“And They Shall Be Your Possession” The Beginnings of American Slavery

Tonight I am posting a section of my book “Mine Eyes Have Seen the Glory” Race, Religion, Ideology and Politics in the Civil War Era. My agent and I both think that it is a story that needs to be told, not only because of how much it matters to history but how much it matters today. Sadly there are people today, even in the United States who feel that the lives of others, especially those of darker skin color or of the female gender should be their possession and that they should be allowed to exploit them from generation to generation. This is nothing new.

The Slave Economy and the Divide between North and South

“Thy bond-men and thy bond-maids which thou shalt have, shall be of the heathen that are round about you: of them you shall buy bond-men and bond-maids. Moreover, of the children of the strangers that do sojourn among you, of them he shall buy, and of their families that are with you, which they begat in your land. And they shall be your possession. And you shall take them as an inheritance for your children after you, they shall be your bond-men forever.” Leviticus 25:44-46

Early Slavery in the Americas and the African Slave Trade

If we are to really understand the Civil War we have to understand the ideological clash between Abolitionists in the North, and Southern proponents of slavery. Slavery began very early in the history of the American colonies and though the British and the Dutch were the largest traders of slaves in those early days, the first American slave ship made its first voyage to bring Africans to the new world. Historian Howard Zinn noted, “By 1800, 10 to 15 million blacks had been transported to the Americas, representing perhaps one-third of those originally seized in Africa. It is roughly estimated that Africa lost 50 million human beings to death and slavery in those centuries we call the beginnings of modern Western civilization, at the hands of slave traders and plantation owners in Western Europe and America, the countries deemed the most advanced in the world.” [1]

Slavery in the Americas grew out of the economic need of planters to for laborers on the vast plantations of the new world as “the number of arriving whites, whether free or indentured servants (under four to seven year contract) was not enough to meet the demand of the plantations.” [2] This need and use of slaves was significantly different than previous forms of slavery in Africa, where slavery was one of a number of forms of labor, and where slaves “worked within the households of their owners and had well-defined rights, such as possessing property and marrying free persons. It was not uncommon for slaves in Africa to acquire their freedom.” [3] In fact the plantation form of slavery practiced in the Americas differed radically from traditional forms of African slavery and was characterized by “the frenzy for limitless profit that comes from capitalistic agriculture; the reduction of the slave to less than human status by the use of race hatred, with that relentless clarity based on color, where white was master, black was slave.” [4]

However in the Americas slavery took on a new form, that of the plantation. The plantation system allowed owners to amass “large concentrations of laborers under the control of a single owner produced goods – sugar, tobacco, rice, and cotton – for the free market.” [5] Beginning with the Spanish and the Portuguese in the early 1500s, the African slave trade became a major part of the world economy, and “slave labor played an indispensable part in its rapid growth” [6] not only in world economy, but in the economy of the English colonies in North America and the new American nation which paradoxically was founded and supposed dedicated to liberty and equality. The “Atlantic slave trade, which flourished from 1500 into the nineteenth century was a regularized business in which European merchants, African traders, and American planters engaged in a highly complex and profitable bargaining in human lives.” [7]

It was economic gain that prompted the growth in slavery, and for which slaves were essential for profit. As such, the “first mass consumer goods in international trade were produced by slaves – sugar, rice, coffee, and tobacco. The profits from slavery stimulated the rise of British ports such as Liverpool and Bristol, and the growth of banking, shipbuilding, and insurance, and helped to finance the early industrial revolution. The centrality of slavery to the British empire encouraged an ever-closer identification of freedom with whites and slavery with blacks.” [8]

The Constitution, Slavery and Disunion

When the United State won its independence the founders of the new nation had to deal with the already existing institution of slavery. It also had to deal with the threat to the Union that the institution and the real possibility of disunion, something that almost all of them feared more than anything. Slavery was an institution that even some powerful politicians who owned slaves were uncomfortable; Patrick Henry noted in 1773 that “to do so was “repugnant to humanity” and “inconsistent with the Bible,” while George Washington wrote in 1786 “There is not a man living…who wishes more sincerely than I do, to see a plan for the gradual abolition of it.” [9]

Slavery was an issue that divided the newly independent states as they gathered for the Constitutional Convention in 1787 and Washington confided to a friend before the convention that “he could “foresee no greater evil than disunion,” and now the “mere discussion of slavery” was poisoning the atmosphere.” [10] James Madison was one of the first to recognize this and noted that “the states differed “primarily from the effects of their having or not having slaves.” [11] The issue came to a head around how the population of the states would be represented in the new government and how to balance the power between the federal government and the various state governments. To do this the founders divided Congress into two houses, the House of Representatives who were directly elected by the voters of each state with the population of the state determining the number of representative each would have; and in the Senate, whose members were elected by the state legislatures, each state would have two members regardless of the size of its population. The division of the legislature in the Constitution “enabled the individual states to retain a large measure of their jealously guarded autonomy.” [12] Eligible voters in each state elected the President by electing “electors” for the Electoral College, and each state was given an amount of electors equal to its representation in the Senate and the House of Representatives.

The heart of the matter came to the issue of what people would be counted in each state. The Northern states wanted to base the number on each state’s white population. The Southern states wanted to “swell their power by counting both white citizens and black non-citizens.” [13] Doing so would give Southern States more power in the House of Representatives which, when coupled with the equality each state had in the Senate, gave the less populous Southern disproportionate power in the national government. A representative from New Jersey, Gouverneur Morris believed that if slaves “were human enough to boost the representation of the Southern States…they should be treated as persons and not property in the South.” [14]There was debate on this issue and to bridge the sectional divide the Convention passed what is now known as the three-fifths compromise.

This measure had profound results. It stipulated that the size of a state’s congressional delegation and its Electoral College electors; and the state’s tax burden would be determined by their population. The population was determined by counting free-persons as a full person, and then adding the words “three-fifths of all other persons.” Of course the “other persons” were slaves, but the language was carefully crafted to avoid the use of the terms slave or slavery to make the document acceptable to Northern delegations. The compromise was the first of many made by the Northern states to appease the South and maintain national unity. The South got less than it wanted, as its delegates wanted slaves to count as a whole person for population sake without considering them as such. When all was said and done in 1790 “southern states, possessing around 40% of the nations’ white population, controlled around 47% of the House and Electoral College.” [15]Gouverneur Morris understood that the compromise would exaggerate Southern power and predicted that “the three-fifths clause’s real legacy would be to give slaveholders majority control over electoral politics.” [16]However, Morris’s warning was unheeded for decades by many in the North, though through electoral experience Northern leaders began to realize what the compromise had wrought but could not change the process without amending the Constitution.

Morris was correct. During the election of 1802 in the Electoral College the “three-fifths clause gave the Southerners 14 extra electors, the Republicans’ Thomas Jefferson defeated the Federalists’ John Adams, 73-65. Jefferson swept South’s extra electors 12-2. If no three-fifths clause had existed and House apportionment been based strictly on white numbers, Adams would have likely squeaked by, 63-61.” [17] The compromise had major impacts on the Electoral College. In the first 36 years of the Republic, only one President came from the North, John Adams. The rest, Washington, Jefferson, Madison and Monroe were all Virginian’s, and all were slaveholders.

Apart from John Quincy Adams who served from 1825-1829 every other President until Abraham Lincoln was either a Southern slaveholder, or a Northern supporter of the South’s position on the preservation and or expansion of slavery. In fact the South dominated all branches of the Federal government from 1789-1861, often with the cooperation of Northern political and business interests. James McPherson wrote, “A Southern slaveholder had been president of the United States two-thirds of the years between 1789 and 1861, and two-thirds of the Speakers of the House and president pro tem of the Senate had also been Southerners. Twenty of the thirty-five Supreme Court justices during that period had been from slave states, which always had a majority on the court before 1861.”[18] Those who believed in the South’s moral, religious, and cultural supremacy over the North often used the Southern domination of American politics as proof of that superiority.

Two other compromises were made by the delegates to the convention. The first dealt with ending the African slave trade. This was contentious and in response to the threat of ending the trade the delegates from South Carolina, John Rutledge and Charles Cotesworth Pinckney insisted that “South Carolina could not join the proposed Union if the slave trade was prohibited.”[19] The compromise allowed the African slave trade to remain legal until 1808 unless Congress voted to allow it to continue. However, this was the first of many threats by Southern leaders and states to threaten disunion over the issue of slavery. A final compromise required states to “extradite and deliver any fugitive from service to his or her master and state of origin.” [20]The wording of the law was purposely vague and could include indentured servants, but the real target was escaped slaves.

The early compromises set the stage for future compromises, in large part because Federalist politicians preferred compromise over disunion, and their fear was that “failure to compromise would bring disunion” [21] and with it disaster. Thus the convention approved the compromises and the states, even Northern states which had abolished or were on the way to abolishing slavery ratified it.

Slavery in the Early Years of the United States

Slavery expanded in the American colonies and continued to do so after American independence despite the fact that a number of prominent slaveholders including George Washington voluntarily emancipated their slaves in the 1780s and 1790s. In large part this was due to fact that the United States “purposely built a weak central state, dispersing power to govern from the center to the constituent (some would have said still sovereign) parts.” [22] That being said the in the new Constitution the founders ensured that the central government was far stronger than the attempt made in the initial Confederation of States in matters of tariffs, taxes and laws to protect bondholders, slaveowners, and land speculators. In this government the land owners of the Southern states, as well as the merchants of the North held the bulk of the economic, political and social power. Significantly, “most of the makers of the Constitution had some direct interest in establishing a strong federal government: the manufacturers needed protective tariffs; the moneylenders wanted to stop the use of paper money to pay off debts; the land speculators wanted protection as they invaded Indian lands; slaveowners needed federal security against slave revolts and runaways; bondholders wanted a government able to raise money by nationwide taxation, to pay off those bonds.”[23] The Constitution ensured that the Federal Government was strong enough to protect those interests, but not strong enough to encroach on the powers granted to the states, especially the powers of slave states.

The conflict between supporters of slavery and those who opposed it on either humanitarian, religious or political-ideological grounds would become more of a source of even conflict when slavery was give a boost by Eli Whitney’s invention of the Cotton Gin. This machine made the production of cotton and its export an even more profitable enterprise requiring more slaves to meet the expanding demand and it was not something that those who believed that slavery would expire of its own accord expected. Thomas Jefferson wrote in 1805 that in regard to slavery that “interest is really going over to the side of morality. The value of the slave is every day lessening; his burden on his master dayly increasing. Interest is therefore preparing for the disposition to be just.” [24] Of course Jefferson, who owned over 200 slaves and had built much of his political base among Virginia planters was wrong, and despite the misgivings that he expresses in some of his letters and papers, including the first draft of the Declaration of Independence, he never took the lead or a public stand on the abolition of slavery.

The difference made by the cotton gin was starling, it enabled greater production and increased the need for slaves, and with the end of the legal African slave trade in 1808 the price of slaves already in the United States went up considerably, making the interstate trafficking of slaves much more profitable. In 1790 “a thousand tons of cotton were being produced every year in the South. By 1860, it was a million tons. In the same period, 500,000 slaves grew to 4 million.” [25] This enriched Northerners as well, “Northern ships carried cotton to New York and Europe, northern bankers and merchants financed the cotton crop, northern companies insured it, and northern factories turned cotton into textiles. The “free states” had abolished slavery, but they remained intimately linked to the peculiar institution.” [26] Thus the institution of slavery’s tentacles reached out to much of America and with the threat of slave rebellions in the South which could upset the economic status quo the nation “developed a network of controls in the southern states, backed by laws, courts, armed forces, and race prejudice of the nation’s political leaders.” [27]

But during the early nineteenth century slavery was on the decline in the rest of the Americas as the Spanish, Portuguese and French lost most of their American possessions, many which became independent and abolished slavery, in each case for the newly liberated countries in Latin America and South America, as well as the ending of serfdom in Europe. Likewise Britain emancipated its slaves in the 1830s and the slaves in its colonies and most countries, even the United States banned the African slave trade. This would lead to increasing calls for the abolition of slavery in the United States and the formation of abolitionist societies, newspapers and stepped up efforts to help slaves escape their bonds and with the advent of a small but vocal abolitionist movement there was a movement, particularly in religious circles to justify and defend the peculiar institution.

Still Relevant Today: Frederick Douglass’s 4th of July Oration

These are the words of Frederick Douglass spoken on July 5th 1852 to a gathering of abolitionists in Rochester New York. He spoke them over 10 years before Abraham Lincoln issued the Emancipation Proclamation. The words are haunting even today because they point to the yet unfulfilled promise of the Declaration:

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness…”

Mr. President, Friends and Fellow Citizens:

He who could address this audience without a quailing sensation, has stronger nerves than I have. I do not remember ever to have appeared as a speaker before any assembly more shrinkingly, nor with greater distrust of my ability, than I do this day. A feeling has crept over me, quite unfavorable to the exercise of my limited powers of speech. The task before me is one which requires much previous thought and study for its proper performance. I know that apologies of this sort are generally considered flat and unmeaning. I trust, however, that mine will not be so considered. Should I seem at ease, my appearance would much misrepresent me. The little experience I have had in addressing public meetings, in country schoolhouses, avails me nothing on the present occasion.

The papers and placards say, that I am to deliver a 4th [of] July oration. This certainly sounds large, and out of the common way, for it is true that I have often had the privilege to speak in this beautiful Hall, and to address many who now honor me with their presence. But neither their familiar faces, nor the perfect gage I think I have of Corinthian Hall, seems to free me from embarrassment.

The fact is, ladies and gentlemen, the distance between this platform and the slave plantation, from which I escaped, is considerable — and the difficulties to be overcome in getting from the latter to the former, are by no means slight. That I am here to-day is, to me, a matter of astonishment as well as of gratitude. You will not, therefore, be surprised, if in what I have to say I evince no elaborate preparation, nor grace my speech with any high sounding exordium. With little experience and with less learning, I have been able to throw my thoughts hastily and imperfectly together; and trusting to your patient and generous indulgence, I will proceed to lay them before you.

This, for the purpose of this celebration, is the 4th of July. It is the birthday of your National Independence, and of your political freedom. This, to you, is what the Passover was to the emancipated people of God. It carries your minds back to the day, and to the act of your great deliverance; and to the signs, and to the wonders, associated with that act, and that day. This celebration also marks the beginning of another year of your national life; and reminds you that the Republic of America is now 76 years old. I am glad, fellow-citizens, that your nation is so young. Seventy-six years, though a good old age for a man, is but a mere speck in the life of a nation. Three score years and ten is the allotted time for individual men; but nations number their years by thousands. According to this fact, you are, even now, only in the beginning of your national career, still lingering in the period of childhood. I repeat, I am glad this is so. There is hope in the thought, and hope is much needed, under the dark clouds which lower above the horizon. The eye of the reformer is met with angry flashes, portending disastrous times; but his heart may well beat lighter at the thought that America is young, and that she is still in the impressible stage of her existence. May he not hope that high lessons of wisdom, of justice and of truth, will yet give direction to her destiny? Were the nation older, the patriot’s heart might be sadder, and the reformer’s brow heavier. Its future might be shrouded in gloom, and the hope of its prophets go out in sorrow. There is consolation in the thought that America is young. Great streams are not easily turned from channels, worn deep in the course of ages. They may sometimes rise in quiet and stately majesty, and inundate the land, refreshing and fertilizing the earth with their mysterious properties. They may also rise in wrath and fury, and bear away, on their angry waves, the accumulated wealth of years of toil and hardship. They, however, gradually flow back to the same old channel, and flow on as serenely as ever. But, while the river may not be turned aside, it may dry up, and leave nothing behind but the withered branch, and the unsightly rock, to howl in the abyss-sweeping wind, the sad tale of departed glory. As with rivers so with nations.

Fellow-citizens, I shall not presume to dwell at length on the associations that cluster about this day. The simple story of it is that, 76 years ago, the people of this country were British subjects. The style and title of your “sovereign people” (in which you now glory) was not then born. You were under the British Crown. Your fathers esteemed the English Government as the home government; and England as the fatherland. This home government, you know, although a considerable distance from your home, did, in the exercise of its parental prerogatives, impose upon its colonial children, such restraints, burdens and limitations, as, in its mature judgment, it deemed wise, right and proper.

