Still Relevant Today: Frederick Douglass’s 4th of July Oration

These are the words of Frederick Douglass spoken on July 5th 1852 to a gathering of abolitionists in Rochester New York. He spoke them over 10 years before Abraham Lincoln issued the Emancipation Proclamation. The words are haunting even today because they point to the yet unfulfilled promise of the Declaration:

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness…”

Mr. President, Friends and Fellow Citizens:

He who could address this audience without a quailing sensation, has stronger nerves than I have. I do not remember ever to have appeared as a speaker before any assembly more shrinkingly, nor with greater distrust of my ability, than I do this day. A feeling has crept over me, quite unfavorable to the exercise of my limited powers of speech. The task before me is one which requires much previous thought and study for its proper performance. I know that apologies of this sort are generally considered flat and unmeaning. I trust, however, that mine will not be so considered. Should I seem at ease, my appearance would much misrepresent me. The little experience I have had in addressing public meetings, in country schoolhouses, avails me nothing on the present occasion.

The papers and placards say, that I am to deliver a 4th [of] July oration. This certainly sounds large, and out of the common way, for it is true that I have often had the privilege to speak in this beautiful Hall, and to address many who now honor me with their presence. But neither their familiar faces, nor the perfect gage I think I have of Corinthian Hall, seems to free me from embarrassment.

The fact is, ladies and gentlemen, the distance between this platform and the slave plantation, from which I escaped, is considerable — and the difficulties to be overcome in getting from the latter to the former, are by no means slight. That I am here to-day is, to me, a matter of astonishment as well as of gratitude. You will not, therefore, be surprised, if in what I have to say I evince no elaborate preparation, nor grace my speech with any high sounding exordium. With little experience and with less learning, I have been able to throw my thoughts hastily and imperfectly together; and trusting to your patient and generous indulgence, I will proceed to lay them before you.

This, for the purpose of this celebration, is the 4th of July. It is the birthday of your National Independence, and of your political freedom. This, to you, is what the Passover was to the emancipated people of God. It carries your minds back to the day, and to the act of your great deliverance; and to the signs, and to the wonders, associated with that act, and that day. This celebration also marks the beginning of another year of your national life; and reminds you that the Republic of America is now 76 years old. I am glad, fellow-citizens, that your nation is so young. Seventy-six years, though a good old age for a man, is but a mere speck in the life of a nation. Three score years and ten is the allotted time for individual men; but nations number their years by thousands. According to this fact, you are, even now, only in the beginning of your national career, still lingering in the period of childhood. I repeat, I am glad this is so. There is hope in the thought, and hope is much needed, under the dark clouds which lower above the horizon. The eye of the reformer is met with angry flashes, portending disastrous times; but his heart may well beat lighter at the thought that America is young, and that she is still in the impressible stage of her existence. May he not hope that high lessons of wisdom, of justice and of truth, will yet give direction to her destiny? Were the nation older, the patriot’s heart might be sadder, and the reformer’s brow heavier. Its future might be shrouded in gloom, and the hope of its prophets go out in sorrow. There is consolation in the thought that America is young. Great streams are not easily turned from channels, worn deep in the course of ages. They may sometimes rise in quiet and stately majesty, and inundate the land, refreshing and fertilizing the earth with their mysterious properties. They may also rise in wrath and fury, and bear away, on their angry waves, the accumulated wealth of years of toil and hardship. They, however, gradually flow back to the same old channel, and flow on as serenely as ever. But, while the river may not be turned aside, it may dry up, and leave nothing behind but the withered branch, and the unsightly rock, to howl in the abyss-sweeping wind, the sad tale of departed glory. As with rivers so with nations.

Fellow-citizens, I shall not presume to dwell at length on the associations that cluster about this day. The simple story of it is that, 76 years ago, the people of this country were British subjects. The style and title of your “sovereign people” (in which you now glory) was not then born. You were under the British Crown. Your fathers esteemed the English Government as the home government; and England as the fatherland. This home government, you know, although a considerable distance from your home, did, in the exercise of its parental prerogatives, impose upon its colonial children, such restraints, burdens and limitations, as, in its mature judgment, it deemed wise, right and proper.

But, your fathers, who had not adopted the fashionable idea of this day, of the infallibility of government, and the absolute character of its acts, presumed to differ from the home government in respect to the wisdom and the justice of some of those burdens and restraints. They went so far in their excitement as to pronounce the measures of government unjust, unreasonable, and oppressive, and altogether such as ought not to be quietly submitted to. I scarcely need say, fellow-citizens, that my opinion of those measures fully accords with that of your fathers. Such a declaration of agreement on my part would not be worth much to anybody. It would, certainly, prove nothing, as to what part I might have taken, had I lived during the great controversy of 1776. To say now that America was right, and England wrong, is exceedingly easy. Everybody can say it; the dastard, not less than the noble brave, can flippantly discant on the tyranny of England towards the American Colonies. It is fashionable to do so; but there was a time when to pronounce against England, and in favor of the cause of the colonies, tried men’s souls. They who did so were accounted in their day, plotters of mischief, agitators and rebels, dangerous men. To side with the right, against the wrong, with the weak against the strong, and with the oppressed against the oppressor! here lies the merit, and the one which, of all others, seems unfashionable in our day. The cause of liberty may be stabbed by the men who glory in the deeds of your fathers. But, to proceed.

Feeling themselves harshly and unjustly treated by the home government, your fathers, like men of honesty, and men of spirit, earnestly sought redress. They petitioned and remonstrated; they did so in a decorous, respectful, and loyal manner. Their conduct was wholly unexceptionable. This, however, did not answer the purpose. They saw themselves treated with sovereign indifference, coldness and scorn. Yet they persevered. They were not the men to look back.

As the sheet anchor takes a firmer hold, when the ship is tossed by the storm, so did the cause of your fathers grow stronger, as it breasted the chilling blasts of kingly displeasure. The greatest and best of British statesmen admitted its justice, and the loftiest eloquence of the British Senate came to its support. But, with that blindness which seems to be the unvarying characteristic of tyrants, since Pharaoh and his hosts were drowned in the Red Sea, the British Government persisted in the exactions complained of.

The madness of this course, we believe, is admitted now, even by England; but we fear the lesson is wholly lost on our present ruler.

Oppression makes a wise man mad. Your fathers were wise men, and if they did not go mad, they became restive under this treatment. They felt themselves the victims of grievous wrongs, wholly incurable in their colonial capacity. With brave men there is always a remedy for oppression. Just here, the idea of a total separation of the colonies from the crown was born! It was a startling idea, much more so, than we, at this distance of time, regard it. The timid and the prudent (as has been intimated) of that day, were, of course, shocked and alarmed by it.

Such people lived then, had lived before, and will, probably, ever have a place on this planet; and their course, in respect to any great change, (no matter how great the good to be attained, or the wrong to be redressed by it), may be calculated with as much precision as can be the course of the stars. They hate all changes, but silver, gold and copper change! Of this sort of change they are always strongly in favor.

These people were called Tories in the days of your fathers; and the appellation, probably, conveyed the same idea that is meant by a more modern, though a somewhat less euphonious term, which we often find in our papers, applied to some of our old politicians.

Their opposition to the then dangerous thought was earnest and powerful; but, amid all their terror and affrighted vociferations against it, the alarming and revolutionary idea moved on, and the country with it.

On the 2d of July, 1776, the old Continental Congress, to the dismay of the lovers of ease, and the worshipers of property, clothed that dreadful idea with all the authority of national sanction. They did so in the form of a resolution; and as we seldom hit upon resolutions, drawn up in our day whose transparency is at all equal to this, it may refresh your minds and help my story if I read it. “Resolved, That these united colonies are, and of right, ought to be free and Independent States; that they are absolved from all allegiance to the British Crown; and that all political connection between them and the State of Great Britain is, and ought to be, dissolved.”

Citizens, your fathers made good that resolution. They succeeded; and to-day you reap the fruits of their success. The freedom gained is yours; and you, therefore, may properly celebrate this anniversary. The 4th of July is the first great fact in your nation’s history — the very ring-bolt in the chain of your yet undeveloped destiny.

Pride and patriotism, not less than gratitude, prompt you to celebrate and to hold it in perpetual remembrance. I have said that the Declaration of Independence is the ring-bolt to the chain of your nation’s destiny; so, indeed, I regard it. The principles contained in that instrument are saving principles. Stand by those principles, be true to them on all occasions, in all places, against all foes, and at whatever cost.

From the round top of your ship of state, dark and threatening clouds may be seen. Heavy billows, like mountains in the distance, disclose to the leeward huge forms of flinty rocks! That bolt drawn, that chain broken, and all is lost. Cling to this day — cling to it, and to its principles, with the grasp of a storm-tossed mariner to a spar at midnight.

The coming into being of a nation, in any circumstances, is an interesting event. But, besides general considerations, there were peculiar circumstances which make the advent of this republic an event of special attractiveness.

The whole scene, as I look back to it, was simple, dignified and sublime.

The population of the country, at the time, stood at the insignificant number of three millions. The country was poor in the munitions of war. The population was weak and scattered, and the country a wilderness unsubdued. There were then no means of concert and combination, such as exist now. Neither steam nor lightning had then been reduced to order and discipline. From the Potomac to the Delaware was a journey of many days. Under these, and innumerable other disadvantages, your fathers declared for liberty and independence and triumphed.

Fellow Citizens, I am not wanting in respect for the fathers of this republic. The signers of the Declaration of Independence were brave men. They were great men too — great enough to give fame to a great age. It does not often happen to a nation to raise, at one time, such a number of truly great men. The point from which I am compelled to view them is not, certainly, the most favorable; and yet I cannot contemplate their great deeds with less than admiration. They were statesmen, patriots and heroes, and for the good they did, and the principles they contended for, I will unite with you to honor their memory.

They loved their country better than their own private interests; and, though this is not the highest form of human excellence, all will concede that it is a rare virtue, and that when it is exhibited, it ought to command respect. He who will, intelligently, lay down his life for his country, is a man whom it is not in human nature to despise. Your fathers staked their lives, their fortunes, and their sacred honor, on the cause of their country. In their admiration of liberty, they lost sight of all other interests.

They were peace men; but they preferred revolution to peaceful submission to bondage. They were quiet men; but they did not shrink from agitating against oppression. They showed forbearance; but that they knew its limits. They believed in order; but not in the order of tyranny. With them, nothing was “settled” that was not right. With them, justice, liberty and humanity were “final;” not slavery and oppression. You may well cherish the memory of such men. They were great in their day and generation. Their solid manhood stands out the more as we contrast it with these degenerate times.

How circumspect, exact and proportionate were all their movements! How unlike the politicians of an hour! Their statesmanship looked beyond the passing moment, and stretched away in strength into the distant future. They seized upon eternal principles, and set a glorious example in their defense. Mark them!

Fully appreciating the hardship to be encountered, firmly believing in the right of their cause, honorably inviting the scrutiny of an on-looking world, reverently appealing to heaven to attest their sincerity, soundly comprehending the solemn responsibility they were about to assume, wisely measuring the terrible odds against them, your fathers, the fathers of this republic, did, most deliberately, under the inspiration of a glorious patriotism, and with a sublime faith in the great principles of justice and freedom, lay deep the corner-stone of the national superstructure, which has risen and still rises in grandeur around you.

Of this fundamental work, this day is the anniversary. Our eyes are met with demonstrations of joyous enthusiasm. Banners and pennants wave exultingly on the breeze. The din of business, too, is hushed. Even Mammon seems to have quitted his grasp on this day. The ear-piercing fife and the stirring drum unite their accents with the ascending peal of a thousand church bells. Prayers are made, hymns are sung, and sermons are preached in honor of this day; while the quick martial tramp of a great and multitudinous nation, echoed back by all the hills, valleys and mountains of a vast continent, bespeak the occasion one of thrilling and universal interest — a nation’s jubilee.

Friends and citizens, I need not enter further into the causes which led to this anniversary. Many of you understand them better than I do. You could instruct me in regard to them. That is a branch of knowledge in which you feel, perhaps, a much deeper interest than your speaker. The causes which led to the separation of the colonies from the British crown have never lacked for a tongue. They have all been taught in your common schools, narrated at your firesides, unfolded from your pulpits, and thundered from your legislative halls, and are as familiar to you as household words. They form the staple of your national poetry and eloquence.

I remember, also, that, as a people, Americans are remarkably familiar with all facts which make in their own favor. This is esteemed by some as a national trait — perhaps a national weakness. It is a fact, that whatever makes for the wealth or for the reputation of Americans, and can be had cheap! will be found by Americans. I shall not be charged with slandering Americans, if I say I think the American side of any question may be safely left in American hands.

I leave, therefore, the great deeds of your fathers to other gentlemen whose claim to have been regularly descended will be less likely to be disputed than mine!

My business, if I have any here to-day, is with the present. The accepted time with God and his cause is the ever-living now.

Trust no future, however pleasant,
Let the dead past bury its dead;
Act, act in the living present,
Heart within, and God overhead.

