When Political Parties Implode, Pt 4: The Secession Crisis

Over the past six months or so I have alluded to events in the Republican Party that make it appear that it is about to implode. I am a historian, and there is precedent in American history for the collapse of a national political party. This happened before in the 1854 collapse of the Whig Party, the 1912 division in the republican Party, but more importantly during the 1858 through 1860 collapse of the Democratic Party. Now I am not a person to say that history repeats itself. there are similarities and trends, but nothing is ever exactly the same as to why different parties collapse.  

While the issues of each day may be different there are common threads of humanity, hubris and hatred that unite to destroy political parties. I think that this is happening now in the Republican Party, and that it is possible that something similar may occur with the Democratic Party in the coming years. So it is important to look at history whenever possible to see how different political leaders responded in times of intense ideological, economic, social, national, and sectional division.

I decided to add an afterward to the three part series on the disaster that the Democratic Party made for itself and the country between 1858 and 1860. The third part deals with the after effects of results of the democratic Party split in the election of 1860. This deals with the secession crisis that enveloped the nation as former Southern Democrats led their states into rebellion against the Union and Northern Democrats joined the anti-secession party in the North.

After the election Lincoln tried to reassure the South that he would remain true to his campaign promise not to interfere with slavery where it already existed, but he also refused to give in to threats of secession. Despite his belief that anything that he said would be twisted into the exact opposite by Southerners, Lincoln released a statement through Senator Lyman Trumbull in Springfield saying:

“The states will be left in complete control of their affairs and property within their respective limits as they have under any administration. I regard it as extremely fortunate for the peace of the whole country, that this point, upon which the Republicans have been for so long, as so presently misrepresented, is now brought to a practical test, and placed beyond the possibility of doubt. Disunionists per se, are now in hot haste to get out of the Union, precisely because they perceive they cannot, much longer, maintain apprehension among the southern people that in their homes, and firesides, and lives, are to be endangered by the action of the Federal Government.” [1]

On his way to Washington D.C. the President Elect stopped in New York and gave a speech “promising that he would “never of his own volition “consent to the destruction of this Union,” he qualified this promise with “unless it were that to be that thing for which the Union itself was made.” [2] Two days later Lincoln speaking Independence Hall in Philadelphia Lincoln further detailed what he meant in New York, going back to the premise of the Declaration of Independence in which “he asserted that he “never had a feeling politically that did not spring from the sentiments embodied in the Declaration…. I was not the mere matter of separation of the colonies from the mother land; but rather something in that Declaration” that provided “hope for the world for all future time. It was that which gave promise that in due time the weights should be lifted from the shoulders of all men, and that all should have an equal chance.” [3] It was a thought that he would continue to refine in the Emancipation Proclamation Gettysburg Address, the Thirteenth Amendment and in his Second Inaugural Address.

Stephen A. Douglas tried to reassure the Southern leaders as well even as argued against secession. He reminded Southerners how he had fought against Lincoln and the platform of the Republican Party and stated “that the mere election of any man to the Presidency does not furnish just cause for dissolving the Union.” [4] Addressing Southern concerns in a pragmatic way, the Little Giant tried to diffuse Southern fears by reminding them that the answer to their fears lay in the checks and balances laid out in the Constitution and in the ballot box. Douglas’s next words redound to the present day:

“It is apprehended that the policy of Mr. Lincoln and the principles of his party endanger the peace of the slaveholding states. Is that apprehension founded? No, it is not. Mr. Lincoln and his party lack the power, even if they had the disposition, to disturb or impair the rights and institutions of the South. They certainly cannot harm the South under existing laws. Will they have the power to repeal or change these laws, or to enact others? It is well known that they will be a minority in both houses of Congress, with the Supreme Court against them. Hence no bill can pass either house of Congress impairing or disturbing these rights or institutions of the southern people in any manner whatever, unless a portion of southern senators and representatives absent themselves so as to give an abolition majority in consequence of their actions.

In short, the President will be utterly powerless to do evil…. Four years shall soon pass, when the ballot box will furnish a peaceful, legal, and constitutional remedy for the evils and grievances with which the country might be afflicted.” [5]

An attempt in Congress led by President James Buchanan and Senator John J. Crittenden of Kentucky to bring about a constitutional compromise to mollify both sides was considered. A committee of thirteen senators was convened to entertain various compromise propositions, however, most of the suggested compromises were heavily weighted toward Southern interests, though it promised to restore the prohibition of slavery north of the line drawn in the Missouri Compromise.

A frustrated Lincoln wrote, “I’ll tell you now what bothered me: the compromises measures introduced in Congress required the Republicans to make all the concessions.” [6] Lincoln warned Crittenden that such proposals would not be acceptable: “Entertain no proposition for a compromise in regard to the extension of slavery…. The instant you do they have us under again…. The tug has to come & better now than later.” [7]

Lincoln had seen how for four decades Southerners had pushed for compromises that only benefited them and the extension of slavery, even at the expense of Northern states rights and he was not about to let it happen again. The President Elect wrote:

“The Crittenden plan, I feared, would put the country back on the high road to a slave empire. Whether it was the revival of the Missouri Compromise line or a popular sovereignty, it was all the same. “Let neither be done,” I warned Republicans in Washington, “and immediately filibustering and extending slavery recommences. Within a year, we shall have to take Cuba as a condition on which the South will stay in the Union. Next it will be Mexico, then Central American. On the territorial question, I am inflexible. On that point hold firm as a chain of steel…” [8]

In the South the efforts of staunch Southern Unionists like Alexander Stephens to discourage secession were dismissed as the movement toward secession became a passion filled revolutionary movement, which acted as a cathartic movement for many Southerners. Like Douglas, Stephens had the greatest faith in the checks and balances provided in the Constitution and he pleaded with his fellow Georgians at the state capital of Milledgeville noting that the checks and balances “would render Lincoln “powerless to do any great mischief,” and he warned that “the dissolution of the Union would endanger this “Eden of the world,” that “instead of becoming gods, we shall become demons, and no distant day commence cutting one another’s throats…” [9] While his speech received favorable coverage in the North and even in London, it was met with little enthusiasm at home.

Influential Southern preachers joined in the push for secession and warned of what they saw as the dire consequences of Lincoln’s election. The Baptist clergyman James Furman expressed the outrage and paranoia of many in the South by warning after Lincoln’s election “If you are tame enough to submit, Abolition preachers will be at hand to consummate the marriage of your daughters to black husbands.” [10] Likewise entire southern denominations began to endorse secession, southern Methodists raised “alarms about a Union dominated by abolitionists as they called on the Lord for deliverance from the northern “Egypt.” The division of Israel and Judah (not to mention the nation’s already fractured churches0 became typologies for the American crisis. Just as southern Methodists had once “seceded from a corrupt church,” a Mississippi politician declared, “We must secede from a corrupt nation.” To drive the point home, Georgia Methodists ministers endorsed disunion by an overwhelming 87-9 vote.” [11]

Despite Lincoln and Douglas’s efforts during and after the election to strike a conciliatory tone, it did not take long before Southern states began to secede from the Union. In light of the profoundly sectional nature of Lincoln’s victory “emboldened many Southern politicians and journalists to insist that they would not be bound by the result.” [12] In his final speech before the Senate, Senator Robert Toombs of Georgia lambasted the “black Republicans” and abolitionists, “We want no negro equality, no negro citizenship, we want no negro race to degrade our own; and as one man [we] would meet you upon the border with the sword in one hand and the torch in the other.” [13] Other Senators, many who would become prominent leaders of the Confederacy made their speeches, some, like that of Jefferson Davis tinged with regret while others like Senator Stephen Mallory, and the future Secretary of the Navy for the Confederacy delivered a fiery broadside against his Northern colleagues, “You cannot conquer us. Imbue your hands in our blood and the rains of a century will not wipe away from them stain, while the coming generation will weep for your wickedness and folly.” [14] As these men finished the left the chambers of Congress where many had served for years many left with tears, while some marked their exit with angry words.

Stephens, still a Unionist at heart lamented the election even as he prepared to leave the Senate before becoming the vice president of the Confederacy, warned that “revolutions are much easier started than controlled, and the men who begin them [often] …themselves become the victims.” [15] Even so the senator noted “If the policy of Mr. Lincoln and his Republican associates be carried out…no man in Georgia will be more willing or ready than myself to defend our rights, interest, and honor at every hazard and to the last extremity.” [16] But as he resigned his office Stephens replied to a friend’s question, “why must we have civil war?”

“Because there are not virtue and patriotism and sense enough left in the country to avoid it. Mark me, when I repeat that in less than twelve months we shall be in the midst of a bloody war. What will become of us then God only knows.” [17]

But Stephens’ warning fell on deaf ears as passionate secessionist commissioners went throughout the South spreading their message of fear. “Thus fanned, mob spirit ran close enough to the surface to intimidate many moderates – the very temperament that inclines men toward moderation is apt to respond timidly when threatened or abused – and to push others closer to the extremist position.” [18] Such was the case with Southern moderates and Unionists as men like Stephens were swept up in the tumult as their states seceded from the Union. Senator Judah P. Benjamin of Louisiana wrote, “The prudent and conservative men South… were not able to stem the wild torrent of passion which is carrying everything before it…. It is a revolution…of the most intense character…and it can no more be checked by human effort, for the time, than a prairie fire by a gardener’s watering pot.” [19]

The Palmetto State of South Carolina was the first state to secede. Its senior senator, James Chesnut launched a fusillade against the North in a speech before the state legislature in which he argued that the South could not wait for another election: He thundered:

“Because of the Yankee puritans’ invasive mentality, incendiary documents would flood our region, Southern Republicans would fill our offices. Enemies would control our mails. The resulting upheaval would make “Lincoln’s election…a decree for emancipation. Slavery cannot survive the four years of an administration whose overwhelming influences” will be “brought to bear against it.” To submit now is to guarantee that before 1865, we must “slay the Negro, or ourselves be slain.” [20]

William Tecumseh Sherman was serving as the President the Louisiana State Seminary of Learning and Military Academy, what is now Louisiana State University. Like many men in the ante-bellum era, Sherman had thought little about the slavery issue, though he was very concerned with the preservation of the Union. He thought secession made no sense, especially for the people of the South. When Sherman read the news of South Carolina’s secession it “cut to the depths of his nationalistic soul.” The future general wept, and told his friend David Boyd “Boyd, you people of the South don’t know what you are doing! You think you can tear to pieces this great union without war…. “The North can make a steam-engine, locomotive, or railway car; hardly a yard of cloth or shoes can you make. You are rushing into war with one of the most powerful, ingeniously mechanical and determined people on earth…. You are bound to fail. Only in spirit and determination are you prepared for war.” [21] Sherman, the man who later proclaimed that “War is Hell” proved to be a remarkably accurate seer regarding the fate of the Confederacy.

South Carolina was followed by Mississippi, Florida, Alabama, Georgia, Louisiana and Texas. “A belt of seven states from South Carolina to Texas, embracing nearly one-sixth of the country’s population and nearly one-fifth of the national domain, had proclaimed independence and severed its ties with the Union.” [22] Many of the declarations of causes for secession made it quite clear and explicit that slavery, and fear that the institution was threatened by Northern abolitionists was the root cause. The declaration of South Carolina is typical of these and is instructive of the basic root cause of the war:

“all the States north of that line have united in the election of a man to the high office of President of the United States, whose opinions and purposes are hostile to slavery. He is to be entrusted with the administration of the common Government, because he has declared that that “Government cannot endure permanently half slave, half free,” and that the public mind must rest in the belief that slavery is in the course of ultimate extinction.” [23]

Throughout the war slavery loomed large, even though in the beginning of the abolition controversies of the 1830s many northerners “were content to tolerate slavery’s indefinite survival in the South so long as it did not impinge on their own rights and aspirations at home.” [24] Such attitudes were still common in the North during the late 1850s, especially among Democrats.

But it was the continued actions and multiple transgressions of slavery supporters that energized northerners as never before. Their use of the courts to advance their rights and the cause of slavery, by the compromises that had extended slavery to the territories; their use of the courts especially the Dred Scott to allow slaveholders to recover their human property, even in Free States provoked no end of indignation throughout the North, even for those sympathetic to Southern concerns. Those actions demonstrated to Northerners:

“just how fundamental and intractable the differences with Southern political leaders were. Thus educated, most northern voters had decided by 1860 that only an explicitly anti-slavery party could protect their interests.” [25]

The fiery abolitionist and profoundly religious editor of The Liberator, William Lloyd Garrison, used biblical imagery in a rather astute analysis of the behavior of Southern leaders after the election of 1860. He wrote of the Southern response to Lincoln’s election:

“Never had the truth of the ancient proverb “Whom the gods intend to destroy, they first make mad” been more signally illustrated than in the condition of southern slaveholders following Lincoln’s election. They were insane from their fears, their guilty forebodings, their lust for power and rule, hatred of free institutions, their merited consciousness of merited judgments; so that they may be properly classed as the inmates of a lunatic asylum. Their dread of Mr. Lincoln, of his Administration, of the Republican Party, demonstrated their insanity. In vain did Mr. Lincoln tell them, “I do not stand pledged to the abolition of slavery where it already exists.” They raved just as fiercely as though he were another John Brown, armed for southern invasion and universal emancipation! In vain did the Republican party present one point of antagonism to slavery – to wit, no more territorial expansion. In vain did that party exhibit the utmost caution not to give offense to any other direction – and make itself hoarse in uttering professions of loyalty to the Constitution and the Union. The South protested that its designs were infernal, and for them was “sleep no more!” Were these not the signs of a demented people?” [26]

But both sides were blind to their actions and with few exceptions, most leaders, especially in the South badly miscalculated the effects of the election of 1860. The leaders in the North did not realize that the election of Lincoln would mean the secession of one or more Southern states, and Southerners “were not able to see that secession would finally mean war” [27] despite the warnings of Alexander Stephens to the contrary. In fact throughout the South it was believed that there would be no war because “they believed that the Yankees were cowards and would not fight”… “Senator James Chesnut of South Carolina offered to drink all the blood shed as a consequence of secession. It became a common saying in the South during the secession winter that “a lady’s thimble will hold all the blood that will be shed.” [28]

Following their secession the five slave states of the lower South: “appointed commissioners to the other slave states, and instructed them to spread the secessionist message across the entire region. These commissioners often explained in detail why their states were exiting the Union, and they did everything in their power to persuade laggard slave states to join the secessionist cause. From December 1860 to April 1861 they carried the gospel of disunion to the far corners of the South.” [29]

The editors of the Philadelphia Press accused the Southern secessionists of being enemies of democracy and wrote:

“should the Cotton States go out in a body, we shall witness the beginning of an experiment to establish, on this continent, a great slaveholding monarchy. With few exceptions, the leaders of the Disunion cabal are men of the most aristocratic pretensions – men who…easily adopt the habits and titles of the European nobility. South Carolina, which is the head of Secession, is almost a monarchy herself. Her representatives in both branches of Congress, for years past, have acted upon the idea that the people of the free states are servile, and Mr. Hammond, the most candid and straightforward of the set, denounced the laboring white masses of the free States as the mudsills of society …” [30]

The mood of the South in the fall of 1860 was “fearful, uncertain, impatient and volatile, eager to adopt the course that best offered hope of deliverance – which was ideally suited for the immediacy and urgency of the radical secessionists.” [31] Using the political machinery of the Democratic Party in the South which they now possessed, the proponents of secession were far better organized than Southern Unionists who had a difficult time putting up a united front in the face of the radicals.

Slavery and the superiority of the white race over blacks were at the heart of the message brought by these commissioners to the legislatures of the yet undecided states. Former Congressman John McQueen of South Carolina wrote to secessionists in Virginia “We, of South Carolina, hope to greet you in a Southern Confederacy, where white men shall rule our destinies, and from which we may transmit our posterity the rights, privileges and honor left us by our ancestors.” [32] In Texas McQueen told the Texas Convention: “Lincoln was elected by a sectional vote, whose platform was that of the Black Republican part and whose policy was to be the abolition of slavery upon this continent and the elevation of our own slaves to an equality with ourselves and our children.” [33] These Southern secessionists were realists, they knew that the election of 1860 was a watershed in terms of the history of slavery in the United States, emancipation was coming, it might take a decade, it might take twenty-five or even fifty years, but they knew that it was coming, and for them secession was the only logical action left that was “consistent with their ideology.” [34] Many of these men now viewed it as an issue of now or never.

In his First Inaugural Address Lincoln cut to the heart of the division in the country: “One section of our country believes slavery is right and ought to be extended, while the other believes it is wrong and ought not to be extended. This is the only substantial dispute.” [35] Of course he was right, and his Southern opponents agreed. Jefferson Davis wrote: “The great northern party, thus organized, succeeded in electing to the office of the Presidency a man who openly proclaimed his hatred of slavery, who declared that the government could not endure “half slave and half free.” [36]

As the war began, white Southerners of all types and classes rallied to the call of war against the hated Yankee. The common people, the poor yeomen farmers were often the most stalwart defenders of the South. With the Orwellian slogan “Freedom is not possible without slavery” ringing in their ears, they went to war against the Yankees alongside their slave-owning neighbors to “perpetuate and diffuse the very liberty for which Washington bled, and which the heroes of the Revolution achieved.” [37]

Alexander Stephens, the longtime friend of Lincoln who had been a devout Unionist, who had supported Stephen Douglas until the bitter end, and who had strenuously opposed secession in the months leading to the election of 1860 was now the Vice President of the Confederacy. He had been elected Vice President the same day as Jefferson Davis was elected President by the new Confederate Congress and now went through the South speaking about the nature of the new government. Stephens explained the foundations of the Southern state in his Cornerstone Speech of March 21st 1861, the speech echoed what many Southerners had believed for years regarding slavery and the status of Blacks, namely that Blacks were a lesser order of humanity:

Our new government is founded upon exactly the opposite idea; its foundations are laid, its corner- stone rests upon the great truth, that the negro is not equal to the white man; that slavery — subordination to the superior race — is his natural and normal condition. [Applause.] This, our new government, is the first, in the history of the world, based upon this great physical, philosophical, and moral truth.” [38]

Jefferson Davis had issued instructions to cabinet members to downplay slavery as an issue and was infuriated. The new President of the Confederacy wrote: “That speech infuriated me, Oh, what Stephens had said was true, perfectly true, but could anything hurt us more abroad than such impolitic remarks? It was the beginning of a fatal falling out between me and that rebellious and vindictive dwarf, who was hell-bent on forming his own policies and disputing mine with niggardly deviousness.” [39]

The Orwellian definition of slavery as being necessary to liberty and the Confederate leader’s proclamations that they were comparable to the founding fathers was condemned throughout the North. The editors of the New York Evening Post wrote:

“The founders fought to “establish the rights of man… an principles of universal liberty.” The South was rebelling “not in the interest of general humanity, but of a domestic despotism…. Their motto is not liberty, but slavery.” Thomas Jefferson’s Declaration of Independence spoke for “Natural Rights against Established Institutions,” added the New York Tribune, while “Mr. Jeff. Davis’s caricature thereof is made in the interest of an unjust, outgrown, decaying institution against the apprehended encroachments of human rights.” It was, in short, not a revolution for liberty but a counterrevolution “reversing the wheels of progress…. to hurl everything backward into deepest darkness… despotism and oppression.” [40]

Virginia’s Ordinance of Secession

Secession commissioners from the first seven Confederate States fanned out to the undecided Slave states to spread the message of secession. One of these men was Henry Benning of Georgia. Benning spoke to the secession convention of Virginia, a state that the new Confederacy deemed all-important to its cause and which it had to have on its side in the coming confrontation with the Union. There the Georgia Supreme Court Justice used the time-honored method of racial fear mongering to sway the men of the Virginia House of Delegates, he thundered:

“If things are allowed to go on as they are, it is certain that slavery is be abolished except in Georgia and the other cotton States, and…ultimately in these States also,” Benning insisted. “By the time the North shall have attained the power, the black race will be a large majority, and we will have black governors, black legislatures, black juries, black everything.” [41]

Not letting up the fiery Georgian told the Virginians that the North would invade the South to end slavery and of the outcome of such an invasion:

“We will be overpowered and our men compelled to wander like vagabonds all over the earth,” he told his audience, “and for our women, the horrors of their state cannot contemplate in imagination.” This then, was “the fate that Abolition will bring upon the white race….We will be exterminated.” [42]

Virginia’s Governor, John Letcher was “a longtime foe of secession and had wanted to bring slavery to an end in Virginia, but once elected to the governorship he adroitly put all that behind him, and rather like [Robert E.] Lee, he went to work with considerable efficiency for two causes in which he did not believe.” [43] One Unionist delegate to the convention wrote of the proceedings, “The scenes witnessed within the wall of that room…have no parallel in the annals of ancient or modern times. On the morning of the 17th, Mr. Wise rose from his seat and drawing a large Virginia horse-pistol from his bosom laid it before him and proceeded to harangue the body in the most violent and denunciatory manner. He concluded by taking his watch from his pocket and, with glaring eyes and bated breath, declared that events were now transpiring which caused a hush to come over his soul.” [44] Those events were a planned seizure of Federal facilities including the arsenal at Harpers Ferry and the Naval Yard at Norfolk. But not all in Virginia were convinced. The strongly Unionist western counties of the state, where few people owned slaves and those who did held very few, voted heavily against secession. The counties withstood the initial shock of secession and would “in a wholly extra-legal way, abetted by Washington – perform its own act of secession, breaking away from Virginia and clinging to the Union as a bob-tailed but finally acceptable new state.” [45]

Former President John Tyler added his voice to the secession cause in Virginia and “personally drafted a document placing the state’s military force under Jefferson Davis’s direct command.” Shortly thereafter he was “elected to the Confederate Congress – becoming the only former President to win office in a foreign country.” [46] However, before he could take office, the former President, now an intractable enemy of the country that he once led, died in Richmond. Shortly thereafter his portrait was removed from its place of honor in the capital.

