“Anyone Could Do It; It Required No Brains at All. It Merely Required No Character” Trump’s Evangelical Allies

When I see the political-religious leaders of the Christian Right defend the indefensible actions of President Trump I am reminded of the words of Joseph Heller in his classic novel Catch 22  who wrote about the Chaplain:

“The chaplain had mastered, in a moment of divine intuition, the handy technique of protective rationalization, and he was exhilarated by his discovery. It was miraculous. It was almost no trick at all, he saw, to turn vice into virtue and slander into truth, impotence into abstinence, arrogance into humility, plunder into philanthropy, thievery into honor, blasphemy into wisdom, brutality into patriotism, and sadism into justice. Anybody could do it; it required no brains at all. It merely required no character.” 

As much as I doubt I am still a Christian, even if I wasn’t already a Christian I couldn’t think of a single reason to follow the false God of men like Pat Robertson, Jerry Falwell Jr., Franklin Graham, Tony Perkins, or any of the host of big name Evangelical Christian preachers who excuse the behaviors of President Trump and his decadently despicable defenders, including people that I once thought that I knew.

I used to think that most people like to believe that religion is a benign or positive influence in the world. As much as I want to believe the positive aspects I have to admit based on the historical and sociological evidence that this is not so, especially during unsettled times of great change. We live in such an era and when it comes to identity, God is the ultimate trump card.

If one wonders why the most fanatical individuals and groups on earth are tied to religions, whether it is the Islamic State and Al Qaeda, Boko Haram, Hezbollah, Orthodox Jews, radical Hindus and Buddhists as well as militant Christians. Of course all of these groups have different goals, but their thought and philosophy are quite similar.

Robert Heinlein wrote:

“Almost any sect, cult, or religion will legislate its creed into law if it acquires the political power to do so.”

Heinlein, the author of the classic Starship Troopers was absolutely correct. Just look at any place in any time where any religion, sect or cult has gained control of a government. They are not loving, they are not forgiving and they use the police power of the state to persecute any individual or group that is judged to be in error, or even worse has the gall to question their authority.

Since the Christian groups tend to thrive in the West, they only speak in terms of violence, most, with the exception of Russian Orthodox Christians, do not have a government to translation of those words into action. Many, especially conservative Catholics and some Evangelical and Charismatic Protestants seem for a long for the day when they can assume control of a theocratic government.

Samuel Huntington wrote in his book The Clash of Civilizations:

“People do not live by reason alone. They cannot calculate and act rationally in pursuit of their self-interest until they define their self. Interest politics presupposes identity. In times of rapid social change established identities dissolve, the self must be redefined, and new identities created. For people facing the need to determine Who am I? Where do I belong? Religion provides compelling answers….In this process people rediscover or create new historical identities. Whatever universalist goals they may have, religions give people identity by positing a basic distinction between believers and non-believers, between a superior in-group and a different and inferior out-group.”

Huntington was right, you see the true believers, those who follow their religion without question and believe that it is superior to all others also believe that their religion entitles them to be atop the food chain, others who don’t believe like them be damned, if not in this life, the next. That is the certitude of the true believer, especially the religious one. Secular or atheistic fanatics could care less about the next life, for this life is all that they have. But the religious “true believers” are not only interested in destroying someone in this life, but ensuring that in the next that they suffer for eternity, unless they believe in the annihilation of the soul after death, which really spoils the whole Dante’s Inferno perspective of the damned in the afterlife.

The great American philosopher, Eric Hoffer wrote:

“The impression somehow prevails that the true believer, particularly the religious individual, is a humble person. The truth is the surrendering and humbling of the self breed pride and arrogance. The true believer is apt to see himself as one of the chosen, the salt of the earth, the light of the world, a prince disguised in meekness, who is destined to inherit the earth and the kingdom of heaven too. He who is not of his faith is evil; he who will not listen will perish.”

That is why they, the religious true believers of any faith are capable of such great evil, and why such people can murder innocents in the most brutal manner simply because they do not believe correctly. In fact today when I see the words and actions of these supposed Conservative Christians.

Please do not get me wrong. I am a Christian, a priest, a historian and a theologian, but I also know just how insidious those who hold their religion over those of others can be. While I hold faith dear, I know that it can be abused for the claim of some to have God as their final authority is a sort of trump card with which they are able to justify the most obscene and evil acts against others.

Likewise I struggle with faith every day. If you have read this blog from the beginning you will see chronicle my struggles with faith and its practice, especially in life and politics.

I guess that is why I am even more frightened of religious true believers than non-religious true believers. While the non-religious true believer may sacrifice everything for the sake of power and control in this life, and may in fact commit the most heinous crimes against humanity, their hatred is bounded in space and time to this earth. The religious true believer is not content with that; their enemies must be damned and punished in this life, but for eternity, without hope of salvation.

When they look at people like me or Yossarian they believe as Heller wrote:

“Morale was deteriorating and it was all Yossarian’s fault. The country was in peril; he was jeopardizing his traditional rights of freedom and independence by daring to exercise them.”

2020: Time For Reading, Reflecting, Writing, and Action to Help our Neighbors

Welcome to 2019. I know, we’re all still a bit hung over from last night, but welcome to the New Year. Admittedly it doesn’t yet feel a lot different than 2018, but I really expect that 2019 will mark an epochal change in our history. Since I wrote about that yesterday I won’t go back for more.

That being said there is one resolution that I think that all people, the great and the small, should do, and that is not to cry boo who, but read like our lives depended on it, which in a sense they do. By reading, I don’t mean just the news, commentary, or opinion sections of print or online news services, but get real books, especially works of history, biography, philosophy, and the classics.

Barbara Tuchman wrote:

“Books are the carriers of civilization. Without books, history is silent, literature dumb, science crippled, thought and speculation at a standstill. Without books, the development of civilization would have been impossible. They are engines of change (as the poet said), windows on the world and lighthouses erected in the sea of time. They are companions, teachers, magicians, bankers of the treasures of the mind. Books are humanity in print.”

Likewise, the French philosopher Voltaire hit the nail on the head when he said:

“Despite the enormous quantity of books, how few people read! And if one reads profitably, one would realize how much stupid stuff the vulgar herd is content to swallow every day.”

That my friends is fact. If you want to be able to better distinguish fact from fake, read.

Last year I committed to read more, even as I stayed current on the news, analysis of it, and commentary, even as I continued to write. My office at work is crammed with books, as is much of our home. I think that we follow well the advice of Dr. Seuss who wrote:

“Fill your house with stacks of books, in all the crannies and all the nooks.”

So I read, and I read, until my eyes they turned red. I read with those eyes that had turned red, in bed and even in the head.

I read as I eat, and eat as I read, because somewhere in my soul I have this great need, which I ever did cede I would be a great deal poorer indeed.

The pages they turned and as my eyes burned I knew I could never be through so long as my fingers don’t turn blue. I read and read with voices sounding through my head I, but I will not stress even though I digress…

I continually read and I try to update my readers on the latest series of books that I have read and every few months try to let my readers know what I have been up to in my Reading Rainbow.

Since I have tried to keep my readers up with throughout the year I will concentrate on my most recent reads of the past few months. As usual many deal with human behavior in war, particularly in regard to to war crimes; perpetrators, victims, and bystanders. Most of my study of this field have focused on the Nazi Regime, its crimes, and the justice handed out to it, as well as American Slavery and racism. I have also read about crimes that Europeans enacted in their colonies, the Americans in the American West, Mexico, has Vietnam, Iraq, and Afghanistan, the Balkan wars of the 1990s, the Armenian genocide, and the Rwandan genocide.

But one of my readers challenged me to look at the war crimes of the Japanese War Crimes in Asia. I have written about the Rape of Nanking, writing about it specifically and also in more generic articles about human nature, conduct, and genocide. But, other than that at some cursory reads about how the Japanese treated POWs, conquered people’s, and units such as Unit 731; but those were all wave top looks, I never took the deep dive until after we got back from Germany in October.

Since then I have made the deep dive. It has opened my eyes to myths that I believed about Emperor Hirohito and the actions of of his government, and those of the supposedly honorable Imperial Japanese Navy, whose war crimes at sea and ashore rate their own article. In fact one of the books I read was Slaughter at Sea: The Story of Japan’s Naval War Crimes by Mark Felton.

Likewise, I learned of the American complicity at the highest levels in rigging the Tokyo trials to ensure that the Emperor, the bankers, business leaders, most politicians, civil servants, police officials and organizations, the members of Unit 731, which was involved in biological warfare and human experimentation similar to that of the Nazis. This is well documented in Robert P. Bix’s Pulitzer Prize winning biography Hirohito and the Making of Modern Japan and The Other Nuremberg: the Untold Story of the Tokyo War Crimes Trials by Arnold Brackman.

Both books, in excoriating detail not only deal with the Japanese War Crimes and criminals, but deal with the inclusion of the actions of President Truman and General MacArthur to protect certain war criminals, including the Emperor, and deflect responsibility to others such as General and Prime Minister Tojo. The Tokyo Trials took more than twice the time of the Nuremberg Trials, and allowed most of the highest order of war criminals to go free, while unlike Nuremberg exempting lower order war criminals and functionaries off the hook, because of the Cold War. That too, is another article.

I also read Lord Russell of Liverpool’s classic The Knights of Bushido: a Short (Over 300 pages) History of Japanese War Crimes and Showa: Chronicles of a Fallen God by Paul-Yanic Lequerre, another biography of Hirohito. I also re-read War Without Mercy: Race and Power in the Pacific War by John Dower, as well as John Toland’s Rising Sun: the Decline and Fall of the Japanese Empire 1936-1945; Infamy: Pearl Harbor and its Aftermath; and But Not In Shame: The Six Months After Pearl Harbor, as well as Max Hastings Retribution: The Battle for Japan 1944-1945. Then I re-read Iris Chang’s The Rape of Nanking and The Nanking Massacre: History Of China, Japan, and the Events Surrounding the Nanking Massacre by Mukuro Mori. Finally, For the first time I read Japan’s Infamous Unit 731: Firsthand Accounts of Japan’s Wartime Human Experimentation Program by Hal Gold.

All of these first or second time reads added a dimension to the Japanese atrocities that I had managed to cover with Cold War ideology and the myth that Emperor Hirohito was simply a figurehead leader with no responsibility for the war. He knew of the plans of his Army, he studied them, and criticized his military, but he always, even when military and civilian advisers urged him to seek peace, and that went on even after the atomic bombs were dropped. I’ll deal with that in another article.

I also re-read some of my Nazi War Crime books, but I won’t list them here and now. Likewise I have a good number of books to read in the coming weeks and months. As far as my writing I plan on blogging about the aspects of the Japanese War crimes and American complicity to cover them up after the war, as well as the book I started working on last year Lest We Forget: Walk, Remember, Bear Witness; Bearing Witness as the Last Witnesses to the Holocaust Pass Away.

So, I think that is enough for the day. However, our New Year’s Eve was nice. We went to our favorite German Restaurant for dinner, then went home, spent time with our dogs and binged watched episodes of Star Trek Deep Space Nine until about a half an hour before the new year, then we switched to CNN and Anderson Cooper counting down to 2020 in New York. We toasted with a German Rose Sekt (Champagne), stayed up a while longer then went to bed. We got up late, Judy and the dogs watched the Rose Parade, while between doing laundry and taking naps I spent the day until we went out to dinner at our favorite Mexican restaurant came home, and then help our next door neighbor who had collapsed on her porch from low blood sugar. Thanks to the prompt work of the EMS and our neighbor Larry she was able to treated in the ambulance. Judy and I helped with her dogs, and Judy helped her when the EMS released her and didn’t take her to the hospital once they got her blood sugar to a normal range. She stayed with her until she got her insulin and we will make sure she will be okay today. We care about our neighbors.

Today is the 156th  anniversary of the Emancipation Proclamation. The proclamation made by Abraham Lincoln when the outcome of the rebellion of the Southern slave states against the Union was still up in the air was a watershed for civil rights in the United States. Though it was a military order that only affected slaves in the rebellious states, it also set the stage for the 13th, 14th, and 15th Amendments and other legal rulings that affected not only African Americans and former slaves, but also Native Americans, Women, other racial minorities and LGBTQ people. It is something that in our era when so many civil rights are under threat that we must remember and continue to fight for in the coming years. Freedom is never free.

