Liberty & Those who Oppose It: the Aftermath of Obergfell v. Hodges

I rejoiced yesterday when majority of the Supreme Court ruled in favor of marriage equality throughout the country. I believe that this was an important continuation in or understanding of ever expanding liberty found in the Declaration of Independence that Abraham Lincoln said in 1854 was the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.” 

Thomas Jefferson wrote a letter to Samuel Kercheval in 1816 that we should take to heart when we look at changes in laws that religious traditionalists oppose so vehemently:

“I know also, that laws and institutions must go hand in hand with the progress of the human mind. As that becomes more developed, more enlightened, as new discoveries are made, new truths disclosed, and manners and opinions change with the change of circumstances, institutions must advance also, and keep pace with the times. We might as well require a man to wear still the coat which fitted him when a boy, as civilized society to remain ever under the regimen of their barbarous ancestors.” 

When Justice Anthony Kennedy wrote the majority opinion in the case of Obergfell v. Hodges he made a comment that echoed the words of Thomas Jefferson when he wrote:

Changes, such as the decline of arranged marriages and the abandonment of the law of coverture, have worked deep transformations in the structure of marriage, affecting aspects of marriage once viewed as essential. These new insights have strengthened, not weakened, the institution. Changed understandings of marriage are characteristic of a Nation where new dimensions of freedom become apparent to new generations.

In the aftermath of Obergfell v. Hodges these people are scrambling to carve out exemptions to the law in order to ensure that the prejudices ingrained in their “sincerely held religious belief” can remain. Of course for churches that is not an issue, churches can grant or deny the sacraments or ordinances of their faith to anyone they chose to and this they routinely do. If you desire to get married in a church you must follow the rules for that church, and the clergy of that church are free to deny sacraments, including marriage to anyone. If you are not a Roman Catholic in good standing you are not permitted to receive the Eucharist, you may not be married in the church, and other churches including many Baptists and other “free” churches have similar prohibitions that no court has dared to overturn. This even includes rules that discriminate against women who cannot be ordained clergy. So when I hear pastors screaming that somehow they will be prosecuted or jailed for refusing to marry gays I have to throw the bullshit flag.

Now this may not apply to the “ministers” who set up their own so called marriage chapels where unconnected to any church they operate as for profit businesses. Sometimes courts do find in favor of litigants in civil proceedings when such businesses use their prejudice to deny services to people, especially gays.

While I am a historian and should know better, I am amazed to see many American Christians doing all they can in the name of protecting their Religious Liberty to deny rights to those that they disapprove. I shouldn’t be surprised, Thomas Jefferson wrote of what happens when preachers and priests lead political movements. Jefferson so rightly noted:

“History, I believe, furnishes no example of a priest-ridden people maintaining a free civil government. This marks the lowest grade of ignorance, of which their civil as well as religious leaders will always avail themselves for their own purposes.”

James Madison, who crafted the Bill of Rights, including the First Amendment wrote:

“Who does not see that the same authority which can establish Christianity, in exclusion of all other religions, may establish with the same ease any particular sect of Christians, in exclusion of all other sects?”

Currently this is the case with the Republican Party, a party that I remind you that I belonged for over three decades, beginning with my work for the Ford campaign as a high school student. I left the GOP in 2008 after years of disillusionment, and lies when I returned from Iraq.

Barry Goldwater, a conservative if there ever was one, a man that would be driven out of today’s GOP spoke on the Senate floor in the early 1980s at the beginning of the Reagan Revolution and the commandeering of the party by politically minded preachers like Jerry Falwell, James Robertson, Dr. D. James Kennedy, James Dobson and of course our local Tidewater Taliban Mullah, Pat Robertson. Goldwater so wisely noted:

“Mark my word, if and when these preachers get control of the [Republican] party, and they’re sure trying to do so, it’s going to be a terrible damn problem. Frankly, these people frighten me. Politics and governing demand compromise. But these Christians believe they are acting in the name of God, so they can’t and won’t compromise. I know, I’ve tried to deal with them.”

Well, now the preachers have control of that party. Every declared candidate for the GOP presidential nomination kowtows to these religious leaders and nearly every one of them has come out to announce their opposition to the Supreme Court ruling.

Some are suggesting that thousands of preachers run for office in the GOP in order to foist their agenda on the rest of the population. Right now Conservative Christians for all intents and purposes run many state legislatures. In the ones that they have controlled for the past number of years they have been enacting all sorts of discriminatory laws against those they find offensive, and have attempted to shackle the study of science, history, and roll back voting rights for minorities.

This is particularly true of the conservative Christian, antipathy towards Gays, Lesbians and others in the LGBT community. In the past number of weeks I have seen proposed legislation in several states that would allow people to discriminate against anyone simply based on a sincerely held religious belief.

Other laws passed within the six moths at the state level in Arkansas and West Virginia to nullify any city or county ordinances banning discrimination against gays. In other words, religious zealots in control of state houses are imposing heir beliefs on cities, towns and counties that are more progressive in regard to the treatment of gays.

The irony is that the people who complain about Federal laws which trump state law are doing the same thing that they object to in order to ensure that citizens of their states are treated less than equal.

The target of these laws are gays and the LGBT community, but anyone with half a brain knows that once they are on the books they provide ample room for religious zealots of any kind to discriminate and even persecute those that they despise.

They may start with the gays, but be assured, those who pass these laws will extend them to apply to anyone to whom they believe harms or interferes with their sincerely held religious beliefs. Jefferson also noted “In every country and in every age, the priest has been hostile to liberty. He is always in alliance with the despot, abetting his abuses in return for protection to his own.”

It is something that our founders wisely chose to avoid, not wanting this nation to become like the European nations whose state churches had denied rights, persecuted and killed those that they deemed heretical. While the proponents of these new laws to “protect” religious liberty claim that they are done with no intent to discriminate, there is only one reason to enact them, that to give legal protection to people who want to discriminate. Is this not what is happening throughout the Middle East as Islamic fundamentalists of various sects impose similar laws on Christians as well as others including Moslems of rival sects?

Now just imagine for one moment living in such a society, a society where someone who was not of the right race, or belief did not enjoy the same freedoms of other citizens. Imagine a society where those that started with laws to supposedly defend their religious liberty, or rights then supported other more far reaching laws, laws which deprived those that they demonized and refused to serve of citizenship, freedom of association, freedom of movement, and robbed them of their homes and businesses, banished them to ghettos and eventually exterminated them. While the Nazis primarily went after the Jews, they also went after the gays.

Of course the Nazis did this in the years leading up to World War Two in their actions against loyal German Jews who simply wanted to fit in, and well we Americans, let’s not even go there… but the let’s go there. We have the extermination and the ghettoization of our Native American population, we have the African slave trade and the institution of slavery, we have the human trafficking and exploitation of Chinese workers in the 1800s, the Jim Crow Laws, and yes the incarceration of Japanese Americans in what we called “internment camps” in World War Two.

Now for one minute tell me that those that propose such barbarous laws now to be used against the gays, simply because Christians want to have a law that allows them to discriminate against those they hate and condemn to hell are that much different than those Christians, be they American or German who justified their actions with law based on their deeply and sincerely held religious beliefs? I think not. In fact the whole proposition that we enact such laws flies in the face of the wars that these same people want to send in the ground troops to fight Islamic State over. Heck, the Islamic State is actually acting out the fantasies of the most extreme American Christian anti-gay preachers. They are killing gays, throwing them off the roofs of tall buildings. Sadly, many American Christians so consumed by the hate and paranoia being preached in their churches and by right-wing political groups which pose, as Christian ministries don’t see that their actions are simply a different breed of the same animal. Right now, the difference is just a matter of degree.

I think that is why Thomas Jefferson wrote this very pertinent warning to us who might want to return to the barbarous ways of our ancestors:

“I know also, that laws and institutions must go hand in hand with the progress of the human mind. As that becomes more developed, more enlightened, as new discoveries are made, new truths disclosed, and manners and opinions change with the change of circumstances, institutions must advance also, and keep pace with the times. We might as well require a man to wear still the coat which fitted him when a boy, as civilized society to remain ever under the regimen of their barbarous ancestors.” 

I personally do not want to live under the laws of our barbarous ancestors, and I will fight for the rights of those who are being targeted, primarily the LGBT community, but anyone else, by the lawmakers and supporters of such laws.

That my friends is why I rejoice in the Supreme Court ruling in Obergfell v. Hodges. It is a step to moving forward in liberty and progress and away from barbarism.

A Great Day for Liberty for All

Today is a good day for freedom. It has been to long coming. The Supreme Court, citing the Fourteenth Amendment ruled in favor of Marriage Equality for Gays Lesbians and others in the LGBTQ community in the case of Obergfell v. Hodges. I am quite happy for my Gay and Lesbian friends  for this.

As historian and who has and continues to study the American Civil War, especially the fight for the abolition of slavery, the emancipation of African Americans and the extension of the the full benefits of citizenship and liberty.

As early as 1854 Lincoln posed the idea that the Declaration of Independence was the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.” 

The understanding that the liberties enunciated in the Declaration extend to first to African-Americans was made part of the Constitution in the Thirteenth, Fourteenth and Fifteenth Amendments to the Constitution. The precedent of Fourteenth Amendment has been used to grant Suffrage to Women, to end Jim Crow laws, Black Codes and Separate but Equal laws. Today it was correctly used to ensure that all people have the freedom to marry.

The ruling was about liberty, it was about equality, it was about due process, and today the Court’s majority noted:

The history of marriage as a union between two persons of the opposite sex marks the beginning of these cases. To the respond- ents, it would demean a timeless institution if marriage were extend- ed to same-sex couples. But the petitioners, far from seeking to devalue marriage, seek it for themselves because of their respect—and need—for its privileges and responsibilities, as illustrated by the petitioners’ own experiences.

The history of marriage is one of both continuity and change.

Changes, such as the decline of arranged marriages and the abandonment of the law of coverture, have worked deep transformations in the structure of marriage, affecting aspects of marriage once viewed as essential. These new insights have strengthened, not weakened, the institution. Changed understandings of marriage are characteristic of a Nation where new dimensions of freedom become apparent to new generations.

They also added:

The fundamental liberties protected by the Fourteenth Amendment’s Due Process Clause extend to certain personal choices central to individual dignity and autonomy, including intimate choic- es defining personal identity and beliefs.

Most of the opposition to Gay marriage and for that matter to all Gay Rights has been from conservative Christians. Sadly it was conservative Christians who have been in the forefront of denying liberty to people in the country since the beginning of the abolition movement in the 1830s. They labeled fellow evangelicals in the abolition movement as “atheists, infidels, communists, free-lovers, Bible-haters, and anti-Christian levelers.” 

This was not limited to Southern  conservative Christians.

The fact that so many Protestant ministers, intellectuals, and theologians, not only Southerners, but men like “Princeton’s venerable theologian Charles B. Hodge – supported the institution of slavery on biblical grounds, often dismissing abolitionists as liberal progressives who did not take the Bible seriously” leaves a troubling question over those who claim to oppose issues on supposedly Biblical grounds. Such men in the North spoke out for it “in order to protect and promote interests concomitant to slavery, namely biblical traditionalism, and social and theological authority.” [1] The Northern clerical defenders of slavery perceived the spread of abolitionist preaching as a threat, not just to slavery “but also to the very principle of social and ecclesiastical hierarchy.” [2]Alistair McGrath asks a very important question for modern Christians who might be tempted to support a position for the same reasons today, “Might not the same mistakes be made all over again, this time over another issue?” [3]

Throughout American history conservative Christians have often espoused a concept of limited liberty, liberty for the few and the powerful. This happened as I have noted during the fight against emancipation, but also Women’s Suffrage and the various Jim Crow laws and rights for other groups. This is happening again today with anti-Gay Christians attacking the ruling and like those who fought abolition proclaiming in apocalyptic language that Christians will be persecuted and that God will judge the United States for allowing Gays to marry.

However, the fact is that very little will change in the country, most people will move along. Christian conservatives will not be persecuted, religious liberties will not be violated they will be enhanced as churches who allow Gays to marry will be able to extend this rite of their churches to their parishioners and others.

Today, despite the cries of many on the American Religious Right liberty has been protected. as Lincoln said: the declaration’s promise of equality was “a beacon to guide” not only “the whole race of man then living” but “their children and their children’s children, and the countless myriads of generations who should inhabit the earth in other ages.” [4]

I am happy for my Gay friends who have labored for this for so long enduring hatred, violence and social, political, religious and economic discrimination for so many years.

Freedom for the Few: the Curse of Racism

I have been posting portions of my Civil War and Gettysburg Staff Ride text and in light of the act of terrorism committed in Charleston last Wednesday and the subsequent controversy surrounding the Confederate Battle Flag flying at full staff on the grounds of the South Carolina State Capitol while both the United States and South Carolina flags flew at half-staff. I do plan on addressing the issue of the Confederate flag in a separate article but so often that flag is flow or displayed by people who proclaim the historical revisionism of the tradition of the Lost Cause. which asserts that the Civil War was about everything but slavery as truth. 

This section of the chapter on religion and ideology is important because it addresses the issue in a forthright manner. It is important to tell the truth about the key issue that brought about the Civil War, and why the display of the Confederate Battle Flag only serves to propagate myth and instill a false sense of pride for a system and a war which cost more American lives than any other. 