We have to do with the past only as we can make it useful to the present and to the future. To all inspiring motives, to noble deeds which can be gained from the past, we are welcome. But now is the time, the important time. Your fathers have lived, died, and have done their work, and have done much of it well. You live and must die, and you must do your work. You have no right to enjoy a child’s share in the labor of your fathers, unless your children are to be blest by your labors. You have no right to wear out and waste the hard-earned fame of your fathers to cover your indolence. Sydney Smith tells us that men seldom eulogize the wisdom and virtues of their fathers, but to excuse some folly or wickedness of their own. This truth is not a doubtful one. There are illustrations of it near and remote, ancient and modern. It was fashionable, hundreds of years ago, for the children of Jacob to boast, we have “Abraham to our father,” when they had long lost Abraham’s faith and spirit. That people contented themselves under the shadow of Abraham’s great name, while they repudiated the deeds which made his name great. Need I remind you that a similar thing is being done all over this country to-day? Need I tell you that the Jews are not the only people who built the tombs of the prophets, and garnished the sepulchres of the righteous? Washington could not die till he had broken the chains of his slaves. Yet his monument is built up by the price of human blood, and the traders in the bodies and souls of men shout — “We have Washington to our father.” — Alas! that it should be so; yet so it is.

The evil that men do, lives after them, The good is oft-interred with their bones.

Fellow-citizens, pardon me, allow me to ask, why am I called upon to speak here to-day? What have I, or those I represent, to do with your national independence? Are the great principles of political freedom and of natural justice, embodied in that Declaration of Independence, extended to us? and am I, therefore, called upon to bring our humble offering to the national altar, and to confess the benefits and express devout gratitude for the blessings resulting from your independence to us?

Would to God, both for your sakes and ours, that an affirmative answer could be truthfully returned to these questions! Then would my task be light, and my burden easy and delightful. For who is there so cold, that a nation’s sympathy could not warm him? Who so obdurate and dead to the claims of gratitude, that would not thankfully acknowledge such priceless benefits? Who so stolid and selfish, that would not give his voice to swell the hallelujahs of a nation’s jubilee, when the chains of servitude had been torn from his limbs? I am not that man. In a case like that, the dumb might eloquently speak, and the “lame man leap as an hart.”

But, such is not the state of the case. I say it with a sad sense of the disparity between us. I am not included within the pale of this glorious anniversary! Your high independence only reveals the immeasurable distance between us. The blessings in which you, this day, rejoice, are not enjoyed in common. — The rich inheritance of justice, liberty, prosperity and independence, bequeathed by your fathers, is shared by you, not by me. The sunlight that brought life and healing to you, has brought stripes and death to me. This Fourth [of] July is yours, not mineYou may rejoice, I must mourn. To drag a man in fetters into the grand illuminated temple of liberty, and call upon him to join you in joyous anthems, were inhuman mockery and sacrilegious irony. Do you mean, citizens, to mock me, by asking me to speak to-day? If so, there is a parallel to your conduct. And let me warn you that it is dangerous to copy the example of a nation whose crimes, lowering up to heaven, were thrown down by the breath of the Almighty, burying that nation in irrecoverable ruin! I can to-day take up the plaintive lament of a peeled and woe-smitten people!

“By the rivers of Babylon, there we sat down. Yea! we wept when we remembered Zion. We hanged our harps upon the willows in the midst thereof. For there, they that carried us away captive, required of us a song; and they who wasted us required of us mirth, saying, Sing us one of the songs of Zion. How can we sing the Lord’s song in a strange land? If I forget thee, O Jerusalem, let my right hand forget her cunning. If I do not remember thee, let my tongue cleave to the roof of my mouth.”

Fellow-citizens; above your national, tumultuous joy, I hear the mournful wail of millions! whose chains, heavy and grievous yesterday, are, to-day, rendered more intolerable by the jubilee shouts that reach them. If I do forget, if I do not faithfully remember those bleeding children of sorrow this day, “may my right hand forget her cunning, and may my tongue cleave to the roof of my mouth!” To forget them, to pass lightly over their wrongs, and to chime in with the popular theme, would be treason most scandalous and shocking, and would make me a reproach before God and the world. My subject, then fellow-citizens, is AMERICAN SLAVERY. I shall see, this day, and its popular characteristics, from the slave’s point of view. Standing, there, identified with the American bondman, making his wrongs mine, I do not hesitate to declare, with all my soul, that the character and conduct of this nation never looked blacker to me than on this 4th of July! Whether we turn to the declarations of the past, or to the professions of the present, the conduct of the nation seems equally hideous and revolting. America is false to the past, false to the present, and solemnly binds herself to be false to the future. Standing with God and the crushed and bleeding slave on this occasion, I will, in the name of humanity which is outraged, in the name of liberty which is fettered, in the name of the constitution and the Bible, which are disregarded and trampled upon, dare to call in question and to denounce, with all the emphasis I can command, everything that serves to perpetuate slavery — the great sin and shame of America! “I will not equivocate; I will not excuse;” I will use the severest language I can command; and yet not one word shall escape me that any man, whose judgment is not blinded by prejudice, or who is not at heart a slaveholder, shall not confess to be right and just.

But I fancy I hear some one of my audience say, it is just in this circumstance that you and your brother abolitionists fail to make a favorable impression on the public mind. Would you argue more, and denounce less, would you persuade more, and rebuke less, your cause would be much more likely to succeed. But, I submit, where all is plain there is nothing to be argued. What point in the anti-slavery creed would you have me argue? On what branch of the subject do the people of this country need light? Must I undertake to prove that the slave is a man? That point is conceded already. Nobody doubts it. The slaveholders themselves acknowledge it in the enactment of laws for their government. They acknowledge it when they punish disobedience on the part of the slave. There are seventy-two crimes in the State of Virginia, which, if committed by a black man, (no matter how ignorant he be), subject him to the punishment of death; while only two of the same crimes will subject a white man to the like punishment. What is this but the acknowledgement that the slave is a moral, intellectual and responsible being? The manhood of the slave is conceded. It is admitted in the fact that Southern statute books are covered with enactments forbidding, under severe fines and penalties, the teaching of the slave to read or to write. When you can point to any such laws, in reference to the beasts of the field, then I may consent to argue the manhood of the slave. When the dogs in your streets, when the fowls of the air, when the cattle on your hills, when the fish of the sea, and the reptiles that crawl, shall be unable to distinguish the slave from a brute, then will I argue with you that the slave is a man!

For the present, it is enough to affirm the equal manhood of the Negro race. Is it not astonishing that, while we are ploughing, planting and reaping, using all kinds of mechanical tools, erecting houses, constructing bridges, building ships, working in metals of brass, iron, copper, silver and gold; that, while we are reading, writing and cyphering, acting as clerks, merchants and secretaries, having among us lawyers, doctors, ministers, poets, authors, editors, orators and teachers; that, while we are engaged in all manner of enterprises common to other men, digging gold in California, capturing the whale in the Pacific, feeding sheep and cattle on the hill-side, living, moving, acting, thinking, planning, living in families as husbands, wives and children, and, above all, confessing and worshipping the Christian’s God, and looking hopefully for life and immortality beyond the grave, we are called upon to prove that we are men!

Would you have me argue that man is entitled to liberty? that he is the rightful owner of his own body? You have already declared it. Must I argue the wrongfulness of slavery? Is that a question for Republicans? Is it to be settled by the rules of logic and argumentation, as a matter beset with great difficulty, involving a doubtful application of the principle of justice, hard to be understood? How should I look to-day, in the presence of Americans, dividing, and subdividing a discourse, to show that men have a natural right to freedom? speaking of it relatively, and positively, negatively, and affirmatively. To do so, would be to make myself ridiculous, and to offer an insult to your understanding. — There is not a man beneath the canopy of heaven, that does not know that slavery is wrong for him.

What, am I to argue that it is wrong to make men brutes, to rob them of their liberty, to work them without wages, to keep them ignorant of their relations to their fellow men, to beat them with sticks, to flay their flesh with the lash, to load their limbs with irons, to hunt them with dogs, to sell them at auction, to sunder their families, to knock out their teeth, to burn their flesh, to starve them into obedience and submission to their masters? Must I argue that a system thus marked with blood, and stained with pollution, is wrong? No! I will not. I have better employments for my time and strength than such arguments would imply.

What, then, remains to be argued? Is it that slavery is not divine; that God did not establish it; that our doctors of divinity are mistaken? There is blasphemy in the thought. That which is inhuman, cannot be divine! Who can reason on such a proposition? They that can, may; I cannot. The time for such argument is passed.

At a time like this, scorching irony, not convincing argument, is needed. O! had I the ability, and could I reach the nation’s ear, I would, to-day, pour out a fiery stream of biting ridicule, blasting reproach, withering sarcasm, and stern rebuke. For it is not light that is needed, but fire; it is not the gentle shower, but thunder. We need the storm, the whirlwind, and the earthquake. The feeling of the nation must be quickened; the conscience of the nation must be roused; the propriety of the nation must be startled; the hypocrisy of the nation must be exposed; and its crimes against God and man must be proclaimed and denounced.

What, to the American slave, is your 4th of July? I answer: a day that reveals to him, more than all other days in the year, the gross injustice and cruelty to which he is the constant victim. To him, your celebration is a sham; your boasted liberty, an unholy license; your national greatness, swelling vanity; your sounds of rejoicing are empty and heartless; your denunciations of tyrants, brass fronted impudence; your shouts of liberty and equality, hollow mockery; your prayers and hymns, your sermons and thanksgivings, with all your religious parade, and solemnity, are, to him, mere bombast, fraud, deception, impiety, and hypocrisy — a thin veil to cover up crimes which would disgrace a nation of savages. There is not a nation on the earth guilty of practices, more shocking and bloody, than are the people of these United States, at this very hour.

Go where you may, search where you will, roam through all the monarchies and despotisms of the old world, travel through South America, search out every abuse, and when you have found the last, lay your facts by the side of the everyday practices of this nation, and you will say with me, that, for revolting barbarity and shameless hypocrisy, America reigns without a rival.

Take the American slave-trade, which, we are told by the papers, is especially prosperous just now. Ex-Senator Benton tells us that the price of men was never higher than now. He mentions the fact to show that slavery is in no danger. This trade is one of the peculiarities of American institutions. It is carried on in all the large towns and cities in one-half of this confederacy; and millions are pocketed every year, by dealers in this horrid traffic. In several states, this trade is a chief source of wealth. It is called (in contradistinction to the foreign slave-trade) “the internal slave trade.” It is, probably, called so, too, in order to divert from it the horror with which the foreign slave-trade is contemplated. That trade has long since been denounced by this government, as piracy. It has been denounced with burning words, from the high places of the nation, as an execrable traffic. To arrest it, to put an end to it, this nation keeps a squadron, at immense cost, on the coast of Africa. Everywhere, in this country, it is safe to speak of this foreign slave-trade, as a most inhuman traffic, opposed alike to the laws of God and of man. The duty to extirpate and destroy it, is admitted even by our DOCTORS OF DIVINITY. In order to put an end to it, some of these last have consented that their colored brethren (nominally free) should leave this country, and establish themselves on the western coast of Africa! It is, however, a notable fact that, while so much execration is poured out by Americans upon those engaged in the foreign slave-trade, the men engaged in the slave-trade between the states pass without condemnation, and their business is deemed honorable.

Behold the practical operation of this internal slave-trade, the American slave-trade, sustained by American politics and America religion. Here you will see men and women reared like swine for the market. You know what is a swine-drover? I will show you a man-drover. They inhabit all our Southern States. They perambulate the country, and crowd the highways of the nation, with droves of human stock. You will see one of these human flesh-jobbers, armed with pistol, whip and bowie-knife, driving a company of a hundred men, women, and children, from the Potomac to the slave market at New Orleans. These wretched people are to be sold singly, or in lots, to suit purchasers. They are food for the cotton-field, and the deadly sugar-mill. Mark the sad procession, as it moves wearily along, and the inhuman wretch who drives them. Hear his savage yells and his blood-chilling oaths, as he hurries on his affrighted captives! There, see the old man, with locks thinned and gray. Cast one glance, if you please, upon that young mother, whose shoulders are bare to the scorching sun, her briny tears falling on the brow of the babe in her arms. See, too, that girl of thirteen, weeping, yes! weeping, as she thinks of the mother from whom she has been torn! The drove moves tardily. Heat and sorrow have nearly consumed their strength; suddenly you hear a quick snap, like the discharge of a rifle; the fetters clank, and the chain rattles simultaneously; your ears are saluted with a scream, that seems to have torn its way to the center of your soul! The crack you heard, was the sound of the slave-whip; the scream you heard, was from the woman you saw with the babe. Her speed had faltered under the weight of her child and her chains! that gash on her shoulder tells her to move on. Follow the drove to New Orleans. Attend the auction; see men examined like horses; see the forms of women rudely and brutally exposed to the shocking gaze of American slave-buyers. See this drove sold and separated forever; and never forget the deep, sad sobs that arose from that scattered multitude. Tell me citizens, WHERE, under the sun, you can witness a spectacle more fiendish and shocking. Yet this is but a glance at the American slave-trade, as it exists, at this moment, in the ruling part of the United States.

I was born amid such sights and scenes. To me the American slave-trade is a terrible reality. When a child, my soul was often pierced with a sense of its horrors. I lived on Philpot Street, Fell’s Point, Baltimore, and have watched from the wharves, the slave ships in the Basin, anchored from the shore, with their cargoes of human flesh, waiting for favorable winds to waft them down the Chesapeake. There was, at that time, a grand slave mart kept at the head of Pratt Street, by Austin Woldfolk. His agents were sent into every town and county in Maryland, announcing their arrival, through the papers, and on flaming “hand-bills,” headed CASH FOR NEGROES. These men were generally well dressed men, and very captivating in their manners. Ever ready to drink, to treat, and to gamble. The fate of many a slave has depended upon the turn of a single card; and many a child has been snatched from the arms of its mother by bargains arranged in a state of brutal drunkenness.