As you read this compare the words of Lincoln with those of his Copperheads, or Peace Democrat opponents it would seem that the modern Republicans led by President Trump, have become the new day Copperheads, a party of White Supremacy, willing to destroy the country in order to do so. Thus the fight goes on.

From the beginning of the war many Northerners, especially abolitionists and radical Republicans believed that “as the “cornerstone” of the confederacy (the oft-cited description by the South’s vice-president, Alexander H. Stephens) slavery must become a military target.” [1]When some Union generals made their own attempts at issuing emancipation orders, Lincoln countermanded them for exceeding their authority. Lincoln resisted the early calls of the abolitionists to make that a primary war goal for very practical reasons, he had to first ensure that the Border Slave States did not secede, something that would have certainly ensured that the Union would not survived. As a result in the first year of the war, Lincoln “maneuvered to hold Border South neutrals in the Union and to lure Union supporters from the Confederacy’s Middle South white belts. He succeeded on both scores. His double success with southern whites gave the Union greater manpower, a stronger economy, and a larger domain. These slave state resources boosted free labor states’ capacity to should the Union’s heavier Civil War burden.” [2] His success in doing this was instrumental in enabling him to turn to emancipation in 1862.

Finally, some twenty months after Fort Sumter fell and after nearly two years of unrelenting slaughter culminating in the bloody battle of Antietam, Abraham Lincoln published the Emancipation Proclamation. Emancipation was a tricky legal issue for Lincoln as “an executive order of emancipation would be beyond the powers of the president, but not, Lincoln concluded, if such an order were issued as furtherance of the executive’s war powers.” [3] Lincoln had desired to issue the order during the summer and sounded out elected officials and soldiers as to his plan.

Lincoln discussed his views with General George McClellan during a visit to the latter’s headquarters. McClellan stated his strident opposition to them in writing. McClellan did not admire slavery but he despised abolitionists and he wrote one of his political backers “Help me to dodge the nigger – we want nothing to do with him. I am fighting for the Union…. To gain that end we cannot afford to mix up the negro question.”  [4]

Lincoln then called border state Congressmen to sound them out on the subject on July 12th 1862 only to be met with opposition. Such opposition caused Lincoln “to give up trying to conciliate conservatives. From then on the president tilted toward the radical position, though this would not become publicly apparent for more than two months.” [5]

Lincoln’s cabinet met to discuss the proclamation on July 22nd 1862 and after some debate decided that it should be issued, although it was opposed by Postmaster General Montgomery Blair who believed that “the Democrats would capitalize on the unpopularity of such a measure in the border states and parts of the North to gain control of the House in the fall elections.” [6] Wisely, Lincoln heeded the advice of Secretary of State Seward to delay the announcement until military victories ensured that people did not see it as a measure of desperation. Seward noted: “I approve of the proclamation, but I question the expediency of its issue at this juncture. The depression of the public mind, consequent on our repeated reverses, is so great I fear…it may be viewed as the last measure of an exhausted government, a cry for help…our last shriek on the retreat.” Seward suggested that Lincoln wait “until the eagle of victory takes his flight,” and buoyed by military success, “hang your proclamation about his neck.” [7]

After the Battle of Antietam, President Lincoln issued the Preliminary Emancipation Proclamation. This document served as a warning to the leaders of the South, and insisted that there was much more at stake in their rebellion unless they surrendered; their slaves, the very “property” for which the seceded. The document “warned that unless the South laid down its arms by the end of 1862, he would emancipate the slaves.” [8] This was something that they could not and would not do, even as their cities burned and Confederacy collapsed around them in 1864.

The proclamation was a military order in which Lincoln ordered the emancipation of slaves located in the Rebel states and areas of those states occupied by Union troops. It was not designed to change law, which would have to wait until Lincoln felt he could have Congress amend the Constitution.  Instead of law it was “the doctrine of military necessity justified Lincoln’s action.” [9] The concept emanated from Boston lawyer William Whiting who argued “the laws of war “give the President full belligerent rights” as commander and chief to seize enemy property (in this case slaves) being used to wage war against the United States.” [10] There was a legitimate military necessity in the action as Confederate armies used slaves as teamsters, laborers, cooks, and other non-combatant roles to free up white soldiers for combat duty, and because slaves were an important part of the Southern war economy which could not function without them. The proclamation gave inspiration to many slaves throughout the South to desert to the Union cause or to labor less efficiently for their Confederate masters. A South Carolina planter wrote in 1865:

“the conduct of the Negro in the late crisis of our affairs has convinced me that we were all laboring under a delusion….I believed that these people were content, happy, and attached to their masters, But events and reflection have caused me to change these positions….If they were content, happy and attached to their masters, why did they desert him in the moment of need and flocked to the enemy, whom they did not know….” [11]

The proclamation authorized that freed blacks be recruited into the Federal army and it ensured that freed slaves would not again be surrendered back into slavery. As Montgomery Blair had warned Lincoln and the Republicans suffered sharp electoral reverses as “Democrats made opposition to emancipation the centerpiece of their campaign, warning that the North would be “Africanized” – inundated by freed slaves competing for jobs and seeking to marry white women.”  [12]

Lincoln’s response was to continue on despite the opposition and issue the Proclamation in spite of electoral reverses and political resistance. The vehemence of some Northern Democrats came close to matching that of white Southerners. The “white Southerner’s view of Lincoln as a despot, hell-bent on achieving some unnatural vision of “equality,” was shared by Northern Democrats, some of whom thought the president was now possessed by a “religious fanaticism.” [13] But Lincoln was not deterred and he understood “that he was sending the war and the country down a very different road than people thought they would go.” [14] He noted in December 1862:

“Fellow citizens, we cannot escape history….This fiery trial through which we pass, will light us down, in honor or dishonor, to the latest generation….In giving freedom to the slave, we assure freedom to the free – honorable alike in what we give, and what we preserve.”[15]

For Lincoln the Emancipation Proclamation was something that he believed was something that he had to do, and he believed that it would be the one thing that he did in life that would be remembered. He had long been convicted of the need for it, but timing mattered, even six months before it might have created a political backlash in the North which would have fractured support for the war effort, and in this case timing and how he made the proclamation mattered.

The Emancipation Proclamation had military, domestic political, and diplomatic implications, as well as moral implications for the conduct of the war.

The military implication would take some time to achieve but were twofold. First, Lincoln hoped that the Emancipation Proclamation would encourage former slaves, as well as already free blacks in the North to join the Union cause and enlist to serve in the Federal Army. The act would vest African Americans in the Union’s cause as little else could, and at the same time begin to choke-off the agricultural labor force that provided the backbone of the Confederate economy. Frederick Douglass eloquently made the case for African Americans to serve in July 1863, telling a crowd in Philadelphia:

 “Do not flatter yourself, my friends, that you are more important to the Government than the Government is to you. You stand but as a plank to the ship. This rebellion can be put down without your help. Slavery can be abolished by white men: but Liberty so won for the black man, while it may leave him an object of pity, can never make him an object of respect…. Young men of Philadelphia, you are without excuse. The hour has arrived, and your place is in the Union army. Remember that the musket – the United States musket with its bayonet of steel – is better than all the parchment guarantees of Liberty. In you hands the musket means Liberty…” [16] By the end of the war over 180,000 African American men would serve as volunteers in the United States Army.

Politically the proclamation would the diplomatic purpose by isolating the Confederacy from European assistance. This it did, after the proclamation public sentiment, especially among Europe’s working classes turned solidly against the Confederacy. Domestically it would break-ground for the Thirteenth Amendment, which Lincoln, the pragmatic lawyer was needed to actually abolish slavery. Morally, it  would serve as the guarantee of The United States Government’s public, irrevocable pledge of freedom to African Americans if the North won the war.

Lincoln signed the order on January 1st 1863. As he got ready to sign the document he paused and put down the pen, speaking to Seward he said “I never, in my life, felt more certain that I was doing right, than I do now in signing this paper….If my name ever goes down in history it will be for signing this act, and my whole soul is in it.” [17] The opening paragraph read:

“That on the first day of January, in the year of our Lord one thousand eight hundred and sixty-three, all persons held as slaves within any State or designated part of a State, the people whereof shall then be in rebellion against the United States, shall be then, thenceforward, and forever free; and the Executive Government of the United States, including the military and naval authority thereof, will recognize and maintain the freedom of such persons, and will do no act or acts to repress such persons, or any of them, in any efforts they may make for their actual freedom.” [18]

At the ends of the proclamation he added the words suggested by his devoutly Christian Secretary of the Treasury Salmon Chase: “And upon this act, sincerely believed to be an act of justice, warranted by the Constitution, upon military necessity, I invoke the considerate judgment of mankind, and the gracious favor of Almighty God.” [19]

The response throughout the North was euphoric as celebrations took place throughout the North. In some cities one hundred gun salutes were fired. At Boston’s Tremont Temple people broke out singing a hymn “Sound the loud timbrel o’er Egypt’s dark sea, Jehovah hath triumphed, his people are free.” [20] The Boston Daily Evening Telegraph predicted, “Slavery from this hour ceases to be a political power in this country…such a righteous revolution as it inaugurates never goes backward.” [21]

Frederick Douglass wrote about his reactions to the Emancipation proclamation as he had nearly despaired wondering if the Lincoln administration would actually take up the fight for emancipation:

“The fourth of July was great, but the first of January, when we consider it in all of its relations and bearings in incomparably greater. The one we respect to the mere political birth to a nation, the last concerns national life and character, and is to determine whether that life and character shall be radiantly and glorious with all high and noble virtues, or infamously blackened, forevermore, with all the hell-darkened crimes and horrors which we attach to Slavery.” [22]

The proclamation was not all some had hoped for and it was certainly provoked a negative response in the South and among many Northern Democrats. Southerners accused Lincoln of inciting racial warfare and Jefferson Davis responded “The day is not so distant when the old Union will be restored with slavery nationally declared to be the proper condition of all of African descent.” [23]

But the proclamation did something that politicians, lawyers did not comprehend, that “the details of the emancipation decree were less significant than the fact that there was an emancipation decree, and while the proclamation read like a dull legal brief, filled with qualifying clauses and exceptions, it was not language made for this, finally, a moral document. It was its existence, its title, its arrival into this world, its challenge to the accepted order, and from that there was no turning back. In this sense it was a revolutionary statement, like the Declaration itself, and nearly as significant.” [24]

 That the proclamation most certainly was and it was a watershed from which there was no stepping back. “It irrevocably committed the government of the United States to the termination of slavery. It was an act of political courage, take at the right time, in the right way.” [25]

However, it would take another two years, with the Confederacy crumbling under the combined Federal military onslaught before Lincoln was able to secure passage of the Thirteenth Amendment to the Constitution in January 1865.  The amendment abolished slavery and involuntary servitude throughout the country, as well as nullified the fugitive slave clause and the Three-Fifths Compromise. It would be followed after Lincoln’s death by the Fourteenth Amendment which reversed the result of the Dred Scott decision and declared that all people born in the United States were citizens and entitled to the rights of citizenship. During the Grant administration the Fifteenth Amendment was passed, and this finally extended to African American men, the right to vote in every state.

Though limited in scope, the Emancipation Proclamation had more than a domestic military, social and political effect. It also had an effect on foreign policy which ensured that Britain, and thereby France would not intervene in the war on behalf of the Southern Confederacy. It stopped all British support for the Rebels to include seizing warships that had been contracted for by Confederate agents that were building or being fitted out in British Yards. Likewise the British rejected various proposals of Emperor Napoleon III to intervene in the war in late 1862 and during the summer of 1863.