If you take the time to read the article you will also notice that a number of the defenses of slavery are being used today to deny voting rights and other civil rights to American citizens by people who honestly believe that freedom is for the few. Many Right Wing pundits, politicians and preachers openly advocate this and even attempt to make voting and other civil functions which all citizens have the right are made more difficult or denied entirely. 

If you are curious as to where these people get their ideology look no further than the ante-bellum South.

The Impact of Slavery on the Growing Divide between North and South

Slavery was the key issue that permeated all aspects of the Civil War to include the cultural, the economic and the ideological. David M. Potter summed up this understanding of the connection between the ideological, cultural and economic aspects of the conflict and just how the issue of slavery connected all three realms in the American Civil War:

“These three explanations – cultural, economic and ideological – have long been the standard formulas for explaining the sectional conflict. Each has been defended as though it were necessarily incompatible with the other two. But culture, economic interest, and values may all reflect the same fundamental forces at work in a society, in which case each will appear as an aspect of the other. Diversity of culture may produce both diversity of interests and diversity of values. Further, the differences between a slaveholding and a nonslaveholding society would be reflected in all three aspects. Slavery represented an inescapable ethical question which precipitated a sharp conflict of values.” [1]

The political ends of the Civil War grew out of the growing cultural, economic, ideological and religious differences between the North and South that had been widening since the 1830s. However, slavery was the one issue which helped produce this conflict in values and it was “basic to the cultural divergence of the North and South, because it was inextricably fused into the key elements of southern life – the staple crop of the plantation system, the social and political ascendency of the planter class, the authoritarian system of social control.” [2] Without slavery and the Southern commitment to an economy based on slave labor, the southern economy would have most likely undergone a similar transformation as what happened in the North; thus the economic divergence between North and South would “been less clear cut, and would have not met in such head-on collision.” [3] But slavery was much more than an economic policy for Southerners; it was a key component of their religious, racial and philosophic worldview.

Freedom for the Few

The issue of slavery even divided the ante-bellum United States on what the words freedom and liberty meant. The dispute can be seen in the writings of many before the war, with each side emphasizing their particular understanding of these concepts. In the South, freedom was reserved for those who occupied the positions of economic power; slavery was key to that from not only an economic point of view but as a social philosophy. The concept of human equality, which was so much a part of the Declaration of Independence was downplayed George Fitzhugh, a planter and slave owner in eastern Virginia commented that that concept “is practically impossible, and directly conflicts with all government, all separate property, and all social existence.” [4]

The political philosophy such as Fitzhugh’s, which was quite common, was buttressed by a profound religious belief that it was the South’s God ordained mission to maintain and expand slavery. One Methodist preacher in his justification of slavery wrote, “God as he is infinitely wise, just and holy never could authorize the practice of moral evil. But God has authorized the practice of slavery, not only by bare permission of his providence, but by the express permission of his word.” [5] Buttressed by such scriptural arguments Southerners increasingly felt that they were the only people following God. The Northern abolitionists as well as those who advocated for the concept of human equality and free labor were heretics to be damned. As such the “South’s ideological isolation within an increasingly antislavery world was not a stigma or a source of guilt but a badge of righteousness and a foundation for national identity and pride.” [6]

Speaking of the necessity for slavery, as well as limitations on the equality of human beings no matter what their race or sex, Fitzhugh penned words that explained that human relationships were not to be seen in terms of individual liberty, “but in relations of strict domination and subordination. Successful societies were those whose members acknowledged their places within that hierarchy.” [7]

Fitzhugh was quite caustic when he discussed the real implications of his philosophy:

“We conclude that about nineteen out of twenty individuals have “a natural and inalienable right” to be taken care of and protected, to have guardians, trustees, husbands or masters; in other words they have a natural and inalienable right to be slaves. The one in twenty are clearly born or educated in some way fitted for command and liberty.” [8]

Fitzhugh’s chilling conclusion was summarized in the words “Liberty for the few – slavery in every form, for the mass.” [9]

But many Southerners, including many poor whites, especially the Yeoman farmers who were the backbone of the Southern populace did not see or understand the limitations that were placed on their own liberty by the slavery system and instead saw slavery as the guarantee of their economic freedom. John C. Calhoun said to the Senate in 1848 that “With us, the two great divisions of society are not the rich and poor, but white and black; and all of the former, the poor as well as the rich, belong to the upper class, and are respected and treated as equals.” [10] Calhoun’s racial distinction is important if we are to understand why poor whites would fight and die for a social and economic idea that did not benefit them or their families.

But it was Abraham Lincoln, who cut to the heart of the matter when he noted the difference between his understanding of liberty and that of Calhoun and others in the South who defended slavery and the privileges of the Southern oligarchs:

“We all declare for liberty” but “in using the same word we do not all mean the same thing. With some the word liberty may mean for each man to do as he pleases with himself and the product of his labor; while with others the same word may mean for some men to do as they please with other men and the product of other men’s labor.” [11]

The growing economic disparity between the Slave and Free states became more about the expansion of slavery in federal territories as disunion and war approached; for a number of often competing reasons. These differences, amplified by the issue of slavery led to the substitution of stereotypes of each other and had the “effect of changing men’s attitudes toward the disagreements which are always certain to arise in politics: ordinary, resolvable disputes were converted into questions of principle, involving rigid, unnegotiable dogma.” [12] The Charleston Mercury noted in 1858 “on the subject of slavery…the North and the South…are not only two peoples, but they are rival, hostile peoples.” [13]

This was driven both by the South’s insistence on both maintaining slavery where it was already legal and expanding it into new territories which was set against the vocal abolitionist movement. But Southern exponents of expanding slavery were fighting an even more powerful enemy than the abolitionists, who despite their vocal protests were not yet in a position to influence policy. They were now fighting Northern industrialists who were not as idealistic as the abolitionists who were much more concerned with “economic policy designed to secure Northern domination of Western lands than the initial step in a broad plan to end slavery.” [14]

This competition between the regions not only affected politics, it affected religion and culture. In the South it produced a growing culture of victimhood, which was manifest in the words of Robert Toombs who authored Georgia’s declaration of causes for secession:

“For twenty years past, the Abolitionists and their allies in the Northern states, have been engaged in constant efforts to subvert our institutions, and to excite insurrection and servile war among us…” whose “avowed purpose is to subject our society, subject us, not only to the loss of our property but the destruction of ourselves, our wives and our children, and the dissolution of our homes, our altars, and our firesides.” [15]

As the social, economic, cultural and religious differences between the two regions grew wider and the people of the South became ever more closed off from the North. “More than other Americans, Southerners developed a sectional identity outside the national mainstream. The Southern life style tended to contradict the national norm in ways that life styles of other sections did not.” [16]

The complex relationship of Southern society where “Southern bodies social, economic, intellectual, and political were decidedly commingled” [17] came to embrace the need for slavery and its importance to Southern society. This occurred despite the fact that the system did not benefit poor whites in the South and actually harmed them economically. The Southern: “system of subordination reached out still further to require a certain kind of society, one in which certain questions were not publically discussed. It must give blacks no hope of cultivating dissention among the whites. It must commit non slaveholders to the unquestioning support of racial subordination…. In short, the South became increasingly a closed society, distrustful of isms from outside and unsympathetic to dissenters. Such were the pervasive consequences of giving top priority to the maintenance of a system of racial subordination.” [18]

Silencing the Critics of Slavery 

Southern planters declared war on all critics of their “particular institution” beginning in the 1820s. As Northern abolitionists like William Lloyd Garrison and his newspaper The Liberator grew in its distribution and began to appear in the South various elected officials throughout the South “suppressed antislavery books, newspapers, lectures, and sermons and strove generally to deny critics of bondage access to any public forum.[19] Despite this resistance, abolitionists continued to use the U.S. Mail service to send their literature south provoking even more drastic action from Southern legislators.

In response to the proliferation of abolitionist literature in the South, John C. Calhoun proposed that Congress pass a law to prosecute “any postmaster who would “knowingly receive or put into the mail any pamphlet, newspaper, handbill, or any printed, written, or pictorial representation touching the subject of slavery.” [20] Calhoun was not alone as other members of Congress as well as state legislatures worked to restrict the import of what they considered subversive and dangerous literature.

Beginning in 1836 the House of Representatives, led by Southern members of Congress passed a “gag rule” for its members which “banned all petitions, memorials, resolutions, propositions, or papers related in any way or to any extent whatever to the subject of slavery.” [21] Former President John Quincy Adams challenged the gag-rule in 1842, as did a number of others. The pressure was such that finally in 1844 the House voted to rescind it.

However, Southern politicians were unhappy with this measure and “began to spout demands that the federal government and the Northern states issue assurances that the abolitionists would never be allowed to tamper with what John Calhoun had described as the South’s “peculiar domestic institution.” [22] As tensions grew between the regions, the issue of slavery more than any other issue “transformed political action from a process of accommodation to a mode of combat.” [23]

Around the same time as the gag rule was played out in Congress the Supreme Court had ruled that the Federal government alone “had jurisdiction where escaped slaves were concerned” which resulted in several states enacting “personal liberty laws” to “forbid their own elected officials from those pursuing fugitives.” Southern politicians at the federal and state levels reacted strongly to these moves, which they believed to be an assault on their institutions and their rights to their human property. Virginia legislators said these laws were a “disgusting and revolting exhibition of faithless and unconstitutional legislation.” [24]

The issue of slavery shaped political debate and “structured and polarized many random, unoriented points of conflict on which sectional interest diverged.” [25] As the divide grew leaders and people in both the North and the South began to react to the most distorted images of each other imaginable- “the North to an image of a southern world of lascivious and sadistic slave drivers; the South to the image of a northern world of cunning Yankee traders and radical abolitionists plotting slave insurrections.[26]

Court decisions on Civil Rights matter and sometime soon we will get the Supreme Court decision on the Case of Obergfell v. Hodges, the case that will determine if Marriage Equity will become the law of the land or not. Such cases are important. As I mentioned yesterday freedom for all matters and I completely agree with he words of Abraham Lincoln in regard to liberty that the words of the Declaration of Independence that “all men are created equal” is a universal standard. That it is the “the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.” This should be true for all, people including the LGBTQ community.

Since it matters so much I am posting a section from my Civil War and Gettysburg Staff Ride text on the Dred Scott decision. If you read it you will find just how chilling and similar the arguments of the Chief Justice of the Supreme Court Roger Taney are to those who oppose Marriage Equity and other rights being extended to Gay people.

As the 1850s wore on, the divisions over slavery became deeper and voices of moderation retreated. The trigger for the worsening of the division was the political battle regarding the expansion of slavery; even the status of free blacks in the north who were previously slaves, over whom their owners asserted their ownership. Southerners considered the network to help fugitive slaves escape to non-slave states, called the Underground Railroad “an affront to the slaveholders pride” and “anyone who helped a man or woman escape bondage was simply a thief” who had robbed them of their property and livelihood, as an “adult field hand could cost as much as $2000, the equivalent of a substantial house.” [1]

In 1856 the Supreme Court, dominated by southern Democrats ruled in favor of southern views in the Dred Scott decision, one pillar of which gave slavery the right to expand by denying to Congress the power to prohibit slavery in Federal territories. Taney’s ruling in the case insisted that “Neither the Declaration of Independence nor the Constitution had been intended to apply to blacks he said. Blacks were “so far inferior that they had no rights which the white man was bound to respect.” Taney did not stop with this but he declared the Missouri Compromise itself unconstitutional for “Congress had exceeded its authority when it forbade slavery in the territories by such legislation as the Missouri Compromise, for slaves were private property protected by the Constitution.” [2]

The decision was momentous, but the judicial fiat of Taney and his court majority was a disaster for the American people. It solved nothing and further divided the nation:

“In the South, for instance, it encouraged southern rights advocates to believe that their utmost demands were legitimatized by constitutional sanction and, therefore, to stiffen their insistence upon their “rights.” In the North, on the other hand, it strengthened a conviction that an aggressive slavocracy was conspiring to impose slavery upon the nation, and that any effort to reach an accommodation with such aggressors was futile. While strengthening the extremists, it cut the ground from under the moderates.” [3]

The decision in the case is frightening when one looks upon its tenor and implications. The majority opinion which was written by Chief Justice Roger Taney was chilling, not only in its views of race, but the fact that blacks were perpetually property without the rights of citizens. Taney wrote:

“Can a negro, whose ancestors were imported into this country, sold as slaves, become a member of the political community formed and brought into existence by the Constitution of the United States, and as such become entitled to all the rights, and privileges, and immunities, guaranteed by that instrument to the citizen?…It is absolutely certain that the African race were not included under the name of citizens of a state…and that they were not included, and were not intended to be included, under the word “citizens” in the Constitution, and therefore claim none of the rights and privileges which that instrument provides for and secures to citizens of the United States. On the contrary, they were at that time considered as a subordinate and inferior class of beings, who had been subjugated by the dominant race, and, whether emancipated or not, yet remain subject to their authority, and had no rights or privileges but those who held the power and the Government might choose to grant them” [4]

