The Massacre at Babi Yar

Introduction

Since I recently wrote about the invasion of Poland, the T4 Euthanasia Program, and the actions of the Einsatzgruppen in Poland, I thought that it would be a good thing to lay the foundations for the German campaign in the East which began in Poland on September 1st 1939.

As part of my academic work when I taught ethics at the Joint Forces Staff College a few years, I dealt with military ethics as related to the Just War Theory. In the class on jus post bellum or justice after war I dealt with the legal implications of participating in war crimes.

It is a serious subject and in the class I attempted  to make my students, all relatively senior officers from the United States and allied nations as uncomfortable as possible. I used a number of examples from the major war crimes trials at Nuremberg as well as the Generals Trial. I had some exceptionally good class over those years which motivated me me to go back and do some revisions to a number articles that I wrote in the past, beginning during my time working towards my Masters Degree in Military History, since then I have published a version of this before but I continue, between my other writing to make revisions and additions which I often post here.

As I went through previous notes and research I felt a tenseness and revulsion for the actions of those that ordered, committed or condoned these crimes; many of who were men who like me were professional career officers. I realize how easily it is for normal, rational, and even basically decent people to succumb to either participating in or turning a blind eye to crimes against others, even on a massive scale, in fact the bigger they are they seem easier to dismiss, because the victims cease be human, and simply a statistic. Sadly, Josef Stalin probably got human nature right when he said “The death of one man is a tragedy. The death of millions is a statistic.” That comment causes great revulsion in my soul, but I have to admit it seems to be the way that many people deal with such great crimes.

September 29th 2020 was the 79th anniversary of the Babi Yar massacre. It was committed by members of the SS Einsatzgruppen C near Kiev shortly after the German Army captured that city. In total some 33,771 Jews were exterminated by the members of Sonderkommando 4b of Einsatzgruppen C as well as attached Ordungspolizei battalions. About 10,000 others, mainly Communist Officials and Gypsies were rounded up and killed in the same operation. The victims were stripped of all of their belongings taken to a ravine and shot. It was the second largest killing action by the various Einsatzgruppen in the war. It was committed by men who either believed that the people that they were killing were sub-human, or did not have the courage to stand up and say no.

These issues are still with us. Hannah Arendt made the comment that “The sad truth is that most evil is done by people who never make up their minds to be good or evil.” Likewise, Historian Gerhard Weinberg wrote:

“It’s very, very important for people to get a sense of what the potentialities of people really are, what the dangers of ignorance can be. It is in this context, that a supposedly advanced society risks descending into the sewer, that the Holocaust is a warning to people who think of themselves as an advanced, modern society.” 

These are uncomfortable subjects. We like to say that the Nazis were different than us or others. To some extent this is true, but the real truth is that most of the Christian Western European countries, and I include the United States have also committed gross crimes against humanity against peoples that we believed were less than human and not afforded human rights or protections. In the movie Judgement at Nuremberg Spencer Tracy makes a comment that should send chills through any of us. He spoke concerning one of the judges on trial, “Janning, to be sure, is a tragic figure. We believe he loathed the evil he did. But compassion for the present torture of his soul must not beget forgetfulness of the torture and the death of millions by the Government of which he was a part. Janning’s record and his fate illuminate the most shattering truth that has emerged from this trial: If he and all of the other defendants had been degraded perverts, if all of the leaders of the Third Reich had been sadistic monsters and maniacs, then these events would have no more moral significance than an earthquake, or any other natural catastrophe. But this trial has shown that under a national crisis, ordinary – even able and extraordinary – men can delude themselves into the commission of crimes so vast and heinous that they beggar the imagination….”

American Associate Supreme Court Justice Robert Jackson spoke these words in his opening arguments during the Major War Crimes Trials at Nuremberg:

“The persecution of the Jews was a continuous and deliberate policy. It was a policy directed against other nations as well as against the Jews themselves. Anti-Semitism was promoted to divide and embitter the democratic peoples and to soften their resistance to the Nazi aggression. As Robert Ley declared in Der Angriff on 14 May, 1944, “the second German secret weapon is Anti-Semitism because, if it is constantly pursued by Germany, it will become a universal problem which all nations will be forced to consider.”

Anti-Semitism also has been aptly credited with being a “spearhead of terror.” The ghetto was the laboratory for testing repressive measures. Jewish property was the first to be expropriated, but the custom grew and included similar measures against Anti-Nazi Germans, Poles, Czechs, Frenchmen, and Belgians. Extermination of the Jews enabled the Nazis to bring a practised hand to similar measures against Poles, Serbs, and Greeks. The plight of the Jew was a constant threat to opposition or discontent among other elements of Europe’s population -Pacifists, Conservatives, Communists, Catholics, Protestants, Socialists. It was in fact, a threat to every dissenting opinion and to every non-Nazi’s life.” 

Babi Yar is just one example of how civilized people can get can commit great atrocities in the name of ideology and race, and it does not stand alone. The tragic fact is that it really doesn’t take much to condition people to go commit such crimes; just teach people from childhood that people of certain races or religions are less than human. Then subjugate them to incessant propaganda and then turn them loose using the pretext that they are killing terrorists or insurgents. But the more troubling question is about the adults in the room, the politicians, the career government officials and military officers who had once taken oaths to uphold the Constitution, and laws of their countries. Men who were not subjected to the incessant propaganda of a dictatorship until it arose in the middle or toward the end of their careers.

Beginning tonight I will be exploring the ideological as well as existing military doctrines that brought about Babi Yar and so many other atrocities committed by the Nazis during the campaigns in Poland and the Soviet Union. That is because Genocide and mass murder does not occur in a vacuum. It doesn’t just happen. There are pre-existing racial, ethnic and religious hatreds that often define how a country and culture view their enemies that can play into the domestic persecution of those people, and their actions during war, especially as to how the observe the Geneva and Hague Conventions, especially in terms of their treatment of civilians and non-combatants.

What happened at Babi Yar and the thousands of other massacres committed by the Nazi units, the Einsatzgruppen, Ordungspolizei, Waffen SS, the German Army of Heer, Luftwaffe Field Divisions, and locally recruited auxiliaries, is just one example of how civilized people can get can commit great atrocities in the name of ideology and race, and it does not stand alone. Introduction to Genocidal Race War 

The German war against the Soviet Union was the first truly race-based ideological war in history with the campaign against Poland its precursor. Adolf Hitler’s racial theories and beliefs played a dominant role in Germany’s conduct of the war in the East in both the military campaign and occupation. This has become clearer in recent years as historians have had the opportunity to examine Hitler’s writings, those of senior Nazi officials and military officers and documents which had been unavailable until the end of the Cold War.

Understanding the Nazi ideological basis and the underlying cultural prejudice against the Jews and eastern Europeans in general is foundational to understanding Hitler’s conduct of the war and why the destruction of the Jews figured so highly in his calculations. One must also understand the military and police cultures and doctrines that enabled them to cooperate so closely in the conduct of the war.

The German war in the east would differ from any previous war. Its underlying basis was ideological. Economic and geopolitical considerations were given importance in relationship to the understanding of the German “Master Race.” Race and Lebensraum was the goal of the State that “concentrates all of its strength on marking out a way of life for our people through the allocation of Lebensraum for the next one hundred years…the goal corresponds equally to the highest national and ethnic requirements.” 1

Hitler believed that Germany was “entitled to more land…because it was the “mother of life” not just some “little nigger nation or another.”” 2 The Germans planned to “clear” the vast majority of the Slavic population and the “settlement of millions of hectares of eastern Lebensraum with German colonists” complimented by a short term exploitation of the land to “secure the food balance of the German Grossraum.” 3 Joachim Fest notes that Hitler called it a “crime” to wage war only for the acquisition of raw materials. Only the issue of living space permitted resort to arms. 4

Following the Peace of Westphalia wars in Europe typically emphasized conquest of territory and natural resources either to expand empires or promote some kind of self-sufficiency. The Thirty Years War, which was ended by the Treaty of Westphalia had a heavy religious component which added to its brutality. However the root of much of this conflict was about increasing the power of emerging nation states led by men not necessarily loyal to their religious brethren. 5

The American and Russian Civil wars had some ideological basis and helped usher in the brutality of total war. Both had major effect in these nations’ development and both were bitterly contested with the winners imposing to various degrees political changes on their vanquished brothers they were civil wars. 6

Economic Historian Adam Tooze sees the Holocaust as the first step of the “last great land grab in the long and bloody history of European colonialism…” 7 This does have merit, Hitler’s desire for Lebensraum or living space was a type of colonialism. However, Tooze’s argument does not take away from the basic premise that Germany’s war in the east was at its heart motivated by ideological factors, mostly in Hitler’s belief in the mythical Aryan Supermen of the German Race, and their üntermenschen (sub human) foes, Jews, Gypsies, Blacks and Slavic people. In Hitler’s world  their existence was a threat, and they were occupying lands that rightly belonged to Germany and the Germans.

German Anti-Semitism and Adolf Hitler

The root cause of this war was in the mind of Adolf Hitler himself. Hitler was born in Linz Austria during a time when various Pan-German and Ant-Semitic groups, publications and propaganda were widespread. As a young man Hitler moved to Vienna hoping to become an artist, something that he found little commercial success. While struggling to make a living in Vienna he was exposed to a culture far different from the provincial city of his youth, a cosmopolitan metropolis that had much culture but was also a meeting ground for the various conglomerate of peoples that populated the Austro- Hungarian Empire, including Slavs and many Jews. While many of the Germanic or Austrian Jews were outwardly little different from their Christian neighbors the Jews from Eastern Europe repulsed Hitler.

This attitude was not unique to German but found its roots in the various anthropologies written by other Europeans as well as Germans regarding the lack of rights of “inferior cultures” as related to their colonial expansion as well as the westward expansion of Americans. Friedrich Ratzel a German anthropologist and a founder of the Pan-German League paired the Jews with “the stunted hunting people of the African interior” into “the class of scattered people with no land.” 8 Ratzel’s work also examined the conquest of the Native American tribes by whites. This helped form the basis of Hitler’s Understanding of Lebensraum, a concept that he borrowed from Ratzel. Ratzel was originally a zoologist. In his concept of Lebensraum Ratzel “linked the biological theory of life with the geographical theory of space.” Ratzel believed that to “conquer and hold sufficient Lebensraum, others have to be displaced.” Ratzel noted how European settles had taken over land from the Native Americans to take it for themselves. He noted that “the result was an annihilating struggle, the prize for which was the land, the space.” 9

Another German academic and lecturer at the University of Glasgow Alexander Tille, wrote in 1893 that it is “the right of the stronger race to annihilate the lower…when that race does not maintain its ability to resist then it has no right to exist, for anyone who cannot maintain himself must be content to go under.” Tille’s “laws” were easily applied to both primitive peoples as well as to “the economically less successful peoples of Europe.” 10

Hitler’s lack of success in Vienna and continued struggle, despite a decent inheritance, with poverty and resentment of others led him to the writings of the Pan-Germanic and Anti-Semitic movements. Hitler’s  years in Vienna were foundational as he as he absorbed the ideas of these Pan-German, anti-Semitic groups through newspapers like the Deutsches Volksblatt. 11 In Vienna Hitler began to connect the Jews with Marxism.12 Joachim Fest noted that in Vienna Hitler became obsessed by the fear of the Slavs and Jews, hated the House of Hapsburg, the Social Democratic Party, and “envisioned the end of Germanism.” 13

Hitler’s racial views were amplified after the war in turbulent Weimar Germany, while serving as a political operative of the German Army, the Reichswehr, was assigned to watch a small but radical political party, the National Socialist, Democratic Workers Party, or NDSAP.  He soon left the army and became a member of the NDSAP, where he rose rapidly within it through is nearly hypnotic oratory skills. It was not long before he took over the party leadership. He reorganized it so that it “became the instrument of Hitler’s policies.” 14

The party rapidly gained strength under his leadership and Hitler made connections with other prominent right wing groups and leaders, including General Erich Ludendorff and became powerful enough in Munich that he believed that he and his Stürmabteilung (S.A.) would successfully gain the support of other right wing groups, paramilitaries, and possibly the support of the Army. But Hitler overplayed his hand, and his revolt was stopped in Munich’s Odeonsplatz by a company of Police who would not yield. In the resulting firefight a number of Hitler’s men were killed or wounded. Among the wounded was Hermann Goering whose wounds were attended to by a Jewish doctor. Hitler tried to flee but was arrested, tried and convicted of trying to overthrow the government. He was sentenced to five years imprisonment at Landsberg Prison where he was treated as a celebrity and released after serving just nine months in prison.

During his stay at Landsberg Hitler wrote Mein Kampf  in which he enunciated his views about the Jews, Slavs and Lebensraum. Hitler believed that Imperial Germany had been “hopelessly negligent” in regard to the Jews 15 and that the Jews in conjunction with the Catholic Center Party and Socialists worked together for “maximum damage to Germany.” 16

The book was filled with the standard tropes of the anti-Semitism that had swept Europe for decades, it enunciated little in the way of a political plan, except his hatred of the Jews and the need of Germany for Lebensraum, or living space, and was terribly written. It did not prove to be a best seller but Hitler received enough in royalties to live more comfortably, supported by an ever growing ring of financial supporters.

Hitler wrote that the Jews as being the leaders of the “main ideological scourges of the nineteenth and twentieth century’s.” 17 It was the ideology of Hitler’s “obsessive anti-Semitism” 18 that drove Nazi Germany’s policy in regard to the Jews and against Jewish-Bolshevism.

By the 1920s Hitler had “combined his hatred of the Jews and of the supposedly Jewish dominated Soviet state with existing calls to conquer additional Lebensraum, or living space, in the east.” 19 Hitler wrote: “The fight against Jewish world Bolshevism requires a clear attitude toward Soviet Russia. You cannot drive out the Devil with Beelzebub.” 20 Richard Evans noted that Mein Kampf clearly enunciated that “Hitler considered racial conflict…the essence of history, and the Jews to be the sworn enemy of the German race ….” Likewise, Evans wrote that the “Jews were now linked indissolubly in Hitler’s mind with “Bolshevism” and “Marxism.” 21

When Hitler became the dictator of Germany “his ideology and strategy became the ends and means of German foreign policy.” 22 His aims were clear, Hitler remarked to Czech Foreign Minister Chvalkovsky on 21 January 1939: “We are going to destroy the Jews.” 23

It was clear that Hitler understood his own role in this effort telling General Gotthard Heinrici that “he was the first man since Charlemagne to hold unlimited power in his own hand. He did not hold this power in vain, he said, but would know how to use it in the struggle for Germany…” 24

David Barton made the same arguments recently about the American Indians. Barton said: “You have to deal, a lot of it, with how the enemy responds. Mass Murder Up Close and Personal: The Einsatzgruppen Warm up for the Soviet Union In Poland

Since I posted an article about Hitler’s attack on Poland a few days ago, and wrote an article about the T4 Euthanasia program which was authorized the same day as the invasion of Poland, followed up by the our Hearts of Darkness; I am following it up with an older article dealing with Hitler’s first use of the Einsatzgruppen in dealing with Poles who might become leaders in an anti-Nazi Resistance as well as Jews. 

