On Tyranny: Twenty Lessons from the Twentieth Century, 128 pages, Tim Duggan Books, March 2017

Timothy Snyder is the Housum Professor of History at Yale University and a permanent fellow at the Institute for Human Sciences in Vienna. Among his publications are several award-winning books, all of which have been translated: The Red Prince: The Secret Lives of a Habsburg Archduke (2008); Bloodlands: Europe Between Hitler and Stalin (2010), Black Earth: The Holocaust as History and Warning, Snyder is also the co-editor of Wall Around the West: State Borders and Immigration Controls in Europe and North America (2001) and Stalin and Europe: Terror, War, Domination (2013). He helped Tony Judt to compose a thematic history of political ideas and intellectuals in politics, Thinking the Twentieth Century (2012). He is a member of the Committee on Conscience of the United States Holocaust Memorial Museum and sits on the advisory councils of the Yivo Institute for Jewish Research and other organizations.

Today a short review of a very timely new book. Dr. Timothy Snyder’s On Tyranny: Twenty Lessons from the Twentieth Century.

The book is a must read for anyone concerned with the direction that the United States and Western Europe are heading at this time. If we have an expert in understanding tyranny today it is Dr. Snyder. His research and writing in that field, highlighted by his books and publications on the history of Germany and Eastern Europe should be read in order to grasp the full implications of totalitarianism.

This book is timely and concise. It easily can be read in one sitting, but you will want to go back and read it again and again as his salient points need to be thought about, digested, and taken for action, not only in public but in our private lives.

Snyder’s premise is that Americans are no wiser than the peoples of Europe in the 1920s and 1930s in their response and acceptance of totalitarian movements. He asserts that we must grapple with history to understand what is going on and to warn us that temptation “to think our democratic heritage automatically protects us from threats,” is a “misguided reflex.”

In the twenty short chapters of the book Snyder presents twenty historical lessons from the twentieth century which he has adapted to the situation that we find ourselves today. Our founders were aware of the dangers to the republic that they founded, and from their study of Greece and Rome, particularly the threats of oligarchy and empire which overcame those ancient democracies. He explains that the founders attempted to mitigate those dangers in the institutions that they created but did not think that what they created was immune to those threats. James Madison wrote that tyranny rises “on some favorable emergency.”  The understood as Aristotle did that inequity brought instability and Plato’s belief that demagogues exploited free speech to install themselves as tyrants. They “fought to avoid the evil that they, like the ancient philosophers, called tyranny.”  That is an ongoing struggle today, both in the United States and Western Europe.

His talks about the means that authoritarians use to gain and keep power, particularly in their cynical derision of truth, claims to different truths, and alternative facts. One particular point that he makes is that we have to believe in truth, and fight for it. He writes: “To abandon facts is to abandon freedom. If nothing is true, then no one can criticize power, because there is no basis to do so. If nothing is truth, then all is spectacle. The biggest wallet pays for the most blinding lights.”

In each chapter he makes very practical observations and recommendations which can be implemented in our public and private lives. One of the most important of these is real human contact, meeting and getting to know people who came from different backgrounds and experiences than us; simple things like making eye contact, and having private lives, building friendships, and hobbies, even as he notes former Czech dissident and later President Vaclav Havel even suggested brewing beer.

But he also mentions the importance of remembering professional ethics, investigating truth claims, standing out in the crowd, not obeying authority in advance, defend democratic institutions including the press and the courts, to listen for dangerous words such as extremism and terrorism, as well as what he calls the “fatal notions of emergency and exception” and the “treacherous use of patriotic vocabulary.”

I could go on, but I would rather that you read his words. The book can be purchased for under seven dollars, and the Kindle edition for under three dollars.

I highly recommend this book, it is a must for our day.

Human Beings as Property Part 1: American Slavery

I am going to be posting a number of articles from my various texts dealing with the American Civil War era dealing with topics that some would want to forget, but are very important if we want to fully appreciate the struggle of African-Americans for equality. One of these is the distinctly American version of slavery that arose in the American South. That is the subject of today and tomorrow’s articles. More articles will follow in the next couple of weeks.

The Slave Economy and the Divide between North and South

Early Slavery in the Americas and the African Lave Trade

If we are to really understand the Civil War we have to understand the ideological clash between Abolitionists in the North, and Southern proponents of slavery. Slavery began very early in the history of the American colonies and though the British and the Dutch were the largest traders of slaves in those early days, the first American slave ship made its first voyage to bring Africans to the new world. Historian Howard Zinn noted, “By 1800, 10 to 15 million blacks had been transported to the Americas, representing perhaps one-third of those originally seized in Africa. It is roughly estimated that Africa lost 50 million human beings to death and slavery in those centuries we call the beginnings of modern Western civilization, at the hands of slave traders and plantation owners in Western Europe and America, the countries deemed the most advanced in the world.” [1]

Slavery in the Americas grew out of the economic need of planters to for laborers on the vast plantations of the new world as “the number of arriving whites, whether free or indentured servants (under four to seven year contract) was not enough to meet the demand of the plantations.” [2] This need and use of slaves was significantly different than previous forms of slavery in Africa, where slavery was one of a number of forms of labor, and where slaves “worked within the households of their owners and had well-defined rights, such as possessing property and marrying free persons. It was not uncommon for slaves in Africa to acquire their freedom.” [3] In fact the plantation form of slavery practiced in the Americas differed radically from traditional forms of African slavery and was characterized by “the frenzy for limitless profit that comes from capitalistic agriculture; the reduction of the slave to less than human status by the use of race hatred, with that relentless clarity based on color, where white was master, black was slave.” [4]

However in the Americas slavery took on a new form, that of the plantation. The plantation system allowed owners to amass “large concentrations of laborers under the control of a single owner produced goods – sugar, tobacco, rice, and cotton – for the free market.” [5] Beginning with the Spanish and the Portuguese in the early 1500s, the African slave trade became a major part of the world economy, and “slave labor played an indispensable part in its rapid growth” [6] not only in world economy, but in the economy of the English colonies in North America and the new American nation which paradoxically was founded and supposed dedicated to liberty and equality. The “Atlantic slave trade, which flourished from 1500 into the nineteenth century was a regularized business in which European merchants, African traders, and American planters engaged in a highly complex and profitable bargaining in human lives.” [7]

It was economic gain that prompted the growth in slavery, and for which slaves were essential for profit. As such, the “first mass consumer goods in international trade were produced by slaves – sugar, rice, coffee, and tobacco. The profits from slavery stimulated the rise of British ports such as Liverpool and Bristol, and the growth of banking, shipbuilding, and insurance, and helped to finance the early industrial revolution. The centrality of slavery to the British empire encouraged an ever-closer identification of freedom with whites and slavery with blacks.” [8]

The Constitution, Slavery and Disunion

When the United State won its independence the founders of the new nation had to deal with the already existing institution of slavery. It also had to deal with the threat to the Union that the institution and the real possibility of disunion, something that almost all of them feared more than anything. Slavery was an institution that even some powerful politicians who owned slaves were uncomfortable; Patrick Henry noted in 1773 that “to do so was “repugnant to humanity” and “inconsistent with the Bible,” while George Washington wrote in 1786 “There is not a man living…who wishes more sincerely than I do, to see a plan for the gradual abolition of it.” [9]

Slavery was an issue that divided the newly independent states as they gathered for the Constitutional Convention in 1787 and Washington confided to a friend before the convention that “he could “foresee no greater evil than disunion,” and now the “mere discussion of slavery” was poisoning the atmosphere.” [10] James Madison was one of the first to recognize this and noted that “the states differed “primarily from the effects of their having or not having slaves.” [11] The issue came to a head around how the population of the states would be represented in the new government and how to balance the power between the federal government and the various state governments. To do this the founders divided Congress into two houses, the House of Representatives who were directly elected by the voters of each state with the population of the state determining the number of representative each would have; and in the Senate, whose members were elected by the state legislatures, each state would have two members regardless of the size of its population. The division of the legislature in the Constitution “enabled the individual states to retain a large measure of their jealously guarded autonomy.” [12] Eligible voters in each state elected the President by electing “electors” for the Electoral College, and each state was given an amount of electors equal to its representation in the Senate and the House of Representatives.

The heart of the matter came to the issue of what people would be counted in each state. The Northern states wanted to base the number on each state’s white population. The Southern states wanted to “swell their power by counting both white citizens and black non-citizens.” [13] Doing so would give Southern States more power in the House of Representatives which, when coupled with the equality each state had in the Senate, gave the less populous Southern disproportionate power in the national government. A representative from New Jersey, Gouverneur Morris believed that if slaves “were human enough to boost the representation of the Southern States…they should be treated as persons and not property in the South.” [14] There was debate on this issue and to bridge the sectional divide the Convention passed what is now known as the three-fifths compromise.

This measure had profound results. It stipulated that the size of a state’s congressional delegation and its Electoral College electors; and the state’s tax burden would be determined by their population. The population was determined by counting free-persons as a full person, and then adding the words “three-fifths of all other persons.” Of course the “other persons” were slaves, but the language was carefully crafted to avoid the use of the terms slave or slavery to make the document acceptable to Northern delegations. The compromise was the first of many made by the Northern states to appease the South and maintain national unity. The South got less than it wanted, as its delegates wanted slaves to count as a whole person for population sake without considering them as such. When all was said and done in 1790 “southern states, possessing around 40% of the nations’ white population, controlled around 47% of the House and Electoral College.” [15] Gouverneur Morris understood that the compromise would exaggerate Southern power and predicted that “the three-fifths clause’s real legacy would be to give slaveholders majority control over electoral politics.” [16] However, Morris’s warning was unheeded for decades by many in the North, though through electoral experience Northern leaders began to realize what the compromise had wrought but could not change the process without amending the Constitution.

Morris was correct. During the election of 1802 in the Electoral College the “three-fifths clause gave the Southerners 14 extra electors, the Republicans’ Thomas Jefferson defeated the Federalists’ John Adams, 73-65. Jefferson swept South’s extra electors 12-2. If no three-fifths clause had existed and House apportionment been based strictly on white numbers, Adams would have likely squeaked by, 63-61.” [17] The compromise had major impacts on the Electoral College. In the first 36 years of the Republic, only one President came from the North, John Adams. The rest, Washington, Jefferson, Madison and Monroe were all Virginian’s, and all were slaveholders.