The effect of the ruling on individuals and the states was far reaching. “No territorial government in any federally administered territory had the authority to alter the status of a white citizen’s property, much less to take that property out of a citizen’s hands, without due process of law or as punishment for some crime.” [5] Free slaves were no longer safe, even in Free States, from the possibility of being returned to slavery, because they were considered property. The tens of thousands of free blacks in the South were effectively stripped of citizenship, and became vulnerable to either expulsion or re-enslavement, something that the legislatures in Virginia, North Carolina and Missouri debated in 1858. Likewise the decision cast doubt on the free status of every African American regardless of residence.” [6]

But the decision had been influenced by President-Elect James Buchanan’s secret intervention in the Supreme Court deliberations two weeks before his inauguration. Buchanan hoped by working with the Justices that he would save the Union from breaking apart by appeasing slave owners and catering to their agenda. “The president-elect wanted to know not only when, but if the Court would save the new administration and the Union from the issue of slavery in the territories. Would the judges thankfully declare the explosive subject out of bounds, for everyone who exerted federal power? The shattering question need never bother President Buchanan.” [7] In his inaugural address he attempted to camouflage his intervention and “declared that the Court’s decision, whatever it turned out to be, would settle the slavery issue forever.” [8]

But Buchanan was mistaken. The case made the situation even more volatile as it impaired “the power of Congress- a power which had remained intact to this time- to occupy the middle ground.” [9] Taney’s decision held that Congress “never had the right to limit slavery’s expansion, and that the Missouri Compromise had been null and void on the day of its formulation.” [10]

The Court’s decision “that a free negro was not a citizen and the decision that Congress could not exclude slavery from the territories were intensely repugnant to many people in the free states” [11] and it ignited a firestorm in the north where Republicans now led by Abraham Lincoln, decried the decision and southerners basked in their judicial victory. Southerners were exultant, the Richmond Enquirer wrote that the Court had destroyed “the foundation of the theory upon which their warfare has been waged against the institutions of the South.” [12] Northerners now quite rightly feared that an activist court would rule to deny their states the right to forbid slavery. As early as 1854 Lincoln posed the idea that the Declaration of Independence was the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.” [13]

After the Dred Scott decision Lincoln warned that the Declaration was being cheapened and diluted, he remained insistent on this point, he noted:

“Our Declaration of Independence was held sacred by all, and thought to include all” Lincoln declared, “but now, to aid in making the bondage of the Negro universal and eternal, it is assaulted, and sneered at, and construed, and hawked at, and torn, till, its framers could ride from their graves, they could not recognize it at all.” [14]

Lincoln attacked the decision noting that Taney “insists at great length that negroes were no part of the people who made, or for whom made, the declaration of Independence or the Constitution.” But as Doris Kearns Goodwin notes “in at least five states, black voters action on the ratification of the Constitution and were among the “We the People” by whom the Constitution was ordained and established.” Lincoln acknowledged that the founders “did not declare all men equal in all respects. They did not mean to say that all were equal in color, size, intellect, moral developments, or social capacity.” But they dis declare all men “equal in ‘certain inalienable rights, among which are life, liberty, and the pursuit of happiness.’…They meant simply to declare the right, so the enforcement of it might follow as circumstances permit.” [15]

Not only that, Lincoln asked the logical question regarding Taney’s judicial activism. Lincoln and other Republican leaders “noted that all slavery needed was one more Dred Scott decision that a state could not bar slavery and the objective of Slave Power to nationalize slavery would be accomplished.” [16] How long would it be, asked Abraham Lincoln, before the Court took the next logical step and ruled explicitly that the:

“Constitution of the United States does not permit a state to exclude slavery from its limits?” How far off was the day when “we shall lie down pleasantly thinking that the people of Missouri are on the verge of making their State free; and shall awake to the reality, instead, that the Supreme Court has made Illinois a slave State?” [17]

Lincoln discussed the ramification of the ruling for blacks, both slave and free:

“to aid in making the bondage of the Negro universal and eternal….All the powers of the earth seem rapidly combining against him. Mammon is after him; ambition follows, and philosophy follows, and the theology of the day is fast joining the cry. They have him in his prison house;…One after another they have closed the heavy doors upon him…and they stand musing as to what invention, in all the dominions of mind and matter, can be produced the impossibility of his escape more complete than it is.” [18]

Frederick Douglass noted that “Judge Taney can do many things…but he cannot…change the essential nature of things – making evil good, and good, evil.” [19]

Lincoln was not wrong in his assessment of the potential effects of the Dred Scott decision on Free States. State courts in free-states made decisions on the basis of Dred Scott that bode ill for blacks and cheered slave owners. In newly admitted California the state supreme court ominously “upheld a slaveowner’s right to retain his property contrary to the state’s constitution.” [20]

A similar decision by a New York Court was being used by slave-states to bring that issue to the Taney Court following Dred Scott. “In 1852 a New York judge upheld the freedom of eight slaves who had left their Virginia owner while in New York City on their way to Texas.” [21] The Dred Scott decision brought that case, Lemon v. The People back to the fore and “Virginia decided to take the case to the highest New York court (which upheld the law in 1860) and would have undoubtedly appealed it to Taney’s Supreme Court had not secession intervened.” [22] Even non-Republican parties such as the democrats could see the writing on the wall. The national publication of the Democratic Party, the Washington Union “announced that the clear implication of the Dred Scott decision was that all state laws prohibiting a citizen from another state, either permanently or temporarily, were unconstitutional.” [23]

Fiery Trials: Emancipation & Equality Today

Just a coupled of thoughts on this Sunday night. Like yesterday I have been spending a lot of time on my Civil War-Gettysburg Staff Ride text. I have been working on re-writing the chapter on ideology and religion as they related to the causes of the war, its conduct and its aftermath. One thing that caught my attention was something that I think is profoundly important today.

In December of 1862 as he spoke to Congress prior to the the signing of the Emancipation Proclamation Lincoln spoke these profound words:

“Fellow citizens, we cannot escape history….This fiery trial through which we pass, will light us down, in honor or dishonor, to the latest generation….In giving freedom to the slave, we assure freedom to the free – honorable alike in what we give, and what we preserve.”

His words in giving freedom to the slave, we assure freedom to the free are part of an understanding of freedom, especially Lincoln’s radical understanding that the Declaration of Independence actually meant what it said that “all men are created equal.” For Lincoln this meant African Americans, inlacing those that labored as slaves. Lincoln understood the Declaration in its most broad understanding, he saw it as a universal liberty. As early as 1854 Lincoln posed the idea that the Declaration of Independence was the standard maxim of free society …constantly spreading and deepening its influence,” ultimately applicable “to peoples of all colors everywhere.”

Today there are a lot of people, especially the loudly political preachers, pundits and politicians of the Christian right and their allies who are committed to rolling back the rights of blacks, but also of women, and to prevent Gays, Lesbians and others of the LGBTQ community from having any rights commensurate with their status as citizens. In many states we have seen the protections of the Voter’s Rights Act being eroded as state legislatures enact laws to restrict voting rights and make it more difficult for people to exercise their right to vote. State legislatures are enacting laws that allow people to discriminate against others based on “a sincerely held religious belief” and while those laws are targeted against Gays they are in many cases written so broadly that they will protect just about any form of discrimination based on religion, even by public officials in the conduct of their duties as happened in  North Carolina last week. 

That is why what Lincoln said as he was preparing to sign the Emancipation Proclamation matters today. When we give freedom to people, we protect the freedom of everyone, but that my friends is not how many people in the so-called Christian Right see it. For them it is their freedom to discriminate in God’s name, because they like the anointed lords of the Southern Aristocracy believe that it is God’s will for them to do this. Sounding like a Southern planter, preacher or politician of the 1850s the founder of the movement known and Christian Dominionism R.J. Rushdooney wrote: “One faith, one law and one standard of justice did not mean democracy. The heresy of democracy has since then worked havoc in church and state . . . Christianity and democracy are inevitably enemies.”

British Evangelical-Anglican theologian Alister McGrath notes how “the arguments used by the pro-slavery lobby represent a fascinating illustration and condemnation of how the Bible may be used to support a notion by reading the text within a rigid interpretive framework that forces predetermined conclusions to the text.”

That my friends are what we are dealing with today. There is a party of Christians who have tremendous political power who are using it for the most nefarious of purposes, using the law and the police power of the state to deny rights to others while preserving their own while claiming to be the victims of persecution, just as did Southern slaveholders in the 1830s to 1861.

So, that is all for the night. I expect to put out something related to this topic again tomorrow, perhaps a full section of the chapter on religion and ideology from my text.

ISIL, the Caliphate and Manifest Destiny: Two sides of the Same Coin

Today another section of my Gettysburg Staff Ride text, taken from the second introductory chapter which deals with how religion and ideology plays a huge role in conflict and how it was used during the American Civil War.  This section discusses how a people’s worldview is strongly linked to culture and religion. It deals with the rather uncomfortable truth that the Islamic concept of the Caliphate differs little from the American idea of Manifest Destiny, a concept which may have created our nation as we know it but in practice was as barbaric and dishonorable as nearly conquering power has ever done, in fact there are many on the political right in this country, especially the Christian Right who are apologists for what occurred in the past and who advocate more of the same now. 

This might be an uncomfortable read for some people, and I hope that is the case. Of course in no way am I condoning anything that the Islamic State is doing in its quest to create a Caliphate, that needs to be condemned and fought wherever possible, preferably by the people most affected by it, the Arabs. 

But the truth is, religiously based imperialism, be it Manifest Destiny or the Islamic State’s dream of a Caliphate are two sides of the same coin of evil.

One can never separate war and the means by which it is fought from its political ends. According to Clausewitz, war is an extension or continuation of politics. Of course Clausewitz understood the term politics or policy in the light of the concept of a “World View” or to use the German term Weltanschauung. The term is not limited to doctrine or party politics, but it encompasses the worldview of a people or culture. The world view is oft used by the political, media and religious leadership of countries and can be quite instrumental in the decision by a people to go to war; who they war against, their reasons for going to war, the means by which they fight the war, and the end state that they envision. This concept includes racial, religious, cultural, economic and social dimensions of a worldview.

One of the problems that modern Americans and Western Europeans have is that we tend to look at the world, particularly in terms of politics and policy, be it foreign or domestic, through a prism from which we cannot see the forest for the trees. We look at individual components of issues such as economic factors, military capabilities, existing political systems, diplomatic considerations and the way societies get information in isolation from each other. We dissect them, we analyze them, and we do a very good job in examining and evaluating each individual component; but we often do this without understanding the world view and ideological factors that link how a particular people, nation or party understand these components of policy.

Likewise policy makers tend to take any information they receive and interpret it through their own worldview. This is true even if they have no idea what their world-view is or how they came to it. Most often a worldview is absorbed over years. Barbara Tuchman wrote “When information is relayed to policy-makers, they respond in terms of what is already inside their heads and consequently make policy less to fit the facts than to fit the notions and intentions formed out of the mental baggage that has accumulated in their minds since childhood.” [1]

Policy makers often fail to see just how interconnected the most primal elements of the human experience are to the worldview of others as well as their own.

Because of this, many policy makers, be they military or civilian do not understand how critical the understanding of worldview is to designing effective polices. Likewise, many fail to see how the world view of others influence their application of economic, political, diplomatic and military power as well as the use and dissemination of information in their nation or culture. This is true no matter which religion or sect is involved, even if a people or nation is decidedly secular, or at least outwardly non-religious.

Perhaps this is because we do not want to admit that our Western culture itself is very much a product of primal religious beliefs which informed politics, philosophy, ethics, law, economics, views of race, and even the arts for nearly two millennia. Perhaps it is because we are justifiably appalled and maybe even embarrassed at the excesses and brutality of our ancestors in using religion to incite the faithful to war; to use race and religion justification to subjugate or exterminate peoples that they found to be less than human; or to punish and conquer heretics.

The United States Military made a belated attempt to address ideology, culture and religion in terms of counter-insurgency doctrine when it published the U.S. Army/Marine Counterinsurgency Manual. The discussion of these issues is limited to two pages that specifically deal with various extreme Moslem groups that use that religion as a pillar of their ideology, strategy and operations. But the analysis in the counterinsurgency manual of is limited because its focus is very general and focused at a tactical level.

Likewise the analysis of world view, ideology and religion in the counterinsurgency manual is done in an “us versus them” manner. While the manual encourages leaders to attempt to understand the cultural differences there is little in it to help leaders to understand why this understanding of religion and ideology is important at the strategic and operational levels of war.