But, your fathers, who had not adopted the fashionable idea of this day, of the infallibility of government, and the absolute character of its acts, presumed to differ from the home government in respect to the wisdom and the justice of some of those burdens and restraints. They went so far in their excitement as to pronounce the measures of government unjust, unreasonable, and oppressive, and altogether such as ought not to be quietly submitted to. I scarcely need say, fellow-citizens, that my opinion of those measures fully accords with that of your fathers. Such a declaration of agreement on my part would not be worth much to anybody. It would, certainly, prove nothing, as to what part I might have taken, had I lived during the great controversy of 1776. To say now that America was right, and England wrong, is exceedingly easy. Everybody can say it; the dastard, not less than the noble brave, can flippantly discant on the tyranny of England towards the American Colonies. It is fashionable to do so; but there was a time when to pronounce against England, and in favor of the cause of the colonies, tried men’s souls. They who did so were accounted in their day, plotters of mischief, agitators and rebels, dangerous men. To side with the right, against the wrong, with the weak against the strong, and with the oppressed against the oppressor! here lies the merit, and the one which, of all others, seems unfashionable in our day. The cause of liberty may be stabbed by the men who glory in the deeds of your fathers. But, to proceed.

Feeling themselves harshly and unjustly treated by the home government, your fathers, like men of honesty, and men of spirit, earnestly sought redress. They petitioned and remonstrated; they did so in a decorous, respectful, and loyal manner. Their conduct was wholly unexceptionable. This, however, did not answer the purpose. They saw themselves treated with sovereign indifference, coldness and scorn. Yet they persevered. They were not the men to look back.

As the sheet anchor takes a firmer hold, when the ship is tossed by the storm, so did the cause of your fathers grow stronger, as it breasted the chilling blasts of kingly displeasure. The greatest and best of British statesmen admitted its justice, and the loftiest eloquence of the British Senate came to its support. But, with that blindness which seems to be the unvarying characteristic of tyrants, since Pharaoh and his hosts were drowned in the Red Sea, the British Government persisted in the exactions complained of.

The madness of this course, we believe, is admitted now, even by England; but we fear the lesson is wholly lost on our present ruler.

Oppression makes a wise man mad. Your fathers were wise men, and if they did not go mad, they became restive under this treatment. They felt themselves the victims of grievous wrongs, wholly incurable in their colonial capacity. With brave men there is always a remedy for oppression. Just here, the idea of a total separation of the colonies from the crown was born! It was a startling idea, much more so, than we, at this distance of time, regard it. The timid and the prudent (as has been intimated) of that day, were, of course, shocked and alarmed by it.

Such people lived then, had lived before, and will, probably, ever have a place on this planet; and their course, in respect to any great change, (no matter how great the good to be attained, or the wrong to be redressed by it), may be calculated with as much precision as can be the course of the stars. They hate all changes, but silver, gold and copper change! Of this sort of change they are always strongly in favor.

These people were called Tories in the days of your fathers; and the appellation, probably, conveyed the same idea that is meant by a more modern, though a somewhat less euphonious term, which we often find in our papers, applied to some of our old politicians.

Their opposition to the then dangerous thought was earnest and powerful; but, amid all their terror and affrighted vociferations against it, the alarming and revolutionary idea moved on, and the country with it.

On the 2d of July, 1776, the old Continental Congress, to the dismay of the lovers of ease, and the worshipers of property, clothed that dreadful idea with all the authority of national sanction. They did so in the form of a resolution; and as we seldom hit upon resolutions, drawn up in our day whose transparency is at all equal to this, it may refresh your minds and help my story if I read it. “Resolved, That these united colonies are, and of right, ought to be free and Independent States; that they are absolved from all allegiance to the British Crown; and that all political connection between them and the State of Great Britain is, and ought to be, dissolved.”

Citizens, your fathers made good that resolution. They succeeded; and to-day you reap the fruits of their success. The freedom gained is yours; and you, therefore, may properly celebrate this anniversary. The 4th of July is the first great fact in your nation’s history — the very ring-bolt in the chain of your yet undeveloped destiny.

Pride and patriotism, not less than gratitude, prompt you to celebrate and to hold it in perpetual remembrance. I have said that the Declaration of Independence is the ring-bolt to the chain of your nation’s destiny; so, indeed, I regard it. The principles contained in that instrument are saving principles. Stand by those principles, be true to them on all occasions, in all places, against all foes, and at whatever cost.

From the round top of your ship of state, dark and threatening clouds may be seen. Heavy billows, like mountains in the distance, disclose to the leeward huge forms of flinty rocks! That bolt drawn, that chain broken, and all is lost. Cling to this day — cling to it, and to its principles, with the grasp of a storm-tossed mariner to a spar at midnight.

The coming into being of a nation, in any circumstances, is an interesting event. But, besides general considerations, there were peculiar circumstances which make the advent of this republic an event of special attractiveness.

The whole scene, as I look back to it, was simple, dignified and sublime.

The population of the country, at the time, stood at the insignificant number of three millions. The country was poor in the munitions of war. The population was weak and scattered, and the country a wilderness unsubdued. There were then no means of concert and combination, such as exist now. Neither steam nor lightning had then been reduced to order and discipline. From the Potomac to the Delaware was a journey of many days. Under these, and innumerable other disadvantages, your fathers declared for liberty and independence and triumphed.

Fellow Citizens, I am not wanting in respect for the fathers of this republic. The signers of the Declaration of Independence were brave men. They were great men too — great enough to give fame to a great age. It does not often happen to a nation to raise, at one time, such a number of truly great men. The point from which I am compelled to view them is not, certainly, the most favorable; and yet I cannot contemplate their great deeds with less than admiration. They were statesmen, patriots and heroes, and for the good they did, and the principles they contended for, I will unite with you to honor their memory.

They loved their country better than their own private interests; and, though this is not the highest form of human excellence, all will concede that it is a rare virtue, and that when it is exhibited, it ought to command respect. He who will, intelligently, lay down his life for his country, is a man whom it is not in human nature to despise. Your fathers staked their lives, their fortunes, and their sacred honor, on the cause of their country. In their admiration of liberty, they lost sight of all other interests.

They were peace men; but they preferred revolution to peaceful submission to bondage. They were quiet men; but they did not shrink from agitating against oppression. They showed forbearance; but that they knew its limits. They believed in order; but not in the order of tyranny. With them, nothing was “settled” that was not right. With them, justice, liberty and humanity were “final;” not slavery and oppression. You may well cherish the memory of such men. They were great in their day and generation. Their solid manhood stands out the more as we contrast it with these degenerate times.

How circumspect, exact and proportionate were all their movements! How unlike the politicians of an hour! Their statesmanship looked beyond the passing moment, and stretched away in strength into the distant future. They seized upon eternal principles, and set a glorious example in their defense. Mark them!

Fully appreciating the hardship to be encountered, firmly believing in the right of their cause, honorably inviting the scrutiny of an on-looking world, reverently appealing to heaven to attest their sincerity, soundly comprehending the solemn responsibility they were about to assume, wisely measuring the terrible odds against them, your fathers, the fathers of this republic, did, most deliberately, under the inspiration of a glorious patriotism, and with a sublime faith in the great principles of justice and freedom, lay deep the corner-stone of the national superstructure, which has risen and still rises in grandeur around you.

Of this fundamental work, this day is the anniversary. Our eyes are met with demonstrations of joyous enthusiasm. Banners and pennants wave exultingly on the breeze. The din of business, too, is hushed. Even Mammon seems to have quitted his grasp on this day. The ear-piercing fife and the stirring drum unite their accents with the ascending peal of a thousand church bells. Prayers are made, hymns are sung, and sermons are preached in honor of this day; while the quick martial tramp of a great and multitudinous nation, echoed back by all the hills, valleys and mountains of a vast continent, bespeak the occasion one of thrilling and universal interest — a nation’s jubilee.

Friends and citizens, I need not enter further into the causes which led to this anniversary. Many of you understand them better than I do. You could instruct me in regard to them. That is a branch of knowledge in which you feel, perhaps, a much deeper interest than your speaker. The causes which led to the separation of the colonies from the British crown have never lacked for a tongue. They have all been taught in your common schools, narrated at your firesides, unfolded from your pulpits, and thundered from your legislative halls, and are as familiar to you as household words. They form the staple of your national poetry and eloquence.

I remember, also, that, as a people, Americans are remarkably familiar with all facts which make in their own favor. This is esteemed by some as a national trait — perhaps a national weakness. It is a fact, that whatever makes for the wealth or for the reputation of Americans, and can be had cheap! will be found by Americans. I shall not be charged with slandering Americans, if I say I think the American side of any question may be safely left in American hands.

I leave, therefore, the great deeds of your fathers to other gentlemen whose claim to have been regularly descended will be less likely to be disputed than mine!

My business, if I have any here to-day, is with the present. The accepted time with God and his cause is the ever-living now.

Trust no future, however pleasant,
Let the dead past bury its dead;
Act, act in the living present,
Heart within, and God overhead.

We have to do with the past only as we can make it useful to the present and to the future. To all inspiring motives, to noble deeds which can be gained from the past, we are welcome. But now is the time, the important time. Your fathers have lived, died, and have done their work, and have done much of it well. You live and must die, and you must do your work. You have no right to enjoy a child’s share in the labor of your fathers, unless your children are to be blest by your labors. You have no right to wear out and waste the hard-earned fame of your fathers to cover your indolence. Sydney Smith tells us that men seldom eulogize the wisdom and virtues of their fathers, but to excuse some folly or wickedness of their own. This truth is not a doubtful one. There are illustrations of it near and remote, ancient and modern. It was fashionable, hundreds of years ago, for the children of Jacob to boast, we have “Abraham to our father,” when they had long lost Abraham’s faith and spirit. That people contented themselves under the shadow of Abraham’s great name, while they repudiated the deeds which made his name great. Need I remind you that a similar thing is being done all over this country to-day? Need I tell you that the Jews are not the only people who built the tombs of the prophets, and garnished the sepulchres of the righteous? Washington could not die till he had broken the chains of his slaves. Yet his monument is built up by the price of human blood, and the traders in the bodies and souls of men shout — “We have Washington to our father.” — Alas! that it should be so; yet so it is.

The evil that men do, lives after them, The good is oft-interred with their bones.

Fellow-citizens, pardon me, allow me to ask, why am I called upon to speak here to-day? What have I, or those I represent, to do with your national independence? Are the great principles of political freedom and of natural justice, embodied in that Declaration of Independence, extended to us? and am I, therefore, called upon to bring our humble offering to the national altar, and to confess the benefits and express devout gratitude for the blessings resulting from your independence to us?

Would to God, both for your sakes and ours, that an affirmative answer could be truthfully returned to these questions! Then would my task be light, and my burden easy and delightful. For who is there so cold, that a nation’s sympathy could not warm him? Who so obdurate and dead to the claims of gratitude, that would not thankfully acknowledge such priceless benefits? Who so stolid and selfish, that would not give his voice to swell the hallelujahs of a nation’s jubilee, when the chains of servitude had been torn from his limbs? I am not that man. In a case like that, the dumb might eloquently speak, and the “lame man leap as an hart.”

But, such is not the state of the case. I say it with a sad sense of the disparity between us. I am not included within the pale of this glorious anniversary! Your high independence only reveals the immeasurable distance between us. The blessings in which you, this day, rejoice, are not enjoyed in common. — The rich inheritance of justice, liberty, prosperity and independence, bequeathed by your fathers, is shared by you, not by me. The sunlight that brought life and healing to you, has brought stripes and death to me. This Fourth [of] July is yours, not mineYou may rejoice, I must mourn. To drag a man in fetters into the grand illuminated temple of liberty, and call upon him to join you in joyous anthems, were inhuman mockery and sacrilegious irony. Do you mean, citizens, to mock me, by asking me to speak to-day? If so, there is a parallel to your conduct. And let me warn you that it is dangerous to copy the example of a nation whose crimes, lowering up to heaven, were thrown down by the breath of the Almighty, burying that nation in irrecoverable ruin! I can to-day take up the plaintive lament of a peeled and woe-smitten people!

“By the rivers of Babylon, there we sat down. Yea! we wept when we remembered Zion. We hanged our harps upon the willows in the midst thereof. For there, they that carried us away captive, required of us a song; and they who wasted us required of us mirth, saying, Sing us one of the songs of Zion. How can we sing the Lord’s song in a strange land? If I forget thee, O Jerusalem, let my right hand forget her cunning. If I do not remember thee, let my tongue cleave to the roof of my mouth.”

Fellow-citizens; above your national, tumultuous joy, I hear the mournful wail of millions! whose chains, heavy and grievous yesterday, are, to-day, rendered more intolerable by the jubilee shouts that reach them. If I do forget, if I do not faithfully remember those bleeding children of sorrow this day, “may my right hand forget her cunning, and may my tongue cleave to the roof of my mouth!” To forget them, to pass lightly over their wrongs, and to chime in with the popular theme, would be treason most scandalous and shocking, and would make me a reproach before God and the world. My subject, then fellow-citizens, is AMERICAN SLAVERY. I shall see, this day, and its popular characteristics, from the slave’s point of view. Standing, there, identified with the American bondman, making his wrongs mine, I do not hesitate to declare, with all my soul, that the character and conduct of this nation never looked blacker to me than on this 4th of July! Whether we turn to the declarations of the past, or to the professions of the present, the conduct of the nation seems equally hideous and revolting. America is false to the past, false to the present, and solemnly binds herself to be false to the future. Standing with God and the crushed and bleeding slave on this occasion, I will, in the name of humanity which is outraged, in the name of liberty which is fettered, in the name of the constitution and the Bible, which are disregarded and trampled upon, dare to call in question and to denounce, with all the emphasis I can command, everything that serves to perpetuate slavery — the great sin and shame of America! “I will not equivocate; I will not excuse;” I will use the severest language I can command; and yet not one word shall escape me that any man, whose judgment is not blinded by prejudice, or who is not at heart a slaveholder, shall not confess to be right and just.

But I fancy I hear some one of my audience say, it is just in this circumstance that you and your brother abolitionists fail to make a favorable impression on the public mind. Would you argue more, and denounce less, would you persuade more, and rebuke less, your cause would be much more likely to succeed. But, I submit, where all is plain there is nothing to be argued. What point in the anti-slavery creed would you have me argue? On what branch of the subject do the people of this country need light? Must I undertake to prove that the slave is a man? That point is conceded already. Nobody doubts it. The slaveholders themselves acknowledge it in the enactment of laws for their government. They acknowledge it when they punish disobedience on the part of the slave. There are seventy-two crimes in the State of Virginia, which, if committed by a black man, (no matter how ignorant he be), subject him to the punishment of death; while only two of the same crimes will subject a white man to the like punishment. What is this but the acknowledgement that the slave is a moral, intellectual and responsible being? The manhood of the slave is conceded. It is admitted in the fact that Southern statute books are covered with enactments forbidding, under severe fines and penalties, the teaching of the slave to read or to write. When you can point to any such laws, in reference to the beasts of the field, then I may consent to argue the manhood of the slave. When the dogs in your streets, when the fowls of the air, when the cattle on your hills, when the fish of the sea, and the reptiles that crawl, shall be unable to distinguish the slave from a brute, then will I argue with you that the slave is a man!

For the present, it is enough to affirm the equal manhood of the Negro race. Is it not astonishing that, while we are ploughing, planting and reaping, using all kinds of mechanical tools, erecting houses, constructing bridges, building ships, working in metals of brass, iron, copper, silver and gold; that, while we are reading, writing and cyphering, acting as clerks, merchants and secretaries, having among us lawyers, doctors, ministers, poets, authors, editors, orators and teachers; that, while we are engaged in all manner of enterprises common to other men, digging gold in California, capturing the whale in the Pacific, feeding sheep and cattle on the hill-side, living, moving, acting, thinking, planning, living in families as husbands, wives and children, and, above all, confessing and worshipping the Christian’s God, and looking hopefully for life and immortality beyond the grave, we are called upon to prove that we are men!

Would you have me argue that man is entitled to liberty? that he is the rightful owner of his own body? You have already declared it. Must I argue the wrongfulness of slavery? Is that a question for Republicans? Is it to be settled by the rules of logic and argumentation, as a matter beset with great difficulty, involving a doubtful application of the principle of justice, hard to be understood? How should I look to-day, in the presence of Americans, dividing, and subdividing a discourse, to show that men have a natural right to freedom? speaking of it relatively, and positively, negatively, and affirmatively. To do so, would be to make myself ridiculous, and to offer an insult to your understanding. — There is not a man beneath the canopy of heaven, that does not know that slavery is wrong for him.