Effects of the Emancipation Proclamation on Military Law

The Emancipation Proclamation and the elimination of slavery also impacted the Union war effort in terms of law, law that eventually had an impact around the world as nations began to adapt to the changing character of war. It was important because for the first time slavery was accounted for in the laws of war. The “Instructions for the Government of Armies of the United States in the Field, General Orders No. 100 by President Lincoln, April 24, 1863; Prepared by Francis Lieber, LLD noted in Article 42 of that Code:

“Slavery, complicating and confounding the ideas of property, (that is of a thing,) and of personality, (that is of humanity,) exists according to municipal or local law only. The law of nature and nations has never acknowledged it. The digest of the Roman law enacts the early dictum of the pagan jurist, that “so far as the law of nature is concerned, all men are equal.” Fugitives escaping from a country in which they were slaves, villains, or serfs, into another country, have, for centuries past, been held free and acknowledged free by judicial decisions of European countries, even though the municipal law of the country in which the slave had taken refuge acknowledged slavery within its own dominions.” [26]

It continued in Article 43:

“Therefore, in a war between the United States and a belligerent which admits of slavery, if a person held in bondage by that belligerent be captured by or come as a fugitive under the protection of the military forces of the United States, such person is immediately entitled to the rights and privileges of a freeman To return such person into slavery would amount to enslaving a free person, and neither the United States nor any officer under their authority can enslave any human being. Moreover, a person so made free by the law of war is under the shield of the law of nations, and the former owner or State can have, by the law of postliminy, no belligerent lien or claim of service.” [27]

The Continued Fight for Emancipation: Dealing with the Copperheads and the Passage of the Thirteenth Amendment

But there were still legitimate concerns that slavery might survive as the war continued. Lincoln knew that in issuing the Emancipation Proclamation raised the stakes of the war far higher than they had been. He noted, “We shall nobly save, or meanly lose, the last best hope on earth.” [28] The threat of the destruction of the Union and the continuance of slavery in either the states of the Confederacy, the new western states, territories, or the maintenance of the Union without emancipation was too great for some; notably, the American Freedmen’s Commission to contemplate. With Grant’s army stalled outside Richmond the Copperheads and the peace party gained influence and threatened to bring about a peace that allowed Confederate independence and the continuance of slavery; members of that caucus they Edwin Stanton in the spring of 1864:

“In such a state of feeling, under such a state of things, can we doubt the inevitable results? Shall we escape border raids after fleeing fugitives? No man will expect it. Are we to suffer these? We are disgraced! Are we to repel them? It is a renewal of hostilities!…In the case of a foreign war…can we suppose that they will refrain from seeking their own advantage by an alliance with the enemy?”[29]

The effort of the Copperheads and the peace party to was soon crushed under the military successes of William Tecumseh Sherman’s armies in Georgia. This was especially true of the capture of Atlanta, which was followed by Sherman’s march to the sea and the Carolinas. Additionally the naval victory of David Farragut’s fleet at the Battle of Mobile Bay served to break the stranglehold that the Copperheads were beginning to wield in Northern politics.  These efforts helped secure Lincoln’s reelection by a large margin in the 1864 presidential election over a divided Democratic opposition, whose presidential nominee McClellan could not even endorse his party’s platform.

In his Second Inaugural Address, Abraham Lincoln discussed the issue of slavery as the chief cause of the war. In it, Lincoln noted that slavery was the chief cause of the war in no uncertain terms and talked in a language of faith that was difficult for many, especially Christians, who “believed weighty political issues could be parsed into good or evil. Lincoln’s words offered a complexity that many found difficult to accept,” for the war had devastated the playground of evangelical politics, and it had “thrashed the certitude of evangelical Protestantism” [30] as much as the First World War shattered Classic European Protestant Liberalism.  Lincoln’s confrontation of the role that people of faith brought to the war in both the North and the South is both illuminating and a devastating critique of the religious attitudes that so stoked the fires of hatred.  His realism in confronting facts was masterful, and badly needed.  He spoke of “American slavery” as a single offense ascribed to the whole nation.” [31]

“One-eighth of the whole population were colored slaves, not distributed generally over the Union, but localized in the southern part of it. These slaves constituted a peculiar and powerful interest. All knew that this interest was somehow the cause of the war. To strengthen, perpetuate, and extend this interest was the object for which the insurgents would rend the Union even by war, while the Government claimed no right to do more than to restrict the territorial enlargement of it. Neither party expected for the war the magnitude or the duration which it has already attained. Neither anticipated that the cause of the conflict might cease with or even before the conflict itself should cease. Each looked for an easier triumph, and a result less fundamental and astounding. Both read the same Bible and pray to the same God, and each invokes His aid against the other. It may seem strange that any men should dare to ask a just God’s assistance in wringing their bread from the sweat of other men’s faces, but let us judge not, that we be not judged. The prayers of both could not be answered. That of neither has been answered fully. The Almighty has His own purposes. “Woe unto the world because of offenses; for it must needs be that offenses come, but woe to that man by whom the offense cometh.” If we shall suppose that American slavery is one of those offenses which, in the providence of God, must needs come, but which, having continued through His appointed time, He now wills to remove, and that He gives to both North and South this terrible war as the woe due to those by whom the offense came, shall we discern therein any departure from those divine attributes which the believers in a living God always ascribe to Him? Fondly do we hope, fervently do we pray, that this mighty scourge of war may speedily pass away. Yet, if God wills that it continue until all the wealth piled by the bondsman’s two hundred and fifty years of unrequited toil shall be sunk, and until every drop of blood drawn with the lash shall be paid by another drawn with the sword, as was said three thousand years ago, so still it must be said “the judgments of the Lord are true and righteous altogether.” [32]

Study the Past, Fight, and Live for the Future: Advice Entering the 4th Year of Trump

I tend to become somewhat reflective as the New Year approaches. I am reminded of Peter Benchley, who wrote, “The past always seems better when you look back on it than it did at the time. And the present never looks as good as it will in the future.” Likewise, St Augustine of Hippo once asked “How can the past and future be, when the past no longer is, and the future is not yet?”

Augustine’s question is interesting, but I think that his question is flawed. I think that the past lives in the present much more than we would like to think and that our future, though unwritten can unfold in a multitude of ways and possibilities.

Many of us live in the past as if it were today. We, individually and collectively, as individuals and nations live in the past and look to it much more fondly than when it was our present. I think that historian Will Durant possibly said it the best: “The past is not dead. Indeed, it is often not even past.”

As a historian myself I value the past and seek answers and wisdom from it to use in the present because what we do in the present does, for better or worse defines our future. Confucius said “study the past if you would define the future.” He was quite wise, he said to study the past, did he did not say to live in it.

That is something that I have been learning for over 20 years now when my Clinical Pastoral Education Supervisor, used a Star Trek Next Generation metaphor from the episode A Matter Of Time in order to teach me how my past was influencing the way I was living my life.In the episode a shadowy visitor who claimed to be from the future refuses to help the crew of the Enterprise save an endangered world, claiming that if he were to help them, that his “history – would unfold in a way other than it already has.”

Finally, after other all other possibilities were exhausted, Captain Picard was forced to make a decision and confronted the visitor, who as it turned out to be a thief from the past, using time travel to collect technology to enrich himself by bringing it back in time. Picard makes a comment which I think is pertinent in a time like ours.

“A person’s life, their future, hinges on each of a thousand choices. Living is making choices! Now, you ask me to believe that if I make a choice other than the one that appears in your history books, then your past will be irrevocably altered. Well… you know, Professor, perhaps I don’t give a damn about your past, because your past is my future, and as far as I’m concerned, it hasn’t been written yet!”

When my supervisor told me that my past did not have to be my future, it opened a door of life and faith that I had never experienced before and which showed me that life was to be boldly lived in the present. While it meant a lot then, it means more now for the past according to William Shakespeare “is prologue.”

We cannot help being influenced by the past. We should indeed learn from it, but we cannot remain in it or try to return to it. Kierkegaard said that “Life can only be understood backwards; but it must be lived forwards.”

Since I am a Christian, at least by profession, my faith in that future is in the God who is eternal, the God of love. Victor Hugo in Les Miserables said “Love is the only future God offers.” That is the future that I want to envision.

Unfortunently there are many people who claim the same Christian faith that I claim who attempt to return to an imaginary past and to try to legislate that past onto others who do not share their beliefs, if necessarily using the police powers of the state to do so. Such is neither honest because it attempts to enforce a mythologized past on others, nor Christian, because ultimately the Christian hope is focused on the yet to be realized future and not the past, it has nothing to do with establishing some kind of theocratic Christian state that denies rights and a future to all but like minded Christians.

Living is making choices and the future hinges on thousands of them. Many of these choices we make automatically without thought simply because we have always done them that way, or because that is how it was done in the past. However, if we want to break the cycle, if we want to live in and envision that future of the God of love then we have to live in the present though the past lives in us.

T.S. Elliot penned this verse:

“For last year’s words belong to last year’s language
And next year’s words await another voice.
And to make an end is to make a beginning.”

The coming year promises to be challenging, and the tensions between those who want to return to the past, especially the predominantly Christian cult  devoted to President Trump and making America great again and those who believe in an inclusive hope and future for all will be on full display.

As for me, I choose the path of Picard; because my future, and our future, hasn’t been written yet. Likewise I cannot surrender to those who want to return us to a mythologized past that never existed in history, except in authoritarian States. But the Trump Cult, led by those in elected or appointed office at every level of government are attempting to create an authoritarian state, appealing to a mythological past to write the future. If that is the future they imagine, and want to legislate, I will fight.

I am reminded of the words of the late British military historian B.H. Liddell-Hart who wrote in his final book Why Don’t We Learn From History, wrote something that is quite descriptive of the actions of President Trump and his Cult.

“We learn from history that self-made despotic rulers follow a standard pattern. In gaining power: They exploit, consciously or unconsciously, a state of popular dissatisfaction with the existing regime or of hostility between different sections of the people. They attack the existing regime violently and combine their appeal to discontent with unlimited promises (which, if successful, they fulfil only to a limited extent). They claim that they want absolute power for only a short time (but “find” subsequently that the time to relinquish it never comes). They excite popular sympathy by presenting the picture of a conspiracy against them and use this as a lever to gain a firmer hold at some crucial stage.” 

My choice in our time is to resist, and to fight for a future that includes everyone.  I close with the words of Sophie Scholl, a leader of the anti-Nazi White Rose resistance:

The real damage is done by those millions who want to ‘survive.’ The honest men who just want to be left in peace. Those who don’t want their little lives disturbed by anything bigger than themselves. Those with no sides and no causes. Those who won’t take measure of their own strength, for fear of antagonizing their own weakness. Those who don’t like to make waves—or enemies. Those for whom freedom, honour, truth, and principles are only literature. Those who live small, mate small, die small. It’s the reductionist approach to life: if you keep it small, you’ll keep it under control. If you don’t make any noise, the bogeyman won’t find you. But it’s all an illusion, because they die too, those people who roll up their spirits into tiny little balls so as to be safe. Safe?! From what? Life is always on the edge of death; narrow streets lead to the same place as wide avenues, and a little candle burns itself out just like a flaming torch does. I choose my own way to burn.

Such a course is not safe because the fact is, that too many ordinary people who have sold their souls to the Cult of Trump and who would if given the choice, would, just like the janitor at Munich University who identified and turned Sophie and her brother to the Gestapo and death at the hands of Roland Freisler and the extra-judicial Volksgericht (People’s Court).

“We will not be silent. We are your bad conscience. The White Rose will not leave you in peace!” A Lesson from the Past for the Present

This evening the House of Representatives voted impeachment articles against President Trump, only the third time that any President has been stained with articles of impeachment. No other President charged with impeachable offenses has not been stained for life with those charges, in which both of the previous Presidents, Andrew Johnson and Bill Clinton were acquitted in the Senate, and Richard Nixon, without a band of followers best described as a cult, resigned when members of his Party’s Senate told him to resign or be impeached and convicted. Sadly, the leaders of the Republican Senate, like Lindsey Graham and Mitch McConnell, have, despite the oath that they will have to swear during an impeachment trial that they are not impartial jurors, which demonstrates their contempt for the Constitution.

I cannot have ever imagined such a situation. Yesterday, the President sent a six page letter that can only generously describe as the thoughts of someone suffering from some kind of dementia. Less than generously the letter can be described as the screed of a madman, but regardless the Republican Party is now Trump’s Party, even more than the Nazi Party was that of Hitler; but then not long after taking power Hitler murdered his party rivals on the Night of the Long Knives. I actually believe that most GOP are willing to support him because they are afraid that his more violent cult members will kill them. Since his nomination they have shown no moral or political courage. The last GOP Senator to do so was the late John McCain. I do not know if the House will send the articles to the Senate unless the Senate agrees to a fair trial. Some Democrats are urging that the articles are not sent until there is the promise of a fair trial, while conducting more investigation and simply hold the charges over Trump’s head like the Sword of Damocles. I think that there is wisdom in that course of action. But I digress, that is just my comment on the big news of the day, and my intent when I started was to proceed with the fourth letter of the anti-Nazi White Rose Resistance.