Commendably, the manual discusses how terrorist and insurgent groups use ideology, which is frequently based on religion to create a narrative. The narrative often involves a significant amount of myth presented as history, both Al Qaida and ISIL use the idea of the Caliphate as a religious and political ideal to achieve, because for many Moslems the idea of the Caliphate “produces a positive image of the golden age of Islamic civilization.” [2]

But Islam is not the only religion to do this. Most Americans are blind as to how previous generations Americans have used the Christian religion and race as a theological tool to justify subjugating other peoples and how that impacts us today. Beginning with the “landing of the Mayflower Pilgrims, the notion that the British colonies in the New World had been founded with divine assistance, in order to fulfill a providential mission, was commonly accepted.[3] The idea that it was God’s will for White Protestant settlers to push west, conquer and settle the continent of North America crystalized in the term Manifest Destiny. This concept was what motivated Americans to move into lands claimed by Britain as well as those which belonged to Mexico. The fact that the lands belong to other nations “was a small matter…Because most Americans considered it their “manifest destiny” to absorb these regions into the United States.” [4] There was a hunger in the land for more and Congressman John L. O’Sullivan, the inventor of the phrase proclaimed “Yes, more, more, more!….More…till our national destiny is fulfilled and…the whole boundless continent is ours.” [5]

The issue came to a head when American settlers moved into Mexican territory in what is not Texas. The Mexican government allowed the settlers on the provision that they would become Catholic and swear allegiance to Mexico. The settlers did this but had no intention of honoring their word for they believed that their race and the Protestant religion they had denied to settle in Mexico “made them naturally superior to the mestizos – people of mixed Indian and European blood – who governed in the name of Mexico.” [6] This caused serious issues. Especially when the settlers, many of who were Southerners refused to give up their slaves when Mexico abolished slavery in 1829. The American colonists disregarded every agreement they had made with the Mexican government, they flouted the Catholic Church, and they refused to learn Spanish and refused to obey Mexican law. Eventually “their numbers dwarfed the tiny Mexican population of Texas.” [7]

One of the most prominent of the early settlers, Stephen Austin declared “for fifteen years, I have been laboring to Americanize Texas” noting that his enemies were a “population of Indians, Mexican and renegados, all mixed together, and all the natural enemies of white men and civilization.” [8] Eventually General Santa Anna attempted to seal the border between Texas and Louisiana to forestall the movement of any new settlers into the territory, but the move backfired and the Texans revolted and in the ensuing war secured their independence. The agreement pledged that Texas would remain an independent nation and not become part of the United States, but this agreement was broken as well and in 1845 Texas was admitted to the Union as a Slave State, furthering the cries of those advocating Manifest destiny for more. One Congressman asserted that:

“When God crowned American arms with success in the Revolution…he had not “designed the original States should be the only abode of liberty on earth. On the contrary, He only designed them as the great center from which civilization, religion, and liberty should radiate and radiate until the whole continent shall bask in their blessing.” [9]

The year after Texas joined the Union the administration of President James K. Polk provoked a war with Mexico which secured most of the rest of what we now know as the United States. In the process the Americans decided to violate treaties they had made with Native American tribes, and the “manifest destiny that represent hope for white Americans thus spelled doom for red Americans,” [10] and through war and disease the Americans decimated the Indian populations over the next fifty years.

A few voices were raised against the war with Mexico, former President John Quincy Adams said in the House of Representatives that in a war with Mexico “the banners of freedom will be the banners of Mexico; and your banners, I blush to speak the word, will be the banners of slavery.” [11] Abraham Lincoln doomed his reelection prospects in 1848 by condemn the war and criticizing President Polk. Alexander Stephens, a Southern Whig and later Vice President of the Confederacy assailed the President:

“The principle of waging war against a neighboring people to compel them to sale their country, is not only dishonorable, but disgraceful and infamous. What. Shall it be said that American honor aims at nothing higher than land…..never did I expect to live to see the day when the Executive of this country should announce that our honor was such a loathsome, beastly thing, that it could be satisfied with any achievements in arms, however brilliant and glorious, but must feed on the earth – gross, vile, dirt!” [12]

Walt Whitman prophetically noted that “the United States may conquer Mexico, but it will be as the man who swallows arsenic, which brings him down in turn. Mexico will poison us.” [13] Whitman would be proven right as it was the territorial acquisitions gained in the war with Mexico which lit the fuse which ignited the Civil War.

The deeply Christian and imperialist civil-religious concept of Manifest Destiny of can still be seen in pronouncements of some politicians, pundits and preachers who believe that that this is America’s mission in the world. Manifest Destiny is an essential element of the idea of American Exceptionalism which often has been the justification for much American foreign policy from the time of President McKinley. Former President George W. Bush alluded to this in his 2003 State of the Union Address, “that freedom is the right of every person and the future of every nation. The liberty we prize is not America’s gift to the world, it is God’s gift to humanity.” [14] Throughout the Bush presidency the idea that God undergirded the policy of the United States led to a mismatch of policy ends and the means to accomplish them. Former Israeli Ambassador to the U.S. and historian Michael Oren wrote:

“Not inadvertently did Bush describe the struggle against Islamic terror as a “crusade to rid the world of evildoers.” Along with this religious zeal, however, the president espoused the secular fervor of the neoconservatives…who preached the Middle East’s redemption through democracy. The merging of the sacred and the civic missions in Bush’s mind placed him firmly in the Wilsonian tradition. But the same faith that deflected Wilson from entering hostilities in the Middle East spurred Bush in favor of war.” [15]

Policy makers and military leaders must realize that if they want to understand how culture and religious ideology drive others to conquer, subjugate and terrorize in the name of God, they first have to understand how our ancestors did the same thing. It is only when they do that that they can understand that this behavior and use of ideology for such ends is much more universal and easier to understand.

If one wants to see how the use of this compulsion to conquer in the name of God in American by a national leader one needs to go no farther than to examine the process whereby President McKinley, himself a veteran of the Civil War, decided to annex the Philippine in 1898 following the defeat of the Spanish. That war against the Filipinos that we had helped liberate from Spanish rule saw some of the most bloodthirsty tactics employed in fighting the Filipino insurgents, who merely wanted independence. It was a stain on our national honor which of which Mark Twain wrote: “There must be two Americas: one that sets the captive free, and one that takes a once-captive’s new freedom away from him, and picks a quarrel with him with nothing to found it on; then kills him to get his land. . .” [16]

A doubtlessly sincere McKinley sought counsel from God about whether he should annex the Philippines or not.

“He went down on his knees, according to his own account, and “prayed to Almighty God for light and guidance.” He was accordingly guided to conclude “that there was nothing left to do for us but to take them all, and to educate the Filipinos. And uplift and civilize and Christianize them, by God’s grace to do the very best we could by them, as our fellowmen for whom Christ died.” [17]

On the positive side the counterinsurgency manual does mention how “Ideology provides a prism, including a vocabulary and analytical categories, through which followers perceive their situation.” [18] But again it does so at a micro-level and the lessons of it are not applied at the higher levels of strategic thinking and policy. This is often due to the fact that American and other Western policy makers “as a set of theological issues rather than as a profoundly political influence in public life.” [19] Even after nearly a decade and a half of unremitting war against enemies for whom religion is at the center of their politics policy makers still misread or neglect the importance of religion and religiously based ideology in the political motivations of their opponents. In many cases the religion of a people is stronger part of their identity than that of the state. Nations which were created during the post-colonial era “continue to see religion, clan, ethnicity, and other such factors as the markers of community identity.” [20]

Thus when faced with cultures for which religion provides the adhesive which binds each of these elements, such as the Islamic State or ISIL we attempt to deal with each element separately, as if they have no connection to each other. But that is where we err, for even if the religious cause or belief has little grounding in fact, science or logic, and may be the result of a culture’s attempt to seize upon mythology to build a new reality, it is, in the words of Reggie Jackson the “straw that stirs the drink” and to ignore or minimize it is to doom our efforts to combat its proponents.

Perhaps that is because people do not like to look at themselves and their own history in the mirror. People tend to be uncomfortable when the face that they see in the mirror is face too similar to those they oppose, especially those who are perfectly willing to commit genocide in the name of their God. It really does not matter if one holds a predominantly secularist worldview and lives a secular lifestyle, or if one is religious yet embarrassed by the religiously motivated criminal actions of their forefathers, the result is strikingly and tragically similar; it makes them blind to the religious motivations of others and causes them to misread events in often tragic ways.

Lincoln and the Importance of Civilian Leadership

I am posting another section of the first chapter of my Gettysburg text tonight. It is about the importance of civilian leadership in regard to the military and the importance of not just relying on military power to win wars. The American Civil War gives us a good example of civilian leaders who grasped both of these elements of leadership and national power. Of course the article is just a part of a text that goes into a lot more depth on both subjects., but it is a part of the introductory chapter. 

I expect that I will be writing about the three latest attacks on the LGBT community by the governors of Texas, Michigan and the legislature of North Carolina which occurred today in the next couple of days. I am doing some more work on my Gettysburg test and the chapter dealing with religion, ideology and politics which dovetail nicely with these events, I just have to put everything together, and I would rather do it right than to do a half-assed job.

Abraham Lincoln

Over time the Union developed what we would now refer to as a “whole of government approach” to the war. This included not only the military instrument but the use of every imaginable means of national power, from the diplomatic, the economic and the informational aspects of the Union in the effort to subdue the Confederacy. The understanding and use of the “whole of government approach” to war and conflict is still a cornerstone of United States military policy in “unified action, to achieve leverage across different domains that will ensure conditions favorable to the U.S. and its allies will endure.” [1]

Over the United States Government and that of the Confederacy sat two men whose backgrounds were widely different, Abraham Lincoln and Jefferson Davis. Lincoln had no real military experience, training or background. Davis, seemed to be a man fully ready based on his background as a West Point graduate, Army officer and Secretary of War to be a wartime commander in chief. However, it was Lincoln who learned how to be an effective wartime leader, while Davis, despite his background floundered in that capacity. James McPherson notes that:

“In all five functions as commander in chief – policy, national strategy, military strategy, operations, and tactics – Lincoln’s conception and performance were dynamic rather than static. He oversaw the evolution of the war from one of limited ends with limited means to be a full-scale effort that destroyed the old Union and built a new and better one on its ashes.” [2]

Not only was Lincoln’s evolution in military affairs remarkable, but he had a far better grasp of people than his prickly Confederate counterpart. “Lincoln was more eloquent than Davis in expressing war aims, more successful in communicating with people, more skillful as a political leader in keeping factions together for the war effort, better able to work with his critics to achieve a common goal. Lincoln was flexible, pragmatic, with a sense of humor to smooth relationships and help him survive the stress of his job.” [3] On the other hand Davis was none of these. He had a hard time getting along with people, as was evidenced by the rate that he went through secretaries of war, five in four years and his bad relations with two of his premier generals, Joseph Johnston and P.T.G. Beauregard. Quarrelsome and disputatious, “Davis seemed to prefer winning an argument to winning the war; Lincoln was happy to lose an argument if it would help win the war.” [4] The example of Davis is ample evidence that just because someone has military experience does not mean that they are able to assume the duties of commander-in-chief.

Edwin Stanton

One of the key aspects of a successful whole of government approach to war, crisis and national emergency is effective civilian leadership at the cabinet level, especially the Secretary of State and the Secretary of Defense. In 1861 the later was split between Secretary of War, who headed the War Department and the Secretary of the Navy who headed the Department of the Navy. When he was elected Lincoln chose Simon Cameron as Secretary of War and Gideon Welles as Secretary of the Navy. Welles’s solid leadership of the Navy was never in question was both efficient and competent in managing the affairs of the rapidly expanding Navy.

However, Lincoln’s first Secretary of War, Simon Cameron was incompetent. Under Cameron the War Department lacked direction and within months was engulfed in controversy and charges of corruption and inefficiency. Though he was a skillful politician who “maintained his power base in Pennsylvania through the skillful use of patronage to reward loyalists and punish opponents” [5] Cameron was incompetent corrupt, and he was not equal to the task of managing the rapidly expanding war effort. Congress began to investigate and a number of Cameron’s political allies were found to have made great profits off of war contracts, which public funds had been wasted and the men who had volunteered to serve endangered. Lincoln and Secretary of State William Seward “agreed that Cameron should be removed and that Edwin Stanton – the diligent lawyer who had served as Seward’s window into the late Buchannan administration – would be a good successor.” [6]

Stanton and Lincoln’s relationship went back to an incident where the former, a very powerful and successful lawyer had humiliated Lincoln in Cincinnati before the Reaper lawsuit of 1855 where after a change of venue Stanton got Lincoln kicked off the case. It was an incident that Lincoln found humiliating, and that he vowed never to again return to Cincinnati. That being said, Lincoln had a keen appreciation for Stanton’s abilities. During the final days of the Buchannan administration it was Stanton as attorney general provided the intelligence that “had helped root out traitors and keep Washington safe from capture.” [7] Lincoln removed Cameron and as consolation sent him off to serve as Ambassador to Russia in St. Petersburg rather than humiliating Cameron, who still had a loyal base in Pennsylvania. Cameron’s reputation remained intact until the “House Committee on Contracts published its 1,100-page report in February 1862, detailing the extensive corruption in the War department that led to the purchasing of malfunctioning weapons, diseased horses, and rotten food.” [8] The act humiliated Cameron, and Lincoln took the unusual step of writing a long public letter to Congress to somewhat protect Cameron’s reputation by declaring that he and the entire cabinet “were at least equally responsible with [Cameron] for whatever error, wrong, or fault was committed.” [9] This was the first of many times where Lincoln chose to share the blame rather than further humiliate disgraced members of his administration, and it was a characteristic that

Cameron’s replacement as Secretary of War, Edwin Stanton was an entirely different type of man than Cameron. He was hard driving and ruthless in his pursuit of policies that would win the war. Stanton “drove himself as his staff of undersecretaries with maniacal fury and animation, auditing army contracts, reviewing and digesting military data for Lincoln’s use, intimidating army contractors, barking orders, and banging on his stand-up writing desk to make his point.” [10] Stanton’s brusque and brutally honest nature offended many people, but “he brought efficiency and integrity to the business of war contracts.” [11]

Likewise Stanton forced Union generals to adhere to administration policies, sacking those who were incompetent or recalcitrant and making a key change to the high command by replacing George McClellan as General-in-Chief with Major General Henry Wager Halleck. He also redefined the duties of the office making Halleck an advisor to the administration and liaison with the armies in the field. Halleck was perfectly suited to this position as “there was a need, in a civilian-run republic, fore a reliable and competent organizer who could serve as that kind of liaison  between the civilian leadership at the War Department and the military at the front.” [12] When Lincoln and Stanton brought in Ulysses Grant to serve as General-in Chief in March 1864, Halleck remained in Washington where he continued his staff and liaison work allowing Grant to command the armies in the field.