What, am I to argue that it is wrong to make men brutes, to rob them of their liberty, to work them without wages, to keep them ignorant of their relations to their fellow men, to beat them with sticks, to flay their flesh with the lash, to load their limbs with irons, to hunt them with dogs, to sell them at auction, to sunder their families, to knock out their teeth, to burn their flesh, to starve them into obedience and submission to their masters? Must I argue that a system thus marked with blood, and stained with pollution, is wrong? No! I will not. I have better employments for my time and strength than such arguments would imply.

What, then, remains to be argued? Is it that slavery is not divine; that God did not establish it; that our doctors of divinity are mistaken? There is blasphemy in the thought. That which is inhuman, cannot be divine! Who can reason on such a proposition? They that can, may; I cannot. The time for such argument is passed.

At a time like this, scorching irony, not convincing argument, is needed. O! had I the ability, and could I reach the nation’s ear, I would, to-day, pour out a fiery stream of biting ridicule, blasting reproach, withering sarcasm, and stern rebuke. For it is not light that is needed, but fire; it is not the gentle shower, but thunder. We need the storm, the whirlwind, and the earthquake. The feeling of the nation must be quickened; the conscience of the nation must be roused; the propriety of the nation must be startled; the hypocrisy of the nation must be exposed; and its crimes against God and man must be proclaimed and denounced.

What, to the American slave, is your 4th of July? I answer: a day that reveals to him, more than all other days in the year, the gross injustice and cruelty to which he is the constant victim. To him, your celebration is a sham; your boasted liberty, an unholy license; your national greatness, swelling vanity; your sounds of rejoicing are empty and heartless; your denunciations of tyrants, brass fronted impudence; your shouts of liberty and equality, hollow mockery; your prayers and hymns, your sermons and thanksgivings, with all your religious parade, and solemnity, are, to him, mere bombast, fraud, deception, impiety, and hypocrisy — a thin veil to cover up crimes which would disgrace a nation of savages. There is not a nation on the earth guilty of practices, more shocking and bloody, than are the people of these United States, at this very hour.

Go where you may, search where you will, roam through all the monarchies and despotisms of the old world, travel through South America, search out every abuse, and when you have found the last, lay your facts by the side of the everyday practices of this nation, and you will say with me, that, for revolting barbarity and shameless hypocrisy, America reigns without a rival.

Take the American slave-trade, which, we are told by the papers, is especially prosperous just now. Ex-Senator Benton tells us that the price of men was never higher than now. He mentions the fact to show that slavery is in no danger. This trade is one of the peculiarities of American institutions. It is carried on in all the large towns and cities in one-half of this confederacy; and millions are pocketed every year, by dealers in this horrid traffic. In several states, this trade is a chief source of wealth. It is called (in contradistinction to the foreign slave-trade) “the internal slave trade.” It is, probably, called so, too, in order to divert from it the horror with which the foreign slave-trade is contemplated. That trade has long since been denounced by this government, as piracy. It has been denounced with burning words, from the high places of the nation, as an execrable traffic. To arrest it, to put an end to it, this nation keeps a squadron, at immense cost, on the coast of Africa. Everywhere, in this country, it is safe to speak of this foreign slave-trade, as a most inhuman traffic, opposed alike to the laws of God and of man. The duty to extirpate and destroy it, is admitted even by our DOCTORS OF DIVINITY. In order to put an end to it, some of these last have consented that their colored brethren (nominally free) should leave this country, and establish themselves on the western coast of Africa! It is, however, a notable fact that, while so much execration is poured out by Americans upon those engaged in the foreign slave-trade, the men engaged in the slave-trade between the states pass without condemnation, and their business is deemed honorable.

Behold the practical operation of this internal slave-trade, the American slave-trade, sustained by American politics and America religion. Here you will see men and women reared like swine for the market. You know what is a swine-drover? I will show you a man-drover. They inhabit all our Southern States. They perambulate the country, and crowd the highways of the nation, with droves of human stock. You will see one of these human flesh-jobbers, armed with pistol, whip and bowie-knife, driving a company of a hundred men, women, and children, from the Potomac to the slave market at New Orleans. These wretched people are to be sold singly, or in lots, to suit purchasers. They are food for the cotton-field, and the deadly sugar-mill. Mark the sad procession, as it moves wearily along, and the inhuman wretch who drives them. Hear his savage yells and his blood-chilling oaths, as he hurries on his affrighted captives! There, see the old man, with locks thinned and gray. Cast one glance, if you please, upon that young mother, whose shoulders are bare to the scorching sun, her briny tears falling on the brow of the babe in her arms. See, too, that girl of thirteen, weeping, yes! weeping, as she thinks of the mother from whom she has been torn! The drove moves tardily. Heat and sorrow have nearly consumed their strength; suddenly you hear a quick snap, like the discharge of a rifle; the fetters clank, and the chain rattles simultaneously; your ears are saluted with a scream, that seems to have torn its way to the center of your soul! The crack you heard, was the sound of the slave-whip; the scream you heard, was from the woman you saw with the babe. Her speed had faltered under the weight of her child and her chains! that gash on her shoulder tells her to move on. Follow the drove to New Orleans. Attend the auction; see men examined like horses; see the forms of women rudely and brutally exposed to the shocking gaze of American slave-buyers. See this drove sold and separated forever; and never forget the deep, sad sobs that arose from that scattered multitude. Tell me citizens, WHERE, under the sun, you can witness a spectacle more fiendish and shocking. Yet this is but a glance at the American slave-trade, as it exists, at this moment, in the ruling part of the United States.

I was born amid such sights and scenes. To me the American slave-trade is a terrible reality. When a child, my soul was often pierced with a sense of its horrors. I lived on Philpot Street, Fell’s Point, Baltimore, and have watched from the wharves, the slave ships in the Basin, anchored from the shore, with their cargoes of human flesh, waiting for favorable winds to waft them down the Chesapeake. There was, at that time, a grand slave mart kept at the head of Pratt Street, by Austin Woldfolk. His agents were sent into every town and county in Maryland, announcing their arrival, through the papers, and on flaming “hand-bills,” headed CASH FOR NEGROES. These men were generally well dressed men, and very captivating in their manners. Ever ready to drink, to treat, and to gamble. The fate of many a slave has depended upon the turn of a single card; and many a child has been snatched from the arms of its mother by bargains arranged in a state of brutal drunkenness.

The flesh-mongers gather up their victims by dozens, and drive them, chained, to the general depot at Baltimore. When a sufficient number have been collected here, a ship is chartered, for the purpose of conveying the forlorn crew to Mobile, or to New Orleans. From the slave prison to the ship, they are usually driven in the darkness of night; for since the antislavery agitation, a certain caution is observed.

In the deep still darkness of midnight, I have been often aroused by the dead heavy footsteps, and the piteous cries of the chained gangs that passed our door. The anguish of my boyish heart was intense; and I was often consoled, when speaking to my mistress in the morning, to hear her say that the custom was very wicked; that she hated to hear the rattle of the chains, and the heart-rending cries. I was glad to find one who sympathized with me in my horror.

Fellow-citizens, this murderous traffic is, to-day, in active operation in this boasted republic. In the solitude of my spirit, I see clouds of dust raised on the highways of the South; I see the bleeding footsteps; I hear the doleful wail of fettered humanity, on the way to the slave-markets, where the victims are to be sold like horsessheep, and swine, knocked off to the highest bidder. There I see the tenderest ties ruthlessly broken, to gratify the lust, caprice and rapacity of the buyers and sellers of men. My soul sickens at the sight.

Is this the land your Fathers loved,
The freedom which they toiled to win?
Is this the earth whereon they moved?
Are these the graves they slumber in?

But a still more inhuman, disgraceful, and scandalous state of things remains to be presented. By an act of the American Congress, not yet two years old, slavery has been nationalized in its most horrible and revolting form. By that act, Mason and Dixon’s line has been obliterated; New York has become as Virginia; and the power to hold, hunt, and sell men, women, and children as slaves remains no longer a mere state institution, but is now an institution of the whole United States. The power is co-extensive with the Star-Spangled Banner and American Christianity. Where these go, may also go the merciless slave-hunter. Where these are, man is not sacred. He is a bird for the sportsman’s gun. By that most foul and fiendish of all human decrees, the liberty and person of every man are put in peril. Your broad republican domain is hunting ground for men. Not for thieves and robbers, enemies of society, merely, but for men guilty of no crime. Your lawmakers have commanded all good citizens to engage in this hellish sport. Your President, your Secretary of State, our lordsnobles, and ecclesiastics, enforce, as a duty you owe to your free and glorious country, and to your God, that you do this accursed thing. Not fewer than forty Americans have, within the past two years, been hunted down and, without a moment’s warning, hurried away in chains, and consigned to slavery and excruciating torture. Some of these have had wives and children, dependent on them for bread; but of this, no account was made. The right of the hunter to his prey stands superior to the right of marriage, and to all rights in this republic, the rights of God included! For black men there are neither law, justice, humanity, not religion. The Fugitive Slave Law makes mercy to them a crime; and bribes the judge who tries them. An American judge gets ten dollars for every victim he consigns to slavery, and five, when he fails to do so. The oath of any two villains is sufficient, under this hell-black enactment, to send the most pious and exemplary black man into the remorseless jaws of slavery! His own testimony is nothing. He can bring no witnesses for himself. The minister of American justice is bound by the law to hear but one side; and that side, is the side of the oppressor. Let this damning fact be perpetually told. Let it be thundered around the world, that, in tyrant-killing, king-hating, people-loving, democratic, Christian America, the seats of justice are filled with judges, who hold their offices under an open and palpable bribe, and are bound, in deciding in the case of a man’s liberty, hear only his accusers!

In glaring violation of justice, in shameless disregard of the forms of administering law, in cunning arrangement to entrap the defenseless, and in diabolical intent, this Fugitive Slave Law stands alone in the annals of tyrannical legislation. I doubt if there be another nation on the globe, having the brass and the baseness to put such a law on the statute-book. If any man in this assembly thinks differently from me in this matter, and feels able to disprove my statements, I will gladly confront him at any suitable time and place he may select.

I take this law to be one of the grossest infringements of Christian Liberty, and, if the churches and ministers of our country were not stupidly blind, or most wickedly indifferent, they, too, would so regard it.

At the very moment that they are thanking God for the enjoyment of civil and religious liberty, and for the right to worship God according to the dictates of their own consciences, they are utterly silent in respect to a law which robs religion of its chief significance, and makes it utterly worthless to a world lying in wickedness. Did this law concern the “mint, anise, and cumin” — abridge the right to sing psalms, to partake of the sacrament, or to engage in any of the ceremonies of religion, it would be smitten by the thunder of a thousand pulpits. A general shout would go up from the church, demanding repeal, repeal, instant repeal! — And it would go hard with that politician who presumed to solicit the votes of the people without inscribing this motto on his banner. Further, if this demand were not complied with, another Scotland would be added to the history of religious liberty, and the stern old Covenanters would be thrown into the shade. A John Knox would be seen at every church door, and heard from every pulpit, and Fillmore would have no more quarter than was shown by Knox, to the beautiful, but treacherous queen Mary of Scotland. The fact that the church of our country, (with fractional exceptions), does not esteem “the Fugitive Slave Law” as a declaration of war against religious liberty, implies that that church regards religion simply as a form of worship, an empty ceremony, and not a vital principle, requiring active benevolence, justice, love and good will towards man. It esteems sacrifice above mercy; psalm-singing above right doing; solemn meetings above practical righteousness. A worship that can be conducted by persons who refuse to give shelter to the houseless, to give bread to the hungry, clothing to the naked, and who enjoin obedience to a law forbidding these acts of mercy, is a curse, not a blessing to mankind. The Bible addresses all such persons as “scribes, Pharisees, hypocrites, who pay tithe of mintanise, and cumin, and have omitted the weightier matters of the law, judgment, mercy and faith.”

But the church of this country is not only indifferent to the wrongs of the slave, it actually takes sides with the oppressors. It has made itself the bulwark of American slavery, and the shield of American slave-hunters. Many of its most eloquent Divines. who stand as the very lights of the church, have shamelessly given the sanction of religion and the Bible to the whole slave system. They have taught that man may, properly, be a slave; that the relation of master and slave is ordained of God; that to send back an escaped bondman to his master is clearly the duty of all the followers of the Lord Jesus Christ; and this horrible blasphemy is palmed off upon the world for Christianity.

For my part, I would say, welcome infidelity! welcome atheism! welcome anything! in preference to the gospel, as preached by those Divines! They convert the very name of religion into an engine of tyranny, and barbarous cruelty, and serve to confirm more infidels, in this age, than all the infidel writings of Thomas Paine, Voltaire, and Bolingbroke, put together, have done! These ministers make religion a cold and flinty-hearted thing, having neither principles of right action, nor bowels of compassion. They strip the love of God of its beauty, and leave the throng of religion a huge, horrible, repulsive form. It is a religion for oppressors, tyrants, man-stealers, and thugs. It is not that “pure and undefiled religion” which is from above, and which is “first pure, then peaceable, easy to be entreated, full of mercy and good fruits, without partiality, and without hypocrisy.” But a religion which favors the rich against the poor; which exalts the proud above the humble; which divides mankind into two classes, tyrants and slaves; which says to the man in chains, stay there; and to the oppressor, oppress on; it is a religion which may be professed and enjoyed by all the robbers and enslavers of mankind; it makes God a respecter of persons, denies his fatherhood of the race, and tramples in the dust the great truth of the brotherhood of man. All this we affirm to be true of the popular church, and the popular worship of our land and nation — a religion, a church, and a worship which, on the authority of inspired wisdom, we pronounce to be an abomination in the sight of God. In the language of Isaiah, the American church might be well addressed, “Bring no more vain ablations; incense is an abomination unto me: the new moons and Sabbaths, the calling of assemblies, I cannot away with; it is iniquity even the solemn meeting. Your new moons and your appointed feasts my soul hateth. They are a trouble to me; I am weary to bear them; and when ye spread forth your hands I will hide mine eyes from you. Yea! when ye make many prayers, I will not hear. YOUR HANDS ARE FULL OF BLOOD; cease to do evil, learn to do well; seek judgment; relieve the oppressed; judge for the fatherless; plead for the widow.”

The American church is guilty, when viewed in connection with what it is doing to uphold slavery; but it is superlatively guilty when viewed in connection with its ability to abolish slavery. The sin of which it is guilty is one of omission as well as of commission. Albert Barnes but uttered what the common sense of every man at all observant of the actual state of the case will receive as truth, when he declared that “There is no power out of the church that could sustain slavery an hour, if it were not sustained in it.”

Let the religious press, the pulpit, the Sunday school, the conference meeting, the great ecclesiastical, missionary, Bible and tract associations of the land array their immense powers against slavery and slave-holding; and the whole system of crime and blood would be scattered to the winds; and that they do not do this involves them in the most awful responsibility of which the mind can conceive.

In prosecuting the anti-slavery enterprise, we have been asked to spare the church, to spare the ministry; but how, we ask, could such a thing be done? We are met on the threshold of our efforts for the redemption of the slave, by the church and ministry of the country, in battle arrayed against us; and we are compelled to fight or flee. From what quarter, I beg to know, has proceeded a fire so deadly upon our ranks, during the last two years, as from the Northern pulpit? As the champions of oppressors, the chosen men of American theology have appeared — men, honored for their so-called piety, and their real learning. The Lords of Buffalo, the Springs of New York, the Lathrops of Auburn, the Coxes and Spencers of Brooklyn, the Gannets and Sharps of Boston, the Deweys of Washington, and other great religious lights of the land have, in utter denial of the authority of Him by whom they professed to be called to the ministry, deliberately taught us, against the example or the Hebrews and against the remonstrance of the Apostles, they teach that we ought to obey man’s law before the law of God.