Another section of the article dealing with the campaign of mass murder and genocide conducted by Hitler’s legions in Eastern Europe. This section deals with the actions of the Einsatzgrüppen in during the Polish campaign and occupation in 1939 and 1940. In it you will see that the while most of the killing was done by the SS that the German military high command was not guiltless. Some commanders attempted to stop SS actions, but they were the minority.  Most simply turned a blind eye to what was going on and a few would lend their assistance to the Einsatzgrüppen.

Please note, that all of this took place before the first extermination camps began operations, and were accomplished well before the decision about the Final Solution. This killing was done up close and personal by  the men of the Einsatzgruppen and the Police battalions, sometimes with the direct support and approval of the Wehrmacht. In all just a few thousand troops massacred hundreds of thousands of Polish Jews as well as the Polish gentile elites.

The precedent of the Polish Campaign would set the course of future Einsatzgruppen Operations in the Soviet Union and the Baltic states. Their actions showed that formerly law abiding and otherwise decent people could become mass murderers and war criminals. Many of these men had been honorable police officers until the Ordungspolizei and Germanderei, the City and County Police were absorbed by the SS, and their units and members used as part of the Police, and Reserve Police Battalions which assisted the Einsatzgruppen in their mass murder of Poles, and later of Russians, Ukrainians. Belorussians, Estonians, Latvians, and  Lithuanians. As historian Timothy Snyder wrote:

“The European history of the twentieth century shows us that societies can break, democracies can fall, ethics can collapse, and ordinary men can find themselves standing over death pits with guns in their hands. It would serve us well today to understand why.”

It is terribly uncomfortable, for as I always say, these men were little different than most of us, they were terribly ordinary. The real question for Americans is this: can once Fully trust formerly trusted officials of local, state and even Federal law enforcement agencies of being completely loyal to their oaths to the Constitution when the Justice Department, before it’s takeover by Trump Loyalists noted that Neo-Nazis and White Supremacists had already infiltrated police forces at every level, and that White Nationalist groups were the greater threat to national security than any other terrorist organization. Thus when local and state police authorities commit homicide against Black Citizens and then stand beside and support Neo-Nazis, they must be exposed and prosecuted to the fullest extent of the law in order to protect and defend the great number of others who uphold the law, apply it equitably, and seek justice and and see their roles as servants, who protect and defend all citizens, not just those of those who are their race, creed, or political ideology.

The Polish campaign was a precursor to the Russian campaign and was not totally race driven. It contained elements of Germany’s perception of the injustice of Versailles which gave Poland the Danzig corridor and Germany’s desire to reconnect East Prussia to the Reich, as well as the perceived necessity to remove a potential enemy from its rear as it faced France, yet it was a campaign steeped in Nazi racial ideology. Poland resisted German efforts to ally itself with Germany in 1939, thus Hitler determined it “would be crushed first.” 80

Meeting with military leaders on 23 May 1939 Hitler “made it plain that the real issue was not Danzig, but securing of Germany’s Lebensraum….” 81 On 22 August Hitler enjoined the generals to “Close your hearts to pity! Act brutally! Eighty million people must obtain what is their right.” 82

Even so, most military leaders failed to appreciate what Hitler was calling on them to do; Erich von Manstein would later note that “what Hitler had to say about an eventual war with Poland, could not, in my opinion, be interpreted as a policy of annihilation.” 83

Others such as Abwehr director Wilhelm Canaris was “utterly horrified.” As he read his notes to his closest colleagues “His voice trembled as he read, Canaris was acutely aware that he had witnessed something monstrous.” 84 General Johannes Blaskowitz, the controversial commander of the German 8th Army who would become the military commander in Poland did not leave any notes about the meeting. However, his biographer noted that Blaskowitz “may have naively attached a military meaning to these terms since he was busy with military matters and soon to begin operations.” 85 As was noted before this was also the interpretation of Erich Manstein gave Hitler’s words, but one has to wonder as to the veracity of his statements. 86 Field Marshal Keitel noted that the speech was “delivered in the finest sense of psychological timing and application,” with Hitler molding “his words and phrases to suit his audience.” 87

In light of the mixed interpretations by military leaders, it is possible that many misinterpreted Hitler’s intent and did not fully appreciated his ideology as they went into Poland, carefully secluding themselves in the narrow confines of their military world. While such an explanation is plausible for some, it is also true that many others in light of subsequent actions were in full agreement with Hitler. One author notes that “no man who participated in the FührerConferences….and there were present the highest ranking officers of the three services, could thereafter plead ignorance of the fact that Hitler had laid bare his every depth of infamy before them, and they had raised no voice in protest either then or later.” 88 In July, General Wagner, the Quartermaster General issued orders that “authorized German soldiers to take and execute hostages in the event of attacks by snipers or irregulars.” 89

Regardless of the meaning ascribed to Hitler’s speech by his generals, Hitler had already laid plans to destroy the Jews in Poland and decimate the Polish intelligentsia and leadership.   Hitler gave Himmler the task of forming Einsatzgrüppen to follow the German troops as they advanced into Poland and liquidate Poland’s upper class wherever it was to be found.” 90 While senior party leaders remained at Hitler’s side following the conference, Himmler worked to coordinate his troops, including the reinforced Totenkopf battalions and Einsatzgrüppen with the Army. 91

Himmler began planning in early May and the Army, working in close collaboration with the SS decided to “use SS and police units to augment their own forces for security tasks.” 92 Himmler established “five Einsatzgrüppen to accompany each of the numbered German armies at the start of the campaign.” 93 Placed under the aegis of Reinhard Heydrich the groups were broken down into smaller units of 100-150 men and allotted to army corps. All senior posts were occupied by officers of the SD, the Sicherhietsdienst. 94

Two additional Einsatzgrüppen were formed shortly after the invasion. 95Additionally three regiments of the SS Totenkopfverbandeunder the direction of SS General Theodore Eicke were deployed in the rear areas of the advancing armies. These regiments were formed from the Concentration Camp guard units and eventually became the nucleus of the 3rd SS Panzer Division Totenkopf. 96 The SS carefully shielded the real purpose of these units from the Army in the planning stages, while the Army might countenance anti-guerrilla operations and cooperate in arresting people who might lead resistance in Poland, the SS was not yet sure that the Army would support or countenance mass murder. 97 That being said, Heydrich worked with the Army to develop lists of up to 30,000 Poles to be arrested following the invasion including intellectuals, political leaders and clergy. 98

To eliminate the Polish elites without disturbing the Army, Himmler and Heydrich gave the Army “only the bare minimum of information” as to their ultimate intent99 The deception was initially successful and many Wehrmacht commanders welcomed the assistance of the SS units for rear area security missions. Blaskowitz’s 8th Army defined the mission of the Einsatzgrüppen in the traditional doctrinal terms of the Ettapen, noting their mission as “the suppression of all anti-Reich and anti- German elements in the rear of the “fighting troops, in particular, counter espionage arrests of  politically unreliable persons, confiscation of weapons, safeguarding of important counter- espionage materials etc…” 100 General Wagner, the Quartermaster General issued orders in July 1939 that “authorized German soldiers to take and execute hostages in the event of attacks by snipers or irregulars.” Despite the deception, there was no way to disguise the murder of Polish intelligentsia and Jews once it began, and had the Army had the political acumen and moral courage it could have considerably restricted or even halted the terror campaign. 101

The ensuing campaign in Poland demonstrated Hitler’s true intent. Heydrich openly discussed “murdering the Polish ruling class” of the aristocracy, Catholic clergy, communists and Jews at a meeting on September 7th, barely a week after the beginning of the invasion. 102 As the German armies advanced into Poland slicing through the badly deployed and inadequately equipped Polish Army the Einsatzgruppen and the Totenkopf Verbande followed in their wake, conducting mass arrests and executions of those Poles deemed to be a threat.

Many army leaders were worried about Polish soldiers left behind in rear areas as the armies advanced. In some cases that concern became a paranoid mindset and some generals believed that a “brutal guerrilla campaign has broken out everywhere and we are ruthlessly stamping it out.” 103

Yet some of the actions by Einsatzgruppen and Totenkopf Verbande against the Polish elites and the Jews drew Army reactions. The unit commanded by SS General Woyrsch “behaved with such unparalleled bestiality that it was thrown out of the operational area” by General List of 14th Army.” 104 Another unit, the Totenkopfverbande Brandenburg came to Army attention when its commander remarked that the “SSVT would not obey Army orders.” The conclusion drawn by the Army General was that “the SSVT commander was following orders from some non-military authority to terrorize the local Jews.” 105

These atrocities as well as those of other Waffen-SS units were hard to hide and brought reactions out of army commanders who sought to punish the offenders. Blaskowitz and a few other commanders attempted to put a halt to SS actions against Poles and Jews, 106 but most officers turned a blind eye to the atrocities or outright condoned them. It is believed that General Walter Model and many other senior officers “not only knew what was occurring in Poland but actually took part in what Colonel General Franz Halder himself described in October as “this devilish plan.”” 107

It appears that many of the officers who objected were not motivated so much by humanitarian, moral or legal considerations, but rather by the effect on good order and discipline of their soldiers. 108 Likewise it is clear that many officers, even if they did not participate in the actions probably approved of them. Many of the early biographies and histories of this period were written by authors who were influenced by surviving German officers. Many of these men were being rehabilitated and helping the Americans and British meet the threat of the Soviet Union, made no or little mention of the Army’s part in these actions.

Both Himmler and Heydrich were sensitive to the perception of the Army and resented the fact that the Army believed them to be responsible for actions that they were carrying out under the direction and orders of Hitler himself, They also resented that their troops were characterized as “undisciplined gangs of murderers” by many Army officers. 109

After crushing the Polish armies and dividing Poland with the help of the Red Army, the Germans established what became known as the Government General, which was headed by Hans Frank. The new civilian administration came into conflict with the military governor, General Blaskowitz. Appalled by the actions of the SS, Police and the Nazi administration. Blaskowitz made an “elaborate report on the atrocities of the SS,” 110 expressing concern about his “extreme alarm about illegal executions, his worries about maintaining troop discipline under those circumstances, the failure of discussions with the SD and Gestapo and their assertions that they were only following SS Orders.” 111

While it is unclear if the memorandum made it to Hitler, it is clear that Hitler did know about the protest and Blaskowitz fell into disfavor and was reassigned after a period of continued conflict with the Nazi administration. Hitler was not impressed by the less than ruthless attitudes of Blaskowitz and other commanders. His reaction to Army objections regarding the methods of the SS and police units was characteristically acidic. Hitler’s military adjutant recalled that Hitler accused the Army’s leaders of using “Salvation Army” methods, and called their ideas regarding the occupation as “childish.” 112

Following the reassignment of Blaskowitz, other officers that objected were also relieved of their commands or reassigned. General Georg von Külcher was relieved of command for protesting SS and police atrocities. 113

At the beginning of the campaign the SS units and their commanders fell under military justice, and a number of SS officers and their troops were convicted by Army courts-martial for their actions. But soon, SS Officers convicted by Army courts-martial were given amnesty by Hitler and Hitler “removed SS units from the jurisdiction of military courts,” on October 4th 1939. 114 While the army remained, it was no longer in charge and would actively assist the SS and Police in combat and further atrocities against civilians. In November 1939, One German officer, who later was a conspirator in the July 20th plot, remarked, “was ashamed to be German! The minority are dragging our good through the mud by murdering, looting and torching houses will bring disaster on the whole German people if we do not stop it soon…” 115

The Army was soon relieved of responsibility for policing Poland which fell on the Ordungspolizei battalions and Gendarmerie. Many officers were pleased as they could now turn their backs on the situation there and begin to prepare for the campaign in the West.

The Ordungspolizei battalions and the Gendarmerie units were composed of mobilized city police and rural constabulary police. These men would soon wreak their own devastation on Poland in the coming months and years. 116Poland was also be the first use of mass evacuations of civilian populations to make room for German settlers, in the newly acquired Lebensraum. Poles were driven into the newly formed Government General and ethnic Germans moved into previously Polish occupied territories. By 1941 over 1,200,000 Poles and 300,000 Jews had been expelled and 497,000 ethnic Germans brought into provinces German had lost in 1919. 117

Prior to the war about 3.3 million Jews lived in Poland. The actions of the Einsatzgruppen and the Police brought a reign of terror to Poland’s Jews. The Jews were rounded up and sent to Ghettos from which they would be dispatched to the death camps following the decision to implement the “Final Solution.”After the war only some 50-70,000 Jews were found to have survived in Poland, the Polish Army and camps in Germany. A further 180,000 were repatriated from the Soviet Union. 118

It is Happening Again, Not in Nazi Germany: The Campaign Against “Life Unworthy of Life”

Friends of Padre Steve’s World,

I am reflecting about the present in light of the past, and how policy wise, the Social Darwinist policies of the Trump Administration, and the words of his cult propagandists about the value of human life during the Coronavirus 19 Pandemic since it first began. Throughout the pandemic President Trump and his ruthless enablers have done all tat they can to ensure that the pandemic has killed and infected more people in the United States than any nation in the world, and for a nation that represents barely 4% of the world population with one of the most advanced medical systems in the world that is saying a lot. The only answer for such a disaster is that Trump and his Cult want this to happen. Why else would he first deny the infection, then minimize it, then issue a series of contradictory guidance, leave the states to determine their own way through, and then sign a one time bill that provided some relief, but has not been followed up on. The answer to Republicans is that the people helped by it really are not worthy, while the hundreds of billions sucked up by Wall Street and major corporations is worth it. The program is so much like the Nazi economic plan that it defies the imagination.