That letter was written in a time that the lies of the Hitler regime were being exposed, millions of Jews being exterminated, and Nazi Armies being halted in the Soviet Union and North Africa, and the Nazi homeland was beginning to be hit with large aerial attacks by British and American strategic bombers. The war was coming home to roost as well over a million German soldiers had already been sacrificed on the altar of a madman.

Unlike Trump, Hitler’s madness would not be exposed until 1944, and would get worse and worse until with the Red Army on the doorsteps of the Reich Chancellory in Berlin he killed himself. Sophie Scholl and the members of the White Rose movement. This letter was published as the German advance in North Africa was stopped and Army Group South in the Soviet Union was failing in its mission to capture Stalingrad and seize the oil fields of the Caucasus. Had German leaders paid attention to the truths of this letter instead of remaining as members of the Hitler Cult, the war might have ended differently, and permanently changing the the future.

So in light of that I give you the English translation of the fourth letter of the White Rose as done by the Holocaust Education Archival Research Team. So until tomorrow I wish you all the best.

The Fourth Leaflet

There is an ancient maxim that we repeat to our children: “He who won’t listen will have to feel.” But a wise child will not burn his fingers the second time on a hot stove. In the past weeks Hitler has choked up successes in Africa and in Russia. In consequence, optimism on the one hand and distress and pessimism on the other have grown within the German people with a rapidity quite inconsistent with traditional German apathy. On all sides one hears among Hitler’s opponents – the better segments of the population – exclamations of despair, words of disappointment and discouragement, often ending with the question: “Will Hitler now, after all…?”

Meanwhile, the German offensive against Egypt has ground to a halt. Rommel has to bide his time in a dangerously exposed position. But the push into the East proceeds. This apparent success has been purchased at the most horrible expense of human life, and so it can no longer be counted an advantage. Therefore we must warn against all optimism.

Neither Hitler nor Goebbels can have counted the dead. In Russia thousands are lost daily. It is the time of the harvest, and the reaper cuts into the ripe grain with wide strokes. Mourning takes up her abode in the country cottages, and there is no one to dry the tears of the mothers. Yet Hitler feeds with lies those people whose most precious belongings he has stolen and whom he has driven to a meaningless death.
Every word that comes from Hitler’s mouth is a lie. When he says peace, he means war, and when he blasphemously uses the name of the Almighty, he means the power of evil, the fallen angel, Satan. His mouth is the foul-smelling maw of Hell, and his might is at bottom accursed. True, we must conduct a struggle against the National Socialist terrorist state with rational means; but whoever today still doublts the reality, the existence of demonic powers, has failed by a wide margin to understand the metaphysical background of this war. Behind the concrete, the visible events, behind all objective, logical considerations, we find the irrational element: The struggle against the demon, against the servants of the Antichrist.

Everywhere and at all times demons have been lurking in the dark, waiting for the moment when man is weak; when of his own volition he leaves his place in the order of Creation as founded for him by God in freedom; when he yields to the force of evil, separates himself from the powers of a higher order; and after voluntarily taking the first step, he is driven on to the next and the next at a furiously accelerating rate.

Everywhere and at all times of greatest trial men have appeared, prophets and saints who cherished their freedom,who preached the One God and who His help brought the people to a reversal of their downward course. Man is free, to be sure, but without the true God he is defenseless against the principle of evil. He is a like rudderless ship, at the mercy of the storm, an infant without his mother, a cloud dissolving into thin air.

I ask you, you as a Christian wrestling for the preservation of your greatest treasure, whether you hesitate, whether you incline toward intrigue, calculation, or procrastination in the hope that someone else will raise his arm in your defence? Has God not given you the strength, the will to fight? We must attack evil where it is strongest, and it is strongest in the power of Hitler.

So I returned, and considered all the oppressions that are done under the sun: and behold the tears of such as were oppressed, and they had no comforter; and on the side of their oppressors there was power; but they had no comforter. Wherefore I praised the dead which are already dead than the living which are yet alive. Ecclesiastes 4

True anarchy is the generative element of religion. Out of the annihilation of every positive element she lifts her gloriously radiant countenance as the founder of a new world… If Europe were about to awaken again, if a state of states, a teaching of political science were at hand! Should hierarchy then… be the principle of the union of states? Blood will stream over Europe until the nations become aware of the frightful madness which drives them in circles. And then, struck by celestial music and made gentle, the approach their former altars all together, hear about the works of peace, and hold a great celebration of peace with fervent tears before the smoking altars. Only religion can reawaken Europe, establish the rights of the peoples, and install Christianity in new splendour visibly on earth in its office as guarantor of peace. Novalis.

We wish expressly to point out that the White Rose is not in the pay of any foreign power. Though we know that National Socialist power must be broken by military means, we are trying to achieve a renewal from within of the severely wounded German spirit. This rebirth must be preceded, however, by the clear recognition of all the guilt with which the German people have burdened themselves, and by an uncompromising battle against Hitler and his all too many minions, party members, Quislings, and the like. With total brutality the chasm that separates the better portion of the nation from everything that is opened wide. For Hitler and his followers there is no punishment on this Earth commensurate with their crimes.

But out of love for coming generations we must make an example after the conclusion of the war, so that no one will ever again have the slightest urge to try a similar action. And do not forget the petty scoundrels in this regime; note their names, so that none will go free! They should not find it possible, having had their part in these abominable crimes, at the last minute to rally to another flag and then act as if nothing had happened! To set you at rest, we add that the addresses of the readers of the White Rose are not recorded in writing. They were picked at random from directories.

We will not be silent. We are your bad conscience. The White Rose will not leave you in peace!

Patriotism or Treason? Rule of Law of Law of the Tyrny of One.

Well, after a brief divergence into the Battle of the Bulge I am back to the letters of Sophie Scholl and the Anti-Nazi White Rose Resistance movement. The members of White Rose were University students, professors, and medical students, many had served on the Russian Front, some like Sophie and her brother were Lutheran Christians, others were Catholic or Orthodox Christians, and still others whose beliefs are not known. Yet they resisted a totalitarian dictatorship built upon lies, violence, and racism.

They are an interesting group, because they believed in non-violent resistance and speaking the uncomfortable truth. They had no political or military power, but they had the power of the truth, which they spoke openly, knowing that such resistance could lead to their deaths. For many, including Sophie this would mean exactly that. At the same time they were willing to encourage violent acts against the tyrannical rule of their nation.

Their writings are full of references to Ancient Greek, Roman, and Chinese philosophers, as well as the Christian and Jewish scriptures. I have already share the first two letters of the White Rose. This is the third, written at the end of 1942.

The principles and truths of these letters are timeless. They are every bit as important today as when they were written. The problem is that most people want the past to remain in the past, even as its ghosts reveal themselves in the actions of political leaders in the present.

Once again I give credit to the scholars of the Holocaust Education Archive Research Team for their translation of this letter. This is something that cannot be forgotten, and regardless of whom these evils are deployed against ”

The Third Leaflet

Salus publica suprema lex ( “The welfare of the people shall be the supreme law”) Cicero 

All ideal forms of government are utopias. A state cannot be constructed on a purely theoretical basis; rather, it must grow and ripen in the way an individual human being matures. But we must not forget that at the starting point of every civilization the state was already there in rudimentary form. The family is as old as man himself, and out of this initial bond man, endowed with reason, created for himself a state founded on justice, whose highest law was the common good. The state should exist as a parallel to the divine order, and the highest of all utopias, the civitas dei, is the model which in the end it should approximate. Here we will not pass judgment on the many possible forms of the state – democracy, constitutional monarchy, and so on. But one matter needs to be brought out clearly and unambiguously. Every individual human being has a claim to a useful and just state, a state which secures freedom of the individual as well as the good of the whole. For, according to God’s will, man is intended to pursue his natural goal, his earthly happiness, in self-reliance and self-chosen activity, freely and independently within the community of life and work of the nation.

But our present “state” is the dictatorship of evil. “Oh, we’ve known that for a long time,” I hear you object, “and it isn’t necessary to bring that to our attention again.” But, I ask you, if you know that, why do you not bestir yourselves, why do you allow these men who are in power to rob you step by step, openly and in secret, of one domain of your rights after another, until one day nothing, nothing at all will be left but a mechanized state system presided over by criminals and drunks? Is your spirit already so crushed by abuse that you forget it is your right – or rather, your moral duty – to eliminate this system? But id a man no longer can summon the strength to demand his right, then it is absolutely certain that he will perish. We would deserve to be dispersed through the earth like dust before the wind if we do not muster our powers at this late hour and finally find the courage which up to now we have lacked. Do not hide your cowardice behind a cloak of expediency, for with every new day that you hesitate, failing to oppose this offspring of Hell, your guilt, as in a parabolic curve, grows higher and higher. Many, perhaps most, of the readers of these leaflets do not see clearly how they can practice an effective opposition. They do not see any avenues open to them. We want to try to show them that everyone is in a position to contribute to the overthrow of this system. It is not possible through solitary withdrawal, in the manner of embittered hermits, to prepare the ground for the overturn of this “government” or bring about the revolution at the earliest possible moment. No, it can be done only by the cooperation of many convinced, energetic people – people who are agreed as to the means they must use to attain their goal. We have no great number of choices as to these means. The only one available is passive resistance.

The meaning and the goal of passive resistance is to topple National Socialism, and in this struggle we must not recoil from any course, any action, whatever its nature. At all points we must oppose National Socialism, wherever it is open to attack. We must soon bring this monster of a state to an end. A victory of fascist Germany in this war would have immeasurable, frightful consequences. The military victory over Bolshevism dare not become the primary concern of the Germans. The defeat of the Nazis must unconditionally be the first order of business, the greater necessity of this latter requirement will be discussed in one of our forthcoming leaflets.

And now every convinced opponent of National Socialism must ask himself how he can fight against the present “state” in the most effective way, how he can strike it the most telling blows. Through passive resistance, without a doubt. We cannot provide each man with the blueprint for his acts, we can only suggest them ingeneral terms, and he will find the way of achieving this end:

Sabotage in armament plants and war industries, sabotage at all gatherings, rallies, public ceremonies, and organizations of the National Socialist Party. Obstruction of the smooth functioning of the war machine (a machine for war that goes on solely to shore up and perpetuate the National Socialist Party and its dictatorship).

Sabotage in all the areas of science and scholarship which further the continuation of the war – whether in universities, technical schools, laboratories, research institutes, or technical bureaus. Sabotage in all cultural institutions which could potentially enhance the “prestige” of the fascists among the people. Sabotage in all branches of the arts which have even the slightest dependence on National Socialism or render it service.

Sabotage in all publications, all newspapers, that are in the pay of the “government” and that defend its ideology and aid in disseminating the brown lie. Do not give a penny to public drives (even when they are conducted under the pretense of charity). For this is only a disguise. In reality the proceeds aid neither the Red Cross nor the needy. The government does not need this money; it is not financially interested in these money drives. After all, the presses run continuously to manufacture any desired amount of paper currency. But the populace must be kept constantly under tension, the pressure of the bit must not be allowed to slacken! Do not contribute to the collections of metal, textiles, and the like. Try to convince all your acquaintances, including those in the lower social classes, of the senselessness of continuing, of the hopelessness of this war; of our spiritual and economic enslavement at the hands of the National Socialists; of the destruction of all moral  and religious values; and urge them to passive resistance!

Aristotle, Politics: “… and further, it is part [of the nature of tyranny] to strive to see to it that nothing is kept hidden of that which any subject says or does, but that everywhere he will be spied upon, … and further, to set man against the privileged and the wealthy. Also it is part of these tyrannical measures, to keep the subjects poor, in order to pay the guards and soldiers, and so that they will be occupied with earning their livelihood and will have neither leisure nor opportunity to engage in conspiratorial acts…. Further, [to levy] such taxes on income as were imposed in Syracuse, for under Dionysius the citizens gladly paid out their whole fortunes in taxes within five years. Also, the tyrant is inclined constantly.

“Too late. You Are Compromised Beyond Repair” A Warning to Americans From Milton Mayer’s “They Thought They Were Free: The Germans 1933-1945”

In light of the direction the Trump Administration, the GOP Senate, and the Trump Cult loyalists are moving as a result of the probability of impeachment and how to protect Trump from removal, either by a quitting him in the Senate, working to re-elect him, and threatening those who oppose him; I am re-posting an article about one of the most important books that was published in the years following the Second World War. That book is Milton Mayer’s They Thought They Were Free. 