My spirit wearies of such blasphemy; and how such men can be supported, as the “standing types and representatives of Jesus Christ,” is a mystery which I leave others to penetrate. In speaking of the American church, however, let it be distinctly understood that I mean the great mass of the religious organizations of our land. There are exceptions, and I thank God that there are. Noble men may be found, scattered all over these Northern States, of whom Henry Ward Beecher of Brooklyn, Samuel J. May of Syracuse, and my esteemed friend (Rev. R. R. Raymond) on the platform, are shining examples; and let me say further, that upon these men lies the duty to inspire our ranks with high religious faith and zeal, and to cheer us on in the great mission of the slave’s redemption from his chains.

One is struck with the difference between the attitude of the American church towards the anti-slavery movement, and that occupied by the churches in England towards a similar movement in that country. There, the church, true to its mission of ameliorating, elevating, and improving the condition of mankind, came forward promptly, bound up the wounds of the West Indian slave, and restored him to his liberty. There, the question of emancipation was a high religious question. It was demanded, in the name of humanity, and according to the law of the living God. The Sharps, the Clarksons, the Wilberforces, the Buxtons, and Burchells and the Knibbs, were alike famous for their piety, and for their philanthropy. The anti-slavery movement there was not an anti-church movement, for the reason that the church took its full share in prosecuting that movement: and the anti-slavery movement in this country will cease to be an anti-church movement, when the church of this country shall assume a favorable, instead of a hostile position towards that movement. Americans! your republican politics, not less than your republican religion, are flagrantly inconsistent. You boast of your love of liberty, your superior civilization, and your pure Christianity, while the whole political power of the nation (as embodied in the two great political parties), is solemnly pledged to support and perpetuate the enslavement of three millions of your countrymen. You hurl your anathemas at the crowned headed tyrants of Russia and Austria, and pride yourselves on your Democratic institutions, while you yourselves consent to be the mere tools and body-guards of the tyrants of Virginia and Carolina. You invite to your shores fugitives of oppression from abroad, honor them with banquets, greet them with ovations, cheer them, toast them, salute them, protect them, and pour out your money to them like water; but the fugitives from your own land you advertise, hunt, arrest, shoot and kill. You glory in your refinement and your universal education yet you maintain a system as barbarous and dreadful as ever stained the character of a nation — a system begun in avarice, supported in pride, and perpetuated in cruelty. You shed tears over fallen Hungary, and make the sad story of her wrongs the theme of your poets, statesmen and orators, till your gallant sons are ready to fly to arms to vindicate her cause against her oppressors; but, in regard to the ten thousand wrongs of the American slave, you would enforce the strictest silence, and would hail him as an enemy of the nation who dares to make those wrongs the subject of public discourse! You are all on fire at the mention of liberty for France or for Ireland; but are as cold as an iceberg at the thought of liberty for the enslaved of America. You discourse eloquently on the dignity of labor; yet, you sustain a system which, in its very essence, casts a stigma upon labor. You can bare your bosom to the storm of British artillery to throw off a threepenny tax on tea; and yet wring the last hard-earned farthing from the grasp of the black laborers of your country. You profess to believe “that, of one blood, God made all nations of men to dwell on the face of all the earth,” and hath commanded all men, everywhere to love one another; yet you notoriously hate, (and glory in your hatred), all men whose skins are not colored like your own. You declare, before the world, and are understood by the world to declare, that you “hold these truths to be self evident, that all men are created equal; and are endowed by their Creator with certain inalienable rights; and that, among these are, life, liberty, and the pursuit of happiness;” and yet, you hold securely, in a bondage which, according to your own Thomas Jefferson, “is worse than ages of that which your fathers rose in rebellion to oppose,” a seventh part of the inhabitants of your country.

Fellow-citizens! I will not enlarge further on your national inconsistencies. The existence of slavery in this country brands your republicanism as a sham, your humanity as a base pretence, and your Christianity as a lie. It destroys your moral power abroad; it corrupts your politicians at home. It saps the foundation of religion; it makes your name a hissing, and a bye-word to a mocking earth. It is the antagonistic force in your government, the only thing that seriously disturbs and endangers your Union. It fetters your progress; it is the enemy of improvement, the deadly foe of education; it fosters pride; it breeds insolence; it promotes vice; it shelters crime; it is a curse to the earth that supports it; and yet, you cling to it, as if it were the sheet anchor of all your hopes. Oh! be warned! be warned! a horrible reptile is coiled up in your nation’s bosom; the venomous creature is nursing at the tender breast of your youthful republic; for the love of God, tear away, and fling from you the hideous monster, and let the weight of twenty millions crush and destroy it forever!

But it is answered in reply to all this, that precisely what I have now denounced is, in fact, guaranteed and sanctioned by the Constitution of the United States; that the right to hold and to hunt slaves is a part of that Constitution framed by the illustrious Fathers of this Republic.

Then, I dare to affirm, notwithstanding all I have said before, your fathers stooped, basely stooped

To palter with us in a double sense:
And keep the word of promise to the ear,
But break it to the heart.

And instead of being the honest men I have before declared them to be, they were the veriest imposters that ever practiced on mankind. This is the inevitable conclusion, and from it there is no escape. But I differ from those who charge this baseness on the framers of the Constitution of the United States. It is a slander upon their memory, at least, so I believe. There is not time now to argue the constitutional question at length — nor have I the ability to discuss it as it ought to be discussed. The subject has been handled with masterly power by Lysander Spooner, Esq., by William Goodell, by Samuel E. Sewall, Esq., and last, though not least, by Gerritt Smith, Esq. These gentlemen have, as I think, fully and clearly vindicated the Constitution from any design to support slavery for an hour.

Fellow-citizens! there is no matter in respect to which, the people of the North have allowed themselves to be so ruinously imposed upon, as that of the pro-slavery character of the Constitution. In that instrument I hold there is neither warrant, license, nor sanction of the hateful thing; but, interpreted as it ought to be interpreted, the Constitution is a GLORIOUS LIBERTY DOCUMENT. Read its preamble, consider its purposes. Is slavery among them? Is it at the gateway? or is it in the temple? It is neither. While I do not intend to argue this question on the present occasion, let me ask, if it be not somewhat singular that, if the Constitution were intended to be, by its framers and adopters, a slave-holding instrument, why neither slavery, slaveholding, nor slave can anywhere be found in it. What would be thought of an instrument, drawn up, legally drawn up, for the purpose of entitling the city of Rochester to a track of land, in which no mention of land was made? Now, there are certain rules of interpretation, for the proper understanding of all legal instruments. These rules are well established. They are plain, common-sense rules, such as you and I, and all of us, can understand and apply, without having passed years in the study of law. I scout the idea that the question of the constitutionality or unconstitutionality of slavery is not a question for the people. I hold that every American citizen has a right to form an opinion of the constitution, and to propagate that opinion, and to use all honorable means to make his opinion the prevailing one. Without this right, the liberty of an American citizen would be as insecure as that of a Frenchman. Ex-Vice-President Dallas tells us that the Constitution is an object to which no American mind can be too attentive, and no American heart too devoted. He further says, the Constitution, in its words, is plain and intelligible, and is meant for the home-bred, unsophisticated understandings of our fellow-citizens. Senator Berrien tell us that the Constitution is the fundamental law, that which controls all others. The charter of our liberties, which every citizen has a personal interest in understanding thoroughly. The testimony of Senator Breese, Lewis Cass, and many others that might be named, who are everywhere esteemed as sound lawyers, so regard the constitution. I take it, therefore, that it is not presumption in a private citizen to form an opinion of that instrument.

Now, take the Constitution according to its plain reading, and I defy the presentation of a single pro-slavery clause in it. On the other hand it will be found to contain principles and purposes, entirely hostile to the existence of slavery.

I have detained my audience entirely too long already. At some future period I will gladly avail myself of an opportunity to give this subject a full and fair discussion.

Allow me to say, in conclusion, notwithstanding the dark picture I have this day presented of the state of the nation, I do not despair of this country. There are forces in operation, which must inevitably work the downfall of slavery. “The arm of the Lord is not shortened,” and the doom of slavery is certain. I, therefore, leave off where I began, with hope. While drawing encouragement from the Declaration of Independence, the great principles it contains, and the genius of American Institutions, my spirit is also cheered by the obvious tendencies of the age. Nations do not now stand in the same relation to each other that they did ages ago. No nation can now shut itself up from the surrounding world, and trot round in the same old path of its fathers without interference. The time was when such could be done. Long established customs of hurtful character could formerly fence themselves in, and do their evil work with social impunity. Knowledge was then confined and enjoyed by the privileged few, and the multitude walked on in mental darkness. But a change has now come over the affairs of mankind. Walled cities and empires have become unfashionable. The arm of commerce has borne away the gates of the strong city. Intelligence is penetrating the darkest corners of the globe. It makes its pathway over and under the sea, as well as on the earth. Wind, steam, and lightning are its chartered agents. Oceans no longer divide, but link nations together. From Boston to London is now a holiday excursion. Space is comparatively annihilated. Thoughts expressed on one side of the Atlantic, are distinctly heard on the other. The far off and almost fabulous Pacific rolls in grandeur at our feet. The Celestial Empire, the mystery of ages, is being solved. The fiat of the Almighty, “Let there be Light,” has not yet spent its force. No abuse, no outrage whether in taste, sport or avarice, can now hide itself from the all-pervading light. The iron shoe, and crippled foot of China must be seen, in contrast with nature. Africa must rise and put on her yet unwoven garment. “Ethiopia shall stretch out her hand unto God.” In the fervent aspirations of William Lloyd Garrison, I say, and let every heart join in saying it:

God speed the year of jubilee
The wide world o’er
When from their galling chains set free,
Th’ oppress’d shall vilely bend the knee,

And wear the yoke of tyranny
Like brutes no more.
That year will come, and freedom’s reign,
To man his plundered fights again
Restore.

God speed the day when human blood
Shall cease to flow!
In every clime be understood,
The claims of human brotherhood,
And each return for evil, good,
Not blow for blow;
That day will come all feuds to end.
And change into a faithful friend
Each foe.

God speed the hour, the glorious hour,
When none on earth
Shall exercise a lordly power,
Nor in a tyrant’s presence cower;
But all to manhood’s stature tower,
By equal birth!
That hour will come, to each, to all,
And from his prison-house, the thrall
Go forth.

Until that year, day, hour, arrive,
With head, and heart, and hand I’ll strive,
To break the rod, and rend the gyve,

The Hero Betrayed: Gouverneur Warren, Little Round Top and Moral Injury

This is another article from one of my yet unpublished boos on the Battle of Gettysburg. Hopefully my agent will find a home for it. That being said the men who fought that battle were very little different from the men and women that serve in our armed forces today. I find a particular affinity with this man, Gouverneur Warren.

Throughout this study we have been looking at how leaders at various levels in conduct of campaigns as well as battles make decisions. Likewise we examine the lives and character of those leaders as it applies to their actions at critical points of a battle. In this chapter we will examine three officers whose lives, character and actions at Gettysburg, specifically at Little Round Top exemplify two of the Chairman of the Joint Chiefs of Staff Desired Leader Attributes, “to anticipate and adapt to surprise and uncertainty” and the principle of Mission Command, to “operate on intent through trust, empowerment and understanding.” It is from those perspectives that we will look at this part of the battle, but we would be amiss if we did not address the nearly mythical status to which this action has risen.

The actions of three men at the Battle of Little Round Top; Brigadier General Gouverneur Warren, the Chief Engineer of the Army of the Potomac, Colonel Strong Vincent, commanding Third Brigade, First Division, V Corps and Colonel Joshua Lawrence Chamberlain, commanding the 20th Maine Infantry Regiment of Vincent’s brigade are very important to the outcome of the battle, but also for what they teach us about leadership and the profession of arms. This chapter focuses on Warren, in particular with his work with the Commander of the Army of the Potomac, George Meade and his actions to secure Little Round Top on July 2nd 1863, the next will deal with Chamberlain and Vincent.

The battle at Little Round Top is an iconic part of American History and in particular for the Army, a key element of how leadership has been studied. It has achieved nearly mythical status due to the actions of Colonel Joshua Chamberlain which have been told many times in history, fiction and in film, particularly Michael Shaara’s classic historical novel The Killer Angels and its film adaptation Gettysburg. While these accounts are certainly inspiring and allow us to experience the emotion and near spiritual quality of what Chamberlain writes, there is much more to learn.

That near spiritual quality and mythic status that we accord Gettysburg is important, for in large part it is why we come to the battlefield, and why we study. Chamberlain said it well many years after Gettysburg at the dedication of the Maine Monuments:

“In great deeds, something abides. On great fields, something stays. Forms change and pass; bodies disappear; but spirits linger, to consecrate ground for the vision-place of souls… generations that know us not and that we know not of, heart-drawn to see where and by whom great things were suffered and done for them, shall come to this deathless field, to ponder and dream; and lo! the shadow of a mighty presence shall wrap them in its bosom, and the power of the vision pass into their souls.” [1]

So as we endeavor to look at the actions of these leaders on that fateful day it is important to recognize that we cannot totally separate those actions that helped decide the battle from the mythos that surrounds the story. [2] Likewise, it important to acknowledge that we cannot separate their character and the totality of military leaders lives from their actions on a particular battlefield. Unlike Chamberlain Warren does not engender myth, and that is why he is often overlooked by many casual students and observers of the Battle of Gettysburg.

For the purposes of this study it is important to note that Warren was not a commander during this action, he was, like most senior officers today, a staff officer. Many times students of military history and theory are inclined to dismiss the contributions of staff officers because they do not have the overall responsibility of a battle, or the glamour of the limelight of the commanders that they serve under. However, for military professionals, especially those serving on senior staffs who prepare campaign plans, contingency plans and crisis plans the study of officers like Warren is essential.

The Federal Army at Gettysburg, like its Confederate opponent had a wide variety of officers serving in its ranks. Many of its senior officers were graduates of West Point. Many had served together in Mexico and in the various campaigns against Native American tribes. Those who stayed in the Army during the long “peace” between the Mexican War and the outbreak of the Civil War endured the monotony, boredom and often miserable conditions of isolated army posts, long family separations, as well as low pay, slow promotion and often low social status.[3] In light of such conditions, many resigned their commissions to undertake various professional, business or academic pursuits; in fact Samuel Huntington noted that in the years before the Civil War that “West Point produced more railroad presidents than generals.” [4] However, on the outbreak of the war returned to service whether in the service of the Union, or the Confederate States.

When the war began the Army underwent a massive expansion, which it met through and the call of up militia and raising new units from the various states. In the expansion many officers were appointed who had no prior military service, or if they did it was performed years or even decades before the war. Some of these men were simply patriots who rallied to the flag, others due to a sense of righteousness about their cause, while others were political opportunists or appointees. In the north this was a particular problem as “professional officers were pushed aside and passed over in the Union, the higher commissions going, in the first stages of the war at least to officers called back into service or directly appointed from civilian life, many of them “political” appointees.” [5]

At times the lack of experience, training and sometimes the poor character of these men was tragic. However, many of these men performed as well or better than some of their regular army counterparts at various levels of command. At the same time a good number of Regular Army officers were allowed to assist states in the formation and training of these new units, one of whom was Gouverneur Warren. Gettysburg would provide opportunity for the best and worst of all of these types of officers to succeed or fail. In this chapter we will look at one of the regular officers and two of the volunteer whose lives intersected on July 2nd 1863.

Brigadier General Gouverneur Warren was typical of the many professional officers of the old army. An 1850 graduate of West Point, Warren was a bright student who had absorbed the teachings of his professor, Dennis Hart Mahan as the core of his own military thought, both in his senior year in college and through reinforcement as a faculty member. [6] Warren was commissioned as a Brevet Second Lieutenant and because of his high standing in his class was assigned to Corps of Topographical Engineers. He spent his first seven years in a number of assignments which took him throughout much of the country.

Warren’s work involved exploring and mapping for various enterprises including the project to help tame the Mississippi River, and the exploration of the Great Plains and Black Hills where he developed a sympathy for the various Sioux tribes he encountered noting on completion of his mission in 1858, writing that He had never heard a Sioux chief express an opinion in regard to what was due them in which I do not concur and that many of them view the extinction of their race as an inevitable result of the operation of present causes, and do so with all the feelings of despair with which we should contemplate the extinction of our nationality. [7] Following his years in the west he returned as faculty to West Point where he as an Assistant Professor, shared mathematics instructional duties with Oliver O. Howard and resumed his relationship with his former professor Mahan. [8]

On the outbreak of war Warren was granted leave from his duties at West Point to serve as Lieutenant Colonel of Volunteers in the 5th New York Infantry Regiment, also known as Duryee’s Zouaves. Where Duryee was appointed as a Brigadier General, Warren became its Colonel, serving with it during the Peninsula campaign where he was eventually given command of a provisional brigade and promoted to Brigadier General, serving as a Brigade Commander in at Second Manassas, Antietam and Fredericksburg.