Stanton tolerated no inefficiency and immediately went to work to clear out corrupt officials and deny office seekers whose only claim to office was the patronage of elected officials or even their families. He denied one such man who came with the recommendation of Mary Todd Lincoln and then paid her a visit. Stanton “told her that “in the midst of a great war for national existence,” his “first duty is to the people,” and his next duty is to protect your husband’s honor, and your own. If he appointed unqualified men simply to return favors, it would “strike as the very root of all confidence.” [13] Mrs. Lincoln agreed and never asked Stanton for such favors again.

Major General Montgomery Meigs 

The working staff of the Stanton and Halleck’s War Department developed rapidly. Major General Montgomery Meigs served as Quartermaster General and effectively coordinated with railroads, weapons manufacturers and suppliers of clothing, food and other necessities to supply the army and navy so well that Union forces never lacked for what they needed to win the war. Like Stanton, Meigs was incorruptible and unlike Cameron, “a congressional audit could not find so much as one penny unaccounted for in any major contract authorized by Meigs.” [14]

Stanton and Meigs were “aided by the entrepreneurial talent of northern businessmen” which allowed that “the Union developed a superior managerial talent to mobilize and organize the North’s greater resources for victory in the modern industrialized conflict that the Civil War became.” [15] The other two major players in the War department were Commissary General Joseph P. Taylor and Chief of Ordnance James Wolfe Ripley. Neither man had the same talent as Meigs, but both turned into excellent administrators who ensured that Union forces always had ample supplies of provisions, weapons and ammunition.

The Confederacy never achieved anything like this, with the exception of his Chief of Ordnance, Josiah Gorgas the men in charge of ensuring that the Confederate armies had adequate supplies of food, clothing and equipment were inept, incompetent and utterly incapable of running a way.

The understanding of this eternal nature and ever changing character of war to leaders of nations as well as military commanders and planners has been very important throughout history. It can be seen in the ways that Jefferson Davis and Abraham Lincoln conducted the war. Lincoln, though he did not have the previous military experience of Davis, was the better learner and leader who came to understand the nature of modern war, including its logistic, political and diplomatic, and social-cultural contexts.

The contrast between Lincoln and Davis “directs attention to the difficulties of translating political judgment into effective warmaking.” [16] As such military leaders, understanding their relationship with the civil government should be the people to advise and instruct policy makers in aligning their policies to what is actually feasible based on the ends ways and means, as well as the strengths and limitations of the military to carry out policy decisions. History reminds us “that policymakers committed strongly to their political desires are not easily deflected by military advice of a kind that they do not want to hear.” [17] Too many times in history military leaders for many reasons have failed to raise their voice and to speak unpleasant truths regarding what is possible and what is not, often with catastrophic results for their nations. Likewise political leaders bent upon their own goals, even those goals that are at odds with their nation’s interests can ensure that their nation ends up on the ash heap up history.

The First Modern War – Introduction

Those who are habitual readers here know that I teach military history and ethics. One of the things that I lead is a Staff Ride at Gettysburg for which I am in the process of writing a text which will probably when I am done will be two, maybe even three books. The text is massive and I have been done a lot of editing, revising and even expanding it as I come to realize just how limited my previous vision was for producing it.

I have been writing about the pursuit of truth for several months, and one of those truths is that war cannot be separated from its contexts and that military power alone does not win wars or establish a just and equitable peace. That is one of the problems with many who write popular military history, they are so focused on the battles, campaigns, tactics and technology that they focus so much on the military aspects, that the miss the other contexts that are so important.

A few days ago I released a section of this same chapter dealing with women in the Civil War. Today is the introduction to that chapter, appropriately titled “The First Modern War.” It deals with the political, social-cultural, economic, technological, military strategic, geographical, and historical contexts of the war and introduces us to the importance of capable and competent civilian leadership as was exhibited by Lincoln and his advisers; and that how that knowing understanding the contexts keeps leaders from seeking short-cuts from the snake oil salesmen who promise a “silver bullet” with which all war can be won.

I’ll be releasing the second section of this chapter dealing with the importance of civilian leadership either tomorrow or Wednesday because I need to get my opinion piece that deals with the Duggaring of the Religious Right.

The American Civil War was the first modern war. It was a watershed event in an era, which introduced changes in new types of weapons, more lethal versions of older weapons, tactics, army organization, logistics, intelligence and communications. Though the war did not change the essential nature of war, which Clausewitz says is “is an act of violence to compel our opponent to fulfill our will” [1] it expanded the parameters of war and re-introduced the concept of “total war” to the world and “because its aim was all embracing, the war was to be absolute in character.” [2] In a sense it was a true revolution in military affairs.

The Civil War was truly a revolution in military affairs. The war changed the character of war, as it had been known for centuries, since the Peace of Westphalia and the end of the Thirty Years War. In the American Civil War, the character of war changed from a limited war waged between opposing armies to a total war, waged between two people who shared much in common but were divided by an ideology which encompassed politics, economics, society, law, and even religion.

The war was revolutionary in other ways, and brought about a host of social, philosophical, economic, and political changes which continue to impact the lives of people in the United States and around the world even today. Some of these, especially those regarding the abolition of slavery and emancipation, as well as the beginnings of the Women’s Rights movement have had a ripple effect in matters of political and social equality for other previously disenfranchised groups of citizens. As one author noted “The Civil War uprooted institutions, transformed our politics, influenced social relationships of half a continent, and wrought changes that echo down the generations.” [3]

In a sense, when Abraham Lincoln proclaimed “a new birth of freedom” in his Gettysburg address it served as a watershed moment in American history because it brought to the forefront the understanding of Jefferson and the other signers of the Declaration of Independence that all men are created equal.

Thus it is important to study the Gettysburg campaign in the context of the Civil War because the campaign of 1863 in the east cannot be divorced from what was happening in the west at Vicksburg, nor the Union blockade, nor the diplomatic, economic and informational aspects of the war. Likewise the Gettysburg campaign cannot be separated from its relationship to the broader understanding of the nature and character of war. To do this one must examine the connection between them and policies made by political leaders; to include the relationship of political to military leaders, diplomats, the leaders of business and industry and not to be forgotten, the press and the people. Likewise we must understand the various contexts of war, to include the social, political, ideological and even the religious components of war, how they impacted Civil War leaders and why civilian policy makers and military leaders must understand them today.

While the essential nature of war remains constant, wars and the manner in which they are fought have changed in their character throughout history, and this distinction matters not only for military professionals, but also policy makers. The changing character of war was something that military leaders as well as policy makers struggled with during the American Civil War much as today’s military leaders and policy makers seek to understand the character of warfare today. British military theorist Colin Gray writes “Since the character of every war is unique in the details of its contexts (political, social-cultural, economic, technological, military strategic, geographical, and historical), the policymaker most probably will struggle of the warfare that is unleashed.” [4] That was not just an issue for Abraham Lincoln and Jefferson Davis, both of whom struggled with the nature of the war which had been unleashed, but it is one for our present political leaders, who as civilian politicians are “likely to be challenged by a deficient grasp of both the nature of war as well as its contemporary context-specific character.” [5]

In addition to being the first modern war, or maybe I should say, the first war of the Industrial Age, the Civil War became a “total war.” It was the product of both the massive number of technological advances which both preceded and occurred during it, in which the philosophical nature of the Industrial Revolution came to the fore. Likewise, the enmity of the two sides for one another which had been fostered by a half century of relentless and violent propaganda which ushered from the mouths of politicians, the press and even from the pulpit, even to the point of outright armed conflict and murder in “Bleeding Kansas” during the 1850s.

As a total war it became a war that was as close to Clausewitz’s understanding of absolute war in its in character waged on the American continent, and it prefigured the great ideological wars of the twentieth century, as J.F.C. Fuller noted “for the first time in modern history the aim of war became not only the destruction of the enemy’s armed forces, but also of their foundations- his entire political, social and economic order.” [6] It was the first war where at least some of the commanders, especially Ulysses S. Grant and William Tecumseh Sherman were men of the Industrial Age, in their thought and in the way that they waged war, in strategy, tactics even more importantly, psychologically. Fuller wrote:

“Spiritually and morally they belonged to the age of the Industrial Revolution. Their guiding principle was that of the machine which was fashioning them, namely, efficiency. And as efficiency is governed by a single end- that every means is justified- no moral or spiritual conceptions of traditional behavior must stand in its way.” [7]

Both men realized in early 1864 that “the South was indeed a nation in arms and that the common European practice of having standing armies engaged each other in set-piece battles to determine the outcome of a war was not enough to win this struggle.” [8] Though neither man was a student of Clausewitz, their method of waging war was in agreement with the Prussian who wrote that “the fighting forces must be destroyed; that is, they must be put in such a position that they can no longer carry on the fight” but also that “the animosity and the reciprocal effects of hostile elements, cannot be considered to have ended so long as the enemy’s will has not been broken.” [9]

William Tecumseh Sherman told the mayor of Atlanta after ordering the civilian population expelled that “we are not only fighting hostile armies, but a hostile people, and must make the old and young, the rich and poor, feel the hard hand of war.” [10] Sherman was one of the first American military leaders to understand that a civil war could not be waged according to the limited war doctrines most American officers had been taught. He not only “carried on war against the enemy’s resources more extensively and systematically than anyone else had done, but he developed also a deliberate strategy of terror directed against the enemy’s minds.” [11] While some might find this troubling, the fact remains that it was Sherman’s Southern sweep of all that lay before him that broke the back of the Confederacy.

Abraham Lincoln came to embrace the eternal nature of war as well as the change in the character of the war over time. Lincoln had gone to war for the preservation of the Union, something that for him was almost spiritual in nature, as is evidenced by the language he used in both of his inaugural addresses and the Gettysburg Address. Instead of a war to re-unite the Union with the Emancipation Proclamation the war became a war for the liberation of enslaved African Americans, After January 1st 1863 when the Emancipation Proclamation went into effect, Lincoln “told an official of the Interior Department, “the character of the war will be changed. It will be one of subjugation…The [old] South is to be destroyed and replaced by new propositions and ideas.” [12] That too was a modern understanding of war.

Of course, the revolution in military affairs that characterized the Civil War took time, but it was the political and military leaders of the North who better adapted themselves and their nation to the kind of war that was being fought. “Lincoln’s remarkable abilities gave him a wide edge over Davis as a war leader, while in Grant and Sherman the North acquired commanders with a concept of total war and the determination to make it succeed.” [13]

At the beginning of the war the leaders and populace of both sides still held a romantic idea of war. The belief that the war would be over in a few months and that would be settled by a few decisive battles was held by most, including many military officers on both sides. There were some naysayers like the venerable and rather corpulent General Winfield Scott, but politicians and the press mocked Scott and those who even suggested that the war would be long, hard, and bloody. Of course those who predicted a short, easy, and relatively bloodless war who were proven wrong, and the war became the bloodiest war ever waged by Americans, and it was against other Americans.

The Civil War became an archetype of the wars of the twentieth century, and I believe will be so for the twenty-first century as well because of the emphasis on competing ideologies often buttressed with near fanatical religious extremism. The American Civil War evolved into a clash between peoples with radically different ideologies, which extended beyond the province of purely military action. The war “was preceded by years of violent propaganda, which long before the war had obliterated all sense of moderation, and awakened in the contending parties the primitive spirit of tribal fanaticism.” [14]

Those who conducted the American Civil War added new dimensions to war, and the technology they embraced increased war’s lethality in ways that they did not anticipate. For the first time since the 30 Years’ War, this war on the American continent saw opponents intentionally target the property, homes and businesses of the opposing civilian populations as part of their military campaign. The Civil War was a precursor to the wars that followed, especially the First World War that it prefigured in so many ways.