Tennessee was another state where secession was problematic. Eastern Tennessee was strongly Unionist and the counties “held a convention, denounced the governor and legislature for making the alliance with the Confederacy, and sent a memorial asking that the eastern counties be allowed to form a new state.” [47] The legislature and governor refused this but the area would prove a problem for Jefferson Davis as well as Lincoln who would have liked to help the Tennessee Unionists, but had no military way to do so.

The highly divided border states of Kentucky and Missouri remained in the Union, but became highly partisan battlegrounds between secessionists and Unionists in which insurgents used terrorist methods against their fellow citizens throughout the war. Kentucky’s pro-secession Governor, Beriah Magoffin called the legislature into convention to decide secession “but the legislature, by a vote of 54 to 36 in the lower house, refused to call one and adjourned on February 11 without taking any decisive action.” [48] Losing that vote, he issued a declaration of neutrality which caused both Lincoln and Jefferson Davis to move with caution in the state. Lincoln understood the strategic importance of Kentucky and said “I think to lose Kentucky is nearly the same as to lose the whole game….Kentucky gone, we cannot hold Missouri, nor, as I think, Maryland. These all against us, and the job on our hands is too large for us. We may as well consent to separation at once, including the surrender of this capital.” [49] Lincoln’s use of caution, diplomacy, and when needed the force of the law, courts, and the military paid strategic military and economic dividends for the North as the Ohio River remained under Union control.

Maryland too remained in the Union as Governor Thomas H. Hicks, with the help of federal troops resisted a call in the legislature for a secession vote, even so as Union volunteers marched to Washington in response to Lincoln’s calls for troops some regiments were attacked in Baltimore. The 6th Massachusetts Volunteer Infantry was set upon as a “crowd of southern sympathizers threw bricks and stones and fired into their ranks as they changed trains. They returned the fire, killing twelve citizens and wounding many more, then packed their four dead on ice for shipment north, and came on to Washington, bearing their seventeen wounded on stretchers.” [50]

To Lincoln, the issue of secession as well as territory was “never just about politics. To him it spoke about the nation, even if primarily as a symbol. In his mind the nation must be about freedom, never slavery.” [51] For him the Union was sacred and could not be dissolved for any reason, especially the cause of slavery. In contrast to the secessionists who proclaimed that the states had formed the Federal Government and had the right to dissolve the Union, Lincoln, using the reasoning and arguments of Daniel Webster asserted in his inaugural address that the Union actually predated the Constitution:

“Descending from these general principles, we find the propositions that, in legal contemplation, the Union is perpetual, confirmed by the history of the Union itself. The Union is much older than the Constitution. It was formed, in fact, by the Articles of Association in 1774. It was matured and continued by the Declaration of Independence in 1776. It was further matured, and the faith of all the then thirteen States expressly plighted and engaged that it should be perpetual, by the Articles of Confederation in 1778. And final, in 1787, one of the declared objects for ordaining and establishing the Constitution, was “to form a more perfect Union.” [52]

In early April 1861, a few days before the first shot was fired at Fort Sumter, a New York Times editorial made a proposition that unveiled the reality of the situation now confronting the divided nation, and which so many had for so long refused to face: “If two sections can no longer live together, they can no longer live apart in quiet until it is determined which is master. No two civilizations ever did, or can, come into contact as the North and South threaten to do, without a trial of strength, in which the weaker goes to the wall…. We must remain master of the occasion and the dominant power on this continent.” [53]

Thus, the American ideological war was born; it had taken decades to reach the point of no return. It had taken years of frustration, and attempts at compromise by politicians who attempted to dodge the moral issues inherent in slavery. Time could not heal the wounds caused by slavery as long as “one section of the country regarded it as a blessing, the other as a curse.” [54] Frederick Douglass observed: “Whatever was done or attempted with a view to the support and secularity of slavery on served to fuel the fire, and heated the furnace of [anti-slavery] agitation to a higher degree than had any before attained.” [55]

When Political Parties Implode, Pt 2: The 1860 Democratic Convention

Over the past six months or so I have alluded to events in the Republican Party that make it appear that it is about to implode. I am a historian, and there is precedent in American history for the collapse of a national political party. This happened before in the 1854 collapse of the Whig Party, the 1912 division in the republican Party, but more importantly during the 1858 through 1860 collapse of the Democratic Party. Now I am not a person to say that history repeats itself. there are similarities and trends, but nothing is ever exactly the same as to why different parties collapse.  

While the issues of each day may be different there are common threads of humanity, hubris and hatred that unite to destroy political parties. I think that this is happening now in the Republican Party, and that it is possible that something similar may occur with the Democratic Party in the coming years. So it is important to look at history whenever possible to see how different political leaders responded in times of intense ideological, economic, social, national, and sectional division.

This is a three part series on the disaster that the Democratic Party made for itself and the country between 1858 and 1860. This second part deals with the after effects of the Lecompton Constitution fiasco during the 1860 Democratic Party Conventions in Charleston and Baltimore.

The fight over Lecompton was a watershed in American politics that those who wrote the Constitution of the United States could not have imagined. The deeply partisan fight served to illuminate how easily “minuscule minorities’ initial concerns ballooned into unmanageable majoritarian crises. The tiny fraction of Missouri slaveholders who lived near the Kansas border, comprising a tinier fraction of the South and a still tinier fraction of the Union, had demanded their chance to protect the southern hinterlands.” [1] The crisis that Kansas Democrats provoked drew in the majority of Southern Democrats who came to their aid in Congress and President Buchanan. This provoked Northerner, including Democrats to condemn the Southern minority, which they believed was disenfranchising the majority of people in the territory in order to expand slavery there and to other territories in the west.

The issue of Lecompton crisis galvanized the political parties of the North and demolished any sense of national unity among the Democrats. The split in the Democratic Party mirrored the national divide and the party split into hostile Northern and Southern factions, which doomed it as a national party for the foreseeable future.

Following Lecompton the intra-party Democrat divide widened as “Pro-Douglas and pro-Buchanan Democrats openly warred on one another for the next two years; an unacknowledged but real split had taken place.” [2]

The battle over the Lecompton Constitution also marked the first time that a coalition Northern Democrats sided with anti-slavery forces to defeat pro-slavery legislation in congress. Though the measure to admit Kansas as a slave state was defeated it was a narrow victory; the “Republicans and anti-Lecompton Douglas Democrats, Congress had barely turned back a gigantic Slave Power Conspiracy to bend white men’s majoritarianism to slavemaster’s dictatorial needs, first in Kansas, then in Congress.” [3]

The political impact of the Lecompton crisis on the Democratic Party was an unmitigated disaster. The party suffered a major election defeat in the 1858 mid-term elections and lost its majority in the House of Representatives even though it barely maintained a slim majority in the Senate. While the victorious Republicans had won the election, they made little legislative headway since the Democrats still controlled the Senate and James Buchanan remained President. In a sense “there were two Democratic parties: one northern, on southern (but with patronage allies in the north); one having its center of power in the northern electorate and in the quadrennial party convention… the other with its center of power in Congress; one intent on broadening the basis of support to attract moderate Republicans, the other more concerned to preserve a doctrinal defense of slavery even if it meant driving heretics out of the party.” [4] Democratic Party divide fulfilled what Lincoln had said about the country, as the Democratic Party had “became increasingly a house divided against itself.” [5]

Douglas’s courageous opposition to the fraud of Lecompton would be the chief reason for the 1860 split in the Democratic Party as Southern Democrats turned with a vengeance on the man who had been their standard bearer during the 1856 Democratic primary. “Most southern Democrats went to Charleston with one overriding goal: to destroy Douglas.” [6] The party decided to meet in the Charleston to decide on their platform and the man who would be their standard bearer in the election of 1860. When the convention met in April 1860 it rapidly descended into a nightmare for the Democrats as “Southern delegates were much more intent on making a point than on nominating a presidential candidate.” [7] The “Southern delegates demanded a promise of federal protection of slavery in all the territories and a de facto veto in the selection of the party’s presidential candidate” [8] in order to block the nomination of Douglas. Southern radicals “led by William Lowndes Yancey of Alabama stood for seven days agitating for a pro-slavery platform.” [9]

Ohio Democrat George A. Pugh responded to the Southern fire-eaters and said that “Northern Democrats had worn themselves out defending Southern interests – and he declared that the Northern Democrats like himself were now being ordered to hide their faces and eat dirt.” [10] Georgia Senator Alexander Stephens who had moderated his position and was supporting Douglas wrote that the radicals “strategy was to “rule or ruin.” [11] When their attempts to place the pro-slavery measures into the party platform were defeated by Northern delegates, it prompted “a walkout by delegates from Alabama, South Carolina, Georgia, Florida, Mississippi, Louisiana, and Texas.” [12] This deprived Douglass of the necessary two thirds majority needed for the nomination and “the shattered convention adjourned, to reconvene in Baltimore on June 18,” [13] the “incendiary rhetoric left the Democratic Party in ashes.” [14] A friend of Alexander Stephens suggested that the party might patch things up in Baltimore, but Stephens dismissed the suggestion and told his friend, “The party is split forever. The only hope was in Charleston.” [15]

Old line former Whigs who feared the disintegration of the country led by Kentucky Senator John J. Crittenden formed their own convention, the Constitutional Union Party and declared a pox on both the Buchanan and Douglas factions of the Democratic Party. They nominated a rather cold and uninspiring moderate slave owner, the sixty-four year old John Bell of Tennessee as their candidate for President and “then chose a man who overshadowed him, Edward Everett of Massachusetts, aged sixty-seven, as the vice-presidential nominee.” [16] But this ticket had no chance of success, as Bell “stood for moderation and the middle road in a country that just now was not listening to moderates, and the professional operators were not with him.” [17]

When the Democratic Party convention reconvened the results were as Stephens predicted. Another walk out by Southern delegates resulted in another and this time a final split. “Rival delegations from the Lower South States arrived in Baltimore, one side pledged to Douglas and the other to obstruction. When the convention voted for the Douglas delegations, the spurned delegates walked out, this time joined by colleagues from the Upper South.” [18] Though Douglas did not have the two-thirds majority, the convention “adopted a resolution declaring Douglas unanimously nominated.” [19] A day later the radicalized Southern delegates nominated their own candidate, the current Vice President, John C. Breckinridge of Kentucky as their candidate “for president on a slave-code platform.” [20]

There were now four presidential tickets, three composed of Democrats and former Whigs, “each supported by men who felt that they were following the only possible path to salvation. A Republican victory was almost certain, and the Democrats, who had the most to lose from such a victory, were blindly and with a fated stubbornness doing everything they could to bring that victory to pass.” [21]

The Democratic Party had imploded and doomed the candidacies of Douglas and Breckinridge. The Augusta Daily Chronic and Sentinel editorialized, “It is an utterly futile and hopeless task to re-organize, re-unite and harmonize the disintegrated Democratic party unless this is to be done by a total abandonment of principle… No, sensible people might as well make up their minds to the fact that the Democratic party is dissolved forever, that new organizations must take its place.” [22]

Senator Stephen A. Douglas

Kansas was politically divided between two competing legislatures, each which claimed to be the voice of the people. The population of Kansas was heavily anti-slavery, in fact slaveholders and their supporters were a minuscule minority in the territory, but they were both load, and often used violence and intimidation to achieve power. As such many citizens felt disenfranchised by the official legislature, which was “a pro-slavery body elected by fraud in 1855.” [1] This body met in the city of Lecompton. In 1857 the Lecompton legislature sensed the opportunity to have Kansas admitted to the Union as a Slave State. To ease the way for this to happen over the will of the majority this legislature elected slavery supporters to be members of a constitutional convention, the goal of which was to draft a constitution which would be submitted to Congress for the admission of the Kansas Territory to the Union as a Slave State.

Free State partisans in Kansas feared that that if they participated in the election that they would be “gerrymandered, and simply counted out by stuffed ballots,” and most decided to sit out of the election. As a result it was “a quiet election, with many proslavery candidates unopposed and only 2,200 out of 9,000 registered voters going to the polls, a large majority of extreme proslavery men won election as delegates to the constitutional convention in September.” [2] But the result of the election was untenable, for “Two thousand voters in a territory with 24,000 eligible for the franchise had elected a body of delegates whom no one seriously regarded as representative of the majority opinion in Kansas.” [3]

The Lecompton legislature passed the proslavery constitution, but it was vetoed by the outgoing governor, John W. Geary. Geary accused “the pro-slavery legislature of attempting to stampede a rush to statehood on pro-slavery terms,” but his veto was overridden. The constitution had several provisions that most of the population found unacceptable. It protected owners of “the 200 slaves in Kansas, banned free blacks from the state, and prohibited any amendments to the constitution for seven years.” [4] In response the pro-Free State legislature in Topeka issued a referendum in which people voted “10,226 votes to 162 votes” [5] against the pro-slavery measures contained in the Lecompton Constitution. The newly appointed governor of the territory, Robert J. Walker opposed the measure and denounced it “as a vile fraud, a bare counterfeit.” [6] Walker demanded a new, fair, referendum, which the newly elected president James Buchanan, also backed. In response many Southerners in Congress “threatened to secede unless the administration fired Walker and backed down on the referendum issue.” [7] The threat of secession by Southerners in support of the radical minority in Lecompton led to chaos in the Democratic Party which controlled the House, the Senate and held the Presidency.

James Buchanan was a pro-slavery Pennsylvania Democrat who had rode into office on the votes of the South. He was now pressured by Southern legislators to change his position on the Lecompton Constitution. Buchanan’s cabinet, which was heavily Southern, and pro-slavery expansion also used its influence to pressure the president into supporting the plan to admit Kansas as a Slave State. In response to the pressure, Buchanan reversed his previous stance in regard to Kansas and endorsed the bill, and he “called on Congress admit Kansas as a slave state with a constitution (drafted by the proslavery territorial government at Lecompton) that was never approved by Kansas voters and obviously opposed by a majority of them.” [8] The decision by Buchanan tossed aside the doctrine of popular sovereignty which had been key to engineering earlier compromises and in response some Northern Democrats opposed Buchanan.

Buchanan’s patently obvious move to placate the slave states and overturn the restrictions on the expansion of slavery contained in the Missouri Compromise, the Compromise of 1850, and the Kansas-Nebraska Act, provoked a new outcry, this time from Northern members of the Democratic Party. Many Northern Democrats were outraged by Buchanan’s flip-flop and the threats of secession emanating from the South if the measure was not approved. Most of the Northern Democrats were willing to accept and even defend slavery where it existed, but they were opposed to the expansion of slavery. His announcement to the House of Representatives “touched off a twelve-hour donnybrook in February 1858” and “about 50 congressmen in various states of inebriation tangled with each other on the House floor… The rumble subsided only when Mississippi congressman William Barksdale tackled an unidentified assailant as the latter snatched his toupee and waved it about like a captured flag. Barksdale finally retrieved his scalp and plopped it on his head wrong side out, the absurdity of the scene giving the combatant’s pause.” [9] Many Northern Democrats felt betrayed by their president’s actions and rose in opposition to the bill that would admit Kansas as a Slave State. Even so Buchanan was a “skilled political infighter swung a remarkable percentage of Northern Democratic members of the House of Representatives, fully 60 percent, behind the Lecompton Constitution,” [10] but he did not contend with the charismatic power of Stephen Douglas in the Senate.

These Democrats were led by the formidable Senator Stephen A. Douglas. Known as the Little Giant Douglas had skillfully crafted the Compromise of 1850 using the principle of popular sovereignty, led these Democrats in their fight against Buchanan’s acceptance and endorsement of Lecompton. Douglas’s previous actions to support the rights of Slave States had made him a hero in much of the South and his stature in both the North and the South made him the frontrunner to win the Democratic nomination for the presidency in 1860.

But Douglas, who had worked so hard to build compromises that would hold the Union together could not countenance the actions and tactics of the Southern members of his party. Douglas was a political realist and not an ideologue. He was very sympathetic to slave holders and was certainly no supporter of emancipation, in fact the Little Giant was an avowed racist. He was completely convinced “of the inferiority of the Negro, and he had a habit of stating it with brutal bluntness, “I do not believe that the Negro is any kin of mine at all…. I believe that this government of ours was founded, and wisely founded upon white basis. It was made by white men, for the benefit of white men and their posterity, to be executed and managed by white men.” [11] But despite his own racist beliefs Douglas understood the danger that the pro-slavery extremists supporting Lecompton were to the Democratic Party and the nation. Douglas understood that if the bill to admit Kansas as a slave state was passed that it would destroy the unity of the Democratic Party and quite possibly the Union itself.

The Illinois Senator found out about the President Buchanan’s new support of the measure when he read the newspaper. He was outraged when he saw the news in the Washington Union that Buchanan had decided to support Lecompton. He was infuriated and the fury showed when he wrote with characteristic honesty:

“This left no doubt were the old bastard stood. “Can you believe his Goddamned arrogance?” I told a friend. “I run the Committee on Territories. He should have consulted me before approving the Lecompton fraud. He’ll pay for that. By God, sir, I made Mr. James Buchanan, and by God, sir, I’ll unmake him.” [12]

As such, the Little Giant threw caution to the wind and stormed to the White House “to confront Buchanan on the “trickery and juggling of the Lecompton constitution.” He warned the president of that his actions in support of the Lecompton party would “destroy the Democratic party in the North,” and we warned that “if Buchanan insisted on going through with it, Douglas swore to oppose him in Congress.” [13]

It was an epic confrontation. Douglas recalled, “The Lecompton constitution, I told Buchannan bluntly, was a blatant fraud on the people of Kansas and the process of democracy, I warned him not to recommend acceptance of it. With his head titled forward in that bizarre habit of his, he said that he intended to endorse the constitution and send it to Congress. “If you do,” I thundered, “I’ll denounce it the moment that it is read.” His face turned red with anger. “I’ll make Lecompton a party test,” he said. “I expect every democratic Senator to support it.” I will not, sir![14]

Angry and offended by the confrontation of Douglas, Buchanan cut the senator off and issued his own threat to Douglas and his political career saying, “I desire you to remember that no Democrat ever yet differed from an administration of his own choice without being crushed….Beware of the fate of Tallmadge and Rives,” two senators who had gone into political oblivion after crossing Andrew Jackson.” The redoubtable Senator from Illinois was undeterred by the President’s threat and fought back, “Douglas riposted: “Mr. President, I wish to remind you that General Jackson is dead, sir.” [15] It was an unprecedented action by a sitting Senator, to confront a President of one’s own party and threaten to oppose him in Congress was simply not done, but now Douglas was doing it, but doing so to his President’s face, and the consequences for him, his party, and the country would be immense.

Following his confrontation with Buchanan, Douglas was even more determined to defeat the Lecompton party and their brazen attempt to admit Kansas as a slave state over the will of the non-slave majority. In a display of righteous anger Douglas did what few politicians would consider doing in our day and age and “took his political life into his own hands and assailed the Lecompton Constitution on the floor of the Senate as a mockery of the popular sovereignty principle.” [16] President Buchanan and his allies in Congress fought back viciously, so much so that the two sides sometimes came into physical confrontation with each other in the chambers of Congress.