Apart from John Quincy Adams who served from 1825-1829 every other President until Abraham Lincoln was either a Southern slaveholder, or a Northern supporter of the South’s position on the preservation and or expansion of slavery. In fact the South dominated all branches of the Federal government from 1789-1861, often with the cooperation of Northern political and business interests. James McPherson wrote, “A Southern slaveholder had been president of the United States two-thirds of the years between 1789 and 1861, and two-thirds of the Speakers of the House and president pro tem of the Senate had also been Southerners. Twenty of the thirty-five Supreme Court justices during that period had been from slave states, which always had a majority on the court before 1861.” [18] Those who believed in the South’s moral, religious, and cultural supremacy over the North often used the Southern domination of American politics as proof of that superiority.

Two other compromises were made by the delegates to the convention. The first dealt with ending the African slave trade. This was contentious and in response to the threat of ending the trade the delegates from South Carolina, John Rutledge and Charles Cotesworth Pinckney insisted that “South Carolina could not join the proposed Union if the slave trade was prohibited.” [19] The compromise allowed the African slave trade to remain legal until 1808 unless Congress voted to allow it to continue. However, this was the first of many threats by Southern leaders and states to threaten disunion over the issue of slavery. A final compromise required states to “extradite and deliver any fugitive from service to his or her master and state of origin.” [20] The wording of the law was purposely vague and could include indentured servants, but the real target was escaped slaves.

The early compromises set the stage for future compromises, in large part because Federalist politicians preferred compromise over disunion, and their fear was that “failure to compromise would bring disunion” [21] and with it disaster. Thus the convention approved the compromises and the states, even Northern states which had abolished or were on the way to abolishing slavery ratified it.

Slavery in the Early Years of the United States

Slavery expanded in the American colonies and continued to do so after American independence despite the fact that a number of prominent slaveholders including George Washington voluntarily emancipated their slaves in the 1780s and 1790s. In large part this was due to fact that the United States “purposely built a weak central state, dispersing power to govern from the center to the constituent (some would have said still sovereign) parts.” [22] That being said the in the new Constitution the founders ensured that the central government was far stronger than the attempt made in the initial Confederation of States in matters of tariffs, taxes and laws to protect bondholders, slaveowners, and land speculators. In this government the land owners of the Southern states, as well as the merchants of the North held the bulk of the economic, political and social power. Significantly, “most of the makers of the Constitution had some direct interest in establishing a strong federal government: the manufacturers needed protective tariffs; the moneylenders wanted to stop the use of paper money to pay off debts; the land speculators wanted protection as they invaded Indian lands; slaveowners needed federal security against slave revolts and runaways; bondholders wanted a government able to raise money by nationwide taxation, to pay off those bonds.” [23] The Constitution ensured that the Federal Government was strong enough to protect those interests, but not strong enough to encroach on the powers granted to the states, especially the powers of slave states.

The conflict between supporters of slavery and those who opposed it on either humanitarian, religious or political-ideological grounds would become more of a source of even conflict when slavery was give a boost by Eli Whitney’s invention of the Cotton Gin. This machine made the production of cotton and its export an even more profitable enterprise requiring more slaves to meet the expanding demand and it was not something that those who believed that slavery would expire of its own accord expected. Thomas Jefferson wrote in 1805 that in regard to slavery that “interest is really going over to the side of morality. The value of the slave is every day lessening; his burden on his master dayly increasing. Interest is therefore preparing for the disposition to be just.” [24] Of course Jefferson, who owned over 200 slaves and had built much of his political base among Virginia planters was wrong, and despite the misgivings that he expresses in some of his letters and papers, including the first draft of the Declaration of Independence, he never took the lead or a public stand on the abolition of slavery.

The difference made by the cotton gin was starling, it enabled greater production and increased the need for slaves, and with the end of the legal African slave trade in 1808 the price of slaves already in the United States went up considerably, making the interstate trafficking of slaves much more profitable. In 1790 “a thousand tons of cotton were being produced every year in the South. By 1860, it was a million tons. In the same period, 500,000 slaves grew to 4 million.” [25] This enriched Northerners as well, “Northern ships carried cotton to New York and Europe, northern bankers and merchants financed the cotton crop, northern companies insured it, and northern factories turned cotton into textiles. The “free states” had abolished slavery, but they remained intimately linked to the peculiar institution.” [26] Thus the institution of slavery’s tentacles reached out to much of America and with the threat of slave rebellions in the South which could upset the economic status quo the nation “developed a network of controls in the southern states, backed by laws, courts, armed forces, and race prejudice of the nation’s political leaders.” [27]

But during the early nineteenth century slavery was on the decline in the rest of the Americas as the Spanish, Portuguese and French lost most of their American possessions, many which became independent and abolished slavery, in each case for the newly liberated countries in Latin America and South America, as well as the ending of serfdom in Europe. Likewise Britain emancipated its slaves in the 1830s and the slaves in its colonies and most countries, even the United States banned the African slave trade. This would lead to increasing calls for the abolition of slavery in the United States and the formation of abolitionist societies, newspapers and stepped up efforts to help slaves escape their bonds and with the advent of a small but vocal abolitionist movement there was a movement, particularly in religious circles to justify and defend the peculiar institution.

All Should be Equally Free: Recognizing the Terror of the New Religious Liberty Laws

This may seem a familiar topic for my readers, but due to events in a number of states I feel compelled to talk about it again. The issue of religious liberty and the right to free expression has once again come to the fore in the wake of the Obergfell v. Hodges ruling and the pathetically un-American passage of particularly odious, religiously based anti-LGBT laws in North Carolina, Mississippi, and Tennessee, as well as one that was vetoed by Georgia’s governor. I call these laws pathetic and un-American because they fly in the face of the ideals of the real champions of religious liberty in the United States. One of these early proponents of religious liberty and freedom in the United States was the Virginia Baptist pastor, John Leland.

Sadly, many American Christians either have never heard of him. Likewise, if they have heard of him, as the great pontificator, Mike Huckabee should have in his brief tenure as a student at Southwestern Baptist Theological Seminary; they seem to have ignored his warnings about state religion. I guess that problems in his church history and Baptist history classes were a big reason that he left seminary. Ideologues like the Huckster didn’t last at Southwestern, at least until the fundamentalist takeover in 1994 that helped destroy the academic and scholarly reputation of that once fine school, but I digress….

Leland was a friend of Thomas Jefferson and James Madison and without him it is unlikely that the First Amendment of the Constitution would have mentioned religious faith. Leland had a very personal interest in this as during the 1780s the Anglican Church in Virginia was attempting to again become the official state religion. Anglicans, with the help of local authorities were attacking Baptist congregations and even resorting to physical violence. In defiance of the Anglicans, Leland wrote:

“The notion of a Christian commonwealth should be exploded forever. … Government should protect every man in thinking and speaking freely, and see that one does not abuse another. The liberty I contend for is more than toleration. The very idea of toleration is despicable; it supposes that some have a pre-eminence above the rest to grant indulgence, whereas all should be equally free, Jews, Turks, Pagans and Christians.”

There is a form of religion and indeed the “Christian” faith that is toxic and if not treated leads to the spiritual and sometimes the physical and emotional death of the infected person.

There is a nationalized version of this supposedly Christian faith in the Untied Stats today. It is a bastardized version of the Christian faith overlaid with the thin veneer of an equally bastardized version of American history. Its purveyors are quite popular in the world of “conservative” American Evangelicalism and Catholicism.

Supreme Court Justice Robert Jackson and chief Nuremberg war crimes trials prosecutor warned us about people like them over a half-century ago. Jackson wrote, “[I]n our country are evangelists and zealots of many different political, economic and religious persuasions whose fanatical conviction is that all thought is divinely classified into two kinds — that which is their own and that which is false and dangerous.”

Pat Robertson, evangelist and founder of the Christian Broadcasting Network is an example of what Leland and Jackson warned us about. Robertson said on his program that “You say you’re supposed to be nice to the Episcopalians and the Presbyterians and the Methodists and this, that, and the other thing. Nonsense, I don’t have to be nice to the spirit of the Antichrist.” — Pat Robertson, The 700 Club, January 14, 1991. The late David Chilton was another. He wrote: “We believe that institutionally Christianity should be the official religion of the country, that its laws should be specifically Christian”

It is quite fascinating when you look at it. This faith is a combination of a selective reading of American history, Christian teaching and Biblical interpretation that mixes and matches a wide variety of mutually conflicting and contradictory traditions. This Toxic “faith” if you can call it that; is based on a reading of American and Western History, which negates, marginalizes or willingly distorts the views or contributions of those who they disagree. It does not matter of their opponents are not Christians, or were Christians, including Baptists like John Leland and Roger Williams. Due to their experiences of religious persecution, Williams and Leland refused to buy into any form of state sanctioned religion.

I find it interesting that Conservative Icon and champion of limited government Barry Goldwater had great reservations about those that sought to establish the superiority of any religion. Goldwater said on the Senate floor: “The religious factions that are growing throughout our land are not using their religious clout with wisdom. They are trying to force government leaders into following their position 100 percent.”

The leaders of this new and quasi “Christian faith” are many and include some of the most popular religious leaders in the United States such as Pat Robertson, the pseudo-historian David Barton, James Robison, Gary North, Bryan Fischer, James Dobson, Gary Bauer Phyllis Schafley and a host of others. For them the Gospel has been equated with government legislation of supposedly “Christian” values; which conveniently are defined by their political agenda, often in complete contradiction to the Gospel and to nearly 2000 years of Christian experience. North, one of the most eloquent expositors of the Dominionist movement wrote:

“The long-term goal of Christians in politics should be to gain exclusive control over the franchise. Those who refuse to submit publicly to the eternal sanctions of God by submitting to His Church’s public marks of the covenant–baptism and holy communion–must be denied citizenship, just as they were in ancient Israel.”