Then there is the President’s continued resistance to testing, tracing, passive preventive measures such as cloth face masks, social distancing, and closing down the places where the infection spreads most effectively, bars, churches, discos, and sadly Schools too. He has sacked or marginalized many of the best immunologists, virologists, and public health officials in the country and has in the past few weeks appointed political hacks to key positions in his Coronavirus Task Force, who now argue for the Discredited and inhuman concept of Herd Immunity, which if it was employed in the United States would result in at least TWO MILLION MORE DEATHS, and countless more infections. That any President or Administration would even consider such measures places them in the realm of a criminal regime bent on the mass murder or American citizens without even having to fire a bullet or resort to poison gas. All they have to do is let the virus run rampant, which seems to be their plan. As of yesterday the United States reported 187,736 deaths, and 6,211, 796 total cases, 24% of the world’s infections and 22% of the world’s deaths. The American totals are no doubt serious undercounts due to the Trump Administration’s orders to minimize testing and reporting of Coronavirus 19 infections and deaths to minimize the political fallout of the catastrophe that Trump and his Cult Followers not only seek to minimize but pretend that it didn’t happen at all. Instead of reporting the truth the report the false narrative that Trump has saved the country, and the Coronavirus Pandemic was defeated by him even as it rages.

But regardless, the actions of Trump and his followers direct me to the Eugenics movement of the 1920s and 1930s in the United States, Weimar Germany, and other European nations, as well as Japan. But the eugenics movement was nowhere more malevolent, evident and active than it was in Hitler’s Germany. Likewise it is hard to believe that members of the administration as well as its supporters seem to believe, if you take them at their word that the elderly, disabled, mentally ill, and poor, especially those who are not white or Christian are a burden on the State, and are as the Eugenicists of the 1920s and 1930s, as well as Hitler’s Nazi Party believed, were ”Life unworthy of life .” 


It seems hard to believe for anyone born after the mid 1960s, that government through its laws, decrees, and policies could deem certain people to be “life unworthy of life.” The most malevolent of such governments was the Nazi regime of Adolf Hitler, but individuals and institutions in the United States promoted the same ideology in the 1920s and 1930s but, in spite of actions like the the Tuskegee Experiments, could not carry it to its logical conclusion because most Americans of the time couldn’t go along with it. But the moral, social, religious and ideological barriers to its implementation then no longer exist today.

In Nazi Germany life that was unworthy of life included the physically and mentally handicapped or disabled, those with Downs Syndrome, Cerebral Palsy, Polio, and people with other neurological conditions. Likewise the mentally ill, those suffering clinical depression, schizophrenia, and other mental illnesses were considered to be life unworthy of life. Even the deaf were included, as well as veterans suffering from what we would now call PTSD or Traumatic Brain Injury. Also included were people labeled as “asocial” a very loose definition that could include almost any metal disorder or criminal act, including being a homosexual. Sadly, the President himself has made statements that show that he has no regard for the lives of such people, his policies, especially his executive orders, and the men and women he nominates to the Federal Judiciary have similar views to him.

I have been to Hadamar, I have walked it’s grounds, toured its wards, and stood in its gas chambers and crematoria. Tens of thousands people deemed “Life unworthy of Life” were liquidated at the T-4 Euthanasia centers, most located in former hospitals, psychiatric institutions, or sanitariums.

Once the Nazis decided to eliminate them the same day as they invaded Poland in 1939, most of these people gassed with carbon monoxide gas from the exhaust of trucks or Diesel engines, and their remains were cremated. Others, especially children were either starved to death or given a lethal injection while they slept. In every case the next of kin of each victim was sent a standard form letter telling them that their relative had died of influenza, typhus, or some other disease while being given the best of care. The next of kin were then given the option of paying for an urn that may or may not have contained the ashes of their loved ones for inurnment near their home town. If they could not afford an urn the ashes were disposed of in the cemetery nearest to where they were killed. At Hadamar, it was on the grounds of the institution.

Despite the Nazis attempts to disguise their crime they could not be hidden, and after over 70,000 Germans were Euthanized the official T-4 Euthanasia program was ended in Germany.  The gas chambers, cremation ovens and facilities were disassembled by SS experts, and sent east to Poland, where they and their experienced technicians became key components of the Holocaust of the Jews at Soribor, Belzec, Treblinka, and Auschwitz. 

But the Euthanasia program, despite Nazi lies to senior clerics and officials of neutral countries didn’t stop, it simply moved eastward as the SS Einsatzgruppen killed the patients at every mental hospital, sanitarium, old folks home, or orphanage they came across. Inside Germany at the four T4 centers over 80,000 were gassed. At Hartheim in Austria a Party was held on the gassing of the 10,000th victim. Richard Evans wrote:

“At Hartheim the staff held a party to celebrate their ten-thousandth cremation, assembling in the crematorium around the naked body of a recently gassed victim, which was laid out on a stretcher and covered with flowers. One staff member dressed as a clergyman and performed a short ceremony, then beer was distributed to all present. Eventually no fewer than 20,000 were gassed at Hartheim, the same at Sonnenstein, 20,000 at Brandenburg and Bernburg, and another 20,000 at Grafeneck and Hadamar, making a total of 80,000 altogether.”

The tolls in Poland, the Baltic States, and the Soviet Union were much higher, but were conducted outside the auspices of the T4 program which “officially” ended in 1941, but continued in a more clandestine manner throughout the war.

Now in Trump’s United States of 2020 the laws guaranteeing health care to people are being challenged, the Secretary of Education has removed funding from the Department’s funding request for the Special Olympics, programs for the physically and mentally disabled under the SSI are being cut to the bone, and even care for disabled veterans is being threatened as not being economical because none of them are economically valuable to an administration for which profit is the bottom line of the insurance industry. Likewise, most supposedly pro-life Christians have no problems in cutting such programs because many have bought into the materialistic, Prosperity Gospel, whose fawning preachers have anointed President Trump if he were King Cyrus.

To Trump’s Cult of Evangelicals no criticism of the President can be tolerated, no matter how factual it may be, even if it involves the lives of the least, and most most vulnerable members of our society. Thus, for these supposedly “pro-life Christians” the  sick, the weak, the infirm, or mentally ill, who are not productive have no place in society. Inside the womb they are a remarkably powerful political issue; but once outside the womb they might as well be dead if you listen to Trump’s clique of Reichsbishofs, according to who cannot produce for the economy should not eat, get medical care, or live. They are life unworthy of life. This is even worse than the Nazis, for there is not even the Darwinistic idea of producing superior human beings, but rather to kill and let die for profit. The Nazis did that too, with the life of every human being that the considered sub-human, but the overriding the goal of the Nazi true believers, the idea of a perfect Aryan Germanic Master Race was always the ideal to be pursued.

Thus the propaganda directed at German citizens as to how much these men women and children cost the German taxpayer in order to get them to acquiesce to something they would never consider. Now today’s Republican leaders use the same arguments to justify cutting taxes and let the social contract we have with our fellow human beings collapse, because the to poor, the sick, the infirm, the disabled, prisoners, the mentally ill and the elderly simply cost more than they are worth, that also applies to infants and young children suffering any expensive chronic but treatable conditions.

You see, in the authoritarian world in which we live; a world where an uninhibited and unhinged executive backed by cult followers, profit minded billionaires, and greedy preachers, such lives; the old and infirm, the disabled, the mentally ill, the young but physically disabled, those with neurological issues, and birth defects stand in the way of profit, stand in the way of a “perfect” society. They have no value to them because they cost too much, and burden real Americans.

If you directly challenged such people may not advocate euthanasia per say, they would not advocate for gas chambers, or firing squads. Instead they would turn a blind eye to depriving their victims of citizenship, starving them, depriving them of medical care, and turning them out of care facilities knowing that their families lack the capability of caring for them. and if they have any capacity for work, work them until they die, so long as they Confess Christ before they die.

How do we know that life does not matter to them? One way is to note the many times that pharmaceutical corporations have increased the costs of previously inexpensive yet vital life saving medicines by thousands of dollars a dose all for profit with little to no pushback from the White House, or the FDA, much less the Senate GOP majority, or the Evangelical supporters of Trump.

Please understand, this dystopian future need not happen if people of any faith, or no faith at all make a stand against a twisted idea of dictatorship backed up by billionaires and corporate entities that suck billions of dollars from the taxpayer and pay almost nothing themselves. Of course they couldn’t do it on their own in not supported by a de facto State Media, and a cult like legion of followers who would follow Trump even if he shot someone on 5th Avenue. His words, not mine.

I am now 60 years old, and I have served in the military over 39 years, and this does bother me enough to speak out. As a senior military officer facing the end of my career and retirement amid multiple physical and emotional issues, it does matter. I keep two things in mind today. First is that of my own responsibility to my Oath, and to fellow citizens.  In that I am reminded of the words of German General Ludwig Beck who wrote:

“It is a lack of character and insight, when a soldier in high command sees his duty and mission only in the context of his military orders without realizing that the highest responsibility is to the people of his country.”

And like Beck’s compatriot, Major General Henning Von Tresckow stated: “We have to show the world that not all of us are like him. Otherwise, this will always be Hitler’s Germany.” Or in my case, Trump’s America.

Historian Timothy Snyder reminds of a certain truth, which should we forget, as I imagine a large number of Trump supporters have:

“The European history of the twentieth century shows us that societies can break, democracies can fall, ethics can collapse, and ordinary men can find themselves standing over death pits with guns in their hands. It would serve us well today to understand why.”


Those are all hard truths to comprehend. As Americans we always presume that we are the good guys, when in fact many times we have acted in means contrary to the ideals of the Declaration as well as the Constitution, and other laws enacted by Congress. But our republic has survived, but its institutions are both resilient and fragile. History has proven this, we have even survived a civil war, but we may not survive an increasingly vindictive and unstable President, his compliant majority in the Senate, and the 35-40% of voters who are in effect no longer Republicans, but a Trump Cult which is largely buttressed by Conservative Evangelical Churches, and inspired by a President who uses force, legal, and extralegal alike to secure his rule. That my friends is what a Fascist Authoritarian does.

We live in extraordinary times which call for extraordinary strength if our Republic is to continue in any form that resembles the intentions of the founders and their liberal enlightenment beliefs. The German Pastor, Theologian, and Martyr to the Hitler regime wrote:

“The fearful danger of the present time is that above the cry for authority, be it of a Leader or of an office, we forget that man stands alone before the ultimate authority and that anyone who lays violent hands on man here is infringing eternal laws and taking upon himself superhuman authority which will eventually crush him. The eternal law that the individual stands alone before God takes fearful vengeance where it is attacked and distorted. Thus the Leader points to the office, but Leader and office together point to the final authority itself, before which Reich or state are penultimate authorities. Leaders or offices which set themselves up as gods mock God and the individual who stands alone before him, and must perish.”

If we do not want to see the return of a full fledged government and industrial sponsored campaign to eradicate life unworthy of life, we have to fight. It is a fight that we did not chose, but if the Republic is to survive without becoming a criminal dictatorship we must speak up, and we must do so now. If we do not we have no one to blame but ourselves.

As Yehuda Bauer said: “Thou shall not be a perpetrator, thou shall not be a victim, and thou shall never, but never, be a bystander.”

The choice is ours, and the time is now. As Bonhoeffer noted: “The church has an unconditional obligation to the victims of any ordering society, even if they do not belong to the Christian community.” and also“We are not to simply bandage the wounds of victims beneath the wheels of injustice, we are to drive a spoke into the wheel itself.”

Likewise he wrote: We in the resistance have learned to see the great events of world history from below, from the perspective of the excluded, the ill treated, the powerless, the oppressed and despised… so that personal suffering has become a more useful key for understanding the world than personal happiness.”

If I as a Christian and an American officer sworn to uphold our Constitution cannot do that, I am worse than Trump and his cult. Over the past few years I have come to understand what Bonhoeffer wrote in prison:

“During the last year or so I’ve come to know and understand more and more the profound this-worldliness of Christianity.  The Christian is not ahomo religiosus, but simply a man, as Jesus was a man…I’m still discovering right up to this moment, that it is only by living completely in this world that one learns to have faith. One must completely abandon any attempt to make something of oneself, whether it be a saint, or a converted sinner, or a churchman (a so-called priestly type!) a righteous man or an unrighteous one, a sick man or a healthy one.  By this-worldliness I mean living unreservedly in life’s duties, problems, successes and failures, experiences and perplexities.  In so doing we throw ourselves completely into the arms of God, taking seriously, not our own sufferings, but those of God in the world—watching with Christ in Gethsemane. That, I think, is faith; that is metanoia; and that is how one becomes a man and a Christian.”

“I discovered later, and I’m still discovering right up to this moment, that is it only by living completely in this world that one learns to have faith. By this-worldliness I mean living unreservedly in life’s duties, problems, successes and failures. In so doing we throw ourselves completely into the arms of God, taking seriously, not our own sufferings, but those of God in the world. That, I think, is faith.”

In the midst of all the lies of Trump and his cult. In the midst of their attempt to kill as many people as possible, and to bring about a dictatorship I can only say as did Marin Luther at the Diet of Worms: 

“Since your most serene majesty and your high mightinesses require of me a simple, clear and direct answer, I will give one, and it is this: I cannot submit my faith either to the pope or to the council, because it is as clear as noonday that they have fallen into error and even into glaring inconsistency with themselves. If, then, I am not convinced by proof from Holy Scripture, or by cogent reasons, if I am not satisfied by the very text I have cited, and if my judgment is not in this way brought into subjection to God’s word, I neither can nor will retract anything; for it cannot be either safe or honest for a Christian to speak against his conscience. Here I stand; I cannot do otherwise; God help me! Amen.

I double dog dare any Trump Cultist who calls themselves a Christian to refute that.

I am tired of the so called Evangelical Christians who damn Christ and his Gospel for their political gain and shit upon their evangelical forefathers like the great Virginia Baptist John Leland who in defense of religious liberty for all wrote:

“The notion of a Christian commonwealth should be exploded forever. … Government should protect every man in thinking and speaking freely, and see that one does not abuse another. The liberty I contend for is more than toleration. The very idea of toleration is despicable; it supposes that some have a pre-eminence above the rest to grant indulgence, whereas all should be equally free, Jews, Turks, Pagans and Christians.”

I will fight for the truth, I will fight for the rights of every American. But I will not ever concede ground to a murderous group of thugs masquerading as Christians whose only goal is the continuation in power of a man who will give them anything in exchange for his unbridled power and authoritarian rule.

McCarthy to Cohn to Trump and Judgment at Nuremberg: Will You Make Your Life Excrement or Tell the Truth?

I have written about the classic film Judgment at Nuremberg many times. I am doing it again because I have been doing a lot of reading about some of the other war crimes trials conducted in post-World War II Germany, and I have been following the abject racism and white nationalism being espoused at the 2020 Republican National Convention, which might was we’ll be called the Trump Party Coronation Celebration, rather than anything that ever related to a political convention staged by any political party in American History.