At Chancellorsville he was pulled from his brigade duties by Hooker who employed him with good effect to assist his engineering staff, first with mapping and then building the fortifications that stopped the ferocious Confederate storm on the second day of battle. [9] In less than 48 hours Warren’s troops threw up five miles of the most formidable entrenchments yet constructed under battlefield conditions. [10] Edward Alexander, Longstreet’s artillery officer noted that when the Confederates came upon the fortifications after Hooker’s withdraw that “they were amazed at the strength and completeness of the enemys fortifications. [11] Following the battle Warren was appointed as Chief Engineer of the Army of the Potomac on May 12th 1863 by Hooker. When Hooker was relieved of command and was replaced by Meade on June 28th 1863, he was kept in that position by his fellow engineer Meade rather than being promoted to a division or being assigned as Meade’s Chief of Staff. As this turned out it was a wise choice.

Warren along with Major General Winfield Scott Hancock arrived at Cemetery Hill on the night of July 1st. As Meade organized his defenses he not only depended on his advice about the ground, but “consulted him constantly at headquarters or sent him off on matters of highest importance.” [12] Meade respected Warren and had offered Warren the chance to serve as his Chief of Staff, a position that Warren, like Seth Williams, the Adjutant General declined that offer indicating that he had too much work in their departments to take on the burdens of a new job. [13] Lee appreciated Warren’s calm, absorbed, and earnest manner, his professional skill and sound judgment.[14] These qualities would serve both men and the army well on July 2nd.

When Sickles moved III Corps forward during the afternoon without permission moved his Corps forming a vulnerable salient at the Peach Orchard leaving the southern flank in the air, Meade was aghast. Warren who from his reconnaissance of the previous day and the morning knew the position better than anyone recognized that something was badly awry on SicklesThird Corps front  matters there were not all straight. [15] He had sent an officer to discover to investigate Sickles’ front and that officer reported that the section of Cemetery Ridge assigned to III Corps was not occupied.[16]

Meade and Warren discussed the situation and realized that III Corps “could hardly be said to be in position” [17] and knowing VI Corps was now close at hand order V Corps, at the time his only reserve into the position vacated by Sickles. They went forward and seeing the empty spaces Warren told Meade “here is where our line should be” to which Meade replied: “It’s too late now.” [18] Warren, whose familiarity with the whole of the battlefield gave him concern about Sickles’ corps dispositions suggest that Meade send him to the Federal left, “to examine the condition of affairs.” [19]

Meade concurred with his Engineer and in dispatching him he also gave Warren the authority to take charge as needed saying “I wish you would ride over there and if anything serious is going on, attend to it.” [20] Again Meade’s choice of Warren for the task demonstrated the trust that is essential in command. The two officers worked together seamlessly and as Coddington described their relationship that day: “Meade chose him to act as his alter ego in crucial moments of the battle, and Warren rendered services for which Meade and the country were to be eternally grateful.” [21]Warren would not see Meade again “until the attack had spent its force.” [22]

Hunt noted that “The duty could not have been in better hands.” [23]When Warren arrived on Little Round Top he found it unoccupied save for a few signal corps soldiers. Warren immediately recognized the tactical value of Little Round Top and noted that it was “the key of the whole position.” [24]Warren saw that the Confederates were massing not more than a mile away and that there were no troops on the hill to stop them. He believed that an area “of woods on the near side of the Emmitsburg Road as “an excellent place for the enemy to form out of sight” [25] which was exactly what Major General John Bell Hood’s division was doing, as Henry Hunt noted “The enemy at the time lay concealed, awaiting signal for the assault…” [26] To test his suspicions Warren sent a messenger to Captain James Smith’s 4th New York artillery battery on Devil’s Den to fire a single shot into the woods. Warren described the situation:

“As the shot went whistling through the air the sound of it reached the enemy’s troops and caused every one to look in the direction of it. This motion revealed to me the glistening gun-barrels and bayonets of the enemy’s line of battle, already formed and far outflanking the position of any of our troops; so that the line of his advance from the right to Little Round Top was unopposed. I have been particular in telling this, as the discovery was intensely thrilling to my feelings, and almost appalling.” [27]

Upon confirming his fears Warren resorted to ruse and action. He order the “signalmen to keep up their wigwag activity, simply as a pretense of alertness, whether they had any real signals to transmit or not…”[28] He also sent messengers to Meade, Sickles and Sykes, the commander of V Corps asking Meade to “Send at least a division to me” [29] instructing the messenger, Lieutenant Randall Mackenzie to tell Meade “that we would at once have to occupy that place very strongly.” [30] Sickles refused on account of how badly stretched his lines were, however George Sykes of V Corps responded sending Captain William Jay to find Barnes commander of his 1st Division. The messenger could not find Barnes, but instead came across the commander of the division’s 3rd Brigade Colonel Strong Vincent. Vincent knew that Barnes was self-medicating his “pre-battle anxieties out of a black commissary quart bottle” and was already “hollow from skull to boots” and demanded “What are your orders? Give me your orders.” [31] Upon learning that Sykes wanted a brigade to proceed to Little Round Top Vincent responded immediately to take the initiative and ordered his four regiments up Little Round Top without waiting for permission. Vincent told Sykes messenger “I will take the responsibility myself of taking my brigade there.” [32]

Meade’s choice of Warren was demonstrated in how Warren continued to act with alacrity and decisiveness throughout the afternoon. “As the Union line began to crumble on Little Round Top, Warren, vested with the authority of Meade’s chief representative, emerged as the right man at the right place at the right time.” [33] Warren did not stop with sending messengers, but seeing the danger building he noted that the northwest face of the hill was still unoccupied and open to attack. Warren forgot “all about a general’s dignity” he “sprinted down the east slope of the hill like a rabbit.” [34] There he found Brigadier General Stephen Weed’s brigade which he had previously commanded. Since he did not see Weed, but he found Colonel Patrick O’Rorke of the 140th New York and ordered him to follow him up the hill, saying “Paddy…give me a regiment.” [35] When O’Rorke said that Weed expected him to be following him Warren took the responsibility telling O’Rorke “Bring them up on the double quick, and don’t stop for aligning. I’ll take responsibility.” [36] O’Rorke followed with his gallant regiment with the rest of the brigade under Weed following. Warren’s actions were fortuitous as the 140th New York and Lieutenant Charles Hazlett’s battery of the 5th Artillery arrived at the crest just in time to repulse the advancing Confederates. In the fight the brigade would take fearful casualties and by the end of the battle, Weed, O’Rorke and Hazlett would all be dead, but with Vincent’s brigade they held on and saved the Union line.[37]

Warren continued to urge on the Federal troops despite being wounded, in the words of a reporter who observed him in “a most gallant and heroic manner, riding with utmost confidence over fields swept by the enemy’s fire, seemingly everywhere present, directing, aiding, and cheering the troops.” [38] Once he was assured that Little Round Top was secure he proceeded to rejoin Meade “near the center of the battlefield where another crisis was at hand.” [39]

Warren distinguished as a Corps commander until he ran afoul of the fiery General Phillip Sheridan in 1865. Sheridan relieved Warren of command of V Corps following the Battle of Five Forks where Sheridan believed that Warren’s Corps had moved too slowly in the attack. The relief was brutal and ruined his career. Warren was a professional soldier and took the relief hard. Unfortunately as a topographic engineer he was an outsider to many in the army and not fully appreciated by Grant or Sheridan who in their haste at Five Forks destroyed his career.

After the war Warren resigned his commission as a Major General of Volunteers and returned to his permanent rank as a Major of Engineers. He served another 17 years doing engineeringduty and was promoted to Lieutenant Colonel in 1879, but his past always haunted him, even his sleep. He wrote his wife while supervising a major bridge construction project over the Mississippi River in 1867: “I wish I did not dream so much. They make me sometimes to dread to go to sleep. Scenes from the war, are so constantly recalled, with bitter feelings I wish never to experience again. Lies, vanity, treachery, and carnage.” [40]

He sought a Court of Inquiry to exonerate himself but this was refused until President Grant left office. The Court eventually exonerated him but he died three months before the results were published. Embittered he directed that he be buried in civilian clothes and without military honors. His funeral was attended by his friends Winfield Scott Hancock and Samuel Crawford, his oldest army friend and mentor Andrew Humphreys was called away before the service due to the sudden illness of his son. [41] The Washington Post noted that Warren “had gone “where neither the malevolence nor the justice of this world can reach him. He had enough of the former; and denial of the latter not only embittered his closing months of his life, but undoubtedly hastened his end.” [42]

Warren’s actions on that hot and muggy July 2nd exemplified the leadership qualities that we as an institution strive for, and from a leadership perspective demonstrate how the Chairman’s Desired Leader Attributes and the principles of Mission Command“the ability to operate on intent through trust, empowerment and understanding” should work in a relationship between seniors and subordinates. But his life also serves to remind us of the ethics of our profession. Loomis Langdon, who served as the official recorder for the board of inquiry wrote of Warren:

“I had never met General Warren till he came before his Court of Inquiry…I learned to value his good opinion – and while I admired him for his great patience, his wonderful energy, habit of concentration, his vast learning and untiring application, I loved him for his tenderness, gentleness and charity, even to those whom he believed had combined to do him a cruel wrong; and I admired him for his nobleness of character and his courage and unselfish patriotism.” [43]

It is easy for military professionals to become totally focused in our profession, especially the details of planning and process to forget the humanity of those that we serve alongside. Warren is one of those complex figures who are not easy to categorize. His biographer Jordan wrote that:

“Warren was a man with fine intellect, widely read, and of keen sensibilities. He was also an excellent engineer, mapmaker, and scientist. He was a soldier who cared much for the safety and welfare of the men under him, and he was sickened by the appalling carnage of the war in which he took such a prominent part. He was arrogant and proud, and he hesitated hardly at all in putting down those of his colleagues he regarded as inferiors. His mind’s eye took in much beyond what was his immediate concern, but this gift worked against him in the hierarchical realm of military life. Warren was prone to long sieges of depression, and he himself agreed that others found him morose and unsmiling…” [44]

In reading military history is far too easy to isolate and analyze a commander’s actions in battle and ignore the rest of their lives. I think that this does a great disservice to the men themselves. In time of war gives up something of themselves and sometimes even heroes like Gouverneur Warren are destroyed by the actions of institutions that they serve.

The Hidden Side of the Hero: Joshua and Fannie Chamberlain, Military Marriage

The past few days I have posted articles from my still untitled text on the Battle of Gettysburg dealing with the lives of three of the men who were immortalized during the battle of Little Round Top. Today is A follow up to those articles dealing with an American icon with feet of clay. The impact of war on those who go to war and the loved ones that they return to is often incredibly difficult, I know from experience. I am lucky, first I survived war, then I at least until now have survived its aftermath, finally, I have a wife who survived it with me and in spite of all the trauma our marriage not only survived but has become better. I hope that you appreciate this account of the post-war life of Joshua and Fannie Chamberlain.

Chamberlain’s accolades were certainly earned but others on that hill have been all too often overlooked by most people. This list includes Gouverneur Warren who was humiliated by Phillip Sheridan at Five Forks, Strong Vincent who died on of wounds suffered on Little Round Top and Paddy O’Rorke, the commander of the 140th New York of Weed’s Brigade on Vincent’s right who was mortally wounded that day.

After the war like most citizen soldiers, Chamberlain returned to civilian life, and a marriage that was in crisis in which neither Joshua nor Fannie seemed able to communicate well enough to mend.  The troubled couple “celebrated their tenth wedding anniversary on December 7, 1865. He gave her a double banded gold-and-diamond bracelet from Tiffany’s, an extravagant gift that only temporarily relieved the stresses at work just below the surface of their bland marriage. Wartime separation had perhaps damaged it more than Chamberlain knew.”  [1]

When he came home Chamberlain was unsettled. Fannie quite obviously hoped that his return would reunite them and bring about “peaceful hours and the sweet communion of uninterrupted days with the husband that had miraculously survived the slaughter” [2] and who had returned home, but it was not to be. Army life had given him a sense of purpose and meaning that he struggled to find in the civilian world. He was haunted by a prediction made by one of his professors. A prediction that “he would return from war “shattered” & “good for nothing,” [3] Chamberlain began to search for something to give his life meaning. He began to write a history of V Corps and give speeches around the northeast, and “these engagements buoyed his spirit, helping him submerge his tribulations and uncertainties in a warm sea of shared experience. [4] In his travels he remained apart from Fannie, who remained with the children, seldom including her in those efforts. She expressed her heart in a letter in early 1866:

“I have no idea when you will go back to Philadelphia, why dont you let me know about things dear?….I think I will be going towards home soon, but I want to hear from you. What are you doing dear? are you writing for your book? and how was it with your lecture in Brunswick- was it the one at Gettysburg? I look at your picture when ever I am in my room, and I am lonely for you. After all, every thing that is beautiful must be enjoyed with one you love, or it is nothing to you. Dear, dear Lawrence write me one of the old letters…hoping to hear from you soon…I am as in the old times gone bye Your Fannie.” [5]

In those events he poured out his heart in ways that seemed impossible for him to do with Fannie. He accounted those wives, parents, sons and daughters at home who had lost those that they loved, not only to death:

“…the worn and wasted and wounded may recover a measure of their strength, or blessed by your cherishing care live neither useless nor unhappy….A lost limb is not like a brother, an empty sleeve is not like an empty home, a scarred breast is not like a broken heart. No, the world may smile again and repair its losses, but who shall give you back again a father? What husband can replace the chosen of your youth? Who shall restore a son? Where will you find a lover like the high hearted boy you shall see no more?” [6]

Chamberlain set his sights on politics, goal that he saw as important in championing the rights of soldiers and their well treatment by a society, but a life that again interrupted his marriage to Fannie and brought frequent separation. Instead of the one term that Fannie expected, Chamberlain ended up serving four consecutive one year terms as Governor of Maine, and was considered for other political offices. However, the marriage continued to suffer and Fannie’s “protracted absence from the capital bespoke her attitude toward his political ambitions.” [7]  Eventually Chamberlain returned home and. “For twelve years following his last term as governor, he served as president of Bowdoin College, his alma mater. [8]

He became a champion of national reconciliation admired by friend and former foe alike, but he returned with bitterness towards some in the Union who he did not believe cared for his comrades or their families, especially those who had lost loved ones in the war. While saluting those who had served in the Christian and Sanitary Commissions during the war, praising veterans, soldiers and their families he noted that they were different than:

Those who can see no good in the soldier of the Union who took upon his breast the blow struck at the Nation’s and only look to our antagonists for examples of heroism- those over magnanimous Christians, who are so anxious to love their enemies that they are willing to hate their friends….I have no patience with the prejudice or the perversity that will not accord justice to the men who have fought and fallen on behalf of us all, but must go round by the way of Fort Pillow, Andersonville and Belle Isle to find a chivalry worthy of praise.” [9]

Chamberlain’s post-war life, save for the times that he was able to revisit the scenes of glory and be with his former comrades was marred by deep personal and professional struggles and much suffering. He struggled with the adjustment to civilian life, which for him was profoundly difficult. He “returned to Bowdoin and the college life which he had sworn he would not again endure. Three years of hard campaigning however, had made a career of college teaching seem less undesirable, while his physical condition made a permanent army career impossible.” [10] The adjustment was more than even he could anticipate, and the return to the sleepy college town and monotony of teaching left much to be desired.

These are not uncommon situations for combat veterans to experience, and Joshua Chamberlain, the hero of Little Round Top who was well acquainted with the carnage of war, suffered immensely. His wounds never fully healed and he was forced to wear what would be considered an early form of a catheter and bag. In 1868 he was awarded a pension of thirty dollars a month for his Petersburg wound which was described as “Bladder very painful and irritable; whole lower part of abdomen tender and sensitive; large urinal fistula at base of penis; suffers constant pain in both hips.” [11] Chamberlain struggled to climb out of “an emotional abyss” in the years after the war. Part was caused by his wounds which included wounds to his sexual organs, shattering his sexuality and caused his marriage to deteriorate.