That is quite a statement and those who think that they can co-opt people like North, Robertson or others are quite mistaken. Goldwater realized this. What is fascinating to me is to watch these men and women advocate religious and political positions in regard to Church-State relations that completely opposite of what early American Christian and non-Christian civil libertarians imagined when our country was founded. Positions that quite often are at odds with even the historical tenants of their own faith. Their only claim to innocence can be because not a one of them have any training in history and often are even worse when it comes to their understanding of the Christian tradition, which did not begin in and will not end in the United States.

In this confused and often hateful “faith” we see men and women who hate centralized government but extol a centralized religion. I was talking with a friend who is adamantly opposed to a powerful Federal Government but extols the perfection of the centralized bureaucracy of his Roman Catholic Faith. He could not see the contradiction. I watch others who extol an almost Libertarian understanding of the government and the Constitution who supposedly in their religious tradition are from the “Free Church” who now advocate the supremacy of the Church over the State and in doing so their particular and limited understanding of Church over that of the Church Universal.

In this confused and contradictory setting there are Catholics espousing political views that are in direct opposition to the understanding of government supported by the Magisterium of the Church. There are Evangelical and Charismatic Protestants that mix and match the untenable and contradictory beliefs of Dominionism and Millennialism which involve on one hand the takeover of earthly power by the Church and the ushering in of the Kingdom of God and the understanding that earthly power is ultimately under the dominion of Satan and must be overcome by the Second Coming of Christ.

Leland wrote:

“These establishments metamorphose the church into a creature, and religion into a principle of state, which has a natural tendency to make men conclude that Bible religion is nothing but a trick of state.”

Leland was one of the most important persons in regards to the relationship of the Christian Churches to the American Government. He was a champion of the religious liberty enshrined in the Bill of Rights and helped influence both James Madison and Thomas Jefferson. He noted in 1791:

“Is conformity of sentiments in matters of religion essential to the happiness of civil government? Not at all. Government has no more to do with the religious opinions of men than it has with the principles of mathematics. Let every man speak freely without fear–maintain the principles that he believes–worship according to his own faith, either one God, three Gods, no God, or twenty Gods; and let government protect him in so doing, i.e., see that he meets with no personal abuse or loss of property for his religious opinions. Instead of discouraging him with proscriptions, fines, confiscation or death, let him be encouraged, as a free man, to bring forth his arguments and maintain his points with all boldness; then if his doctrine is false it will be confuted, and if it is true (though ever so novel) let others credit it. When every man has this liberty what can he wish for more? A liberal man asks for nothing more of government.” John Leland, “Right of Conscience Inalienable, and Therefore, Religious Opinions Not Cognizable By The Law”

When the adherents of a faith, any faith, but especially the Christian faith enlist the government to enforce their understanding of faith they introduce a toxicity that is eventually fatal when consumed and acted on.

I think that much of what we are witnessing today is much more the product of fear mongering preachers that see opportunity in their political alliances and that are willing to reduce the Gospel to a number of “Christian values” in order to achieve a political end; even if that end is ultimately destructive to the Church and to the Gospel.

The message of the Apostle Paul to the Church in Corinth was this: “All this is from God, who reconciled us to himself through Christ, and has given us the ministry of reconciliation; that is, in Christ God was reconciling the world to himself, not counting their trespasses against them, and entrusting the message of reconciliation to us.” (2 Cor 5:18-19 NRSV) 

The early church thrived when it had no earthly power. It thrived when it was persecuted and when the Roman government openly supported almost every religion but it. However, once it became powerful and worldly it became ensnared in affairs far from that simple message of reconciliation.

It was in this country that the various sects of the Christian faith had the opportunity to make a new start, unencumbered by the trappings of power. But instead, like those that came before us, the toxin of power has all too often seduced us. John Leland understood this and fought to ensure that all people of faith were free and unencumbered by state supported religion.

Leland’s friend James Madison wrote to Edward Everett toward the end of his life:

“The settled opinion here is, that religion is essentially distinct from civil Government, and exempt from its cognizance; that a connection between them is injurious to both; that there are causes in the human breast which ensure the perpetuity of religion without the aid of the law; that rival sects, with equal rights, exercise mutual censorships in favor of good morals; that if new sects arise with absurd opinions or over-heated imaginations, the proper remedies lie in time, forbearance, and example; that a legal establishment of religion without a toleration could not be thought of, and with a toleration, is no security for and animosity; and, finally, that these opinions are supported by experience, which has shewn that every relaxation of the alliance between law and religion, from the partial example of Holland to the consummation in Pennsylvania, Delaware, New Jersey, &c., has been found as safe in practice as it is sound in theory. Prior to the Revolution, the Episcopal Church was established by law in this State. On the Declaration of Independence it was left, with all other sects, to a self-support. And no doubt exists that there is much more of religion among us now than there ever was before the change, and particularly in the sect which enjoyed the legal patronage. This proves rather more than that the law is not necessary to the support of religion” (Letter to Edward Everett, Montpellier, March 18, 1823).

That is the antidote to the toxic faith embodied in the politically motivated Christian Right. It stands against any idea of a state sanction or religion or a religion that like in Saudi Arabia or Iran controls the state. It stands in opposition to the beliefs of so many “Christian” religious leaders work to ensure that they control the powers of government. Attempts that try to proclaim their superiority above even the ultimate message of the Gospel that proclaims, “for God so loved the world….” 

By the way there are always results. The Puritans who many extoll were some of the most intolerant of dissenters of any group that has every held the reins of power over the state and religion ever known in this country. Their victims included Quakers as well as American Indian converts to Christianity. The picture below of the Puritans hanging Quakers in the Massachusetts Bay Colony should give pause to anyone who thinks that such actions are not possible today should any religion gain control of political power.

Be Careful What You Vote Against

Since the Illinois and Missouri primary results will not be settled before I pass out tonight I will save my article about the results of what happened last night until tomorrow. As such I see no reason to do much commentary other than to note that Missouri is going to be close in both the Republican and Democratic races. 

Because of that  I am republishing an article that I wrote almost four years ago. Truthfully, no matter what your political leanings are I think that is important and well worth the read. I find that too many people don’t take the time to examine the second, third, and fourth order consequences of their actions, and that includes the action of casting a vote. Far to many votes are cast out of emotions, especially those of fear and anger, and without thought of the long term consequences. That was the case in less than a century ago in Germany. 

was reminded oft his article when a friend of mine remembered it and posted a link to it on Facebook a couple of days ago. In his note about it he noted that I was well ahead of the media. I hate it when that happens, but such is the danger of being a historian who has the capacity of self-reflection. The article is here in its entirety. I have not updated it with any references to Donald Trump or the violence that is occurring with startling regularity on the campaign trail. Even so it is decidedly uncomfortable reading, especially when I see quite a few Evangelical leaders, including pastors, and media pundits endorsing Trump.

German Pastor Martin Niemoller wrote: “I hated the growing atheistic movement, which was fostered and promoted by the Social Democrats and the Communists. Their hostility toward the Church made me pin my hopes on Hitler for a while. I am paying for that mistake now; and not me alone, but thousands of other persons like me.”

Martin Niemöller

Martin Niemöller was a war hero. He had served on U-Boats during the First World War and commanded a U-Boat in 1918 sinking a number of ships. After the war he resigned his commission in the Navy in opposition to the Weimar Republic and briefly was a commander in a local Freikorps unit. His book Vom U-Boot zur Kanzel (From U-boat to Pulpit) traced his journey from the Navy to the pastorate. He became a Pastor and as a Christian opposed what he believed to be the evils of Godless Communism and Socialism. This placed him in the very conservative camp in the years of the Weimar Republic and he rose in the ranks of the United Evangelical Church of the Old Prussian Union. Active in conservative politics, Niemöller initially support the appointment of Adolf Hitler as Chancellor.

However, he quickly soured on Hitler due to his insistence on the state taking precedence over the Church. Niemöller was typical of many Germans of his era and harbored ant-Semitic sentiments that he only completely abandoned his anti-Semitic views until after he was imprisoned. He would spend 8 years as a prisoner of the Nazis a period hat he said changed him including his views about Jews, Communists and Socialists. Niemöller was one of the founding members of the Pfarrernotbund (Pastor’s Emergency Federation) and later the Confessing Church. He was tried and imprisoned in concentration camps due to his now outspoken criticism of the Hitler regime.

Herman Maas

Herman Maas was another Evangelical Pastor. Unlike Niemöller, Maas was a active participant in the ecumenical movement, built bridges to the Jewish community and defended the rights of Jews as German citizens. He received a fair amount of criticism for his attendance of Reichspräsident Friedrich Ebert’s funeral. Ebert was both a Socialist and avowed atheist. Maas too was active in the Pfarrernotbund and the Confessing church, and unlike Niemöller maintained his opposition to anti-Semitism and the Nazi policies against the Jews. He would help draft the Barmen declaration. He too would be imprisoned and survive the war. Maas was the first non-Jewish German to be officially invited to the newly formed state of Israelin 1950. In July 1964 Yad Vashem recognized the Maas as one of the Righteous Among the Nations.

Dietrich Bonhoeffer

Dietrich Bonhoeffer a young Pastor and theologian would also step up to oppose the Nazis and offer support for the Jews. He helped draft the Bethel Confession which among other things rejected “every attempt to establish a visible theocracy on earth by the church as a infraction in the order of secular authority. This makes the gospel into a law. The church cannot protect or sustain life on earth. This remains the office of secular authority.” He also helped draft the Barmen declaration which opposed and condemned Nazi Christianity. Bonhoeffer would eventually along with members of his family take an active role in the anti-Nazi resistance as a double agent for Admiral Canaris’ Abwehr. For this he would be executed after his final sermon in the concentration camp at Flossenburg just a month prior to the end of the war. Bonhoeffer wrote “If you board the wrong train, it is no use running along the corridor in the other direction.”

Another opponent of the Nazis in the Confessing Church was Swiss-German theologian Karl Barth. Barth went into exile as a Swiss citizen but remained active in the criticism of the Nazi regime.

Catholic Bishop Galen of Münster and others including Father Rupert Meyer in Munich who opposed Hitler in the early 1920s would also oppose the Nazi policies toward the Church and the Jews. Some like Meyer would end up in concentrations camps with some like Canon Bernard Lichtenberg of Berlin dying at the hands of the Nazis.