In fact the GOP has subordinated itself to Trump so much that they did not even bother to publish a party platform, other than pledge their undying and absolute loyalty to the policies and actions of Trump; which change from minute to minute because of his emotional immaturity, need for control and approval, even the approval of bonafide dictators like Russia’s Putin, China’s Xi, North Korea’s Kim, and Turkey’s Erdogan. The list of dictators he admires could go on and on, but I will leave it with them, because honestly such pathetic people bore me, as does Trump. Like them, Trump will lie underneath the dung heap of history whether he wins this election or not, because there is nothing redeeming in his life, character, or actions.

Today I am following my writings about Trump and the 2020 Trump Coronation with another post regarding two of the most riveting monologues in film history, from the great drama, Judgement at Nuremberg, which is unique not simply because it dealt with the trial of the Nazi Judges, but because it took direct aim at the actions of Senator Joe McCarthy, and others who spread fear and terrorized the nation in the name of Blind patriotism and toxic nationalism. That makes it doubly interesting, but to twist the pretzel a bit further, McCarthy’s chief counsel and advisor was Roy Cohn, the future advisor and mentor to President Trump. There can be no greater connection of evil in American Politics, and it sounds like the perfect double play of evil, McCarthy to Cohn to Trump.

McCarthy was directly responsible for the deaths of many and his shameless campaign to destroy the lives and reputations of thousands of loyal and decent Americans of all walks of life. This included men General and Secretary of State George Marshall, who not only helped lead the Allies to victory in the Second World War, but helped engineer the Berlin Airlift and the Marshall Plan to bring Western Europe out of the abyss of war and Naziism.

Sadly, when McCarthy launched his attack on Marshall, Marshall’s friend and colleague of many years, Dwight Eisenhower did not speak up for him for fear of losing Wisconsin in the 1952 election. He won the state handily not needing the support of McCarthy.  However, Eisenhower, instead of making a frontal attack to condemn McCarthy decided to let McCarthy burn himself out. In the following year and a half McCarthy ruined more lives and had the highest approval rating of any politician, in the land, has except Eisenhower. Then, riding high in the polls  McCarthy went after the Army, accusing its leaders of being Communists or supporting Communism. However, the counsel for the Army, Joseph Welch went on the attack and  destroyed McCarthy and his campaign of lies and smears. His classic reply to McCarthy and Cohn was devastating, interrupting Cohen’s diatribe Welch exclaimed “Senator; you’ve done enough. Have you no sense of decency, sir? At long last, have you left no sense of decency?” It was a pivotal moment. Afterward, McCarthy’s polls crashed, the hearing were ended, Cohn resigned as McCarthy’s Counsel and McCarthy was censured by the Senate. He never recovered his previous prominence.  He died at the age of 48 of hepatitis. That being said a significant part of the American political Right Wing still admires McCarthy just as they do Trump. The reason as Welch asked McCarthy and Cohn I ask any defender of Trump: “Have you no sense of decency, sir? At long last have you no sense of decency?” Of course that is a rhetorical question, because anyone who would defend Trump today has surrendered all decency.

So on to Judgment at Nuremberg… 

In this segment of the film, which is a fictionalized version of the Judges Trial, Burt Lancaster plays an accused German Judge and Spencer Tracy plays the role of Chief Judge Dan Heywood who gives his verdict is one of the most telling sequences in cinema regarding what it means to be an American. I used to show it in the first session of my military ethics class at the Staff College and since the majority of my students had never seen the film, it usually left them in silence. So tonight I am just going to leave it with you to watch, read, and contemplate. Ask yourself, who are we, and what do we stand for?

This is especially true when the President, politicians of the majority party in the legislature, pundits, and politically minded preachers make no bones that they have every intent of persecuting those who are of certain races, religions, or political beliefs that they abhor, often using the most scurrilous charges, and outright lies in order to demonize them, dehumanize them, and  open the door for normal, decent, and even brilliant people to justify government sponsored cruelty and injustice that defies the ideals of the Declaration of Independence, the Gettysburg Address, and the Constitution itself.

Please, watch the videos and read the text. Ponder them your heart, because they speak to something that is not a historical aberration, not just a dramatic film, but something that affects the human condition and is present right here and right now in our own country.

First we deal with Lancaster and his portrayal of Ernst Janning, who in any other time would have been and remained a respected jurist with an international following. At the end of the trial he interrupted his defense attorney played by Maximilian Schell to say:

“There was a fever over the land. A fever of disgrace, of indignity, of hunger. We had a democracy, yes, but it was torn by elements within. Above all, there was fear. Fear of today, fear of tomorrow, fear of our neighbors, and fear of ourselves. Only when you understand that – can you understand what Hitler meant to us. Because he said to us: ‘Lift your heads! Be proud to be German! There are devils among us. Communists, Liberals, Jews, Gypsies! Once these devils will be destroyed, your misery will be destroyed.’ It was the old, old story of the sacrificial lamb. What about those of us who knew better? We who knew the words were lies and worse than lies? Why did we sit silent? Why did we take part? Because we loved our country! What difference does it make if a few political extremists lose their rights? What difference does it make if a few racial minorities lose their rights? It is only a passing phase. It is only a stage we are going through. It will be discarded sooner or later. Hitler himself will be discarded… sooner or later. The country is in danger. We will march out of the shadows. We will go forward. Forward is the great password. And history tells how well we succeeded, your honor. We succeeded beyond our wildest dreams. The very elements of hate and power about Hitler that mesmerized Germany, mesmerized the world! We found ourselves with sudden powerful allies. Things that had been denied to us as a democracy were open to us now. The world said ‘go ahead, take it, take it! Take Sudetenland, take the Rhineland – remilitarize it – take all of Austria, take it! And then one day we looked around and found that we were in an even more terrible danger. The ritual began in this courtoom swept over the land like a raging, roaring disease. What was going to be a passing phase had become the way of life. Your honor, I was content to sit silent during this trial. I was content to tend my roses. I was even content to let counsel try to save my name, until I realized that in order to save it, he would have to raise the specter again. You have seen him do it – he has done it here in this courtroom. He has suggested that the Third Reich worked for the benefit of people. He has suggested that we sterilized men for the welfare of the country. He has suggested that perhaps the old Jew did sleep with the sixteen year old girl, after all. Once more it is being done for love of country. It is not easy to tell the truth; but if there is to be any salvation for Germany, we who know our guilt must admit it… whatever the pain and humiliation.

I had reached my verdict on the Feldenstein case before I ever came into the courtroom. I would have found him guilty, whatever the evidence. It was not a trial at all. It was a sacrificial ritual in which Feldenstein, the Jew, was the helpless victim.

Hans Rolfe: Your Honor, I must interrupt. The defendant is not aware of what he’s saying. He’s not aware of the implications!

Janning: I am aware. I am aware! My counsel would have you believe we were not aware of the concentration camps. Not aware. Where were we? Where were we when Hitler began shrieking his hate in Reichstag? Where were we when our neighbors were being dragged out in the middle of the night to Dachau?! Where were we when every village in Germany has a railroad terminal where cattle cars were filled with children being carried off to their extermination?! Where were we when they cried out in the night to us. Were we deaf? Dumb?! Blind?!!

Hans Rolfe: Your Honor, I must protest!

Janning: My counsel says we were not aware of the extermination of the millions. He would give you the excuse: We were only aware of the extermination of the hundreds. Does that make us any the less guilty? Maybe we didn’t know the details. But if we didn’t know, it was because we didn’t want to know.

Emil Hahn: Traitor! Traitor!

Judge Haywood: Order! Order! Order! Put that man [Hahn] back in his seat and keep him there.

Janning: I am going to tell them the truth. I am going to tell them the truth if the whole world conspires against it. I am going to tell them the truth about their Ministry of Justice. Werner Lammpe, an old man who cries into his Bible now, an old man who profited by the property expropriation of every man he sent to a concentration camp. Friedrich Hofstetter, the “good German” who knew how to take orders, who sent men before him to be sterilized like so many digits. Emil Hahn, the decayed, corrupt bigot, obsessed by the evil within himself. And Ernst Janning, worse than any of them because he knew what they were, and he went along with them.

“The trial conducted before this Tribunal began over eight months ago. The record of evidence is more than ten thousand pages long, and final arguments of counsel have been concluded.

Simple murders and atrocities do not constitute the gravamen of the charges in this indictment. Rather, the charge is that of conscious participation in a nationwide, government organized system of cruelty and injustice in violation of every moral and legal principle known to all civilized nations. The Tribunal has carefully studied the record and found therein abundant evidence to support beyond a reasonable doubt the charges against these defendants.

Herr Rolfe, in his very skillful defense, has asserted that there are others who must share the ultimate responsibility for what happened here in Germany. There is truth in this. The real complaining party at the bar in this courtroom is civilization. But the Tribunal does say that the men in the dock are responsible for their actions, men who sat in black robes in judgment on other men, men who took part in the enactment of laws and decrees, the purpose of which was the extermination of humans beings, men who in executive positions actively participated in the enforcement of these laws — illegal even under German law. The principle of criminal law in every civilized society has this in common: Any person who sways another to commit murder, any person who furnishes the lethal weapon for the purpose of the crime, any person who is an accessory to the crime — is guilty.

Herr Rolfe further asserts that the defendant, Janning, was an extraordinary jurist and acted in what he thought was the best interest of this country. There is truth in this also. Janning, to be sure, is a tragic figure. We believe he loathed the evil he did. But compassion for the present torture of his soul must not beget forgetfulness of the torture and the death of millions by the Government of which he was a part. Janning’s record and his fate illuminate the most shattering truth that has emerged from this trial: If he and all of the other defendants had been degraded perverts, if all of the leaders of the Third Reich had been sadistic monsters and maniacs, then these events would have no more moral significance than an earthquake, or any other natural catastrophe. But this trial has shown that under a national crisis, ordinary — even able and extraordinary — men can delude themselves into the commission of crimes so vast and heinous that they beggar the imagination. No one who has sat at through trial can ever forget them: men sterilized because of political belief; a mockery made of friendship and faith; the murder of children. How easily it can happen.

There are those in our own country too who today speak of the “protection of country” — of “survival.” A decision must be made in the life of every nation at the very moment when the grasp of the enemy is at its throat. Then, it seems that the only way to survive is to use the means of the enemy, to rest survival upon what is expedient — to look the other way.

Well, the answer to that is “survival as what?” A country isn’t a rock. It’s not an extension of one’s self. It’s what it stands for. It’s what it stands for when standing for something is the most difficult!

Before the people of the world, let it now be noted that here, in our decision, this is what we stand for: justice, truth, and the value of a single human being.”

Think about it. I hope in the age of the faux patriotism and blind racist nationalism of the Trump Regime that it makes you uncomfortable as hell if you follow him unequivocally, or turn a blind eye to his crimes.

Trump’s Virtual Nuremberg

On March 5th 1933 the Nazi Party secured enough seats in the German Reichstag to form a coalition government with the German People’s Nationalist Party (DVNP). The Nazis won 43.9% of the vote in an election in which Hitler expected to gain an absolute majority. Hitler had gained power through the appointment of President Hindenburg on January 30th following a series of failed attempts by Conservative party leaders to form a stable government. In the month preceding the election Hitler gained the upper hand when a Dutch Communist, acting alone set fire to the Reichstag building.

Historian Timothy Snyder wrote:

“Modern tyranny is terror management. When the terrorist attack comes, remember that authoritarians exploit such events in order to consolidate power. The sudden disaster that requires the end of checks and balances, the dissolution of opposition parties, the suspension of freedom of expression, the right to a fair trial, and so on, is the oldest trick in the Hitlerian book. Do not fall for it.”

In the wake of the Reichstag Fire and under Article 48 of the the Reichstag Fire Decree Hitler mobilized 50,000 SA and SS men as auxiliary police in Prussia. Opposition parties were harassed, their newspapers shut down, leaders, especially Communists, jailed. Hermann Goering issued an order that police could open fire on any opposition. One really couldn’t call it free, but it would be the last contested election held in Germany until after her defeat and Hitler’s death.

Within two weeks the now Nazi controlled Reichstag voted for the Enabling Act, a law that in effect made it obsolete. The Act gave Hitler dictatorial powers, powers he would never willingly give up.

 

Within three months all the other German political parties were either banned or dissolved themselves. Independent newspapers were closed, or placed under Nazi propaganda supervision. Members of racial or religious minorities were persecuted and saw their citizenship rights curtailed or abolished. Political opponents or dissenting pastors and priests were placed in Concentration Camps.

Over the course of the spring and summer of 2020 we have seen the President deny, lie, and obfuscate his way through the Coronavirus 19 Pandemic, all the while casting the people actually fighting the disease as alarmist, liars, and political partisans. But it was his actions going back to ignoring intelligence warnings as early as last December that has resulted in the deaths of over 180,000 Americans, and the infection of nearly six million more. Oh, and let’s talk about many of the survivors, they have been afflicted with life long medical condition due to this, and sadly because the President is more interesting in using it as a political bludgeon, promoting discredited miracle cures and pushing the DEA to approve treatments that have not endured the scrutiny of peer reviewed results.

Of course we can go to the unbridled racism ignited by the President beginning with the announcement of his candidacy in 2015, of course there was his response to Charlottesville in 2017, his consistent approval of White Supremacists, Neo Nazis, and Neo Confederates since then, and most recently his approval of the QANON conspiracy theorists who have been called Domestic Terrorists by Federal law enforcement authorities. QANON followers have resorted to violence and threats, and a willingness to ignore facts and truth to their apocalyptic world view and their certain belief that President Trump is central to their cultish beliefs. Sadly their numbers include many self-styled Evangelical Christians. 

I won’t go into the influence of foreign governments working on the President’s behalf in 2016 now, that will be exposed by any number of ongoing investigations as well as those beginning in the House of Representatives. However, just before the Convention began the GOP issued this statement, effectively seeding the control of their party to a madman bent on authoritarian dictatorship. The GOP released this statement:

“RESOLVED, That the Republican Party has and will continue to enthusiastically support the President’s America-first agenda,” reads a one-page RNC resolution. “The 2020 Republican National Convention will adjourn without adopting a new platform until the 2024 Republican National Convention.”

This makes it the servant of an authoritarian ruler with sights on becoming a dictator. 1933 “Ein Reich! Ein Volk! Ein Führer!” Or maybe a variation on another Nazi slogan “Trump is the GOP, the GOP is Trump!” Of course in Nazi Germany the statement was “Hitler is Germany, Germany is Hitler!” 