When Buchanan’s supporters pushed for Lecompton’s approval and the admission of Kansas as a Slave State, Douglas fired back, warning “You do,” I said, “and it will lead directly to civil war!” I warned the anti-Lecompton Democrats of the North that the President intended to put the knife to the throat of every man who dared to think for himself on this question and carry out principles in good faith. “God forbid,” I said “that I ever surrender my right to differ from a President of the United States for my own choice. I am not a tool of any President!” [17]

Under Douglas the Northern Democrats joined with Republicans for the first time to defeat the admission of Kansas as a Slave State. Douglas recalled the battle:

“After the Christmas recess, the Administration unleashed its heavy horsemen: Davis, Slidell, Hunter, Toombs, and Hammond, all southerners. They damned me as a traitor and demanded that I be stripped of my chairmanship of the Committee on Territories and read out of the Democratic party. Let the fucking bastards threaten, proscribe, and do their worst, I told my followers; it would not cause any honest man to falter. If my course divided the Democratic party, it would not be my fault. We were engaged in a great struggle for principle, I said, and we would defy the Administration to the bitter end.” [18]

Southern Democrats in Congress fought back furiously. As the battle continued their acrimony towards Douglas grew into apocalyptic proportions and their rhetoric against the Little Giant became more heated. According to his opponents Douglas was “at the head of the Black column…stained with the dishonor of treachery without parallel…patent double dealing…detestable heresies…filth of his defiant recreancy…a Dead Cock in the Pit…away with him to the tomb which he is digging for his political corpse.” [19]

But Douglas was undeterred by the threats to his career made by Buchanan, his congressional opponents and the press. He believed that he was in the right, and though he was in agreement with the philosophy of his opponents regarding slavery as an institution to be protected in the South, he realized that appeasing the South was not an option in regard to Lecompton, since that measure undermined the entire concept of popular sovereignty. He wrote:

“My forces in the House fought a brilliant delaying action while I worked to win over wavering Democrats. When we introduced a substitute bill, Buchannan called a dozen congressmen to the White House and exhorted them not to forsake the administration. He was cursing and in tears. He had reason to be: on April first, a coalition of ninety-two Republicans, twenty-two anti-Lecompton Democrats, and six Know-Nothings sent Lecompton down to defeat by passing the substitute bill. This bill provided for a popular vote on the Lecompton constitution and for a new convention if the people rejected that document, as they surely would.” [20]

The substitute bill was passed by the Senate as well and sent back to Kansas for a popular vote. When the Lecompton Constitution was resubmitted to the people of Kansas for a vote, the results of the referendum were devastating to the pro-slave faction, and “to the hideous embarrassment of Buchanan, the voters of Kansas turned on August 30th and rejected Lecompton by a vote of 11,812 to 1,926.” [21] The ever colorful and blunt Little Giant wroteThe agony is over,” cried one of my aides, “and thank God that the right has triumphed. Poor old Buck! Poor old Buck had just had his face rubbed in shit. By our “indomitable courage, “ as another aide put it, we’d whipped this “powerful and proscriptive” Administration and forced the Black Republicans to support a substitute measure which fully embodied the great principles of the Kansas-Nebraska Act.” [22] The victory of Douglas and his faction over the Buchanan faction in the Lecompton fight “ended a political battle which had convulsed the country and virtually destroyed two administrations, but the full consequences of the prolonged struggle had yet to become evident.” [23]

Pro-slavery Southerners were outraged and Buchanan used every measure that he could to crush the anti-Lecompton Democrats, but he had lost “one of the most vicious struggles in the history of Congress, Southern Democrats had seriously damaged the patience of their Northern counterparts, and Buchanan loyalists in the North were unseated wholesale by upstart Republicans in the 1858 congressional elections.” [24] Buchanan’s Presidency was discredited, his party divided, its majority in congress lost, and the South moving closer to secession. Southerners considered Douglas a traitor and accused him of betraying them. “A South Carolinian lamented that “this defection of Douglas has done more than all else to shake my confidence in Northern men on the slavery issue, for I have long regarded him as one of our safest and most reliable friends.” [25]

The Sickles Trial

I am a historian as well as a chaplain and priest. I do a lot of work with the Battle of Gettysburg and much of my work involves biography as I believe that the one constant in history is people. Technology and many other things may change, but people and human nature are constant, for good and for bad, and frankly I find people fascinating.

One of the most fascinating people of the Battle of Gettysburg is Union Major General Daniel E. Sickles, a man who was one of the most fascinating, salacious, scandalous, and incredible figures ever to grace and disgrace American history.

This is the second of a multi-part series taken from my Gettysburg and Civil War text. It deals with one of the most memorable trials in American History. I hope that you enjoy.

The stage was now set for the one of the most unbelievable and storied trials in American history, a trial that would have been much more suited to the era of 24/7 cable news coverage and the Internet than the era of the telegraph and newspaper, but even so it was sensational by any standard and it riveted the attention of the public in every part of the nation, from the largest cities to the smallest towns.

Almost immediately swarms of journalists were camped outside the prison and Sickles’ house where distraught Teresa sought a way to gain Dan’s forgiveness having received his broken wedding band which he sent to her from the jail. Witnesses to her dalliances with Key at the 15th Street house and other venues were brought to the Stockton Mansion to identify her. “She was the meat in the market, the ogre at the carnival. A little way across the square, souvenir hunters were cutting fragments of wood out of the tree by which Key had fallen, and artists from the illustrated papers set up their easels and began sketching every aspect of the area – the railings, the Stockton Mansion, the Clubhouse.” [1] A Presbyterian pastor who knew the couple found her obsessed by the shame that she had brought upon herself and her daughter, and he “found her in such mental agony that he feared for her sanity and even felt that she might try to take her life.” [2]

It was a credit to her own emotional strength that Teresa survived the ordeal that she had helped to bring about, and which she found herself blamed for, even by her father, who felt that she had dishonored the Bagioli family name. Antonio Bagioli wrote to Dan in prison, “You have heaped on my child affection, kindness, devotion, generosity. You have been a good son, a true friend, and a devoted, kind, loving husband and father.” [3] Of all the commentators, it was the eminent historian and diplomat George Bancroft who seemed to have any “sense of Teresa’s pain: “Poor child, what a cruel thing to deprive her of her sole stay and support. Key was the only man she could look to for sympathy and protection.” [4]

After Barton Key’s lifeless body was borne off in a mahogany casket to the Presbyterian cemetery in Baltimore and buried in the grave of his dead wife, and his children placed in the care of his family, his effects, what they amounted to, including his resplendent Montgomery Guards uniform were “sold off to a morbid, bargain-hunting, souvenir-hounding crowd.” [5] It was an ignoble end to the scandalous story of the son of Francis Scott Key, a story that soon with all of its salacious detail would be revealed to the public.

Meanwhile, inside the jail her husband, alternating between fits of rage and calm was visited by Washington’s Mayor James Barret, Sam Butterworth, Attorney General Black, Vice President John C. Breckinridge, and Speaker of the House, James Orr. He was comforted by the many expressions of support and sympathy found in scores of letters from people around the country, one of the first “a kindly note from the President,” [6] and others from total strangers. He was also joined by friends and allies from New York and Washington. “James Topham Brady, John Graham, and Thomas Francis Meagher, able lawyers all, arrived post haste to defend their rash ally” [7] as well as his father who before offering encouragement to his son offered a sharp chastisement, “You hot-headed fool! That’s no way to settle things! No woman’s worth it! No matter how you come out of this, you’ve killed your career – White House and everything else.” [8] Undeterred and calm Dan told his father that he understood and that if he had to he would do it again, after which, his father began to discuss the organization of his son’s defense with this legal team.

The case was front page news in all the major newspapers, which provided “extensive coverage of the “Sickles Tragedy.” Sickles’ murder of his friend Key in broad daylight in view of the White House had all of the scandalous elements that have thrilled Americans then and even today: “adultery, politics, celebrity, and a handsome corpse,” [9] not to mention a beautiful young woman who even more than her husband who had killed a man, stood accused in the eye of the public.

Despite the notoriety of the case, many people found sympathy with Sickles and believed that no jury would convict him of murder or manslaughter, after all, Teresa was the one who committed adultery with Key. The New York Herald “doubted that a grand jury would indict him. Even if he were indicted, Harper’s Weekly presumed that no jury would convict him of manslaughter if the adultery charge were proven, which it considered a foregone conclusion.” [10] The New York Times noted well before the trial opened, “there appears to be no second opinion as to the certainty of Mr. Sickles acquittal” but “national interest” arose from “the general desire to see the whole case fairly put, and the million scandals of mystery laid to rest by the plain facts.” [11] Newspapers like the New York Evening Post, his political arch-enemy found the murder an excellent opportunity to attack Sickles, “That wretched man, Daniel E. Sickles, has in his career reached the stage of assassination, and dipped his hands in human blood… It is certain that a man… who in his own practice, regards adultery as a joke and the matrimonial bond as no barrier against the utmost caprice of licentiousness – has little right to complain when the mischief which he carriers without scruple into other families enters his own.” [12] But such commentary was the exception, and it came from the organ of a political enemy. It is an interesting comment on the era, that a woman’s adultery, even when committed by the wife of an adulterous male who had killed her lover, was consider more of a social stigma and crime than murder.

Within days Sickles had assembled one of the most formidable defense teams ever to dominate an American court. Brady, who was considered to be the ablest criminal defense lawyer of his day became the lead attorney for the defense team, and was joined by Sickles’ New York friends, Graham and Meagher. Brady was an excellent choice, he “was admired and even loved by society in general, but on top of that, though his legal repertoire was wide, he had been involved successfully in more than fifty murder cases.” And he “had also made a special study of pleas of insanity,” [13] something that would figure greatly in the trial.

Additionally, President Buchanan helped recruit one of the finest attorneys in the country, the future Secretary of War, Edwin Stanton to the team. They were joined by four lesser known, yet high-powered attorneys; Samuel Chilton a Virginian who later represented John Brown, and his partner Allen Magruder, Daniel Ratcliffe, and Philip Phillips, a former Alabama Congressman and member of Washington’s Jewish community. Additionally, Reverdy Johnson, one of the most respected attorneys of the day served as an occasional advisor. “The Washington Evening Star observed that Sickles was collecting a lot of lawyers for a man whose defenders did not expect to leave their box before acquitting him.” [14]

Sickles’ defense team was a nineteenth century legal Dream Team against which the government deployed but one attorney, Key’s former assistant District Attorney Robert Ould. Ould, described by one of Sickles’ biographers as “a dull bull of a man, at one time a Baptist parson,” [15] had been named acting District Attorney by President Buchanan when Key was killed. It was an odd place for Ould, as he was serving to prosecute his former boss’s killer, at the behest of the President, who happened to be one of the defendant’s best friends. Ould, the former parson “was placed by inference in the unhappy position of defending adultery – something that he indignantly denied, insisting that he was merely prosecuting a killer….” [16] but to many people, the murderer of an adulterer by an aggrieved husband was complete justified. Ould was totally outclassed by the defense team, and Key’s family paid to have John Carlisle a respected Washington attorney to aid Ould in the case, but the trial would prove them appear incompetent and not up to the task of convicting Sickles.

Teresa Sickles Confession on the Front Page of Harper’s Weekly

The defense pushed for a speedy trial and decided, as many lawyers do today, to try the case in the newspapers, which in light of the lurid nature of the story hung on every word coming out of Washington. The defense team pursued the strategy of “entirely reversing the roles of Sickles and Key by putting the dead man on trial for having made a victim of the defendant, and the New York Press prepared the public for just such an emotional appeal.” [17] The news stories printed by papers that supported Sickles as well as those of his detractors helped inflame the public as the newspapers across the country “wherever wires ran, were front-paging the story under screaming headlines and, in larger cities, rushing out extras every hour or two, as fresh details came to hand.” [18] The private affairs of Dan and Teresa Sickles became known around the nation, and even though the judge in the case refused to admit the confessions Sickles had forced from Teresa into evidence they found their way into the papers, some like Harper’s not only ran the text but reproduced the confession in enlarged facsimile form. The question in many people’s mind “was Dan Sickles justified in slaying the man who had betrayed his confidence and seduced his wife?… As a consequence the whole country turned jury.” [19]

The trial began on April 4th, just over a month after the killing and barely a week after the indictment was handed down. The first three days involved jury selection, a task that the defense turned over to Philip Phillips, who sparred with the prosecutor Ould over the twelve men who would eventually sit in judgment of Dan Sickles. Ould attempted to gain a favorable jury by introducing the property qualifications of jurors, he “ruled out jurors who did not meet the requirement of owning property valued at $800. Since this $800 property limit had not been imposed in similar cases, Ould’s insistence on it would attract much scorn from Dan’s lawyers…” [20] Sickles’ team fought back embarrassing Ould in the process, but not getting the judge to change his narrow application of the law to help the defense. Over two hundred potential jurors were examined before twelve unbiased jurors could be found, and a “great majority of those dismissed confess strong prejudice in favor of the prisoner.” [21] When the jury was seated it was composed of twelve men, two farmers, four grocers, a merchant, a tinner, a coach maker, a men’s clothing salesman, a shoemaker, and a cabinetmaker, “but not a single “gentleman” in the occupational sense.” [22]

Ould opened his case, “ponderously, powerfully, in the blackest of terms,” [23] he drew a picture of the killing. He delivered an “emotionally charged argument that Sickles, “a walking magazine,” had taken deliberate care in arming himself against Key, who only had “a poor and feeble opera-glass.” [24] Ould argued “that homicide with a deadly weapon, perpetrated by a party who has all the advantage on his side and with all the deliberate cruelty and vindictiveness, is murder, no matter what the antecedent provocation in the case.” [25] He then called twenty-eight witnesses, the majority of whom had actually witnessed the shooting, but he did not call upon Butterworth, Teresa, or the young White House page boy who had told President Buchanan and been sent away. Likewise he had not established intent, a key factor in any murder trial, nor had he introduced evidence that he had obtained regarding Sickles’ own affairs with women in Philadelphia, Baltimore, and elsewhere. The presentation of the physical evidence of Barton Key’s clothing and the bullet that supposedly killed Key was botched, the bullet that the prosecution claimed to have killed key did not fit either the Derringer, or the Colt revolver. Thus Ould left open for the defense the chance to explore all the salacious details of the case to put Key on trial, and to establish exculpatory reasons why Sickles had killed Key. Ould’s presentation of his case was brief, and so futile “that it seemed that Key was on trial for seduction, not that Sickles was on trial for murder.” [26]

The defense team made mincemeat of the prosecution. John Graham’s opening statement was a work of oratory genius that “would massively outshine Robert Ould’s more cumbersome opening.” [27]Weaving allusions from Shakespeare and other literary greats into his statement, he painted Sickles as the victim of a adulterous rogue who had on a Sunday, a day when he should have “sent his aspirations heavenward,” had instead besieged “that castle where for security and repose the law had placed the wife and children of his neighbor.” [28] Casting Sickles as the aggrieved and temporarily insane victim he also asked if it was a “crime for a husband to defend his family altar.” From there he proceeded to use quotes from Shakespeare’s Othello he inveighs against the adulterer as the supreme criminal, piling up quotation upon quotation from the Old Testament and Roman law to show that in wiser days the punishment invariably was death’” [29] to paint the picture of Sickles’ agony as he saw the man who had defiled his wife prowling outside of his home. Graham then went to provocation and argued that due the circumstance of the crime, a friend and confidant attempting to defile Sickles’ wife on a Sunday that the prosecution “needed to prove Dan’s sanity at the time of the act. And they could not do that, because there was not enough in the case “to melt the heart that is not cut from the unwedgeable gnarled oak.” [30] It was a masterful performance.

Over the next two weeks, Brady, Stanton, and Graham would continue to hammer the prosecution case. The defense proved that Key’s family had tampered with evidence, including testimony from a locksmith who had changed the locks at the 15th Street house at the direction of Key’s family. Witness after witness was introduced to undermine the prosecution and support the defense’s claim that Sickles’ was indeed in a state of uncontrollable madness, and the defense deftly parried the prosecutor’s rebuttal witnesses. When Ould attempted to keep African American witnesses from testifying Stanton, thundered and “accused the prosecution of a “monstrous” attempt to suppress evidence in its zeal of the defendant’s blood,” [31] and argued from North Carolina precedent that the prosecution was not willing to grant Sickles the same right as a slave. As his lawyers argued his case and witnesses gave testimony Sickles maintained his composure except for a number of times when he broke down and had to be excused from the proceedings. “Whether the courtroom histrionics were real or an award-winning performance, the jury witnessed firsthand a husband who was mentally unable to bear his wife with another man.” [32] On the Friday the 22nd of April Judge Crawford declared the testimony closed and the next day began the closing arguments.

Saturday April 23rd dawned with a violent gale, but that did not prevent crowds of people from trying to gain admittance to the courtroom. Edwin Stanton began the defense closing arguments in a manner that was calm and precise. He brought up that justifiable homicide included that which was “committed in defense of family chastity, the sanctity of the marriage bed, the matron’s honor, the virgin’s purity.” [33] Since the prosecution had never brought into evidence Sickles’ own violation of these covenants his attacks on Key and the prosecution case hit home. As he continued his voice rose to a roar, sounding like a prophet of ancient Israel “Who seeing this thin, would not exclaim to the unhappy husband, “Hasten, hasten, to save the mother of your child! And may the Lord who watches over the home and family guide the bullets and direct the stroke!” [34] When Stanton finished the court erupted in a frenzy as spectators as well as supporters of Sickles applauded his closing.

Next up was Brady who went on for three hours, captivating the audience which hung on every word. “When Daniel Sickles realized how he had been betrayed, all the emotions of his nature changed into a single impulse; every throb of his heart brought before him the sense of his great injuries; every drop of his blood was burdened with a sense of shame; he was crushed by inexorable agony in the loss of his wife, in the dishonor that he had come upon his child, in the knowledge that the future – which had opened to him so full of brilliancy – had now been enshrouded in eternal gloom by one who, contrawise, should have invoked form the eternal God his greatest effulgence on the path of his friend….” [35]

The closing had been masterful, emotional, and dramatic. In response Ould attempted to recover, but his arguments were weak, he agreed with the defense about the crime of adultery, and attempted to redirect the jury’s attention that it was Sickles who was on trial for murder and not Key for adultery, but he had already lost that argument. He called the defense of temporary insanity a ploy and “mentioned how easily, and readily a man on trial for his life might pretend to be deranged if he were on trial for his life.” But it was too little, too late. Since there was no psychiatric profession to weigh in on the matter, the argument of temporary insanity fell back on the “tradition of male marital dominance” and “that argument played well among men who rarely wore collars on their shirts…” [36] the very kind of men seated in the jury booth. When the jury recessed to deliberate Sickles’ fate on the 26th it took them less than an hour to return their verdict, and few were surprised when it came back “not guilty.” Stanton “was so excited that he did a jig in the courtroom, the hoarsely called for three cheers.” [37] As he did “Pandemonium and cheers broke out in the courtroom.” [38] People crowded around to congratulate Sickles and the crush was so great that Sickles had to be escorted for the courtroom. President Buchanan on hearing the verdict was delighted, later in the evening, though he sought rest, Sickles was taken by Brady to a gala in his honor attended by nearly 1500 supporters and well-wishers. The trial was over but the trials of Dan Sickles were not.

George Meade had made his dispositions on July 2nd 1863 with care, but there was one notable problem, the commander of III Corps, Major General Dan Sickles did not like the position assigned to his corps on the south end of Cemetery Ridge. But before discussing that it is worth chasing the rabbit so to speak and spend some time on the life of a man referred to by one by one biographer as an American Scoundrel and another as Sickles the Incredible. The interesting thing is that lie most complex characters in history that Dan Sickles was both and, “he might have had more faults than virtues, but everything about him was perfectly genuine.” [1] That is one of the reason that he is so fascinating.

Sickles was certainly a scoundrel and at the same time incredible, charming yet terribly vain and often insincere. “He was quick-witted, willful, brash, and ambitious, with pliable moral principles.” [2] But he was also incredibly brilliant, far sighted, patriotic, and civic minded. He was a political general, “flamboyant, impulsive, and brave, some would wonder about his discipline and military judgement.” [3] His notoriety and unpopularity among the West Point trained professional officers in the Army of the Potomac, as well as his tactical decision to move his corps on the afternoon of July 2nd 1863, and his subsequent political machinations ensured that he would be the only corps commander of that army not commemorated with a monument at Gettysburg.

Dan Sickles was one of the most colorful, controversial, and perhaps the most scandalous officer ever to command a corps in the history of the United States Army. While he lacked professional training he had done a fair amount of study of the military arts in his spare time, and he “made up for his lack of military training by acting on the battlefield with reckless courage, and was much admired for it by his men.” [4]

After having served as a brigade and division commander Sickles was promoted to corps command. “Sickles owed his elevation to corps command to the patronage of his friend Joseph Hooker…. And while man of the West Point officer….regarded Sickles military acumen with the greatest skepticism, many in the volunteer ranks were of a different mind. “Sickles is a great favorite in this corps,” asserted Private John Haley of the 17th Maine. “The men worship him. He is every inch a soldier and looking like a game cock. No one questions his bravery or patriotism.” [5] General Alpheus Williams who commanded a division in the Union Twelfth Corps despised Sickles, and after Chancellorsville Williams wrote “A Sickles’ would beat Napoleon in winning glory not earned,,, He is a hero without a heroic deed! Literally made by scribblers.” [6] Likewise, Sickles, the political general was no favorite of George Gordon Meade.

On July 2nd 1863 Sickles would be responsible for an act that threw George Meade’s defensive plan into chaos, and according to most historians and analysts nearly lost the battle, however, there are some who defend his actions and give him credit for upsetting Lee’s plan of attack. However, the truth lays somewhat in the middle as both observations are correct. Sickles’ decision created a massive controversy in the months following the battle as public hearings in Congress, where Sickles, a former congressman from New York had many friends, as well as enemies, sought a political advantage from a near military disaster.