All these men took risks to defend the Jews who were religious minority group that had been traditionally discriminated against in Germany. They opposed the Nazi policies which were widely supported by much of the German populace making them unpopular in their own churches as among the traditionally conservative supporters of the Evangelical and Catholic Churches. The Jews were not simply discriminated against as a racial or religious group but also identified with the political left, especially the Social Democrats, Independent Socialists, Communists and the Spartacists.

Since the Independent Socialists, Communists and Spartacists were all involved in attempts to create a Soviet state during the early tumultuous years of Weimar and been involved in many acts of violence against traditional German institutions and the state, they were viewed by Hitler and others as part of the Bolshevik-Jewish threat to Germany. A sentiment harbored by many non-Nazi conservatives and Christians.

Karl Liebnicht and Rosa Luxembourg were among the high profile leaders of this movement in Germany and both were Jewish. The fact that many in the leadership of the Bolshevik movement in theSoviet Union were Jewish added fuel to the fire that the Nazis stoked in Germany. Hitler and the Nazis played on the historic, but muted prejudice against German Jews who in many cases were more secular and German than religious and had assimilated well in Germany. Hitler’s rhetoric as well as that of other Nazis and Nazi publications helped identify the Jews as part of the “Stab in the back” myth that was commonly used by the German right to explain the defeat in the First World War. Thus they were painted as a political and social threat to Germany.

Nazi Political and Religious Opponents in Concentration Camps

When Hitler took power persecution of the Jews began in earnest. Jews were along with Communists, Trade Unions and Socialists enemies of the state. They were banned from the military, civil service and other government employment, professional associations and forced to wear a gold Star of David on their clothing. Their property was seized, many were abused by SA men acting as deputized auxiliary police and many times their businesses, Synagogues and homes were vandalized, burned or seized by the state. Many would be forced to flee in order not to be sent to ghettos and concentration camps. Even those leaving only escaped with the minimum of their possessions as the Nazi regime extorted anything of value from them as they left Germany. This was all done because Hitler and those like him portrayed the Jews as not only an inferior race, but enemies of the state and the German people.

Hitler portrayed himself and his movement as defenders of Christianity. He was not the first or last to do so but his speech of February 1st 1933, the day after he was appointed Chancellor by President Hindenburg made it abundantly clear that he was bent on securing the support of Christians to solidify his grip on power: “The National Government will regard it as its first and foremost duty to revive in the nation the spirit of unity and co-operation. It will preserve and defend those basic principles on which our nation has been built. It regards Christianity as the foundation of our national morality, and the family as the basis of national life. . . .”

The Sturmabteilung (SA) at Church

Churches became sponsors of Nazi meetings, the Swastika banner hung in the sanctuaries of churches throughout the Reich and Bishops, Priests and Pastors joined Nazi organizations and gave the Nazi salute. They had sold their soul to Hitler and the Nazis out of fear of the Communists, Socialists, Jews and Slavs.

Eric Hoffer noted that “It is when power is wedded to chronic fear that it becomes formidable.” Hitler and his enablers spread fear and took advantage of it to bring those fearful of the left to his support.

Today we face a similar phenomena in conservative circles in the United States. This time it is not the Jews but Moslems, Gays, immigrants and racial minorities who are the targets of the xenophobic rage by many influential members of the “conservative” media including Rush Limbaugh, Sean Hannity and numerous others. Their popularity in voicing support for “Christian morale values” such as being against abortion has ingratiated them with conservative Christians. It is so bad that that many “conservative” Christians cannot differentiate between their vitriolic and un-Christian rage against Moslems, Gays and Lesbians, trade unionists, Democrats or anyone else portrayed by the big media talkers and the Gospel.

It is if they have become an appendage to Republican or “conservative” politicians rather than a Christian church. It is not uncommon to see Christians on the web or on the call in talk radio programs identify lock stock and barrel with Limbaugh and others identifying the crass materialism and social Darwinism of “pure” Capitalism and the anti-Christian policy of pre-emptive war. That may seem harsh, but many of these people in the “Conservative Bible project” seek to re-translate the Bible into their own political, social and economic policies even seeking to change or minimize any Scripture that might be equated with the “Social Gospel.” Unfortunately many Christians and others have jumped in on the anti-Moslem and anti-immigrant crusades and anti-Gay launched by those on the far right.

There are those on the far right that advocate eliminating all Moslems from the military, government, security intelligence and police forces and even universities. Similar threats are made against non-European immigrants, legal and illegal alike especially those from Mexico or Latin America. I have a friend; a Navy Officer who served a year in Iraq that was confronted by a member of the “Minutemen” in Texas to show his Green Card and threatened simply because he is Mexican. Others especially conservative Christians suggest criminalizing homosexuality, jailing homosexuals or putting them in concentration camps, deporting them or even punishing gays with the death penalty.

This is so similar to the Nuremberg Laws and the Aryan Paragraph issued by the Nazis that it is scary. Likewise the threats to American Moslems or Gays of placing them “behind razor wire” as we did to American Japanese citizens in World War II are chilling. I wonder how Christians would react if an atheist or someone on the political left suggested all conservative Christians or members of pro-Life groups be imprisoned for the actions of Christians or pro-Life movement members like Scott Roeder or Eric Rudolph who killed to stop abortion or Fred Phelps and his Westboro Baptist Church?

This new found militancy has swept up the “Christian right” and others since 9-11 and has reached proportions that I could never have imagined. After my tour in Iraq I realized that much of what these people were saying was not Christian at all and when taken to their logical conclusion would be a police state in which anyone who opposed them would be persecuted. I question the motivations of the leaders of the movement but believe that most of the Christian conservatives have been caught up in the anger and the emotion of the times versus being true believers in what these men say. That being said, you don’t have to be a true believer to be a willing accomplice in actions that first are not Christian and second trample on the Constitutional rights of American citizens.

I could keep citing examples but if someone can show me where this is condoned in the Gospels I would like to know. The fact is that Christians are to place God first and defend the rights of others, even non-believers. This is found not only in Scripture but runs through the Christian tradition across the denominational spectrum.

The persecution of American Moslems, minorities, Gays and others is dangerous, not just for those minorities but ultimately for Christians who endorse and advocate against those groups. American and English law is based on legal precedence. Once something has been determined to be legal, or constitutional it is considered by the law to be settled law. This is a point made by Chief Justice Roberts regarding Roe v. Wade at his confirmation hearings. If Christians want to use the law against Moslems or for that matter any other minority be it religious or political they tread on very dangerous ground. Not only do they make a mockery of the Gospel command to love our neighbors, care for the foreigners among us and to be a witness to non-Christians support policies or laws that if enacted could and very well would be used against them by their opponents.

During the Republican Presidential primaries major leaders of the Evangelical movement and churches did all that they could to paint Mitt Romney as a religious cultist because he is Mormon. When Romney secured the nomination those same people started backtracking and committing their support to him because they believe that President Obama is an enemy of the country. They don’t like Romney, they are just against Obama. Romney will remember what they called him and their tepid support. If he becomes President he will not be beholden to them and will govern as he desires. Laws and Executive orders that give expanded power to the Executive Branch will not be overturned and if Evangelicals decide that they don’t like what he is doing and act toward him as they have President Obama they could find themselves on the outside and abandoned by the man that they supported.

Law is all about precedent and if such laws were enacted and upheld by the courts they would be settled law that could be used against anyone. What these dear brothers and sisters fail to realize is that such laws can be turned against them if the state should ever decided based on the statements of actions of some that the Christian community is a threat to state security of the public welfare. With the actions of some radical Christians who have committed murder and violence against political, social and religious opponents it would not be hard for the government to label whole churches as enemies of the state. The law is a two edged sword and those who want to use it to have the state enforce their religious, social, ideological or political beliefs on others need to remember what comes around goes around.

The Confessing church understood this and many were imprisoned, exiled or killed for this belief. The founding fathers of this country understood this too, that is why there is the Constitutional protection of Religion in the First Amendment. This was put in because Virginia Baptists who had been persecuted by Anglicans lobbied James Madison for the amendment in the Bill of Rights threatening to withdraw their support for his candidacy if he did not. Niemöller would discover the depths of his earlier folly in prison telling one interviewer after the war:

“I find myself wondering about that too. I wonder about it as much as I regret it. Still, it is true that Hitler betrayed me. I had an audience with him, as a representative of the Protestant Church, shortly before he became Chancellor, in 1932. Hitler promised me on his word of honor, to protect the Church, and not to issue any anti-Church laws. He also agreed not to allow pogroms against the Jews, assuring me as follows: ‘There will be restrictions against the Jews, but there will be no ghettos, no pogroms, in Germany. I really believed given the widespread anti-Semitism in Germany, at that time—that Jews should avoid aspiring to Government positions or seats in the Reichstag. There were many Jews, especially among the Zionists, who took a similar stand. Hitler’s assurance satisfied me at the time. On the other hand, I hated the growing atheistic movement, which was fostered and promoted by the Social Democrats and the Communists. Their hostility toward the Church made me pin my hopes on Hitler for a while. I am paying for that mistake now; and not me alone, but thousands of other persons like me.”

It is easy for well meaning people Niemöller to be bought with promises of support by politicians and media types who speak the words they want to hear in difficult times. So today I suggest the formation of an ecumenical Pastor’s Emergency League which will not be bought by the empty and godless promises of hate mongers on the right or the left. Such a group of men and women spanning the breadth of the Christian tradition and others that see the danger of extremism of all types is becoming necessary. Such a step is becoming necessary due to the militancy of the Christian right as well as the militancy of atheist groups who lobby against all public religious expression by any religion. Such a League would respect the various creeds and statements of faith of each member’s denomination. The movement of the right has set a dangerous course fraught with perils that they do not comprehend.

We have entered a dangerous phase of American history. These movements have the potential not only to oppress law-abiding and patriotic Americans of all faiths and to crush the religious freedoms of all in this county. Suggesting that American citizens, including those who serve the county in the military or government of entire religious, ethnic, political, religious affiliation or sexual preference be jailed, banned from office or fired is totalitarian and dare I say Nazi like.