 


Despite the factual and empirical evidence of the President’s failures his cult pretends that he is their Messiah. The President’s speeches and “press conferences” are almost always a panoply of racist tropes, scurrilous accusations, profanity, and lie after lie. He has openly threatened opponents, including those of his own party in ways I have never seen by any President of any party.

In every political speech or campaign stump speech I have ever seen him give, and I actually attended one of his rallies in October 2016, he appears possessed or under the influence of heavy doses of Amphetamines, I have compared each to a Nuremberg Party Rally, the kind that followed Hitler’s takeover. However, to keep my sanity I did not tune in and will not watch the GOP Convention, I wanted to watch some of the DNC Convention last week but events overwhelmed me. Instead I had to catch up on the speeches and events by news articles and videos. I imagine I will do the same this week, not because of events that keep me from doing so, but because I hate it when religious cultist Try to shove their crap down my throat. I send them away when the come to my door and I will be damned if I allow their poison to be fed live without interruption into my house.

I mused upon the 2019 approval numbers, 43.9%, not even a majority of the vote, just like 2016 when he lost the popular voted by over 3 million votes. The President’s former lawyer and fixer, Michael Cohen has warned us that if Trump loses the 2020 election, that there will not be a smooth transition of power. Neither Trump nor his followers will abide it. At the present the President’s approval rating remains below 40% and he continues to lose ground in most of the swing states that by a tiny sliver of the vote gained him enough Electoral College votes to claim the presidency.

Historian Timothy Snyder wrote:

“The hero of a David Lodge novel says that you don’t know, when you make love for the last time, that you are making love for the last time. Voting is like that. Some of the Germans who voted for the Nazi Party in 1932 no doubt understood that this might be the last meaningfully free election for some time, but most did not. Some of the Czechs and Slovaks who voted for the Czechoslovak Communist Party in 1946 probably realized that they were voting for the end of democracy, but most assumed they would have another chance. No doubt the Russians who voted in 1990 did not think that this would be the last free and fair election in their country’s history, which (thus far) it has been. Any election can be the last, or at least the last in the lifetime of the person casting the vote.”

Imagine, a militant minority led by an unstable and volatile con man ruling in an authoritarian state after overwhelming its Constitution and institutions. It is already beginning, and it will happen if President Trump legally or illegally retains power.

Tonight, he and those who spoke for him did not present an optimistic or hopeful vision for the country. They spoke to the dystopian and apocalyptic fears of their base, striking repeatedly on stopping the invasion of Blacks into the suburbs, of the threat of Latino immigrants, legal, and illegal, The use of the China Virus to describe the COVID19 pandemic, ignoring the Administrations’ response as well as the many GOP controlled state houses response, and the pressures put by the administration on states that had the virus under control until the yielded to the pressure of the President, his administration and his followers.

Because of this the economy and our society are in shambles. For that the President and his cult have to take credit. Over 10% unemployment, industries that are shuttering forever, and much of our service based economy shattered. We still do not have enough PPE for hospital or other essential workers, we have an anti-masking campaign mostly fronted by QANON followers and other wackos, and the administration is pushing for the full reopening of schools despite the recommendations of scientists, public health experts, and teachers when there are no universal regulations of when opening is safe and certainly no effort in many states to enforce social distancing or wearing of masks by students. The result will bring only more deaths, more infections, and lead to the closing of schools, and businesses at an ever increasing rate until the jackals of Wall Street finally realize that this is terribly bad for the economy, and the markets crash for an extended time.

Milton Mayer wrote of an encounter with a German colleague at a German University after the war. His friend noted:

“How is this to be avoided, among ordinary men, even highly educated ordinary men? Frankly, I do not know. I do not see, even now. Many, many times since it all happened I have pondered that pair of great maxims, Principiis obsta and Finem respice—‘Resist the beginnings’ and ‘Consider the end.’ But one must foresee the end in order to resist, or even see, the beginnings. One must foresee the end clearly and certainly and how is this to be done, by ordinary men or even by extraordinary men? Things might have. And everyone counts on that might.”

So take these words into your hearts and minds. “Resist the beginnings… Consider the end.”

But the end is something Snyder reminds us:

“The president is a nationalist, which is not at all the same thing as a patriot. A nationalist encourages us to be our worst, and then tells us that we are the best. A nationalist, “although endlessly brooding on power, victory, defeat, revenge,” wrote Orwell, tends to be “uninterested in what happens in the real world.” Nationalism is relativist, since the only truth is the resentment we feel when we contemplate others. As the novelist Danilo Kiš put it, nationalism “has no universal values, aesthetic or ethical.” A patriot, by contrast, wants the nation to live up to its ideals, which means asking us to be our best selves. A patriot must be concerned with the real world, which is the only place where his country can be loved and sustained. A patriot has universal values, standards by which he judges his nation, always wishing it well—and wishing that it would do better.”

Sadly, many, especially in the GOP have refused to do so. I will not make any more comments about the Trump Party Convention this week. I have no reason to expect that it will improve and I have better things to write about, and live for.

The President Who Poisons All He Touches: Donald Trump, the First American Dictator

It has been a bit over three and a half years since President Trump took the oath of office as President of the United States. Over that time his actions have been similar to other leaders of history who have gravitated towards authoritarian rule, and his Party has only emboldened him. Former GOP House Majority Leader John Boehner noted on October 26th of last year: “There is no Republican Party, only the Party of Trump.”

Today I want to share the words of British military theorist and historian B.H. Liddell-Hart and some others of note as to what happens when authoritarian, or authoritarian leaders gain control of a government. His Liddell-Hart’s words, from his short, but profound book Why Don’t We Learn from History are worth the considered read for anyone with an open mind who can, despite the proliferation of propaganda can still see clearly. Liddell-Hart wrote:

They soon begin to rid themselves of their chief helpers, “discovering” that those who brought about the new order have suddenly become traitors to it. Now think of his early supporters who he has ditched, thrown under the bus, or fired them from his cabinet.

They suppress criticism on one pretext or another and punish anyone who mentions facts which, however true, are unfavourable to their policy. Whether it be Russia, COVID19, the Post Office, his deals with Kim Jun Un, and what has happened to every member of his staff, the GOP establishment, or member of Congress who has openly criticized him, including senior Justice Department, State Department, National Security Council Staff, the Military, the Judiciary, and on and on and on.

They enlist religion on their side, if possible, or, if its leaders are not compliant, foster a new kind of religion subservient to their ends. Trump would not be in power without his willful collaborators of the Christian Right who for all intents and purposes have become his Cult.

They spend public money lavishly on material works of a striking kind, in compensation for the freedom of spirit and thought of which they have robbed the public. The President has constructed nothing truly lavish, or of any cultural value, but he has built portions of a very expensive and ineffective border wall.

They manipulate the currency to make the economic position of the state appear better than it is in reality. He first did this with his tax overhaul of 2017 which improved the stock markets, and since the malfeasance of the Treasury Department has been to prop up the markets by purchasing stocks and bonds.

They ultimately make war on some other state as a means of diverting attention from internal conditions and allowing discontent to explode outward. This has not happened yet, but he continues to ratchet up tensions with China, North Korea, and Iran, and in the latter case he brokered a peace deal with two of Iran’s most strident enemies, Israel and the United Arab Emirates, effectively binding the United States to any military actions that they might take against Iran. These is also Venezuela which albeit a failed, and repressive dictatorship, which in Trump’s crosshairs for some time. He or any of the players in these geopolitical regions which resemble a full body dry heave could vomit all over the world, and Trump would us it to do what every authoritarian ruler does when he needs attention drawn away from himself.

They use the rallying cry of patriotism as a means of riveting the chains of their personal authority more firmly on the people. Since his announcement of his candidacy Trump has made the distinction that his supporters are Patriots and those who do not are traitors. He has amped this up every year he has been in office, and his supporters are now showing up armed in the streets as he has used the police power of the state to violently attack those who protest his policies and actions.

They expand the superstructure of the state while undermining its foundations by breeding sycophants at the expense of self-respecting collaborators, by appealing to the popular taste for the grandiose and sensational instead of true values, and by fostering a romantic instead of a realistic view, thus ensuring the ultimate collapse, under their successors if not themselves, of what they have created. The President has expanded and not cut the government, especially in the areas of its police powers, and appointed men and women who are dedicated to protecting him and not the Constitution, laws, or people as heads of agencies.

This political confidence trick, itself a familiar string of tricks, has been repeated all down the ages. Yet it rarely fails to take in a fresh generation. Sadly it has taken in yet another generation, but such is no surprise to anyone who seriously studies history.

But Liddell-Hart wasn’t the only one to warn us of such leaders, those who come to power legally and the work every day to destroy the democratic systems that brought them to power. In fact this was a concern of our founders who in the Declaration of Independence noted:  A Prince whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.”

I cannot think of an American President who these were more pertinent to, then  Donald Trump. He is the man who Alexander Hamilton warned us in his words and in the Federalist Papers: “Of those men who have overturned the liberties of republics, the greatest number have begun their career by paying an obsequious court to the people, commencing demagogues and ending tyrants.”

Yale Historian and Holocaust expert Timothy Snyder warned after Trump was elected in 2016:

”The mistake is to assume that rulers who came to power through institutions cannot change or destroy those very institutions—even when that is exactly what they have announced that they will do.”

That is something I have understood since Trump first announced his candidacy in 2015. Two weeks before his election in 2016 I wrote this:

“As I watched and listened to Donald Trump before and after the third and thankfully final debate of the 2016 Presidential election, I was struck with just how viscous, vulgar, and venomous this man is. I cannot remember anyone in American politics at the national level, Republican or Democrat, or for that matter even Whig, who ever managed to immerse himself so deeply into the amoral, unethical, and undemocratic sewer that Trump has bathed himself, the Republican Party and this nation.

Trump’s toxicity is unparalleled in American politics. Everything and everyone who has ever had anything to do with him is poisoned by his touch. Wives, business partners, contractors, employees, political advisors, and supporters have all been stained by the Mustard Gas that Trump emits on a minute to minute basis. Maybe the most stained are the Evangelical Christian church leaders who have not only endorsed and defended Trump, but  who positively described his character as Christian and said nothing about Trump’s words and actions, which if an opponent had uttered, or had been accused, they would have excoriated with a particularly “Christian” self-righteousness.  Their actions have stained the witness of the church for at least the next generation and it is no wonder that young people are fleeing the church. I specifically use the imagery of Mustard Gas, not just because of its toxicity, but because of its persistence. The battlefields of World War One France and Belgium are still contaminated by it, and the toxic residue still injures people today. 

That my friends is the poisonous and corrosive effect of Donald Trump on this country.  He is a toxic and persistent threat to everyone, even his most devout followers. Race baiting, misogynistic, narcissistic, vulgar, and ignorant, Trump spews his vile venom of conspiracy theories wrapped in fiction, and coated in lies, and buttressed with near pornograpic misogyny in every direction. He has given his supporters in the heavily armed Alt-Right, the neo-Nazis, Klansmen, and White Supremacists the boldness to come out of hiding because he has normalized their hate, something that no Western statesman or politician has done since before the verdicts at Nuremberg. 

I have long felt that Trump reminded me of Nazi leaders, but frankly most of them, while every bit as toxic as Trump were both more intelligent and were better able to cover the darkness of their amoral souls with a modicum of respectability, with the exception of one; the publisher of the infamous newspaper Der Sturmer, and Gauleiter of Nuremberg, Julius Streicher. 

Robert Jackson, the Associate Justice of the Supreme Court who served as the Chief American Prosecutor at Nuremberg referred to Streicher in his summation:

“Streicher, the venomous vulgarian, manufactured and distributed obscene racial libels which incited the populace to accept and assist the progressively savage operations of “race purification.” 

Is that not exactly what Trump has done during his seventeen month campaign to stir up race hatred against Mexicans and Arabs, not to mention Asians and Blacks? Of course it is, which is exactly why the leaders of the Alt-Right claim him as their candidate, the man who in their perverted minds has made them respectable again and ready to assume their place in Trump’s new order. Anti-Semitism and racism runs rampant in the words of his closest collaborators such as the Breitbart News chief Steve Bannon, as well as Alt-Right Neo-Nazi and KKK leaders like David Duke, Richard Spencer, Jared Taylor, and Peter Brimalow. 

My friends, what you see in Trump is what you get. Unlike Hitler and Goering, but much like Streicher, Trump has no capability of maintaining any sort of respectability. Based on what he says on a daily basis, including admitting that he was deliberately sabotaging the ability of the US Postal Service to ensure that the mail in and absentee ballots are not received in time to be counted for the General Election. If he is successful is an action that will ensure no clear result, confusion, and creating a crisis that our electoral system was not designed to handle and cast doubt on our electoral system that will allow him to win and then proclaim himself President for life.

That might seem cynical but Trump has said “Trump 2024, 2028, 2032” and so on. There is no doubt that his supporters would attempt to overturn the 22nd  Amendment to the Constitution which limits Presidents to two terms in office, including some who have encouraged that.

What President Trump and his appointees are doing is in direct contravention of the Declaration, the Constitution, U.S. Code, the intents of our Founders, and anyone that values liberty for all, not the few.

Judge Learned Hand spoke these words to a citizenship ceremony in which a million and a half people were present in New York’s Central Park, two weeks before D-Day and I think they are most applicable now:

“What do we mean when we say that first of all we seek liberty? I often wonder whether we do not rest our hopes too much upon constitutions, upon laws and upon courts. These are false hopes; believe me, these are false hopes. Liberty lies in the hearts of men and women; when it dies there, no constitution, no law, no court can save it; no constitution, no law, no court can even do much to help it… What is this liberty that must lie in the hearts of men and women? It is not the ruthless, the unbridled will; it is not the freedom to do as one likes. That is the denial of liberty and leads straight to its overthrow. A society in which men recognize no check their freedom soon becomes a society where freedom is the possession of only a savage few — as we have learned to our sorrow.

What then is the spirit of liberty? I cannot define it; I can only tell you my own faith. The spirit of liberty is the spirit which is not too sure that it is right; the spirit of liberty is the spirit which seeks to understand the minds of other men and women; the spirit of liberty is the spirit which weighs their interests alongside its own without bias; the spirit of liberty remembers that not even a sparrow falls to earth unheeded; the spirit of liberty is the spirit of Him who, near two thousand years ago, taught mankind that lesson it has never learned, but has never quite forgotten; that there may be a kingdom where the least shall be heard and considered side by side with the greatest.”