One of the most powerful books I have ever read was Milton Mayer’s “They Thought They Were Free: The Germans 1933-1945.” Mayer was a visiting professor at the University of Frankfurt in the 1950s and lived in a small Hessian town near the city. The book is about the relationships that he built with ten ordinary citizens in the town and how they lived under Nazism and how most saw little wrong with it in the end.

The book is well worth the read and very timely when one compares the attitudes of the men who became Mayer’s friends and many people in the United States today. The last few chapters of the book are a reflection of the author’s opinions of the future of Germany at the time of his writing and he was mistaken on how the Germans would eventually become a society that embraced democracy and rejected authoritarianism (at the time he felt that it was very possible that democracy would fail in Germany,) they do not take away anything from the heart of the book and its message about how people adjust to authoritarian rule.

One chapter in particular struck me, it was a conversion that Mayer had with a colleague at the University who also reflected what it was like to live in the Third Reich and how in doing so he compromised himself and lost the opportunity to resist when resistance might have changed the course of events as Germany proceeded down the road to dictatorship and destruction. The chapter is particularly painful to read as the man understood that he should have known better but didn’t recognize the warning signs of the gradual nature of how life was changing with each new law or dictate from the Fuhrer.

In reading the chapter I see parallels in American society today. There are the Trump loyalists, many of who openly call for restrictions of liberty and crushing opposition to the President’s policies using extra-constitutional means including violence. I watched a video of interviews with Trump supporters at his Harrisburg, Pennsylvania rally last night. A number discussed resorting to violence, killing opponents, and civil war if Trump is removed from office or is defeated in the 2020 election. Sadly, it is not a stand alone video, there are others much like it, as well as blog posts, Twitter and Facebook posts, and other social media platforms.

Many are quite extreme while others, persuaded by years of right-wing talk radio, politically charged sermons by their pastors, and the daily dose of Fox News believe everything said by the President even when confronted by facts. Then there are Trump’s opponents, but many of the opponents are divided and cannot get along with each other. Some of these opponents actually helped Trump into office by circulating the Russian anti-Clinton conspiracy theories and falsehoods throughout the campaign. Each of these groups probably composes about 25-30% of the electorate each. The remaining segment are the people who simply go with the flow because life is too busy and crisis laden to get too deeply enmeshed in the political debate, and many have become so cynical that they see no difference in either side and are much more concerned about making it paycheck to paycheck even as the economy booms.

Chapter 13: But Then It Was Too Late

“What no one seemed to notice,” said a colleague of mine, a philologist, “was the ever widening gap, after 1933, between the government and the people. Just think how very wide this gap was to begin with, here in Germany. And it became always wider. You know, it doesn’t make people close to their government to be told that this is a people’s government, a true democracy, or to be enrolled in civilian defense, or even to vote. All this has little, really nothing, to do with knowing one is governing.

“What happened here was the gradual habituation of the people, little by little, to being governed by surprise; to receiving decisions deliberated in secret; to believing that the situation was so complicated that the government had to act on information which the people could not understand, or so dangerous that, even if the people could not understand it, it could not be released because of national security. And their sense of identification with Hitler, their trust in him, made it easier to widen this gap and reassured those who would otherwise have worried about it.

“This separation of government from people, this widening of the gap, took place so gradually and so insensibly, each step disguised (perhaps not even intentionally) as a temporary emergency measure or associated with true patriotic allegiance or with real social purposes. And all the crises and reforms (real reforms, too) so occupied the people that they did not see the slow motion underneath, of the whole process of government growing remoter and remoter.

“You will understand me when I say that my Middle High German was my life. It was all I cared about. I was a scholar, a specialist. Then, suddenly, I was plunged into all the new activity, as the university was drawn into the new situation; meetings, conferences, interviews, ceremonies, and, above all, papers to be filled out, reports, bibliographies, lists, questionnaires. And on top of that were the demands in the community, the things in which one had to, was ‘expected to’ participate that had not been there or had not been important before. It was all rigmarole, of course, but it consumed all one’s energies, coming on top of the work one really wanted to do. You can see how easy it was, then, not to think about fundamental things. One had no time.”

“Those,” I said, “are the words of my friend the baker. ‘One had no time to think. There was so much going on.’”

“Your friend the baker was right,” said my colleague. “The dictatorship, and the whole process of its coming into being, was above all diverting. It provided an excuse not to think for people who did not want to think anyway. I do not speak of your ‘little men,’ your baker and so on; I speak of my colleagues and myself, learned men, mind you. Most of us did not want to think about fundamental things and never had. There was no need to. Nazism gave us some dreadful, fundamental things to think about—we were decent people—and kept us so busy with continuous changes and ‘crises’ and so fascinated, yes, fascinated, by the machinations of the ‘national enemies,’ without and within, that we had no time to think about these dreadful things that were growing, little by little, all around us. Unconsciously, I suppose, we were grateful. Who wants to think?

“To live in this process is absolutely not to be able to notice it—please try to believe me—unless one has a much greater degree of political awareness, acuity, than most of us had ever had occasion to develop. Each step was so small, so inconsequential, so well explained or, on occasion, ‘regretted,’ that, unless one were detached from the whole process from the beginning, unless one understood what the whole thing was in principle, what all these ‘little measures’ that no ‘patriotic German’ could resent must some day lead to, one no more saw it developing from day to day than a farmer in his field sees the corn growing. One day it is over his head.

“How is this to be avoided, among ordinary men, even highly educated ordinary men? Frankly, I do not know. I do not see, even now. Many, many times since it all happened I have pondered that pair of great maxims, Principiis obsta and Finem respice—‘Resist the beginnings’ and ‘Consider the end.’ But one must foresee the end in order to resist, or even see, the beginnings. One must foresee the end clearly and certainly and how is this to be done, by ordinary men or even by extraordinary men? Things might have. And everyone counts on that might.

“Your ‘little men,’ your Nazi friends, were not against National Socialism in principle. Men like me, who were, are the greater offenders, not because we knew better (that would be too much to say) but because we sensed better. Pastor Niemöller spoke for the thousands and thousands of men like me when he spoke (too modestly of himself) and said that, when the Nazis attacked the Communists, he was a little uneasy, but, after all, he was not a Communist, and so he did nothing; and then they attacked the Socialists, and he was a little uneasier, but, still, he was not a Socialist, and he did nothing; and then the schools, the press, the Jews, and so on, and he was always uneasier, but still he did nothing. And then they attacked the Church, and he was a Churchman, and he did something—but then it was too late.”

“Yes,” I said.

“You see,” my colleague went on, “one doesn’t see exactly where or how to move. Believe me, this is true. Each act, each occasion, is worse than the last, but only a little worse. You wait for the next and the next. You wait for one great shocking occasion, thinking that others, when such a shock comes, will join with you in resisting somehow. You don’t want to act, or even talk, alone; you don’t want to ‘go out of your way to make trouble.’ Why not?—Well, you are not in the habit of doing it. And it is not just fear, fear of standing alone, that restrains you; it is also genuine uncertainty.

“Uncertainty is a very important factor, and, instead of decreasing as time goes on, it grows. Outside, in the streets, in the general community, ‘everyone’ is happy. One hears no protest, and certainly sees none. You know, in France or Italy there would be slogans against the government painted on walls and fences; in Germany, outside the great cities, perhaps, there is not even this. In the university community, in your own community, you speak privately to your colleagues, some of whom certainly feel as you do; but what do they say? They say, ‘It’s not so bad’ or ‘You’re seeing things’ or ‘You’re an alarmist.’

“And you are an alarmist. You are saying that this must lead to this, and you can’t prove it. These are the beginnings, yes; but how do you know for sure when you don’t know the end, and how do you know, or even surmise, the end? On the one hand, your enemies, the law, the regime, the Party, intimidate you. On the other, your colleagues pooh-pooh you as pessimistic or even neurotic. You are left with your close friends, who are, naturally, people who have always thought as you have.

“But your friends are fewer now. Some have drifted off somewhere or submerged themselves in their work. You no longer see as many as you did at meetings or gatherings. Informal groups become smaller; attendance drops off in little organizations, and the organizations themselves wither. Now, in small gatherings of your oldest friends, you feel that you are talking to yourselves, that you are isolated from the reality of things. This weakens your confidence still further and serves as a further deterrent to—to what? It is clearer all the time that, if you are going to do anything, you must make an occasion to do it, and then you are obviously a troublemaker. So you wait, and you wait.

“But the one great shocking occasion, when tens or hundreds or thousands will join with you, never comes. That’s the difficulty. If the last and worst act of the whole regime had come immediately after the first and smallest, thousands, yes, millions would have been sufficiently shocked—if, let us say, the gassing of the Jews in ’43 had come immediately after the ‘German Firm’ stickers on the windows of non-Jewish shops in ’33. But of course this isn’t the way it happens. In between come all the hundreds of little steps, some of them imperceptible, each of them preparing you not to be shocked by the next. Step C is not so much worse than Step B, and, if you did not make a stand at Step B, why should you at Step C? And so on to Step D.

“And one day, too late, your principles, if you were ever sensible of them, all rush in upon you. The burden of self-deception has grown too heavy, and some minor incident, in my case my little boy, hardly more than a baby, saying ‘Jewish swine,’ collapses it all at once, and you see that everything, everything, has changed and changed completely under your nose. The world you live in—your nation, your people—is not the world you were born in at all. The forms are all there, all untouched, all reassuring, the houses, the shops, the jobs, the mealtimes, the visits, the concerts, the cinema, the holidays. But the spirit, which you never noticed because you made the lifelong mistake of identifying it with the forms, is changed. Now you live in a world of hate and fear, and the people who hate and fear do not even know it themselves; when everyone is transformed, no one is transformed. Now you live in a system which rules without responsibility even to God. The system itself could not have intended this in the beginning, but in order to sustain itself it was compelled to go all the way.

“You have gone almost all the way yourself. Life is a continuing process, a flow, not a succession of acts and events at all. It has flowed to a new level, carrying you with it, without any effort on your part. On this new level you live, you have been living more comfortably every day, with new morals, new principles. You have accepted things you would not have accepted five years ago, a year ago, things that your father, even in Germany, could not have imagined.

“Suddenly it all comes down, all at once. You see what you are, what you have done, or, more accurately, what you haven’t done (for that was all that was required of most of us: that we do nothing). You remember those early meetings of your department in the university when, if one had stood, others would have stood, perhaps, but no one stood. A small matter, a matter of hiring this man or that, and you hired this one rather than that. You remember everything now, and your heart breaks. Too late. You are compromised beyond repair.

“What then? You must then shoot yourself. A few did. Or ‘adjust’ your principles. Many tried, and some, I suppose, succeeded; not I, however. Or learn to live the rest of your life with your shame. This last is the nearest there is, under the circumstances, to heroism: shame. Many Germans became this poor kind of hero, many more, I think, than the world knows or cares to know.”

I said nothing. I thought of nothing to say.

“I can tell you,” my colleague went on, “of a man in Leipzig, a judge. He was not a Nazi, except nominally, but he certainly wasn’t an anti-Nazi. He was just—a judge. In ’42 or ’43, early ’43, I think it was, a Jew was tried before him in a case involving, but only incidentally, relations with an ‘Aryan’ woman. This was ‘race injury,’ something the Party was especially anxious to punish. In the case at bar, however, the judge had the power to convict the man of a ‘nonracial’ offense and send him to an ordinary prison for a very long term, thus saving him from Party ‘processing’ which would have meant concentration camp or, more probably, deportation and death. But the man was innocent of the ‘nonracial’ charge, in the judge’s opinion, and so, as an honorable judge, he acquitted him. Of course, the Party seized the Jew as soon as he left the courtroom.”

“And the judge?”

“Yes, the judge. He could not get the case off his conscience—a case, mind you, in which he had acquitted an innocent man. He thought that he should have convicted him and saved him from the Party, but how could he have convicted an innocent man? The thing preyed on him more and more, and he had to talk about it, first to his family, then to his friends, and then to acquaintances. (That’s how I heard about it.) After the ’44 Putsch they arrested him. After that, I don’t know.”

I said nothing.

“Once the war began,” my colleague continued, “resistance, protest, criticism, complaint, all carried with them a multiplied likelihood of the greatest punishment. Mere lack of enthusiasm, or failure to show it in public, was ‘defeatism.’ You assumed that there were lists of those who would be ‘dealt with’ later, after the victory. Goebbels was very clever here, too. He continually promised a ‘victory orgy’ to ‘take care of’ those who thought that their ‘treasonable attitude’ had escaped notice. And he meant it; that was not just propaganda. And that was enough to put an end to all uncertainty.