Niemöller would say it well in this poem:

First they came for the communists, and I did not speak out—because I was not a communist;
Then they came for the socialists, and I did not speak out—because I was not a socialist;
Then they came for the trade unionists, and I did not speak out—because I was not a trade unionist;
Then they came for the Jews, and I did not speak out—because I was not a Jew;
Then they came for me—and there was no one left to speak out for me.

Freedom or Security? The Precarious Balance

The Roman philosopher and political theorist Cicero wrote words that are chilling, and over 2000 years after he wrote them, still troubling, “Inter Arma Enim Silent Leges,” in time of war the law stands silent…

Yesterday I wrote a piece that dealt with the moral and ethical costs of fighting a war against the self-proclaimed Islamic State using the lens of the Star Trek Deep Space Nine episode In the Pale Moonlight. I found it troubling and even had some nightmares involving this war, as a result I did not sleep well last night. So today I am going to continue the discussion, with a slightly different emphasis, again using a Deep Space Nine episode, this one called Inter Arma Enim Silent Leges which deals with a Federation security service trying to co-opt the Chief Medical Officer of Deep Space Nine to spy for them.

James Madison wrote that “A popular government, without popular information, or the means of acquiring it, is but a prologue to a farce or a tragedy; or, perhaps both.”

After September 11th 2001 the National Security State went into overdrive with the passage of the so called Patriot Act. That act opened the floodgates for an ever expanding national security state. With the growing likelihood that a Russian airline was destroyed by a terrorist bomb over the Sinai Peninsula, the probability is that more and more civil liberties will disappear in the name of national security. The fact is that we as a society need to wrestle with the questions of maintaining an open and free society in the midst of a world that is growing ever more dangerous. If we are to maintain an open and free society we must have this discussion, and we cannot allow ourselves to be duped into surrendering the very rights and civil liberties that we hold dear, in the name of security against threats real, and imagined. The fact that the threat to civil liberties is growing, and has been for the last decade and a half under both Republican and Democratic administrations, and Congresses controlled at one time or another by the Republican and the Democratic Parties.

I have a lot of apprehension when I read the reports about the activities of the National Security Agency, other intelligence and police agencies at all levels of government and the pervasive erosion of civil rights.  The national security state and the seeming all pervasive security and surveillance apparatus which demolishes any sense of privacy, especially the protections enunciated in the Fourth Amendment and to some extent the First Amendment. Of course the use of similar methods by the private sector, often in conduction with government agencies is another concern, but that needs to wait for another day.

I also understand from history and empirical evidence that many others, many from unfriendly countries do not share those apprehensions. Many of these competitors are willing to use whatever openness that we have as a society against us, using similar technology and methods used by our intelligence, police, governmental and private sector. It makes for an ethical, legal and even constitutional conundrum. I know that I am not comfortable with this, and perhaps maybe none of us should be.

It is very easy on one hand in light of history, our Constitution and democratic process to condemn the NSA, the FISA courts and other lawfully constituted agencies and those that drafted the laws over the decades that allow the activities which they now conduct. The same can be said of foreign intelligence agencies which all engage in similar activities including the British GCHQ, the German Bundesnachrichtendienst and so many others including the Chinese and Russians.

Likewise it is equally easy in light of history, current events and national security concerns for people to jump to the other side of the fence and not only defend the activities of the NSA and agencies like it, and to demonize those that protest or expose such activities.

When I see the talking heads on cable news shows defending or condemning such activities and not agonizing over the complexity and issues involved I get worried. Because there are legitimate concerns voiced by critics as well as defenders. But since we live in an era of soundbites, gotcha and half-truths being portrayed as all truth I find it helpful to use either historical examples, literature or fiction, and even science fiction to wrestle with the fundamental truths. So I find looking at such issues through the prism of Star Trek sometimes more interesting and provocative than simply doing the whole moralizing pundit thing.

There was an episode of Star Trek Deep Space Nine that aired well before the events of 9-11-2001, and the subsequent Global War on Terror, that I find fascinating. The episode deals with a secretive agency in Starfleet operating in the gray areas between the laws and ideals of the Federation and the threats that the Federation faces. Even when the Federation is a peace, Section 31, as it is called is engaged in activities https://www.youtube.com/watch?v=DhkfuyBLDlYagainst historic or potential enemies. In a way it is somewhat like the NSA or the Defense Intelligence Agency.

At the beginning of the Deep Space Nine Episode Inter Arma Enim Silent Leges the head of Section 31, a man only known as Sloan comes back Doctor Julia Bashir to involve him in an clandestine operation. An operation to on the Romulans who at this point are a Federation ally against the Dominion.

Sloan makes his approach and Bashir, who expresses his reservations:

BASHIR: You want me to spy on an ally.

SLOAN: To evaluate an ally. And a temporary ally at that. I say that because when the war is over, the following will happen in short order. The Dominion will be forced back to the Gamma Quadrant, the Cardassian Empire will be occupied, the Klingon Empire will spend the next ten years recovering from the war and won’t pose a serious threat to anyone. That leaves two powers to vie for control of the quadrant, the Federation and the Romulans.

BASHIR: This war isn’t over and you’re already planning for the next.

SLOAN: Well put. I hope your report is equally succinct.

BASHIR: How many times do I have to tell you, Sloan? I don’t work for you.

SLOAN: You will. It’s in your nature. You are a man who loves secrets. Medical, personal, fictional. I am a man of secrets. You want to know what I know, and the only way to do that is to accept the assignment.

I find the exchange both illuminating and riveting. The fact is that in the situation we face today the arguments of both sides should make us very uncomfortable.

Whether we like it or not or not, the incredibly rapid technical and communication advances of the past couple of decades have primed us for our present conundrum of liberty and privacy or security. That technology, as wonderful as it is  has enabled a generation to grow up in a virtual world in many ways detached from the moral and ethical balances between individual rights and liberties as well responsibility to community.

All the wonderful gadgets that we employ in everyday life, make it easy for enemies and “friends” to do things that were unimaginable to people other than science fiction writers even twenty to thirty years ago. Likewise they were certainly beyond the wildest imaginations of any of the founders who drafted Constitution.

The reality is, the things that make are lives so easy are also the things that have the potential to remove the very liberties that we treasure, either by our enemies using them, or those that defend us.

The truth is, that throughout history, even our own there have been operatives within the government in charge of secrets, as well as spies. In the Inter Arma Enim Silent Leges episode we see an operation that is full of duplicity and moral ambiguity all committed in the name of security. There is an exchange between Dr. Bashir and Admiral Ross of Starfleet command which is very enlightening because it practically mirrors how many on both the civil liberties and the national security side of the current controversy feel about the War on Terror.

BASHIR: You don’t see anything wrong with what happened, do you.

ROSS: I don’t like it. But I’ve spent the last year and a half of my life ordering young men and young women to die. I like that even less.

BASHIR: That’s a glib answer and a cheap way to avoid the fact that you’ve trampled on the very thing that those men and women are out there dying to protect! Does that not mean anything to you?

ROSS: Inter arma enim silent leges.

BASHIR: In time of war, the law falls silent. Cicero. So is that what we have become? A twenty fourth century Rome driven by nothing more than the certainty that Caesar can do no wrong!

ROSS: This conversation never happened.

In light of the controversy of today regarding the NSA, FISA Courts, government secrecy and intelligence gathering information on its own citizens, as well as allies, friends and and enemies we face a growing tide of reporters and others seeking to reveal those secrets. Back in 1989 ethicist Sissela Bok wrote something very important in her book Secrets: Moral Choice in Public and Private Life:

“…as government secrecy expands, more public officials become privy to classified information and are faced with the choice of whether or not to leak … growing secrecy likewise causes reporters to press harder from the outside to uncover what is hidden. And then in a vicious circle, the increased revelations give government leaders further reasons to press for still more secrecy.”

As we wade through the continuing controversy surrounding these issues we will see people do exactly what Bok said. These are the exact arguments are being made by the people and officials directly involved in such activities, as well as former elected and appointed officials, and members of the press.

The interesting thing to me is that very few of the people or agencies, past and present, Republican and Democrat involved have clean hands. It is amazing to see former champions of civil liberties defend the NSA actions and those that empowered the NSA in the Patriot Act now condemn it. I find it both fascinating and frightening.

At the end of the Inter Arma Enim Silent Leges episode the mysterious Sloan pops back in on Doctor Bashir who is in his quarters, asleep and depressed by what he experienced during the operation on Romulus and with Admiral Ross.

Someone has to protect men like you from a universe that doesn’t share your sense of right and wrong.

BASHIR: Should I feel sorry for you? Should I be weeping over the burden you’re forced to carry in order to protect the rest of us?

SLOAN: It is an honor to know you, Doctor. Goodnight.

We live in this kind of world and maybe it is good to sometimes step back and look at issues using a different prism. I really don’t have the answers. I am a civil libertarian who places a high value on the openness of a government to its people. I also know that there are those that have no regard for such openness or, to quote Sloan don’t “share your sense of right and wrong.”

Maybe that is not a good answer. I really don’t know. All I know is that as uncomfortable as this all is that those on both sides of the issue have valid points and concerns. It is a debate that needs to happen if we are able to balance that a society needs to balance individual rights and responsibility to the community; openness and secrecy; civil liberties and national security.

But that being said. it is a debate that needs to happen, even if it makes us uncomfortable. I for one think that it is better that we be uncomfortable when looking at such an important debate than to be prisoners of our certitude.

Who but Tyrants? The Danger of State Religion

James Madison wrote something about certain Christians of his day that could have been written today. The topic, one of Madison’s favorite topics actually, was the subject of the relationship between church and state. Madison wrote:

“[T]here remains [in some parts of the country] a strong bias towards the old error, that without some sort of alliance or coalition between Govt. & Religion neither can be duly supported. Such indeed is the tendency to such a coalition, and such its corrupting influence on both parties, that the danger cannot be too carefully guarded against.”