This is what is at stake today. We have a Venomous Vulgarian like Julius Streicher as our President. He is a man so open and unrepentant in his racist, anti-immigrant, and anti-American System of Government statements, tweets, and executive orders that it is glaringly obvious to anyone with eyes to see and ears to hear, except to his Cult who have sworn their eternal allegiance to him. I am not one of them. I am bound by my oath to the Constitution and my vows as a Priest to oppose him at every opportunity. I will obey every legal order, but I will not sacrifice my sacred oath to the Constitution and vows as a Priest in the Holy Catholic Church, to him.

I have both witnessed and experienced what happens to those who merely speak out against his policies based on my oath to the Constitution and my sacred vows as a priest. All that matters to Trump is personal loyalty, which he has neither earned or deserved. He is a draft dodger, he is a serial adulterer, a racist, a serial bankruptcy artist who has left thousands of contractors, employees, and students in the lurch. Likewise he is a serial liar the kind of which has never been seen in history. He makes Hitler and his minions, Stalin and his successors until Gorbachev, Castro, Lenin, Mussolini, Franco, Quisling, Petain and Laval, Putin, the Ayatollahs, Saddam Hussein, Pol Pot, Jefferson Davis and the Lost Cause Cult, and all of the North Korean Kim Family look like pillars of honesty and decency. As an American, it shames me to have to admit this. He makes a mockery of the Christian faith yet his strongest supporters are supposed conservative and evangelical Christians, people who now believe more in the QAon lies than the Gospel.

How can I remain silent? I refuse to be one of his perpetrators, I will fight to ensure that I am not a victim, and most of all I cannot and will not be a bystander and turn my back on his crimes, those already committed and those that he is planning. The German Pastor, theologian, and martyr to Hitler, Dietrich Bonhoeffer wrote:

“We must finally stop appealing to theology to justify our reserved silence about what the state is doing — for that is nothing but fear. ‘Open your mouth for the one who is voiceless’ — for who in the church today still remembers that that is the least of the Bible’s demands in times such as these?”

And I stand by the 22 year old German University student and martyr Sophie Scholl who in writing about Hitler might have well been writing about Trump and his Christian followers:

“Every word that comes from Hitler’s mouth is a lie. When he says peace, he means war, and when he blasphemously uses the name of the Almighty, he means the power of evil, the fallen angel, Satan. His mouth is the foul-smelling maw of Hell, and his might is at bottom accursed…. I ask you, you as a Christian wrestling for the preservation of your greatest treasure, whether you hesitate, whether you incline toward intrigue, calculation, or procrastination in the hope that someone else will raise his arm in your defence? Has God not given you the strength, the will to fight? We must attack evil where it is strongest, and it is strongest in the power of Hitler.”

It is quite obvious to me that most American Christians are either completely supportive of Trump, or too afraid to say anything. Some of us do, and I will finish with the words of yet another German martyr to Hitler, Major General Henning Von Tresckow:

cannot understand how people can still call themselves Christians and not be furious adversaries of Hitler’s regime.”

Tresckow also said:

“It is almost certain that we will fail. But how will future history judge the German people, if not even a handful of men had the courage to put an end to that criminal?”

We have to put an end to the Trump regime at the ballot box, and even that may not cause him give up without a physical fight. His former attorney, Michael Cohen has said exactly that. Trump is destroying the hard work of Americans and our allies to build a better would, and in almost every country, Trump is destroying the image of the United States, like Tresckow said in his time:

“We have to show the world that not all of us are like him. Otherwise, this will always be Hitler’s Germany.”

I say to you, whether it is in the spoken word, the written word, the acts of non-violent protests, and at the ballot box we have to put an end to this before he destroys all of us, even his cult of supporters who he would not hesitate to abandon when he no longer needs them, or he knows his reign of terror is at an end, and blames them for his defeat.

If we are too timid or afraid to stand now, this will be forever Trump’s America. Not the America of our Founders or the reformers and resisters who successful fought for the end of slavery, the citizenship of every native born American, the right to vote for first black men, then all women, then the members of our First Nations, then Japanese and other Asians, overturned Jim Crow, fought for civil rights for all, including LGBTQ citizens who were denied the right to marry, property rights, and civil rights long after almost every other American had them.

We have to win this fight legally at the ballot box.

Friends of Padre Steve’s World,

In spite of being very busy working in the house and going  back to work to deal with the crisis d’jour I have been very reflective about all I have been through over the past couple of years. Unlike past times of reflection this has been a rather uplifting experience of grace and not a de-evolution into a morbid state of moroseness.

Two years ago I put in my papers for voluntary retirement from the Navy. The previous 28 months in my old billet as the Command Chaplain at Joint Expeditionary Base, Little Creek – Fort Story had convinced me that the pain of trying to care for and fight for unappreciative people, including people who tried to destroy my life and career was not worth the fight. But just days after I put it in and the retirement request was approved I suffered a fall down my stairs while dealing with bilateral knee, ankle, and right hip injuries while making home repairs. My request was to retire on 1 September 2019, but by April 2019 with failed surgeries, injection treatments, and physical therapy, I realized that more needed to be done and requested that my retirement date be shifted to my statutory retirement date of 1 April 2020. However, when I called the retirement branch at Naval Personnel Command, I was told that there had been a mistake and that my actual statuary date was 1 August 2020.

Since everyone was planning on my September retirement, and my relief was already in place, the new situation was unbearable to the command, and something had to be done. So they transferred me to an unoccupied billet in which they could hide me while sending me on temporary duty orders to Norfolk Naval Shipyard, which turned out to be my earthly salvation. When the Coronavirus 19 pandemic hit, the Navy asked a few officers in certain specialties to volunteer to remain on service past their retirement date, until December 31st 2002. I had come to love the people I served and had my faith and call as a Priest renewed.There was no pressure, all I had to do was make myself known, get out among our people and be transparent, caring for and respecting everyone, not just Christians. In the past couple of years I’ve experienced and learned more about forgiveness and forgiving wrongs committed against me, and recognizing actions committed by me that hurt others.

The fact is that I have a tremendous ability to dwell upon injustices committed against others, especially those done by powerful people who use their position to deliberately cause harm or death to people. This you will see a steady stream of articles addressing things like slavery, racism, the Holocaust, unjust wars, government actions that do deliberately harm to the most vulnerable members of society.

While do really love the concept of forgiveness, as a Christian I have no idea of how Jesus managed to forgive, even to the point of sacrificing his life to forgive the sins of the world.  Nor do I really understand how the great saints of every faith managed to live lives full of grace and forgiveness. It probably goes back to my Irish-Scottish DNA,  that can make one a hilarious hoot one minute and a brooding bore the next regardless of whether or not alcohol is involved.

But there is something that I have learned: forgiveness doesn’t require me to be dishonest about how I feel about something. I learned that from Raymond Reddington, and yes I have been binge-watching The Blacklist of late and I find Reddington’s grip on philosophy, religion, and the human condition to be quite fascinating. Reddington observed:

“Sins should be buried like the dead. Not that they may be forgotten but we may remember them and find our way forward nonetheless.”

Truthfully I don’t believe in the forgive and forget bullshit, it’s a nice thought, but my brain doesn’t work that way. I can forgive someone every day, but the memories will still be there. That’s what makes it so hard. As Reddington said to Donald Ressler:

“There is nothing that can take the pain away. But eventually, you will find a way to live with it. There will be nightmares. And every day when you wake up, it will be the first thing you think about. Until one day, it’s the second.”

That is why the Christian understanding of the forgiveness of sins is so important to me and so difficult. It certainly wasn’t meant to be easy or painless, but it might make a difference, as Reddington noted:

“A friend told me recently that forgiveness won’t change the past but could very well change their future. Apparently, everything is forgivable.” 

So that’s all for today. Yes I know there are many things going on that I can write about but right now I need to stay in this place for a moment.

“Say I Slew Them Not” Genocide, Crimes Against Humanity, and the U.S. Response to COVID19

I have to admit that the amount of ignorance in the defense of evil that I see daily is simply mind blowing. It makes me shake my head. But then I cannot be surprised anymore. Over the weekend I saw a poll in which nine percent of Americans said that holding White Supremacist or Neo-Nazi views and ideology was okay.

Now nine percent doesn’t sound like a big number or anything to worry about until you extrapolate that percentage into the numbers of people who hold that view. Based on the population of the United States that nine percent equals about thirty million individuals. Now I’m sure that many of these patriotic Americans are not card carrying Klansmen or Nazis, but the fact that they would turn a blind eye to the evil of both in the name of some incomprehensible moral equivalence as did President Trump after Charlottesville is quite disturbing. Perhaps it is his example that enables them to be so open about their acceptance of evil.

Yesterday on my Facebook page a friend of a friend commented on an article which discussed new research that indicates that the Nazis in their occupation of the Ukraine killed perhaps a half million more Jews than previously believed. That woman made the comment that there were others, and yes that is true. Had the Nazis won the war tens of millions more of the Jews as well as the Slavs who they referred to as Untermenschen or subhumans would have been killed, either directly or through a policy of intentional starvation. But make no bones about it, from the months that Hitler spent in Landsberg prison for his role in the Beer Hall Putsch of 1923 writing Mein Kampf until the end of the war as the Red Army closed in on his bunker in Berlin, the Jews above all were the object of his personal hatred.

Close to six million Jews and millions of others were killed by the Nazis. Millions of Africans were enslaved in the United States and even after emancipation were by law treated as less than full citizens. Under Jim Crow they were discriminated against at every level of government including states that were neither a part of the Confederacy or not even States when the Civil War was fought, they were impressed as forced labor under the Black Codes and thousands were murdered, often in public by people who brought their children to watch Black men die.

But these people were not just numbers. It’s all to easy to blur them into a mass of dehumanized humanity by talking about the millions, when every single one was a human being, yes, I believe created in the image of God. We have to see their faces and we have to recognize their essential humanity as men and women, children, fathers, mothers, brothers, sisters, husbands and wives, whose lives were in the case of the Jews obliterated as if they never existed, and others like African slaves who were simply property.

I explained that in quite a few fewer words and told her that she shouldn’t challenge me on the subject, which of course she did. So I went into more detail and shot her argument down in flames, to the cheers of other commentators on the post. When you have spent much of your academic life studying a subject it really gets old hearing people make excuse for evil by trying to minimize that evil, especially against the targeted people.

It’s like Confederate apologists saying that the institution of slavery which enslaved millions of Africans was actually worse for White people. Yes it is true that many poor whites benefited little from slavery, but they were not bought and sold as chattel, sold away from their wives and children, whipped, and marched across country in chains to new owners, or yes even killed simply because they were not considered human beings but property.

Sadly, as Dr. Timothy Snyder wrote “The history of the Holocaust is not over. Its precedent is eternal, and its lessons have not yet been learned.”

So there are about 30 million Americans who believe that holding Nazi and White Supremacist beliefs is okay. A few years ago I would believed that the number was lower, but after seven months of living in Trump’s America I believe that it might be even higher than the poll indicated. I only say this based on the postings I see on various social media platforms, news comment pages, the proliferation of websites that cater to these beliefs, and the lack of real condemnation of such individuals by the majority of the GOP Senate and House majorities, and the outright defense of them by other GOP representatives at the Federal and State level. These people have not learned the lessons of the Holocaust, nor American slavery.

Again I don’t believe that the majority of these people are real card carrying Nazis or Klansmen. Most would probably be considered great citizens: they work, they raise families, they go to church, and many would claim that they have “a Black or Jewish friend” so obviously they cannot be racists. But that being said they turn a blind eye to the evil of race hatred and White supremacy, and sometimes join in on social media meme wars where they mock the victims. But no matter what, not condemning the purveyors of White Supremacist or Neo-Nazi ideology, or by using the arguments of moral equivalence to minimize those crimes against humanity makes these people as complicit in the past, present, and future crimes of Naziism as if they were.

They may be ordinary people, as seemingly normal as anyone else, but as Hannah Arendt noted about Adolf Eichmann and other Nazis who advanced the destruction of the Jews was that they were so normal. She wrote:

“The trouble with Eichmann was precisely that so many were like him, and that the many were neither perverted nor sadistic, that they were, and still are, terribly and terrifyingly normal. From the viewpoint of our legal institutions and of our moral standards of judgment, this normality was much more terrifying than all the atrocities put together.”

That my friends is as true as the day she wrote it after Eichmann’s trial, as it is today, and why we must constantly educate people in every forum possible that it is all too easy to become either a perpetrator or evil or a bystander. As Snyder wrote:

“It is less appealing, but morally more urgent, to understand the actions of the perpetrators. The moral danger, after all, is never that one might become a victim but that one might be a perpetrator or a bystander. It is tempting to say that a Nazi murderer is beyond the pale of understanding. …Yet to deny a human being his human character is to render ethics impossible. To yield to this temptation, to find other people inhuman, is to take a step toward, not away from, the Nazi position. To find other people incomprehensible is to abandon the search for understanding, and thus to abandon history.”

Since they were human beings the Nazis were not unique to history. In every era of history human beings have committed atrocities, many in the name of some kind of ethnic, religious, or nationalist ideology of supremacy that held other people to be less than human. That may sound harsh, but it is all too true based on history.

Yehuda Bauer wrote: “The horror of the Holocaust is not that it deviated from human norms; the horror is that it didn’t. What happened may happen again, to others not necessarily Jews, perpetrated by others, not necessarily Germans. We are all possible victims, possible perpetrators, possible bystanders.”

In the movie Judgment at Nuremberg the judge played by Spencer Tracy noted something important about the defendants in the trial. His words need to be heard today as well:

Janning, to be sure, is a tragic figure. We believe he loathed the evil he did. But compassion for the present torture of his soul must not beget forgetfulness of the torture and the death of millions by the Government of which he was a part. Janning’s record and his fate illuminate the most shattering truth that has emerged from this trial: If he and all of the other defendants had been degraded perverts, if all of the leaders of the Third Reich had been sadistic monsters and maniacs, then these events would have no more moral significance than an earthquake, or any other natural catastrophe.

But this trial has shown that under a national crisis, ordinary – even able and extraordinary – men can delude themselves into the commission of crimes so vast and heinous that they beggar the imagination. No one who has sat through the trial can ever forget them: men sterilized because of political belief; a mockery made of friendship and faith; the murder of children. How easily it can happen. There are those in our own country too who today speak of the “protection of country” – of ‘survival’. A decision must be made in the life of every nation at the very moment when the grasp of the enemy is at its throat. Then, it seems that the only way to survive is to use the means of the enemy, to rest survival upon what is expedient – to look the other way. Well, the answer to that is ‘survival as what’? A country isn’t a rock. It’s not an extension of one’s self. It’s what it stands for. It’s what it stands for when standing for something is the most difficult! Before the people of the world, let it now be noted that here, in our decision, this is what we stand for: justice, truth, and the value of a single human being.