“Once the war began, the government could do anything ‘necessary’ to win it; so it was with the ‘final solution of the Jewish problem,’ which the Nazis always talked about but never dared undertake, not even the Nazis, until war and its ‘necessities’ gave them the knowledge that they could get away with it. The people abroad who thought that war against Hitler would help the Jews were wrong. And the people in Germany who, once the war had begun, still thought of complaining, protesting, resisting, were betting on Germany’s losing the war. It was a long bet. Not many made it.”

The Holocaust Can Happen Again “Because it Deviated Not from Human Norms”

The crimes of Adolf Hitler’s Nazi regime may seem like the happened a long time ago in a galaxy far, far away, we would all like to believe that. However, they are only as far away as the next time. That is why we must continue to show them in their awful reality. Yehuda Bauer, a historian of the Holocaust whose family escaped from Czechoslovakia the day it was annexed by the Third Reich wrote:

“The horror of the Holocaust is not that it deviated from human norms; the horror is that it didn’t. What happened may happen again, to others not necessarily Jews, perpetrated by others, not necessarily Germans. We are all possible victims, possible perpetrators, possible bystanders.”

This is an eternal truth. The Red Chinese in Tibet, the Cambodian Killing Fields, the Serbians massacring Bosnians under the noses of Dutch Peacekeepers in Srebrenica, the Tutsis of Rwanda butchered by their Hutu neighbors shortly after Easter, as well as the crimes of the Islamic State against Kurds, opposition Sunnis, Shia, Yazidis, and Christians in Iraq and Syria.

Besides genocide we can add the crime of aggressive war against weaker neighbors or nations committed Russia in Georgia and the Ukraine, and the United States against Iraq. Then there is the assault on minority groups within various nations, the rejection of refugees, and rise in anti-Semitism across Russia, Europe, and the United States have all produced myriads of victims, perpetrators, and bystanders.

The crimes committed by the Nazis against their own citizens and the nations that they victimized are not completely unique to them. While the Nazi Genocide committed against the Jews is unique, what motivated them is far more common than we would want to admit. The Holocaust and the Nazi war for Lebensraum is not an aberration from the norms of human nature, it is the norm. That is why continuing to expose those crimes, the men and women behind them, and those who stood by, doing nothing while their neighbors were being marched away, or stood by as other men marched men, women, and children to massive pits and shot them one by one, up close and personal, by the tens of thousands.

I would like with all my heart to consign the crimes of the Nazis to the depths of history, but I cannot. It is beginning to happen again before our very eyes, the American President is pardoning convicted war criminals, rescinding American participation in international treaties, agreements, and organizations, as well as conducting anti-immigration operations, in violation of our own and international law that Jackson would have classed as crimes against humanity. That is why I, a man born thirteen and a half years after the major Nuremberg War Crimes ended with ten of the defendants hanging from the gallows continue to write about it. If we are not careful, it can and will happen again.

Over the past week I have been writing about the Nuremberg Trials and the American Chief Prosecutor, Supreme Court Justice Robert Jackson. Last night I wrote about the introduction of his closing arguments before the Tribunal which followed his opening address by nine months. I now continue with Justice Jackson’s closing arguments against the Nazi war criminals sitting in the dock of Nuremberg’s Palace of Justice.

THE CRIMES OF THE NAZI REGIME

The strength of the case against these defendants under the conspiracy count, which it is the duty of the United States to argue, lies in its simplicity. It involves but three ultimate inquiries: First, have the acts defined by the Charter as crimes been committed; second, were they committed pursuant to a common plan or conspiracy; third, are these defendants among those who are criminally responsible? The charge requires examination of a criminal policy, not of a multitude of isolated, unplanned, or disputed crimes. The substantive crimes upon which we rely, either as goals of a common plan or as means for its accomplishment, are admitted. The pillars which uphold the conspiracy charge may be found in five groups of overt acts, whose character and magnitude are important considerations in appraising the proof of conspiracy.

1. THE SEIZURE OF POWER AND SUBJUGATION OF GERMANY TO A POLICE STATE The Nazi Party seized control of the German State in 1933. “Seizure of power” is a characterisation used by defendants and defence witnesses, and so apt that it has passed into both history and everyday speech. The Nazi junta in the early days lived in constant fear of overthrow. Goering, in 1934, pointed out that its enemies were legion, and said:

“Therefore, the concentration camps have been created, where we have first confined thousands of Communists and Social Democrat functionaries.”

In 1933 Goering forecast the whole programme of purposeful cruelty and oppression when he publicly announced:

“Whoever in the future raises a hand against a representative of the National Socialist movement or of the State must know that he will lose his life in a very short while.”

New political crimes were created to this end. It was made a treason, punishable with death, to organize or support a political party other than the Nazi Party. Circulating a false or exaggerated statement, or one which would harm the State or even the Party, was made a crime. Laws were enacted of such ambiguity that they could be used to punish almost any innocent act. It was, for example, made a crime to provoke “any act contrary to the public welfare”.

The doctrine of punishment by analogy was introduced to enable conviction for acts which no statute forbade. Minister of Justice Guertner explained that National Socialism considered every violation of the goals of life which the community set up for itself to be a wrong per se, and that the acts could be punished even though it was not contrary to existing “formal law”.

The Gestapo and the SD were instrumentalities of an espionage system which penetrated public and private life. Goering controlled a personal wiretapping unit. All privacy of communication was abolished. Party Blockleiter appointed over every 50 householders spied continuously on all within their ken.

Upon the strength of this spying individuals were dragged off to “protective custody” and to concentration camps without legal proceedings of any kind1and without statement of any reason therefore. The partisan political police were exempted from effective legal responsibility for their acts.

With all administrative offices in Nazi control and with the Reichstag reduced to impotence, the judiciary remained the last obstacle to this reign of terror. But its independence was soon overcome and it was reorganised to dispense a venal justice. Judges were ousted for political or racial reasons and were spied upon and put under pressure to join the Nazi Party. After the Supreme Court had acquitted three of the four men whom the Nazis accused of setting the Reichstag on fire, its jurisdiction over treason cases was transferred to a newly established “People’s Court” consisting of two judges and five Party officials. The German film of this “People’s Court” in operation, which the showed in this chamber, revealed its presiding judge pouring partisan abuse on speechless defendants. Special courts were created to try political crimes, only Party members were appointed judges, and “Judges’ letters” instructed the puppet judges as to the “general lines” they must follow.

The result was the removal of all peaceable means either to resist or to change the Government. Having sneaked through the portals of power, the Nazis slammed the gate in the face of all others who might also aspire to enter. Since the law was what the Nazis said it was, every form of opposition was rooted out and every dissenting voice throttled. Germany was in the clutch of a police State, which used the fear of the concentration camp as a means to enforce non-resistance. The Party was the State, the State was the Party, and terror by day and death by night were the policy of both.

2. THE PREPARATION AND WAGING OF WARS OF AGGRESSION From the moment the Nazis seized power, they set about with feverish but stealthy efforts, in defiance of the Versailles Treaty, to arm for war. In 1933 they found no air force. By 1939 they had 21 squadrons, consisting of 240 echelons or about 2,400 first-line planes, together with trainers and transports.

In 1933 they found an army of 3 infantry [sic] (actually 7) and 3 cavalry divisions. By 1939 they had raised and equipped an army of 51 divisions, 4 of which were fully motorized and 4 of which were panzer divisions. In 1933 they found a navy of one cruiser and six light cruisers. By 1939 they had built a navy of 4 battleships, 1 aircraft carrier, 6 cruisers, 22 destroyers, and 54 submarines. They had also built up in that period an armament industry as efficient as that of any country in the world.

These new weapons were put to use, commencing in September, 1939, in a series of undeclared wars against nations with which Germany had arbitration and non-aggression treaties, and in violation of repeated assurances.

On 1st September, 1939, this rearmed Germany attacked Poland. The following April witnessed the invasion and occupation of Denmark and Norway, and May saw the overrunning of Belgium, the Netherlands, and Luxembourg. Another spring saw Yugoslavia and Greece under attack, and in June, 1941, came the invasion of Soviet Russia. Then Japan, which Germany had embraced as a partner, struck without warning at Pearl Harbour in December, 1941, and four days later Germany declared war on the United States.

We need not trouble ourselves about the many abstract difficulties that can be conjured up about what constitutes aggression in doubtful cases. I shall show you, in discussing the conspiracy, that by any test ever put forward by any responsible authority, by all the canons of plain common sense, these were unlawful wars of aggression in breach of treaties and in violation of assurances.

3. WARFARE IN DISREGARD OF INTERNATIONAL LAW

It is unnecessary to labour this point on the facts. Goering asserts that the Rules of Land Warfare were obsolete, that no nation could fight a total war within their limits. He testified that the Nazis would have denounced the Conventions to which Germany was a party, but that General Jodl wanted captured German soldiers to continue to benefit from their observance by the Allies.

It was, however, against the Soviet people and Soviet prisoners that Teutonic fury knew no bounds, in spite of a warning by Admiral Canaris that the treatment was in violation of International Law. We need not, therefore, for the purposes of the conspiracy count, recite the revolting details of starving, beating, murdering, freezing, and mass extermination admittedly used against the Eastern soldiery. Also, we may take as established or admitted that the lawless conduct such as shooting British and American airmen, mistreatment of Western prisoners of war, forcing French prisoners of war into German war work, and other deliberate violations of the Hague and Geneva Conventions, did occur, and in obedience to highest levels of authority.

4. ENSLAVEMENT AND PLUNDER OF POPULATIONS IN OCCUPIED COUNTRIES

The defendant Sauckel, Plenipotentiary General for the Utilization of Labour, is authority for the statement that “out of five million foreign workers who arrived in Germany, not even 200,000 came voluntarily”. It was officially reported to defendant Rosenberg that in his territory “recruiting methods were used which probably have their origin in the blackest period of the slave trade”. Sauckel himself reported that male and female agents went hunting for men, got them drunk, and “shanghaied” them to Germany. These captives were shipped in trains without heat, food, or sanitary facilities. The dead were thrown out at stations, and the newborn were thrown out the windows of moving trains.

Sauckel ordered that “all the men must be fed, sheltered and treated in such a way as to exploit them to the highest possible extent at the lowest conceivable degree of expenditure”. About two million of these were employed directly in the manufacture of armaments and munitions. The director of the Krupp locomotive factory in Essen complained to the company that Russian forced labourers were so underfed that they were too weakened to do their work, and the Krupp doctor confirmed their pitiable condition. Soviet workers were put in camps under Gestapo guards, who were allowed to punish disobedience by confinement in a concentration camp or by hanging on the spot.

Populations of occupied countries were otherwise exploited and oppressed unmercifully. Terrorism was the order of the day. Civilians were arrested without charges, committed without counsel, executed without hearing. Villages were destroyed, the male inhabitants shot or sent to concentration camps, the women sent to forced labour, and the children scattered abroad. The extent of the slaughter in Poland alone was indicated by Frank, who reported:

” If I wanted to have a poster put up for every seven Poles who were shot, the forests of Poland would not suffice for producing the paper for such posters.”

Those who will enslave men cannot be expected to refrain from plundering them. Boastful reports show how thoroughly and scientifically the resources of occupied lands were sucked into the German war economy, inflicting shortage, hunger, and inflation upon the inhabitants. Besides this grand plan to aid the German war effort there were the sordid activities of the Rosenberg “Einsatzstab”, which pillaged art treasures for Goering and his fellow-bandits. It is hard to say whether the spectacle of Germany’s No. 2 leader urging his people to give up every comfort and strain every sinew on essential war work while he rushed around confiscating art by the trainload should be cast as tragedy or comedy. In either case it was a crime.

International Law at all times before and during this war spoke with precision and authority respecting the protection due to civilians of an occupied country, and the slave trade and plunder of occupied countries was at all times flagrantly unlawful.