He wrote to Fannie in 1867 about the “widening gulf between them, one created at least in part by his physical limitations: “There is not much left in me to love. I feel that all too well.” [12] Chamberlain’s inability to readjust to civilian life following the war, and Fanny’s inability to understand what he had gone through during it caused great troubles in their marriage. Chamberlain “felt like hell a lot of the time, morose in mood and racked with pain.” [13] His wounds would require more surgeries, and in “April 1883 he was forced to have extensive surgery on his war wounds, and through the rest of the decade and well into the next he was severely ill on several occasions and close to death once.” [14]

By 1868 the issues were so deep that Fannie threatened him with divorce and was accusing Joshua of domestic abuse, not in court, but among her friends and in town; a charge which he contested. It is unknown if the abuse actually occurred and given Chamberlain’s poor physical condition it is unlikely that he could have done what she claimed, it is actually much more likely, based on her correspondence as well as Fannie’s:

“chronic depression, her sense of being neglected of not abandoned, and her status as an unappreciated appendage to her husband’s celebrated public career caused her to retaliate in a manner calculated to get her husband’s attention while visiting on him some of the misery she had long endured.” [15]

The bitterness in their relationship at the time was shown in his offer to her of a divorce; a condition very similar to what many combat veterans and their families experience today. After he received news of the allegations that Fannie was spreading among their friends around town, Chamberlain wrote to her:

“If it is true (as Mr. Johnson seems to think there is a chance of its being) that you are preparing for an action against me, you need not give yourself all this trouble. I should think we had skill enough to adjust the terms of a separation without the wretchedness to all our family which these low people to whom it would seem that you confide your grievances & plans will certainly bring about.

You never take my advice, I am aware.

But if you do not stop this at once it will end in hell.” [16]

His words certainly seem harsh, especially in our time where divorce, be it contested or uncontested does not have the same social stigma it did then. Willard Wallace writes that the letter “reflects bewilderment, anger, even reproof, but not recrimination; and implicit throughout is an acute concern for Fanny, who did not seem to realize the implications of legal action. The lot of a divorcee in that era in a conservative part of the country was not likely to be a happy one.” [17]This could well be the case, but we do not know for sure his intent. We can say that it speaks to the mutual distress, anger and pain that both Joshua and Fannie were suffering at the time.

The marriage endured a separation which lasted until 1871 when his final term of office expired they reconciled, and the marriage did survive, for nearly forty more years. “Whatever differences may have once occasionally existed between Chamberlain and Fanny, the two had been very close for many years.” [18] The reconciliation could have been for any number of reasons, from simple political expedience, in that he had been rejected by his party to be appointed as Senator, and the realization that “that politics, unlike war, could never stir his soul.” [19] Perhaps he finally recognized just how badly he had hurt her over all the years of his neglect of her needs. But it is just as likely that deep in his heart he really did love her despite his chronic inability for so many years to demonstrate it in a way she could feel. Fannie died in 1905 and Chamberlain, who despite all of their conflicts loved her and grieved her, a grief “tinged with remorse and perhaps also with guilt.” [20] The anguished widower wrote after her death:

“You in my soul I see, faithful watcher, by my cot-side long days and nights together, through the delirium of mortal anguish – steadfast, calm, and sweet as eternal love. We pass now quickly from each other’s sight, but I know full well that where beyond these passing scenes you shall be, there will be heaven!”

Chamberlain made a final trip to Gettysburg in May of 1913. He felt well enough to give a tour to a delegation of federal judges. “One evening, an hour or so before sunset, he trudged, alone, up the overgrown slope of Little Round Top and sat down among the crags. Now in his Gothic imagination, the ghosts of the Little Round Top dead rose up around him….he lingered up the hillside, an old man lost in the sepia world of memory.” [21] He was alone.

Chamberlain died on a bitterly cold day, February 24th 1914 of complications from complications of the ghastly wound that he received at Petersburg in 1864. The Confederate minié ball that had struck him at the Rives’ Salient finally claimed his life just four months shy of 50 years since the Confederate marksman found his target.

Sadly, the story of the marriage of Joshua and Fannie Chamberlain is all too typical of many military marriages and relationships where a spouse returns home changed by their experience of war and struggles to readjust to civilian life. This is something that we need to remember when we encounter those changed by war and the struggles of soldiers as well as their families; for if we have learned nothing from our recent wars it is that the wounds of war extend far beyond the battlefield, often scarring veterans and their families for decades after the last shot of the war has been fired.

The Battle for Little Round Top which is so legendary in our collective history and myth was in the end something more than a decisive engagement in a decisive battle. It was something greater and larger than that, it is the terribly heart wrenching story of ordinary, yet heroic men like Vincent, Chamberlain and O’Rorke and their families who on that day were changed forever. As Chamberlain, ever the romantic, spoke about that day when dedicating the Maine Monument in 1888; about the men who fought that day and what they accomplished:

“In great deeds, something abides. On great fields, something stays. Forms change and pass; bodies disappear; but spirits linger, to consecrate ground for the vision-place of souls… generations that know us not and that we know not of, heart-drawn to see where and by whom great things were suffered and done for them, shall come to this deathless field, to ponder and dream; and lo! the shadow of a mighty presence shall wrap them in its bosom, and the power of the vision pass into their souls.” [22]

Another of my articles pulled from my yet unpublished books on the Battle of Gettysburg. Pray that my agent will find a publisher for them. 

Since I am continuing to post articles about Gettysburg and holding off on any articles regarding our contemporary situation, even though I would class President Trump as slightly more abhorrent than the leaders of the leaders of the Confederate rebellion against the United States. I will leave it there for now but will let my readers debate the meaning of treason. But I digress… 

I hope that you enjoy this article about one of my favorite historical personalities, a real human being with many admirable traits who also had feet of clay, Major General Joshua Lawrence Chamberlain.

While Colonel Joshua Chamberlain’s story is much better known than his brigade commander, Strong Vincent, he was another of the citizen soldiers whose performance and leadership on Little Round Top saved the Union line that hot July evening. Chamberlain was a graduate of Bowdoin College and Bangor Theological Seminary. Fluent in nine languages other than English, he remained at Bowdoin as Professor of Rhetoric and was deeply unhappy at missing the war even as his students left and were commissioned as officers in newly raised regiments.

In June of 1862 Chamberlain wrote to Governor Israel Washburn requesting an appointment in a newly raised Maine Regiment without consulting either the college or his wife Fannie, who was “shocked, hurt, and alarmed by the decision he had made without consulting her…She remonstrated, she raised her voice, and quite possibly wept over the injustice he had done to both by this unilateral act that threatened to send their world careening in all directions.” [1]

As far as Bowdoin went, Chamberlain actually deceived the college by requesting a “scholarly sabbatical when in fact he had applied to the governor of Maine in the new 20th Maine Infantry in the late summer of 1862.” [2] When the faculty of Bowdoin found out of Chamberlain’s action many of them “were livid over what they considered his duplicity, and some shunned him during the brief period that he remained in Brunswick before reporting to training camp. [3]

The letter that Chamberlain wrote to Governor Israel Washburn details Chamberlain’s desire to serve and in some ways shows his considerable political skill in presenting his case to join the army:

“For seven years past I have been Professor in Bowdoin College. I have always been interested in military matters, and what I do not know in that line I know how to learn.

Having been lately elected to a new department here, I am expecting to have leave, at the approaching Commencement, to spend a year or more in Europe, in the service of the College. I am entirely unwilling, however, to accept this offer, if my Country needs my service or example here.

Your Excellency presides over the Educational as well as the military affairs of our State, and, I am well aware, appreciates the importance of sustaining our Institutions of Learning. You will therefore be able to decide where my influence is most needed.

But, I fear, this war, so costly of blood and treasure, will not cease until the men of the North are willing to leave good positions, and sacrifice the dearest personal interests, to rescue our Country from Desolation, and defend the National Existence against treachery at home and jeopardy abroad. This war must be ended, with a swift and strong hand; and every man ought to come forward and ask to be placed at his proper post.

Nearly a hundred of those who have been my pupils, are now officers in our army; but there are many more all over our State, who, I believe, would respond with enthusiasm, if summoned by me, and who would bring forward men enough to fill up a Regiment at once. I can not free myself from my obligations here until the first week in August, but I do not want to be the last in the field, if it can possibly be helped.” [4]

Chamberlain’s pre-war experiences gave no indication that he would emerge as a military hero. His father, a veteran of the War of 1812 had named him after Captain James Lawrence, the commanding officer of the frigate USS Chesapeake in the War of 1812 who uttered the famous words “Don’t give up the ship” as he lay mortally wounded when that ship was defeated by the HMS Shannon off Boston Harbor in 1813. However, Chamberlain’s mother added the name Joshua as his first name in the town’s books. While his father hoped that the young Chamberlain would pursue a military career, his mother earnestly desired that he would pursue a ministerial career. Chamberlain did become a licensed minister but had no desire to become a pastor, and was never ordained. This was reinforced by Fannie, who though the daughter of a minister was “too much a free thinker” and “did not share the devotion her father and Chamberlain held for organized religion.”  [5]

Chamberlain debated attending West Point after graduation, a path that his classmate Oliver O. Howard took. Instead he attended Bangor Theological Seminary and following graduation took up his academic career at Bowdoin. It was during this time that he met, fell in love with, pursued, courted and finally married Frances Caroline Adams, who played the organ at the local Congregational Church that he attended. Known by most as “Fannie,” she was the adopted daughter of the eminent Congregationalist minister, Dr. George Adams who served as pastor. Fannie had a strong independent streak and was as an accomplished musician and artist.

The couple was an interesting match. Chamberlain was impressed by Fannie’s “artistic gifts. Fannie had talent not only in music but in poetry and, especially; art…” [6] but he ignored potential areas of conflict that would create difficulties throughout their marriage. However, Fannie was beset by numerous fears, as well as a desire not to be dominated by any man. Chamberlain pursued her with abandon but for a time she resisted, until her widowed father married a woman not much older than herself. She desired to pursue the study of music and went away to New York to do so, but in 1852 she decided that she was in love with him. “Yet she harbored doubts about her ability to return his feelings for her measure for measure.” [7]

Fannie suffered from depression and a constant worry about her eyesight which began failing her and an early age. It was a malady that eventually left her completely blind by then turn of the century. Compounding her struggles was that fact that her new husband struggled with his own doubts and depression, a depression that only seamed to lift during the war years.

“During most of his life, Chamberlain struggled with bouts of deep depression and melancholy. But not during the war years. It was as if the war and soldiering had made a new man out of him.” [8]

Chamberlain was offered command of the 20th Maine but asked Governor Washburn that he was appointed as a Lieutenant Colonel, which he was in August 1862. He fought with the regiment at Fredericksburg and was named commander of it when Colonel Adelbert Ames, his commander was transferred to preform staff duties prior to obtaining a brigade command in Oliver Howard’s XI Corps following the debacle at Chancellorsville.

Chamberlain at his heart, through his association with abolitionists and other prior to the war was a staunch Unionist. Before going into the army he wrote:

“We have this war upon is & we want to stop it. It has cost us already too much precious blood. It has carried stagnation, starvation & grief in to too many villages of our fair land – brought death to too many noble hearts that we could ill afford to lose. But the only way to stop this war, is first to show that we are strongest…I feel that we are fighting for our country – for our flag- not as so many Stars and Stripes, but as the emblem of a good &  powerful nation – fighting to settle the question whether we are a nation or a basket of chips. Whether we shall leave our children the country we have inherited – or leave them without a country – without a name – without a citizenship among the great nations of the earth – take the chief city of the rebels. They will have no respect for us unless we whip them & and I say it in all earnestness….” [9]

Like Vincent, Chamberlain was also a quick student or military science and rapidly adapted to being a soldier, officer and commander of troops in combat. He spent as much time studying the art of war under the supervision of Colonel Ames including Henri Jomini’s Art of War which he wrote to Fannie “The Col. & I are going to read it. He to instruct me, as he is kindly doing everything now.” [10] He excelled at his studies under Ames, but since most of the manuals that he studied were based on Napoleonic tactics and had not incorporated the changes brought about by the rifled musket, Chamberlain like so many others would have to learn the lesson of war the hard way.

Chamberlain was with the regiment at Antietam, but it saw no action.  He was in the thick of the fighting at Fredericksburg and Burnside’s subsequent “Mud March” which were both disastrous for the army.

He took command of the regiment in late April after Ames left on detached duty before assuming a brigade command. As the new commander of the regiment, Chamberlain and the 20th Maine missed the Battle of Chancellorsville as the regiment had been quarantined due to an epidemic of smallpox, which they had probably received from “poorly prepared serum with which the regiment was vaccinated” [11] in April.

From the regiment’s quarantined location Chamberlain and his men could hear the sound of battle. One of his soldiers wrote “We could hear the firing plain but there we lay in glorious idleness without being able to lift a finger or fire a gun.” [12] In frustration Chamberlain rode to Major General Joseph Hooker’s headquarters and asked Hooker’s Chief of Staff Dan Butterfield for the chance to enter the fight. Refused the chance Chamberlain told Butterfield “If we couldn’t do anything else we would give the rebels the smallpox!” [13] The regiment spent the battle guarding a telegraph line must to Chamberlain and his soldier’s disgust.

On the march up to Gettysburg, Chamberlain was ordered to take a number of veterans of the 2nd Maine who had signed three year, rather than two year enlistment contracts and were angry at remaining in the army when the regiment was mustered out. The men were angry and Chamberlain was given permission by Meade to fire on them “if they refused to do duty. The new colonel realized he had a crisis on his hands.” [14] The soldiers were bitter but Chamberlain treated them graciously and “almost all of them agreed to take up their muskets again the service of the 20th Maine.” [15] Chamberlain later remarked of how these men “we’re afterward among my best men, worthy of the proud fame of the 2nd, and the hard earned laurels of the 20th.” [16]

On receiving his orders from Vincent, Chamberlain deployed his small regiment halfway down the southern slope facing the small valley between Little Round Top and Big Round Top. By the time he arrived at Gettysburg he had become “a great infantry officer, and among his valuable qualities was [understanding] where an attack would come….” [17]

Since Chamberlain’s account is so important I will forgo a discussion of his tactics and instead quote the sections of his after action report that explains his actions. Chamberlain wrote:

“On reaching the field at about 4 p.m. July 2d, Col. Vincent commanding the Brigade, placing me on the left of the Brigade and consequently on the extreme left of our entire line of battle, instructed me that the enemy were expected shortly to make a desperate attempt to turn our left flank, and that the position assigned to me must be held at every hazard.

I established my line on the crest of a small spur of a rocky and wooded hill, and sent out at once a company of skirmishers on my left to guard against surprise on that unprotected flank.

These dispositions were scarcely made when the attack commenced, and the right of the Regt. found itself at once hotly engaged. Almost at the same moment, from a high rock which gave me a full view of the enemy, I perceived a heavy force in rear of their principal line, moving rapidly but stealthily toward our left, with the intention, as I judged, of gaining our rear unperceived. Without betraying our peril to any but one or two officers, I had the right wing move by the left flank, taking intervals of a pace or two, according to the shelter afforded by rocks or trees, extending so as to cover the whole front then engaged; and at the same time moved the left wing to the left and rear, making a large angle at the color, which was now brought to the front where our left had first rested.

This hazardous maneuvre [sic] was so admirably executed by my men that our fire was not materially slackened in front, and the enemy gained no advantage there, while the left wing in the meantime had formed a solid and steady line in a direction to meet the expected assault. We were not a moment too soon; for the enemy having gained their desired point of attack came to a front, and rushed forward with an impetuosity which showed their sanguine expectations.