British general and military theorist J.F.C. Fuller encapsulated the massive amount of change brought about by the Civil War quite well in his book A Military History of the Modern World:

The war fought by Grant and Lee, Sherman and Johnston, and others closely resembled the First of the World Wars. No other war, not even the Russo-Japanese War of 1904-1905, offers so exact a parallel. It was a war of rifle bullets and trenches, of slashings, abattis, and even of wire entanglements- an obstacle the Confederates called “a devilish contrivance which none but a Yankee could devise” because at Drewry’s Bluff they had been trapped in them and slaughtered like partridges.” It was a war of astonishing in its modernity, with wooden wire-bound mortars hand and winged grenades, rockets, and many forms of booby traps. Magazine rifles and Requa’s machine guns were introduced and balloons were used by both sides although the confederates did not think much of them. Explosive bullets are mentioned and also a flame projector, and in June, 1864, General Pendleton asked the chief ordnance officer at Richmond whether he could supply him with “stink-shells” which would give off “offensive gases” and cause “suffocating effect.” The answer he got was “stink-shells, none on hand; don’t keep them; will make them if ordered.” Nor did modernity end there; armoured ships, armoured trains, land mines and torpedoes were used. A submarine was built by Horace H. Hundley at Mobile….” [15]

However, like all in nearly all wars, the many lessons of the American Civil War were forgotten, or even worse, completely dismissed by military professionals in the United States as well as in Europe. Thus 50 years later during First World War, the governments Britain, France, Imperial Germany, Austria-Hungary and Imperial Russia wasted vast amounts of manpower and destroyed the flower of a generation because they did not heed the lessons of the Civil War. For that matter neither did General John Pershing, commander of the American Expeditionary Force who three and a half years after those countries destroyed the flower of their nation’s manhood and repeated all of their mistakes with the lives of American soldiers. Fuller noted:

“Had the nations of Europe studied the lessons of the Civil War and taken them to heart they could not in 1914-1918 have perpetuated the enormous tactical blunders of which that war bears record.” [16]

The lessons of the war are still relevant today. Despite vast advances in weaponry, technology and the distances with which force can be applied by opponents, war remains an act of violence to compel an enemy to fulfill our will. War according to Clausewitz is “more than a chameleon that slightly adapts its characteristics to the given case.” [17] but it is always characterized by the violence of its elements, the province of chance and its subordination to the political objective and as such forces political and military leaders as well as policy makers to wrestle with “the practical challenge of somehow mastering the challenge of strategy in an actual historical context.” [18]

Colin Gray in his book Fighting Talk emphasizes that the “contexts of war are all important.” Gray makes a case for seven essential contexts that must be understood by policy makers and military leaders regarding war, which if ignored or misunderstood “can have strong negative consequences.” [19] Gray enunciates seven contexts of war that policy makers as well as military professionals ignore at the own peril: There is the political context, the social context, the cultural context, the economic context; the military-strategic context, the geographic context and the historical context. Gray notes these seven contexts “define all the essential characteristics of a particular armed conflict.” [20]

Gray discusses the importance of this. Noting that strategists are “ever on the look out for shortcuts” [21] and because they are pragmatic, wanting simple and well defined solutions they tend not to want to deal with complexities that muddy the water, that those who decide on strategy are “eternally at hazard to the siren call of the technological solution, the cultural fix, the promise of historical understanding and so forth.” [22] He notes that there are always those trying to sell strategists catalogs, which promise “products that answer the strategist’s questions” turning “the base metal of confusion of information into the pure gold of comprehension.” [23] But such easy answers are often little more than snake oil. The virtue of seeing war through all of these contexts “obliges strategists to examine holistically, in the round,” [24] that the “recognition of war’s multiple contexts helps immunize the strategist against getting captured by such fantasies.” [25]

The study of the Civil War can be helpful to political leaders, military strategists, joint planners and commanders because it so wonderfully shows just how important understanding the context of wars is. Likewise it gives us an American context where we can see the interplay of how Clausewitz’s “paradoxical trinity- composed of primordial violence, hatred, and enmity, which are to be regarded as a blind natural force; of the play of chance and the element of subordination, as an instrument of policy, which makes it subject to reason alone.” [26]

This is especially important, because we live during an era of great technological, social, geopolitical and philosophical change, just as did the leaders of the United States and the Rebel Confederates States did in the ante-bellum and the war years. The importance of this cannot be underestimated, for in this era of change, like in every era, some leaders and commanders were either resistant to, or failed to understand the changes being forced upon them in their conduct of war by the industrialization of war and its attendant technology.

Examples of this are found in the actions of so many leaders and commanders in the Civil War. Like the American political and military leaders who in Iraq “were ignorant of how to conduct themselves in a military and social-cultural context of irregular warfare” [27] many of the officers who fought the Civil War completely ignorant of what they were facing. Educated in Napoleonic the principles of Henri Jomini, officers who only knew limited war in Mexico and irregular warfare against Indians were faced with fighting a total war on a continental scale. The war witnessed a host of new technologies and “many officers found themselves wholly unprepared for what they faced, in effect, compelled to purchase learning with lives.” [28]

However, unlike many political leaders, Abraham Lincoln came to understand the radical and revolutionary nature of the war and had to find military leaders who understood the same. In frustration Lincoln rebuked those who urged limited war saying “The government cannot much longer play a game in which it stakes all, and its enemies stake nothing. Those enemies must understand that they cannot experiment for ten years trying to destroy the government, then if the fail still come back into the Union unhurt.” [29]

Eventually Lincoln found Ulysses Grant and his lieutenants William Tecumseh Sherman and Philip Sheridan. These me not only understood the military aspects of the contexts of the war, but embraced them and applied them with ruthless skill and vigor that stunned the leaders and the people of the South. When John Bell Hood wrote Sherman a letter in which he condemned the Union commander for the destruction of Atlanta, and the forced evacuation of its inhabitants, even invoking God’s judgment Sherman would have nothing of it. Sherman wrote back that “Hood’s appeal to a “just God” was “sacrilegious,” Sherman insisted, for it was the South which had “plunged a nation into war, dark and cruel war, who dared and badgered us to battle.” Having created the war, the South would now experience it.” [30]

Strategists and planners must develop a philosophical foundation that they must seek to understand the contexts of war matters now more than ever. By looking at the Gettysburg campaign in context we can begin to draw lessons that we can apply today. Not that our situation is the same as the leaders who led the Union and Confederacy in the Civil War, but exploring these issues is vital to us understanding the contexts of the wars that we fight today and the world in which we live.

I Will Fight Them: John Reynolds at Gettysburg

This is another part of my Gettysburg text Chapter on John Reynolds. I have divided it up into three sections. The first was the biographic section, the second, published yesterday was about Kate Hewitt, the girl he left behind.  Today is an expanded version of what was the original chapter which focused almost exclusively on Reynolds’s and his actions at Gettysburg on the morning of July 1st 1863.

On the night of June 30th Reynolds was awash in reports, some of them conflicting and even though he was without Meade’s course of action for the next day “concluded that Lee’s army was close by and in force.” [1] He spent the night at his headquarters “studying the military situation with Howard and keeping in touch with army headquarters.” [2] Howard noted Reynolds anxiety and “received the impression that Reynolds was depressed.” [3] After Howard’s departure Reynolds took the opportunity to get a few hours of fitful sleep before arising again at 4 a.m. on July 1st.

When morning came, Reynolds was awakened by his aide Major William Riddle with Meade’s order to “advance the First and Eleventh Corps to Gettysburg.” [4] Reynolds studied the order and though he expected no battle that morning, expecting “only moving up to be in supporting distance to Buford” [5] took the prudent and reasonable precautions that his Confederate opponents A.P. Hill and Harry Heth refused to take as they prepared to move on Gettysburg.

His troops were in fine spirits that morning even though it had been busy. After a breakfast of hardtack, pork and coffee the troops moved out. An officer of the Iron Brigade noted that the soldiers of that brigade were “all in the highest spirits” while Lieutenant Colonel Rufus Dawes of the “placed the fifes and drums at the head of the Sixth Wisconsin and ordered the colors unfurled” as the proud veterans marched forward into the sound of the raging battle to the tune of “The Campbell’s are Coming.” [6]

Though Reynolds was not expecting a fight he organized his march in a manner that ensured if one did happen that he was fully prepared. The precautionary measures that he took were those that any prudent commander having knowledge that strong enemy forces were nearby would take. Reynolds certainly took to heart the words of Napoleon who said “A General should say to himself many times a day: If the hostile army were to make its appearance in front, on my right, or on my left, what should I do?” [7]

This was a question that A.P. Hill and Harry Heth seemed not to consider on that warm and muggy July morning when Heth was committing Lee’s army to battle on his own authority. Reynolds was also about to commit the Army of the Potomac to battle, but unlike Heth who had no authority to do so, Reynolds “had at least been delegated the authority for making such a decision” [8] by his army commander George Meade. Though Meade was unaware of what was transpiring in the hills beyond Gettysburg he implicitly trusted the judgement of Reynolds, and Meade been with the advanced elements of Reynold’s wing he too “probably would have endorsed any decision he made.” [9]

Reynolds placed himself with the lead division, that of Wadsworth, and “directed Doubleday to bring up the other divisions and guns of the First Corps and had ordered Howard’s Eleventh Corps up from Emmitsburg.” [10] Reynold’s also understood the urgency of the situation and “wanted all the fighting troops to be up front, so he instructed Howard not to intermingle his supply wagons with his infantry. Similar instructions had been given to Abner Doubleday; to ensure that the First Corps wagons would wait until the Eleventh Corps foot soldiers had passed.” [11]

Instead operating in the normal fashion of rotating units on the march, Reynolds opted to save time. Since Wadsworth’s First Division was further advanced than his other First Corps divisions, Reynolds instructed it to move out first with Cutler’s brigade in the lead followed by the Iron Brigade under Brigadier General Solomon Meredith. In doing so Reynolds countermanded the order of the acting corps commander Doubleday who had ordered Wadsworth’s division to allow the other divisions of First Corps to pass his before advancing. Reynolds told Wadsworth that Doubleday’s order “was a mistake and that I should move on directly.” [12]

He went forward with Wadsworth’s division and gave Doubleday his orders for the coming engagement. Doubleday later recalled that when Reynolds arrived to discuss the situation that Reynolds:

“read to me the various dispatches he had received from Meade and Buford, and told me that he should go at once forward with the leading division – that of Wadsworth – to aid the cavalry. He then instructed me to draw in my pickets, assemble the artillery and the remainder of the corps and join him as soon as possible. Having given me these orders, he rode off at the head of the column, and I never saw him again.” [13]

Reynolds ordered Howard’s Eleventh Corps to follow First Corps and according to Doubleday directed an aid of Howard to have Howard “bring his corps forward at once and form them on Cemetery Hill as a reserve.” [14] Howard received the order and since his troops were ready to move out “no time was lost in setting them in motion.” [15] While some writers believe that Reynolds directed Oliver Howard to prepare Cemetery Hill as a fallback position [16] there is more evidence that points to Howard selecting the that commanding hill himself. [17] Regardless of which is correct the result was that both Reynolds and Howard recognized the importance of the position and took action to secure it.

Likewise Reynolds ordered Sickles’ III Corps to come up from Emmitsburg where that corps had bivouacked the previous night. [18] Sickles had heard the guns in the distance that morning and sent his senior aide, Major Henry Tremain to find Reynolds. Reynolds told Tremain “Tell General Sickles I think he had better come up” but the order left Sickles in a quandary. He recalled “he spend an anxious hour deciding what to do” [19] for he had “been ordered by Meade to hold his position at Emmitsburg” [20] and Sickles sent another rider to Reynolds and awaited the response of his wing commander instead of immediately advancing to battle on 1 July and it would not be until after 3 P.M. that he would send his lead division to Gettysburg.

According to Doubleday Reynolds’s intention was “to fight the enemy as soon as I could meet him.” [21] Reynolds rode forward with some of his staff into the town as the infantry of the First Corps and the Eleventh Corps moved advanced. As they rode through the town Reynolds and his party were met by “a fleeing, badly frightened civilian, who gasped out the news that the cavalry was in a fight.” [22] When he came to the Lutheran Seminary he came across Buford. It was a defining moment of the Civil War, a moment that shaped the battle to come. It has been recounted many times and immortalized on screen in the movie Gettysburg, a time “when the entire battle would come down to a matter of minutes getting one place to another.” [23]

As the rough and tumble Kentuckian, Buford, and Reynolds, the dashing Pennsylvanian, discussed the situation they had to know that odd that they were facing. With close to 32,000 rebels from the four divisions of Hill’s and Ewell’s corps closing in from the west and the north and with only about 18,000 men of First Corps, Eleventh Corps and Buford’s cavalry division to meet them, the odds were not in his favor, but unlike other battles that the army of the Potomac faced, this time the army and its commanders were determined not to lose the battle and not to retreat and for the first time John Reynolds “led the advance” and for the first time in the war “might have some say about fighting.” [24]

Reynolds and Buford committed their eighteen thousand men against Lee’s thirty-two thousand in a meeting engagement that develop into a battle that would decide the outcome of Lee’s invasion. Likewise it was a battle for the very existence of the Union. Abner Doubleday noted the incontestable and eternal significance of the encounter to which Buford and Reynolds were committing the Army of the Potomac on July 1st 1863:

“The two armies about to contest on the perilous ridges of Gettysburg the possession of the Northern States, and the ultimate triumph of freedom or slavery….” [25]

Even though they understood that they were outmanned and outgunned by the advancing Confederates, both Buford and Reynolds knew that this was where the battle must be waged. It was here on this spot, for the ground gave them an advantage that they would not have elsewhere; but only if they could hold on long enough for the rest of the army to arrive. As Alan Nolan wrote: “this Pennsylvania ground – was defensible, and behind it, through the town, loomed Cemetery Hill, another natural point of defense if the battle at Seminary Ridge went against the Federals.” [26]

Reynolds vs. Heth July 1st

When John Buford saw Reynolds infantry advancing as the Confederates increased the pressure on his outnumbered cavalry, he remarked to a staff member “now we can hold this place.” [27] Buford was not mistaken, when Reynolds rode up to the scene of the battle on Seminary Ridge he greeted Buford, who was in the cupola of the seminary. He called out “What’s the matter John?” to which Buford replied “The devil’s to pay” before he came down to discuss the tactical situation with Reynolds. [28] Buford explained the situation noting that “I have come upon some regiments of infantry…they are in the woods…and I am unable to dislodge them.” [29]

Reynolds needed no other convincing. He asked Buford if he could hold and quickly sent off a number of messages. One officer wrote: “The Genl ordered Genl Buford to hold the enemy in check as long as possible, to keep them from getting into town and at the same time sent orders to Genl Sickles…& Genl Howard to come as fast as possible.” [30] Additionally, Reynolds sent a message to Meade stating: “The enemy are advancing in strong force. I fear they will get to the heights beyond the own before I can. I will fight them inch by inch, and if driven into the town, I will barricade the streets and hold them back as long as possible.” [31] He directed Major Weld of his staff to take it to Meade with all haste as Weld recalled: “with the greatest speed I could, no matter if I killed my horse.” [32] When Meade received the report he was concerned, but with great confidence in Reynolds’s ability he remarked “Good!…That is just like Reynolds; he will hold on to the bitter end.[33]

After dictating his instructions and sending off his messengers, Reynolds then did what no senior Confederate commander did during the entirety of the battle, he rode back and took personal charge of the movements of his troops to hurry them forward. Unlike Heth who so badly misjudged the tactical situation, he had taken note of the ground and recognized from Buford’s reports that “the Confederates were marching only on that single road and thus would not be able to push their forces to the front any faster than Reynolds could reach the battlefield with his First Corps divisions.” [34] It was a key observation on his part which again allowed him to make appropriate decisions as to how he shaped the battle.