5. PERSECUTION AND EXTERMINATION OF JEWS AND CHRISTIANS

The Nazi movement will be of evil memory in history because of its persecution of the Jews, the most far-flung and terrible racial persecution of all time. Although the Nazi Party neither invented nor monopolised anti-Semitism, its leaders from the very beginning embraced it, incited it, and exploited it. They used it as “the psychological spark that ignites the mob”. After seizure of power, it became an official State policy. The persecution began in a series of discriminatory laws eliminating the Jews from the civil service, the professions, and economic life. As it became more intense it included segregation of Jews in ghettoes, and exile. Riots were organized by Party leaders to loot Jewish business places and to burn synagogues. Jewish property was confiscated and a collective fine of a billion marks was imposed upon German Jewry. The programme progressed in fury and irresponsibility to the “final solution”. This consisted of sending all Jews who were fit to work to concentration camps as slave labourers, and all who were not fit, which included children under 12 and people over 50, as well as any others judged unfit by an SS doctor, to concentration camps for extermination.

Adolf Eichmann, the sinister figure who had charge of the extermination programme, has estimated that the anti-Jewish activities resulted in the killing of six million Jews. Of these, four million were killed in extermination institutions, and two million were killed by Einsatzgruppen, mobile units of the Security Police and SD which pursued Jews in the ghettoes and in their homes and slaughtered them in gas wagons, by mass shooting in anti-tank ditches and by every device which Nazi ingenuity could conceive.

So thorough and uncompromising was this programme that the Jews of Europe as a race no longer exist, thus fulfilling the diabolic “prophecy” of Adolf Hitler at the beginning of the war. Of course, any such programme must reckon with the opposition of the Christian Church. This was recognized from the very beginning. Defendant Bormann wrote all Gauleiter in 1941 that “National Socialism and Christian concepts are irreconcilable”, and that the people must be separated from the Churches, and the influence of the Churches totally removed. Defendant Rosenberg even wrote dreary treatises advocating a new and weird. Nazi religion.

The Gestapo appointed “Church specialists” who were instructed that the ultimate aim was “destruction of the confessional Churches”. The record is full of specific instances of the persecution of clergymen, the confiscation of Church property, interference with religious publications, disruption, of religious education, and suppression of religious organizations.

The chief instrument for persecution and extermination was the concentration camp, sired by the defendant Goering and nurtured under the overall authority of defendants Frick and Kaltenbrunner.

The horrors of these iniquitous places have been vividly disclosed by documents and testified to by witnesses. The Tribunal must be satiated with ghastly verbal and pictorial portrayals. From your records it is clear that the concentration camps were the first and worst weapon of Nazi oppression used by the National Socialist State, and that they were the primary means utilised for the persecution of the Christian Church and the extermination of the Jewish race. This has been admitted to you by some of the defendants from the witness stand. In the words of defendant Frank:

“A thousand years will pass and this guilt of Germany will still not be erased.”

These, then, were the five great substantive crimes of the Nazi regime. Their commission, which cannot be denied, stands admitted. The defendant Keitel, who is in a position to know the facts, has given the Tribunal what seems to be a fair summation of the case on the facts:

“The defendant has declared that ‘he admits the contents of the general Indictment to be proved from the objective and factual point of view’ (that is to say, not every individual case) ‘and this in consideration of the law of procedure governing the trial. It would be senseless, despite the possibility of refuting several documents or individual facts, to attempt to shake the Indictment as a whole.’” I pass now to the inquiry as to whether these groups of criminal acts were integrated in a common plan or conspiracy.

THE COMMON PLAN OR CONSPIRACY

The prosecution submits that these five categories of premeditated crimes were not separate and independent phenomena but that all were committed pursuant to a common plan or conspiracy.

The defence admits that these classes of crimes were committed, but denies that they are connected one with another as parts of a single programme. The central crime in this pattern of crimes, the king-pin which holds them all together, is the plot for aggressive wars. The chief reason for international cognizance of these crimes lies in this fact. Have we established the plan or conspiracy to make aggressive war?

Certain admitted or clearly proven facts help to answer that question. First is the fact that such war of aggression did take place. Second, it is admitted that from the moment the Nazis came to power, every one of them and every one of the defendants worked like beavers to prepare for some war. The question therefore comes to this: Were they preparing for the war which did occur, or were they preparing for some war which never happened?

It is probably true that in their early days none of them had in mind what month of what year war would begin, the exact dispute which would precipitate it, or whether its first impact would be Austria, Czechoslovakia, or Poland. But I submit that the defendants either knew or were chargeable with knowledge that the war for which they were making ready would be a war of German aggression. This is partly because there was no real expectation that any power or combination of powers would attack Germany. But it is chiefly because the inherent nature of the German plans was such that they were certain sooner or later to meet resistance and that they could then be accomplished only by aggression.

The plans of Adolf Hitler for aggression were just as secret as Mein Kampf, of which over six million copies were published in Germany. He not only openly advocated overthrowing the Treaty of Versailles, but made demands which went far beyond a mere rectification of its alleged injustices. He avowed an intention to attack neighbouring States and seize their lands, which he said would have to be won with “the power of a triumphant sword”. Here, for every German to hearken to, were the “ancestral voices prophesying war”.

Goering has testified in this courtroom that at his first meeting with Hitler, long before the seizure of power:

“I noted that Hitler had a definite view of the impotency of protest and, as a second point, that he was of the opinion that Germany should be freed of the Peace of Versailles. ‘We did not say we shall have to have a war and defeat our enemies’; this was the aim and the methods had to be adapted to the political situation.”

When asked if this goal were to be accomplished by war if necessary, Goering did not deny that eventuality but evaded a direct answer by saying, “We did not debate about that at all at that time.” He went on to say that the aim to overthrow the Treaty of Versailles was open and notorious and that, I quote again, “Every German in my opinion was for its modification, and there was no doubt that this was a strong inducement for joining the party.”

Thus, there can be no possible excuse for any person who aided Hitler to get absolute power over the German people, or who took a part in his regime, to fail to know the nature of the demands he would make on Germany’s neighbours.

“To Pay any Price, to Bear Any Burden” Remembering John F. Kennedy on the 56th Anniversary of His Assassination

Fifty-six years ago President John F. Kennedy was assassinated by Lee Harvey Oswald in Dallas Texas. Despite his many flaws he was an inspiring American hero. Today I am taking the time to remember something that he said that is so lacking in our political discourse today.

Kennedy said:“So let us begin a new remembering on both sides that civility is not a sign of weakness, and sincerity is always subject to proof. Let us never negotiate out of fear. But let us never fear to negotiate.”


Some fifty-six years ago a young, handsome Irish Catholic from Massachusetts took the oath of office of the President of the United States. President John F. Kennedy had won an exceptionally close Presidential Race against Republican Voce President Richard M. Nixon, a race that some believe was decided by votes of the dead in places like Chicago and West Virginia. Despite the contested nature of the election Nixon was gracious and conceded the race to avoid deeper division.

Fifty years ago today that young President was gunned down in Dealey Plaza in Dallas Texas by Lee Harvey Oswald. It was an event that shattered our nation which helped in many ways to foment the deep and abiding cynicism that is the hallmark of our recent political landscape.

The Kennedy administration had a wonderful vision but was not always successful. In fact there were time its policies and actions in the case of the Bay of Pigs Invasion, and the Assassination of South Vietnamese President Diem, were mired in controversy. Decisions made by Kennedy to send more advisors to Vietnam would be followed by the Johnson Administration sending combat troops. Kennedy played a high stakes game of chess with Nikita Khrushchev during the Cuban Missile Crisis where the world came perilously close to nuclear war.

That being said he also inspired and energized Americans and our Allies to greatness. Kennedy’s speech at the Berlin Wall where he identified himself with the city saying “Ich bin Ein Berliner”inspired many in Germany who realized that in Kennedy they had a friend who would not abandon them.

Kennedy challenged us as Americans to put a man on the moon by 1970. He  supported NASA as they began to develop the Apollo program which did achieve that lofty goal when Apollo 11 landed on the Moon on July 11th 1969.

Kennedy was a visionary. He supported the establishment the Army Special Forces, or the Green Berets.  He helped to found and promote the Peace Corps.  His economic policies were fiscally conservative but did not ignore the poor. He pushed for equal rights for African Americans against a much divided nation.

As I said, Kennedy was a flawed man. A deeply flawed man. I have written about that before. He was not known for his sexual morality and the stories of him with various mistresses including Marilyn Monroe abound. At the same time he was a hero. He volunteered to serve on PT Boats in the Second World War when his political connections would have ensured him a billet in a non-combat area and his physical condition would have exempted him from any military service.

Kennedy died 56 years ago today. I was three and a half years old. He was the victim of an assassin’s bullet in Dealey Plaza in Dallas Texas with his wife Jackie at his side. His death stunned the nation and in a sense ended our innocence.  Since that time American politics has been on a slow but steady descent into darkness which both parties have aided and abetted to the point that they view each other as mortal enemies and along with it have devastated our body politic.

JOHN F KENNEDY FUNERAL

In our divided state it seems that the nation has become nothing more than a collection of special interest groups. Each group is driven by their own wants and needs above that of others goaded into a frenzy by politicians who cater to those needs whether they be tax breaks, entitlements or “pork barrel” projects which only benefit the political benefactors of the politicians. I know that American politics has always had such elements but I don’t think that my parents or those other young people who heard and responded to this speech ever imagined that we would come to this.

While Kennedy still has critics, and was a flawed man, I find him still to be a great and compelling President, especially compared to Donald Trump. His greatness was not in his achievements, his Vice President and successor Lyndon Johnson has the courage to defy Southern Democrats and work with Republicans to pass the Voting Rights Act of 1964, the Civil Rights Act of 1965, as well Medicare, and equal housing laws. These were things that Kennedy paid lip service to, but did little to change by aggressively pushing legislation that would help average as well as disadvantaged Americans. This was a point of frustration for more progressive Democrats. He was too civil to rock the boat with the old Southern Democrats and the Dixiecrats. That didn’t mean that he lacked courage or commitment, he was, and that was proven in war, but Lyndon Johnson was a better master of the legislative process than Kennedy.

Despite his flaws, John F. Kennedy is one of my favorite Presidents in large part because he understood that “civility is not a sign of weakness.” In our current poisonous political environment this is something that all of us need to take to heart, especially people of faith are the least civil and most hateful in our society.

Kennedy was one of those rare leaders who called us to better as individuals and as a nation. Today we remember his life and the tragedy of his death.

But today I think about Kennedy’s inaugural address. It is a speech that in my opinion calls us as Americans to higher and better ideals. It is a speech that if we actually listen to it can still help point us away from the abyss which we are staring into. I have posted the text of the speech as well as a link to the video of it here.

Vice President Johnson, Mr. Speaker, Mr. Chief Justice, President Eisenhower, Vice President Nixon, President Truman, Reverend Clergy, fellow citizens:

We observe today not a victory of party but a celebration of freedom, symbolizing an end as well as a beginning, signifying renewal as well as change. For I have sworn before you and Almighty God the same solemn oath our forbears prescribed nearly a century and three-quarters ago.

The world is very different now. For man holds in his mortal hands the power to abolish all forms of human poverty and all forms of human life. And yet the same revolutionary beliefs for which our forebears fought are still at issue around the globe – the belief that the rights of man come not from the generosity of the state but from the hand of God.

We dare not forget today that we are the heirs of that first revolution. Let the word go forth from this time and place, to friend and foe alike, that the torch has been passed to a new generation of Americans, born in this century, tempered by war, disciplined by a hard and bitter peace, proud of our ancient heritage, and unwilling to witness or permit the slow undoing of those human rights to which this nation has always been committed, and to which we are committed today at home and around the world.

Let every nation know, whether it wishes us well or ill, that we shall pay any price, bear any burden, meet any hardship, support any friend, oppose any foe to assure the survival and the success of liberty.

This much we pledge – and more.

To those old allies whose cultural and spiritual origins we share, we pledge the loyalty of faithful friends. United there is little we cannot do in a host of cooperative ventures. Divided there is little we can do; for we dare not meet a powerful challenge at odds and split asunder.

To those new states whom we welcome to the ranks of the free, we pledge our word that one form of colonial control shall not have passed away merely to be replaced by a far more iron tyranny. We shall not always expect to find them supporting our view. But we shall always hope to find them strongly supporting their own freedom; and to remember that, in the past, those who foolishly sought power by riding the back of the tiger ended up inside.

To those people in the huts and villages of half the globe struggling to break the bonds of mass misery, we pledge our best efforts to help them help themselves, for whatever period is required – not because the communists may be doing it, not because we seek their votes, but because it is right. If a free society cannot help the many who are poor, it cannot save the few who are rich.