Sickles was a mercurial, vain and scandal plagued man who “wore notoriety like a cloak” and “whether he was drinking, fighting, wenching or plotting, he was always operating with the throttle wide open.” [7] Sickles was born in New York to George and Susan Marsh Sickles in late 1819, though a number of sources, including Sickles himself cite dates ranging from 1819 through 1825. “There is little reliable information about Sickles’ early days,” [8] and he did not talk much about them, especially after the war, when Gettysburg and the Civil War became his main subjects of conversation. His father, a sixth generation American whose family were early Dutch settlers in Manhattan became wealthy through real estate speculation, “and he passed on to his son a pride in being a congenital Knickerbocker,” charming, witty, and clever, in whom “hardheadedness and impulsiveness were combined.” [9]

The young Sickles was an impetuous child and his father’s wealth ensured that Dan Sickles had “the finest of tutors…. And an unceasing bankroll of funding for lascivious escapades.” [10] To get their son special tutoring to prepare him for college, his parents “arranged for him to live in the scholarly house of the Da Pont family…. It was a household like few others in that hardheaded, mercantile city, at a time when New York had little of the Italian character it would later take on.” [11] The home was a place of learning, culture, and unusual relationships. The head of the house was Lorenzo L. Da Pont, a Professor at Columbia, as well as a practicing attorney. Also living in the home was Da Pont’s father, the ninety-year-old Professor Lorenzo Da Pont, who “had been the librettist for three of Mozart’s operas” [12] and “held the chair of Italian and Columbia University” [13] Additionally, the elder Da Pont’s “adopted daughter Maria and her husband, Antonio Bagioli, a successful composer and music teacher” [14] lived under the same roof.

Maria was only about twenty-years-old when Sickles moved in. By this time she and Bagioli already had a child of their own, a three year old daughter named Teresa, which Sickles would eventually marry. While the elder Da Pont claimed Maria as an adopted daughter, it was “widely believed that she was his “natural child” … from an American liaison conducted when he was near the age of seventy.” [15] This spawned rumors, even at the time of Gettysburg that the young Sickles “and his future mother-in-law had a sexual affair.” [16]

Whether the liaison with Maria Bagioli occurred is a matter of innuendo and conjecture, but it would not be out of character for Sickles, who, to put it mildly, had a wild proclivity for the opposite sex. As a young man he frequented brothels, and as his social and political status increased, he moved from the brothels frequented by the middle class to those which catered to the more socially well to do. One of his affairs was with the a prostitute named Fanny White, a woman who was smart, pretty, and upwardly mobile who ran her own bordello. His affair with Fanny was well publicized, but did not prevent him from being elected to the state legislature in 1847. She and Sickles would continue their relationship for years with her asking nothing more than expensive gifts, and there are inklings that Fanny help to fund Sickles’ early political campaigns. There is also speculation that in 1854 following his marriage, that Fanny spent time with him in London while he was working with James Buchanan and that that he “may have brought Fanny to one of the Queens’s receptions and introducing the prostitute to Her Majesty.” [17] But Fanny eventually moved on to a man older and richer than Sickles. Eventually she retired from her business and married another New York lawyer but died of complications of tuberculosis and possibly syphilis in 1860. Her property at the time of her death was conservatively “estimated at $50,000 to $100,000” [18] a considerable fortune for a woman of her day and age.

While he lived with the Da Pont family, Sickles gained an appreciation for foreign languages, as well as theater and opera. The elder Professor Da Pont was a major part of his academic life and quite possibly in the development of Sickles liberal education and his rather libertine morality. Lorenzo had been a Catholic Priest and theologian in Italy, but like his young American admirer had quite the attraction for women, and was a connoisseur of erotic literature and poetry. His activities resulted in him being expelled from his teaching position in the seminary, after which he became fast friends with a man whose name is synonymous with smooth talking, suave, amorous men, Giacomo Casanova, and in Europe “his affairs with women had been almost as notorious as those of his good friend.” [19] Certainly the elder Lorenzo’s tales “of Casanova, the fabled prince of Priapus, did nothing to quell Dan’s adolescent sexual appetite.” [20]

Noted Civil War and Gettysburg historian Allen Guelzo describes the Sickles in even less flattering terms, “Sickles was from the beginning, a spoiled brat, and he matured from there into a suave, charming, pathological liar, not unlike certain characters in Mozart operas.” [21]

Following the deaths of both the elder and younger Professor Da Pont, Sickles was stricken with grief. At the funeral of the younger Professor Da Pont Sickles “raved and tore up and down the graveyard shrieking,” [22] forcing other mourners to take him away by force. Soon after, Sickles left New York University and began to work in the law office of the very formidable New York lawyer and former U.S. Attorney General, Benjamin F. Butler.

While he was studying for the bar under Butler, he was joined by his father who would also become an attorney. It was under the influence of his father, who was now a wealthy Wall Street investor, and the Democrats of Tammany Hall that the incredibly talented Sickles was groomed for political leadership. Tammany was a rough and tumble world of hardnosed politics, backroom deals, corruption and graft.

He passed the bar in 1843 and soon was making a name for himself in the legal world, and in politics, despite his well-known questionable ethics and morality. His political career began in 1844 when “he wrote a campaign paper for James Polk and became involved in the Tammany Hall political machine.” [23] The ever ambitious Sickles “clambered up the city’s Democratic party ladder, on the way collecting allies and enemies with utter disregard for the consequences, attending the typically unruly Tammany meetings armed with bowie knife and pistol.” [24]

Like many of his fellow New York Democrats he was a proponent of “Manifest Destiny, and the right of the United States to acquire and hold Texas, New Mexico, California, perhaps the isthmus of Central American, and certainly Cuba.” [25] He was also a political ally of many states rights Southern Democrats and “largely opposed anti-slavery legislation.” [26] This was in large part due to the commercial interests of New York, which between banking and commercial shipping interests profited from the South’s slave economy.

He was elected to the New York State legislature in 1847 and his political star continued to rise even as his personal reputation sank among many of his peers. An attorney who knew him described Sickles as “one of the bigger bubbles in the scum of the profession, swollen, and windy, and puffed out with fetid gas.” [27] Sickles rivals any American politician, before or since in his ability to rise even as the slime ran down his body, the term “Teflon” applied to politicians like Presidents Ronald Reagan and Bill Clinton comes to mind when one studies Sickles’ career. New York lawyer and diarist George Templeton Strong wrote, “One might as well try to spoil a rotten egg as to damage Dan’s career.” [28]

But there was no denying that Sickles was a brilliant lawyer, politician, and debater. One observed that Sickles was “a lawyer by intuition – careful in reaching his conclusions, but quick and bold in pushing them.” [29] New York Governor “William Marcy grudgingly said that as a debater Sickles excelled any man of his years, and the astute Henry Raymond declared that as a parliamentary leader he was unsurpassed.” [30] Soon Sickles was a delegate to the 1848 Democratic Convention where he helped nominate Franklin Pierce for his unsuccessful run at the democratic nomination. The convention enabled Sickles to enter the world of national politics making friends with many influential politicians and financiers, including Pierce, the Van Burens, and James Buchanan. On his return to New York he received an appointed as a Major in the New York Militia.

Even as Sickles rose in the tumultuous world of American law and politics, and chased Fanny White he became enamored with the now teenage daughter of Antonio and Maria Bagioli, Miss Teresa Bagioli who though only fifteen was beautiful, wise beyond her years, fluent in French and Italian, devoted to the arts, and entirely besotted by Dan Sickles. Both the parents of Sickles and Teresa opposed the relationship, but both were madly in love, and Teresa was as headstrong as Dan regarding the relationship. Though such a relationship would be considered completely scandalous today, such marriages were not uncommon then, though they were certainly less common in the upper society of New York. Sickles “was enchanted by her” and “courted her with the sensibility of being a friend of her parents and he must have suspected that he loved her with a fated and exclusive love.” [31] When she was just sixteen Teresa quit school and married the thirty-three year-old assemblyman in a civil ceremony officiated by New York Mayor Ambrose Kingsland on September 27th 1852. Six months later, the two were married in the Catholic Church by Archbishop John Hughes, in a “gala and largely attended affair.” [32] Just three months after the church wedding their daughter, Laura, was born. Though there can be no doubt that Sickles loved Teresa, and she him, it did not stop him from other extramarital affairs, nor did it take much away from his political machinations at Tammany Hall.

Following the 1852 Democratic convention where he again supported Franklin Pierce, Sickles hard fighting and influence at in the Wigwam of was rewarded with political plum prize of being appointed “corporation counsel of New York City, a post that paid a flattering salary with extra emoluments and also left room for profitable legal work on the side.” [33] His political and social acumen were again demonstrated as he convinced the state legislature, through personal force of will, to enable the New York City Corporation “to go ahead with creating a great central park,” [34] a park that we now know today as Central Park. He also helped push forward a proposal to create New York’s first mass transportation system, that of horse drawn omnibuses.

Later in the year Sickles was appointed as secretary of the American legation to the Court of St. James n London, headed by former Secretary of State James Buchanan. The position paid a pittance of what Sickles was earning in New York, but he realized that the serving overseas in such a position could not but help him on the national political stage. Though Buchanan and Pierce wanted Sickles, the new Secretary of State, the former New York Governor William Marcy refused to sign Sickles’ commission for the post. Eventually, Pierce prevailed and Sickles got the job.

As their baby, Laura, was still very young and sea travel still quite hazardous, Teresa remained at home, and joined her husband in London the following year. However, when she arrived in London, the teenage wife of Dan Sickles charmed Americans and Britons alike. Aided by her multilingual gifts, which “were rare among American diplomats’ wives,” [35] she became a great success and the unmarried Buchanan appointed her as hostess for the legation. She rapidly became a celebrity due to her stunning beauty and charm, and like he had Fanny, Sickles had Teresa introduced to the Queen. Her celebrity status evoked different responses from those that observed her. “One contemporary described Teresa as an Italian beauty, warm, openhearted, and unselfish. Another described her as being “… without shame or brain and [having] a lust for men.” [36] That “lust for men” coupled with the neglect of her husband may well have been the catalyst for the scandal which overwhelmed them in Dan’s congressional career.

It was during his service in London with Buchanan that Sickles became embroiled in one of the most embarrassing diplomatic incidents in American history. The proponents of Manifest Destiny and American expansion had long desired to take Cuba from Spain through diplomacy, or if needed force. Following a failed attempt by American “Filibusters” to seize the island in 1852 which ended in the execution of fifty Americans, including the son of U.S. Attorney General John Crittenden by Spanish authorities, and in 1854 President Franklin Pierce authorized Buchanan to attempt to negotiate the acquisition of Cuba.

Pierce authorized Buchanan to meet with James Mason, the United States Ambassador to France and Pierre Soule, the United States Ambassador to Spain secretly in order to draft “a statement on the future of Cuba and the proposed role of the United States.” [37] Soule dominated the meeting and the statement, which was in large part drafted by Dan Sickles, was highly inflammatory. Despite this the statement was released to the press in defiance of the order to maintain the strictest secrecy and it resulted in a diplomatic disaster for the Pierce Administration.

The document was prepared by Soule and Sickles and endorsed by Buchanan and Mason was known as the Ostend Manifesto, and it “was one of the most truly American, and at the same time most undiplomatic, documents every devised.” [38] The manifesto prepared by Soule and Sickles proclaimed that “Cuba is as necessary to the North American Republic as any of its present members, and that it belongs naturally to the great family of states of which the Union is the Providential Nursery.” [39] The authors of the manifesto also threatened Spain should the Spanish fail to accede to American demands. The authors declared that if the United States “decided its sovereignty depended on acquiring Cuba, and if Spain would not pass on sovereignty in the island to the United States by peaceful means, including sale, then, “by every law, human and Divine, we shall be justified in wresting it from Spain.” [40]

The Ostend Manifesto “sent shivers through the chancelleries of Europe, provoked hurried conversations between the heads of the French and British admiralties.” [41] European diplomats and leaders reacted harshly to the statement and Secretary of State William Marcy who had previously supported the ideas in the document immediately distance himself and official American policy from it and the authors. Marcy then “forced Soule’s resignation by repudiating the whole thing, but the damage was done.” For months the Pierce administration was on the defensive, and was condemned “as the advocate of a policy of “shame and dishonor,” the supporter of a “buccaneering document,” a “highwayman’s plea.” American diplomacy, said the London Times, was given to “the habitual pursuit of dishonorable object by clandestine means.” [42] The incident ended official and unofficial attempts by Americans to obtain Cuba by legal or extralegal means until the Spanish American War in 1898.

When Political Parties Implode: The Battle over the Lecompton Constitution and its Relevance Today

I have been watching the implosion of the Republican Party with some concern, not because I am a Republican or support that party, but because I am a historian and understand that the effects of these kinds of crack ups are not just bad for the party concerned, but often for the country, because they reveal deeper social and political issues. As I watch this I am reminded of the crisis and battle regarding the Lecompton Constitution in 1858. Since the article deals with this in some detail I will cut to the bottom line. In 1858 the Democratic Party held majorities in both houses of Congress and the Presidency. It had been aided by the collapse of the Whig Party and the new republican Party was still in its infancy. But extremists Democrats sought to push through a measure to bring Kansas into the Union as a Slave State, though the measure was rife with fraud. It split the Democratic Party and for a time destroyed it as a national party and helped bring about the Civil War. The battle over the Lecompton constitution is an epic event in our history. 

The issues today are not the same by any means, but the rhetoric and the intransigence of the most zealous ideologues is destroying the Republican Party in much the same way other ideologues destroyed the Democratic Party in 1858.  I admit that I could be wrong, but everything that I see happening is pointing to the implosion and possible breakup of the Republican Party. This may be good for Democrats in the short term, but seldom is it good for the country. But whatever your political views are, I do hope that you read this article and think about the implications of it, and of what is happening in our country today.

Kansas was politically divided between two competing legislatures, each which claimed to be the voice of the people. The population of Kansas was heavily anti-slavery and many citizens felt disenfranchised by the official legislature, which was “a pro-slavery body elected by fraud in 1855.” [1] This body met in the city of Lecompton. In 1857 the Lecompton legislature sensed the opportunity to have Kansas admitted to the Union as a Slave State. It elected slavery supporters as members of a constitutional convention to draft a constitution which would be submitted to Congress for admission to the Union as a Slave State.

Free State partisans feared that that if they participated in the election that they would be “gerrymandered, and simply counted out by stuffed ballots,” and sat out the election. As a result it was “a quiet election, with many proslavery candidates unopposed and only 2,200 out of 9,000 registered voters going to the polls, a large majority of extreme proslavery men won election as delegates to the constitutional convention in September.” [2] But the result of the election was untenable, for “Two thousand voters in a territory with 24,000 eligible for the franchise had elected a body of delegates whom no one seriously regarded as representative of the majority opinion in Kansas.” [3]

The Lecompton legislature passed the proslavery constitution, but it was vetoed by the outgoing governor, John W. Geary. Geary accused “the pro-slavery legislature of attempting to stampede a rush to statehood on pro-slavery terms,” but his veto was overridden. The constitution had several provisions that most of the population found unacceptable. It protected owners of “the 200 slaves in Kansas, banned free blacks from the state, and prohibited any amendments to the constitution for seven years.” [4] The newly appointed governor of the territory, Robert J. Walker opposed the measure and denounced it “as a vile fraud, a bare counterfeit.” [5] Walker demanded a new, fair, referendum, which the newly elected president James Buchanan, also backed. In response many Southerners in Congress “threatened to secede unless the administration fired Walker and backed down on the referendum issue.” [6] The threat of secession by Southerners in support of the radical minority in Lecompton led to chaos in the Democratic Party which controlled the House, the Senate and held the Presidency.

James Buchanan, who had rode into office on the votes of the South was now pressured by Southern legislators to change his position on the Lecompton Constitution. Buchannan’s cabinet, which was heavily Southern, and pro-slavery expansion also used its influence to pressure the president. In response to the pressure, Buchanan reversed his previous stance in regard to Kansas and endorsed the bill. This provoked a new outcry, this time from members of the Democratic Party. Many Northern Democrats were outraged by the reversal and the threats of secession. Most of the Northern Democrats were willing to accept and even defend slavery where it existed, but they were opposed to the expansion of slavery. They felt betrayed by their president’s actions and rose in opposition to the bill that would admit Kansas as a Slave State.

The formidable Stephen A. Douglas, the Little Giant who had so skillfully crafted the Compromise of 1850 using the principle of popular sovereignty, led these Democrats in their fight against Buchanan’s acceptance and endorsement of Lecompton. Douglas’s previous actions to support the rights of Slave States had made him a hero in much of the South and his stature in both the North and the South made him the front runner to win the Democratic nomination for the presidency in 1860.

But Douglas, who had worked so hard to build compromises that would hold the Union together could not countenance the actions and tactics of the Southern members of his party. Douglas was a political realist and not an ideologue. He was very sympathetic to slave holders and no supporter of emancipation, in fact Douglas was a racist, and was convinced “of the inferiority of the Negro, and he had a habit of stating it with brutal bluntness, “I do not believe that the Negro is any kin of mine at all…. I believe that this government of ours was founded, and wisely founded upon white basis. It was made by white men, for the benefit of white men and their posterity, to be executed and managed by white men.” [7] But despite his own beliefs Douglas understood the danger that the pro-slavery extremists supporting Lecompton were to the party, and he knew that if the bill was passed that it would destroy the unity of the Democratic Party and possibly the Union itself.

Douglas was outraged and when he saw the news that in the Washington Union that Buchanan had decided to support Lecompton he wrote:

“This left no doubt were the old bastard stood. “Can you believe his Goddamned arrogance?” I told a friend. “I run the Committee on Territories. He should have consulted me before approving the Lecompton fraud. He’ll pay for that. By God, sir, I made Mr. James Buchanan, and by God, sir, I’ll unmake him.” [8]

As such, the Little Giant threw caution to the wind and stormed to the White House “to confront Buchanan on the “trickery and juggling of the Lecompton constitution.” He warned the president of that his actions in support of the Lecompton party would “destroy the Democratic party in the North,” and we warned that “if Buchanan insisted on going through with it, Douglas swore to oppose him in Congress.” [9]

It was an epic confrontation. Douglas recalled, “The Lecompton constitution, I told Buchanan bluntly, was a blatant fraud on the people of Kansas and the process of democracy, I warned him not to recommend acceptance of it. With his head titled forward in that bizarre habit of his, he said that he intended to endorse the constitution and send it to Congress. “If you do,” I thundered, “I’ll denounce it the moment that it is read.” His face turned red with anger. “I’ll make Lecompton a party test,” he said. “I expect every democratic Senator to support it.” I will not, sir![10] Buchanan then cut Douglas off.

Angry and offended by Douglas Buchanan issued his own threat to Douglas saying, “I desire you to remember that no Democrat ever yet differed from an administration of his own choice without being crushed….Beware of the fate of Tallmadge and Rives,” two senators who had gone into political oblivion after crossing Andrew Jackson.” Douglas was undeterred and fought back, Douglas riposted: “Mr. President, I wish to remind you that General Jackson is dead, sir.” [11] It was an unprecedented action by a sitting Senator, to confront a President of one’s own party and threaten to oppose him in Congress was not done.

Following the confrontation with Buchanan Douglas was even more determined to defeat the Lecompton party. In righteous anger Douglas “took his political life into his own hands and assailed the Lecompton Constitution on the floor of the Senate as a mockery of the popular sovereignty principle.” [12] Buchanan’s allies in Congress fought back, and the two sides sometimes came into physical confrontation with each other in the chambers of Congress. When Buchanan’s supporters pushed for Lecompton’s approval and the admission of Kansas as a Slave State, Douglas fired back, warning “You do,” I said, “and it will lead directly to civil war!” I warned the anti-Lecompton Democrats of the North that the President intended to put the knife to the throat of every man who dared to think for himself on this question and carry out principles in good faith. “God forbid,” I said “that I ever surrender my right to differ from a President of the United States for my own choice. I am not a tool of any President!” [13]

Under Douglas the Northern Democrats joined with Republicans for the first time to defeat the admission of Kansas as a Slave State. Douglas recalled the battle:

“After the Christmas recess, the Administration unleashed its heavy horsemen: Davis, Slidell, Hunter, Toombs, and Hammond, all southerners. They damned me as a traitor and demanded that I be stripped of my chairmanship of the Committee on Territories and read out of the Democratic party. Let the fucking bastards threaten, proscribe, and do their worst, I told my followers; it would not cause any honest man to falter. If my course divided the Democratic party, it would not be my fault. We were engaged in a great struggle for principle, I said, and we would defy the Administration to the bitter end.” [14]

Southern members of Congress fought back and as the battle continued their acrimony towards Douglas grew and their rhetoric against the Little Giant became more heated. He was “at the head of the Black column…stained with the dishonor of treachery without parallel…patent double dealing…detestable heresies…filth of his defiant recreancy…a Dead Cock in the Pit…away with him to the tomb which he is digging for his political corpse.” [15]

But Douglas was undeterred by the threats to his career, he saw that he was in the right, and though he was in agreement with the philosophy of his opponents regarding slavery as an institution he realized that appeasing the South was not an option in regard to Lecompton. He wrote:

“My forces in the House fought a brilliant delaying action while I worked to win over wavering Democrats. When we introduced a substitute bill, Buchanan called a dozen congressmen to the White House and exhorted them not to forsake the administration. He was cursing and in tears. He had reason to be: on April first, a coalition of ninety-two Republicans, twenty-two anti-Lecompton Democrats, and six Know-Nothings sent Lecompton down to defeat by passing the substitute bill. This bill provided for a popular vote on the Lecompton constitution and for a new convention if the people rejected that document, as they surely would.” [16]

The substitute bill was passed by the Senate as well and sent back to Kansas for a popular vote. When the Lecompton Constitution was resubmitted to the people of Kansas, “to the hideous embarrassment of Buchanan, the voters of Kansas turned on August 30th and rejected Lecompton by a vote of 11,812 to 1,926.” [17] Douglas wroteThe agony is over,” cried one of my aides, “and thank God that the right has triumphed. Poor old Buck! Poor old Buck had just had his face rubbed in shit. By our “indomitable courage, “ as another aide put it, we’d whipped this “powerful and proscriptive” Administration and forced the Black Republicans to support a substitute measure which fully embodied the great principles of the Kansas-Nebraska Act.” [18]

Pro-slavery Southerners were outraged and Buchanan used every measure that he could to crush the anti-Lecompton Democrats, but he had lost “one of the most vicious struggles in the history of Congress, Southern Democrats had seriously damaged the patience of their Northern counterparts, and Buchannan loyalists in the North were unseated wholesale by upstart Republicans in the 1858 congressional elections.” [19] Buchanan’s Presidency was discredited, his party divided, its majority in congress lost, and the South moving closer to secession. Southerners considered Douglas a traitor and accused him of betraying them. “A South Carolinian lamented that “this defection of Douglas has done more than all else to shake my confidence in Northern men on the slavery issue, for I have long regarded him as one of our safest and most reliable friends.” [20]

The fight over Lecompton was a watershed. It served to illuminate how “minuscule minorities’ initial concerns ballooned into unmanageable majoritarian crises. The tiny fraction of Missouri slaveholders who lived near the Kansas border, comprising a tinier fraction of the South and a still tinier fraction of the Union, had demanded their chance to protect the southern hinterlands.” [21] The crisis that they provoked drew in the majority of Southern Democrats who came to their aid in Congress and provoked Northerners to condemn the Southern minority, which they believed was disenfranchising the majority in order to expand slavery to new territories.