We have not learned any of those lessons as Americans and it is being seen in the response of the Trump Administration, Republican Senators and Representatives, as well as many GOP state and local, officials to the Coronavirus 19 pandemic. This pandemic has already claimed the lives of over 170,000 Americans, with roughly two and a half million currently infected, with over 50,000 cases a day, a number that with the reopening of many schools is probably going to increase to 70,000 or more in the next few weeks with a death rate that will increase correspondingly a few weeks later. Despite that the lies of the Coronavirus 19 pandemic deniers, led by President Trump continue to deny and lie, as if the dead were not dead. As Justice Robert Jackson said of the defendants at the Major War Crimes Trial at Nuremberg, the blood of these people is on their hands

“They stand before the record of this trial as bloodstained Gloucester stood by the body of his slain King. He begged of the widow, as they beg of you: “Say I slew them not.” And the Queen replied, “Then say they were not slain. But dead they are ….” If you were to say of these men that they are not guilty, it would be as true to say that there has been no war, there are no slain, there has been no crime.” 


That is exactly what Trump and his racist and pandemic denying cult are guilty of, and they will continue to shed to blood of fellow Americans citizens until, and probably after when he leaves office. And every person they kill through their inaction, lack of empathy, and their willingness to share in the crimes of Trump, is very little different from Germans who said nothing as Hitler’s cult slaughtered the Jews and Millions of others in their dreams of a pure Aryan race, and Lebensraum or living space, even if it meant killing millions of innocent victims. American Army Psychologist Gustave Gilbert wrote in his book:

“In my work with the defendants (at the Nuremberg Trails 1945-1949) I was searching for the nature of evil and I now think I have come close to defining it. A lack of empathy. It’s the one characteristic that connects all the defendants, a genuine incapacity to feel with their fellow men. Evil, I think, is the absence of empathy.”

The people of today who support the policies of Trump, the GOP, and their propagandists who are directly responsible through their words, policies, and lack of responsibility are no different than the supporters of Hitler who carried out the Holocaust and regarded their victims very much As such they are no different than Joseph Stalin who said: “The death of one man is tragic, but the death of thousands is statistic.”

It is high time that we learn that again and that we make up our minds to oppose the ideologies that made the Holocaust,  Slavery and our pathetic and often selfish response to the Coronavirus 19 pandemic possible. As Hannah Arendt observed: “The sad truth is that most evil is done by people who never make up their minds to be good or evil.”  Those who defend the actions, take part in them, or remain bystanders and make excuses for themselves on demonstrate the depths of moral depravity they have sunk to, the depths of their narcissism, and their complete lack of empathy for the victims. In other words just what malignant sociopaths they are.

COVID19 Deniers and Enablers: Trump, His Cult and the Commission of Crimes Against Humanity

I hate having to write this, especially because the deliberate lies and intentional malfeasance of government officials, and their enablers who have allowed as of yesterday over 164,000 of their own citizens die from a deadly virus. That virus, the Coronavirus 19, while highly contagious and dangerous could have been contained with far less loss of life, economic carnage, and social disruption than the Cult built around President Donald Trump has saddled us with.

The cost to date: over 164,000 dead, over Five Million infected, of whom some 2.3 Million are still infected, about 1-2% are in serious or critical condition. Since 6% of the closed cases, that is known cases with some manner or level of recovery and deaths resulted in death, a statistic which is consistent with the world’s death rate, we can probably expect that of the 2.3 Million currently infected, that somewhere around 138,000 will die, not including those infected after I write this.

Of course that number could be lower or higher, but that really depends on how overwhelmed hospitals, especially rural or community hospitals which have very limited and critical care or ICU capacity are hit. If one looks at the statistics at the county level in predominantly rural states, this is worse than the major medical centers in the major cities and metropolitan centers of those same states being so overwhelmed by cases and deaths that they need refrigerated cargo trailers to put the bodies of the COVID19 dead that won’t fit in their morgues

But I have to ask: How can it be that a Modern, highly technological society with some of the most advanced medical centers, physicians and research institutions be the hardest hit country in the world by the Coronavirus 19? It is a fair question because we only have about 4.25% of the world’s population but have over 25% of the total number of infections, and just under 25% of the total deaths in the world. Add to this that we have a natural defensive barrier of two oceans to keep infected people out of the country.

But let us assume that better protocols and drugs that lower the death rate to one or two percent the deaths of those infected as of today would be 23,000 to 46,000 deaths. But that does not count the people being infected at 50,000 to 70,000 a day, before we reopen schools, which in states like Georgia are being reopened without social distancing or any requirement for masks. Sadly, despite the factual inaccuracy of President Trump’s statements that children and young people don’t get the virus, they do. Some die, but they spread the virus to teachers, cafeteria workers, administrators, parents, siblings, grandparents, aunts, uncles, cousins, and neighbors. This is a game changer, because when we shut down schools we limited the spread of the virus. The same thing happened when we made a decision to lock everything down until certain criteria of infection rates, deaths and those hospitalized went down.

Unfortunately, when President Trump gave states the opportunity to reopen businesses, restaurants, entertainment venues they did so, many under the pressure of the administration, opened before any of their states had met the Center for Disease metrics for reopening. Since then, the virus has grown exponentially. The current and gold standard models for COVID19 related deaths, that of the University of Washington project that at current rates with no changes that by 1 December 2020, that if things remain as they are we will have almost 300,000 deaths,  if restrictions are eased that number rises to almost 500,000, but if they are strengthen by law that number could fall to 230,000 if every swinging Richard and Mulva wears their face masks. Of course the latter will never happen and even if an effective vaccine is developed and fielded in the requisite numbers, the dumb-ass anti-vaxers and their political, propaganda and religious allies will do all that they can to ensure that as few people get it as they can. If the religious among them claim to be pro-life, then they are liars, because once a baby leave the womb they don’t care if it lives or dies, and that is the brutal truth.

Now I admit that the charge of Crimes Against Humanity as currently defined by the U.N., the Treaty of Rome, and the Nuremberg and Tokyo International War Crimes Tribunals never anticipated any government acting in am manner to ensure the maximum number of its citizens are infected and killed by a virus that they though their willing negligence and malfeasance of their government were killed. Maybe it is time to amend international law to include such actions as crimes against humanity, and maybe it is time for the leaders of the United States to follow in word and deed what Associate Supreme Court Justice Robert Jackson when the charges against the Nazi War Criminals were developed before Nuremberg:

Sadly, there are now many Trump supporters, who claim that yes their is a pandemic, but that the numbers of deaths and infections are inflated. When you get to the hear of their arguments they are in substance no different than Holocaust Deniers. For such people are quite willing to sacrifice the lives those of less value than themselves, the elderly, the disabled, racial, ethnic, and religious minorities, and Non-white immigrants, and yes, that includes pregnant mothers just to prove their point and say that their supposed freedom matters more than the lives of others.

As such they are no different than Joseph Stalin who said: “The death of one man is tragic, but the death of thousands is statistic.” 

Sadly the vast majority of Trump supporters who deny the evidence, make light of the deaths, and argue that certain lives are worth more than others prove their agreement with the Soviet Dictator. I say the hell with them and any other participant or bystander when human rights are being steamrolled, the Constitution being trampled, and the greatest commandments of the Jewish and Christian Religions are upended by their supposed defenders.

The German martyr Dietrich Bonhoeffer wrote:

“Christianity stands or falls with its revolutionary protest against violence, arbitrariness and pride of power and with its plea for the weak. Christians are doing too little to make these points clear rather than too much. Christendom adjusts itself far too easily to the worship of power. Christians should give more offense, shock the world far more, than they are doing now. Christian should take a stronger stand in favor of the weak rather than considering first the possible right of the strong.”

He also said:

“If I sit next to a madman as he drives a car into a group of innocent bystanders, I can’t, as a Christian, simply wait for the catastrophe, then comfort the wounded and bury the dead. I must try to wrestle the steering wheel out of the hands of the driver.”


Another, Major General Henning Von Tresckow said: We have to show the world that not all of us are like him. Otherwise, this will always be Hitler’s Germany.”

General Ludwig Beck said: “Final decisions about the nation’s existence are at stake here; history will incriminate these leaders with bloodguilt if they do not act in accordance with their specialist political knowledge and conscience. Their soldierly obedience reaches its limit when their knowledge, their conscience, and their responsibility forbid carrying out an order.”


Sophie Scholl
a twenty-two year old student at the University of Munich and a leader of the anti-Nazi White Rose Resistance movement wrote:

The real damage is done by those millions who want to ‘survive.’ The honest men who just want to be left in peace. Those who don’t want their little lives disturbed by anything bigger than themselves. Those with no sides and no causes. Those who won’t take measure of their own strength, for fear of antagonizing their own weakness. Those who don’t like to make waves—or enemies. Those for whom freedom, honour, truth, and principles are only literature. Those who live small, mate small, die small. It’s the reductionist approach to life: if you keep it small, you’ll keep it under control. If you don’t make any noise, the bogeyman won’t find you. But it’s all an illusion, because they die too, those people who roll up their spirits into tiny little balls so as to be safe. Safe?! From what? Life is always on the edge of death; narrow streets lead to the same place as wide avenues, and a little candle burns itself out just like a flaming torch does. I choose my own way to burn.”

And finally, the words of  the leader of the Protestant Reformation, Martin Luther: “Unless I am convicted by scripture and plain reason – I do not accept the authority of the popes and councils, for they have contradicted each other – my conscience is captive to the Word of God. I cannot and I will not recant anything for to go against conscience is neither right nor safe. God help me. Amen.”It is legend that Luther said the words “Here I stand. I cannot do otherwise. God help me.”

That being said, Luther’s, Scholl’s, Beck’s, Von Tresckow’s and Bonhoeffer’s words are my words today, both in reference to the Constitution and my vows as a Christian, Deacon, and Priest.

The Combination of Trump and his System has Brought About this Catastrophe

The crimes of Adolf Hitler’s Nazi regime may seem like the happened a long time ago in a galaxy far, far away, we would all like to believe that. However, they are only as far away as the next time. That is why we must continue to show them in their awful reality. Yehuda Bauer, a renowned historian of the Holocaust whose family escaped from Czechoslovakia the day it was annexed by the Third Reich wrote:

“The horror of the Holocaust is not that it deviated from human norms; the horror is that it didn’t. What happened may happen again, to others not necessarily Jews, perpetrated by others, not necessarily Germans. We are all possible victims, possible perpetrators, possible bystanders.”

This is an eternal truth. The Red Chinese in Tibet, the Cambodian Killing Fields, the Serbians massacring Bosnians under the noses of Dutch Peacekeepers in Srebrenica, the Tutsis of Rwanda butchered by their Hutu neighbors shortly after Easter, as well as the crimes of the Islamic State against Kurds, opposition Sunnis, Shia, Yazidis, and Christians in Iraq and Syria.

Besides genocide we can add the crime of aggressive war against weaker neighbors or nations committed Russia in Georgia and the Ukraine, and the United States against Iraq. Then there is the assault on minority groups within various nations, the rejection of refugees, and rise in anti-Semitism across Russia, Europe, and the United States have all produced myriads of victims, perpetrators, and bystanders.

The crimes committed by the Nazis against their own citizens and the nations that they victimized are not completely unique to them. While the Nazi Genocide committed against the Jews is unique, what motivated them is far more common than we would want to admit. The Holocaust and the Nazi war for Lebensraum is not an aberration from the norms of human nature, it is the norm. That is why continuing to expose those crimes, the men and women behind them, and those who stood by, doing nothing while their neighbors were being marched away, or stood by as other men marched men, women, and children to massive pits and shot them one by one, up close and personal, by the tens of thousands.

I would like with all my heart to consign the crimes of the Nazis to the depths of history, but I cannot. That is why I, a man born thirteen and a half years after the major Nuremberg War Crimes ended with ten of the defendants hanging from the gallows continues to write about it.

However, that is not the case. What is happening in the United States under the authoritarian regime of President Trump which is smashing the legal, constitutional, and institutional guardrails that until now preventing a Chief Executive from becoming an autocrat are endangering the Republic and threading to destroy our system of government, our alliances, economy, National security, and the lives and civil rights of all Americans, including his deluded cult followers who he will condemn to death by COVID19, lack of health care, or simply betray them to poverty, unemployment and opioid addiction. Of course as far as the heavily armed self-proclaimed militias, they would do well to remember the story of SA the Sturmanteilung, or Storm Troopers, that once their purpose was finished, Hitler killed their leaders and consigned them to the lowest rungs of the Nazi hierarchy, with meaningless titles and no power. He needed no competition from an armed force that wanted to displace the military, police, and SS from their positions. No one, not even his faithful should trust him because he only cares for himself, and will blame them if he falls from power.

Albert Speer commented:

“The tremendous danger, however, contained in this totalitarian system only became abundantly clear at the moment when we were approaching the end. It was then that one could see what the meaning of the principle was, namely, that every order should be carried out without any criticism. Everything . . . you have seen in the way of orders which were carried out without any consideration, did after all turn out to be mistakes . . . This system let me put it like this to the end of the system it had become clear what tremendous dangers are contained in any such system, as such quite apart from Hitler’s principle. The combination of Hitler and this system, then, brought about this tremendous catastrophe to this world.” 

He told his staff on the morning of 22 April 1945:

“Everyone has lied to me, everyone has deceived me… the SS left me in the lurch. The German people have not fought heroically. It deserves to perish… it is not I who have lost the war, but the German people.”

If Trump loses and lives, that will be his judgement on both the nation and those who followed him into the abyss of his own making. After all, he has never taken personal responsibility for anything;  his multiple corporate bankruptcies, his avoidance of military service in Vietnam, his failed marriages, all which all ended because of his unfaithfulness to his wives, and then with the Coronavirus 19 Pandemic, where he has claimed on several occasions, “I take no responsibility for anything.”  That is one thing that he is not lying about. To him, all of his failures are the fault of someone else.

Over the past few days I have been writing about the Nuremberg Trials and the American Chief Prosecutor, Supreme Court Justice Robert Jackson. Last night I wrote about the introduction of his closing arguments before the Tribunal which followed his opening address by nine months. I now continue with Justice Jackson’s closing arguments against the Nazi war criminals sitting in the dock of Nuremberg’s Palace of Justice, many of whom were little different than Trump and his sycophants.