To our sister republics south of our border, we offer a special pledge: to convert our good words into good deeds in a new alliance for progress; to assist free men and free governments in casting off the chains of poverty. But this peaceful revolution of hope cannot become the prey of hostile powers. Let all our neighbors know that we shall join with them to oppose aggression or subversion anywhere in the Americas. And let every other power know that this Hemisphere intends to remain the master of its own house.

To that world assembly of sovereign states, the United Nations, our last best hope in an age where the instruments of war have far outpaced the instruments of peace, we renew our pledge of support, to prevent it from becoming merely a forum for invective, to strengthen its shield of the new and the weak, and to enlarge the area in which its writ may run.

Finally, to those nations who would make themselves our adversary, we offer not a pledge but a request: that both sides begin anew the quest for peace, before the dark powers of destruction unleashed by science engulf all humanity in planned or accidental self-destruction.

We dare not tempt them with weakness. For only when our arms are sufficient beyond doubt can we be certain beyond doubt that they will never be employed.

But neither can two great and powerful groups of nations take comfort from our present course – both sides overburdened by the cost of modern weapons, both rightly alarmed by the steady spread of the deadly atom, yet both racing to alter that uncertain balance of terror that stays the hand of mankind’s final war.

So let us begin a new remembering on both sides that civility is not a sign of weakness, and sincerity is always subject to proof. Let us never negotiate out of fear. But let us never fear to negotiate.

Let both sides explore what problems unite us instead of belaboring those problems which divide us.

Let both sides, for the first time, formulate serious and precise proposals for the inspection and control of arms – and bring the absolute power to destroy other nations under the absolute control of all nations.

Let both sides seek to invoke the wonders of science instead of its terrors. Together let us explore the stars, conquer the deserts, eradicate disease, tap the ocean depths and encourage the arts and commerce.

Let both sides unite to heed in all corners of the Earth the command of Isaiah to “undo the heavy burdens . . . (and) let the oppressed go free.”

And if a beachhead of cooperation may push back the jungle of suspicion, let both sides join in creating a new endeavor, not a new balance of power, but a new world of law, where the strong are just and the weak secure and the peace preserved.

All this will not be finished in the first one hundred days. Nor will it be finished in the first one thousand days, nor in the life of this Administration, nor even perhaps in our lifetime on this planet. But let us begin.

In your hands, my fellow citizens, more than mine, will rest the final success or failure of our course. Since this country was founded, each generation of Americans has been summoned to give testimony to its national loyalty. The graves of young Americans who answered the call to service surround the globe.

Now the trumpet summons us again; not as a call to bear arms, though arms we need; not as a call to battle, though embattled we are; but a call to bear the burden of a long twilight struggle, year in and year out, “rejoicing in hope, patient in tribulation” – a struggle against the common enemies of man: tyranny, poverty, disease and war itself.

Can we forge against these enemies a grand and global alliance, North and South, East and West, that can assure a more fruitful life for all mankind? Will you join in that historic effort?

In the long history of the world, only a few generations have been granted the role of defending freedom in its hour of maximum danger. I do not shrink from this responsibility; I welcome it. I do not believe that any of us would exchange places with any other people or any other generation. The energy, the faith, the devotion which we bring to this endeavor will light our country and all who serve it – and the glow from that fire can truly light the world.

And so, my fellow Americans: ask not what your country can do for you – ask what you can do for your country.

My fellow citizens of the world: ask not what America will do for you, but what together we can do for the freedom of man.

Finally, whether you are citizens of America or citizens of the world, ask of us here the same high standards of strength and sacrifice which we ask of you. With a good conscience our only sure reward, with history the final judge of our deeds, let us go forth to lead the land we love, asking His blessing and His help, but knowing that here on Earth God’s work must truly be our own.

A New Birth of Freedom and its True Meaning: The Gettysburg Address


Friends of Padre Steve’s World,

The weekend before Donald Trump was elected President I was at Gettysburg with my students from the Staff College. We finished our staff ride at the Soldier’s Cemetery where Abraham Lincoln gave the Gettysburg Address. My practice as always was to close the staff ride by reading his address. I always get a bit choked up when I read it because I realize just how important what he said was then, and still is today. That Sunday it was as if I saw the Confederate hordes advancing upon Cemetery Ridge and the fate of the country hanging in the balance.

I had already seen the assaults on our Republic and Constitution by Donald Trump and his supporters, and that particular day I was full of dread. I knew that if Trump won, and his supporters on the Alt-Right have their way, our system of government will be destroyed, the civil liberties that the men who died at Gettysburg to establish, would be curtailed or even rolled back. I feared, and it turns out quite rightly, that if Trump won, that civil rights would be threatened or rolled back, that White Nationalists would be emboldened, and racist violence and anti-Semitic attacks would increase exponentially. I would have preferred to be wrong, but I was right. Now we are in the midst of impeachment proceedings

In November of 1863 Abraham Lincoln was sick when when he traveled by train from Washington DC to Gettysburg. When Lincoln delivered the address, he was suffering from what was mostly likely a mild form of Smallpox. Thus the tenor, simplicity and philosophical depth of his address are even more remarkable. It is a speech given in the manner of Winston Churchill’s “Blood sweat toil and tears” address to Parliament upon his appointment as Prime Minister in May, 1940. Likewise it echoes the Transcendentalist understanding of the Declaration of Independence as a “test for all other things.”

Many people in the United States and Europe did not agree with Lincoln’s restatement of the founding premise of the Declaration of Independence. Opponents argued that no nation found on such principles could long survive. The more reactionary European subscribers of Romanticism ridiculed the “idea that a nation could be founded on a proposition….and they were not reluctant to point to the Civil War as proof that attempting to build a government around something as bloodless and logical as a proposition was futile.” [1]

As late as 1848, the absolute monarchies of Europe had fought against and put down with force revolutionary movements attempting to imitate the American experiment. Many of the revolutionaries from Germany, Poland, and other nations fled to the United States, where 15 years later, clad in the Blue of the United States Army fought to preserve that experiment on the battlefields of the American Civil War, including Gettysburg.

But Lincoln disagreed with the conservative reactionaries of Europe, or the American Slave owning aristocracy. He believed that Americans would fight to defend that proposition. He believed that the “sacrifices of Gettysburg, Shiloh, Murfreesboro, Chancellorsville, and a hundred other places demonstrated otherwise, that men would die rather than to lose hold of that proposition. Reflecting on that dedication, the living should themselves experience a new birth of freedom, a determination- and he drove his point home with a deliberate evocation of the great Whig orator Daniel Webster- “that government of the people, by the people, for the people, shall not perish from the earth.” [2]

The Unitarian pastor, abolitionist, and leading Transcendentalist thinker, Theodore Parker wrote:

“Our national ideal out-travels our experience, and all experience. We began our national career by setting all history at defiance – for that said, “A republic on a large scale cannot exist.” Our progress since that has shown that we were right in refusing to be limited by the past. The practical ideas of the nation are transcendent, not empirical. Human history could not justify the Declaration of Independence and its large statements of the new idea: the nation went beyond human history and appealed to human nature.” [3]

Lincoln’s address echoes the thought of historian George Bancroft, who wrote of the Declaration:

“The bill of rights which it promulgates is of rights that are older than human institutions, and spring from the eternal justice…. The heart of Jefferson in writing the Declaration, and of Congress in adopting it, beat for all humanity; the assertion of right was made for the entire world of mankind and all coming generations, without any exceptions whatsoever.” [4]

Theodore Parker’s words also prefigured an idea that Lincoln used in his address. Parker, like Lincoln believed that: “the American Revolution, with American history since, is an attempt to prove by experience this transcendental proposition, to organize the transcendental idea of politics. The ideal demands for its organization a democracy- a government of all, for all, and by all…” [5]

Following a train trip to Gettysburg and an overnight stay, Lincoln delivered these immortal words on that November afternoon:

Four score and seven years ago our fathers brought forth on this continent, a new nation, conceived in Liberty, and dedicated to the proposition that all men are created equal.

Now we are engaged in a great civil war, testing whether that nation, or any nation so conceived and so dedicated, can long endure. We are met on a great battle-field of that war. We have come to dedicate a portion of that field, as a final resting place for those who here gave their lives that that nation might live. It is altogether fitting and proper that we should do this.

But, in a larger sense, we cannot dedicate — we can not consecrate — we can not hallow — this ground. The brave men, living and dead, who struggled here, have consecrated it, far above our poor power to add or detract. The world will little note, nor long remember what we say here, but it can never forget what they did here. It is for us the living, rather, to be dedicated here to the unfinished work which they who fought here have thus far so nobly advanced. It is rather for us to be here dedicated to the great task remaining before us — that from these honored dead we take increased devotion to that cause for which they gave the last full measure of devotion — that we here highly resolve that these dead shall not have died in vain — that this nation, under God, shall have a new birth of freedom — and that government of the people, by the people, for the people, shall not perish from the earth.[6]

In a time where many are wearied by the foibles and follies of our politicians, especially a man as singularity ill-equipped and ill-tempered as Donald Trump, Lincoln’s words still matter. Since Trump’s election he, and his supporters, many of whom are White Nationalists, and authoritarians have moved on many fronts to curtail civil rights and re-establish White rule in a way unseen since secession, and Jim Crow. So far our institutions have held, but there is no guarantee that they will. In such an environment, one has to wonder if our very form of government can survive.

But it is important that they do, and despite our weariness, we need to continue to fight for those ideals, even when the world seems to be closing in around us as it must have seemed following Lee’s initial success on the first day of battle at Gettysburg.

Dr. Allen Guelzo, Professor of Civil War Studies at Gettysburg College wrote in the New York Times:

“The genius of the address thus lay not in its language or in its brevity (virtues though these were), but in the new birth it gave to those who had become discouraged and wearied by democracy’s follies, and in the reminder that democracy’s survival rested ultimately in the hands of citizens who saw something in democracy worth dying for. We could use that reminder again today.” [7]

Dr. Guelzo is quite correct. Many people in this country and around the world are having grave doubts about our democracy. I wonder myself, but I am an optimist, and despite my doubts, I have to believe that we will eventually recover.

Admittedly, that is an act of faith based on our historical resiliency, and ability to overcome the stupidity of politicians, pundits and preacher, including the hate filled message of Donald Trump and his White Supremacist supporters, especially supposedly “conservative ” Christians. That doesn’t mean that I am not afraid for our future, or that despite my belief that our institutions will hold. Historian, Timothy Snyder correctly noted:

“The European history of the twentieth century shows us that societies can break, democracies can fall, ethics can collapse, and ordinary men can find themselves standing over death pits with guns in their hands. It would serve us well today to understand why.”

The amazing thing during the Civil War was that in spite of everything, the Union survived. Lincoln was a big part of that. His steady leadership and unfailing resolve help see the Republic through manifold disasters.

But, it was the men who left lives of comfort and security to defend the sacred principles of the Declaration, like Joshua Chamberlain, and many others who brought about that victory. Throughout the war, even to the end Southern political leaders failed to understand that Union men would fight and die for an ideal, something greater than themselves, the preservation of the Union and the freedom of an enslaved race. For those men that volunteered to serve, the war was not about personal gain, loot or land, it was about something greater. It was about freedom, and when we finally realize this fact, and take up the cause that they fought and died for, then maybe, just maybe, we can contemplate the real meaning of “that cause for which they gave the last full measure of devotion.d. [8]

Now, I for one do not think that we are currently living up to the ideals enunciated by Lincoln on that day at Gettysburg. I can understand the cynicism disillusionment of Americans, as well as those around the world who have for over 200 years looked to us and our system as a “city set on a hill.” That being said, when I read these words and walk the hallowed ground of Gettysburg, I am again a believer. I believe that we can realize the ideal, even in our lifetime should we decide to again believe in that proposition and be willing to fight, or even die for it. Of course, it is quite possible that we will not measure up to the example set by Lincoln and the men who fought for the Union at Gettysburg. If we don’t, The blame will be upon all of us.

So, have a great day and please stop to think about how important Lincoln’s words remain as we wait to see what the next day of Trump’s America brings. This is important because Trump and his supporters respect tyrants like King George III, as his supporters like Attorney General William Barr have said that the Colonialists revolted against the Parliament, not the King. To make that argument one has to ignore the Declaration of Independence in its entirety and declare that Trump is King, and that his word is law.

That cannot be allowed to happen, and I will be damned if I allow that happen without speaking out.