The issue of Lecompton galvanized the political parties of the North and split the Democratic Party into Northern and Southern factions, dooming it as a national party for the foreseeable future. It was also the first time that a coalition Northern Democrats sided with anti-slavery forces. Through the efforts of “Republicans and anti-Lecompton Douglas Democrats, Congress had barely turned back a gigantic Slave Power Conspiracy to bend white men’s majoritarianism to slavemaster’s dictatorial needs, first in Kansas, then in Congress.” [22]

The political impact of the Lecompton crisis on the Democratic Party was an unmitigated disaster. The party suffered a major election defeat in the 1858 mid-term elections and lost its majorities, and in a sense fulfilling Lincoln’s words “became increasingly a house divided against itself.” [23] Douglas’s courageous opposition to Lecompton would be chief among the 1860 split in the Democratic Party, Southern Democrats turned with a vengeance on the man who had been their favorite in the 1856 democratic primary. This doomed his candidacy for President and ensured the election of Abraham Lincoln and the Republicans, a man that he had defeated for Senate in that critical summer of 1858.

Dred Scott & Obergfell v. Hodges

Court decisions on Civil Rights matter and sometime soon we will get the Supreme Court decision on the Case of Obergfell v. Hodges, the case that will determine if Marriage Equity will become the law of the land or not. Such cases are important. As I mentioned yesterday freedom for all matters and I completely agree with he words of Abraham Lincoln in regard to liberty that the words of the Declaration of Independence that “all men are created equal” is a universal standard. That it is the “the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.” This should be true for all, people including the LGBTQ community.

Since it matters so much I am posting a section from my Civil War and Gettysburg Staff Ride text on the Dred Scott decision. If you read it you will find just how chilling and similar the arguments of the Chief Justice of the Supreme Court Roger Taney are to those who oppose Marriage Equity and other rights being extended to Gay people.

As the 1850s wore on, the divisions over slavery became deeper and voices of moderation retreated. The trigger for the worsening of the division was the political battle regarding the expansion of slavery; even the status of free blacks in the north who were previously slaves, over whom their owners asserted their ownership. Southerners considered the network to help fugitive slaves escape to non-slave states, called the Underground Railroad “an affront to the slaveholders pride” and “anyone who helped a man or woman escape bondage was simply a thief” who had robbed them of their property and livelihood, as an “adult field hand could cost as much as $2000, the equivalent of a substantial house.” [1]

In 1856 the Supreme Court, dominated by southern Democrats ruled in favor of southern views in the Dred Scott decision, one pillar of which gave slavery the right to expand by denying to Congress the power to prohibit slavery in Federal territories. Taney’s ruling in the case insisted that “Neither the Declaration of Independence nor the Constitution had been intended to apply to blacks he said. Blacks were “so far inferior that they had no rights which the white man was bound to respect.” Taney did not stop with this but he declared the Missouri Compromise itself unconstitutional for “Congress had exceeded its authority when it forbade slavery in the territories by such legislation as the Missouri Compromise, for slaves were private property protected by the Constitution.” [2]

The decision was momentous, but the judicial fiat of Taney and his court majority was a disaster for the American people. It solved nothing and further divided the nation:

“In the South, for instance, it encouraged southern rights advocates to believe that their utmost demands were legitimatized by constitutional sanction and, therefore, to stiffen their insistence upon their “rights.” In the North, on the other hand, it strengthened a conviction that an aggressive slavocracy was conspiring to impose slavery upon the nation, and that any effort to reach an accommodation with such aggressors was futile. While strengthening the extremists, it cut the ground from under the moderates.” [3]

The decision in the case is frightening when one looks upon its tenor and implications. The majority opinion which was written by Chief Justice Roger Taney was chilling, not only in its views of race, but the fact that blacks were perpetually property without the rights of citizens. Taney wrote:

“Can a negro, whose ancestors were imported into this country, sold as slaves, become a member of the political community formed and brought into existence by the Constitution of the United States, and as such become entitled to all the rights, and privileges, and immunities, guaranteed by that instrument to the citizen?…It is absolutely certain that the African race were not included under the name of citizens of a state…and that they were not included, and were not intended to be included, under the word “citizens” in the Constitution, and therefore claim none of the rights and privileges which that instrument provides for and secures to citizens of the United States. On the contrary, they were at that time considered as a subordinate and inferior class of beings, who had been subjugated by the dominant race, and, whether emancipated or not, yet remain subject to their authority, and had no rights or privileges but those who held the power and the Government might choose to grant them” [4]

The effect of the ruling on individuals and the states was far reaching. “No territorial government in any federally administered territory had the authority to alter the status of a white citizen’s property, much less to take that property out of a citizen’s hands, without due process of law or as punishment for some crime.” [5] Free slaves were no longer safe, even in Free States, from the possibility of being returned to slavery, because they were considered property. The tens of thousands of free blacks in the South were effectively stripped of citizenship, and became vulnerable to either expulsion or re-enslavement, something that the legislatures in Virginia, North Carolina and Missouri debated in 1858. Likewise the decision cast doubt on the free status of every African American regardless of residence.” [6]

But the decision had been influenced by President-Elect James Buchanan’s secret intervention in the Supreme Court deliberations two weeks before his inauguration. Buchanan hoped by working with the Justices that he would save the Union from breaking apart by appeasing slave owners and catering to their agenda. “The president-elect wanted to know not only when, but if the Court would save the new administration and the Union from the issue of slavery in the territories. Would the judges thankfully declare the explosive subject out of bounds, for everyone who exerted federal power? The shattering question need never bother President Buchanan.” [7] In his inaugural address he attempted to camouflage his intervention and “declared that the Court’s decision, whatever it turned out to be, would settle the slavery issue forever.” [8]

But Buchanan was mistaken. The case made the situation even more volatile as it impaired “the power of Congress- a power which had remained intact to this time- to occupy the middle ground.” [9] Taney’s decision held that Congress “never had the right to limit slavery’s expansion, and that the Missouri Compromise had been null and void on the day of its formulation.” [10]

The Court’s decision “that a free negro was not a citizen and the decision that Congress could not exclude slavery from the territories were intensely repugnant to many people in the free states” [11] and it ignited a firestorm in the north where Republicans now led by Abraham Lincoln, decried the decision and southerners basked in their judicial victory. Southerners were exultant, the Richmond Enquirer wrote that the Court had destroyed “the foundation of the theory upon which their warfare has been waged against the institutions of the South.” [12] Northerners now quite rightly feared that an activist court would rule to deny their states the right to forbid slavery. As early as 1854 Lincoln posed the idea that the Declaration of Independence was the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.” [13]

After the Dred Scott decision Lincoln warned that the Declaration was being cheapened and diluted, he remained insistent on this point, he noted:

“Our Declaration of Independence was held sacred by all, and thought to include all” Lincoln declared, “but now, to aid in making the bondage of the Negro universal and eternal, it is assaulted, and sneered at, and construed, and hawked at, and torn, till, its framers could ride from their graves, they could not recognize it at all.” [14]

Lincoln attacked the decision noting that Taney “insists at great length that negroes were no part of the people who made, or for whom made, the declaration of Independence or the Constitution.” But as Doris Kearns Goodwin notes “in at least five states, black voters action on the ratification of the Constitution and were among the “We the People” by whom the Constitution was ordained and established.” Lincoln acknowledged that the founders “did not declare all men equal in all respects. They did not mean to say that all were equal in color, size, intellect, moral developments, or social capacity.” But they dis declare all men “equal in ‘certain inalienable rights, among which are life, liberty, and the pursuit of happiness.’…They meant simply to declare the right, so the enforcement of it might follow as circumstances permit.” [15]

Not only that, Lincoln asked the logical question regarding Taney’s judicial activism. Lincoln and other Republican leaders “noted that all slavery needed was one more Dred Scott decision that a state could not bar slavery and the objective of Slave Power to nationalize slavery would be accomplished.” [16] How long would it be, asked Abraham Lincoln, before the Court took the next logical step and ruled explicitly that the:

“Constitution of the United States does not permit a state to exclude slavery from its limits?” How far off was the day when “we shall lie down pleasantly thinking that the people of Missouri are on the verge of making their State free; and shall awake to the reality, instead, that the Supreme Court has made Illinois a slave State?” [17]

Lincoln discussed the ramification of the ruling for blacks, both slave and free:

“to aid in making the bondage of the Negro universal and eternal….All the powers of the earth seem rapidly combining against him. Mammon is after him; ambition follows, and philosophy follows, and the theology of the day is fast joining the cry. They have him in his prison house;…One after another they have closed the heavy doors upon him…and they stand musing as to what invention, in all the dominions of mind and matter, can be produced the impossibility of his escape more complete than it is.” [18]

Frederick Douglass noted that “Judge Taney can do many things…but he cannot…change the essential nature of things – making evil good, and good, evil.” [19]

Lincoln was not wrong in his assessment of the potential effects of the Dred Scott decision on Free States. State courts in free-states made decisions on the basis of Dred Scott that bode ill for blacks and cheered slave owners. In newly admitted California the state supreme court ominously “upheld a slaveowner’s right to retain his property contrary to the state’s constitution.” [20]

A similar decision by a New York Court was being used by slave-states to bring that issue to the Taney Court following Dred Scott. “In 1852 a New York judge upheld the freedom of eight slaves who had left their Virginia owner while in New York City on their way to Texas.” [21] The Dred Scott decision brought that case, Lemon v. The People back to the fore and “Virginia decided to take the case to the highest New York court (which upheld the law in 1860) and would have undoubtedly appealed it to Taney’s Supreme Court had not secession intervened.” [22] Even non-Republican parties such as the democrats could see the writing on the wall. The national publication of the Democratic Party, the Washington Union “announced that the clear implication of the Dred Scott decision was that all state laws prohibiting a citizen from another state, either permanently or temporarily, were unconstitutional.” [23]

Obedience to the Powers that Be: John Reynolds

I am continuing to periodically intersperse and publish short articles about various commanders at Gettysburg on the site. These all are drawn from my student text and may become a book in their own right.  The reason is I am going to do this is because I have found that readers are often more drawn to the lives of people than they are events. As I have noted before that people matter, even deeply flawed people, and we can learn from them.

This article deals with Major General John Fulton Reynolds who in large part is responsible for bringing about the Battle of Gettysburg and whose actions on that field in the opening hours of the engagement helped decide the course of the Civil War. This segment does not include the details of that battle, those are reserved for the rest of this chapter which I am currently revising for the student text.

I have come to admire Reynold’s more and more and I hope that in this brief treatment of his life and career leading to Gettysburg that you will be inspired by his single dovotion to the Union and the humanity compassion that he treated the victims of war.

There is much written about the supposed superiority of Robert E. Lee and the generals of the Army of Northern Virginia over those of the Army of the Potomac. Their eventual defeat is often blamed on the Union’s superior manpower and attrition with scant recognition of times where the Union commanders, particularly at Gettysburg out-generaled them. Not only did Harry Heth have the misfortune of battling John Buford and John Reynolds, but division, brigade and regimental leaders who performed their duties magnificently. Despite being greatly outnumbered by the Confederates these men and their soldiers turned back the initial Confederate assaults and shattering Confederate infantry formations.

Likewise if chance plays a role in war, the Army of the Potomac had good fortune smiling upon it that fateful morning of July 1st 1863. Part of that good fortune was having Major General John Fulton Reynolds, one of the finest commanders on either side during the Civil War directing its operations. During the engagement Reynolds, his subordinates and his successor in command Abner Doubleday dealt with the unforeseen elements of this engagement far better than any Confederate General on the battlefield that morning. Reynolds exemplified the indispensable qualities described by Clausewitz regarding commanders who must deal with the role of chance and the unforeseen elements that so often cloud the battlefield:

“first, an intellect that, even in the darkest hour, retains the glimmerings of the inner light which leads to truth; and second, the courage to follow this faint inner light wherever it may lead.” [1]

John Reynolds was a native Pennsylvanian, born in Lancaster to descendants of Irish Protestants. His maternal grandfather, Samuel Moore fought as a Captain in the Continental Line during the American Revolution. Reynold’s father, was a lawyer and moved to Lancaster where he “owned and published the Journal.” The elder Reynolds had served two terms in the Pennsylvania legislature and in the early 1830s was a political ally and friend of Senator and later President James Buchannan for whom “he was attending to local business affairs” in Lancaster. [2] Buchannan helped one of Reynold’s brother William gain an appointment to the Naval Academy and in 1837 obtained the appointment to West Point.

The young Pennsylvanian graduated from West Point in 1841, twenty-sixth in a class of fifty-two and was commissioned as a Brevet Second Lieutenant in the artillery. Among his classmates were the future Union generals Israel Richardson, Don Carlos Buell and Horatio Wright and Confederate generals Richard Garnett and J.M. Jones. Graduating in the class ahead of him was a man who would become a lifelong friend, William Tecumseh Sherman. He graduated at a time of military cutbacks, the Army was about to be reduced from 12,000 to 9,000 the following year. Chances for promotion were so bad, especially from First Lieutenant to Captain, “so unlikely that in a single year 117 officers resigned.” [3] Many of these officers would find their way back to the army but even so, army life did not promise much.

Despite this Reynolds found army life to his liking. He served in Florida during the Seminole War, as well as in Mexico “where he was cited for bravery at Monterey and Buena Vista.” [4] During the campaign in Mexico he served with the army commanded by General Zachary Taylor and in the artillery battery commanded by the future Confederate general, Captain Braxton Bragg. He acquitted himself well and also had compassion for the Mexican soldiers that he fought against. Visiting Mexican wounded who had been left with “little medical care and less food” he gave them money to help with their needs. At Buena Vista a number of senior officers wrote official citations praising the artillery and Reynolds by name. General John Wool wrote

“Without our artillery,” he said, “we could not have maintained our position a single hour,” and also: “…a section of artillery, admirably served by Lieutenant Reynolds, 3rd Arty, played an important part in checking and dispersing the enemy in the rear of our left. They retired before him whenever he approached them.” [5]

Those actions brought him fame and two brevet promotions for bravery, [6] to Captain at Monterrey and Major at Buena Vista. However, Reynolds saw little value in them if the army’s promotion system was not fixed. He wrote his brother Jim “The system is a complete humbug and until it changes I believe it is to be rather more of a distinction to be passed over than to be breveted…that is, amongst us who know facts.” [7]

Reynold’s skill as an artilleryman would be used to great effect on the morning of July 1st 1863 on McPherson’s Ridge at Gettysburg. Following the war he remained in the army predominantly with the artillery. He served in field and coastal batteries and like John Buford had “participated in the Utah Expedition.” [8] The Utah expedition is little known and nearly forgotten incidents in United States history which involved the territory of Utah, and it left a bitter taste in the mouths of many of the officers and soldiers who served in it, including John Reynolds.

The Territory of Utah had been created after the Compromise of 1850 and President Millard Fillmore named Mormon leader Brigham Young as Governor. The Mormons settled Utah after having been driven out of Illinois and Missouri as a result of their religious beliefs which included polygamy and well as the political concept Theodemocracy, which had been formulated by Mormon founder Joseph Smith Jr. Theodemocracy was a concept which is a blend of theocracy and republican principles. Though it largely died out after the replacement of Young as Governor it has many similarities with theology, political ideology and goals of the leaders of the current Christian Dominion concepts of the leaders of what is called The New Apostolic Reformation which has gained much power among the leadership of the current Republican Party.

In Illinois Smith had “founded an autonomous community, with its own militia, where Smith was eventually called “King of the Kingdom of God.” [9] Smith believed that it was a necessary step until a true theocracy could be established. Smith had taught his ruling Council of Fifty, which included a few non-Mormons “that in the initial stages of the millennium the council would participate in concert with men of differing religious and political persuasions” and the earth would still have a pluralism of governments and religions in the early part of those thousand years…” [10] Tensions between Smith, the Mormon community and surrounding communities grew and “eventually, an unruly mob lynched the prophet and one of his followers.” [11]

Two years after the territory was formed Young “declared that Smith had a vision, until then kept secret, reinstituting polygamy.” [12] To be fair, Young did not require this of his followers, but the introduction produced a furor among many Americans. The situation with Utah was complicated further by the actions of Congress which in throwing out the Missouri Compromise that Utah and New Mexico “when admitted as a State or States…shall be received into the Union, with or without slavery, as their constitution may prescribe at the time of their admission.” [13]

The combination of a growing theocracy, the introduction of polygamy and the possibility of slavery brought many tensions. The 1856 convention of the new Republican Party condemned “the twin relics of barbarism” – slavery and polygamy.” Midwesterners who joined that part remembered their clashes with the Mormons and “few voters were sympathetic to the Mormons” [14] or their growing power in the Utah Territory. In 1857 this tension led to President James Buchannan to appoint a non-Mormon Governor for the territory which led to conflict between Young’s government and its militias and the United States. Young considered U.S. Troops to be those of a “foreign power” and prepared for war “insisting as strongly on the independence of his people from Washington as the capital insisted on its jurisdiction over the territory.” [15]

Like many officers and Americans in general, Reynolds had negative views of the Latter Day Saints. Some were gained in his introduction to the territory, where he found that as a “gentile” he was treated as an outsider by the Mormon community. His initial bad disposition was only deepened through his interactions with Governor Brigham Young. The most important of these to Reynolds was an attempt to bring to justice the Indians who had massacred a party of army engineers under the command of Captain Gunnison the previous summer. Reynolds for that the Mormon led government, particularly Governor Young had convicted the Indians of manslaughter and sentenced them to prison for manslaughter. This act angered Reynolds. He wrote his sisters:

“They have been since tried by the Mormons and found guilty of manslaughter, tho’ the proof was positive and clear. But their jury was counseled by Brigham Young as to their verdict and perjured themselves. May God have mercy upon them, they would hang two Indians for killing two Mormon boys last summer when there was scarcely any proof at all, but when a Gentile is murdered it is only manslaughter!! I cannot write the truth about these people here – but will sometime later.” [16]

After Utah Reynolds served in Kansas and briefly in the Pacific Northwest. During that time he developed a dislike for radical abolitionists who he believed were responsible for much of the division of the country.