THE CRIMES OF THE NAZI REGIME

The strength of the case against these defendants under the conspiracy count, which it is the duty of the United States to argue, lies in its simplicity. It involves but three ultimate inquiries: First, have the acts defined by the Charter as crimes been committed; second, were they committed pursuant to a common plan or conspiracy; third, are these defendants among those who are criminally responsible? The charge requires examination of a criminal policy, not of a multitude of isolated, unplanned, or disputed crimes. The substantive crimes upon which we rely, either as goals of a common plan or as means for its accomplishment, are admitted. The pillars which uphold the conspiracy charge may be found in five groups of overt acts, whose character and magnitude are important considerations in appraising the proof of conspiracy.

1. THE SEIZURE OF POWER AND SUBJUGATION OF GERMANY TO A POLICE STATE The Nazi Party seized control of the German State in 1933. “Seizure of power” is a characterisation used by defendants and defence witnesses, and so apt that it has passed into both history and everyday speech. The Nazi junta in the early days lived in constant fear of overthrow. Goering, in 1934, pointed out that its enemies were legion, and said:

“Therefore, the concentration camps have been created, where we have first confined thousands of Communists and Social Democrat functionaries.”

In 1933 Goering forecast the whole programme of purposeful cruelty and oppression when he publicly announced:

“Whoever in the future raises a hand against a representative of the National Socialist movement or of the State must know that he will lose his life in a very short while.”

New political crimes were created to this end. It was made a treason, punishable with death, to organize or support a political party other than the Nazi Party. Circulating a false or exaggerated statement, or one which would harm the State or even the Party, was made a crime. Laws were enacted of such ambiguity that they could be used to punish almost any innocent act. It was, for example, made a crime to provoke “any act contrary to the public welfare”.

The doctrine of punishment by analogy was introduced to enable conviction for acts which no statute forbade. Minister of Justice Guertner explained that National Socialism considered every violation of the goals of life which the community set up for itself to be a wrong per se, and that the acts could be punished even though it was not contrary to existing “formal law”.

The Gestapo and the SD were instrumentalities of an espionage system which penetrated public and private life. Goering controlled a personal wiretapping unit. All privacy of communication was abolished. Party Blockleiter appointed over every 50 householders spied continuously on all within their ken.

Upon the strength of this spying individuals were dragged off to “protective custody” and to concentration camps without legal proceedings of any kind1and without statement of any reason therefore. The partisan political police were exempted from effective legal responsibility for their acts.

With all administrative offices in Nazi control and with the Reichstag reduced to impotence, the judiciary remained the last obstacle to this reign of terror. But its independence was soon overcome and it was reorganised to dispense a venal justice. Judges were ousted for political or racial reasons and were spied upon and put under pressure to join the Nazi Party. After the Supreme Court had acquitted three of the four men whom the Nazis accused of setting the Reichstag on fire, its jurisdiction over treason cases was transferred to a newly established “People’s Court” consisting of two judges and five Party officials. The German film of this “People’s Court” in operation, which the showed in this chamber, revealed its presiding judge pouring partisan abuse on speechless defendants. Special courts were created to try political crimes, only Party members were appointed judges, and “Judges’ letters” instructed the puppet judges as to the “general lines” they must follow.

The result was the removal of all peaceable means either to resist or to change the Government. Having sneaked through the portals of power, the Nazis slammed the gate in the face of all others who might also aspire to enter. Since the law was what the Nazis said it was, every form of opposition was rooted out and every dissenting voice throttled. Germany was in the clutch of a police State, which used the fear of the concentration camp as a means to enforce non-resistance. The Party was the State, the State was the Party, and terror by day and death by night were the policy of both.

2. THE PREPARATION AND WAGING OF WARS OF AGGRESSION From the moment the Nazis seized power, they set about with feverish but stealthy efforts, in defiance of the Versailles Treaty, to arm for war. In 1933 they found no air force. By 1939 they had 21 squadrons, consisting of 240 echelons or about 2,400 first-line planes, together with trainers and transports.

In 1933 they found an army of 3 infantry and 3 cavalry divisions. By 1939 they had raised and equipped an army of 51 divisions, 4 of which were fully motorized and 4 of which were panzer divisions. In 1933 they found a navy of one cruiser and six light cruisers. By 1939 they had built a navy of 4 battleships, 1 aircraft carrier, 6 cruisers, 22 destroyers, and 54 submarines. They had also built up in that period an armament industry as efficient as that of any country in the world.

These new weapons were put to use, commencing in September, 1939, in a series of undeclared wars against nations with which Germany had arbitration and non-aggression treaties, and in violation of repeated assurances.

On 1st September, 1939, this rearmed Germany attacked Poland. The following April witnessed the invasion and occupation of Denmark and Norway, and May saw the overrunning of Belgium, the Netherlands, and Luxembourg. Another spring saw Yugoslavia and Greece under attack, and in June, 1941, came the invasion of Soviet Russia. Then Japan, which Germany had embraced as a partner, struck without warning at Pearl Harbour in December, 1941, and four days later Germany declared war on the United States.

We need not trouble ourselves about the many abstract difficulties that can be conjured up about what constitutes aggression in doubtful cases. I shall show you, in discussing the conspiracy, that by any test ever put forward by any responsible authority, by all the canons of plain common sense, these were unlawful wars of aggression in breach of treaties and in violation of assurances.

3. WARFARE IN DISREGARD OF INTERNATIONAL LAW

It is unnecessary to labour this point on the facts. Goering asserts that the Rules of Land Warfare were obsolete, that no nation could fight a total war within their limits. He testified that the Nazis would have denounced the Conventions to which Germany was a party, but that General Jodl wanted captured German soldiers to continue to benefit from. their observance by the Allies.

It was, however, against the Soviet people and Soviet prisoners that Teutonic fury knew no bounds, in spite of a warning by Admiral Canaris that the treatment was in violation of International Law. We need not, therefore, for the purposes of the conspiracy count, recite the revolting details of starving, beating, murdering, freezing, and mass extermination admittedly used against the Eastern soldiery. Also, we may take as established or admitted that the lawless conduct such as shooting British and American airmen, mistreatment of Western prisoners of war, forcing French prisoners of war into German war work, and other deliberate violations of the Hague and Geneva Conventions, did occur, and in obedience to highest levels of authority.

4. ENSLAVEMENT AND PLUNDER OF POPULATIONS IN OCCUPIED COUNTRIES

The defendant Sauckel, Plenipotentiary General for the Utilization of Labour, is authority for the statement that “out of five million foreign workers who arrived in Germany, not even 200,000 came voluntarily”. It was officially reported to defendant Rosenberg that in his territory “recruiting methods were used which probably have their origin in the blackest period of the slave trade”. Sauckel himself reported that male and female agents went hunting for men, got them drunk, and “shanghaied” them to Germany. These captives were shipped in trains without heat, food, or sanitary facilities. The dead were thrown out at stations, and the newborn were thrown out the windows of moving trains.

Sauckel ordered that “all the men must be fed, sheltered and treated in such a way as to exploit them to the highest possible extent at the lowest conceivable degree of expenditure”. About two million of these were employed directly in the manufacture of armaments and munitions. The director of the Krupp locomotive factory in Essen complained to the company that Russian forced labourers were so underfed that they were too weakened to do their work, and the Krupp doctor confirmed their pitiable condition. Soviet workers were put in camps under Gestapo guards, who were allowed to punish disobedience by confinement in a concentration camp or by hanging on the spot.

Populations of occupied countries were otherwise exploited and oppressed unmercifully. Terrorism was the order of the day. Civilians were arrested without charges, committed without counsel, executed without hearing. Villages were destroyed, the male inhabitants shot or sent to concentration camps, the women sent to forced labour, and the children scattered abroad. The extent of the slaughter in Poland alone was indicated by Frank, who reported:

” If I wanted to have a poster put up for every seven Poles who were shot, the forests of Poland would not suffice for producing the paper for such posters.”

Those who will enslave men cannot be expected to refrain from plundering them. Boastful reports show how thoroughly and scientifically the resources of occupied lands were sucked into the German war economy, inflicting shortage, hunger, and inflation upon the inhabitants. Besides this grand plan to aid the German war effort there were the sordid activities of the Rosenberg “Einsatzstab”, which pillaged art treasures for Goering and his fellow-bandits. It is hard to say whether the spectacle of Germany’s No. 2 leader urging his people to give up every comfort and strain every sinew on essential war work while he rushed around confiscating art by the trainload should be cast as tragedy or comedy. In either case it was a crime.

International Law at all times before and during this war spoke with precision and authority respecting the protection due to civilians of an occupied country, and the slave trade and plunder of occupied countries was at all times flagrantly unlawful.

5. PERSECUTION AND EXTERMINATION OF JEWS AND CHRISTIANS

The Nazi movement will be of evil memory in history because of its persecution of the Jews, the most far-flung and terrible racial persecution of all time. Although the Nazi Party neither invented nor monopolised anti-Semitism, its leaders from the very beginning embraced it, incited it, and exploited it. They used it as “the psychological spark that ignites the mob”. After seizure of power, it became an official State policy. The persecution began in a series of discriminatory laws eliminating the Jews from the civil service, the professions, and economic life. As it became more intense it included segregation of Jews in ghettoes, and exile. Riots were organized by Party leaders to loot Jewish business places and to burn synagogues. Jewish property was confiscated and a collective fine of a billion marks was imposed upon German Jewry. The programme progressed in fury and irresponsibility to the “final solution”. This consisted of sending all Jews who were fit to work to concentration camps as slave labourers, and all who were not fit, which included children under 12 and people over 50, as well as any others judged unfit by an SS doctor, to concentration camps for extermination.

Adolf Eichmann, the sinister figure who had charge of the extermination programme, has estimated that the anti-Jewish activities resulted in the killing of six million Jews. Of these, four million were killed in extermination institutions, and two million were killed by Einsatzgruppen, mobile units of the Security Police and SD which pursued Jews in the ghettoes and in their homes and slaughtered them in gas wagons, by mass shooting in anti-tank ditches and by every device which Nazi ingenuity could conceive.

So thorough and uncompromising was this programme that the Jews of Europe as a race no longer exist, thus fulfilling the diabolic “prophecy” of Adolf Hitler at the beginning of the war. Of course, any such programme must reckon with the opposition of the Christian Church. This was recognized from the very beginning. Defendant Bormann wrote all Gauleiter in 1941 that “National Socialism and Christian concepts are irreconcilable”, and that the people must be separated from the Churches, and the influence of the Churches totally removed. Defendant Rosenberg even wrote dreary treatises advocating a new and weird. Nazi religion.

The Gestapo appointed “Church specialists” who were instructed that the ultimate aim was “destruction of the confessional Churches”. The record is full of specific instances of the persecution of clergymen, the confiscation of Church property, interference with religious publications, disruption, of religious education, and suppression of religious organizations.

The chief instrument for persecution and extermination was the concentration camp, sired by the defendant Goering and nurtured under the overall authority of defendants Frick and Kaltenbrunner.

The horrors of these iniquitous places have been vividly disclosed by documents and testified to by witnesses. The Tribunal must be satiated with ghastly verbal and pictorial portrayals. From your records it is clear that the concentration camps were the first and worst weapon of Nazi oppression used by the National Socialist State, and that they were the primary means utilised for the persecution of the Christian Church and the extermination of the Jewish race. This has been admitted to you by some of the defendants from the witness stand. In the words of defendant Frank:

“A thousand years will pass and this guilt of Germany will still not be erased.”

These, then, were the five great substantive crimes of the Nazi regime. Their commission, which cannot be denied, stands admitted. The defendant Keitel, who is in a position to know the facts, has given the Tribunal what seems to be a fair summation of the case on the facts:

“The defendant has declared that ‘he admits the contents of the general Indictment to be proved from the objective and factual point of view’ (that is to say, not every individual case) ‘and this in consideration of the law of procedure governing the trial. It would be senseless, despite the possibility of refuting several documents or individual facts, to attempt to shake the Indictment as a whole.’” I pass now to the inquiry as to whether these groups of criminal acts were integrated in a common plan or conspiracy.

THE COMMON PLAN OR CONSPIRACY

The prosecution submits that these five categories of premeditated crimes were not separate and independent phenomena but that all were committed pursuant to a common plan or conspiracy.

The defence admits that these classes of crimes were committed, but denies that they are connected one with another as parts of a single programme. The central crime in this pattern of crimes, the king-pin which holds them all together, is the plot for aggressive wars. The chief reason for international cognizance of these crimes lies in this fact. Have we established the plan or conspiracy to make aggressive war?

Certain admitted or clearly proven facts help to answer that question. First is the fact that such war of aggression did take place. Second, it is admitted that from the moment the Nazis came to power, every one of them and every one of the defendants worked like beavers to prepare for some war. The question therefore comes to this: Were they preparing for the war which did occur, or were they preparing for some war which never happened?

It is probably true that in their early days none of them had in mind what month of what year war would begin, the exact dispute which would precipitate it, or whether its first impact would be Austria, Czechoslovakia, or Poland. But I submit that the defendants either knew or were chargeable with knowledge that the war for which they were making ready would be a war of German aggression. This is partly because there was no real expectation that any power or combination of powers would attack Germany. But it is chiefly because the inherent nature of the German plans was such that they were certain sooner or later to meet resistance and that they could then be accomplished only by aggression.

The plans of Adolf Hitler for aggression were just as secret as Mein Kampf, of which over six million copies were published in Germany. He not only openly advocated overthrowing the Treaty of Versailles, but made demands which went far beyond a mere rectification of its alleged injustices. He avowed an intention to attack neighbouring States and seize their lands, which he said would have to be won with “the power of a triumphant sword”. Here, for every German to hearken to, were the “ancestral voices prophesying war”.

Goering has testified in this courtroom that at his first meeting with Hitler, long before the seizure of power:

“I noted that Hitler had a definite view of the impotency of protest and, as a second point, that he was of the opinion that Germany should be freed of the Peace of Versailles. ‘We did not say we shall have to have a war and defeat our enemies’; this was the aim and the methods had to be adapted to the political situation.”

When asked if this goal were to be accomplished by war if necessary, Goering did not deny that eventuality but evaded a direct answer by saying, “We did not debate about that at all at that time.” He went on to say that the aim to overthrow the Treaty of Versailles was open and notorious and that, I quote again, “Every German in my opinion was for its modification, and there was no doubt that this was a strong inducement for joining the party.”

Thus, there can be no possible excuse for any person who aided Hitler to get absolute power over the German people, or who took a part in his regime, to fail to know the nature of the demands he would make on Germany’s neighbours.