Reynolds leadership at this point might be considered reckless by the standards of our day when senior commanders control battles from miles away with the help of real time intelligence and reporting, including live video feeds, or even the standards of the Second World War. But then in the Civil War a commander in combat could only really control the actions of troops that he could see and because of the time that it took to get messages to subordinate commanders, and the real possibility that verbal orders could be badly misinterpreted in the heat of battle.

Reynolds exercised command directing infantry formations into battle and assisting his artillery battery commanders in the placement of their guns. This was far different than the way that most senior Confederate leaders, including Lee, Longstreet, Hill and Ewell directed their units during the battle of Gettysburg. But such action such action was in keeping with Reynolds’s character, especially in the defense of his home state. Reynolds’ philosophy of command regarding volunteer troops was that they “were better led than driven” [35] and as such he led from the front and Abner Doubleday noted that Reynolds was “inflamed by at seeing the devastation of his native state, was most desirous of getting at the enemy as soon as possible.” [36]

“For God’s Sake Forward!” McPherson’s Ridge

John Reynolds recognized that time was of the essence if his forces were to hold the ground west of the town selected a shortcut around the town for First Corps. Those forces were directed across the fields near the Condori farm toward the back side of Seminary Ridge, with Reynolds’ staff helping to remove fences to speed the advance. [37] It was not an easy advance as the troops had to move across the farm fields at an oblique and have to “double-quick for a mile and a quarter in the thick humidity just to reach the seminary.” [38] One member of the corps recalled “I never saw men more willing to fight than they were at Gettysburg.” [39]

Recognizing that “after two full hours of fighting, Buford’s troopers” fighting on McPherson’s Ridge, were “at the limits of their endurance,” Reynolds ordered Wadsworth’s brigades “to bolster the cavalry and oppose the rebel infantry coming at them.” [40]

As troops arrived Reynolds directed them into position. He directed the artillery of Captain James Hall’s 2nd Maine Battery to McPherson’s Ridge instructing Hall “I desire you to damage their artillery to the greatest possible extent, and to keep their fire from our infantry until they are deployed….” [41]

The leading infantry of First Corps was Major General James Wadsworth’s understrength division containing just two brigades, just over 3000 soldiers, its losses from Chancellorsville not being made good and as the result of the loss of regiments discharged because their enlistments had expired. [42] Wadsworth was not a professional soldier, but like many generals on both sides was a political general who despite his lack of military experience was a natural leader of men. Wadsworth was “a vigorous white-haired old man who had been a well-to-do gentleman farmer in New York State before the war” [43] and he “had interrupted his service in the war to run for and lose his state’s governorship the preceding fall.” [44] He ran against the anti-war, anti-administration and frequently pro-Southern Copperhead Horatio Seymour, but he did not leave the army in order return to the state to mount a personal campaign “on the ground that it did not befit a soldier.” [45]

“What the gray haired general lacked in experience and skill, he compensated with a fighting spirit.” [46] Oliver Howard of Eleventh Corps said that Wadsworth was “always generous and a natural soldier” [47] and while Wadsworth was no professional but he performed admirably on July 1st 1863. Wadsworth was beloved by his men because he demonstrated true concern and care for their living conditions and training and on that morning Wadsworth was commanding his division leading it into action with “an old Revolutionary War saber in his hand.” [48] The gallant Wadsworth would be mortally wounded ten months later leading a division of Gouverneur Warren’s Fifth Corps in the opening engagements of the Wilderness. Secretary of the Navy Gideon Welles noted in his diary when Wadsworth died that Wadsworth “should, by right and fair-dealing, have been at this moment Governor of New York…No purer or single-minded patriot than Wadsworth has shown himself in this war. He left home and comforts and wealth to fight the battles of the Union.” [49]

With their gallant commander at their head the division may not have had much in force in the way of numbers, but the units of the division were “good ones,” composed of hardened combat veterans that went into battle with an eye to victory. In the van was Brigadier General Zylander Cutler’s brigade of New Yorkers and Pennsylvanians, the “celebrated Bucktails.” [50] When they were mustered into service the soldiers of the 13th Pennsylvania had adopted a “bucktail” attached to their service caps as a distinctive insignia, a practice that spread to other regiments of the brigade and for which the brigade became known throughout the army.

Cutler had spent much of his early life in Maine working in a number of fields and businesses. He made a fortune several times and lost it, first when his mill burned down, but he rebuilt his businesses and diversified and “as a leading businessman, Cutler was elected to the Maine senate, college trusteeships and a railroad directorship, but he was financially ruined by the panic of 1866 and moved to Milwaukee to start his career over again.” [51] The tough-minded Cutler had some previous military experience fighting Indians as a member of the Maine militia and was made Colonel of the 6th Wisconsin. Cutler was described by one of his soldiers as “being as “rugged as a wolf” and was “a tenacious fighter, a trait that endeared him to the tough-minded Gibbon.” [52] After Antietam Gibbon recommended Cutler for promotion to Brigadier General and command of the Iron Brigade, but Cutler had been wounded at the bloody Battle of Brawner’s Farm and Solomon Meredith gained a promotion and command of that celebrated brigade. However, in on November 29th 1862 having recuperated from his wounds Cutler was promoted to brigadier general and received command of his Bucktails in March of 1863. The brigade saw only minor action at Chancellorsville and Gettysburg would be the fierce brigadier’s first chance since being wounded to command in combat.

This fine brigade was followed by Brigadier General Solomon Meredith’s “Iron Brigade” composed of westerners in their distinctive black “Jefferson Davis” or “Hardie” hats. The brigade had been initially commanded by Major General John Gibbon, now commanding a division in Winfield Scott Hancock’s Second Corps. Gibbon turned the brigade into one of the finest in the army. At the Battle of Turner’s Gap on South Mountain during the Antietam campaign, the brigade earned its name.

After that bloody battle George McClellan exclaimed “They must be made of Iron!” and Hooker replied, “By the Eternal, they are iron! If you had seen them at Bull Run as I did, you would know them to be iron.” [53] In the fierce battle at South Mountain the brigade had lost over a quarter of its strength, but had gained a share of immortality among the ranks of the United States Army. “The Western soldiers immediately seized on this as their title, and the reputation of the brigade and its new name were soon broadcast around Federal campfires.” [54] The regiments of the brigade rivalled many Regular Army units in effectiveness and discipline and “the black hats became their trademark.” [55] Often committed to the fiercest battles the brigade had been decimated, but now along with the Bucktails it advanced up down Seminary Ridge and up the back side of McPherson’s Ridge. A member of an artillery battery who saw the Bucktails and the Iron Brigade advance recalled:

“No one…will ever again see those two brigades of Wadsworth’s Division – Cutler’s and the Iron Brigade – file by as they did that morning. The little creek made a depression in the road, with a gentle ascent on either side, so that from our point of view the column, as it came down the slope and up the other, had the effect of huge blue billows of men topped with a spray of shining steel, and the whole spectacle was calculated to give nerve to a man who never had one before.[56]

Reynolds directed Cutler’s Bucktails to proceed north of the Cashtown Pike and then “called the Iron Brigade into action on the south side” [57] leading the hearty Westerners himself. Reynolds directed then Wadsworth to take change of the action on the north side of the road while he looked after the left. [58] When Reynolds made that decision he made another. He ordered the 6th Wisconsin of the Iron Brigade into reserve, leaving the Iron Brigade a regiment short but giving him the advantage of having a ready reserve which “permitted them to take full advantage of their interior lines, shift their strength about, and apply it where most needed.” [59]

At about 10:30 the 2nd Wisconsin advanced into the woods Reynolds urged them forward: “Forward men, for God’s sake and drive those fellows out of those woods….” [60] As he looked around toward the seminary to see the progress of reinforcements, Reynolds was struck in the back of the neck by a bullet and fell dead. “Had it come a short time earlier, Reynolds’s death might have thrown the I Corps into fatal confusion.” [61] But Doubleday, who command now fell was up to the task on that sultry July morning.

Cutler’s brigade moved north and engaged Davis’ men near the railroad cut. Here the Cutler’s line was “hardly formed when it was struck by Davis’s Confederate brigade on its front and right flank.” [62] His troops were heavily outnumbered by the advancing Confederates and Davis’ troops initially had the upper hand. In a savage fight they inflicted massive casualties on Cutler’s regiments which outnumbered and being flanked were ordered to withdraw by Wadsworth in order to save them, with the exception of one regiment, the 147th New York nicknamed the Ploughboys which “did not get the order” [63] and though isolated held its ground, “with the support of a fresh six-gun battery whose gunners simply refused to quit.” [64] This was the 2nd Maine Battery under the command of Captain James Hall. Though caught in a cross fire of Rebel artillery and assailed by skirmishers Hall’s artillerymen gamely continued the fight withdrawing by sections, “fighting a close canister range and suffering severely.” [65] The New Yorkers and Hall’s battery battled the Mississippians and the “Ploughboys fell “like autumn leaves; the air was full of lead.” [66]

The inexperienced Davis and his green troops were buoyed by this “gratifying local success” [67] and attempted to exploit it. At this point the Confederates were fatigued by the long march and the fighting and the troops of the 2nd Mississippi and 55th North Carolina “were all jumbled together without regiment or company.” [68] Davis attempted to use the unfinished railroad cut “as cover for getting on the enemy’s flank without exposure.[69] It was a decision that Davis lived to regret. As his troops his units crowed into it, the two regiments of Cutler’s brigade south of the turnpike, the 14th Brooklyn and the 95th New York turned to meet them and were joined by the reserve regiment of the Iron Brigade, the 6nd Wisconsin under Lieutenant Colonel Rufus Dawes. Dawes ordered an immediate advance and called out to Major Edward Pye of the 95th “Let’s go for them Major.” The 6th Wisconsin and the New Yorkers took the Confederates in the flank with enfilade fire, “it was like shooting fish in a barrel.” [70] Dawes’ men slaughtered many of those unfortunate soldiers, and the battle soon became a hand to hand struggle as North Carolinians and Mississippians struggled with the Wisconsin men and New Yorkers.

The melee in and around the cut did not last long:

“for the Confederates were unable to resist their attackers….From the brow of the cut Dawes shouted down to the Confederates below him: “Where is the colonel of this regiment?” A Confederate field officer heard him and replied, “Who are you?” Dawes answered, “I command this regiment. Surrender or I will fire.” [71] Dawes’s men took over 200 prisoners, [72] and the battle flag of the 2nd Mississippi. [73]

The charge had last but minutes yet had shattered Joe Davis’s brigade. Davis was wholly unprepared for this reverse and signaled his forces to pull back convinced that “a heavy force was…moving rapidly to our right.” [74] However, the cost to the 6th Wisconsin was great, “Dawes estimated that 160 men of the 6th fell, not including the brigade guard, whose casualties he did not know.” [75]

Brigadier General Solomon Meredith’s Iron Brigade, which had been brought forward by Doubleday hit Archer’s brigade in the front in the woods on McPherson’s Ridge. Meredith was an unmarried North Carolina Quaker who had moved to Indiana in 1840 owning little more than the clothes that he was wearing. He became a farmer but found politics more to his liking and was elected as a county sheriff and to the state legislature. When the war came he was serving as the Clerk of Wayne County. Meredith, like so many volunteer officers on both sides owed much of his advancement in the army to his political connections. In Meredith’s case this was to Meredith’s friend Governor Oliver Morton. Critics of Meredith decried his appointment as Colonel of the 19th Indiana as “a damnable swindle.” [76] Yet Meredith commanded the regiment effectively and received command of the brigade in November 1862. John Gibbon, the regular officer who initially commanded the brigade was critical of Meredith’s appointment but the soldiers appreciated their kind, six-foot seven-inch tall commander who they affectionately knew as “Long Sol.” But despite the carping of his political enemies and the opposition of Gibbon, Meredith like so many others like him who, “extroverted and ambitious by nature, accustomed to asserting themselves, these men did the best that they could, for themselves and their responsibilities, and they somehow sufficed” [77] though they had no formal military training or experience.