The flesh-mongers gather up their victims by dozens, and drive them, chained, to the general depot at Baltimore. When a sufficient number have been collected here, a ship is chartered, for the purpose of conveying the forlorn crew to Mobile, or to New Orleans. From the slave prison to the ship, they are usually driven in the darkness of night; for since the antislavery agitation, a certain caution is observed.

In the deep still darkness of midnight, I have been often aroused by the dead heavy footsteps, and the piteous cries of the chained gangs that passed our door. The anguish of my boyish heart was intense; and I was often consoled, when speaking to my mistress in the morning, to hear her say that the custom was very wicked; that she hated to hear the rattle of the chains, and the heart-rending cries. I was glad to find one who sympathized with me in my horror.

Fellow-citizens, this murderous traffic is, to-day, in active operation in this boasted republic. In the solitude of my spirit, I see clouds of dust raised on the highways of the South; I see the bleeding footsteps; I hear the doleful wail of fettered humanity, on the way to the slave-markets, where the victims are to be sold like horsessheep, and swine, knocked off to the highest bidder. There I see the tenderest ties ruthlessly broken, to gratify the lust, caprice and rapacity of the buyers and sellers of men. My soul sickens at the sight.

Is this the land your Fathers loved,
The freedom which they toiled to win?
Is this the earth whereon they moved?
Are these the graves they slumber in?

But a still more inhuman, disgraceful, and scandalous state of things remains to be presented. By an act of the American Congress, not yet two years old, slavery has been nationalized in its most horrible and revolting form. By that act, Mason and Dixon’s line has been obliterated; New York has become as Virginia; and the power to hold, hunt, and sell men, women, and children as slaves remains no longer a mere state institution, but is now an institution of the whole United States. The power is co-extensive with the Star-Spangled Banner and American Christianity. Where these go, may also go the merciless slave-hunter. Where these are, man is not sacred. He is a bird for the sportsman’s gun. By that most foul and fiendish of all human decrees, the liberty and person of every man are put in peril. Your broad republican domain is hunting ground for men. Not for thieves and robbers, enemies of society, merely, but for men guilty of no crime. Your lawmakers have commanded all good citizens to engage in this hellish sport. Your President, your Secretary of State, our lordsnobles, and ecclesiastics, enforce, as a duty you owe to your free and glorious country, and to your God, that you do this accursed thing. Not fewer than forty Americans have, within the past two years, been hunted down and, without a moment’s warning, hurried away in chains, and consigned to slavery and excruciating torture. Some of these have had wives and children, dependent on them for bread; but of this, no account was made. The right of the hunter to his prey stands superior to the right of marriage, and to all rights in this republic, the rights of God included! For black men there are neither law, justice, humanity, not religion. The Fugitive Slave Law makes mercy to them a crime; and bribes the judge who tries them. An American judge gets ten dollars for every victim he consigns to slavery, and five, when he fails to do so. The oath of any two villains is sufficient, under this hell-black enactment, to send the most pious and exemplary black man into the remorseless jaws of slavery! His own testimony is nothing. He can bring no witnesses for himself. The minister of American justice is bound by the law to hear but one side; and that side, is the side of the oppressor. Let this damning fact be perpetually told. Let it be thundered around the world, that, in tyrant-killing, king-hating, people-loving, democratic, Christian America, the seats of justice are filled with judges, who hold their offices under an open and palpable bribe, and are bound, in deciding in the case of a man’s liberty, hear only his accusers!

In glaring violation of justice, in shameless disregard of the forms of administering law, in cunning arrangement to entrap the defenseless, and in diabolical intent, this Fugitive Slave Law stands alone in the annals of tyrannical legislation. I doubt if there be another nation on the globe, having the brass and the baseness to put such a law on the statute-book. If any man in this assembly thinks differently from me in this matter, and feels able to disprove my statements, I will gladly confront him at any suitable time and place he may select.

I take this law to be one of the grossest infringements of Christian Liberty, and, if the churches and ministers of our country were not stupidly blind, or most wickedly indifferent, they, too, would so regard it.

At the very moment that they are thanking God for the enjoyment of civil and religious liberty, and for the right to worship God according to the dictates of their own consciences, they are utterly silent in respect to a law which robs religion of its chief significance, and makes it utterly worthless to a world lying in wickedness. Did this law concern the “mint, anise, and cumin” — abridge the right to sing psalms, to partake of the sacrament, or to engage in any of the ceremonies of religion, it would be smitten by the thunder of a thousand pulpits. A general shout would go up from the church, demanding repeal, repeal, instant repeal! — And it would go hard with that politician who presumed to solicit the votes of the people without inscribing this motto on his banner. Further, if this demand were not complied with, another Scotland would be added to the history of religious liberty, and the stern old Covenanters would be thrown into the shade. A John Knox would be seen at every church door, and heard from every pulpit, and Fillmore would have no more quarter than was shown by Knox, to the beautiful, but treacherous queen Mary of Scotland. The fact that the church of our country, (with fractional exceptions), does not esteem “the Fugitive Slave Law” as a declaration of war against religious liberty, implies that that church regards religion simply as a form of worship, an empty ceremony, and not a vital principle, requiring active benevolence, justice, love and good will towards man. It esteems sacrifice above mercy; psalm-singing above right doing; solemn meetings above practical righteousness. A worship that can be conducted by persons who refuse to give shelter to the houseless, to give bread to the hungry, clothing to the naked, and who enjoin obedience to a law forbidding these acts of mercy, is a curse, not a blessing to mankind. The Bible addresses all such persons as “scribes, Pharisees, hypocrites, who pay tithe of mintanise, and cumin, and have omitted the weightier matters of the law, judgment, mercy and faith.”

But the church of this country is not only indifferent to the wrongs of the slave, it actually takes sides with the oppressors. It has made itself the bulwark of American slavery, and the shield of American slave-hunters. Many of its most eloquent Divines. who stand as the very lights of the church, have shamelessly given the sanction of religion and the Bible to the whole slave system. They have taught that man may, properly, be a slave; that the relation of master and slave is ordained of God; that to send back an escaped bondman to his master is clearly the duty of all the followers of the Lord Jesus Christ; and this horrible blasphemy is palmed off upon the world for Christianity.

For my part, I would say, welcome infidelity! welcome atheism! welcome anything! in preference to the gospel, as preached by those Divines! They convert the very name of religion into an engine of tyranny, and barbarous cruelty, and serve to confirm more infidels, in this age, than all the infidel writings of Thomas Paine, Voltaire, and Bolingbroke, put together, have done! These ministers make religion a cold and flinty-hearted thing, having neither principles of right action, nor bowels of compassion. They strip the love of God of its beauty, and leave the throng of religion a huge, horrible, repulsive form. It is a religion for oppressors, tyrants, man-stealers, and thugs. It is not that “pure and undefiled religion” which is from above, and which is “first pure, then peaceable, easy to be entreated, full of mercy and good fruits, without partiality, and without hypocrisy.” But a religion which favors the rich against the poor; which exalts the proud above the humble; which divides mankind into two classes, tyrants and slaves; which says to the man in chains, stay there; and to the oppressor, oppress on; it is a religion which may be professed and enjoyed by all the robbers and enslavers of mankind; it makes God a respecter of persons, denies his fatherhood of the race, and tramples in the dust the great truth of the brotherhood of man. All this we affirm to be true of the popular church, and the popular worship of our land and nation — a religion, a church, and a worship which, on the authority of inspired wisdom, we pronounce to be an abomination in the sight of God. In the language of Isaiah, the American church might be well addressed, “Bring no more vain ablations; incense is an abomination unto me: the new moons and Sabbaths, the calling of assemblies, I cannot away with; it is iniquity even the solemn meeting. Your new moons and your appointed feasts my soul hateth. They are a trouble to me; I am weary to bear them; and when ye spread forth your hands I will hide mine eyes from you. Yea! when ye make many prayers, I will not hear. YOUR HANDS ARE FULL OF BLOOD; cease to do evil, learn to do well; seek judgment; relieve the oppressed; judge for the fatherless; plead for the widow.”

The American church is guilty, when viewed in connection with what it is doing to uphold slavery; but it is superlatively guilty when viewed in connection with its ability to abolish slavery. The sin of which it is guilty is one of omission as well as of commission. Albert Barnes but uttered what the common sense of every man at all observant of the actual state of the case will receive as truth, when he declared that “There is no power out of the church that could sustain slavery an hour, if it were not sustained in it.”

Let the religious press, the pulpit, the Sunday school, the conference meeting, the great ecclesiastical, missionary, Bible and tract associations of the land array their immense powers against slavery and slave-holding; and the whole system of crime and blood would be scattered to the winds; and that they do not do this involves them in the most awful responsibility of which the mind can conceive.

In prosecuting the anti-slavery enterprise, we have been asked to spare the church, to spare the ministry; but how, we ask, could such a thing be done? We are met on the threshold of our efforts for the redemption of the slave, by the church and ministry of the country, in battle arrayed against us; and we are compelled to fight or flee. From what quarter, I beg to know, has proceeded a fire so deadly upon our ranks, during the last two years, as from the Northern pulpit? As the champions of oppressors, the chosen men of American theology have appeared — men, honored for their so-called piety, and their real learning. The Lords of Buffalo, the Springs of New York, the Lathrops of Auburn, the Coxes and Spencers of Brooklyn, the Gannets and Sharps of Boston, the Deweys of Washington, and other great religious lights of the land have, in utter denial of the authority of Him by whom they professed to be called to the ministry, deliberately taught us, against the example or the Hebrews and against the remonstrance of the Apostles, they teach that we ought to obey man’s law before the law of God.

My spirit wearies of such blasphemy; and how such men can be supported, as the “standing types and representatives of Jesus Christ,” is a mystery which I leave others to penetrate. In speaking of the American church, however, let it be distinctly understood that I mean the great mass of the religious organizations of our land. There are exceptions, and I thank God that there are. Noble men may be found, scattered all over these Northern States, of whom Henry Ward Beecher of Brooklyn, Samuel J. May of Syracuse, and my esteemed friend (Rev. R. R. Raymond) on the platform, are shining examples; and let me say further, that upon these men lies the duty to inspire our ranks with high religious faith and zeal, and to cheer us on in the great mission of the slave’s redemption from his chains.

One is struck with the difference between the attitude of the American church towards the anti-slavery movement, and that occupied by the churches in England towards a similar movement in that country. There, the church, true to its mission of ameliorating, elevating, and improving the condition of mankind, came forward promptly, bound up the wounds of the West Indian slave, and restored him to his liberty. There, the question of emancipation was a high religious question. It was demanded, in the name of humanity, and according to the law of the living God. The Sharps, the Clarksons, the Wilberforces, the Buxtons, and Burchells and the Knibbs, were alike famous for their piety, and for their philanthropy. The anti-slavery movement there was not an anti-church movement, for the reason that the church took its full share in prosecuting that movement: and the anti-slavery movement in this country will cease to be an anti-church movement, when the church of this country shall assume a favorable, instead of a hostile position towards that movement. Americans! your republican politics, not less than your republican religion, are flagrantly inconsistent. You boast of your love of liberty, your superior civilization, and your pure Christianity, while the whole political power of the nation (as embodied in the two great political parties), is solemnly pledged to support and perpetuate the enslavement of three millions of your countrymen. You hurl your anathemas at the crowned headed tyrants of Russia and Austria, and pride yourselves on your Democratic institutions, while you yourselves consent to be the mere tools and body-guards of the tyrants of Virginia and Carolina. You invite to your shores fugitives of oppression from abroad, honor them with banquets, greet them with ovations, cheer them, toast them, salute them, protect them, and pour out your money to them like water; but the fugitives from your own land you advertise, hunt, arrest, shoot and kill. You glory in your refinement and your universal education yet you maintain a system as barbarous and dreadful as ever stained the character of a nation — a system begun in avarice, supported in pride, and perpetuated in cruelty. You shed tears over fallen Hungary, and make the sad story of her wrongs the theme of your poets, statesmen and orators, till your gallant sons are ready to fly to arms to vindicate her cause against her oppressors; but, in regard to the ten thousand wrongs of the American slave, you would enforce the strictest silence, and would hail him as an enemy of the nation who dares to make those wrongs the subject of public discourse! You are all on fire at the mention of liberty for France or for Ireland; but are as cold as an iceberg at the thought of liberty for the enslaved of America. You discourse eloquently on the dignity of labor; yet, you sustain a system which, in its very essence, casts a stigma upon labor. You can bare your bosom to the storm of British artillery to throw off a threepenny tax on tea; and yet wring the last hard-earned farthing from the grasp of the black laborers of your country. You profess to believe “that, of one blood, God made all nations of men to dwell on the face of all the earth,” and hath commanded all men, everywhere to love one another; yet you notoriously hate, (and glory in your hatred), all men whose skins are not colored like your own. You declare, before the world, and are understood by the world to declare, that you “hold these truths to be self evident, that all men are created equal; and are endowed by their Creator with certain inalienable rights; and that, among these are, life, liberty, and the pursuit of happiness;” and yet, you hold securely, in a bondage which, according to your own Thomas Jefferson, “is worse than ages of that which your fathers rose in rebellion to oppose,” a seventh part of the inhabitants of your country.