But with tensions growing in 1860 Reynolds was appointed as Commandant of the Corps of Cadets at West Point. During the interregnum of the election of Abraham Lincoln and his inauguration he “hoped for a moderate course that might avoid war.” [17] However, the Confederate seizure of U.S. facilities and siege of Fort Sumter and the tensions building between Southerners and Northerners at the Academy weighed on Reynolds and soon brought about a break with his family’s longtime political ally and benefactor President James Buchannan. Though normally not outspoken about his political beliefs on thing was sure, he valued the Union and as with the Mormons opposed those who sought to undermine it. He wrote his sister Ellie about his feelings for the President at his administration:

“What will history say of us, our Government, and Mr. B’s Administration makes one wish to disown him….”I have said but little, except among ourselves here, on the present difficulties that surround the Government but a more disgraceful plot, on the part of our friend B’s cabinet and the leading politicians of the South, to break up our Government, without cause, has never blackened the pages of history in any nation’s record.” [18]

However, Reynolds’s harshest and most bitter words were reserved for Jefferson Davis who he had served with in Mexico:

“…Who would have believed that when I came here last September and found Mr. Jeff Davis laboring with a Committee of Congress and civilians to re-organize the Academy; our national school! Whose sons, never until the seeds sown by his parricidal hand had filled it with the poisonous weed of secession, had known any other allegiance than the one to the whole country, or worshipped any other flag, than that which has moved our own youthful hopes and aspirations and under which we marched so proudly in our boyish days – who! I dare say, would have believed, that he was brooding over his systematic plans for disorganizing the whole country. The depth of his treachery has not been plumbed yet, but it will be.” [19]

Reynolds served at the Academy until June of 1861 when it graduated its final class before the war began. Departing West Point he was initially appointed as Lieutenant Colonel of the 14th U.S. Infantry regiment. [20] He would have preferred the artillery but wrote that he “could not refuse this promotion offered me under any circumstances, much less at this time, when the Government has a right to my services in any capacity.” [21] How much different was Reynolds than another politically moderate and illustrious soldier, Robert E. Lee, who barely a month after accepting a promotion to full Colonel in the Regular Army resigned his commission to serve his state of Virginia and the Confederacy rather than lead an army “in an invasion of the Southern States” whatever Virginia decided.” [22]

Before Reynolds could take command of the 14th United States, he was promoted to Brigadier General. He commanded a brigade of Pennsylvania volunteers during the Peninsula Campaign and was captured on June 28th after leading his troops successful at Gaines Mill, as McClellan began his withdraw from the gates of Richmond. He spent six weeks in Confederate captivity but was released in a general prisoner exchange on August 15th 1862. [23] Despite being captured Reynolds’s performance during the Seven Days was praised by friend and foe alike and even his Confederate enemies in the city of Fredericksburg petitioned Richmond to release Reynolds who they said:

“when inasmuch as we were prisoners in the hands of General Reynolds we received from him a treatment distinguished by a marked and considerable respect for our opinions and feelings, it becomes us to use our feeble influence in invoking for him, now a prisoner of our Government as kind and as considerate as was extended by him to us. We would therefore hope that he might be placed on parole…” [24]

In doing so they returned to the Army of the Potomac the man who would help decide the fate of the Confederacy barely ten months later.

Reynolds returned to command a division at Second Bull Run where his division held firm as much of the army retreated. Reynolds missed the battle of Antietam as he was called to “the fruitless and frustrating task of trying to organize Pennsylvania’s militia” [25] by Governor Curtin. He returned to the Army of the Potomac and again commanded First Corps at Fredericksburg and again at Chancellorsville.

Reynolds was reportedly offered command of the Army of the Potomac by Lincoln in early June of 1863 but declined it. He went to the White House when he heard that he was under consideration for the post and ensured that he would not get the job by stating the his conditions for taking it. However, he did “urge the president to appoint Meade in Hooker’s place.” [26] He told his artillery chief Colonel Wainwright that he “refused it because he would have been under the same constraints as Burnside and Hooker.” [27] Colonel Wainwright believed that it was in large part due to “Reynolds’s recommendation that General Meade received his appointment.” [28]

The Army of the Potomac’s senior leadership had been the source of much political consternation during 1862 and 1863 for Abraham Lincoln. It was split among Lincoln’s supporters and detractors, Radical Republican abolitionists and moderate Democrats. To complicate matters some of senior leaders of the Army of the Potomac including McClellan, Hooker and Sickles had their own, scarcely hidden aspirations for the presidency.

However, Reynolds was of a different character than the politically connected and conniving commanders who used their position in the army to advance their career. Reynolds was a moderate Pennsylvania Democrat and prior to the war had been no supporter of Lincoln, once comparing him to a “baboon.” That opinion being noted, Reynolds did not allow his political beliefs and opinions to influence the manner in which he upheld his oath to the nation in time of civil war. Lincoln was President and was attempting to hold the Union together against forces that Reynolds found decidedly treacherous. It was a tribute to Reynold’s personal manner of keeping politics out of his command, which allowed him, a moderate Democrat to successfully command a corps whose divisions “were commanded by some of the Army’s most fervent abolitionists – Abner Doubleday, James S. Wadsworth, and John Cleveland Robinson.” [29]

Reynolds was “a serious unbending professional, who unlike McClellan, actually lived by the principle of “obedience to the powers that be.” [30] The Pennsylvanian was “universally respected” in the army “for his high character and sterling generalship” [31] it was noted that unlike others who so quickly interjected themselves into the political turmoil which had embroiled the nation that Reynolds had a policy of holding back. He stood “stoutly aloof from all personal or partisan quarrels, and keeping guardedly free from any of the heart-burnings and jealousies that did so much to cripple the usefulness and endanger the reputation of many gallant officers.” [32]

Oliver Howard noted that unlike many commanders that Reynolds was a commander “who had a steady hand in governing, were generous to a fault, quick to recognize merit, trusted you and sought to gain your confidence, and, as one would anticipate, were the foremost in battle.” [33] George McClellan noted that Reynolds was “remarkably brave and intelligent, an honest, true gentleman.” [34] In his autobiography Howard wrote about Reynolds:

“From soldiers, cadets, and officers, junior and senior, he always secured reverence for his serious character, respect for his ability, care for his uniform discipline, admiration for his fearlessness, and love for his unfailing generosity.” [35]

On the night of June 30th Reynolds was awash in reports, some of them conflicting and even though he was without Meade’s course of action for the next day “concluded that Lee’s army was close by and in force.” [36] He spent the night at his headquarters “studying the military situation with Howard and keeping in touch with army headquarters.” [37] Howard noted Reynolds anxiety and “received the impression that Reynolds was depressed.” [38] After Howard’s departure Reynolds took the opportunity to get a few hours of fitful sleep before arising again at 4 a.m. on July 1st.

When morning came, Reynolds was awakened by his aide Major William Riddle with Meade’s order to “advance the First and Eleventh Corps to Gettysburg.” [39] Reynolds studied the order and though he expected no battle that morning, expecting “only moving up to be in supporting distance to Buford” [40] took the prudent and reasonable precautions that his Confederate opponents A.P. Hill and Harry Heth refused to take as they prepared to move on Gettysburg.

His troops were in fine spirits that morning even though it had been busy. After a breakfast of hardtack, pork and coffee the troops moved out. An officer of the Iron Brigade noted that the soldiers of that brigade were “all in the highest spirits” while Lieutenant Colonel Rufus Dawes of the “placed the fifes and drums at the head of the Sixth Wisconsin and ordered the colors unfurled” as the proud veterans marched forward into the sound of the raging battle to the tune of “The Campbell’s are Coming.” [41]

Though Reynolds was not expecting a fight he organized his march in a manner that ensured if one did happen that he was fully prepared. The precautionary measures that he took were those that any prudent commander having knowledge that strong enemy forces were nearby would take. Reynolds certainly took to heart the words of Napoleon who said “A General should say to himself many times a day: If the hostile army were to make its appearance in front, on my right, or on my left, what should I do?” [42]

This was a question that A.P. Hill and Harry Heth seemed not to consider on that warm and muggy July morning when Heth was committing Lee’s army to battle on his own authority. Reynolds was also about to commit the Army of the Potomac to battle, but unlike Heth who had no authority to do so, Reynolds “had at least been delegated the authority for making such a decision.” [43] While Meade was unaware of what was transpiring in the hills beyond Gettysburg he implicitly trusted the judgement of Reynolds, and he been with the advanced elements of Reynold’s wing Meade too “probably would have endorsed any decision he made.” [44]

Reynolds placed himself with the lead division, that of Wadsworth, and “had directed Doubleday to bring up the other divisions and guns of the First Corps and had ordered Howard’s Eleventh Corps up from Emmitsburg.” [45] Reynold’s also understood the urgency of the situation and “wanted all the fighting troops to be up front, so he instructed Howard not to intermingle his supply wagons with his infantry. Similar instructions had been given to Abner Doubleday; to ensure that the First Corps wagons would wait until the Eleventh Corps foot soldiers had passed.” [46]

Instead operating in the normal fashion of rotating units on the march, Reynolds opted to save time. Since the First Division under the command of James Wadsworth was further advanced than other I Corps divisions, Reynolds instructed it to move first with Cutler’s brigade in the lead followed by the Iron Brigade under Colonel Solomon Meredith. In doing so he countermanded the order of the acting corps commander Doubleday who had ordered that division to allow the other divisions of First Corps to pass his before advancing. Reynolds told Wadsworth that Doubleday’s order “was a mistake and that I should move on directly.” [47]

He went forward with Wadsworth’s division and gave Doubleday his orders for the coming engagement. Doubleday later recalled that when Reynolds arrived to discuss the situation that Reynolds:

“read to me the various dispatches he had received from Meade and Buford, and told me that he should go at once forward with the leading division – that of Wadsworth – to aid the cavalry. He then instructed me to draw in my pickets, assemble the artillery and the remainder of the corps and join him as soon as possible. Having given me these orders, he rode off at the head of the column, and I never saw him again.” [48]

Reynolds ordered Howard’s XI Corps to follow and according to Doubleday directed an aid of Howard to have Howard “bring his corps forward at once and form them on Cemetery Hill as a reserve.” [49] While some writers that he directed Oliver Howard to prepare Cemetery Hill as a fallback position [50] there is more evidence that points to Howard selecting the that commanding hill himself. [51]

Likewise Reynolds ordered Sickles’ III Corps to come up from Emmitsburg where that corps had bivouacked the previous night. [52] Sickles had heard the guns in the distance that morning and sent his senior aide, Major Henry Tremain to find Reynolds. Reynolds told Tremain “Tell General Sickles I think he had better come up” but the order left Sickles in a quandary. He recalled “he spend an anxious hour deciding what to do” [53] for he had “been ordered by Meade to hold his position at Emmitsburg” [54] and Sickles sent another rider to Reynolds and awaited the response of his wing commander instead of immediately advancing to battle on 1 July and it would not be until after 3 P.M. that he would send his lead division to Gettysburg.

Reynolds’ intention according to Doubleday was “to fight the enemy as soon as I could meet him.” [55] Reynolds rode forward with some of his staff into the town as the infantry of I Corps and XI Corps moved advanced. In the town they were met by “a fleeing, badly frightened civilian, who gasped out the news that the cavalry was in a fight.” [56] When he came to the Lutheran Seminary he came across Buford. It was a defining moment of the Civil War, a moment that shaped the battle to come. It has been recounted many times and immortalized on screen in the movie Gettysburg, a time “when the entire battle would come down to a matter of minutes getting one place to another.” [57]

As the rough and tumble Kentuckian, Buford, and Reynolds, the dashing Pennsylvanian, discussed the situation they had to know that odd that they were facing. With close to 32,000 rebels from the four divisions of Hill’s and Ewell’s corps closing in from the west and the north with only about 18,000 men of First Corps, Eleventh Corps and Buford’s cavalry division the odds did not favor them, but unlike other battles that the army of the Potomac faced, this time the army and its commanders were determined not to lose and not to retreat.

Reynolds and Buford committed their eighteen thousand men against Lee’s thirty-two thousand in a meeting engagement that develop into a battle that would decide the outcome of Lee’s invasion. Likewise it was a battle for the very existence of the Union. Abner Doubleday noted the incontestable and eternal significance of the encounter to which Buford and Reynolds were committing the Army of the Potomac:

“The two armies about to contest on the perilous ridges of Gettysburg the possession of the Northern States, and the ultimate triumph of freedom or slavery….” [58]

Dred Scott: A Warning for Today

Friends of Padre Steve’s World

I am a historian, and as such I look to history to understand people and current events. As such I am looking at the upcoming Supreme Court hearing in the case of Obergefell v. Hodges and thinking about it in relation to the Dred Scott Ruling of 1856.

This case deals with Gay marriage and the attempts of mainly Christian Conservatives to roll back the rights of those in the LBGTQ community to marry. Not only does they seek to prevent Gay marriage where it is not permitted but they seek to roll back those rights in states where the majority of voters through their legislators have passed those laws, and negate the traditional understanding of reciprocity between states concerning recognition of marriages performed in other states. As such it is a major case with big ramifications. 

On one hand if the justices rule in favor of those challenging the laws which allow gays to marry it will strike at the very heart of the meaning of the Declaration of Independence’s  central message that “all men are created equal.” Likewise such a ruling will return LBGTQ citizens to a second class status in which though they pay taxes and serve their country in many ways, and contribute to the positive good of all Americans, they will not enjoy the liberties of other citizens and can be denied basic services, or even the right to be at the bedside of a dying spouse. 

Though Gay marriage harms no one its opponents have announced that it will have apocalyptic consequences and will result in a massive persecution of Christians who oppose it. The legal arguments espoused by the opponents of Gay marriage are similar to those who supported the both the protection and expansion of slavery in the 1850s, and those who after emancipation and the Thirteenth Amendment enacted “Black” or “Jim Crow” laws. Sadly, if Gay marriage is upheld by the Court, a number of States are pledging to enact similar laws regarding Gays, and some states are already doing so. 

From more recent Court rulings it appears that the Gay marriage will be upheld, but you never know with the Roberts Court. Several members, Justices Thomas, Alito and Scalia have long histories of opposing and ruling against the rights of gays.  

Today I am looking at the effects of the Dred Scott decision of the Supreme Court. The decision was one of the worst, if not the worst ever enacted by the Supreme Court. The consequences were chilling as it proclaimed that Blacks were a “subordinate and inferior class of beings” who had no rights. It also in combination with the Compromise of 1850 opened territories to slavery and put Blacks in Free States at jeopardy of being re-enslaved.

I ask my readers to imagine what it will be like for Gays if the Supreme Court rules against Gay marriage. I will probably post something tomorrow about the use of the “Black laws” and “Jim Crow” and relate that to the “Gay laws” that are being enacted in many states and locales, laws which serve no purpose than to deprive citizens of basic rights, services and freedoms enjoyed by other citizens.

As the 1850s wore on, the divisions over slavery became deeper and voices of moderation retreated. The trigger for the worsening of the division was the political battle regarding the expansion of slavery; even the status of free blacks in the north who were previously slaves, over whom their owners asserted their ownership. Southerners considered the network to help fugitive slaves escape to non-slave states, called the Underground Railroad “an affront to the slaveholders pride” and “anyone who helped a man or woman escape bondage was simply a thief” who had robbed them of their property and livelihood, as an “adult field hand could cost as much as $2000, the equivalent of a substantial house.” (1)

In 1856 the Supreme Court, dominated by southern Democrats ruled in favor of southern views in the Dred Scott decision, one pillar of which gave slavery the right to expand by denying to Congress the power to prohibit slavery in Federal territories. Taney’s ruling in the case insisted that “Neither the Declaration of Independence nor the Constitution had been intended to apply to blacks he said. Blacks were “so far inferior that they had no rights which the white man was bound to respect.” Taney did not stop with this but he declared the Missouri Compromise itself unconstitutional for “Congress had exceeded its authority when it forbade slavery in the territories by such legislation as the Missouri Compromise, for slaves were private property protected by the Constitution.” (2)

The decision was momentous, but the judicial fiat of Taney and his court majority was a disaster for the American people. It solved nothing and further divided the nation:

“In the South, for instance, it encouraged southern rights advocates to believe that their utmost demands were legitimatized by constitutional sanction and, therefore, to stiffen their insistence upon their “rights.” In the North, on the other hand, it strengthened a conviction that an aggressive slavocracy was conspiring to impose slavery upon the nation, and that any effort to reach an accommodation with such aggressors was futile. While strengthening the extremists, it cut the ground from under the moderates.” (3)

The decision in the case is frightening when one looks upon its tenor and implications. The majority opinion which was written by Chief Justice Roger Taney was chilling, not only in its views of race, but the fact that blacks were perpetually property without the rights of citizens. Taney wrote:

“Can a negro, whose ancestors were imported into this country, sold as slaves, become a member of the political community formed and brought into existence by the Constitution of the United States, and as such become entitled to all the rights, and privileges, and immunities, guaranteed by that instrument to the citizen?…It is absolutely certain that the African race were not included under the name of citizens of a state…and that they were not included, and were not intended to be included, under the word “citizens” in the Constitution, and therefore claim none of the rights and privileges which that instrument provides for and secures to citizens of the United States. On the contrary, they were at that time considered as a subordinate and inferior class of beings, who had been subjugated by the dominant race, and, whether emancipated or not, yet remain subject to their authority, and had no rights or privileges but those who held the power and the Government might choose to grant them” (4)

The effect of the ruling on individuals and the states was far reaching. “No territorial government in any federally administered territory had the authority to alter the status of a white citizen’s property, much less to take that property out of a citizen’s hands, without due process of law or as punishment for some crime.” (5) Free slaves were no longer safe, even in Free States, from the possibility of being returned to slavery, because they were considered property. The tens of thousands of free blacks in the South were effectively stripped of citizenship, and became vulnerable to either expulsion or re-enslavement, something that the legislatures in Virginia, North Carolina and Missouri debated in 1858. Likewise the decision “cast doubt on the free status of every African American regardless of residence.” (6) 

But the decision had been influenced by President-Elect James Buchanan’s secret intervention in the Supreme Court deliberations two weeks before his inauguration. Buchanan hoped by working with the Justices that he would save the Union from breaking apart by appeasing slave owners and catering to their agenda. “The president-elect wanted to know not only when, but if the Court would save the new administration and the Union from the issue of slavery in the territories. Would the judges thankfully declare the explosive subject out of bounds, for everyone who exerted federal power? The shattering question need never bother President Buchanan.” (7) In his inaugural address he attempted to camouflage his intervention and “declared that the Court’s decision, whatever it turned out to be, would settle the slavery issue forever.” (8) 

But Buchanan was mistaken. The case made the situation even more volatile as it impaired “the power of Congress- a power which had remained intact to this time- to occupy the middle ground.” (9)  Taney’s decision held that Congress “never had the right to limit slavery’s expansion, and that the Missouri Compromise had been null and void on the day of its formulation.” (10)

The Court’s decision “that a free negro was not a citizen and the decision that Congress could not exclude slavery from the territories were intensely repugnant to many people in the free states” (11)  and it ignited a firestorm in the north where Republicans now led by Abraham Lincoln, decried the decision and southerners basked in their judicial victory. Southerners were exultant, the Richmond Enquirer wrote that the Court had destroyed “the foundation of the theory upon which their warfare has been waged against the institutions of the South.” (12) Northerners now quite rightly feared that an activist court would rule to deny their states the right to forbid slavery. As early as 1854 Lincoln posed the idea that the Declaration of Independence was “the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.” (13) 

After the Dred Scott decision Lincoln warned that the Declaration was being cheapened and diluted, he remained insistent on this point, he noted:

“Our Declaration of Independence was held sacred by all, and thought to include all” Lincoln declared, “but now, to aid in making the bondage of the Negro universal and eternal, it is assaulted, and sneered at, and construed, and hawked at, and torn, till, its framers could ride from their graves, they could not recognize it at all.” (14)

Lincoln attacked the decision noting that Taney “insists at great length that negroes were no part of the people who made, or for whom made, the declaration of Independence or the Constitution.” But as Doris Kearns Goodwin notes “in at least five states, black voters action on the ratification of the Constitution and were among the “We the People” by whom the Constitution was ordained and established.” Lincoln acknowledged that the founders “did not declare all men equal in all respects. They did not mean to say that all were equal in color, size, intellect, moral developments, or social capacity.” But they dis declare all men “equal in ‘certain inalienable rights, among which are life, liberty, and the pursuit of happiness.’…They meant simply to declare the right, so the enforcement of it might follow as circumstances permit.” (15)

Not only that, Lincoln asked the logical question regarding Taney’s judicial activism. Lincoln and other Republican leaders “noted that all slavery needed was one more Dred Scott decision that a state could not bar slavery and the objective of Slave Power to nationalize slavery would be accomplished.” (16) How long would it be, asked Abraham Lincoln, before the Court took the next logical step and ruled explicitly that the:

“Constitution of the United States does not permit a state to exclude slavery from its limits?” How far off was the day when “we shall lie down pleasantly thinking that the people of Missouri are on the verge of making their State free; and shall awake to the reality, instead, that the Supreme Court has made Illinois a slave State?” (17)

Lincoln discussed the ramification of the ruling for blacks, both slave and free:

“to aid in making the bondage of the Negro universal and eternal….All the powers of the earth seem rapidly combining against him. Mammon is after him; ambition follows, and philosophy follows, and the theology of the day is fast joining the cry. They have him in his prison house;…One after another they have closed the heavy doors upon him…and they stand musing as to what invention, in all the dominions of mind and matter, can be produced the impossibility of his escape more complete than it is.” (18)

Frederick Douglass noted that “Judge Taney can do many things…but he cannot…change the essential nature of things – making evil good, and good, evil.” (19)

Lincoln was not wrong in his assessment of the potential effects of the Dred Scott decision on Free States. State courts in free-states made decisions on the basis of Dred Scott that bode ill for blacks and cheered slave owners. In newly admitted California the state supreme court ominously “upheld a slaveowner’s right to retain his property contrary to the state’s constitution.” (20)

A similar decision by a New York Court was being used by slave-states to bring that issue to the Taney Court following Dred Scott. “In 1852 a New York judge upheld the freedom of eight slaves who had left their Virginia owner while in New York City on their way to Texas.” (21) The Dred Scott decision brought that case, Lemon v. The People back to the fore and “Virginia decided to take the case to the highest New York court (which upheld the law in 1860) and would have undoubtedly appealed it to Taney’s Supreme Court had not secession intervened.” (22) Even non-Republican parties such as the Democrats could see the writing on the wall. The national publication of the Democratic Party, the Washington Union “announced that the clear implication of the Dred Scott decision was that all state laws prohibiting a citizen from another state, either permanently or temporarily, were unconstitutional.” (23)

The Ideological & Religious Foundations of the American Civil War

This is another chapter of my Gettysburg text in which I lay out the ideological foundations of the Civil War. These are important not only to understand that war, but also to shed light on ongoing controversies in our own time in the United States, as well as understanding civil wars and conflicts in other nations.