Their astonishment however was evident, when emerging from their cover, they met instead of an unsuspecting flank, a firm and ready front. A strong fire opened at once from both sides, and with great effect, the enemy still advancing until they came within ten paces of our line, where our steady and telling volleys brought them to a stand. From that moment began a struggle fierce and bloody beyond any that I have witnessed, and which lasted in all its fury, a full hour. The two lines met, and broke and mingled in the shock. At times I saw around me more of the enemy than of my own men. The edge of conflict swayed to and fro -now one and now the other party holding the contested ground. Three times our line was forced back, but only to rally and repulse the enemy. As often as the enemy’s line was broken and routed, a new line was unmasked, which advanced with fresh vigor. Our “sixty rounds” were rapidly reduced; I sent several messengers to the rear for ammunition, and also for reinforcements. In the mean time we seized the opportunity of a momentary lull to gather ammunition and more serviceable arms, from the dead and dying on the field. With these we met the enemy’s last and fiercest assault. Their own rifles and their own bullets were turned against them. In the midst of this struggle, our ammunition utterly failed. The enemy were close upon us with a fresh line, pouring on us a terrible fire. Half the left wing already lay on the field. Although I had brought two companies from the right to its support, it was now scarcely more than a skirmish line. The heroic energy of my officers could avail no more. Our gallant line withered and shrunk before the fire it could not repel. It was too evident that we could maintain the defensive no longer. As a last desperate resort, I ordered a charge. The word “fix bayonets” flew from man to man. The click of the steel seemed to give new zeal to all. The men dashed forward with a shout. The two wings came into one line again, and extending to the left, and at the same time wheeling to the right, the whole Regiment described nearly a half circle, the left passing over the space of half a mile, while the right kept within the support of the 83d Penna. thus leaving no chance of escape to the enemy except to climb the steep side of the mountain or to pass by the whole front of the 83d Penna. The enemy’s first line scarcely tried to run-they stood amazed, threw down their loaded arms and surrendered in whole companies. Those in their rear had more time and gave us more trouble. My skirmishing company threw itself upon the enemy’s flank behind a stone wall, and their effective fire added to the enemy’s confusion. In this charge we captured three hundred and sixty eight prisoners, many of them officers, and took three hundred stand of arms. The prisoners were from four different regiments, and admitted that they had attacked with a Brigade.”[18]

Colonel William Oates of the 15th Alabama gave Chamberlain and his regiment the credit for stopping his attack. Oates wrote: “There have never been harder fighters than the Twentieth Maine and their gallant Colonel. His skill and persistency and the great bravery of his men saved Little Round Top and the Army of the Potomac from defeat.” [19]

As with any firsthand account, aspects of Chamberlain’s accounts are contested by others at the scene. But in another way Chamberlain’s accounts of battle have to be carefully examined, because they often reflect his romanticism, and because he was not always a realist. Unlike others in his command like Major Ellis Spear, who played such an important role on Little Round Top that day, a realist who “saw things plainly and remembered them clearly, in stark, unadorned hues. Joshua Chamberlain was a romanticist; even when describing the horrors of bloodbath his prose could be colorful, lyrical, even poetic.” [20]

There are accounts that differ from Chamberlain’s; Oates wrote that he ordered the retreat and that there were not as many prisoners taken as Chamberlain states. Likewise, one of Chamberlain’s company commanders disputed the account of the Chamberlain’s order of the bayonet charge. But even these accounts take nothing away from what Chamberlain accomplished that day. The fact is that Chamberlain’s regiment was outnumbered nearly two to one by the 4th 15th and 47th Alabama regiments. Chamberlain “offset this superiority with strength of position, iron determination and better tactics.”[21]

While the actions of Chamberlain, Vincent, Warren and others on the Union side, another factor was at play. This was the fatigue of the Confederate soldiers. The regiments attacking Little Round Top and their parent unit, Law’s brigade of Hood’s division, had conducted a grueling 28 mile march to get to the battlefield. By the time that they arrived and made their assault, most soldiers were exhausted and dehydrated. This was something that their commander, Colonel Oates believed was an important factor in what happened. While Oates gives tremendous credit to Chamberlain and the 20th Maine he wrote that the fatigue and dehydration of his soldiers “contributed largely to our failure at Little Round Top.” [22]

Vincent was mortally wounded while leading the defense of the hill. As the men of Robertson’s Texas brigade rushed the hill and threatened to crack “the stout 16th Michigan defense…” [23] Vincent rushed to bolster the defenders. He was standing on a large boulder with a riding crop as the men of the 16th Michigan were beginning to waiver. Fully exposed to enemy fire he attempted to drive the retreating men back into the fight. Brandishing the riding which he cried out: “Don’t yield an inch now men or all is lost,” [24] and moments later was struck by a “minié ball which passed through his left groin and lodged in his left thigh. He fell to the ground and as he was being carried from the field, “This is the fourth or fifth time they have shot at me…and they have hit me at last.” [25]

By Then It Was Too Late: Reflections on a Supreme Court Retirement

In his book They Thought they Were Free Milton Mayer wrote of his conversation with a German university professor colleague after the Second World War:

“How is this to be avoided, among ordinary men, even highly educated ordinary men? Frankly, I do not know. I do not see, even now. Many, many times since it all happened I have pondered that pair of great maxims, Principiis obsta and Finem respice—‘Resist the beginnings’ and ‘Consider the end.’ But one must foresee the end in order to resist, or even see, the beginnings. One must foresee the end clearly and certainly and how is this to be done, by ordinary men or even by extraordinary men? Things might have. And everyone counts on that might.

“Your ‘little men,’ your Nazi friends, were not against National Socialism in principle. Men like me, who were, are the greater offenders, not because we knew better (that would be too much to say) but because we sensed better. Pastor Niemöller spoke for the thousands and thousands of men like me when he spoke (too modestly of himself) and said that, when the Nazis attacked the Communists, he was a little uneasy, but, after all, he was not a Communist, and so he did nothing; and then they attacked the Socialists, and he was a little uneasier, but, still, he was not a Socialist, and he did nothing; and then the schools, the press, the Jews, and so on, and he was always uneasier, but still he did nothing. And then they attacked the Church, and he was a Churchman, and he did something—but then it was too late.”

I feel that if we already haven’t reached to point of things being too late that we are not far from that point and we are closer now with the Justice Anthony Kennedy’s announcement of his retirement from the Supreme Court.

Kennedy announced his retirement yesterday after siding with so-called conservatives on President Trump’s Executive Order targeting Muslims primarily from Iran as supposed security threats. It was an ignominious exit from the Supreme Court for a man who though certainly conservative often acted as the conscience of the court who wrestled with difficult issues and sometimes sided with liberals such in the Obergfell v. Hodges case that at least for now legalized marriage equality.

The decision regarding the Executive Order overturned the decision of Korematsu v. United States which upheld the military orders to send Americans of Japanese descent to detention centers, what in were effect American Concentration Camps. JThat ruling along with Dred Scott and Plessy v. Ferguson is considered one of the most unjust in American history. Justice Robert Jackson who later presided as the organizer and chief prosecutor at the Nuremberg War Crimes Trials wrote in dissent of that ruling:

“A military commander may overstep the bounds of constitutionality, and it is an incident. But if we review and approve, that passing incident becomes the doctrine of the Constitution. There it has a generative power of its own, and all that it creates will be in its own image. Nothing better illustrates this danger than does the Court’s opinion in this case.” 

That is the danger of the Executive Order that the Court upheld. Justice Roberts used the twisted logic of Korematsu to uphold the ruling even as he overturned Korematsu. Justice Kennedy concurred and then retired from the Court leaving a vacancy that will almost be certainly filled by a young, aggressive, and doctrinaire conservative of the new order, unrestrained by precedent or principle. Unless the Democrats go Full Bork Jacket and at least two Republicans grow a set of balls civil rights, civil liberties, and the Constitution are doomed.

The man that nominates Kennedy’s successor is even now under investigation for actions that could be considered by a reasonable person as treason against the United States. That man is the President and almost every day he uses power of his office to demonize any opposition and to dehumanize racial, ethnic, and religious minorities while attacking the freedoms enshrined in the Constitution to free speech and the freedom of the press by referring to his critics as “enemies of the people.” 

The President has invoked violence against his opponents since he was a candidate and then cries foul when political opponents urge non-violent resistance to include the public shaming of his staff members and Cabinet officials who plan (Stephen Miller), execute (Kirstjen Nielsen), and defend (Sarah Huckabee Sanders) his actions against helpless people who he labels as murderers, rapists, and criminals.

Sadly most are refugees from political and criminal persecution and violence in their countries, countries that since the 1840s Americans or the United States Government have treated as subhumans. What is happening now is the result of our past polcies coming home to roost.

Marine Corps Major General and two time Medal of Honor Recipient Smedley Butler wrote in his book War is a Racket:

“I spent 33 years and four months in active military service and during that period I spent most of my time as a high class muscle man for Big Business, for Wall Street and the bankers. In short, I was a racketeer, a gangster for capitalism. I helped make Mexico and especially Tampico safe for American oil interests in 1914. I helped make Haiti and Cuba a decent place for the National City Bank boys to collect revenues in. I helped in the raping of half a dozen Central American republics for the benefit of Wall Street. I helped purify Nicaragua for the International Banking House of Brown Brothers in 1902-1912. I brought light to the Dominican Republic for the American sugar interests in 1916. I helped make Honduras right for the American fruit companies in 1903. In China in 1927 I helped see to it that Standard Oil went on its way unmolested. Looking back on it, I might have given Al Capone a few hints. The best he could do was to operate his racket in three districts. I operated on three continents.”

Despite the fact that the United States has been interfering and exploiting their countries for almost two centuries they are criminals because they want to be free. Their crime is being refugees after the United States instituted race based immigration policies in the early 1900s. These policies were later used to deny Jews fleeing the Holocaust from coming to the United States.

Justice Kennedy left after a series of rulings which seemed to undermine his past judicious behavior on the bench. Maybe at 82 years old he simply decided to punt and place his vote in the column of men who gut the Voting Rights Act, support gerrymandered Congressional districts, and support Executive Orders that while refuting the notorious Supreme Court Decision of Korematsu v. United States used the same logic as that majority used to uphold the President’s third attempt at a travel ban directed a Muslims, primarily Iranians. Japanese Americans who suffered under the military orders enforced by civilian courts and upheld by Korematsu were appalled with good reason.

“Silence in the Face of Evil is Evil Itself” A Critique of Politeness and Civility When Confronting Injustice and Evil

Dietrich Bonhoeffer wrote the words “silence in the face of evil is evil itself.”

This is a very difficult article to write because truthfully I believe that civility and mutual respect should be an ideal that we as Americans should not retreat from, as John F. Kennedy noted:

“So let us begin a new remembering on both sides that civility is not a sign of weakness, and sincerity is always subject to proof. Let us never negotiate out of fear. But let us never fear to negotiate.”

I have written about that a number of times, the last being on November 22nd 2016 shortly after President Trump’s election and on the anniversary of Kennedy’s assassination. However, since that time I have seen the President lead a descent into depravity that I fully comprehended then, though I hoped for a different outcome.

The fact is that the President has in his words, deeds, and tweets destroyed any hope of our political divide being healed, or of Americans of different viewpoints being able to reconcile their differences anytime in the foreseeable future. He stokes the hatred and division almost on an hourly basis, and of course his opponents having become wise to him are rolling up their sleeves and fighting back.

Too me that is an unfortunate situation that might become a tragedy for the United States and the world, as Abraham Lincoln noted “a house divided against itself cannot stand.” To GOP Congressman Steve King of Iowa the sight and sound of Trump’s opponents is like “Harpers Ferry” and what comes next will be “Fort Sumter.” Since King proudly displays the Confederate Battle Flag in his office I know exactly what side of this fight that he is on.

The fact is that he and many like him want bloodshed, they want Civil War, they want to remake the Union in a way that Jefferson Davis and his band of traitors failed to do. As a historian of the period with a book awaiting publication the fact is that in the end it comes down to the fact that King, many of the President’s supporters and quite probably the President himself are all White Supremacists. They want a full and complete return to White Man’s Rule and the subservience of all non-white races and non-Christian religions to it. They are the Know Nothings of the North and Slave Power Secessionists of the South rolled into one package of ignorance, incivility, and hatred.

I write often about comparisons of the attitudes and actions administration and its supporters to Nazi Germany, but truth be told there is a lot of dirty laundry in our own history that sheds light on Trump and his supporters.

The fact is that for nearly three decades the vast majority of Northerners were too polite to criticize the egregious actions of the Know Nothings in their midst or the Southern Slave Power Block that dominated the presidency, Congress, and the Supreme Court for the three decades prior to the War of the Rebellion, also known as the American Civil War, or the War Between the States. Honestly, I think that the term ascribed to it by many Union Veterans in the Grand Army of the Republic after the war, the “War of the Rebellion” is the best.

Those opposed to the Know Nothings and Slave Power Block were condemned as being rude, impolite, and worse. Some were physical assaulted. In 1856 Senator Charles Sumner was attacked by Representative Preston Brooks of South Carolina on the floor of the Senate for his speech against the Kansas Nebraska Act. Sumner was beaten until he was unconscious and Brooks’ heavy cane which he used to conduct the attack broke. Brooks continued to beat Sumner aided by Representative Lawrence Keitt also of South Carolina who brandishing a pistol threatened Senators coming to his aid. Sumner has proclaimed no threats of violence but only spoken the truth about the Act and those that supported it. So much for civility and now.

The scurrilous and overtly violent threats against minorities and civil rights advocates by conservatives, especially White Christian conservatives have continued unabated since from the ante-Bellum South and the Know Nothing North, through the War of the Rebellion, Reconstruction, Jim Crow, to the modern day. Whole political campaigns including that of George H.W. Bush run by Lee Atwater turned on the demonization of African Americans. The same is true regarding the Republican revolution led by Newt Gingrich in the 1990s, and again even more so from the time that Candidate Donald Trump descended to the lobby of Trump Tower in 2015 until now. The President proclaims that White Supremacists and Neo-Nazis are “very fine people.”

The President and many of his followers including administration officials like Stephen Miller set the tone while Presidential spokesperson Sarah Huckabee Sanders lies and denies the President’s words and vilifies anyone that dares to question her. So when she is asked to leave a restaurant, or when Miller or DHS Secretary Nielsen are shamed when trying to enter Mexican restaurants it makes makes my heart bleed. People who have no compassion, no sense of empathy and behave as sociopaths and then act the victim when the tables are turned only deserve scorn.

Their anti-immigrant and often blatantly racist tropes of the President, his administration, and his supporters on the Fox Propaganda Network, the Right Wing media, the Putrid Princes of the Captive Conservative Church, and his assorted sordid supporters should be condemned and opposed around the clock. If they are not then any of us who remain silent knowing the evil of these policies is as guilty as anyone that turned their backs on the Jews in Nazi Germany. The higher the office the greater the guilt and culpability.

That being said if had the chance to see any one of them in a public setting I would not resort to public shaming. I do not own a restaurant or business so I could not ask them to leave. However, that being said if any of them the President himself presented themselves to me at my chapel or any civilian church that I might be celebrating the Eucharist I would deny them communion which from a Christian point of view is “a fate worse than a fate worse than death.”

Bonhoeffer wrote:

“Christianity stands or falls with its revolutionary protest against violence, arbitrariness and pride of power and with its plea for the weak. Christians are doing too little to make these points clear rather than too much. Christendom adjusts itself far too easily to the worship of power. Christians should give more offense, shock the world far more, than they are doing now. Christian should take a stronger stand in favor of the weak rather than considering first the possible right of the strong.”

As for me I must tell the truth and protest against the violence and the arbitrary pride of power exhibited by the Trump administration and its supporters. I could not live with myself if I didn’t do so. Some might think this political and in some sense it is, but it is entirely based on my understanding of the Christian faith and the very premise of the founders of this country, that phrase in the Declaration of Independence that “all men are created equal and endowed by their creator with certain unalienable rights, among them being life, liberty, and the pursuit of happiness.”

If need be I would die for that faith and that proposition and I will not be silent in the face of evil.

Reflections on Life as an Authoritarian State Arises

Friends of Padre Steve’s World,

We are visiting friends in the Washington DC area as we get ready to celebrate our wedding anniversary Monday. It is nice to be relaxing with each other, another friend who is down from Pennsylvania and combined flock of 12 Papillon dogs, three of which are ours. Everyone but me has now gone to their bedrooms while I sip a glass of McClelland’s Highland Single Malt Scotch Whiskey with my little boy Pierre at my side, all 4.8 pounds of him. That’s a good thing.

Since tomorrow’s weather forecast is for continued rain I will probably watch World Cup games, read and spend time with Judy, our friends and the Papillons. If the weather is good Sunday Monday hope to take Judy to the Smithsonian Museum of American History. Monday night we will celebrate our 35th wedding anniversary with our friends. Depending on the weather I hope to get some decent runs and walks in along the Potomac River.