Fellow-citizens! I will not enlarge further on your national inconsistencies. The existence of slavery in this country brands your republicanism as a sham, your humanity as a base pretence, and your Christianity as a lie. It destroys your moral power abroad; it corrupts your politicians at home. It saps the foundation of religion; it makes your name a hissing, and a bye-word to a mocking earth. It is the antagonistic force in your government, the only thing that seriously disturbs and endangers your Union. It fetters your progress; it is the enemy of improvement, the deadly foe of education; it fosters pride; it breeds insolence; it promotes vice; it shelters crime; it is a curse to the earth that supports it; and yet, you cling to it, as if it were the sheet anchor of all your hopes. Oh! be warned! be warned! a horrible reptile is coiled up in your nation’s bosom; the venomous creature is nursing at the tender breast of your youthful republic; for the love of God, tear away, and fling from you the hideous monster, and let the weight of twenty millions crush and destroy it forever!

But it is answered in reply to all this, that precisely what I have now denounced is, in fact, guaranteed and sanctioned by the Constitution of the United States; that the right to hold and to hunt slaves is a part of that Constitution framed by the illustrious Fathers of this Republic.

Then, I dare to affirm, notwithstanding all I have said before, your fathers stooped, basely stooped

To palter with us in a double sense:
And keep the word of promise to the ear,
But break it to the heart.

And instead of being the honest men I have before declared them to be, they were the veriest imposters that ever practiced on mankind. This is the inevitable conclusion, and from it there is no escape. But I differ from those who charge this baseness on the framers of the Constitution of the United States. It is a slander upon their memory, at least, so I believe. There is not time now to argue the constitutional question at length — nor have I the ability to discuss it as it ought to be discussed. The subject has been handled with masterly power by Lysander Spooner, Esq., by William Goodell, by Samuel E. Sewall, Esq., and last, though not least, by Gerritt Smith, Esq. These gentlemen have, as I think, fully and clearly vindicated the Constitution from any design to support slavery for an hour.

Fellow-citizens! there is no matter in respect to which, the people of the North have allowed themselves to be so ruinously imposed upon, as that of the pro-slavery character of the Constitution. In that instrument I hold there is neither warrant, license, nor sanction of the hateful thing; but, interpreted as it ought to be interpreted, the Constitution is a GLORIOUS LIBERTY DOCUMENT. Read its preamble, consider its purposes. Is slavery among them? Is it at the gateway? or is it in the temple? It is neither. While I do not intend to argue this question on the present occasion, let me ask, if it be not somewhat singular that, if the Constitution were intended to be, by its framers and adopters, a slave-holding instrument, why neither slavery, slaveholding, nor slave can anywhere be found in it. What would be thought of an instrument, drawn up, legally drawn up, for the purpose of entitling the city of Rochester to a track of land, in which no mention of land was made? Now, there are certain rules of interpretation, for the proper understanding of all legal instruments. These rules are well established. They are plain, common-sense rules, such as you and I, and all of us, can understand and apply, without having passed years in the study of law. I scout the idea that the question of the constitutionality or unconstitutionality of slavery is not a question for the people. I hold that every American citizen has a right to form an opinion of the constitution, and to propagate that opinion, and to use all honorable means to make his opinion the prevailing one. Without this right, the liberty of an American citizen would be as insecure as that of a Frenchman. Ex-Vice-President Dallas tells us that the Constitution is an object to which no American mind can be too attentive, and no American heart too devoted. He further says, the Constitution, in its words, is plain and intelligible, and is meant for the home-bred, unsophisticated understandings of our fellow-citizens. Senator Berrien tell us that the Constitution is the fundamental law, that which controls all others. The charter of our liberties, which every citizen has a personal interest in understanding thoroughly. The testimony of Senator Breese, Lewis Cass, and many others that might be named, who are everywhere esteemed as sound lawyers, so regard the constitution. I take it, therefore, that it is not presumption in a private citizen to form an opinion of that instrument.

Now, take the Constitution according to its plain reading, and I defy the presentation of a single pro-slavery clause in it. On the other hand it will be found to contain principles and purposes, entirely hostile to the existence of slavery.

I have detained my audience entirely too long already. At some future period I will gladly avail myself of an opportunity to give this subject a full and fair discussion.

Allow me to say, in conclusion, notwithstanding the dark picture I have this day presented of the state of the nation, I do not despair of this country. There are forces in operation, which must inevitably work the downfall of slavery. “The arm of the Lord is not shortened,” and the doom of slavery is certain. I, therefore, leave off where I began, with hope. While drawing encouragement from the Declaration of Independence, the great principles it contains, and the genius of American Institutions, my spirit is also cheered by the obvious tendencies of the age. Nations do not now stand in the same relation to each other that they did ages ago. No nation can now shut itself up from the surrounding world, and trot round in the same old path of its fathers without interference. The time was when such could be done. Long established customs of hurtful character could formerly fence themselves in, and do their evil work with social impunity. Knowledge was then confined and enjoyed by the privileged few, and the multitude walked on in mental darkness. But a change has now come over the affairs of mankind. Walled cities and empires have become unfashionable. The arm of commerce has borne away the gates of the strong city. Intelligence is penetrating the darkest corners of the globe. It makes its pathway over and under the sea, as well as on the earth. Wind, steam, and lightning are its chartered agents. Oceans no longer divide, but link nations together. From Boston to London is now a holiday excursion. Space is comparatively annihilated. Thoughts expressed on one side of the Atlantic, are distinctly heard on the other. The far off and almost fabulous Pacific rolls in grandeur at our feet. The Celestial Empire, the mystery of ages, is being solved. The fiat of the Almighty, “Let there be Light,” has not yet spent its force. No abuse, no outrage whether in taste, sport or avarice, can now hide itself from the all-pervading light. The iron shoe, and crippled foot of China must be seen, in contrast with nature. Africa must rise and put on her yet unwoven garment. “Ethiopia shall stretch out her hand unto God.” In the fervent aspirations of William Lloyd Garrison, I say, and let every heart join in saying it:

God speed the year of jubilee
The wide world o’er
When from their galling chains set free,
Th’ oppress’d shall vilely bend the knee,

And wear the yoke of tyranny
Like brutes no more.
That year will come, and freedom’s reign,
To man his plundered fights again
Restore.

God speed the day when human blood
Shall cease to flow!
In every clime be understood,
The claims of human brotherhood,
And each return for evil, good,
Not blow for blow;
That day will come all feuds to end.
And change into a faithful friend
Each foe.

God speed the hour, the glorious hour,
When none on earth
Shall exercise a lordly power,
Nor in a tyrant’s presence cower;
But all to manhood’s stature tower,
By equal birth!
That hour will come, to each, to all,
And from his prison-house, the thrall
Go forth.

Until that year, day, hour, arrive,
With head, and heart, and hand I’ll strive,
To break the rod, and rend the gyve,
The spoiler of his prey deprive —
So witness Heaven!
And never from my chosen post,
Whate’er the peril or the cost,
Be driven.

The Ring-Bolt to the Chain of Our Nation’s Destiny: The Declaration of Independence at 242 Years

It is July 4th and the 241st anniversary of the declaration by the leaders of 13 colonies of their independence from Britain and the founding on a new nation. It was a nation founded on a principle of the Enlightenment, the principle that all men are created equal, and as their Declaration of Independence noted that as such are “endowed by their creator with certain unalienable rights, among which are life, liberty, and the pursuit of happiness.” 

Seventy-six years later the darkness of 1852 not long after the passage of the Compromise of 1850 which included an enhanced Fugitive Slave Act, it would be Frederick Douglass, the foremost Black abolitionist leader and himself an escaped slave would speak. The laws dictated that Northerners had to cooperate in the recapture and re-enslavement of blacks residing in their own states, regardless of their own state and local laws. While the Southern majority that crafted these laws always played the part of the aggrieved minority whose “states rights” were being threatened. But the reverse was true, with their majorities in the House and Senate which also included some Northern Congressmen and Senators, an always compliant White House, and a majority on the Supreme Court the Southerners used the threat of secession and civil war to enforce their mandates on the Free States.

On July 5th 1852 Douglass spoke these words these words to people who at the time were refused citizenship and who were enslaved:

“I have said that the Declaration of Independence is the ring-bolt to the chain of your nation’s destiny; so, indeed, I regard it. The principles contained in that instrument are saving principles. Stand by those principles, be true to them on all occasions, in all places, against all foes, and at whatever cost.”

Douglass understood this far better than many Americans in the South or the North. It would take a great and bloody war for most Americans to realize just how important the Declaration was to the destiny of the nation.  It would take far longer for the principle of an ever expanding understanding of liberty that included Blacks who were considered in law and statute as less than fully human.

One of the most notable of the apologists for White Supremacy was George Fitzhugh, a major Southern slaveholder and apologist for not only slavery but the inequality of poor whites and women. Fitzhugh spoke for many when he wrote against the principles of the Declaration:

“We must combat the doctrines of natural liberty and human equality, and the social contract as taught by Locke and the American sages of 1776. Under the spell of Locke and the Enlightenment, Jefferson and other misguided patriots ruined the splendid political edifice they erected by espousing dangerous abstractions – the crazy notions of liberty and equality that they wrote into the Declaration of Independence and the Virginia Bill of Rights. No wonder the abolitionists loved to quote the Declaration of Independence! Its precepts are wholly at war with slavery and equally at war with all government, all subordination, all order. It is full if mendacity and error. Consider its verbose, newborn, false and unmeaning preamble…. There is, finally, no such thing as inalienable rights. Life and liberty are not inalienable…. Jefferson in sum, was the architect of ruin, the inaugurator of anarchy. As his Declaration of Independence Stands, it deserves the appropriate epithets which Major Lee somewhere applies to the thought of Mr. Jefferson, it is “exuberantly false, and absurdly fallacious.

Fitzhugh also wrote:

“We conclude that about nineteen out of twenty individuals have “a natural and inalienable right” to be taken care of and protected, to have guardians, trustees, husbands or masters; in other words they have a natural and inalienable right to be slaves. The one in twenty are clearly born or educated in some way fitted for command and liberty.

A greater contrast of views regarding the Declaration is hard to be found. Abraham Lincoln would say about the contrasting views of liberty at a speech in Baltimore on April 18th 1864:

“The world has never had a good definition of the word liberty, and the American people, just now, are much in want of one. We all declare for liberty; but in using the same word we do not all mean the same thing. With some the word liberty may mean for each man to do as he pleases with himself, and the product of his labor; while with others the same word may mean for some men to do as they please with other men, and the product of other men’s labor. Here are two, not only different, but incompatible things, called by the same name, liberty. And it follows that each of the things is, by the respective parties, called by two different and incompatible names–liberty and tyranny.” 

Unfortunately these starkly contrasting views of liberty are still on display today. The President called Mexican and Central American refugees an “infestation” using a word that would to describe rats, insects or other disease carrying species. Members of his administration, Republican Congressmen and State Representatives, and members of various “conservative” media outlets, including their allies in the Alt-Right use the same language as Fitzhugh to declare for the superiority of the White race, to dehumanize Blacks, Mexicans, Arabs, and various dark skinned Asians and argue that darker skinned people are less than human and not entitled to liberty, equality and justice. A constant barrage of what quite literally amounts to state sponsored propaganda demonizes minorities, women, gays, the media, long term allies and alliances, and any potential political opponent.

Our Republic, its institutions and our freedom hinge on what Douglass called “the rig-bolt to the chains of our nation’s destiny,” and its principles “saving principles.” We must be dedicated to the proposition that “all men are created equal” or submit to tyranny.

The proposition in the Declaration that all men are created equal is essential to understanding or appreciating liberty. If we view others as below us, as even less than human then we cannot say that we believe in liberty. If we decide to limit the right of citizens to speak out because of their color, their national origin, their race, their religion, their gender, or sexual identity then we are not for liberty, we are no better than George Fitzhugh or others, even the Nazis, who enslaved, imprisoned, and exterminated others in the name of their power, and their right.

If our concept of liberty is so limited by our ideology that we cannot accept others having it or being equal to us then we stand against the very proposition that the United States was founded and we should bury the American experiment and stop lying about a proposition that we no longer believe in. The eminent American jurist wrote these words, which for me are like the Declaration, the Preamble of the Constitution, the Gettysburg Address, Lincoln’s Second Inaugural Address, and Dr. Martin Luther King Jr.’s I Have a Dream speech are secular scripture that are sacred to my understanding of being an American, and something that I will never yield. Judge Hand said:

“Liberty lies in the hearts of men and women; when it dies there, no constitution, no law, no court can even do much to help it. The spirit of Liberty is the spirit which is not too sure that it is right; the spirit of Liberty is the spirit which seeks to understand the minds of other men and women; the spirit of Liberty is that which weighs their interests alongside its own without bias.”

By Then It Was Too Late: Reflections on a Supreme Court Retirement

In his book They Thought they Were Free Milton Mayer wrote of his conversation with a German university professor colleague after the Second World War:

“How is this to be avoided, among ordinary men, even highly educated ordinary men? Frankly, I do not know. I do not see, even now. Many, many times since it all happened I have pondered that pair of great maxims, Principiis obsta and Finem respice—‘Resist the beginnings’ and ‘Consider the end.’ But one must foresee the end in order to resist, or even see, the beginnings. One must foresee the end clearly and certainly and how is this to be done, by ordinary men or even by extraordinary men? Things might have. And everyone counts on that might.