“At length on 12th April, the tension could no longer bear the strain. Contrary to instructions, in the morning twilight, and when none could see clearly what the historic day portended, the Confederates in Charleston bombarded Fort Sumter, and the thunder of their guns announced that the argument of a generation should be decided by the ordeal of war. A war, not between two antagonistic political parties, but a struggle to the death between two societies, each championing a different civilization…” [1]

One can never separate war and the means by which it is fought from its political ends. War according to Clausewitz is an extension or continuation of politics. When the motivation behind those politics becomes more extreme and powerful, when the politics becomes more than disagreement, but where the ideologies behind the politics evokes hatred between peoples, war can come close to reaching the abstract concept of absolute or total war . Clausewitz wrote:

“The more powerful and inspiring the motives for war, the more they affect the belligerent nations and the fiercer the tensions that precede the outbreak, the closer will war approach its abstract concept, the more important will be the destruction of the enemy, the more closely will the military and the political objects of war coincide, and the more military and less political will war appear to be….” [2]

The American Civil War was the first modern war based on the advancement of technology and the changing character of war. But it was also a modern war which reached back to the most primal urges of the people involved. It was caused by the clash of radically different ideologies, ideologies which championed two very different views of civilization, government, economics and the rights of people. “Like the total wars of the twentieth century, it was preceded by years of violent propaganda, which long before the war had obliterated all sense of moderation, and had awakened in the contending parties the primitive spirit of tribal fanaticism.” [3] It was preceded by the fracturing of political parties and alliances which had worked for compromise in the previous decades to preserve the Union even at the cost of maintaining slavery. Far from being irrational as some have posited, the actions and behavior of politicians in both the North and the South was completely rational based on their conflicting ideologies and views of their opponents. The “South’s fears of territorial and economic strangulation and the North’s fears of a “slave power” conspiracy are anything but irrational, and only someone who refuses to think through the evidence available to Americans in the 1850s would find either of them at all illogical.” [4]

The very realistic fears of both sides brought about clash of extremes in politics which defied efforts at compromise and was already resulting in violent and bloody conflicts between ideologues in Kansas, Missouri and Kentucky years before the firing on Fort Sumter. For both sides their views became a moral cause that bordered on religious faith. British theorist and military historian J.F.C. Fuller wrote of it:

“As a moral issue, the dispute acquired a religious significance, state rights becoming wrapped up in a politico-mysticism, which defying definition, could be argued for ever without any hope of a final conclusion being reached.” [5]

That is why it impossible to simply examine the military campaigns and battles of the Civil War in isolation from the politics, polices, and the competing philosophy and theology which undergirded the arguments of both sides that brought on the war.

Some might wonder where this fits in a text that is about a specific campaign and battle in a war, but for those entrusted with planning national defense and conducting military campaign the understanding of why wars are fought, in particular the ideological causes of war matter in ways that military planners, commanders and even elected political leadership often overlook. Colin Gray notes: “Wars are not free floating events, sufficient unto themselves as objects for study and understanding. Instead, they are entirely the product of their contexts they are entirely the product of their contexts.” [6]

Studying the context of the American Civil War is very important in understanding not just it, but also civil wars in other nations which are currently raging. The study of these contexts brings an American or Western historical perspective to those wars, not so much in trying to place a western template over non-western conflicts; but a human perspective from our own past from which we can gain insight into how the people, even people who share a common language, religion and history, can war against each other in the most brutal of fashions.

For American and western political and military policy makers this is particularly important in Iraq where many Americans have fought, and the related civil war in Syria which has brought about the emergence of the Islamic State of Iraq and the Levant. Thus the study of the American Civil War, from the cultural, economic, social and religious aspects which divided the nation, helps us to understand how those factors influence politics, policy and the primal passions of the people which drive them to war.

The political ends of the Civil War came out of the growing cultural, economic, ideological and religious differences between the North and South that had been widening since the 1830s. The growing economic disparity between the Slave and Free states became more about the expansion of slavery in federal territories as disunion and war approached; for a number of often competing reasons. These differences were amplified by the issue of slavery led to the substitution of stereotypes of each other and had the “effect of changing men’s attitudes toward the disagreements which are always certain to arise in politics: ordinary, resolvable disputes were converted into questions of principle, involving rigid, unnegotiable dogma.” [7]

This was driven both by the South’s insistence on both maintaining slavery where it was already legal and expanding it into new territories which was set against the vocal abolitionist movement and the even more powerful economic concerns of many Northern industrialists who were not so idealistic, and much more concerned with “economic policy designed to secure Northern domination of Western lands than the initial step in a broad plan to end slavery.” [8]

This completion between the regions not only affected politics, it affected religion and culture In the South it produced a growing culture of victimhood which is manifest in the words of Robert Toombs who authored Georgia’s declaration of causes for secession:

“For twenty years past, the Abolitionists and their allies in the Northern states, have been engaged in constant efforts to subvert our institutions, and to excite insurrection and servile war among us…” whose “avowed purpose is to subject our society, subject us, not only to the loss of our property but the destruction of ourselves, our wives and our children, and the dissolution of our homes, our altars, and our firesides.” [9]

As the differences grew and tensions rose the South became ever more closed off from the North. “More than other Americans, Southerners developed a sectional identity outside the national mainstream. The Southern life style tended to contradict the national norm in ways that life styles of other sections did not.” [10] The complex relationship of Southern society where the “Southern bodies social, economic, intellectual, and political were decidedly comingled” [11] and politics of the South came more to embrace the need for slavery and its importance, even to poor whites in the South who it did not benefit and actually harmed economically: “the system of subordination reached out still further to require a certain kind of society, one in which certain questions were not publically discussed. It must give blacks no hope of cultivating dissention among the whites. It must commit nonslaveholders to the unquestioning support of racial subordination….In short, the South became increasingly a closed society, distrustful of isms from outside and unsympathetic to dissenters. Such were the pervasive consequences of giving top priority to the maintenance of a system of racial subordination.” [12]

Southern planters declared war on all critics of their “particular institution” beginning in the 1820s. As Northern abolitionists like William Lloyd Garrison and his newspaper The Liberator grew in its distribution and began to appear in the South various elected officials throughout the South “suppressed antislavery books, newspapers, lectures, and sermons and strove generally to deny critics of bondage access to any public forum.[13] In response to the proliferation of abolitionist literature in the South, John C. Calhoun proposed that Congress pass a law to prosecute “any postmaster who would “knowingly receive or put into the mail any pamphlet, newspaper, handbill, or any printed, written, or pictorial representation touching the subject of slavery.” [14] Beginning in 1836 the House of Representatives passed a “gag rule” which “banned all petitions, memorials, resolutions, propositions, or papers related in any way or to any extent whatever to the subject of slavery.” [15] This was challenged by former President John Quincy Adams in 1842 as well as by others so that in 1844 the House voted to rescind it. However Southern politicians “began to spout demands that the federal government and the Northern states issue assurances that the abolitionists would never be allowed to tamper with what John Calhoun had described as the South’s “peculiar domestic institution.” [16] The issue of slavery more than any other “transformed political action from a process of accommodation to a mode of combat.” [17]

Around the same time as the gag rule was played out in Congress the Supreme Court had ruled that the Federal government alone “had jurisdiction where escaped slaves were concerned” which resulted in several states enacting “personal liberty laws” to “forbid their own elected officials from those pursuing fugitives.” Southern politicians at the federal and state levels reacted strongly to these moves which they believed to be an assault on their institutions and their rights to their human property. Virginia legislators said these laws were a “disgusting and revolting exhibition of faithless and unconstitutional legislation.” [18]

The issue of slavery shaped political debate and “structured and polarized many random, unoriented points of conflict on which sectional interest diverged.” [19] As the divide grew leaders and people in both the North and the South began to react to the most distorted images of each other imaginable- “the North to an image of a southern world of lascivious and sadistic slave drivers; the South to the image of a northern world of cunning Yankee traders and radical abolitionists plotting slave insurrections.” [20]

Edmund Ruffin

Among the people most enraged by Northern opposition to slavery was Edmund Ruffin. Ruffin was a very successful farm paper editor, plantation owner and ardent old line secessionist from Virginia. In 1860 the then 67 year old Ruffin helped change the world forever when, according to popular legend he pulled the lanyard which fired the first shot at Fort Sumter. While he was there and probably was given the honor of firing the first shot from his battery; other guns from other emplacements may have fired first. [21]

Ruffin was a radical ideologue, he had been passionately arguing for secession and Southern independence for fifteen years. Ruffin “perceived the planter civilization of the South in peril; the source of the peril was “Yankee” and union with “Yankees.” Thus he preached revolution, Ruffin was a rebel with a cause, a secular prophet…” [22] He was a type of man who understood reality far better than some of the more moderate oligarchs that populated the Southern political and social elite. While in the years leading up to the war these men, including John Calhoun attempted to secure the continued existence and spread of slavery within the Union through the Congress and the courts, as early as 1850, Ruffin recognized that in order for slavery to survive the slaveholding South would have to secede from the Union. Ruffin and other radical secessionists believed that there could be no compromise with the north. In 1850 he and James Hammond attempted to use a meeting in Nashville to “secure Cooperative State Secession and wrote to Hammond, against those who sought to use the meeting to preserve the Union, “If the Convention does not open the way to dissolution…I hope it shall never meet.” [23] He believed that in order to maintain the institution of slavery the slave holding states that those states had to be independent from the North.

Ruffin’s views were not unique to him, the formed the basis of how most slave owners and supporters felt about slavery’s economic benefits, Ruffin wrote:

“Still, even this worst and least profitable kind of slavery (the subjection of equals and men of the same race with their masters) served as the foundation and the essential first cause of all the civilization and refinement, and improvement of arts and learning, that distinguished the oldest nations. Except where the special Providence and care of God may have interposed to guard a particular family and its descendants, there was nothing but the existence of slavery to prevent any race or society in a state of nature from sinking into the rudest barbarism. And no people could ever have been raised from that low condition without the aid and operation of slavery, either by some individuals of the community being enslaved, by conquest and subjugation, in some form, to a foreign and more enlightened people.”[24]

The Ante-Bellum South was an agrarian society which depended on the free labor provided by slaves and in a socio-political sense it was an oligarchy that offered no freedom to slaves, openly discriminated against free blacks and provided little hope of social or economic advancement for poor and middle class whites.

Over a period of a few decades, Northern states abolished slavery in the years after the United States had gained independence.

The South tied its economy and society to the institution of slavery, and was not content to see it remain just in the original states of the Old South.

The expansion of slavery was essential to its continued maintenance in the states where it was already legal. “Because of the need to maintain a balance in the Senate, check unruly slaves, and cultivate fertile soils, many planters and small plantation owners- particularly those living in the southern districts of the cotton states- asserted that their survival depended on new territory.” [25] In those decades “a huge involuntary migration took place. Between 800,000 and 1 million slaves were moved westward….” [26]

The need for slaves caused prices to soar. In some older states like Virginia where fewer slaves were required the exportation of slaves became a major industry:

“male slaves were marched in coffles of forty or fifty, handcuffed to each other in pairs, with a long chain through the handcuffs passing down the column to keep it together, closely guarded by mounted slave traders followed by an equal number of female slaves and their children. Most of them were taken to Wheeling, Virginia, the “busiest slave port” in the United States, and from there they were transported by steamboat to New Orleans, Natchez, and Memphis.” [27]

In the years the before the war, the North embraced the Industrial Revolution leading to advances which gave it a marked economic advantage over the South. The population of the North also expanded at a clip that far outpaced the South as European immigrants swelled the population.

The divide was not helped by the various compromises worked out between northern and southern legislators. After the Missouri Compromise Thomas Jefferson wrote:

“but this momentous question, like a fire bell in the night, awakened and filled me with terror. I considered it at once as the knell of the Union. It is hushed indeed for the moment, but this is a reprieve only, not a final sentence. A geographical line, coinciding with a marked principle, moral and political, once conceived and held up to the angry passions of men, will never be obliterated; and every new irritation will mark it deeper and deeper.”[28]

The trigger for the increase in tensions was the war with Mexico in which the United States annexed nearly half of Mexico. The new territories were viewed by those who advocated the expansion of slavery as fresh and fertile ground for its spread. Ulysses S Grant noted the effects of the war with Mexico in his memoirs:

“In taking military possession of Texas after annexation, the army of occupation, under General [Zachary] Taylor, was directed to occupy the disputed territory.  The army did not stop at the Nueces and offer to negotiate for a settlement of the boundary question, but went beyond, apparently in order to force Mexico to initiate war….To us it was an empire and of incalculable value; but it might have been obtained by other means.  The Southern rebellion was largely the outgrowth of the Mexican war.”[29]

In the North a strident abolitionist movement took root. It developed during the 1830s in New England as a fringe movement among the more liberal elites, inspired by the preaching of revivalist preacher Charles Finney who “demanded a religious conversion with a political potential more radical than the preacher first intended.” [30] Finney’s preaching was emboldened and expanded by the American Anti-Slavery Society founded by William Lloyd Garrison “which launched a campaign to change minds, North and South, with three initiatives, public speeches, mass mailings and petitions.” [31] Many of the speakers were seminary students and graduates of Lane Seminary in Cincinnati, who became known as “the Seventy” who received training and then “fanned out across the North campaigning in New England, Pennsylvania, New York, Ohio, Indiana and Michigan[32] where many received hostile receptions, and encountered violence. Garrison used his newspaper, The Liberator to “pledge an all-out attack on U.S. slavery.” [33]

The abolition movement aimed to not only stop the spread of slavery but to abolish it. The latter was something that many in the North who opposed slavery’s expansion were often either not in favor of, or indifferent to. The movement was a boost by the huge popularity of Harriett Beecher Stowe’s 1852 novel Uncle Tom’s Cabin “a vivid, highly imaginative, best-selling, and altogether damning indictment of slavery” [34] the abolitionist movement gained steam and power and “raised a counterindignation among Southerners because they thought Mrs. Stowe’s portrait untrue…” [35] The images in Stowe’s book “were irredeemably hostile: from now on the Southern stereotype was something akin to Simon Legree.” [36]

The leaders of the Abolitionist movement who had fought hard against acts the Fugitive Slave Act and the Dred Scott decision were now beginning to be joined by a Northern population that was becoming less tolerant of slavery and the status quo. With the formation of the Republican Party in 1854, a party founded on opposition to the expansion of slavery in the territories found a formidable political voice and became part of a broad coalition of varied interests groups whose aspirations had been blocked by pro-slavery Democrats. These included “agrarians demanding free-homestead legislation, Western merchants desiring river and harbor improvements at federal expense, Pennsylvania ironmasters and New England textile merchants in quest of higher tariffs.” They also made headway in gaining the support of immigrants, “especially among the liberal, vocal, fiercely anti-slavery Germans who had recently fled the Revolution of 1848.” [37] One of those German immigrants, Carl Schurz observed that “the slavery question” was “not a mere occasional quarrel between two sections of the country, divided by a geographic line” but “a great struggle between two antagonistic systems of social organization.” [38]

In light of the threat posed to slavery by the emerging abolitionist movement forced slaveholders to shift their defense of slavery from it being simply a necessary evil. Like in the North where theology was at the heart of many abolitionist arguments, in the South theology was used to enshrine and defend the institution of slavery. The religiously based counter argument was led by the former Governor of South Carolina, John Henry Hammond. Hammond’s arguments included biblical justification of blacks being biologically inferior to whites and slavery being supported in the Old Testament where the “Hebrews often practiced slavery” and in the New testament where “Christ never denounced servitude.” [39] Hammond warned:

“Without white masters’ paternalistic protection, biologically inferior blacks, loving sleep above all and “sensual excitements of all kinds when awake” would first snooze, then wander, then plunder, then murder, then be exterminated and reenslaved.” [40]

Others in the South, including politicians, pundits and preachers “were preaching “that slavery was an institution sanction by God, and that even blacks profited from it, for they had been snatched out of pagan and uncivilized Africa and been given the advantages of the gospel.” [41]

Slave owners frequently expressed hostility to independent black churches and conducted violence against them, and “attacks on clandestine prayer meetings were not arbitrary. They reflected the assumption (as one Mississippi slave put it) “that when colored people were praying [by themselves] it was against them.” [42] But some Southern blacks accepted the basic tenets do slave owner-planter sponsored Christianity. Douglass wrote “many good, religious colored people who were under the delusion that God required them to submit to slavery and wear their chains with weakness and humility.” [43]

The political and cultural rift began to affect entire church denominations, beginning with the Methodists who in “1844 the Methodist General Conference condemned the bishop of Georgia for holding slaves, the church split and the following year saw the birth of the Methodist Episcopal Church.” The Baptists were next, when the Foreign Mission Board “refused to commission a candidate who had been recommended by the Georgia Baptist Convention, on the ground that he owned slaves” [44] resulting in the formation of the Southern Baptist Convention. The Baptist split is interesting because until the early 1800s there existed a fairly strong anti-slavery movement in states such as Kentucky, while in 1790 the General Committee of Virginia “adopted a statement calling slavery “a violent deprivation of the rights of nature, and inconsistent with a republican government; and therefore [we] recommend it to our brethren to make use of every legal measure, to extirpate the horrid evil from the land.” [45] However, in many parts of the Deep South there existed no such sentiment and in South Carolina noted Baptist preachers including “Richard Furman, Peter Bainbridge, and Edmund Botsford were among the larger slaveholders.” [46] Furman wrote a defense of slavery in 1822 where he made the argument that “the right of holding slaves is clearly established in the Holy Scriptures by precept and example.” [47] After a number of slave uprisings, including the Nat Turner Revolt in Virginia, pro-slavery voices “tended to silence any remaining antislavery voices in the South.” [48] These voices grew more ever more strident and in 1835 the Charleston Association “adopted a militant defense of slavery, sternly chastising abolitionists as “mistaken philanthropists, and denuded and mischievous fanatics.” [49] Those who met in Augusta Georgia to found the new Southern Baptist Convention indicated that “the division was “painful” but necessary because” our brethren have pressed upon every inch of our privileges and our sacred rights.” [50] Since the Baptist split was brought about by the refusal of the Triennial Convention to appoint slaveholders as foreign missionaries the new convention emphasized the theological nature of their decision:

“Our objects, then, are the extension of the Messiah’s kingdom, and the glory of God. Not disunion with any of his people; not the upholding of any form of civil rights; but God’s glory, and Messiah’s increasing reign; in the promotion of which, we find no necessity for relinquishing any of our civil rights. We will never interfere with what is Caesar’s. We will not compromit what is God’s.” [51]

Of course what was Caesar’s was obviously the institution of slavery.

The last denomination to split was the Presbyterians in 1861 who, “reflecting the division of the nation, the Southern presbyteries withdrew from the Presbyterian Church and founded their own denomination.” [52] Southern churches and church leaders were among the most enthusiastic voices for disunion and secession. The preachers who had called for separation from their own national denominations years before the war now “summoned their congregations to leave the foul Union and then to cleanse their world.” [53] The Reverend William Leacock of Christ Church, New Orleans declared in his Thanksgiving sermon “Our enemies…have “defamed” our characters, “lacerated” our feelings, “invaded “our rights, “stolen” our property, and let “murderers…loose upon us, stimulated by weak or designing or infidel preachers. With “the deepest and blackest malice,” they have “proscribed” us “as unworthy members… of the society of men and accursed before God.” Unless we sink to “craven” beginning that they “not disturb us,…nothing is now left us but secession.” [54]

From “the beginning of the war southern churches of all sorts with few exceptions promoted the cause militant” [55] and supported war efforts. Bishop Leonidas Polk, the Episcopal Bishop of Louisiana, who had been a classmate of Jefferson Davis at West Point was commissioned as a Major General and appointed to command the troops in the Mississippi Valley. Polk did not resign his ecclesiastical office, and “Northerners expressed horror at such sacrilege, but Southerners were delighted with this transfer from the Army of the Lord.” [56] Lee’s chief of Artillery Brigadier General William Pendleton was also an academy graduate and an Episcopal Priest. By its donations of “everything from pew cushions to brass bells, Southern churches gave direct material aid to the cause. Among all the institutions in Southern life, perhaps the church most faithfully served the Confederate Army and nation.” [57]

Sadly, the denominational rifts persisted until well into the twentieth century. The Presbyterians and Methodists both eventually reunited but the Baptists did not, and eventually “regional isolation, war bitterness, and differing emphasis in theology created chasms by the end of the century which leaders of an earlier generation could not have contemplated.” [58] The Southern Baptist Convention is now the largest Protestant denomination in the United States and many of its preachers are active in often divisive conservative social and political causes. The denomination that it split from, the American Baptist Convention, though much smaller remains a diverse collection of conservative and progressive local churches. Some of these are still in the forefront of the modern civil rights movement, including voting rights, women’s rights and LGBT issues, all of which find some degree of opposition in the Southern Baptist Convention.