I have lost count of the number of preachers, pundits, and politicians, who have been making public statements and doing their best to pass legislation to make Christianity the official state religion of the United States. To a person all represent the politically militant wing of the conservative, or maybe better named Right Wing Christianity. I wrote about this some yesterday and have written numerous pieces on the subject so I am not going to say much more here; except to say that the historical ignorance of those that want to impose Christianity as the law of the land is mind-numbing in large part because of how fiercely the concept was resisted by those who founded the United States.

The great Virginia Baptist leader John Leland, a friend of both Jefferson and Madison was scathing in his condemnation of those who wanted to impose a Christian state religion and place it in the Constitution:

“How undeniable the fact, that civil government is not founded on Christianity …. How improper, how unjust, how anti-Christian it must be, for one man or one party of men to get that kind of religion interwoven into the civil constitution, which they believe is best, under the pretence that their consciences are wounded if others do not believe like themselves. The plea of conscience, in such cases, is the art of ill design, or the effect of imposition, which none but tyrants or bigoted enthusiasts will make …. Government is the formation of an association of individuals, by mutual agreement, for mutual defence and advantage; to be governed by specific rules. And, when rightly formed, it embraces Pagans, Jews, Mahometans and Christians, within its fostering arms–prescribes no creed of faith for either of them–proscribes none of them for being heretics, promotes the man of talents and integrity, without inquiring after his religion–impartially protects all of them–punishes the man who works ill to his neighbor, let his faith and motives be what they may. Who, but tyrants, knaves and devils, can object to such government …. It is the glory of the United States, that, after Christian tyranny had raged with savage fury for fifteen hundred years, its progress should be arrested in this land of liberty.”

The fact is, in every place and clime where a religion, be it a Christian Church, or any non-Christian religion holds the franchise of power with the state that no person is safe. Robert Ingersoll stated it very well, “The liberty of man is not safe in the hands of any church. Wherever the Bible and sword are in partnership, man is a slave. All laws for the purpose of making man worship God, are born of the same spirit that kindled the fires of the auto da fe, and lovingly built the dungeons of the Inquisition….”

Today, a very vocal minority that has seized control of a major political party wish to reverse the very liberty promoted by our founders and men like Leland who fought for it by legislating at every turn laws which give special privilege to Christians, often under the name “Religious Freedom Restoration Acts,” which exempt people from obeying laws applicable to all citizens, merely based on their “sincere religious beliefs.” Some of these laws even permit discrimination against others based on an individual’s sincere religious beliefs. One of that party’s leading candidates for the Presidential nomination, Ben Carson, said that a Moslem should not be able to be President, defying the Constitution itself. I do not have to wonder what Jefferson, Madison, Leland or so many other pioneers of real religious liberty would say to Mr. Carson or others like him. Their replies to the people of their day more than suffice to reply to such ignorant buffoons.

Leland was right. This country was miraculous because to again quote Leland; It is the glory of the United States, that, after Christian tyranny had raged with savage fury for fifteen hundred years, its progress should be arrested in this land of liberty.” And as he so succinctly put it, who but tyrants, knaves, and devils, could resist a government which “embraces Pagans, Jews, Mahometans and Christians, within its fostering arms–prescribes no creed of faith for either of them–proscribes none of them for being heretics, promotes the man of talents and integrity, without inquiring after his religion–impartially protects all of them–punishes the man who works ill to his neighbor, let his faith and motives be what they may.”

For me it gets old to continue to have to write about this, but then someone has to, otherwise the truth about religious freedom will be trampled under the jack-boots of Christian tyrants who have the fact is we deceived sincere Christians into following a creed that will enslave them. History matters, and have not advanced so far that we cannot return to the barbarism of our ancestors. If the political manifestation of the Christian Right was ever to establish themselves and their Dominionist theology as the law of the land, we would all be in trouble.

Religion & State: The Less Mixed the Better

Robert Heinlein wrote that, “Almost any sect, cult, or religion will legislate its creed into law if it acquires the political power to do so.” His words are quite relevant and in a way consistent with the desires of the founders of the United States.

Since I am still getting readjusted to life back in the states after my very nice trip in Germany where I was mostly off the grid I will just share a few thoughts. They are not really original to me, but they are born of reflection on the palpable political anger of the politicians, pundits and preachers of the political-religious movement that I refer to as the “Christian Right.”

In order to be clearly understood it is important for my readers to understand that I am not lumping all “conservative Christians” into the political Christian right. In fact some conservative Christian traditions and their followers are diametrically opposed to the political theology of the Christian Right, which has as its heart the theology of Christian Dominionism, something I have written about many times. This is a modernized understanding of political Calvinism, which has sometimes known as “Seven-Mountain” theology, as such I make a profound distinction between such groups and the political movement which calls itself the Christian Right and assumes that as such it speaks for all conservative Christians.

Gary North, a prominent ideologue of the movement who has advised many of the current Christian Right leaders of the Republican Party, and whose ideas are widely promulgated by the politicians, pundits and preachers of the Christian Right was quite clear in what this movement desires. “The long-term goal of Christians in politics should be to gain exclusive control over the franchise. Those who refuse to submit publicly to the eternal sanctions of God by submitting to His Church’s public marks of the covenant–baptism and holy communion–must be denied citizenship, just as they were in ancient Israel.” Thus, every time you hear the words “religious freedom” or “religious liberty” being uttered by them, please understand that they are talking about their religious liberty only, and that that liberty has at its heart the desire to establish their political-religious dogma as law of the land. Thomas Paine, the author of the amazing little book “Common Sense” which was so much a part of the thought of our founders noted, “Persecution is not an original feature in any religion; but it is always the strongly marked feature of all religions established by law.”

Robert Ingersoll, one of this first prominent skeptics in this country and acknowledged atheists wrote something quite profound in understanding the nature of what our founders intended and why there were protections both for and from religion in the Constitution:

“They knew that to put God in the constitution was to put man out. They knew that the recognition of a Deity would be seized upon by fanatics and zealots as a pretext for destroying the liberty of thought. They knew the terrible history of the church too well to place in her keeping or in the keeping of her God the sacred rights of man. They intended that all should have the right to worship or not to worship that our laws should make no distinction on account of creed. They intended to found and frame a government for man and for man alone. They wished to preserve the individuality of all to prevent the few from governing the many and the many from persecuting and destroying the few.”

Ingersoll correctly reflected the thoughts of Jefferson, Madison, Adams and even George Washington as well as early Virginia Baptist John Leland, and other pioneers of religious liberty like Roger Williams, the founder of the colony of Rhode Island.

According to every scientifically based survey of Christians and non-Christian attitudes toward the church and its religious involvement show that ever-increasing numbers of Christians are fleeing the church. Likewise, increasing numbers of non-Christians want nothing to do with it, even if they are favorably disposed to Jesus and his teachings.

In light of this fact, maybe it is time for Christians to get off their high-horse expecting that they should hold the rights to the political franchise and remember the words of James Madison who said, “Every new & successful example therefore of a perfect separation between ecclesiastical and civil matters, is of importance. And I have no doubt that every new example, will succeed, as every past one has done, in shewing that religion & Govt. will both exist in greater purity, the less they are mixed together.”

Exploding the Myth of Christian America

The whole issue of religious liberty and the right to free expression has once again come to the fore in the wake of the Obergfell v. Hodges ruling and the fairly pathetic attempt of Kim Davis and her lawyers to stop gay marriage in Rowan County Kentucky. I call the attempt pathetic because it flies in the face of the real champions of religious liberty in the United States. One of these early proponents of religious liberty and freedom in the United States was the Virginia Baptist pastor, John Leland.

Sadly, many American Christians either have never heard of him. Likewise, if they have heard of him, as the great pontificator, Mike Huckabee should have in his brief tenure as a student at Southwestern Baptist Theological Seminary; they seem to have ignored his warnings about state religion. I guess that problems in his church history and Baptist history classes were a big reason that he left seminary. Ideologues like the Huckster didn’t last at Southwestern, at least until the fundamentalist takeover in 1994 that helped destroy the academic and scholarly reputation of that once fine school, but I digress….

Leland was a friend of Thomas Jefferson and James Madison and without him it is unlikely that the First Amendment of the Constitution would have mentioned religious faith. Leland had a very personal interest in this as during the 1780s the Anglican Church in Virginia was attempting to again become the official state religion. Anglicans, with the help of local authorities were attacking Baptist congregations and even resorting to physical violence. In defiance of the Anglicans, Leland wrote:

“The notion of a Christian commonwealth should be exploded forever. … Government should protect every man in thinking and speaking freely, and see that one does not abuse another. The liberty I contend for is more than toleration. The very idea of toleration is despicable; it supposes that some have a pre-eminence above the rest to grant indulgence, whereas all should be equally free, Jews, Turks, Pagans and Christians.”

There is a form of religion and indeed the “Christian” faith that is toxic and if not treated leads to the spiritual and sometimes the physical and emotional death of the infected person.

There is a nationalized version of this supposedly Christian faith in the Untied Stats today. It is a bastardized version of the Christian faith overlaid with the thin veneer of an equally bastardized version of American history. Its purveyors are quite popular in the world of “conservative” American Evangelicalism and Catholicism.

Supreme Court Justice Robert Jackson and chief Nuremberg war crimes trials prosecutor warned us about people like them over a half-century ago. Jackson wrote, “[I]n our country are evangelists and zealots of many different political, economic and religious persuasions whose fanatical conviction is that all thought is divinely classified into two kinds — that which is their own and that which is false and dangerous.”

Pat Robertson, evangelist and founder of the Christian Broadcasting Network is an example of what Leland and Jackson warned us about. Robertson said on his program that “You say you’re supposed to be nice to the Episcopalians and the Presbyterians and the Methodists and this, that, and the other thing. Nonsense, I don’t have to be nice to the spirit of the Antichrist.” — Pat Robertson, The 700 Club, January 14, 1991. The late David Chilton was another. He wrote: “We believe that institutionally Christianity should be the official religion of the country, that its laws should be specifically Christian”

It is quite fascinating when you look at it. This faith is a combination of a selective reading of American history, Christian teaching and Biblical interpretation that mixes and matches a wide variety of mutually conflicting and contradictory traditions. This Toxic “faith” if you can call it that; is based on a reading of American and Western History, which negates, marginalizes or willingly distorts the views or contributions of those who they disagree. It does not matter of their opponents are not Christians, or were Christians, including Baptists like John Leland and Roger Williams. Due to their experiences of religious persecution, Williams and Leland refused to buy into any form of state sanctioned religion.