“Your ‘little men,’ your Nazi friends, were not against National Socialism in principle. Men like me, who were, are the greater offenders, not because we knew better (that would be too much to say) but because we sensed better. Pastor Niemöller spoke for the thousands and thousands of men like me when he spoke (too modestly of himself) and said that, when the Nazis attacked the Communists, he was a little uneasy, but, after all, he was not a Communist, and so he did nothing; and then they attacked the Socialists, and he was a little uneasier, but, still, he was not a Socialist, and he did nothing; and then the schools, the press, the Jews, and so on, and he was always uneasier, but still he did nothing. And then they attacked the Church, and he was a Churchman, and he did something—but then it was too late.”

I feel that if we already haven’t reached to point of things being too late that we are not far from that point and we are closer now with the Justice Anthony Kennedy’s announcement of his retirement from the Supreme Court.

Kennedy announced his retirement yesterday after siding with so-called conservatives on President Trump’s Executive Order targeting Muslims primarily from Iran as supposed security threats. It was an ignominious exit from the Supreme Court for a man who though certainly conservative often acted as the conscience of the court who wrestled with difficult issues and sometimes sided with liberals such in the Obergfell v. Hodges case that at least for now legalized marriage equality.

The decision regarding the Executive Order overturned the decision of Korematsu v. United States which upheld the military orders to send Americans of Japanese descent to detention centers, what in were effect American Concentration Camps. JThat ruling along with Dred Scott and Plessy v. Ferguson is considered one of the most unjust in American history. Justice Robert Jackson who later presided as the organizer and chief prosecutor at the Nuremberg War Crimes Trials wrote in dissent of that ruling:

“A military commander may overstep the bounds of constitutionality, and it is an incident. But if we review and approve, that passing incident becomes the doctrine of the Constitution. There it has a generative power of its own, and all that it creates will be in its own image. Nothing better illustrates this danger than does the Court’s opinion in this case.” 

That is the danger of the Executive Order that the Court upheld. Justice Roberts used the twisted logic of Korematsu to uphold the ruling even as he overturned Korematsu. Justice Kennedy concurred and then retired from the Court leaving a vacancy that will almost be certainly filled by a young, aggressive, and doctrinaire conservative of the new order, unrestrained by precedent or principle. Unless the Democrats go Full Bork Jacket and at least two Republicans grow a set of balls civil rights, civil liberties, and the Constitution are doomed.

The man that nominates Kennedy’s successor is even now under investigation for actions that could be considered by a reasonable person as treason against the United States. That man is the President and almost every day he uses power of his office to demonize any opposition and to dehumanize racial, ethnic, and religious minorities while attacking the freedoms enshrined in the Constitution to free speech and the freedom of the press by referring to his critics as “enemies of the people.” 

The President has invoked violence against his opponents since he was a candidate and then cries foul when political opponents urge non-violent resistance to include the public shaming of his staff members and Cabinet officials who plan (Stephen Miller), execute (Kirstjen Nielsen), and defend (Sarah Huckabee Sanders) his actions against helpless people who he labels as murderers, rapists, and criminals.

Sadly most are refugees from political and criminal persecution and violence in their countries, countries that since the 1840s Americans or the United States Government have treated as subhumans. What is happening now is the result of our past polcies coming home to roost.

Marine Corps Major General and two time Medal of Honor Recipient Smedley Butler wrote in his book War is a Racket:

“I spent 33 years and four months in active military service and during that period I spent most of my time as a high class muscle man for Big Business, for Wall Street and the bankers. In short, I was a racketeer, a gangster for capitalism. I helped make Mexico and especially Tampico safe for American oil interests in 1914. I helped make Haiti and Cuba a decent place for the National City Bank boys to collect revenues in. I helped in the raping of half a dozen Central American republics for the benefit of Wall Street. I helped purify Nicaragua for the International Banking House of Brown Brothers in 1902-1912. I brought light to the Dominican Republic for the American sugar interests in 1916. I helped make Honduras right for the American fruit companies in 1903. In China in 1927 I helped see to it that Standard Oil went on its way unmolested. Looking back on it, I might have given Al Capone a few hints. The best he could do was to operate his racket in three districts. I operated on three continents.”

Despite the fact that the United States has been interfering and exploiting their countries for almost two centuries they are criminals because they want to be free. Their crime is being refugees after the United States instituted race based immigration policies in the early 1900s. These policies were later used to deny Jews fleeing the Holocaust from coming to the United States.

Justice Kennedy left after a series of rulings which seemed to undermine his past judicious behavior on the bench. Maybe at 82 years old he simply decided to punt and place his vote in the column of men who gut the Voting Rights Act, support gerrymandered Congressional districts, and support Executive Orders that while refuting the notorious Supreme Court Decision of Korematsu v. United States used the same logic as that majority used to uphold the President’s third attempt at a travel ban directed a Muslims, primarily Iranians. Japanese Americans who suffered under the military orders enforced by civilian courts and upheld by Korematsu were appalled with good reason.

In Today’s Struggle for Principle with Trump there Will be No Republican Stephen A. Douglas

As I watch President Trump’s administration attack the law, the Constitution, and violate the civil rights and human rights of citizens as well as people who have come to the United States to flee oppression and danger at home; to threaten freedom of speech and freedom of the press; to categorize political opponents inside and outside of his party as traitors; to legitimize the most repressive dictatorial regimes while attacking longstanding allies; even as he works to destroy the work of American Presidents and diplomats to build a world order that has brought great benefit to the United States and the world by defeating the Nazis, Imperial Japan, and eventually the Soviet Union. He has chosen the choice of being a rogue superpower rather than being the moderating and stabilizing force in the world that it has played since World War Two. Robert Kagan wrote in the Washington Post yesterday:

“The United States’ adversaries will do well in this world, for Trump’s America does not want war. It will accommodate powers that can harm it. It will pay them the respect they crave and grant them their spheres of interest. Those that depend on the United States, meanwhile, will be treated with disdain, pushed around and used as pawns. At times, they will be hostages to be traded for U.S. gain. The United States and the postwar liberal order protected them and helped them prosper, but it also left them vulnerable to any American leader willing to offer them up as sacrifices to appease aggressors. That is a kind of realism, too… It recognizes no moral, political or strategic commitments. It feels free to pursue objectives without regard to the effect on allies or, for that matter, the world. It has no sense of responsibility to anything beyond itself.”

The President and his administration show little regard for the Constitution and established law in this country and our treaties and agreements with other nations. He appoints men and women who had they been Germans after the Second World War would have been charged with war crimes and crimes against humanity to high office. He defends White Nationalists and Neo-Nazis. He confounds loyalty to himself with patriotism and loyalty to the country.

He uses propaganda to demonize those who seek law and justice. In any normal time a cry would arise from his own party saying “no more,” but his party does nothing, and even those leaders who occasionally speak out against his policies take no actions because they are afraid of retribution. That happened to long time conservative Congressman Mark Sanford in South Carolina this week when the President tweeted his support for his primary opponent. During the primary season White Nationalists, self-proclaimed Nazis, and other Trump supporters advocating the most extreme, unconstitutional and abhorrent positions often swept the field against conservatives who themselves would have been considered extremists just a few years ago. The GOP is on the Party if Trump and it took less than two years to become so.

Barbara Tuchman wrote in her book The March of Folly: From Troy to Vietnam something that we are observing up close and personal as President Trump and his administration flounder in a sea of make believe, a cloud cuckoo land of alternative facts, alternative truth, and alternative history:

“Wooden-headedness, the source of self-deception, is a factor that plays a remarkably large role in government. It consists in assessing a situation in terms of preconceived fixed notions while ignoring or rejecting any contrary signs. It is acting according to wish while not allowing oneself to be deflected by the facts.”

To be true, the Trump administration is not the first in history, in fact not even in our own country to ignore facts when making decisions. However, it is remarkable in its ability not only to shun facts but to make up its own narrative that depends on denying reality while impugning the character, honesty, and decency of those who present facts and truth that is verifiable. To be sure, competence and prudence are not and probably will never be marks of President Trump, his closest advisors, or his enablers in Congress. My hope is that some Republican in either the House or Senate rises up to confront the ineptitude and folly being demonstrated on a daily basis.

President James Buchanan

In some ways the incompetence and refusal to deal with reality by the Trump administration reminds me of the administration of James Buchanan during the years before the American Civil War. Buchanan’s collusion with Chief Justice Roger Taney regarding the Dred Scott decision before his inauguration stained him from the beginning and poisoned his relationship with Congress by declaring that the Congress never had the right to limit slavery as it had in the Missouri Compromise. Buchanan’s presidency is considered by most historians to be the worst in American history, incompetent, arrogant, and ineffective.

Likewise, Buchanan’s attempt to jam the Lecompton Constitution through Congress as a reward to Southern Democrats blew up in his face. The Lecompton Constitution was a gerrymandered bill which ignored the will of the vast majority of Kansas’s settlers who were anti-slavery. The work of the pro-slavery element in Kansas was so onerous that it brought Republicans and Northern Democrats together for the first time as Southern Democrats threatened secession if Kansas was not admitted as a Slave State. Ignoring warnings that supporting a measure that would open the door to slavery in all the western territories would split his party, Buchanan pushed on. His intransigence on the matter brought Democratic Senator Stephen A. Douglas of Illinois to the fore in opposing it. Nicknamed “the Little Giant,” Douglas was the odds on favorite to be the Democratic nominee for the Presidency. Douglas was not against the institution of slavery, and he was a racist, but he had no tolerance for those who would upend carefully crafted compromises to expand it through the whole country. Thus he  took his case to the floor of the Senate and to the President himself.

The Confrontation between the Senator and the President was unparalleled. Douglas recalled, “The Lecompton constitution, I told Buchannan bluntly, was a blatant fraud on the people of Kansas and the process of democracy, I warned him not to recommend acceptance of it. With his head titled forward in that bizarre habit of his, he said that he intended to endorse the constitution and send it to Congress. “If you do,” I thundered, “I’ll denounce it the moment that it is read.” His face turned red with anger. “I’ll make Lecompton a party test,” he said. “I expect every democratic Senator to support it.” I will not, sir!

Angry and offended by the confrontation of Douglas, Buchanan cut the senator off and issued his own threat to Douglas and his political career saying, “I desire you to remember that no Democrat ever yet differed from an administration of his own choice without being crushed….Beware of the fate of Tallmadge and Rives,” two senators who had gone into political oblivion after crossing Andrew Jackson.” The redoubtable Senator from Illinois was undeterred by the President’s threat and fought back, “Douglas riposted: “Mr. President, I wish to remind you that General Jackson is dead, sir.”  It was an unprecedented action by a sitting Senator, to confront a President of one’s own party and threaten to oppose him in Congress was simply not done, but now Douglas was doing it, but doing so to his President’s face, and the consequences for him, his party, and the country would be immense.

Undeterred by facts, Buchanan and Southern Democrats fought for the bill’s passage. When Buchanan’s supporters pushed for Lecompton’s approval and the admission of Kansas as a Slave State, Douglas fired back, warning “You do,” I said, “and it will lead directly to civil war!” I warned the anti-Lecompton Democrats of the North that the President intended to put the knife to the throat of every man who dared to think for himself on this question and carry out principles in good faith. “God forbid,” I said “that I ever surrender my right to differ from a President of the United States for my own choice. I am not a tool of any President!”

Under Douglas the Northern Democrats joined with Republicans for the first time to defeat the admission of Kansas as a Slave State. Douglas recalled the battle:

“After the Christmas recess, the Administration unleashed its heavy horsemen: Davis, Slidell, Hunter, Toombs, and Hammond, all southerners. They damned me as a traitor and demanded that I be stripped of my chairmanship of the Committee on Territories and read out of the Democratic party. Let the fucking bastards threaten, proscribe, and do their worst, I told my followers; it would not cause any honest man to falter. If my course divided the Democratic party, it would not be my fault. We were engaged in a great struggle for principle, I said, and we would defy the Administration to the bitter end.”

Douglas and his supporters did just that, Buchanan and his supporters were outfought and outmaneuvered by Douglas’s Democrats and their Republican allies. The bill was sent back to Kansas where in a new election the people of Kansas voted solidly against the Lecompton Constitution. In the following Congressional elections the thoroughly discredited Democrats lost their majority, their party now hopelessly divided with Southerners determined to destroy Douglas at any cost, even if it meant losing the presidency, the conflict opened the door for the election of Abraham Lincoln in 1860.

I wonder if there will be a Republican in the Congress with the courage that Stephen A. Douglas displayed in confronting the incompetent and vindictive President Buchanan during the Lecompton Crisis. Will there be a Republican with enough courage to stop the insanity of the Trump administration even if it means in the short term to divide the party and doom their political future? Honestly I doubt it as does conservative Republican political strategist Rick Wilson. Wilson wrote:

“Nothing you do matters to this Congress. No matter what damage you inflict on our economy, our alliances, trade, our stature in the world, our role as an exemplar of democratic values, our ability to serve as an honest broker in the international community, and our security, Paul Ryan and Mitch McConnell will lay supine before you.” 

But if Trump’s march of folly is to be stopped, someone in the Republican Senate or House will have to have the courage to stand up and defend the necessity of thinking for themselves, and doing what is right, sadly there is no Stephen Douglas in today’s GOP.