Likewise, despite all that is going on try to take a break from the incessant pounding of crises manufactured by the President and the chaos that he uses to increase his personal power over his administration, the Congress, the media, and yes all of us. Sadly, none of this is going away anytime soon and it will likely become much worse before it gets better; such is the nature of fledgling dictatorships. Even today he demonized all immigrants as criminals and their supporters as being against the rule of law and his supporters applaud as the leaders of his political party cower before him. Eric Hoffer wrote:

Should Americans begin to hate foreigners wholeheartedly, it will be an indication that they have lost confidence in their own way of life.

The words and actions of the President and his supporters bear this out, they claim to be making America great again but they are destroying the very fabric of the ideals on which the nation was founded.

He did this as his administration and immigration agencies imprisons thousands of children, refuses to reunite them with their families, makes plans for camps on military bases to house nearly 150,000 immigrants, sets up checkpoints on American highways demanding that travelers have proof of citizenship, details military JAG officers with no experience in immigration law to serve as Acting US Attorneys to prosecute immigrants.

At a publicity stunt Friday the President compared all immigrants from south of the border to criminals by parading the survivors of people killed by illegals and spouting absolute lies about the number of crimes committed by immigrants, legal and illegal alike. He then took the time to sign his name on the pictures of the victims of those crimes.

Don’t get me wrong, I have a tremendous amount of compassion for the victims of any violent crime. I have stood over the bodies of men, women, and children killed by the bullets of criminals and tried to console their survivors. I did that so many times that I have lost count of the number.

Likewise I have been the victim of violent crime. I was held up at gunpoint with my wife and her family when we were dating and had a pistol pointed at my head as I sat in the back seat of a car unable to go after the gunman without risking the lives of Judy and her parents. I have also had my liefe threatened by White Supremacist for things that I have written, one that was so specific that I reported it to both the local police and the FBI. But in all cases the people who attacked or threatened me were native born Americans.

In the President’s view if you are killed by a dark skinned immigrant your families are called “Angel Families” but if you are killed by an American you and your family do not exist because you serve no political purpose. That my friends is a fact and the statistics show that far more violent crimes are committed by Americans than all immigrants and most actual cases of domestic terrorism in the United States are committed by White Supremacists, and mass murders including those at schools, businesses, entertainment venues, churches or other places of worship are committed by White people, not immigrants. But those go largely unheralded by the President, except for incidental tweets that express thoughts and prayers and praise of law enforcement.

But that is how incipient dictatorships behave. Certain groups are targets, demonized and compared to the worst examples. In the parlance of Trump they are all murderers, rapists, terrorists, gang members, and drug dealers. This behavior runs rampant in dictatorships and authoritarian states. The President has persistently and insidiously invoked that immigrants are evil. Hoffer wrote:

“Hatred is the most accessible and comprehensive of all the unifying agents. Mass movements can rise and spread without belief in a god, but never without a belief in a devil.” 

That has been happening since the day that President Trump announced his candidacy for President and it is no secret. Mexicans were the first devil of his campaign, and he called them criminals, murderers and rapists on the day that he announced his candidacy. The videos of his speeches, his manifold number of Tweets, and the actions of his administration are all too widely available not to be found by anyone seeking the truth about him, but for his most fervent supporters all of those facts are fake, even if he said them in front of millions of people.

Now, events in the United States and at our borders have shown that the President was absolutely correct about his followers when he said that they would continue “to follow him even if he shot somebody on 5th Avenue.”

My friends, it is not going to get any better and we better be ready for what comes next or we will be swept away in the flood of lies and evil to come. Despite his buffoonery, one cannot underestimate the potential evil of the President and his followers. Likewise do not assume that a Blue Wave will happen in November because there may be events that occur which will allow the President to use executive orders enacted by his predecessors during the height of the Cold War and the potential of nuclear war to postpone elections or rule by decree. I refer to this as a Reichstag Fire moment.

Historian Timothy Snyder wrote in his book On Tyranny:

“Modern tyranny is terror management. When the terrorist attack comes, remember that authoritarians exploit such events in order to consolidate power. The sudden disaster that requires the end of checks and balances, the dissolution of opposition parties, the suspension of freedom of expression, the right to a fair trial, and so on, is the oldest trick in the Hitlerian book. Do not fall for it.”

We live in a very perilous time where the vision of our founders could be overturned in the blink of an eye and our Republic, as flawed as it is, but always has embraced the ideal of building a more perfect union will perish from the face of the earth. The nation and people may remain, but the ideal will be gone and with it the Republic.

Resist the Dystopian Law and Order of Trump or be Condemned by History

I love the virtues of the law. When I was in seminary I had friends who asked me why I wasn’t in law school and they didn’t mean it as a compliment. In high school and college debate classes I could be assigned to debate for positions that I abhorred and destroy my opponents by using precedent, history, and even appealing to emotion. Honestly had I not felt a real call to the ministry and later the priesthood I would have become a lawyer, which is something that I occasionally think about doing but at my age I find little motivation to follow, I think that as a priest, historian, and stand-up philosopher and ethicist I can do more with the time required to become a lawyer at my age, but I digress…

The problem is that I see far too many people, especially those in power to be all in favor of being for “law and order” and harsh actions against those alleged lawbreakers while not only excusing, but wholeheartedly supporting the most lawless of Presidents and his policies, almost all of which are based on the most unconstitutional, undemocratic, and inhuman ideas seen in a Western nation since the time of Hitler. To be a “law and order” supporter of President Trump one must subscribe to racism, sexism, homophobia, paranoia, nationalism, and scorn for humanity and even the law itself. If you do not subscribe to that, if you dissent in any way you are an enemy of the President and since the President equates personal loyalty with patriotism an enemy of the state.

Let’s revisit a little bit of history.

The founding fathers of the United States were considered lawbreakers, traitors, and rebels by King George III and his government. One of my distant ancestors. Henry Dundas, Viscount Melville, then serving as Lord Advocate and a member of the House of Lords called them traitors to the Crown. He actually coined the word starvation because he recommended that the rebellious colonies be starved into submission, earning him the nickname of Starvation Dundas. But he was a law and order kind of guy.

In the years after the passage of the Fugitive Slave Act of 1850 people living in Free States could be prosecuted for harboring escaped slaves in the name of the law, even if they were in complete obedience to the laws of their home state. The fact is that at that time States rights only mattered if you were supporting the rights of Slave owners and Slave states. The Dred Scott decision showed this to be fact. To be law and order at that time one had to support white supremacy and the institution of slavery, even if you lived in a Free State. Please don’t get me started on the post-Reconstruction and Jim Crow eras, you can read all of that in my book Mine Eyes Have Seen the Glory’s: Race, Religion, Ideology, and Politics in the Civil War Era when it eventually gets published.

Let’s go now to an even more uncomfortable subject, Nazi Germany and the Holocaust. To be law and order in the Nazi State was to support its racist laws. If you defended or harbored Jews, or for that matter even criticized the policies of the Nazi State you were a criminal. That was the case in Germany as well as the counties that it conquered or occupied. If you harbored or protected Jews you were a criminal. Conversely if you turned in a Jew or informed on their protectors you were obeying the law, thus those who hid and protected people like Anne Frank were criminals while those who turned her and her family in were obeying the law.

In our day President Trump, his administration, and his supporters have turned U.S. law, international law, and basic humanity and I dare say Christian morality on their head in regards to immigrants, legal and illegal alike; racial and ethnic minorities, women, LGBTQ citizens, the free press, and political opponents. Most egregiously this is happening on the Southwestern border of the United States where thousands of children have been separated from their parents who are being prosecuted simply because they are seeking asylum and freedom in a country that they believe stands higher than the countries that they are fleeing.

The policies of the Trump administration are even worse than those of previous administrations, Republican and Democrat, none of which can be called truly humanitarian or in accordance with the principles of the Declaration of Independence. Instead our government and most Republicans have adopted the ideology of King George III and Starvation Dundas; that of the Know Nothings, that of the slaveholder, that of the Jim Crow segregationists, and worst of all that of the Nazi State.

To obey the law is to stand against the principles of the Sermon on the Mount, the Declaration of Independence, the United States Constitution, the Four Freedoms, as well as the principles laid down by the United States and its allies at Nuremberg where Supreme Court Justice Robert Jackson stated before the trials ever started:

“If certain acts of violation of treaties are crimes, they are crimes whether the United States does them or whether Germany does them, and we are not prepared to lay down a rule of criminal conduct against others which we would not be willing to have invoked against us.”

Jackson’s words do not matter to this President or his loyal followers, nor of the words of the Declaration or the Constitution.

I do not recognize my country anymore and I hope almost beyond hope that something will stop our slide into the abyss that Trump and his supporters are bringing upon us. I have to agree with Major General Henning Von Tresckow, a Plotter against Hitler who died in the aftermath of Operation Valkyrie:

“I cannot understand how people can call themselves Christian and not be furious opponents of the Hitler regime.”

He also wrote:

“We have to show the world that not all of us are like him. Otherwise, this will always be Hitler’s Germany.”

Today we simply have to change one word in either of Von Tresckow’s quotes, Trump for Hitler and we also must seriously consider the words of Von Tresckow:

“A man’s moral worth is established only at the point where he is ready to give up his life in defense of his convictions.”

All of us have to show the world that we are not Trump’s America. If we do not we will most deserving of the condemnation of God and history on the United States.

I Will Support and Defend… Reflections on 35 Years of Commissioned Service in the Age of Trump

Thirty-five years ago today I swore an oath as a newly commissioned officer in the United States Army. It is an oath that along with my baptismal, confirmation, marriage, and ordination vows is the most important in my life. Almost two years before that I swore an enlistment oath on August 25th 1981.

It was a hot and smoggy summer day in Van Nuys California when drove into the parking lot of the old Armory on Van Nuys Boulevard in my 1975 yellow Chevy Monza with a black vinyl top. That night the San Francisco Giants defeated the St. Louis Cardinals by a score of 4-2 and the Baltimore Orioles defeated the Seattle Mariners 6-5 in 12 innings.  In less important news the Voyager II space craft reached its lowest orbit around Saturn.

Getting out of the car I walked into the offices of the Headquarters, 3rd Battalion 144th Field Artillery of the California Army National Guard.  I had in my sweaty hands the paperwork from the Army ROTC detachment at UCLA the “Bruin Battalion” accepting me into the program and allowing me to enlist simultaneously in the National Guard.

I was met by the Headquarters Battery Commander, Captain Jeff Kramer who after my commissioning would allow me to borrow his sword and sword belt to wear at my wedding with my Dress Blue Uniform.  Jeff finished his career as a full Colonel in the California National Guard. He took me to Major Charles Armagost the battalion S-1 who rapidly had a clerk type up my enlistment papers and administered the oath of enlistment below:

I, do solemnly swear that I will support and defend the Constitution of the United States and the State of California against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the Governor of California  and the orders of the officers appointed over me, according to law and regulations. So help me God.

That was the beginning of what has turned out to be a very long strange trip.

Renewing the Oath on my Promotion to Lieutenant Commander 2006

In June of 1983 I was commissioned as a Second Lieutenant and I took a different oath, an oath of office versus enlistment, I would repeat it again in February 1984 when I was promoted to First Lieutenant, March of 1987 when promoted to First Lieutenant, and in December 1995 when I was promoted to Major. I swore variations of it in both the Texas and Virginia Army National Guard as well before I commissioned as a Navy Lieutenant  February 9th 1999.  I renewed it in April 2006 upon my promotion to Lieutenant Commander and September of 2011 when I was promoted to Commander. That oath states:

I do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.

Since I swore the oath the first time  I have served in Europe, Asia and the Middle East, at sea and ashore in war and peace.  I have served as a Company Commander and a Staff Officer before becoming a Chaplain. I believe that even today  that there is no greater honor than to serve this country.

It is hard to believe that it has been 35 years.  I do take the oath of office quite seriously especially the part about defending the Constitution against all enemies foreign and domestic.  I have served 30 years I have served under six Presidents

I have not completely agreed with the actions or policies of each President and Congress that I have served. While I have deeply held political views they have never kept me from serving under administrations that I have disagreed with on major policies.  Officers may have strong political views but those must always be subordinated to our oath to support and defend the Constitution.

One of my favorite heroes of the American Civil War, General Winfield Scott Hancock said “We are serving one country and not one man.” Hancock was a states rights Democrat who remained in the Union because he did not believe that secession was legal.  He had no political friends in Washington and he served valiantly during and after the war.  When asked about his opinion on what to do when their home state of Virginia seceded from the Union by his friends and fellow officers George Pickett, Lewis Armistead and Dick Garnett before the war in California he said “I shall not fight upon the principle of state-rights, but for the Union, whole and undivided.”

This is not the case in much of the world. Many militaries swear allegiance to the ruler, the state, ruling political party or the majority religion.  The officers in many Moslem nations combine their oath with the Bya’ah which includes a personal oath to the King or Sheik and the Islamic statement of faith.

The British military swears an oath to the Queen and her successors:

“I  swear by Almighty God that I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth II, her heirs and successors and that I will as in duty bound honestly and faithfully defend Her Majesty, her heirs and successors in person, crown and dignity against all enemies and will observe and obey all orders of Her Majesty, her heirs and successors and of the generals and officers set over me.”

The Red Army of the Soviet Union swore an oath to “to protect with all his strength the property of the Army and the People and to cherish unto death his People, the Soviet homeland and the government of Workers and Peasants, also to respond at the first call from the government of Workers and Peasants to defend the homeland, the USSR.”

Germany has had a rather perilous history with oaths sworn by the military.  The Imperial Army swore an oath to the Kaiser but when the Kaiser abdicated and the Weimar Constitution was ratified German Officers and Soldiers took this oath: “I swear loyalty to the Reich’s constitution and pledge, that I as a courageous soldier always want to protect the German Nation and its legal institutions, (and) be obedient to the Reichspräsident and to my superiors.”  The history of the Republic shows that many officers and soldiers, especially those that had served under the Kaiser resented this oath.

In 1933 Hitler changed the oath to this  “I swear by God this sacred oath, that I will render unconditional obedience to Adolf Hitler, the Fuhrer of the German Reich and people, Supreme Commander of the Armed Forces, and will be ready as a brave soldier to risk my life at any time for this oath.” The current German military oath states: “I swear to serve loyally the Federal Republic of Germany and to defend bravely the right and the freedom of the German people. So help me God.”

All oaths hold potential dangers but those of the United States military officer corps is perhaps the best thought out oath in the world.  The oath is to the Constitution, not a person, political party or religion.  The efficacy of the oath is based on the honor of those that swear to uphold it.  In times of national turmoil it is important for officers and enlisted personnel to ensure that remember that fact.

 

I pray that I will be faithful to the oath and the people that I serve in the coming years.  It is an honor to still remain in the service of this country.  I have served under six Presidents but until 2017 I never believed that I would fear the actions of the President so much that I would based on my oath to the Constitution as well as my ordination vows that I would preach against those actions in a military chapel.

But I remember that my oath is to the Constitution and not any President. I also know that as a Chaplain that I uphold the faith and values of the church that has endorsed me to remain in service as a Chaplain. My call is to serve all of those in my care, and to provide for their rights to the free exercise of religion under the First Amendment. That also extends to the rights of non-believers to not have a state religion shoved down their throats. It also means that I need to speak truth to those in power.  I also remember the words of German General Ludwig Beck who lost his life in the failed attempt on Hitler’s life on July 20th 1944:

“It is a lack of character and insight, when a soldier in high command sees his duty and mission only in the context of his military orders without realizing that the highest responsibility is to the people of his country.” 

Beck had served 35 years before Hitler came to power and initially supported him and many of his goals, but five years later he realized that it was Hitler leading the nation to war and Germany to its destruction. His words are also something that I hold on to today and because of that I will continue to speak out when the President, his appointees, and supporters speak and act against the Constitution, the law, the American people, and against the principles that the country was founded upon, most importantly the words of the Declaration of Independence which states the most revolutionary concept ever promulgated:

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness…”

It then goes on to attack the actions of the British Crown, of which many are being repeated by President Trump and his administration.

I may not be a soldier in high command, but I do realize that my highest duty is not to obey without questioning or criticizing the actions of the President when they go against the Constitution, the law, international treaties that the United States has pledged to uphold, and basic human rights. Thus the oath that I first swore to uphold 35 years ago still matters.