I find it interesting that Conservative Icon and champion of limited government Barry Goldwater had great reservations about those that sought to establish the superiority of any religion. Goldwater said on the Senate floor: “The religious factions that are growing throughout our land are not using their religious clout with wisdom. They are trying to force government leaders into following their position 100 percent.”

The leaders of this new and quasi “Christian faith” are many and include some of the most popular religious leaders in the United States such as Pat Robertson, the pseudo-historian David Barton, James Robison, Gary North, Bryan Fischer, James Dobson, Gary Bauer Phyllis Schafley and a host of others. For them the Gospel has been equated with government legislation of supposedly “Christian” values; which conveniently are defined by their political agenda, often in complete contradiction to the Gospel and to nearly 2000 years of Christian experience. North, one of the most eloquent expositors of the Dominionist movement wrote:

“The long-term goal of Christians in politics should be to gain exclusive control over the franchise. Those who refuse to submit publicly to the eternal sanctions of God by submitting to His Church’s public marks of the covenant–baptism and holy communion–must be denied citizenship, just as they were in ancient Israel.”

That is quite a statement and those who think that they can co-opt people like North, Robertson or others are quite mistaken. Goldwater realized this. What is fascinating to me is to watch these men and women advocate religious and political positions in regard to Church-State relations that completely opposite of what early American Christian and non-Christian civil libertarians imagined when our country was founded. Positions that quite often are at odds with even the historical tenants of their own faith. Their only claim to innocence can be because not a one of them have any training in history and often are even worse when it comes to their understanding of the Christian tradition, which did not begin in and will not end in the United States.

In this confused and often hateful “faith” we see men and women who hate centralized government but extol a centralized religion. I was talking with a friend who is adamantly opposed to a powerful Federal Government but extols the perfection of the centralized bureaucracy of his Roman Catholic Faith. He could not see the contradiction. I watch others who extol an almost Libertarian understanding of the government and the Constitution who supposedly in their religious tradition are from the “Free Church” who now advocate the supremacy of the Church over the State and in doing so their particular and limited understanding of Church over that of the Church Universal.

In this confused and contradictory setting there are Catholics espousing political views that are in direct opposition to the understanding of government supported by the Magisterium of the Church. There are Evangelical and Charismatic Protestants that mix and match the untenable and contradictory beliefs of Dominionism and Millennialism which involve on one hand the takeover of earthly power by the Church and the ushering in of the Kingdom of God and the understanding that earthly power is ultimately under the dominion of Satan and must be overcome by the Second Coming of Christ.

Leland wrote:

“These establishments metamorphose the church into a creature, and religion into a principle of state, which has a natural tendency to make men conclude that Bible religion is nothing but a trick of state.”

Leland was one of the most important persons in regards to the relationship of the Christian Churches to the American Government. He was a champion of the religious liberty enshrined in the Bill of Rights and helped influence both James Madison and Thomas Jefferson. He noted in 1791:

“Is conformity of sentiments in matters of religion essential to the happiness of civil government? Not at all. Government has no more to do with the religious opinions of men than it has with the principles of mathematics. Let every man speak freely without fear–maintain the principles that he believes–worship according to his own faith, either one God, three Gods, no God, or twenty Gods; and let government protect him in so doing, i.e., see that he meets with no personal abuse or loss of property for his religious opinions. Instead of discouraging him with proscriptions, fines, confiscation or death, let him be encouraged, as a free man, to bring forth his arguments and maintain his points with all boldness; then if his doctrine is false it will be confuted, and if it is true (though ever so novel) let others credit it. When every man has this liberty what can he wish for more? A liberal man asks for nothing more of government.” John Leland, “Right of Conscience Inalienable, and Therefore, Religious Opinions Not Cognizable By The Law”

When the adherents of a faith, any faith, but especially the Christian faith enlist the government to enforce their understanding of faith they introduce a toxicity that is eventually fatal when consumed and acted on.

I think that much of what we are witnessing today is much more the product of fear mongering preachers that see opportunity in their political alliances and that are willing to reduce the Gospel to a number of “Christian values” in order to achieve a political end; even if that end is ultimately destructive to the Church and to the Gospel.

The message of the Apostle Paul to the Church in Corinth was this: “All this is from God, who reconciled us to himself through Christ, and has given us the ministry of reconciliation; that is, in Christ God was reconciling the world to himself, not counting their trespasses against them, and entrusting the message of reconciliation to us.” (2 Cor 5:18-19 NRSV) 

The early church thrived when it had no early power. It thrived when it was persecuted and when the Roman government openly supported almost every religion but it. However, once it became powerful and worldly it became ensnared in affairs far from that simple message of reconciliation.

It was in this country that the various sects of the Christian faith had the opportunity to make a new start, unencumbered by the trappings of power. But instead, like those that came before us, the toxin of power has all too often seduced us. John Leland understood this and fought to ensure that all people of faith were free and unencumbered by state supported religion. He wrote:

“The liberty I contend for is more than toleration. The very idea of toleration is despicable; it supposes that some have a pre-eminence above the rest to grant indulgence; whereas all should be equally free, Jews, Turks [Muslims], Pagans and Christians. Test oaths and established creeds should be avoided as the worst of evils.”

Leland’s friend James Madison wrote to Edward Everett toward the end of his life:

“The settled opinion here is, that religion is essentially distinct from civil Government, and exempt from its cognizance; that a connection between them is injurious to both; that there are causes in the human breast which ensure the perpetuity of religion without the aid of the law; that rival sects, with equal rights, exercise mutual censorships in favor of good morals; that if new sects arise with absurd opinions or over-heated imaginations, the proper remedies lie in time, forbearance, and example; that a legal establishment of religion without a toleration could not be thought of, and with a toleration, is no security for and animosity; and, finally, that these opinions are supported by experience, which has shewn that every relaxation of the alliance between law and religion, from the partial example of Holland to the consummation in Pennsylvania, Delaware, New Jersey, &c., has been found as safe in practice as it is sound in theory. Prior to the Revolution, the Episcopal Church was established by law in this State. On the Declaration of Independence it was left, with all other sects, to a self-support. And no doubt exists that there is much more of religion among us now than there ever was before the change, and particularly in the sect which enjoyed the legal patronage. This proves rather more than that the law is not necessary to the support of religion” (Letter to Edward Everett, Montpellier, March 18, 1823).

That is the antidote to the toxic faith embodied in the politically motivated Christian Right. It stands against any idea of a state sanction or religion or a religion that like in Saudi Arabia or Iran controls the state. It stands in opposition to the beliefs of so many “Christian” religious leaders work to ensure that they control the powers of government. Attempts that try to proclaim their superiority above even the ultimate message of the Gospel that proclaims, “for God so loved the world….” 

By the way there are always results. The Puritans who many extoll were some of the most intolerant of dissenters of any group that has every held the reigns of power over the state and religion ever known in this country. Their victims included Quakers as well as American Indian converts to Christianity. The picture below of the Puritans hanging Quakers in the Massachusetts Bay Colony should give pause to anyone who thinks that such actions are not possible today should any religion gain control of political power.

Kim Davis, the recalcitrant County Clerk of Rowan County, Kentucky has now decided that the reason that she cannot issue marriage licenses to Gays is that it is a heaven or hell decision, in other words, if she complies with the court order she will quite possibly go to hell. Actually as a theologian and historian I find this fascinating, and regardless of what happens next in this sorry saga, we must remember the words of Captain Jean Luc Picard “But she, or someone like her, will always be with us. Waiting for the right climate in which to flourish, spreading fear in the name of righteousness….”

Davis, who was elected to the office last November, following her mother who held the office for the 37 years prior, makes $80,000 a year to serve as the Country Clerk and one of her big duties is issuing marriage licenses to citizens of the county. The only problem is that Marriage Equality is the law and gays are entitled to the full rights of all citizens based on a Supreme Court ruling which said that based on the 14th Amendment that Gays, like all other American Citizens were legally entitled to the same rights as all other citizens. Likewise it appealed to the Civil Rights Act of 1965. By refusing the recalcitrant County Clerk of Rowan County Kentucky is in violation of the law. However, because she is an elected official she cannot be fired. She can only be impeached by a state legislature whose members need the votes of her supporters in the state. 

Mrs. Davis is an Apostolic Pentecostal Christian. Her Church, Morehead First Apostolic Church belongs to the United Pentecostal Church International. This denomination is one of the early Pentecostal denominations in the United States, founded in 1905 during the Pentecostal Awakening. It split from another Pentecostal denomination, the Assemblies of God over the issue of the Godhead. The United Pentecostals reject the traditional understanding of Trinitarian Christianity. Their theology is Monotheistic and they interpret the references to Father, Son and Holy as modes in which God reveals himself. In other words, God was the Father, and then the Son, and then the Holy Spirit.

According to mainstream Christianity since the Council of Nicaea in 325 A.D. the theology of the United Pentecostals was considered heretical, by all Eastern and Western branches of Christianity. This means, and I hate to be a theological hard ass here, but technically, they are not Christian, because they worship a different God. Now personally, I am not such a hard ass and believe that God forgives a lot of bad theology, even my own; but the United Pentecostals don’t, and here is where it gets really interesting.

The United Pentecostal Church believes that in order for a person to be “saved” that they must first repent of their sins. No problem there, I think repentance is a good thing. Next one must be baptized, and here is where it gets tricky. If you are not baptized “In Jesus’ Name” your baptism doesn’t count. Sorry all you folks that were baptized “in the Name of the Father, Son and Holy Spirit” you may have repented but you are not saved and yes you are heading for that eternal vacation on the Lake of Fire, so don’t forget your asbestos water skis.

But that’s not all my friends; to Kim Davis and the United Pentecostals you must also be baptized in the Holy Spirit with the evidence of Speaking in Tongues. If not, by their doctrine you are going to hell, and don’t forget to go to bathroom first because it is “damnation without relief” and if you do not go it will be a very uncomfortable eternity. But wait there’s still more…. Even if you a member of these churches, like Kim Davis is and you make it through those first three gates, you can still go to hell; you have to Persevere to the End, that means that she must wear those frumpy clothes, no makeup or jewelry, and avoid doing sinful things and that is kind of tricky because there are so many ways to screw up. No wonder she is afraid of going to hell for doing the duties required by the law.