The Offering We Bring: the Observance of Memorial Day

This is Memorial Day weekend and for the vast majority of Americans, even those who loudly claim to “support the troops” the weekend is little more than an opportunity to start the summer. There will be ball games and picnics, parties and concerts, as well as road trips, and some will even honor the military personnel that are currently serving; however, that is not why we observe Memorial Day.

Memorial Day is observed to honor the lives and sacrifice of those men and women who died in the service of the country. Its roots go back to May 1865 when newly freed Blacks in Charleston South Carolina took the time to honor the fallen Union soldiers by dedicating a cemetery to them. I’ll go back to that in a bit.

Frederick Douglass discussed the meaning of Memorial Day in 1884:

“Dark and sad will be the hour to this nation when it forgets to pay grateful homage to its greatest benefactors. The offering we bring to-day is due alike to the patriot soldiers dead and their noble comrades who still live; for, whether living or dead, whether in time or eternity, the loyal soldiers who imperiled all for country and freedom are one and inseparable.”

Memorial Day, at one time known as Decoration Day is one of our most sacred civil holidays that we observe in the United States, or at least it should be. It was a holiday born out of the shedding of the blood of about 750,000 American soldiers, from the North and the South in the Civil War, a singular event that still echoes in our history and in some sense defines who we are and it is important that we come to understand its meaning and history.

The Racecourse Cemetery

The first observance of what we now know as Memorial Day is fascinating and it needs to be remembered. Frederick Douglass was absolutely right when he spoke the words that I began this article, and we need to remember the humble beginnings of this day which was first marked by recently freed slaves in Charleston South Carolina on May 1st 1865. They did so barely two weeks after Abraham Lincoln was assassinated and three weeks after Robert E. Lee surrendered the Army of Northern Virginia at Appomattox Court House.

The acrid smell of smoke of the last battles of the American Civil War was still lingering over many towns and cities in the South on May 1st 1865. Charleston, the hotbed of secession was particularly hard hit during the war. In 1861 Cadets of the Citadel and South Carolina militia forces began the war with the bombardment of Fort Sumter. Union Forces laid siege to the city in late 1863, a siege which ended with the city’s surrender to Union forces under the command of William Tecumseh Sherman on 18 February 1865. The day of the surrender was somewhat ironic. Charleston, the city most associated with the opening of the conflict surrendered to Union forces on the fourth anniversary of the inauguration of Jefferson Davis as President of the Confederacy. By the time of its surrender much of the city had been destroyed by Union siege artillery and naval forces.

As a Confederate stronghold Charleston had also been the home of three of the Prisoner of War Camps. One was located in the Charleston City Jail and the other at Castle Pinckney which had been one of the ante-bellum U.S. Army installations in the city. A third camp was erected on the site of the Washington Race Course and Jockey Club in 1864. This was an open air camp and Yale Historian David Blight wrote that “Union soldiers were kept in horrible conditions in the interior of the track; at least 257 died of exposure and disease and were hastily buried in a mass grave behind the grandstand.”

By the end of the war most of the white population of the city had left and most of those remaining were recently freed slaves. After their liberation and the city’s occupation by Federal forces, which included the famous 54th Massachusetts as well as the 20th, 35th and 104th US Colored Troops Regiments; about 28 recently liberated Black men went to work and properly reinterred the 257 Union dead on the raceway and built a high fence around it. They inscribed “Martyrs of the Race Course” on an arch above the cemetery entrance.

On May 1st over 10,000 Black Charlestonians gathered at the site to honor the fallen. Psalms, Scriptures and prayers were said, hymns were sung and many brought flowers. A parade of 2800 children covered the burial ground with flowers. They were followed by members of the Patriotic Association of Colored Men and the Mutual Aid Society. This society’s members provided relief supplies to Freedmen and provided aid to bury those Blacks who were too poor to afford burial. More citizens followed many laying flower bouquets on the graves. Children then led the singing of The Star Spangled Banner, America and Rally around the Flag. The Brigade composed of the 54th Massachusetts and the 35th and 104th Colored Regiments marched in honor of their fallen comrades. Following the formalities many remained behind for a picnic.

Other communities established their own Memorial Day observances in the years following the war, but the event in Charleston was the first. The first “Official” commemoration was on 30 May 1868 when Union General John Logan who headed the veteran’s organization called The Grand Army of the Republic appealed to communities to honor the dead by holding ceremonies and decorating the graves of the fallen.

In the South three different days served a similar purpose. In Virginia people commemorated the day on June 3rd, the birthday of Confederate President Jefferson Davis, the Carolinas marked the day on 10 May, the birthday of General Thomas “Stonewall” Jackson. In much of the Deep South the event was conducted April 26th, the anniversary of the surrender of General Joseph Johnson’s Army to General William Tecumseh Sherman. For many in the South, still attempting to come to grips with their defeat the day would become about “The Lost Cause” or “the defense of Liberty” or “States Rights” and the war was often referred to as the “War of Northern Aggression.”

The “Martyrs of the Racecourse” cemetery is no longer there. The site is now a park honoring the fascinatingly complex Confederate General and post-Reconstruction Governor of South Carolina Wade Hampton. An oval track remains in the park and is used to run or walk by the local population and cadets from the Citadel. Thankfully, at long last in 2010, one hundred and forty-five years after the dedication of that cemetery a marker was placed in that park commemorating the cemetery and the event that we now recognize as the first Memorial Day.

The Union dead who had been so beautifully honored by the Black population were moved to the National Cemetery at Beaufort South Carolina by the 1880s. Some state that the reason for this was that the cemetery had fallen into neglect, and this may be the case, but the event and their memory conveniently erased from memory of Charlestonians.

I do not think that this would have happened had the people who had the bodies moved simply restored and maintained the cemetery. Had not historian David Blight found the documentation we probably still would not know of this touching act by former slaves who honored those that fought the battles, and gave their lives to win their freedom. Blight wrote in 2011 in the 1870s Charleston “had no place for the former slaves’ march on their masters’ racecourse.”

The African American population of Charleston understood the bonds of slavery and oppression. They understood the tyranny of prejudice in which they only counted as 3/5ths of a person. They understood and saw the suffering of those that were taken prisoner while attempting to liberate them from the tyranny of slavery. They stand as an example for us today.

But their suffering was not over. Within little more than a decade Blacks in the South would be subject to Jim Crow and again treated by many whites as something less than human. The struggle of they and their descendants against the tyranny of racial prejudice, discrimination and violence over the next 100 years would finally bear fruit in the Civil Rights movement, some of whose leaders, like the Reverend Doctor Martin Luther King Jr. would also become martyrs. Unfortunately that struggle is not over.

Frederick Douglass spoke to Union Veterans on Memorial Day 1878. His words, particularly in light of the war and the struggles of African Americans since and the understanding of what those who were enslaved understood liberation to be are most significant to our time. It was not merely a war based on sectionalism or even “States rights,” it was a war of ideas, a war of diametrically opposed ideologies. He said:

“But the sectional character of this war was merely accidental and its least significant feature. It was a war of ideas, a battle of principles and ideas which united one section and divided the other; a war between the old and new, slavery and freedom, barbarism and civilization; between a government based upon the broadest and grandest declaration of human rights the world ever heard or read, and another pretended government, based upon an open, bold and shocking denial of all rights, except the right of the strongest.”

Douglass’s words were powerful then and they resonate today as many of the same ideas that were the cause of the Civil War and were continued during Jim Crow are still alive. Unfortunately there are those in our society who labor daily to establish the “rights” of the strongest over the weak, the poor, the powerless and minorities of all kinds. Of course such actions, often wrapped in the flag, patriotism and buttressed with cherry picked quotes (many of which are fake, changed or taken out of context) from some of our founders are designed to re-establish the oligarchy of the power of the few, much like the men who owned the lives of the slaves and poor whites in the ante-bellum American South. Such actions do nothing but demean and trample the sacrifice of those who fought for freedom and the only remedy is to fight them with the full knowledge of truth.

I do hope that today we will observe Memorial Day in a fitting manner. Let us honor those Americans who died that others might be free. Let us look back at what freedom actually means and not forget the sacrifices of those that gave, and still give their lives in the “last full measure of devotion to duty” that others might live. This is especially true in an era where the racial and religious hatred and prejudice of Southern Slave Power, and Northern Know Nothings, that enslaved African Americans, exterminated Native American, invaded and Mexico, and treated Irish, German, Asian, and other immigrants, Roman Catholics, and Jews as enemies is raising its head as White Supremacists take their cue from the President that such behavior is acceptable.

Take a moment on Monday at noon to pause what you are doing and go silent for at least one minute, and remember.

“We’ve Got Some Difficult Days Ahead…” The Assassination of Dr. Martin Luther King Jr. at 50 Years

Fifty years ago today a bullet killed Dr. Martin Luther King Jr. while he was in Memphis supporting Sanitation Workers who were being subjected to unsafe working conditions without the same rights, protections, pay, or benefits of white Sanitation workers. As always there were threats on King’s life and he knew that he was a target. The night before his assassination Dr. King spoke at Mason Temple the international headquarters of the Church of God in Christ, the largest historically Black denomination in the United States.

That speech is now known as the “I have been to the mountaintop” speech. Dr. King had flown into Memphis earlier in the day, on a flight delayed by a bomb threat. King like many Civil Rights leaders of his day lived under the constant threat of physical violence, intimidation and assassination. After the heady days of the great march in Washington and the I Have a Dream speech and the award of the Nobel Prize his positions on social and economic justice and his opposition to the Vietnam War had made him a pariah of sorts, even in the Black community. He had place himself in the gunsights of his opponents as he pressed on in spite of the opposition.

Life was precious to him, but he like many others understood that it could be cut short at any moment for simply speaking the truth about racial discrimination, prejudice and violence. King himself had been accosted at different times and spent time in jail for “breaking” laws that enforced and enabled institutions and individuals to discriminate against Blacks with no consequences whatsoever. He was called a radical, a Communist and anti-American by those that opposed any changes to the status quo. He knew that his life was always in danger.

In that speech Dr. King seemed to understand the threat but he was determined to go on and to do God’s will. Dr. King understood that the Christian faith required more than intellectual assent to a doctrine. He understood the words of the German martyr Dietrich Bonhoeffer: We are not to simply bandage the wounds of victims beneath the wheels of injustice, we are to drive a spoke into the wheel itself.”

At Mason Temple Dr King proclaimed:

“And then I got to Memphis. And some began to say the threats…or talk about the threats that were out… What would happen to me from some of our sick white brothers? Well I don’t know what will happen now. We’ve got some difficult days ahead. but it doesn’t matter with me now. Because I been to the mountaintop. And I don’t mind. Like anybody, I would like to live a long life. Longevity has its place. But I’m not concerned about that now. I just want to do God’s will. And He’s allowed me to go up to the mountain. And I’ve looked over.and I have seen the promised land. I may not get there with you. But I want you to know tonight, that we, as a people, will get to the promised land! And so I am happy, tonight. I’m not worried about anything. I am not fearing any man. Mine eyes have seen the glory of the coming of The Lord.”

It was April 4th 1968. The United States was divided by the Vietnam War and numerous social crises. President Lyndon Johnson had just done the unthinkable, he had announced that he was withdrawing from his reelection bid. In many places despite the integration of the Armed Forces, Baseball, the repeal of many Jim Crow laws and the passage of the 1964 Voter’s Rights Act African Americans still felt the sting of individual and institutional racial prejudice. In Vietnam the effects of the Tet Offensive still lingered even as American cities burned.

His speech at Mason Temple was almost prophetic in its message. The words of the thirty-nine year old Baptist Preacher from Atlanta echoed through the sanctuary of the church to the applause of those present even as a heavy spring thunderstorm rocked the city.

The following evening, King with a number of other Civil Rights leaders including Ralph Abernathy and Andrew Young were at the Lorraine Motel, where King often stayed. King was standing on the balcony outside of his room, Room 306 when at 6:01 PM he was cut down and mortally wounded by a single shot fired from a Remington 760 rifle. The bullet struck him in the right cheek, traveled down his spine and severed his jugular vein and several major arteries before it came to rest in his shoulder. He still had a heartbeat when the ambulance arrived and on his arrival at St Joseph’s Hospital. Efforts to revive him by opening his chest and attempting cardiac massage were unsuccessful and at 7:05 PM Dr King was pronounced dead.

Witnesses reported a man named James Earl Ray fleeing the area after the shooting. The Remington rifle and a pair of binoculars with Ray’s fingerprints were found at the scene. Ray was apprehended at London’s Heathrow Airport two months later. Ray was tried and convicted of Dr King’s murder. He was sentenced to 99 years in prison and died in 1998. During the trial Ray recanted his confession, implicated an unknown man named “Raul” who he had supposedly met in Montreal as being involved and said that “he personally did not kill” Dr King hinting at a conspiracy. Ray plead guilty to avoid the death penalty.

Other theories were postulated about the murder and Lloyd Jowers who owned a restaurant across from the Lorraine Motel claimed in a 1993 interview that the US Government and the Mafia were complicit in the killing, that Ray was a scapegoat and that Memphis Police Lieutenant Earl Clark was the shooter.

Jowers’ story is disputed but it was believed by King’s widow Coretta Scott King.  She filed a wrongful death lawsuit in which a jury found that Jowers and others including government agencies were guilty of the plot to kill Dr King on December 8th 1998. Though Jowers’ story was contradicted by much of his own testimony during the trial the results have caused a divide in who experts believe killed Dr King. As for the King family they reconciled with Ray before his death.