As the 1850s wore on the divisions over slavery became deeper and voices of moderation retreated. The trigger for the for the worsening of the division was the political battle regarding the expansion of slavery, even the status of free blacks in the north who were previously slaves, over whom their owners asserted their ownership. Southerners considered the network to help fugitive slaves escape to non-slave states, called the Underground Railroad “an affront to the slaveholders pride” and “anyone who helped a man or woman escape bondage was simply a thief” who had robbed them of their property and livelihood, as an “adult field hand could cost as much as $2000, the equivalent of a substantial house.” [59]

In 1856 the Supreme Court, dominated by southern Democrats ruled in favor of southern views in the Dred Scott decision one pillar of which gave slavery the right to expand by denying to Congress the power to prohibit slavery in Federal territories. The decision was momentous but it was a failure, but it was a disaster for the American people. It solved nothing and further divided the nation:

“In the South, for instance, it encouraged southern rights advocates to believe that their utmost demands were legitimatized by constitutional sanction and, therefore, to stiffen their insistence upon their “rights.” In the North, on the other hand, it strengthened a conviction that an aggressive slavocracy was conspiring to impose slavery upon the nation, and that any effort to reach an accommodation with such aggressors was futile. While strengthening the extremists, it cut the ground from under the moderates.” [60]

The decision in the case is frightening when one looks upon its tenor and implications. The majority opinion which was written by Chief Justice Roger Taney was chilling, not only in its views of race, but the fact that blacks were perpetually property without the rights of citizens. Taney wrote:

“Can a negro, whose ancestors were imported into this country, sold as slaves, become a member of the political community formed and brought into existence by the Constitution of the United States, and as such become entitled to all the rights, and privileges, and immunities, guaranteed by that instrument to the citizen?…It is absolutely certain that the African race were not included under the name of citizens of a state…and that they were not included, and were not intended to be included, under the word “citizens” in the Constitution, and therefore claim none of the rights and privileges which that instrument provides for and secures to citizens of the United States. On the contrary, they were at that time considered as a subordinate and inferior class of beings, who had been subjugated by the dominant race, and, whether emancipated or not, yet remain subject to their authority, and had no rights or privileges but those who held the power and the Government might choose to grant them” [61]

The effect of the ruling on individuals and the states was far reaching. “No territorial government in any federally administered territory had the authority to alter the status of a white citizen’s property, much less to take that property out of a citizen’s hands, without due process of law or as punishment for some crime.” [62] Free slaves were no longer safe, even in Free States from the possibility of being returned to slavery, because they were property.

But the decision had been influenced by President-Elect James Buchanan’s secret intervention in the Supreme Court deliberations two weeks before his inauguration. Buchanan hoped by working with the Justices that he save the Union from breaking apart by appeasing slave owners and catering to their agenda. “The president-elect wanted to know not only when, but if the Court would save the new administration and the Union from the issue of slavery in the territories. Would the judges thankfully declare the explosive subject out of bounds, for everyone who exerted federal power? The shattering question need never bother President Buchanan.” [63] In his inaugural address he attempted to camouflage his intervention and “declared that the Court’s decision, whatever it turned out to be, would settle the slavery issue forever.” [64]

But Buchanan was mistaken, the case made the situation even more volatile as it impaired “the power of Congress- a power which had remained intact to this time- to occupy the middle ground.” [65] Taney’s decision held that Congress “never had the right to limit slavery’s expansion, and that the Missouri Compromise had been null and void on the day of its formulation.” [66]

The decision ignited a firestorm in the north where Republicans now led by Abraham Lincoln decried the decision and southerners basked in their judicial victory. Northerners quite rightly feared that an activist court would rule to deny their states the right to forbid slavery. As early as 1854 Lincoln posed the idea that the Declaration of Independence was “the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.” [67]

But after the Dred Scott decision Lincoln warned that the Declaration was being cheapened and diluted. Not only that, Lincoln asked the logical question regarding Taney’s judicial activism. How long would it be, asked Abraham Lincoln, before the Court took the next logical step and ruled explicitly that:

“the Constitution of the United States does not permit a state to exclude slavery from its limits?” How far off was the day when “we shall lie down pleasantly thinking that the people of Missouri are on the verge of making their State free; and shall awake to the reality, instead, that the Supreme Court has made Illinois a slave State?” [68]

Lincoln discussed the ramification of the ruling for blacks, both slave and free:

“to aid in making the bondage of the Negro universal and eternal….All the powers of the earth seem rapidly combining against him. Mammon is after him; ambition follows, and philosophy follows, and the theology of the day is fast joining the cry. They have him in his prison house;…One after another they have closed the heavy doors upon him…and they stand musing as to what invention, in all the dominions of mind and matter, can be produced the impossibility of his escape more complete than it is.” [69]

In response to the decision the advocates of the expansion of slavery not only insisted on its westward expansion in Federal territories but to Panama, Nicaragua and Cuba as well. In 1857 Jefferson Davis further provoked northern ire when he insisted that “African Slavery as it exists in the United States is a moral, a social, and a political blessing.” [70]

Southern leaders poured political, human and economic capital into the struggle for the imposition of slavery on the Kansas Territory. Victory in Kansas meant “two new U.S. Senators for the South. If a free labor Kansas triumphed, however, the North would gain four senators: Kansas’s immediately and Missouri’s soon.” [71]

Rich Southerners recruited poor whites to fight their battles to promote the institution of slavery. Jefferson Buford of Alabama recruited hundreds of non-slaveholding whites to move to Kansas. Buford claimed to defend “the supremacy of the white race” he called Kansas “our great outpost” and warned that “a people who would not defend their outposts had already succumbed to the invader.” [72] To this end he and 415 volunteers went to Kansas, where they gained renown and infamy as members of “Buford’s Cavalry.” The day they left Montgomery they were given a sendoff. Each received a Bible, and the “holy soldiers elected Buford as their general. Then they paraded onto the steamship Messenger, waving banners conveying Buford’s twin messages: “The Supremacy of the White Race” and “Kansas the Outpost.” [73] His effort ultimately failed but he had proved that “Southern poor men would kill Yankees to keep blacks ground under.” [74]

The issue in Kansas was bloody and full of political intrigue over the Lecompton Constitution which allowed slavery, but which had been rejected by a sizable majority of Kansas residents, so much so that Kansas would not be admitted to the Union until after the secession of the Deep South. But the issue so galvanized the North that for the first time a coalition of “Republicans and anti-Lecompton Douglas Democrats, Congress had barely turned back a gigantic Slave Power Conspiracy to bend white men’s majoritarianism to slavemaster’s dictatorial needs, first in Kansas, then in Congress.” [75]

Taking advantage of the judicial ruling Davis and his supporters in Congress began to bring about legislation not just to ensure that Congress could not “exclude slavery” but to protect it in all places and all times. They sought a statute that would explicitly guarantee “that slave owners and their property would be unmolested in all Federal territories.” This was commonly known in the south as the doctrine of positive protection, designed to “prevent a free-soil majority in a territory from taking hostile action against a slave holding minority in their midst.” [76]

Other extremists in the Deep South had been long clamoring for the reopening of the African slave trade. In 1856 a delegate at the 1856 commercial convention insisted that “we are entitled to demand the opening of this trade from an industrial, political, and constitutional consideration….With cheap negroes we could set hostile legislation at defiance. The slave population after supplying the states would overflow to the territories, and nothing could control its natural expansion.” [77] and in 1858 the “Southern Commercial Convention…” declared that “all laws, State and Federal, prohibiting the African slave trade, out to be repealed.” [78] The extremists knowing that such legislation would not pass in Congress then pushed harder; instead of words they took action.

In 1858 there took place two incidents that brought this to the fore of political debate. The schooner Wanderer owned by Charles Lamar successfully delivered a cargo of four hundred slaves to Jekyll Island, earning him “a large profit.” [79] Then the USS Dolphin captured “the slaver Echo off Cuba and brought 314 Africans to the Charleston federal jail.” [80] The case was brought to a grand jury who had first indicted Lamar were so vilified that “they published a bizarre recantation of their action and advocated the repeal of the 1807 law prohibiting the slave trade. “Longer to yield to a sickly sentiment of pretended philanthropy and diseased mental aberration of “higher law” fanatics…” [81] Thus in both cases juries and judges refused to indict or convict those responsible.

There arose in the 1850s a second extremist movement in the Deep South, this one which had at its heart the mission to re-enslave free blacks. This effort was not limited to fanatics, but entered the Southern political mainstream, to the point that numerous state legislatures were nearly captured by majorities favoring such action. [82] That movement which had appeared out of nowhere soon fizzled, as did the bid to reopen the slave trade, but these “frustrations left extremists the more on the hunt for a final solution” [83] which would ultimately be found in secession.

Previously a man of moderation Lincoln laid out his views in the starkest terms in his House Divided speech given on June 16th 1858. Lincoln understood, possibly with more clarity than others of his time that the divide over slavery was deep and that the country could not continue to exist while two separate systems contended with one another. The Union Lincoln “would fight to preserve was not a bundle of compromises that secured the vital interests of both slave states and free, …but rather, the nation- the single, united, free people- Jefferson and his fellow Revolutionaries supposedly had conceived and whose fundamental principles were now being compromised.” [84] He was to the point and said in clear terms what few had ever said before, in language which even some in his own Republican Party did not want to use because they felt it was too divisive:

“If we could first know where we are and whither we are tending, we could better judge what to do and how to do it. We are now far into the fifth year since a policy was initiated with the avowed object and confident promise of putting an end to slavery agitation. Under the operation of that policy, that agitation has not only not ceased but has constantly augmented. In my opinion, it will not cease until a crisis shall have been reached and passed. “A house divided against itself cannot stand.” I believe this government cannot endure, permanently, half slave and half free. I do not expect the Union to be dissolved; I do not expect the house to fall; but I do expect it will cease to be divided. It will become all one thing, or all the other. Either the opponents of slavery will arrest the further spread of it and place it where the public mind shall rest in the belief that it is in the course of ultimate extinction, or its advocates will push it forward till it shall become alike lawful in all the states, old as well as new, North as well as South.” [85]

Part of the divide was rooted in how each side understood the Constitution. For the South it was a compact among the various states, or rather “only a league of quasi independent states that could be terminated at will” [86] and in their interpretation States Rights was central. In fact “so long as Southerners continued to believe that northern anti-slavery attacks constituted a real and present danger to Southern life and property, then disunion could not be ruled out as an ugly last resort.” [87]

But such was not the view in the North, “for devout Unionists, the Constitution had been framed by the people rather than created as a compact among the states. It formed a government, as President Andrew Jackson insisted of the early 1830s, “in which all the people are represented, which operates directly on the people individually, not upon the States.” [88] Lincoln like many in the North understood the Union that “had a transcendent, mystical quality as the object of their patriotic devotion and civil religion.” [89]

Lincoln’s beliefs can be seen in the Gettysburg Address where he began his speech with the words “Four score and seven years ago our fathers brought forth on this continent, a new nation, conceived in Liberty, and dedicated to the proposition that all men are created equal…” To Lincoln and others the word disunion “evoked a chilling scenario within which the Founders’ carefully constructed representative government failed, triggering “a nightmare, a tragic cataclysm” that would subject Americans to the kind of fear and misery that seemed to pervade the rest of the world.” [90]

Those same beliefs were found throughout the leaders of the Abolition movement, including Theodore Parker who said “The first [step] is to establish Slavery in all of the Northern States- the Dred Scott decision has already put it in all the territories….I have no doubt The Supreme Court will make the [subsequent] decisions.[91]

Even in the South there was a desire for the Union and a fear over its dissolution, even among those officers like Robert E. Lee who would resign his commission and take up arms against the Union in defense of his native state. Lee wrote to his son Custis in January 1861, “I can anticipate no greater calamity for the country than the dissolution of the Union…I am willing to sacrifice everything but honor for its preservation…Secession is nothing but revolution.” But he added “A Union that can only be maintained by swords and bayonets has no charms for me….” [92] The difference between Lee and others like him and Abraham Lincoln was how they viewed the Union, views which were fundamentally opposed.

In the North there too existed an element of fanaticism. While “the restraining hand of churches, political parties and familial concerns bounded other antislavery warriors,” [93] and while most abolitionists tried to remain in the mainstream and work through legislation and moral persuasion to halt the expansion of slavery with the ultimate goal of emancipation, there were fanatical abolitionists that were willing to attempt to ignite the spark which would cause the powder keg of raw hatred and emotion to explode.

Most prominent among these men was John Brown. Brown was a “Connecticut-born abolitionist…a man with the selfless benevolence of the evangelicals wrought into a fiery determination to crush slavery” [94] who as early as 1834 was “an ardent sympathizer the Negroes” desiring to raise a black child in his own home and to “offering guidance to a colony of Negroes on the farm of the wealthy abolitionist Gerrit Smith at North Elba New York.” [95] Brown regarded moderate free-staters with distain and in Kansas set about to change the equation when he and a company of his marauders set upon and slaughtered the family of a pro-slavery settler at Pottawatomie Creek. [96]

Brown was certainly “a religious zealot…but was nevertheless every much the product of his time and place….” [97] Brown was a veteran of the violent battles in Kansas where he had earned the reputation as “the apostle of the sword of Gideon” as he and his men battled pro-slavery settlers. Brown was possessed by the belief that God had appointed him as “God’s warrior against slaveholders.” [98] He despised the peaceful abolitionists and demanded action. “Brave, unshaken by doubt, willing to shed blood unflinchingly and to die for his cause if necessary, Brown was the perfect man to light the tinder of civil war in America, which was what he intended to do.” [99]

Brown’s attempt to seize 10,000 muskets at the Federal armory in Harper’s Ferry Virginia in order to ignite a slave revolt was frustrated and Brown captured, by a force of U.S. Marines led by Colonel Robert E. Lee and Lieutenant J.E.B. Stuart. Brown was tried and hung, but his raid “effectively severed the country into two opposing parts, making it clear to moderates there who were searching for compromise, that northerner’s tolerance for slavery was wearing thin.” [100]

It now did not matter that Brown was captured, tried, convicted and executed for his raid on Harper’s Ferry. He was to be sure was “a half-pathetic, half-mad failure, his raid a crazy, senseless exploit to which only his quiet eloquence during trial and execution lent dignity” [101] but his act was the watershed from which the two sides would not be able to recover, the population on both sides having gone too far down the road to disunion to turn back.

Brown had tremendous support among the New England elites, the “names of Howe, Parker, Emerson and Thoreau among his supporters.” [102] To abolitionists he had become a martyr “but to Frederick Douglass and the negroes of Chatham, Ontario, nearly every one of whom had learned something from personal experience on how to gain freedom, Brown was a man of words trying to be a man of deeds, and they would not follow him. They understood him, as Thoreau and Emerson and Parker never did.” [103]

But to Southerners Brown was the symbol of an existential threat to their way of life. In the North there was a nearly religious wave of sympathy for Brown, and the “spectacle of devout Yankee women actually praying for John Brown, not as a sinner but as saint, of respectable thinkers like Thoreau and Emerson and Longfellow glorifying his martyrdom in Biblical language” [104] horrified Southerners, and drove pro-Union Southern moderates into the secession camp.

The crisis continued to fester and when Lincoln was elected to the Presidency in November 1860 with no southern states voting Republican the long festering volcano erupted. It did not take long before southern states began to secede from the Union. South Carolina was first, followed by Mississippi, Florida, Alabama, Georgia, Louisiana and Texas. Many of the declarations of causes for secession made it clear that slavery was the root cause. The declaration of South Carolina is typical of these and is instructive of the basic root cause of the war:

“all the States north of that line have united in the election of a man to the high office of President of the United States, whose opinions and purposes are hostile to slavery. He is to be entrusted with the administration of the common Government, because he has declared that that “Government cannot endure permanently half slave, half free,” and that the public mind must rest in the belief that slavery is in the course of ultimate extinction.”[105]

Throughout the war slavery loomed large. In his First Inaugural Address Lincoln noted: “One section of our country believes slavery is right and ought to be extended, while the other believes it is wrong and ought not to be extended. This is the only substantial dispute.”[106] Of course he was right, and his southern opponents agreed.

Alexander Stephens the Vice President of the Confederacy noted in his Cornerstone Speech of March 21st 1861 that: “Our new government is founded upon exactly the opposite idea; its foundations are laid, its corner- stone rests upon the great truth, that the negro is not equal to the white man; that slavery — subordination to the superior race — is his natural and normal condition. [Applause.] This, our new government, is the first, in the history of the world, based upon this great physical, philosophical, and moral truth.”[107]

Thus the American ideological war was born, as J.F.C. Fuller wrote:

After the bloody battle of Antietam, Lincoln published the emancipation proclamation in which he proclaimed the emancipation of slaves located in the Rebel states, and that proclamation had more than a social and domestic political effect, it ensured that Britain would not intervene.

In his Second Inaugural Address Lincoln discussed the issue of slavery as being the cause of the war:

“One-eighth of the whole population were colored slaves, not distributed generally over the Union, but localized in the southern part of it. These slaves constituted a peculiar and powerful interest. All knew that this interest was somehow the cause of the war. To strengthen, perpetuate, and extend this interest was the object for which the insurgents would rend the Union even by war, while the Government claimed no right to do more than to restrict the territorial enlargement of it. Neither party expected for the war the magnitude or the duration which it has already attained. Neither anticipated that the cause of the conflict might cease with or even before the conflict itself should cease. Each looked for an easier triumph, and a result less fundamental and astounding. Both read the same Bible and pray to the same God, and each invokes His aid against the other. It may seem strange that any men should dare to ask a just God’s assistance in wringing their bread from the sweat of other men’s faces, but let us judge not, that we be not judged. The prayers of both could not be answered. That of neither has been answered fully. The Almighty has His own purposes. “Woe unto the world because of offenses; for it must needs be that offenses come, but woe to that man by whom the offense cometh.” If we shall suppose that American slavery is one of those offenses which, in the providence of God, must needs come, but which, having continued through His appointed time, He now wills to remove, and that He gives to both North and South this terrible war as the woe due to those by whom the offense came, shall we discern therein any departure from those divine attributes which the believers in a living God always ascribe to Him? Fondly do we hope, fervently do we pray, that this mighty scourge of war may speedily pass away. Yet, if God wills that it continue until all the wealth piled by the bondsman’s two hundred and fifty years of unrequited toil shall be sunk, and until every drop of blood drawn with the lash shall be paid by another drawn with the sword, as was said three thousand years ago, so still it must be said “the judgments of the Lord are true and righteous altogether.”[108]

When Edmund Ruffin pulled the lanyard of the cannon that fired the first shot at Fort Sumter it marked the end of an era and despite Ruffin, Stephens and Davis’ plans gave birth to what Lincoln would describe as “a new birth of freedom.”

When the war ended with the Confederacy defeated and the south in ruins, Ruffin still could not abide the result. In a carefully crafted suicide note he sent to his son the bitter and hate filled old man wrote on June 14th 1865:

“… And now with my latest writing and utterance, and with what will be near my last breath, I here repeat and would willingly proclaim my unmitigated hatred to Yankee rule — to all political, social and business connections with Yankees, and the perfidious, malignant and vile Yankee race.” [109]

Though Ruffin was dead in the coming years the southern states would again find themselves under the governance of former secessionists who were unabashed white supremacists. By 1877 many southerners we taking as much pride in the “Lost Cause” as Northerners took in Appomattox.[110] This led to nearly a hundred more years of effective second class citizenship for now free blacks who were often deprived of the vote and forced into “separate but equal” public and private facilities, schools and recreational activities. The Ku Klux Klan and other violent organizations harassed, intimidated, persecuted and used violence against blacks. Lynching was common and even churches were not safe. It would not be until the Civil Rights movement of the 1950s and 1960s that blacks would finally begin to gain the same rights enjoyed by whites in most of the south.

Ruffin outlived Lincoln who was killed by the assassin John Wilkes Booth on April 14th 1864. However the difference between the two men was marked. In his Second Inaugural Address Lincoln spoke in a different manner than Ruffin. He concluded that address with these thoughts:

“With malice toward none, with charity for all, with firmness in the right as God gives us to see the right, let us strive on to finish the work we are in, to bind up the nation’s wounds, to care for him who shall have borne the battle and for his widow and his orphan, to do all which may achieve and cherish a just and lasting peace among ourselves and with all nations.” [111]

Though the issues may be different in nations where the United States decides to intervene to prevent humanitarian disasters, prevent local civil wars from becoming regional conflagrations, or to provide stability after a civil war, the controversies and conflicts brought on by the ideological, social and religious divides in the Ante-Bellum United States provide planners and commanders a historical example, drawn from our own American history of the necessity of understanding the political, ideological, economic, social and religious seeds of conflict. By taking the time to look at our own history, planners, commanders and policy makers can learn lessons that if they take the time to do so will help them understand such factors in places American troops and their allies might be called to serve. It also shows, through the wisdom of Britain’s non-intervention the importance of staying out of some conflicts.