I find it fascinating that Mrs. Davis and her supporters are so hell bent on making sure that homosexuals cannot get married, or enjoy the same rights as other citizens and condemn homosexuals all to hell based on their interpretation of the Bible. Interestingly enough many of her big supporters are Trinitarian Evangelicals and other Conservative Christians, who by doctrine Kim Davis and the United Pentecostal Church does not consider Christians.

This is the fascinating part. Her biggest defenders and her lawyers are all Trinitarian Christians who Kim Davis and her church believe are going to hell, at least which is what their doctrine says, and these wonderful Trinitarian Christians are so full of animosity to homosexuals that they will defend a person who believes that they too are going to hell with those horrible homosexuals. Imagine, if Kim Davis and her church are right, Mat Staver, lawyer from Liberty Counsel will be sunning himself on the banks of the Lake of Fire with the homosexual that he so loathes, and I hope he takes some tanning oil. The irony is rich, but I digress….

You see this is the problem when you decide to let theologically and historically ignorant religious fanatics run government. But that is the morass that conservative Christians in the United States have created for themselves. Ever since the 1970s when Jerry Falwell began the charge the situation has got increasingly stickier with every passing year. Odd alliances are made by groups who all believe that they have to only way to salvation and that all others are going to hell. The problem is that this alliance cannot hold. Should the Religious Right ever get control they will start persecuting each other in the areas that they are strongest, because it is an alliance of convenience and in their hearts they despise each other almost as much as they do the gays. It will Balkanize and fracture our society beyond belief; but then who cares so long as our religion wins.

Robert Heinlien observed, “Almost any sect, cult, or religion will legislate its creed into law if it acquires the political power to do so.” That is what Davis and her backers want, if they cannot stop the law they want legal authority to disobey it while getting paid to administer it as government officials.

Is it no wonder that James Madison, Thomas Jefferson and others of our founding fathers were so adamant about separating church and state? Madison said why this is so necessary, “The purpose of separation of church and state is to keep forever from these shores the ceaseless strife that has soaked the soil of Europe in blood for centuries.” And why Conservative Atheist Christopher Hitchens remarked “How dismal it is to see present day Americans yearning for the very orthodoxy that their country was founded to escape.”

Mrs. Davis can hold whatever religious views that she desires, and she can chose to worship the God of her choice and take her chances on landing in hell or heaven. However, her duties as an officer of the government require her to carry out the law. If she cannot carry out the law her choice is to resign. She has no right to be paid by the government and then substitute her religious beliefs for law she is to carry out, and thereby sabotage the law, which is meant for all citizens. Since she is unlikely to resign, cannot be fired, and most likely will not be impeached, there is no remedy for the citizens of Rowan County, none of who are able to get a marriage license. It reminds me of the days when White officials in the South defied Congress and the Courts to defend Jim Crow Laws in the 1959s and 1960s. 

Let’s turn this around for a second and put Mrs. Davis standing at the counter trying to get a marriage license following one of her three divorces. Imagine how Mrs. Davis would have felt if some hard-assed Trinitarian Catholic Christian denied her application for a marriage license due to her three divorces, and his belief that divorce was a mortal sin and that to issue a marriage license violated his religious beliefs.

That my friends is the path that Mrs. Davis and her supporters are taking us down. It is the path where a personal belief trumps the law, and one’s duty as an officer of the government to carry out that law.

Mrs. Davis needs to resign, or face the consequences. She will be considered a martyr for a cause by people who she, if she actually believes the teachings of her church, are going to go to hell alongside of the homosexuals that they are defending her from. I love that irony, and since Davis and many of her supporters would probably beleive that I am going to be damned for my support of the civil rights of Gays then I will have to agree with Captain Jean Luc Picard who once said “If we’re going to be damned, let’s be damned for what we really are.”

In Exclusion of All Others: Kim Davis & God’s Authority

Thomas Jefferson so eloquently and correctly observed, “History, I believe, furnishes no example of a priest-ridden people maintaining a free civil government. This marks the lowest grade of ignorance, of which their civil as well as religious leaders will always avail themselves for their own purposes.” It appears that we have some Christians stooping to that “lowest grade of ignorance” which Jefferson noted.

I have been holding back on the case of Kim Davis, the Clerk of Rowan County Kentucky who has strenuously refused to issue marriage licenses of Gay couples based on her “strongly held” or “sincere” religious beliefs. After the rule went into effect she has refused to issue marriage licenses to anyone in her county, citing fairness. Personally when this started I thought this was a publicity stunt by the Christian Right, and especially her lawyer, Mat Staver of Liberty Counsel, the legal activist wing of Liberty University and that it would blow over in a few days.

But then forgot just what a self-righteous bigot and extremist that Staver is when it comes to this issue. He has made a fortune demonizing gays over the years and his words are always extreme, polarizing, and play to the basest prejudices of his audience; angry, politically charged conservative Christians. Yes, in some ways this is still a publicity stunt, because Staver and others like him are using Davis, a woman who according to what Jesus said is an adulteress, having been married four times and divorced three, to make a profit and her a martyr for their cause.

So I was wrong and the circus continues. Davis disobeyed orders from the Governor and Attorney General of Kentucky to comply with the law; she has lost in every court including the entire U.S. Supreme Court. Interestingly enough the conservative Supreme Court Justices who were in the minority in the Obergfell v. Hodges case which legalized Marriage Equality; Scalia, Roberts, Alito and Thomas, refused to hear her case and summarily dismissed her appeal. But she still continues.

Today, after the Supreme Court ruling Davis still refuses to obey the law and do the job that by law, and the dictates and responsibilities of the government office she occupies that she is supposed to do. Citing “God’s authority” for her refusal, Davis has again refused to issue marriage licenses. The fact is that she is denying the rights of every couple in Rowan County to a marriage license is of no concern. The fact that if you swear an oath as a public official to uphold the law, likewise, is of no concern to her. All that matters are her rights, not the people she swore an oath to serve, not the law.

It is being framed by Davis, Staver and their allies as s test of religious liberty, in that Mrs. Davis cannot in good conscience issue a marriage license to a Gay couple because it violates her religious beliefs. I do not disregard those beliefs, I defend the beliefs of people like Mrs. Davis on a daily basis. I do not agree with her but I agree that she can believe whatever she wants. But there is an important caviot to this, Mrs. Davis is not a private citizen. She is an officer of the government who has certain legal responsibilities, among them issuing marriage licenses to eligible people in Rowan County, Kentucky. She took an oath to carry out the laws of the State of Kentucky, and she is not doing that. If she does not to comply she needs to resign or face the legal consequences of her actions.  No officer of the government at any level gets to chose what laws they will obey and which they will not. Her actions violate the 14th Amendment rights of all her citizens, as such they are unconstitutional. This is not like abortion where many medical professionals can opt out of based on a conscience clause. In those cases those physicians refer to others. In this case, which is qualitatively different that abortion, in that it does not involve life or potential life, Mrs. Davis gives the people of her county no option. She is the only one who can issue these licenses and she refuses to do so.

The reality is that no one is forcing Mrs. Davis to change her opinion on Gay marriage. She can do that as a private citizen and in her church, but she cannot use her beliefs to deny the legal rights of others. To allow her to do so would set a dangerous precedent, but it seems neither Davis, her lawyers, or many conservative Christian state and local politicians and activists understand this. Once you set the precedent that a public official can use their religious rights to deny the rights of others you open Pandora’s Box. Our founders understood, that, James Madison correctly observed, “Who does not see that the same authority which can establish Christianity, in exclusion of all other religions, may establish with the same ease any particular sect of Christians, in exclusion of all other sects?”

Can you imagine what Staver’s reaction if a fundamentalist Moslem County clerk decided to not issue a marriage license to a Christian, Jew, Hindu, Buddhist or an unbeliever of any kind? You can bet that he would not be defending that Moslem’s right to disobey the law. Instead, he would be apoplectic and claiming that the Moslems were attempting to impose Sharia on non-Moslems would be demanding that the official comply with the law or go to jail.

What if an Orthodox Jewish elected official refused to work alongside or in the same office as a Christian woman? Would Staver defend him? I think not.

But that is the problem here. Davis and so many others like her believe that their sincerely held beliefs trump the law, and their sworn duty as public officials. My friends, to allow that is to open the way for a theocracy, where in the name of God and the church, the rights of non-believers are disregarded. Sadly, it goes beyond simply refusing rights, but it ends up in religious tyranny and persecution; “witch trials,” the killing of “heretics and unbelievers.” In fact as far as Gays are concerned, there are militant Christian proponents of theocracy in this country who openly state that Gays should be killed, and they are not limited to the fringe of the late Fred Phelps and his Westboro Baptist Church. Some of them are frequent speakers at Republican campaign rallies, Tea Party events and court major conservative political leaders and candidates for office.

Barry Goldwater of all people warned us about them as early as 1981, “Mark my word, if and when these preachers get control of the [Republican] party, and they’re sure trying to do so, it’s going to be a terrible damn problem. Frankly, these people frighten me. Politics and governing demand compromise. But these Christians believe they are acting in the name of God, so they can’t and won’t compromise. I know, I’ve tried to deal with them.”

As much as we want to believe differently, we are not nearly as civilized or tolerant as we claim to be; and the words in the Declaration of Independence that “all men are created equal” only apply to a certain in group; in Davis’ and Staver’s case, Christians. All others, especially Gays, need not apply. Believe me, while people like Davis and Staver are a minority they are benign. Their words and their actions demonstrate that. Like the Nazis of the 1920s they claim to be the victims and decry laws that do not allow them to discriminate. Should they ever gain the reins of power, or more likely, succeed in carving out exemptions in the law that allow them to discriminate against others based on their personal, strongly held religious beliefs; they will become tyrannical, and Davis, even without a shred of law to back her up is behaving as a tyrant, and being applauded by many so-called Christians.

That is something to ponder.