Regardless of who killed Dr King the result was a shock to much of the nation and in many places riots broke out despite the pleadings of most Civil Rights leaders to continue in Dr King’s path of non-violence.

Senator Robert F Kennedy, then running for the Democratic Party nomination for President learned of Dr King’s shooting just before flying to Indianapolis for a campaign rally. On his arrival he learned of Dr King’s death. Warned by police that he could be in danger he made an impromptu speech from the back of a flat bed truck. The speech was short, under 5 minutes but its message is applicable even today.

“Ladies and Gentlemen,

I’m only going to talk to you just for a minute or so this evening, because I have some — some very sad news for all of you — Could you lower those signs, please? — I have some very sad news for all of you, and, I think, sad news for all of our fellow citizens, and people who love peace all over the world; and that is that Martin Luther King was shot and was killed tonight in Memphis, Tennessee.

Martin Luther King dedicated his life to love and to justice between fellow human beings. He died in the cause of that effort. In this difficult day, in this difficult time for the United States, it’s perhaps well to ask what kind of a nation we are and what direction we want to move in. For those of you who are black — considering the evidence evidently is that there were white people who were responsible — you can be filled with bitterness, and with hatred, and a desire for revenge.

We can move in that direction as a country, in greater polarization — black people amongst blacks, and white amongst whites, filled with hatred toward one another. Or we can make an effort, as Martin Luther King did, to understand, and to comprehend, and replace that violence, that stain of bloodshed that has spread across our land, with an effort to understand, compassion, and love.

For those of you who are black and are tempted to fill with — be filled with hatred and mistrust of the injustice of such an act, against all white people, I would only say that I can also feel in my own heart the same kind of feeling. I had a member of my family killed, but he was killed by a white man.

But we have to make an effort in the United States. We have to make an effort to understand, to get beyond, or go beyond these rather difficult times.

My favorite poem, my — my favorite poet was Aeschylus. And he once wrote:

Even in our sleep, pain which cannot forget falls drop by drop upon the heart, until, in our own despair, against our will, comes wisdom through the awful grace of God.

What we need in the United States is not division; what we need in the United States is not hatred; what we need in the United States is not violence and lawlessness, but is love, and wisdom, and compassion toward one another, and a feeling of justice toward those who still suffer within our country, whether they be white or whether they be black.

So I ask you tonight to return home, to say a prayer for the family of Martin Luther King — yeah, it’s true — but more importantly to say a prayer for our own country, which all of us love — a prayer for understanding and that compassion of which I spoke.

We can do well in this country. We will have difficult times. We’ve had difficult times in the past, but we — and we will have difficult times in the future. It is not the end of violence; it is not the end of lawlessness; and it’s not the end of disorder.

But the vast majority of white people and the vast majority of black people in this country want to live together, want to improve the quality of our life, and want justice for all human beings that abide in our land.

And let’s dedicate ourselves to what the Greeks wrote so many years ago: to tame the savageness of man and make gentle the life of this world. Let us dedicate ourselves to that, and say a prayer for our country and for our people.

Thank you very much.”

Two months later Kennedy was shot and mortally wounded by Sirhan Sirhan after winning the California Primary.

The loss of Dr King and later Senator Kennedy was profound. So tonight take the time to remember and pray that we all will be able to go to the mountain and see the promised land where in a more perfect Union we will heal the wounds that so divide our country.

Today the rights that Dr. King and so many others fought for dating back to the days of Frederick Douglass are being rolled back at the local, state and Federal level. The administration of President Trump and Republican led statehouses have been working overtime to silence dissent, discredit opposition, and through unjust laws and policies upend the civil rights not only of Blacks, but other people of color, immigrants, women, LGBTQ people, and Muslims.

Dr. King noted the night before he was slain that “we’ve got some difficult days ahead” but as he told his staff in January 1968 “Hope is the final refusal to give up.”

“I Could Not Afford To Fail” Admiral Samuel Gravely Jr. and Civil Rights

Today in keeping with the theme of Black H“African Americans in Time of War” I am posting an article about a pioneer of civil rights in the United States Navy.

Vice Admiral Samuel Gravely Jr. is among the great pioneers of civil rights in the U.S. Military. The first African-American ever to be promoted to Flag rank he helped pave the way for so many others. Gravely understood the pressures on him at every stage of his career, He wrote:

“I was sure that I could not afford to fail. I thought that would affect other members of my race if I failed anywhere along the line. I was always conscious of that, particularly in midshipman school and any other schools I went to…I tried to set a record of perfect conduct ashore and at sea.”

Things have changed much since 1942 when following the attack on Pearl Harbor a young black college student from Richmond Virginia enlisted in the Navy. Samuel Gravely Jr. was the son of a postal worker and Pullman porter while his mother worked as a domestic servant for white families in Richmond. His mother died unexpectedly when he was 15 in 1937 and he remained to help care for his siblings as his father continued to work. Balancing the care of his family with his education he enrolled in Virginia Union College, a Baptist school in Richmond.

It is hard to imagine for most of us now to comprehend the world that the young Gravely grew up in. Segregation was the norm. Blacks in the south and many other locations faced personal as well as entrenched institutional racism. Violence against blacks was quite common and the Ku Klux Klan was strong.

The military was still segregated and a great gulf existed between white military personnel and blacks. Though the selective service law of 1940 called for the conscription of people regardless of race, creed or color the services enjoyed much latitude in determining how minorities could serve. The Secretary of the Navy at the time, Frank Knox resisted integration. Knox determined that African Americans would remain segregated and serve only as Mess Stewards to “prevent undermining and disruptive conditions in the Navy.” Knox told President Roosevelt in the presence of black leaders that “because men live in such intimacy aboard ship that we simply can’t enlist Negroes above the rank of messman. “

That sentiment was strong in both the Navy and the Marines, even more so than in the Army and Army Air Corps. The leaders of both the Navy and Marine Corps resisted attempts to broaden the ability for African Americans to serve and urged that blacks serve in the Army, not the Naval Service.  Marine Corps Commandant Major General Thomas Holcomb agreed with this stance. He commented:

“If we are defeated we must not close our eyes to the fact that once in they [Negroes] will be strengthened in their effort to force themselves into every activity we have. If they are not satisfied to be messmen. they will not be satisfied to go into the constriction or labor battalions. Don’t forger the colleges are turning out a large number of well educated Negroes. I don’t know how long we will be able to keep them out of the V-7 class. I think not very long.”

But Roosevelt was not deterred and by April 1942 changes were announced to allow African Americans to serve in other capacities. Even so African Americans selected for ratings other than messman were to be segregated and commanded by White Officers and Petty Officers.

Gravely enlisted in the Navy under these conditions. Serving as a Fireman Apprentice after receiving training as a Motor Machinist in San Diego he worked in menial jobs. In 1943 Gravely was one of only three sailors in his unit to be selected for the V-12 officer training program. He was the only black to make the cut. He was commissioned as an Ensign on December 14th 1944 and assigned to train black recruits at Great Lakes though the vast majority of his class went to sea. The was mainly due to the policy set forth by the General Board in 1942 that prescribed:

“(a) the white man will not accept the negro in a position of authority over him; (b) the white man considers that he is of a superior race and will not admit the negro as an equal; and (c) the white man refuses to admit the negro to intimate family relationships leading to marriage. These concepts may not be truly democratic, but it is doubtful if the most ardent lovers of democracy will dispute them, particularly in regard to inter-marriage.”

Despite this by 1945 the Navy was beginning to change. Gravely was chosen to serve on one of two ships assigned to the “experiment” of seeing how blacks in general ratings could serve at sea. The USS Mason (DE 539) and the USS PC-1264 were assigned black crews with majority white officers, except that Gravely was assigned to PC-1264. Though his commander was pleased with his service Gravely, who had been denied admittance to Officer Clubs and many other “white only” facilities resigned from the Navy in 1946. He believed that the inherent discrimination of the Navy left him no place for advancement. He returned to complete his bachelors degree at Virginia Union.

In 1949, following President Truman’s integration of the military Gravely was asked by the Navy to return to active duty. But the end of the old order was foreshadowed by a Navy pamphlet published in 1944 entitled The Guide to the Command of Negro Personnel. That publication included the statement that ”The Navy accepts no theories of racial differences in inborn ability, but expects that every man wearing its uniform be trained and used in accordance with his maximum individual capacity determined on the basis of individual performance.”

Gravely accepted the offer to return to active duty and never looked back. He worked hard for respect and used his natural talents, personality and size to command respect. He was a man who would blaze the way for other African Americans, and later women and most recently gays to go on to greater things.

Gravely would go on to command three ships, all surface combatants. He was the first African American Naval Officer to command a Navy warship, the USS Theodore E Chandler (DD 717), the first to command a Navy ship in combat, the USS Taussig (DD 746) and the first to command a major warship, the USS Jouett (CG 29). Promoted to flag rank he eventually became the first to command a Fleet when he took command of 3rd Fleet. He retired in 1980 and passed away in 2004.

Gravely gave his parents and conditions of his upbringing much credit for his success. He believed that those conditions which forced him to “capitalize on his strong points, build his weak areas and sustain the positive self-esteem and self-worth that his parents instilled in him as a young child.”

He was a great leader. LCDR Desiree Linson who interviewed him for her Air Command and Staff College project noted that Gravely like many other great military leaders before him learned to manage the image that he presented, be a caretaker for his people, what we would now call a mentor. He said “[If I was CNO] my responsibility would be to make sure enlisted men and families were taken care of. I would do everything in my power to make sure.”

Vice Admiral Gravely’s pursuit of excellence, self confidence and mastery of professional skills empowered him in an institution where he was still an anomaly and where racism still existed. He believed in effective communication, especially verbal communication and in building teams and in being a good follower, listening, learning and proactively anticipating the needs of his superiors. Gravely was also a believer in personal morality and self discipline and preparedness. He said:

“I did everything I could think of to prepare myself. If the opportunity came, I would be prepared for it. [The question would not be] “Why didn’t you prepare for this opportunity.” I would be prepared for whatever opportunity that came. If it came, fine. If it did not, fine, but I would be prepared if it did come.”

Vice Admiral Gravely blazed a trail for those that followed him and set an example for all Naval Officers to follow. He did it under conditions that most of us could not imagine. I am proud to serve in the Navy that he helped to make.  I happen to work for an African-American Admiral at the Staff College, and I have served under African American commanders throughout every stage of my military career, in the Army and in the Navy. Admiral Gravely’s vision, service and memory are carried on in this navy and in the ship that bears his name, the USS Gravely DDG-107. Today that ship and her crew stand watch in defense of our nation and our friends around the world. It is a fitting tribute to such an amazing leader.

In his I Have a Dream speech Dr. Martin Luther King Jr. gave all of us a vision of what can and in spite of what I see going on today will be the future of the people of this country:

“I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin, but by the content of their character.”

American History would not be the same without the life, work and prophetic ministry of Dr. Martin Luther King Jr. Dr. King was born in a time when most of the country was segregated when “separate by equal” was simply façade to cover the lie that in no way did African Americans have equal rights or privileges in the United States.

Dr King was born less than 60 years after the secession of the Southern states from the Union and the beginning of the American Civil War. Though that blood conflict had freed the slaves it had not freed African Americans from prejudice, violence and discrimination.  When Dr. King began his ministry and was thrust upon the national stage as the strongest voice for equal rights and protections for blacks the discrimination and violence directed towards blacks was a very real and present reality in much of the United States.

However there were cracks beginning to appear in the great wall of segregation in the years preceding Dr. King’s ascent to leadership as the moral voice of the country in the matter of racial equality. In baseball Jackie Robinson became the first African American player in Major League Baseball opening a door for others who would become legends of the game as well as help white America begin its slow acceptance of blacks in sports and the workplace.

Likewise the contributions of a father and son Brigadier General Benjamin O. Davis Sr. and General Benjamin O. Davis Jr. were advancing the cause of blacks in the military which eventually led to the desegregation of the military in 1948.  The impact of these two men cannot be underestimated for they were trailblazers who by their lives, professionalism and character blazed a trail for African Americans in the military as well as society.

Benjamin O. Davis Sr. was a student at Howard University when the USS Maine exploded and sank in Havana Harbor.  He volunteered for service and was commissioned as a temporary 1st Lieutenant in the 8th United States Volunteer Infantry. He was mustered out of service in 1899 but enlisted as a private in the 9th United States Cavalry one of the original Buffalo Soldiers regiments.  He enlisted as the unit clerk of I troop of 3rd Squadron and was promoted to be the squadron Sergeant Major.

Davis was commissioned while the unit was deployed to the Philippines and assigned to the 10th Cavalry.  He was assigned in various positions throughout his career including command, staff and instruction duties including as Professor of Military Science and Tactics in various ROTC programs.  He reached the rank of rank of temporary Lieutenant Colonel and Squadron Commander of 3rd and later 1st Squadron 9th Cavalry from 1917-1920 in the Philippines before reverting to the rank of Captain on his return as part of the post World War I reduction in force.