As the Iron Brigade advanced toward McPherson’s Ridge and engaged the enemy, Doubleday “urged the men…to hold it all hazards.” Doubleday later wrote that the troops of the brigade, “full of enthusiasm and the memory of their past achievements they said to me proudly, “If we can’t hold it, where will you find men who can?” [78]

Animated by the leadership of Reynolds and now Doubleday they “rushed to the charge, struck successive heavy blows, outflanked and turned the enemy’s right, captured General Archer and a large portion of his brigade, and pursued the remainder across Willoughby Run.” [79] The effect was dramatic as the Iron Brigade overwhelmed Archer’s brigade, whose soldiers now realized they were facing “the first team.” Members of the Iron Brigade recalling the voices of Confederate soldiers exclaiming “Here are those damned black-hat fellers again…’Taint no militia-that’s the Army of the Potomac.” [80] As they attempted to withdraw they piled up at a fence near Willoughby Run and were hit in the flank by “a Michigan regiment that had worked its way around through the woods to the south.” [81] Archer’s Confederates were unable to resist the assault of the Iron Brigade, “Some fled; others threw down their arms and trembling asked where they should go, while others simply dropped their rifles and ducked through the Union formations to the Union rear.” [82]

As for their commander, Archer the ignominy only got worse. “A muscular Irish private in the 2nd Wisconsin ran forward and seized General Archer bodily and made a prisoner of him.” [83] Coddington wrote: “It was a bad moment for the Army of Northern Virginia, and Archer gained the unenviable distinction of being the first of its general officers to be captured after Lee took command.” [84] Doubleday, who knew Archer from the old army, wrote of meeting Archer after that very angry general after had been taken prisoner and roughed up by the aforementioned Private Maloney. Doubleday greeted his old comrade saying: “Archer! I’m glad to see you,” and reached out his hand to greet his friend, to which Archer replied “Well, I’m not glad to see you by a damn sight” and refused to shake Doubleday’s hand. [85]

With the Archer’s brigade whipped and Davis’s in flight Solomon Meredith pulled back the brigade and “was reforming his lines when a shell exploded near him.” [86] Meredith’s horse was killed and fell on him and the tall general was struck in the head by a shell fragment which fractured his skull and rendered him hors d ’combat for the rest of the battle.

Contrary to the reports of many of the Confederates involved, stating that they were outnumbered, some of which have achieved nearly mythic status in some accounts of the battle, the forces engaged were relatively evenly matched. [87] Clifford Dowdey says that the Iron Brigade “heavily outnumbered the one brigade they met. Archer’s….” [88] Such accounts are usually based on the reports of Heth and other confederate commanders. Heth in his after action report wrote that “Archer, encountered heavy masses in his front, and his gallant little brigade, after being almost surrounded by overwhelming forces in front and on both flanks, was forced back….” [89]

However, such was not the case. The reason for this repulse was not that the Union forces had “overwhelming forces” or “greatly superior numbers.” Instead the Archer’s brigade and the Iron Brigade were fairly evenly matched with Archer having about 1,130 men and the Iron Brigade 1,400 while Davis outnumbered Cutler nearly two to one having between 2,400 and 2,600 men in the battle to Cutler’s 1,300. [90]

Following the repulse of Archer and Davis’s brigades by Reynolds’s First Corps, Heth withdrew his badly mauled brigades back to Herr’s Ridge in order to reform them and bring up the brigades of Brockenbrough and Pettigrew before he could resume his attack. In his next assault he would also be supported by Pender’s fresh division which was now coming up.

Coddington notes that the outcome of the opening engagement came down to leadership and “the superior tactical skills of the Northern generals,” who “created a reserve force” with one regiment of the Iron Brigade which “permitted them to take full advantage of their interior lines, shift their strength about, and apply it where most needed.” [91] It was a “calculated risk,” for it assumed that the depleted Iron Brigade could handle Archer’s brigade effectively with only four of their five assigned regiments. [92] Again, even with the loss of Reynolds it was a case of Harry Heth being out-generaled, this time by Abner Doubleday. Heth “had not exercised the close field command by means of which Doubleday had won the brief, furious action.” [93]

The Death of Reynolds

Reynolds was dead, but the series of command decisions reached by Reynolds under the pressure of a meeting engagement “where neither side held an immediate advantage” [94] were critical to the army. Likewise, because he had effectively communicated his intent to his subordinate commanders they were able to continue the fight despite his death, and his superiors and successors were able to effectively continue the battle that he had initiated. When he went into action he had “barely a third of his corps available, and confronting a force of unknown size, he had put himself at the head of his troops to lead them in a vigorous attack.” [95]

Though shaken by Reynolds’ loss, the Union troops fought on at McPherson and Seminary Ridge under the command of Doubleday until the assault of Ewell on their left and the arrival of Pender’s fresh division forced them from their positions. However Reynolds’s death was a major blow for the Federal forces for it “removed from the equation the one person with enough vision and sense of purpose to manage this battle.” [96] Despite this Reynolds, by pushing forward with his troops on McPherson’s Ridge ensured that Howard was able to secure Cemetery Hill and Cemetery Ridge, without which Gettysburg would have been lost.

The contrast between Reynolds and his opponents was marked. Hill was ten miles away from the action. Heth was too far to the rear of his troops to direct their advance when they ran into trouble and did not begin to take control until after the brigades of Davis and Archer had staggered “back up the ravine, with Davis’s temporarily wrecked.” [97] In contrast to Heth, Reynolds “hurried to the front, where he was able to inspirit the defense and throw troops into the decisive zone.” [98] At every point in the brief encounter John Reynolds showed himself superior to his opponents as he directed the battle. “Dedicated to an aggressive forward defense in the vanguard of the entire Army of the Potomac, Reynolds, at the cost of his own life had blunted the Rebel thrust and bought valuable time that permitted the balance of Meade’s army to take possession of the coveted high ground….” [99]

Though he paid for his efforts with his life but his sacrifice was not in vain. Reynolds’s tactics “gave the First Corps room for maneuver in front of Gettysburg and upset General Hill’s timetable.” [100] Harry Hunt noted: “…by his promptitude and gallantry he had determined the decisive field of the war, and he opened brilliantly a battle which required three days of hard fighting to close with a victory.” [101]

In Flanders fields.

There is a poignant scene in the film The Longest Day in which Richard Burton, playing the wounded British Royal Air Force Flying Officer David Campbell looks at the body of a dead German soldier and says to an American paratrooper who is lost from his unit: 

“It’s funny isn’t it. He’s dead, I’m crippled, you’re lost. Suppose it’s always like that. I mean war.”

Back when the movie was filmed in the early 1960s there were still many World War II veterans around and the United States and most Western European nations still had some form of draft or conscription which ensured that most people still had some connection with the military. It’s not like that now. In the United States far these than 1% of the population is serving in the military, and this includes the National Guard and reserves. The numbers are similar throughout Western Europe. Those who have served in combat or even deployed to combat theaters are far fewer. As a result the people of the United States and Western Europe as a whole are so disconnected from military service, not to mention the terrible human cost that is war. As William Tecumseh Sherman said: War is Hell. 

I came back a different man from Iraq. It seems that for me with every passing year Memorial Day becomes more of a melancholy observance. It is a weekend and observance that I feel deeply having lost friends in war and served in Iraq as well as Operation Enduring Freedom. It is also a day in which I feel more and more disconnected from the vast majority of my fellow Americans. I don’t know, but just from my observation it seems that for most Americans the weekend serves as not much more than the end of the school year and the beginning of the summer holiday and vacation season.

Now I could be wrong, but it seems to me that for most Americans, the vast majority who have themselves never served a day in uniform and who have no more than a passing relationship with anyone who is either serving in our current wars or has served in any war, that war is at best a spectator sport.

This is an attitude that has been nurtured by our politicians of all parties, political pundits and preachers for decades. As a result there is a grave disconnect between the society at large and the men and women who serve in the military and in our wars.

To be fair I don’t think it is a matter of ordinary people not caring, not that at all. Many do and I am thankful to them. That being said there are many who though they say they support the troops find war to be some sort of sporting event where we send our heroes out to do battle against the enemies of freedom, while making no sacrifices themselves and even call military health care, retirement benefits and disability pensions “entitlement programs” which need to be reigned in. Yes, that is right. Send the volunteers to war and then abandon them. Sadly, with the exception of the end of World War Two, this is always how this nation has treated its veterans and their families.

The real fact of the matter is that the wars that we have fought since World War II have not been national affairs. If they were we would not be continually fighting wars that most people neither understand and which in many if not most cases we would be better off staying out of completely. That being said I am appreciative of those who do things to care for and honor our veterans, honor our fallen and do practical things for the survivors. There are some really wonderful people, many who have never served who do what they can for those who fight and die in or come back forever changed from these misbegotten and unpopular wars.

At the same time there are a lot of what I call War Porn addicts, especially the pundits, politicians and preachers who cannot get enough of war. As a Christian I hate to say that many of the worst of the war porn addicts are the supposedly Christian pundits, politicians and preachers who cannot seem to find enough new wars to get us involved in even as we struggle to deal with what is on our plate already. If you ask me these sons-of-bitches are traitors who do not love the troops, do not love this country and should be forced into the front line so they can see, smell and taste death.

What I find the most offensive are the war mongers and profiteers who have never served. I feel this way about those who did all that they could to avoid serving in the military and those who did the very minimum to satisfy outward appearances of service while avoiding anything difficult, especially deployment to combat zones. Of the latter I can think of five to six currently serving and very outspoken conservative members of the House of Representatives and the Senate that fit the description. I shan’t mention the members of the previous Presidential administration who through their outright lies caused the deaths of nearly 4500 American military personnel in Iraq. I speak about men who in their writings, their appearances on news networks and their think tanks and corporations that do nothing but profit off of war. Some are current or former politicians, others supposedly “academics” and others men who smell a profit in war.

I find such people to be loathsome and wonder how on Memorial Day weekend they can show their faces. But then they are rather shameless. Sometimes their actions make me wonder if the sacrifices made by those who serve are in vain. However, I strive to resist that and pray that our sacrifices will not be in vain. While they profit from war others pay the bill and it has always been this way. Marine Corps Major General Smedley Butler, a two time winner of the Congressional Medal of Honor wrote after World War One in his book War is a Racket:

“This bill renders a horrible accounting. Newly placed gravestones. Mangled bodies. Shattered minds. Broken hearts and homes. Economic instability. Depression and all of its attendant miseries. Back -breaking taxation for generations and generations. For a great many years as a soldier I had a suspicion that war was a racket; not only until I retired to civilian life did I fully realize it….”

Maybe I feel this way because I grew up in a military family where my dad was frequently deployed and served in Vietnam, a place where some of my friends fathers died, and because I have been in the military 32 years between the Army and the Navy. Maybe it is partly because I am a military historian, theologian, priest and chaplain who has seen the horrors of war and the wounds that remain for life in the bodies, minds and spirits of those that fight in them. I cannot speak of how my heart feels when I see young men and women, wounded in war, their lives forever changed bravely struggling to go on even as the war mongers, war profiteers and chicken-hawks profit off of their suffering. As I said before, these people are traitors and if I had my way we would drive them at bayonet point into the arms of the Islamic State so they can taste what war is all about. Maybe then these sons-of-bitches would think twice before sending another young American to die so they might make a profit.

So for me this is a rather melancholy time. A time where I struggle a time when I get so angry. That being said I also echo the words of Civil War Veteran and Supreme Court Justice Oliver Wendell Holmes who spoke these words in 1895:

“even if those who come after us are to forget all that we hold dear, and the future is to teach and kindle its children in ways as yet unrevealed, it is enough for us that this day is dear and sacred…. nevertheless, the generation that carried on the war has been set apart by its experience. Through our great good fortune, in our youth our hearts were touched with fire. It was given to us to learn at the outset that life is a profound and passionate thing. While we are permitted to scorn nothing but indifference, and do not pretend to undervalue the worldly rewards of ambition, we have seen with our own eyes, beyond and above the gold fields, the snowy heights of honor, and it is for us to bear the report to those who come after us.”

I honor the fallen, my brothers and sisters who have given the last full measure of devotion in serving this country, those that I know personally or have served with and those who did so before I was every born. Why you might ask? 

The reason is simple and I think that Abraham Lincoln said it best as he closed his Gettysburg Address:

“It is for us the living, rather, to be dedicated here to the unfinished work which they who fought here have thus far so nobly advanced. It is rather for us to be here dedicated to the great task remaining before us — that from these honored dead we take increased devotion to that cause for which they gave the last full measure of devotion — that we here highly resolve that these dead shall not have died in vain — that this nation, under God, shall have a new birth of freedom — and that government of the people, by the people, for the people, shall not perish from the earth.”
