists representing some of the vilest elements of our society. As a result for at least the past 10 years and I am sure a lot more they have for the most part forgotten the people that they are supposed to represent. The political class doesn’t live in our world, thus they do everything that they can not to look at what is best for the country but rather what is best for them, for their party, their supporters and their agendas. If you ask me its all out of whack and they really all should be whacked.

Since they all spend far too much time in Washington or raising money to stay there it is high time that they get out of Dodge so to speak. This is my idea of how we fix this situation. My suggestion is definitely not politics as usual. Instead it is based on relationships built from shared suffering and since we are suffering why shouldn’t they suffer too? So here’s my idea. First we shut down the government for a month. Now before you think that you won’t get what the government owes you I don’t mean the people that actually do the work. What I mean is both houses of Congress, the White House and the Supreme Court. We shut them down. Let the clerks of the court do their thing, let the White House staff do its job and congressional aides deal with constituents. Give the Russians and Chinese, the Iranians, Al Qaida, the European Union and everyone else a message that we’re busy the next month so don’t bother us. We’ll tell them that if they mind their own business that our stand ins with itchy fingers won’t nuke them. where is Al Haig when you need him the most? Hey MAD (mutual assured destruction) worked during the Cold War, after all nothing like an ICBM loaded with multiple nuclear warheads to keep people in line and not do anything really stupid.

Once we shut the place down we put all of these guys and gals on Greyhound buses packed to the gills. Each bus would have a mix of members of each party really making sure those that hate each other most sit next to each other. Secret Service and FBI agents on the buses would have the option to Taser anyone that tries to switch seats. Then we drive them all to some big assed dude ranch in Montana, outfit them in silly looking cowboy clothes with boots that are a bit too tight and leave them there in the charge of a bunch of cowboys at least two of which have had a recent “Brokeback Mountain” experience.