Davis continued to serve during the inter-war years and assumed command of the 369th Infantry Regiment New York National Guard in 1938. He was promoted to Brigadier General on 25 October 1940 becoming the first African American elevated to that rank in the United States Army and was assigned as Commander 4th Brigade 2nd Cavalry Division. He later served in various staff positions at the War Department and in France and was instrumental in the integration of the U.S. Military. He retired after 50 years service in 1948 in a public ceremony with President Harry S. Truman presiding. He was a member of the American Battle Monuments Commission from 1953-1961 and died in 1970.

His son Benjamin O. Davis Jr. was appointed to West Point in 1932.  He graduated and was commissioned in 1936 graduating 35 out of 278, the fourth African American graduate of West Point. During his time at the Academy most of his classmates shunned him and he never had a roommate.  Despite this he maintained a dogged determination to succeed.  The Academy yearbook made this comment about him:

“The courage, tenacity, and intelligence with which he conquered a problem incomparably more difficult than plebe year won for him the sincere admiration of his classmates, and his single-minded determination to continue in his chosen career cannot fail to inspire respect wherever fortune may lead him.”

He was denied entrance to the Army Air Corps because of his race and assigned to the Infantry first to the all lack 24th Infantry Regiment at Ft Benning where he was not allowed in the Officers Club due to his race. Upon his commissioning the Regular Army had just 2 African American Line Officers, 2nd Lieutenant Davis and his father Colonel Davis.

After completion of Infantry School he was assigned as an instructor of Military Science and Tactics and the Tuskegee Institute.  In 1941 the Roosevelt Administration moved to create a black flying unit and Captain Davis was assigned to the first black class at the Tuskegee Army Air Field and in March 1942 one his wings as one of the first 5 African Americans to complete flight training.

In July 1942 he was assigned as Commanding Officer of the 99th Pursuit Squadron which served in North Africa and Sicily flying Curtiss P-40 Warhawks. He was recalled to the United States in September 1943 to command the 332ndFighter Group. However some senior officers attempted to prevent other black squadrons from serving in combat alleging that the 99th had performed poorly in combat. Davis defended his squadron and General George Marshall ordered an inquiry which showed that the 99th was comparable to white squadrons in combat and during a 2 day period over the Anzio beachhead the pilots of the 99thshot down 12 German aircraft.

Davis took the 332nd to Italy where they transitioned to P-47 Thunderbolts and in July 1944 to the P-51 Mustang which were marked with a signature red tail. During the war, the units commanded by Davis flew more than 15,000 sorties, shot down 111 enemy planes, and destroyed or damaged 273 on the ground at a cost of 66 of their own planes.

Their record against the Luftwaffe was outstanding and their protection of the bombers that they escorted was superb with very few bombers lost while escorted by them men that the Luftwaffe nicknamed the Schwarze Vogelmenschen and the Allies the Red-Tailed Angels or simply the Redtails. Davis led his Tuskegee Airmen to glory in the war and their performance in combat helped break the color barrier in the U.S. Military which was ended in 1948 when President Truman signed an executive order to end the segregation of the military. Colonel Davis helped draft the Air Force plan and the Air Force was the first of the services to fully desegregate.

Colonel Davis transitioned to jets and let the 51st Fighter Interceptor Wing against Chinese Communist MIGs in the Korean War.  He was promoted to Brigadier General in 1954 and served in numerous command and staff positions. He retired in 1970 with the rank of Lieutenant General and was advanced to General while retired by President Clinton in 1998.  He died in 2002 at the age of 89.

The legacy of Benjamin O. Davis Senior and Benjamin O. Davis Junior is a testament to their character, courage and devotion to the United States of America. They helped pioneer the way for officers such as General Colin Powell and helped change this country for the better.  During times when discrimination was legal they overcame obstacles that would have challenged lesser men.  Benjamin O. Davis Junior remarked:

“My own opinion was that blacks could best overcome racist attitudes through achievements, even though those achievements had to take place within the hateful environment of segregation.”

Such men epitomize the selfless service of so many other African Americans who served the country faithfully and “by the content of their character” triumphed over the evil of racism and helped make the United States a more perfect union. That may seem threatened today with the open display of White Supremacy movements which are now openly being supported by certain Republican politicians, but it was worse before and in the words of the old spiritual, “we shall overcome.”

The Orangeburg Massacre at 50

Thursday was the 50th anniversary of a massacre that most people have forgotten, even if they knew about it. On Febuary 8th 1968 three African American students were killed by police and twenty-seven others wounded while protesting on the campus of South Carolina State University. All were unarmed and none had resisted the police.

In February 2013, Supreme Court Justice Clarence Thomas lamented the “race consciousness” and “sensitivity” of the present time as compared to when he was growing up in Savannah Georgia in the 1960s.

If he were not in a position of nearly unlimited power and influence where he can through a legal opinion overturn established laws regarding voters rights, equal opportunity and discrimination his memory of the era would be laughable. However, Justice Thomas seemed to have missed so much of what was happening to African Americans and others during the Jim Crow Era, the campaigns for resistance in the “segregation forever” movement and the wanton violence used on African Americans who simply wanted the same rights that other Americans enjoyed.

How a man as educated and supposedly aware as Thomas supposedly is can make such an absurd statement is beyond me. In fact it is ludicrous and speaks volumes about how Thomas would willingly cover up the gross injustices that were perpetrated against African-Americans.

The brutality of those in power against Blacks and their allies  who demonstrated and campaigned for civil rights was widespread. If Justice Thomas did not hear about it in his childhood it was more likely that it was because Blacks had no voice in local or state government, no support in the local media and those who spoke out were brutalized, their homes, churches or businesses burned or or bombed, and for their trouble many went to jail. It took extraordinarily courageous men and women to stand up to the tyranny perpetrated by politicians, police, businessmen, and even church leaders at the local and State level, which were often directly connected to the activities of the Ku Klux Klan in many parts of the South.

Thomas said that he was treated worse by the Northeastern Liberal Elites, than he was in his home town. That may be so, racial prejudice was not unique to the South, in fact some of the worst riots against desegregation occurred in Boston, not far from Thomas’ college Alma mater. In fact in some Northern cities racism and discrimination were as bad than in parts of the South.

Likewise there were incidents of violence in Watts California by the Los Angeles Police Department that helped trigger the Watts Riots. That being said, there can be no doubt that in terms of organized systemic discrimination, persecution, and violence, it was in the South where Blacks suffered the gravest injustice. The South was the unparalleled hotbed of resistance to change, and resistance to the simple desire of people to receive equal treatment under the law.

Today, even many whites remember some of those incidents; the burning of the Freedom Riders bus in Anniston Alabama, the baring of James Meredith from the University of Mississippi, the 16th Street Baptist Church Bombing in which four little girls going to Sunday School were murdered, the brutal attacks on protestors in that same city that sent Dr Martin Luther King to jail, the murder of Medgar Evers, the murder of the Mississippi Civil Rights Workers, Bloody Sunday on the Edmund Pettus Bridge in Selma Alabama, and the assassination of Martin Luther King Jr.

We all know about those, well at least some of us do. They all occurred early in my lifetime and certainly if Thomas didn’t know about them as a child, he most certainly knows about them now. But the good Justice willingly chooses to ignore and treat them if they never happened, to Thomas, those were the “good ole days.”

But such an attitude denies history. It is inexcusable for any man or woman, of any race holding such an important position as Thomas to have, that of a Supreme Court Justice to hold such ahistoric and surprisingly for a Black man to hold such racist views. For man like Thomas, who in his office helps to make and interpret law that affects the civil rights of all Americans it is unconscionable. But then, after Anita Hill I never believed that Justice Thomas has a conscience.

But for each of those incidents there were many more, some very bloody which have been forgotten. I was reminded of one of those incidents when I was stationed at the Joint Forces Staff College and our Commandant, Rear Admiral John Smith talked about an incident that occurred at his alma mater, South Carolina State University in Orangeburg South Carolina, the Orangeburg Massacre. I think I had read about it once, but I had forgotten about it until he spoke of it during the Black History Month observance.

The massacre occurred on February 8th 1968 when students at the college began to protest for equal access to local businesses, especially at the only bowling alley in town, the All Star Lanes. The owner of the bowling alley refused to allow Blacks to patronize his establishment. In the days leading up to the massacre students were beaten by police as they engaged in peaceful protests in the town.

The protests continued on campus and hundreds of police and state troopers were dispatched to the scene as well as troops and armored vehicles from the South Carolina National Guard. On the campus about 200 students milled around a dying bonfire.

It was then that local and state police opened fire on a crowed of students at a bonfire. Contrary to the claims of the police none of the students were armed, three students were killed, and twenty seven wounded. Many of the students were shot in the back. The dead included a college Army ROTC Cadet named Henry Smith, another, a member of the college football team, Samuel Hammond who died reciting the 23rd Psalm with his mother at his side, and lastly the young Delano Middleton, a local high school student who had joined the protest.

FBI Director J. Edgar Hoover ordered agents to make false statements to Justice Department officials to cover for the State Troopers involved. When nine of the police officers went to trial for excessive use of force all were acquitted. But how could they be? Evidence was suppressed, false statements made and testimony of the victims discounted.

For years the subject was covered up, and disinformation spread by elected and police officials, including the governor who blamed the protest on outside “Black Power agitators” and who claimed that the protest took place off campus. Activist Cleveland Sellers was convicted of “inciting a riot” and spent seven months in jail. Twenty five years later he was pardoned. It was not until 2001 that a Governor, then Jim Hodges attended the school’s annual memorial and it was not until 2005 when then Governor Mark Sanford made a formal apology for the massacre.

The massacre received almost no coverage in the national media and was soon forgotten. The energy of most Americans was focused on protesting the Vietnam War, the Kent State Shootings and the assassination of Dr Martin Luther King Jr.and the deaths of a few Black students in South Carolina passed without notice in most of the county.

Justice Thomas and others, whether they be white or black may have historical amnesia, but history is history, even history that those in power desired to cover up.

History and justice, even belated justice matter because there are those in our country; not all in the South, who would like to roll back the protections that exist in law to protect African Americans and other minorities from institutional discrimination in matters of voters rights and equality. Even today there are business owners who openly boast of their refusal to serve minorities, and are hailed by some for doing so.

Like Montgomery, Birmingham, Anniston, Memphis and Selma, Orangeburg though forgotten by most, still matters. Denial is not an option, it is up to us the living not to forget and never to let it happen again.

Americans are Not the Übermenschen: We Are the Wretched Refuse

In the wake of President Trump’s remarks about “shithole” countries I have top put in my two cents. The fact is that most Americans, even the whiter than white, are descended from people who were the “wretched refuse” of their countries of origin. As Bill Murray said in the movie Stripes:

“The hell’s the matter with you?! Stupid! We’re all very different people. We’re not Watusi. We’re not Spartans. We’re Americans, with a capital ‘A’, huh? You know what that means? Do ya? That means that our forefathers were kicked out of every decent country in the world. We are the wretched refuse.” 

I’m sorry Mr. President, your family and mine our no different, our ancestors escaped countries that they felt that they had no future. In my family that included members of the Scottish nobility who weren’t high enough on the nobility scale to inherit much and as such went to the colonies to use their name and money to their advantage; or others who fled poverty, famine, and religious persecution: Irish Catholics, French Huguenots, Welsh coal miners, indentured servant English farmers and herdsmen, just to name a few. At least to my knowledge none of my ancestors were dodging the draft or conscription to get here, not that there is anything wrong with that, but I digress…

I hate to be so blunt but anyone that thinks that the United States is some kind of white nationalist homeland is sadly mistaken. The most kind word to describe people who believe that bullshit is ignorant; the worst, deliberately deceitful and evil.

So when the American President makes comments about Haitians, Hispanics, and African immigrants as coming from “shithole countries” one has to remember how the Irish, Germans, Italians, Poles, Russians, Greeks, Jews, and Eastern European immigrants were viewed and treated when they came to this country. While were at it let’s not even talk about the Chinese, Japanese, Filipinos, Indians, Arabs, various Latin Americans, or Mexicans; the latter who lost 40% of their country to an expanding and imperialistic United States after the War with Mexico.

The United States of America is not an ethnicity, it is not a race, it is an idea; a proposition that “all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.” Abraham Lincoln certainly understood this to the extent that he was willing to issue the Emancipation Proclamation and push through the 13th Amendment and in his last public remarks voiced support for Negro Suffrage, something that infuriated John Wilkes Booth that it moved him to assassinate Lincoln.

That being said if we are really Americans. If we are truly part of that “wretched refuse” then we should never forget the words of Lincoln’s Gettysburg Address where he said:

“It is for us the living rather to be dedicated here to the unfinished work which they who fought here have thus far so nobly advanced. It is rather for us to be here dedicated to the great task remaining before us–that from these honored dead we take increased devotion to that cause for which they gave the last full measure of devotion–that we here highly resolve that these dead shall not have died in vain, that this nation under God shall have a new birth of freedom, and that government of the people, by the people, for the people shall not perish from the earth.”

The remarks of the President which he denied, but have not been denied by the White House and testified to by Democrat and Republican Senators who heard them are despicable, racist, and conduct unbecoming for an American President. In the military I have served alongside men and women from every country that the President has called shitholes, every single one of them has more integrity, honor, and courage than the President, some have given their lives in defense of this country while many of them still serve this country in harms way. Many came as immigrants or were the sons or daughters of immigrants: all of them volunteered to serve and none dodged the draft like the current occupant of the White House.

The fact is if you are an American, unless perhaps you are a direct descendent of one of the great American Indian Chiefs or Shamans, you, like me are part of the wretched refuse.
